Veteran politician William Ronkorua ole Ntimama (pictured) is dead. Family and police sources said he died at his Melili home in Narok County last night after suffering a short illness. Narok County Police Commander Jillo Galgalo said the former cabinet minister had over the last one month been receiving treatment for the illness from his home. “It is true we can confirm that Ole Ntimama is dead,” he said. “We were called to the home by the family and the reports we have is that he died from natural causes,” added the police boss. His body has been transported to the Lee Funeral home in Nairobi where politicians trooped early today view his remains. He was aged 86. Former Cabinet secretary Joseph ole Lenku said Mr Ntimama’s death is a blow to the Maasai community and the country. “We woke up this morning to the sad news that our father and hero has passed on; as a nation and as a people, this is a very big blow,” he said. Although he announced his retirement from active politics in September 2013 after losing his Narok North parliamentary seat to Koitalel ole Kenta in the last general election, he has remained an influential figure in Maasailand politics and was even present at
State House, Nairobi about two weeks ago when he took some of his committee members to join the ruling Jubilee alliance. He remained the de-facto leader of the Maasai whose rights he passionately championed for more employment opportunities and land ownership. Before his retirement, Ntimama was engaged in the political arena for a little more than three decades. “Even though I have retired from active politics that does not mean that I have to keep mum on development issues. I must also contribute to matters of national importance,” he said in 2013. Ntimama served as Narok North MP for 25 years after ousting the then minister in the Office of the President Justus ole Tipis in 1988. He was former President Daniel Moi’s right hand man until Moi retired in 2003. Mr Ntimama served as chairman of
the Narok County Council for 15 years before he joined parliament and was subsequently appointed minister. After Moi left power in 2003, Ntimama became a staunch supporter of opposition leader Raila Odinga in the 9th and 10th Parliament. He was later appointed Cabinet minister for National Heritage and Culture in Grand National government led by retired president Mwai Kibaki and Raila Odinga as Prime Minister. On March 16, 2014, he decamped from ODM to join President Uhuru Kenyatta’s The National Alliance (TNA) party. In July this year, he led a delegation from Narok and Laikipia counties to announce that they are prepared to join the Jubilee Party at a function at State House Nairobi. @hillary_x254
Uhuru leads the nation in mourning ex-minister President Uhuru Kenyatta today led the nation in mourning the death of veteran politician and former cabinet minister William ole Ntimama who paased away at his rural home in Narok. The President in his message of condolence to the family recalled Ntimama as a great leader who devoted his time and life to the service of the nation. He praised the former Narok North MP as a man with an unwavering loyalty whose service was exemplary and selfevident. “His devotion to our national cause and values will forever remain etched in our minds, Indeed, Kenyans will always be grateful for the crucial role Hon. Ntimama particularly played in our independence struggle,” President Kenyatta. Cord leader Raila Odinga also mourned

Rest in peace Mzee Ntimama” Odinga said in a statement. Deputy President William Ruto said he learned of Mr Ntimama’s death with great sorrow. “I have learned of the passing on of former Cabinet Min. William ole Ntimama with sorrow & sadness. I pray that God will comfort his family,” he tweeted. Cabinet Secretaries Amina Mohamed and Eugene Wamalwa also sent their condolences. “To the family of former Cabinet Minister William ole Ntimama, my heartfelt sympathies on the passing on of the patriarch, a resolute leader,” Ms Mohamed said.

