Employment and Labour Relations Court judge Justice Hellen Wasilwa issued the directive today and told the doctors’ union officials to return to the negotiating table to reach a mediated solution with the government. She said the doctors are holding on to a CBA that does not exist since it has not been legalized. “I expect to see you here in two weeks’ time after you have finished your negotiations and when you come back the strike should have been called off or else prepare to walk straight into cells should you defy the directive,” Justice Wasilwa directed. She ruled that the officials had blatantly ignored a court order asking them to call off the nationwide doctor’s strike that has since paralysed healthcare services in the country for 39 days now. “The court has found you guilty of ignoring a court order. However, noting that the matter before this court is weighty, I will be lenient and sentence you to a one month suspended sentence which will take effect after two weeks if you will not have called of the strike,” Justice Wasilwa ruled. The Seven union officials led by National chairman Samuel Oroko and Secretary General Ouma Oluga had put a spirited fight against their sentencing arguing that theirs was a fight to protect the health of Kenyans that they claimed to have been in jeopardy since independence. They claimed their sentencing would aggravate the current situation as ongoing negotiations would collapse. “If you sentence us, the ongoing talks to end the strike will be halted pitting lives of millions of Kenyans in danger,” Dr Oroko said in his appeal to the court.

The officials had presented themselves before the court after a warrant of arrest had been issued against them. On Tuesday, the Labour Relations Court had ordered their arrest for refusing to appear in court for sentencing after being found guilty of disobeying the court order.

The court had on December 1 ordered the union to put off the industrial action for 30 days to allow room for talks after the doctors had been sued by the Council of Governors who had asked the court to throw KMPDU bosses into prison. However the KMPDU officials have

remained adamant to end the strike including rejecting a 40 per cent pay rise offered by President Uhuru Kenyatta last week and vowed not to go back to work, dashing hopes that public health services. The doctors, who downed their tools

on December 5, crippling operations at public hospitals countrywide, called a press conference on Friday in which they announced that their work boycott was still on because what the President had offered had been presented to them before by the government. They have vowed that only the full implementation of a collective bargaining agreement (CBA) signed in 2013 and which includes a 100 per cent pay increase would see them resume work The government has said its 2013 Collective Bargaining Agreement (CBA) with doctors cannot be implemented as it did not have the “input and blessings” of the Salaries and Remuneration Commission (SRC). The Labour Relations Act requires that such agreements be registered with the Industrial Court, something that had not been done by either the government or the Kenya Medical Practitioners and Dentists Union (KMPDU). “You are holding to a CBA that has not been legalized by courts. You only say implement CBA while in boardrooms and have never submitted it to courts,” Justice Wasilwa said “A CBA is only legal after it has been submitted to court and in this way you failed to give the court a chance to solve this issue,” she added. @wilson_x254

The Civil Society Organisations have registered their displeasure over what they termed constant harassment by the government ahead of the August general elections. In a statement, the Civil Societies complained of endless intimidation and harassment meted out on them by the government in the pretext of regulation. The NGO Coordination Board Executive Director Fazul Mahammad came under sharp criticism of the CSOs saying it is being used by the government to silence organizations deemed to be opposing the government. “The Civil Society Reference Group wishes to express its deepest concern about the seemingly endless acts of intimidation and harassment being meted out on the sector in the pretext of regulation,” reads the statement. The Civil Societies pointed out that Mahammad has overstepped its mandate and frustrate the work of NGOs in the country. “It should also be recalled that Fazul’s first official action upon his appointment in December 2014 was the announcement through the media, of deregistration of 510 NGOs contrary to the laid down procedure

of arriving at and communicating such a drastic decision to the affected organizations,” reads the statement. In October 2015, Fazul struck again, this time putting on notice 959 organizations for deregistration for what he described as alleged misappropriation, embezzlement and diversion of donor funds, money laundering and terrorism financing. The Kenya Human Rights Commission (KHRC) an indigenous and credible human rights organization and indeed one of the premier human rights NGOs in the