Maasai leaders have described the death of former Cabinet Minister William ole Ntimama as a big blow to the community he has defended all through his political career. Among the leaders who accompanied the body along with his family to the Lee Funeral Home was former Interior Cabinet Secretary Joseph ole Lenku, who described Ntimama as his mentor. “We woke up this morning to the sad news that our father and hero has passed on; as a nation and as a people, this is a very big blow,” he said. “I would like our people to reflect on the role mzee played to make us one people and a proud one at that regardless of the boundaries that exist between our people.” Lenku said he was inspired to joining politics by Ntimama, who also used to give him wise counsel during his turbulent moments at the Interior Ministry. “He is a dear person to me as a friend,” he said. The former minister even revealed that he had a meeting with Ntimama a few months ago, where he was urged to spread the message of unity even as he kicks off his political career. Another former Cabinet Minister Julius Sunkuli who also spoke at the mortuary
says the country has lost a great leader at a crucial time when the country is headed to elections. “Ntimama has been a strong politician and a Maasai leader of all seasons. We were in Parliament with him for a period of 10 years,” he stated. “He has been quite resolute in the fight of Maasai people and a father figure.” Former Transport Licensing Board Chairman Hassan ole Kamwaro recalled how he had a hearty conversation with Ntimama on Thursday evening and that they were meant to attend a fundraiser on Friday. “Yesterday at 5pm, he called me while
I was attending the memorial of Mzee Nyachae’s wife where he asked to pass my condolences. He was in a jovial mood,” a visibly sad Kwamwaro said. “I was shocked when we got the news that he is no more. Today he was supposed to have a Harambee. We are sad that we have lost him.” Ntimama aged 86 died peacefully in his sleep at his rural home in Narok County. Report reveals massive corruption at entry points Various points of entry into the country including airports have massive loopholes abetting corruption, a new report by the Ethics and AntiCorruption Commission (EACC) released today says. The report conducted between March and May this year found that there is lack of coordination among various agencies at the entry points of the country thereby providing room for corruption to thrive. Speaking during the launch of the report at Kenyatta International Convention Centre (KICC) today, director of preventive services at EACC Vincent Okong’o said there are overlapping mandates of various agencies at the airport, a situation he said is not good for the country in terms of security. “Points of entry are very critical in terms of image of a country and for security reasons and therefore when agencies have no clear mandate on their roles, our country is at risk of receiving counterfeits goods and even aliens,” Okong’o said. He pointed out that the Kenya Bureau of Standards and the Kenya Port Health are both mandated to draw samples of the liquid goods entering the country for testing hence none has the final authority on the goods getting into the country. “All the two agencies have the same mandate, one clears another product and another rejects the outcome, this creates disharmony between the two leading to some goods getting into the country without being tested,” Okong’o said. He also pointed out that there is confusion between the immigration department and the custom department on which one is clearly mandated to clear foreigners before getting into the country hence some people find their way into the country without going through the

Horatius Da Gama Rose whose land saga implicated senior government officials including former Lands Cabinet Secretary Charity Ngilu died at a Nairobi hospital yesterday. Waqo said he has personally received numerous complaints from foreigners of corruption at the entry points. “Places such as airports and border points are the first contact points of our country and the world hence officers working on those areas should have high standards of integrity,” Waqo said.
Waqo directed all Managing Directors of the Immigration department, Custom department, All Ports Authority to use the findings of the reports and prepare a plan on how they intend to curb corruption within a month. “I expect the Managing Directors to present to the EACC a report on how they intend to tackle corruption within one month,” Waqo said. @sam_x254

State moves to harmonise cash transfers to vulnerable groups

Cash transfer programs by the government to support the vulnerable people will now be made through a single platform unlike in the past where they were conducted in fragments. While announcing the new directive, Principal Secretary in the State Department of Social Protection Susan Mochache said the government is implementing a Single Registry to manage data and information related to the targeted beneficiaries. All cash to the more than 800,000 beneficiaries including orphans, persons with severe disabilities, the aged and hunger suffering communities will now be availed to them from the new platform. She argued that most of the targeted beneficiaries have either missed their stipends or received more than their share. “The Kenya Single Registry will be used as a central repository of information on social programmes to inform decisions making and refrain from numerous inefficiencies the state has suffered in the past,” Ms Mochache explained. Mochache maintained the government is committed to social protection saying more policies are being implemented to cushion vulnerable group as mandated by the constitution. “The Jubilee government is committed to ensuring that vulnerable groups reduce poverty and manage risks as envisaged by the constitution and in its manifesto,” she said.
The PS argued that other than the cash transfer programs, the ministry is also keen on providing social security to retirees and health insurance mainly to the old and citizens suffering from chronic illnesses. “Our aim is to see an increased purchasing power for households, improved retention and transition for students, reduction in child labour as well improved health and nutrition amongst out people,” she added. In the new order, beneficiaries will access their stipends through commercial banks that have established delivery points away from the tradition where they walked to Postal Cooperation offices to get the same service. However, the state will not add its grant that currently stands at Sh2000 per month owing to the growing number of target persons. “In the interim our grant will continue at Sh2000 monthly as we are adding to the fold hundreds of people daily,” stated the PS. The National Treasury has significantly increased its allocation from Sh200 million in 2013 to 18billion in the current financial year totaling to Sh69 billion that has been used since the program was launched in 2006. Samsung recalls smartphone
Hundreds arrested in Gabon post-election skirmishes
Samsung Electronics is recalling its flagship Galaxy Note 7 smartphone and said that battery problems were behind phones catching fire. The decision follows reports in the US and South Korea of the phone “exploding” during or after charging. The South Korean company said customers who had already bought the phone would be able to swap it for a new one. Samsung said it had been difficult to work out which phones were affected among the 2.5 million Note 7s sold. “There was a tiny problem in the manufacturing process, so it was very difficult to figure out,’’ the president of Samsung’s mobile business Koh Dong-jin told reporters. “It will cost us so much it makes my heart ache. Nevertheless, the reason we made this decision is because what is most important is customer safety,” he said. The firm said it would take about two weeks to prepare replacement devices. According to Samsung, the phone has been launched in 10 countries so far but with different companies supplying the batteries. The recall comes just one week ahead of an expected presentation of a new iPhone model from its main rival Apple. Over the past few days, several users have reported their phones catching fire or exploding while charging, and Samsung said it had confirmed 35 such cases. A YouTube user uploaded a video under the name Ariel Gonzalez on 29 August of a Galaxy Note 7 with burnt rubber casing and damaged screen. He said the handset “caught fire” shortly after he unplugged the official Samsung charger, less than a fortnight after purchasing it. Further images of a burnt Galaxy Note 7 were uploaded to Kakao Story, a popular social media site in Korea, on 30 August.
Security forces in Gabon have arrested more than 1,000 people during a second day of violence following disputed presidential elections. Three people were killed in clashes in the capital, Libreville. Protests began after the announcement that President Ali Bongo had been narrowly re-elected in Wednesday’s vote. Opposition leader Jean Ping, who is in hiding, told the BBC that his party headquarters had been bombed. The UN, US and former colonial power France have called for restraint and greater transparency about the results. “I know who has won and who has lost,” Mr Bongo told local media. “Who has won? 1.8m Gabonese with whom we will progress together. Who has lost? A small group which had the objective of taking power to use Gabon instead of serving it.” Interior Minister Pacome Moubelet Boubeya said on Thursday that 800 people had been arrested in Libreville and 400 in other areas of the country. Security forces cracked down after protesters attacked the national assembly building late on Wednesday, tearing down its main gate and setting parts of it on fire.
On Thursday the building’s facade was blackened by fire and its windows were smashed. Burned-out cars littered nearby streets. “Democracy does not sit well with an attack on parliament,” Mr Bongo said. Police used tear gas to prevent crowds from gathering there again and arrested people as they emerged from remains of the building. Correspondents in Libreville says people there have been unable to access the internet. Meanwhile, Jean Ping told the BBC that a presidential guard helicopter had bombed his headquarters
and killed two people. “They attacked around 01:00 (00:00 GMT),” he said. “They were bombarding with helicopters and then they attacked on the ground.” Security forces were surrounding the building on Thursday night and had detained members of the opposition National Union party inside, a spokeswoman for the party said. It was not immediately clear where Mr Ping had gone into hiding but a European diplomat quoted by AFP news agency said he was safe.