country that has been in operation since 1992 was among the 959 organizations in the 2015 list. The CSOs argued that the smear campaign also seems to be targeted at organizations seeking to promote free, fair and credible elections as witnessed in the recent attacks on the International Foundation of Electoral Systems (IFES). NEWS 3 NTSA now put GoK vehicles on notice Government vehicles found flouting road traffic rules risk losing licences and their drivers arrested, the National Transport and Safety Authority (NTSA) has warned. The Authority’s Director General Francis Meja (pictured), said overlapping vehicles cause unnecessary jam and inconvenience to other road users. He said they have received a lot of complaints from the public about government vehicles and other rogue drivers who overlap thereby inconveniencing other road users. Speaking yesterday in Nairobi, Meja said no one will be spared in the operation that will start soon to tame rogue road users who cause unnecessary jam traffic especially in Nairobi. “We have deployed our officers in major roads and I want to assure you that no one will be use spared. Whether a government vehicle, public transport vehicles or private cars, we must adhere to the traffic rules at all times,” Meja warned. “The consequences of one losing his driving license is real and others will be even be apprehended in this process,” he added. The new measure Meja said is to bring sanity in the roads and to stop unnecessary jam in the city. He said they will deploy undercover officers to carry out the operation. “It will not be business as usual, we will deploy unmarked cars to apprehend the culprits,” Meja said. “We are not going to sit back and see innocent motorists suffer the wrath of rogue drivers. Varsity staff now issue seven-day strike notice Learning in public universities could be paralysed next week after lecturers and staff warned that they will go on strike if a Collective Bargaining Agreement (CBA) they signed with the government four years ago is not implemented. Universities Academic Staff Union (UASU) and the Kenya Universities Staff Union (KUSU) today issued a sevenday strike notice warning that they will down their tools to push for full implementation of the CBA. At least 33 public universities and their constituent colleges across the country will be affected by the industrial action. The two unions’ representatives said that the government had failed to factor the 2013-2017 CBA in the budget for the last four financial years. “All employees of public universities who are members of UASU and KUSU will withdraw their labour from Thursday 19th January, 2017 until the 2013-2017 CBA is negotiated and signed,” a statement by UASU National Secretary General Constantine Wasonga and KUSU Secretary General Charles Mukhwaya said. Kenya signs Sh10.3bn credit deal with India to mechanize agriculture

President Uhuru Kenyatta and Indian Prime Minister, Narendra Modi have signed a Line of Credit Agreement worth Sh10.3 billion for agricultural mechanization in Kenya. The two countries signed a Memorandum of Understanding on cooperation to improve the agriculture, trade, health and ICT sectors. Kenyatta expressed confidence that the agreement and Memorandum of Understanding will provide a solid framework for collaboration. “I request both sides to immediately work on their implementation. I acknowledge the progress being made in areas previously agreed on and look forward to collaboration in new areas like tourism,” the President said. European Commission offers Kenya organisations Sh441m to combat food insecurity The European Commission is offering Kenya-based organisatons, EU Member states and associated countries Sh441 million in funding as part of its ‘Food 2030’ initiative, a European research and innovation policy framework for food and nutrition security. The Commission is seeking proposals for the initiative, which aims to underpin the transformation of food systems so as to make them ‘future-proof ’: sustainable, resilient, performant, inclusive, diverse, and competitive. “Food and Nutrition Security is a growing challenge characterized by urgency and complexity due to the compounded effects of population growth, urbanization, migration, resource scarcity and climate change affecting the food systems in Europe and beyond. Research and Innovation (R&I) is key to finding solutions to sustainably feeding the planet in a changing world,” the Commission said in a statement. Program objectives under the programme include: reducing hunger, malnutrition and diet-related illnesses and building a climate change-resilient primary production system, while empowering communities. “The Commission considers that proposals requesting a contribution from the EU of up to 4 million Euros (Sh441.8 million) would allow this challenge to be addressed appropriately,” the organisation added in its statement.

Bank on innovative partnerships to eradicate poverty in Kenya, AfDB says Kenya and other African countries will need innovative partnerships and a mix of small-scale and big transformational projects to build resilience and overcome economic fragility, African Development Bank (AfDB) President, Akinwumi Adesina has said. Adesina says that the Bank has created a bottom-up initiative to deliver on the lender’s development priorities in 10,000 communities in fragile situations in 1,000 days. “It requires innovative partnerships to scale up existing technologies in these environments. One such technology is present with us here in the room,” he told the Africa Resilience Forum, an initiative that aims to strengthen partnerships that go beyond aid coordination. The Forum also seeks to effectively build resilience at community, country and regional levels.

The Bank’s understanding of fragility has evolved to a universal risk concept where it is considered “a condition of elevated risk of institutional breakdown, societal collapse or violent conflict.” “Fragility is neither constrained by any geographical setting, nor is it bound by time,” said Adesina. “Countries, therefore, experience varying intensities of fragility and duration, in some cases manifesting as pockets of fragility.” The Bank’s commitment to building resilience is also reflected in its resource allocation. Since its inception in 2008, the Transition Support Facility has mobilized more than $3.63 billion (Sh377 billion) in additional resources. The share of these additional concessional resources for fragile situations has steadily increased, most recently from 13 per cent

under the 13th Replenishment of the African Development Fund (ADF-13) to 17 per cent under the Fund’s 14th Replenishment (ADF14). Energy remains a critical part of the agenda. It helps fight fragility in the context of large-scale and uncontrolled urbanization. For instance, since 2010, Kenya’s Government has improved electricity supply in Kibera, the largest slum in Nairobi, as part of a programme that targets the areas of greatest social inequality. “Providing electricity and modern fuels in marginalized areas lowers the risk of internal unrest and reduces the movement of people across borders. This is why the Bank will be investing $12 billion (Sh1.2 trillion) in the energy sector over the next ten years,” Adesina said. @enock_x254

Kenya’s real estate sector has consistently outperformed other asset classes over the last 5 years, generating returns of over 25 per cent per annum, compared to an average of 10 per cent per annum in the traditional asset classes This is according to one of the latest reports by financial services group, Cytonn Investments. A recent analysis by the group indicates that Residential units in Kenya generate an average rental yield of 5 per cent,

Students with disabilities to benefit from Sh14.5 million Inuka Scholarship Programme Hundreds of 2016 Kenya Certificate of Primary Education (KCPE) students living with disabilities are set to from a Sh14.5 million Kenya Pipeline Company (KPC) initiative dubbed the Inuka Scholarship programme. KPC’s Managing Director, Joe Sang says the kitty will only benefit bright, needy and physically-challenged students from poor backgrounds. “We have embarked on this initiative to empower and transform the lives of young persons living with disability,” Sang said in a recent statement. “We will ensure that the vulnerable maximumly benefit from this initiative as we will select two candidates from across the 47 candidates who scored the highest marks in last year’s KCPE,” he added. Those who will be selected will benefit from funding worth Sh80, 000 per year to cater for their four years in secondary school. The amount will further help beneficiaries by training them on how they can access

government services, including tenders. Partnered with the National Council for Persons With Disabilities (NCPWD), the 2016 KCPE students will be the first beneficiaries of the programme across the whole country. Last week, over 5,000 needy students from across the country secured scholarship programmes from Equity Bank under its ‘Wings to Fly’ programme with Nakuru County recording the highest number of beneficiaries. However, it is projected that all who sat for the hotly monitored 2016 national examination won’t be joining Secondary schools of their choice due to various reasons, including lack of schools fees and poor performance among others. Balala seeks sustainable tourism solutions at UNWTO Madrid forum THURSDAY, JANUARY 12, 2017