Melania Trump is suing a British newspaper and a US blogger for $150m (£114m) over allegations she was a sex worker in the 1990s, her lawyer says. The Daily Mail suggested Mrs Trump may have worked as a part-time escort in New York, and met husband Donald Trump, who is now running for the White House, earlier than previously reported. The claims were “outright lying”, lawyer Charles Harder said. Both the blogger and the Daily Mail have since retracted their articles. “These defendants made several statements about Mrs Trump that are 100% false and tremendously damaging to her personal and professional reputation,” Mr Harder said in a statement. “Defendants’ actions are so egregious, malicious and harmful to Mrs Trump that her damages are estimated at $150m,” Mr Harder’s statement said.
He has filed the complaint before the Circuit Court for Montgomery County in the US state of Maryland. Mrs Trump, 46, was born in Slovenia and moved to the US to work as a model in the 1990s. She married Mr Trump in 2005. Blogger Webster Tarpley had written that Mrs Trump feared her past becoming public. The article on the Daily Mail’s website quoted claims published in Slovenian magazine Suzy that the modelling agency Mrs Trump was working for also functioned as an escort agency, court papers show. The newspaper also quoted Slovenian journalist Bojan Pozar, author of an unauthorised biography, who claimed Mrs Trump had posed for nude photos in New York in 1995 and alleged that she had met Mr Trump that year, three years before their reported first meeting in 1998.
Her lawyers say she moved to the US in 1996. Mr Tarpley meanwhile alleged that Mrs Trump was “reportedly obsessed by fear of salacious revelations by wealthy clients from her time as a high-end escort” and had suffered a “full-blown nervous breakdown”. The Daily Mail’s retraction, published late on Thursday, insisted it had not suggested the sex work claims were true but said that, even if false, they could affect the US presidential campaign. In July, Mrs Trump was embroiled in a row over plagiarism, after her speech at the Republican convention. Lines matched almost word for word those delivered by First Lady Michelle Obama at the Democrats’ convention in 2008. An employee of the Trump Organisation, Meredith McIver, later admitted her role in writing the speech, saying it was her mistake.

Sumsung Electronics has announced a global recall of its flagship Galaxy Note 7 smartphone because of faulty batteries that could explode while being charged. The quality issue is an unexpected blow for the South Korean technology company, which has had revived fortunes in the smartphone market after two tough years, driven by strong sales of the Galaxy S7 phones. The company, which reported its best quarterly operating profit in more than two years in the April-June period, had hoped that the latest Note 7 would extend momentum in the second half. A report released by the Commission for Higher Education has revealed that more than 50,000 students graduate from private and public universities each year. The new graduates lack employment opportunities, with the Kenya National Bureau of Statistics placing unemployment rate at 40 per cent. The highest percentage is recorded among youth between the ages of 18 and 34.
National Bank of Kenya (NBK) has decided to review its interest rates in line with the recentlyassented Bill that seeks to put a cap on fees that lenders charge to their debtors. The lender has said that going forward, the bank will focus more of its resources on small enterprises. The decision follows the recent signing of the Banking (Amendment) Bill into law by President Uhuru Kenyatta, which sets the minimum interest rate chargeable for a credit facility at 4 per cent above the base rate set and published by the Central Bank of Kenya (CBK). “National Bank is a compliant bank and a true partner who listens to our customers. We continue to lead the market with competitive rates, true to our foundation objective which remains to be the leading bank enabling inclusive access of low cost credit to all Kenyans,” said Ag. Managing Director and CEO, Mr. Wilfred Musau. Mr. Musau added that prior to the Bill being assented into law, National Bank had taken the initiative to reduce reducing its rates by 1 per cent in response to the earlier reduced Kenya Bank’s Reference Rate (KBRR).