Tourism Minister Hon. Najib Balala and Jumia Travel CEO, Paul Midy are part of the African ministerial panel that will spearhead a roundtable discussion on ‘Technology and Design of New Touristic Products. The discussion is to be hosted during the Tourism Investment and Business Forum for Africa (INVESTOUR) at the upcoming International Tourism Fair in Spain (FITUR). The annual event, scheduled to take place between January 18th and 22nd in Madrid, will also mark - among other distinguished activities - the official presentation of ‘The Year of Sustainable Development Tourism 2017’, as declared by the UNWTO. The Year of Sustainable Tourism Development largely seeks to promote five key areas through collaboration by stakeholders across the globe. These include resource efficiency mainly touching on environmental protection and climate change, inclusive and sustainable economic growth, social inclusiveness which aims at job creation and poverty eradication, promotion of cultural values and bolstering mutual understanding in a bid to promote peace and security. The United Nations General Assembly declared 2017 as the International Year of Sustainable Tourism for Development owing to the sector’s potential to contribute to, and aid in the realization and achievement of the well spelt out 2030 Agenda for Sustainable Development and the 17 Sustainable Development Goals (SDGs). The Agenda is described as a plan of action for people, planet, and prosperity and is expected to build on the Millennium Development Goals

shortlisted to head the year’s initiative will be presented. New SGR freight locomotives will be well-suited for Kenya’s tropical climate, says Transport Ministry Freight locomotives for the Standard Gauge Railway (SGR) will be suited for Kenya’s tropical climate, the Ministry of Transport has confirmed. The first batch of locomotives recently arrived in the country and is ready for the line testing process in the first quarter of this year. The locomotives were received by Cabinet Secretary for Transport, Infrastructure, Housing, and Urban Development, Mr. James Macharia at a ceremony held at Mombasa’s Port Reitz Station, which is the starting point for the SGR’s Mombasa-Nairobi line. “Thanks to the efforts of the Kenyan railway builders and Government agencies involved in this landmark project, the Mombasa-Nairobi SGR has registered a remarkable construction speed and we expect completion of the entire project soon, and within our contract terms. The delivery of this

first batch of freight locomotives is a major milestone on this journey,” said CS Macharia during the ceremony. Also present were Principal Secretary Irungu Nyakera; Chargé d’ affaires Yao Ming from Embassy of China in Kenya; members of the Kenya Railways Corporation Board and top officials from CRBC, among others. Six locomotives docked at the port, four of which are freight trains of the model DF8B diesel locomotive. This is the main traction locomotive model of the Chinese railway system, with locomotive power of 3100KW and a maximum speed of 100 km/h. Once the SGR is operational, this locomotive will be the main force serving freight transportation needs on the entire railway. Also expected are 2 DF7G shunting locomotives with 1550KW power, which together with the freight locomotives, will be used for

marshalling and dispatching locomotives and rolling stock within stations. There will be a total of 56 locomotives manufactured by CRRC Corporation in operation on the Mombasa-Nairobi SGR route. The entire fleet is expected to be in the country by mid-year and will arrive in four batches. The fleet, when complete, will consist of three models: passenger, freight and shunting locomotives. There will be five DF11 passenger locomotives, 43 DF8B freight locomotives and eight DF7G locomotives. The DF8B heavy-duty diesel locomotive, which just arrived at Mombasa Port is the classic model with an AC-DC transmission DieselElectric, high-power engine. It is widely used for both passenger and freight, and boasts a domestic market share of 60 per cent in China. The DF11 passenger locomotive

represents the realization of highspeed passenger transportation in China. It is the highest scientific and technological achievement by the Chinese diesel locomotive industry, and will arrive at Mombasa Port by the end of January, together with the second batch of locomotives and rolling stock equipment. They newly acquired locomotives are expected to spearhead the historic mission of boosting the capacity of Kenya’s railway transportation, engendering smooth flow of traffic on the main artery of national economic development. According to the CRBC, the three locomotive models have been customized for Kenya’s tropical savannah climate, operational environment and future maintenance requirements. @kevin_x254