The government last year announced plans to give tax subsidies to companies that hire at least 10 graduates to prepare them for the rigours of the labour market. Facebook CEO Mark Zuckerberg is expected to meet with developers and partners later in the day to explore how the country’s pioneering mobile money ecosystem is evolving. Zuckerberg, who landed yesterevening from Lagos Nigeria will among other issue discus how facebook can better support small businesses, developers and content creators amid growing markets. His visit comes at a time when Kenya is the world’s leading nation in terms of mobile money platforms. “Just landed in Nairobi! Chase Bank adopts lower interest rates for new and existing loans Chase Bank has lowered the interest rates of its new and existing loan facilities to no more than 14.5 per cent as part of its industry commitment to the new Banking (Amendment) Act. “Chase Bank’s path to full recovery is hinged on the support of our customers and this further underscores our commitment to extend new benefits to our customers who have been regrettably inconvenienced,” said the lender in a statement. Effective September 1, 2016, Chase Bank Kenya (in receivership) said it will review all new and existing loan facilities which the bank has said will be priced at not more than 14.5 per cent. Relationship managers and branch managers of the bank are engaging customers to guide them on the review of current facilities as of September 1, 2016. The bank has also urged its customers to get in touch with their relationship managers and branch managers who will avail additional information with respect to the terms of the existing facilities. Since April, Chase Bank has recorded improved inflows in excess of Sh18.7 billion while thousands of new customers have also come on board since the Bank reopened its doors. With the recent approval
from the Central Bank of Kenya (CBK) to offer lending and term deposits, the adoption of new interest rates provides Chase Bank the opportunity to continue to support the SME sector, especially youth, women and agribusinesses to grow their businesses and achieve what matters most to them. Chase Bank’s decision follows similar moves from Barclays Bank, KCB and Co-operative Bank, lenders that have all complied with the capping law. Barclays and KCB reduced their interest rates to 14.5 per cent barely three days ago, a move that is applicable to all new loans. The announcement comes days after Co-operative Bank lowered their lending rates to 14.5 per cent. Roughly two weeks remain before the law takes effect. Most lending institutions are still waiting for guidance from the Central Bank on existing loans once the law is gazetted. Barclays Bank has however, increased interest rates applicable on new ‘Zidisha’ savings accounts and new term deposits to a minimum rate of 7.35 per cent. Diamond Trust Bank (DTB) has announced that it has adjusted its interest rates levied on all new and existing loans to not more than 14.5 per cent as from September 1, 2016. The bank will also review its operations to align applicable interest earning deposit accounts to the new minimum rate requirement. This prompt action follows the decision reached by Parliament to cap credit facilities at 4 per cent above the base rate set by the Central Bank of Kenya and set a minimum rate on interest earning deposits pegged to the CBK’s set base rate. “DTB prides itself as a customer centric financial institution. We hope this legislation will encourage more Kenyans not only to take advantage of the affordable credit facilities but also improve their savings culture and livelihoods,” said Nasim Devji, Group CEO and Managing Director. Several banks in Kenya have so far adjusted interest rates since the President signed the hotly-contested Bank Amendment Bill. DTB has been at the forefront of Small Microfinance Enterprises (SMEs) lending for over 70 years and has recently committed over Sh 2 billion to lend to SME’s under the Kenya Bankers Association (KBA) Inuka Enterprise programme. Consolidated Bank’s net profit jumps 4pc to Sh9Bn Consolidated Bank has recorded a net profit of Sh9.11 billion for the first six months of the half year ended June 2016. This represents a growth of 4 per cent compared to similar period last year where the lender posted a net profit of Sh8.80 billion. During the period under review, nonfunded income rose by 99 per cent to Sh389 million from Sh196 million during the same period last year. The bank attributed the growth to an increase in write backs from recovery of nonperforming loans, which increased to Sh125 million from Sh16 million during the same period last year. However, customer deposits declined by 4 per cent during the period due to tight liquidity in the market that resulted in increased interest payments. This led the bank to record a pre-tax loss of Sh63 million in the period ending 30 June 2016. Interest income increased by 4 per cent, although interest expense increased by 23 per cent due to the high cost of deposits. This reflects the difficult operating environment for the banking sector over the last six months. The Bank also managed to reduce its overall bad debt by 44 per cent in 12 months, attributed to aggressive debt recovery efforts. Net impairment provisions for bad loans increased to Sh137 million from
a write back of Sh37 million against a backdrop of an aggressive provisioning model adopted by the Bank to ensure compliance with the Central Bank of Kenya’s Prudential Guidelines. Although a previous Rights Issue by the lender was not successful, Consolidated Bank expects ongoing conversations with the National Treasury on recapitalization to bear positive results. This is in addition to a restructuring drive undertaken by the bank’s management to reduce bad loans and generate internal efficiencies. This process, said the lender, and the recapitalization will enable the Bank to comfortably adhere to the CBK’s Prudential Guidelines and fund its operations. The National Treasury, which commands 77.9 per cent shareholding, is keen to support the Bank on its quest to recapitalize its business in order to meet the prescribed prudential ratios. The Bank fully supports efforts to reduce the cost of credit as stipulated in the Banking (Amendment) Bill 2015 that seeks to control interest rates on loans and deposits. “Consolidated Bank remains stable and committed to meet its regulatory obligations as well as delivering bestin-class service to its valued customers,” the lender said. @enock_x254

Bill to ensure locals benefit directly from exploitation of natural resources Members of the Senate Committee on Energy have officially launched a proposed law titled the Local Content Bill, 2016 that seeks to ensure that Kenyans from all walks of life and from all corners of the country can participate and benefit from natural resources in their vicinity. The Bill principally seeks to promote the maximization of valueaddition and the creation of employment opportunities in the extractive industry value chain through the use of local expertise, goods, services, businesses and financing and their retention in the country. “The Local Content Bill is a historic moment for our great Republic. It strives to introduce a set of rules and guidelines into Kenya’s oil and natural resources industry as a means of facilitating local employment and industry,” said the Chairman of the Senate Standing Committee on Energy Hon. Gideon Moi. The Bill stipulates that communities in mineral-rich areas will benefit from the new proposals that impose strict requirements on mineral operators while giving locals a greater say over their resources. The Bill promises to give local communities more control over
ownership, control and financing of resources such as oil and gas among other minerals. The bill also focuses on the oil and gas industry in Kenya which has over the years been marred by a myriad of challenges imposed by cartels. It will ensure the industry is protected and is strategically placed to compete globally. “An operator shall, before applying for, or bidding for a license, permit or interest and before engaging in any extractive activity, prepare and submit to the committee a local content plan with respect to the extractive activity in the prescribed form,” partly reads the draft Bill. If the Bill passes into law, then all companies dealing in natural resources such as oil and gas will have to table to licensing authorities ways in which the local community in their area of operation will directly benefit from their activities before they are licensed. Unlike in the past, if this Bill sails through and becomes law, communities will no longer be shortchanged by large firms that earn huge profits, while ignoring the welfare of their hosts and other key factors such as conservation of the environment. @kevin_x254

The artist and ecowarrior hosts a periodical event, ‘Glass Art with Kendi’ that has become a big hit within art circles in the city. XACCESS had the chance to catch up with her and this is what she had to say about honing her craft and the joys she gets from her artistry.