NIC expands internship programme in bid to tap youth talent Financial services provider, NIC Bank has administered an aptitude test for 2,278 college students. The students, who were selected from different local and international universities across the country, undertook the test as part of the selection process for the NIC Bank University Internship Programme. The number of applicants for the internship programme has more than doubled this year as compared to the 1,112 applications received in December 2015. “The two-fold increase in the number of applicants demonstrates the growing profile of NIC Bank as an employer of choice for the youth,” said Monica Kihia, Human Resource Director at NIC Bank. NIC Bank’s internship programme aims to tap into the youth’s talent and creativity to not only give the bank a competitive edge in the market, but also present the youth with an opportunity to access stable and fulfilling careers. “In just one year we have had 75 interns, many of whom have been retained in full time entry level jobs in line with the branch expansion,” remarked Kihia. NIC Bank has expanded its branch network from 27 in the beginning of 2016 to the current 33. All successful recruits will receive comprehensive induction into the bank and acquire mentorship, coaching, branch exposure and project delivery opportunities in the different departments. NIC Bank’s initiative to create employment for the youth comes at a time when youth unemployment in Kenya has soared to alarming levels. Unemployment among Kenya’s youth is now estimated at 17.3 per cent compared to six per cent for both Uganda and Tanzania, a World Bank report released in March 2016 indicates. Kenya created only 128,000 formal jobs in 2015, according to the recently released Economic Survey 2016. In contrast, the number of graduates from universities and colleges stands at more than 450,000 annually. “The huge mismatch between job opportunities and graduates joining the job market underlines the need for more proactive recruitment policies such as the ones we have embraced at NIC Bank” said Kihia. s with every new academic year, more students are admitted into school than with the preceding years. Kenyatta University seems to have fallen victim to this bottleneck but with an added twist. Renovations are to blame for the new accommodation situation at the school. According to Magazine Reel, the university relocated around 6000 students from Nyayo hostels, the university’s largest accommodation complex, to make way for the revamp. The limited spaces available for students to relocate to has apparently created such a bad state that some students are considering postponing their studies as they have nowhere to live. “I have looked everywhere close to the university including Kahawa, Githurai and Ruiru but all in vain. All the accommodation spaces are occupied and I might be forced to defer my studies”, a student told Magazine Reel.

Isuza relishes Ingwe move Midfielder Whyvonne Isuza says the prospect to join Sportpesa Premier League side AFC Leopards from Mathare United was too sweet to turn down. The player while speaking to XSport after signing a pre-contract agreement with the Leopards said the move will to be a positive sign of growth for his footballing career. He is set to complete his switch to the den within a week. Isuza, who finished first runners up in the KPL Midfielder of the Year category at the 2016 Footballer of the Year Awards held in mid-December will join teammate Robinson Kamura and six other players on Leopard’s growing list of new signings. Sources within Ingwe revealed the attacking midfielder has in the past week shot to the top of head coach Stewart Hall’s wish list as the Englishman embarks on rebuilding the 12-time champions who endured a nightmare 2016 season. “My time at Mathare has been remarkable. I have played and learnt and grown in many aspects. I want to thank the entire Mathare family as I embark on yet another journey,” declared the Most Valuable player at Mathare United in the 2015 season. Isuza scored six times for the Slum Boys as he helped the club to a seventh position finish in the 16-team KPL log with 44