I
s this what you always wanted to do? Yes, kind of. Not really, but I’ve always been into art. I’ve always loved doing art, I didn’t know that this was what I was going to be doing in future but even while I was in high school and university I was doing it on the side. What is the first professional piece you remember making? A piece called ‘Butterfly Orchid’ it was a flower piece. Its full title was ‘Butterfly Orchid Flowers on Glass.’ That was my very first professional work. Considering its fragile nature, why did you choose glass as your medium? When I was in high school I wanted to work with tile for my art class project and then I started considering glass. I began playing around with what I could do with glass and the different kinds of creations I could come up with using glass as a medium. I just fell in love with it and decided to work with glass exclusively. Most glass work is usually colourful, is that a priority for you? I usually just make whatever comes to mind but also glass as a medium is colour-specific. You can’t use some colours like cream, it doesn’t come out as well on glass. Opaque colours don’t show up as brightly either. Colours like red, orange yellow look better on glass but I use those though depending on what comes to me. But I’m also a very colourful person myself, I’m a very happy person and I get happiness through art as well. How did ‘Glass Art with Kendi’ come about? Art, Wine and Cheese in The Park called me up and asked me to do an event with Coca-Cola. After that I also started participating in Art and Wine events and because of high

demand I’ve been called on a few more times. This would be my third time working with Art, Wine and Cheese in The Park. What do guests have to look forward to at ‘Glass Art with Kendi’? I usually do two of them, a wine bottle and an art piece that you can use in the house. Apart from Karura, which other places can people see your artwork? Lionel Messi scored the winning goal for Argentina on his return to international football while his Barcelona teammate Neymar converted from the penalty spot to set Brazil to a 3-0 win over Ecuador in South America’s 2018 World Cup qualifying race. Copa America Centenario winners Chile however lost 2-1 away in Paraguay while Colombia and Bolivia both recorded 2-0 wins over Venezuela and Peru respectively. Argentina captain Messi had stunned the footballing world in June when he announced his international retirement after an agonizing final defeat to Chile in the Copa America Centenario in the US. However, that tearful farewell was a distant memory at Mendoza’s Estadio Malvinas last night as the as the Barcelona superstar orchestrated a 1-0 victory over Uruguay. Messi, showing no sign of the groin injury which had placed a question mark against his participation, lashed home the winner on 42 minutes, with his low shot taking a wicked deflection to deceive Uruguay goalkeeper Fernando Muslera at the near post. Man City contest Kun Aguero elbow charge Manchester City are contesting a violent conduct charge against striker Sergio Aguero for elbowing West Ham’s Winston Reid. Aguero, 28, clashed with Reid during Sunday’s 3-1 win in the Premier League at the Etihad. Referee Andre Marriner missed the incident but television footage appeared to show Aguero elbowing Reid as they tussled for the ball. The Argentine forward lashed out with an elbow which caught the West Ham defender in the throat. The Football Association said referee Andre Marriner and his officials did not see the 76th-minute incident so it has decided to take retrospective action after reviewing television footage. An independent panel is due to rule on the case on Friday using written submissions and reviewing video evidence. If found guilty, the Argentina international would be banned for three matches and miss the Manchester derby on 10 September. He would also miss a league match against Bournemouth and the EFL Cup game against Swansea. Aguero, who is out of Argentina’s two
2018 World Cup qualifiers this month with a calf injury, will not appear in person. However, Manchester City coach Pep Guardiola has said his team will carry on regardless of the outcome of the appeal. “I didn’t see it,” said Guardiola of the incident at Eastlands following a win that left City top of the table on goal difference. “I am new here so I don’t know how it works,” the Spaniard added. “I didn’t see so I cannot comment. Hopefully nothing happens. If it happens, we accept and adapt. If we lose him, we lose him. We are going to play with 11,” he told AFP after the Sunday clash. City travel to Old Trafford on September 10 to face rivals Manchester United in a derby when league action resumes after the international break. Both clubs are tied at the top of the table with nine points after three matches with just a goal separating City from United which lies in third behind Chelsea. That means the derby will see either team open an early lead on their rivals with the race for Premiership glory quickly taking shape.

Martinez booed as Spain beat Belgium Roberto Martinez’s first match as Belgium head coach ended in defeat and jeers from the crowd as David Silva scored twice to give Spain a 2-0 win.