Hockey player injured in robbery attempt

A heroic hockey player was last night left with a deep cut on his head in his successful attempt to thwart a robbery incident on Ghanaian players currently taking part in the ongoing Africa Nations Club Cup championship in Nairobi. Ghana Police men’s Hockey club players were attacked by thugs next to their hotel in an incident that left Kenyan Linus Sang and one foreign player with serious injuries. Sang, the National team and United States International University – Africa (USIU-A) goalkeeper, was with the foreign team during the ugly incident that left him nursing almost a 15cm-long cut at the lower back of his head in the 8.00pm incident after he jumped in to diffuse the situation after unknown men attacked the team. The number of the attackers was not immediately established. The player took to social media to announce his heroic act that kept the attackers at bay but left him with exposed flesh that missed his throat by an inch. “Just now while protecting Ghana police from…” he wrote on his social media page accompanied with the graphic photograph of his wound. It was not immediately established whether the cut was as a result of a knife or a machete. Fortunately, the cut, which covered a big part of the cervical did not touch his occipital but was just a few centimeters from his throat. Southampton hold a slender advantage in the EFL Cup semi-final after a fully deserved first-leg victory over Liverpool at St Mary’s last night. Nathan Redmond’s cool finish from Jay Rodriguez’s pass gave Saints a crucial lead to take to Anfield on 25 January - but Southampton can count themselves unlucky not to be in complete control of this battle for a place at Wembley. Liverpool’s much-criticised goalkeeper Loris Karius was one of very few in Jurgen Klopp’s side to distinguish himself amid a shocking performance, making two fine firsthalf saves from goalscorer Redmond. Karius’s one-handed save from Redmond right on half-time was vital but he was helpless late on as the same player threatened once more, Liverpool enjoying more good fortune as his effort came back off the bar. Southampton’s recent form has been indifferent but manager Claude Puel will have been delighted with their display at St Mary’s. He is responsible for Liverpool still being in this tie after a shocking display. “We needed Loris Karius to save our lives two or three times. The best thing for us is the result. We know that we can play better at Anfield - nothing is decided,” Klopp said.

Fellaini contract extension triggered

anchester United have triggered a clause in Marouane Fellaini’s contract that will keep him at Old Trafford until 2018. Fellaini signed a four-year deal with the option of a further year when he joined from Everton for £27.5m in 2013. United boss Jose Mourinho has activated the option despite uncertainty over the 29-year-old midfielder’s future. Fellaini was booed by his own fans last month but scored in the EFL Cup semifinal win against Hull on Tuesday. The Belgium international ran to Mourinho to celebrate his goal in what seemed to be a show of recognition for the faith shown in him after a difficult period, which included giving away a costly penalty at Everton on 4 December. Speaking after Tuesday’s victory, Mourinho said: “He has a very strong mentality and has coped well. “He knows he is a very important player for me.”

uis Suarez scored his 100th goal in his 120th game for Barcelona as the Spanish giants overturned a 2-1 first leg loss with a commanding 3-1 victory over Athletic Bilbao to reach the Copa del Rey quarter-finals last night. Suarez volleyed home from Neymar’s cross at the Nou Camp to put Barcelona 1-0 up on the night and ahead in the tie on away goals with the scores level at 2-2. The Uruguayan is the third-fastest player to reach a century of goals for Barcelona, with only Mariano Martin (99 games) and Hungarian striker Laszlo Kubala (103) having taken fewer appearances to reach the landmark. Neymar put Barcelona 3-2 ahead on aggregate after the break when he coolly drilled in a low penalty after he was fouled.

But moments later Athletic striker Saborit’s towering header levelled the tie on away goals. A nervousness engulfed the Nou Camp with the tie heading towards extra-time - until Messi curled in a shot off the post from 20 yards. The Argentina forward’s strike - his third free-kick in three games in 2017 - put the Catalans into the quarter-finals for the seventh successive season. Messi’s strike also equaled the record for the highest number of free-kick goals for Barcelona. That record was being held by Everton boss Ronald Koeman who played for the Catalans in the 1990’s. “Congratulations on scoring your 26th free kick goal at Barcelona tonight. One

Barcelona have not lost a La Liga game since the start of October but after a series of disappointing draws are five points behind arch rivals Real Madrid in the race for the Spanish title.
