PALM CITY — The last Chamber of Commerce town hall meeting of the year is coming up on Wednesday, Nov. 19. Proposed incorporation of Palm City may or may not be on the agenda. “This one, the (Community Redevelopment Agency) is back to update us on the design and progression of Mapp Road,” Nikki Norton, chamber president, said. The chamber of commerce has had some initial meetings to look into whether Palm City could in-

corporate to become the city of Palm City. Norton said that may be part of the town hall discussion. She said there’ll definitely be discussion about All Aboard Florida — the proposed highspeed passenger rail that’ll cut a swath through the Treasure Coast — and a big-box retailer looking at possibly making a home in Palm City. “Costco is back,” Norton said. Fort Lauderdale’s Thomas Engineering Group met with county staff on March 6 regarding a proposed Costco in Palm City. However, at press time, the re-

MARTIN COUNTY — Sheriff Will Snyder is getting ready to take his office on the road. “We’ll have the command post vehicle for major crime scenes and natural disasters,” he said. “It would serve as a mobile sheriff’s office. I could take that anywhere in the county and run an operation.” Criminals donated the money to refit the truck chassis Martin County Fire Rescue gave the Sheriff’s Office for a mobile command post. are also buying the department a 2015 Lenco BearCat G3 for its SWAT team. All told, that’s about a $369,000 donation criminals are making to the Sheriff Snyder’s efforts to see them locked away for a long time. “There’s no taxpayer dollars in either of these two purchases,” Snyder said. “These are the proceeds of crime enhancing public safety, which I think is poetic justice.” OK, criminals didn’t host a poker run, bake sale or telethon to raise money for the Martin

There’s talk at the Palm City Chamber of Commerce about whether the town should incorporate. But, what is Palm City? “We’ve formed a committee to investigate (incorporation) and see what the requirements are,” Nikki Norton, the chamber’s president, said. Taryn Kryzda, Martin County administrator and Palm City resident, said there are numerous issues incorporation advocates would have to consider. “What is the end game?” Kryzda said. “Are they going to create a complete level of government? Are they intending to have their own police department? What is the

anticipation of how they would (financially) manage as a city? Where’s city hall going to be? Will they have to build another building (for one)?” But, she said, the most important question might seem like the simplest. Until you ask it. “The other part for me is, where Palm City really ends,” Kryzda said. “When you think of Palm City, what are your true boundaries?” The St. Lucie River makes the eastern border of a proposed city of Palm City pretty easy to draw. The C-23 canal essentially forming the St. Lucie and Martin counties’ line is an obvious place to draw Palm City’s northern boundary. But then there’s west and south. Where does Palm

The assessed value is about $2.9 billion, and taxable value about $2.2 billion. This year Martin County’s taxable value is at $17.6 billion. In other words, that slice between I-95 and the river is about 12.5 percent of the county’s taxable value. The population is about 21,000 to 22,000 people. Martin has about 146,000 residents. Just about 15 percent of the county’s population live between the St. Lucie River, county line and I-95. Haddox said those numbers don’t show value Palm City has, but can’t fully tap under current interpretations and applications of the Martin County Comprehensive Growth Management Plan, commonly called the “comp plan,” and other land-use regulations. He said Martin Highway is ripe for development, but the County Commission can stand in the way until the end of time. “They can dictate Palm City’s future growth,” he said. That’s why Haddox said he initially favors incorporation. “It’s controlling your own destiny,” he said. “If that’s the only benefit, it’s a big benefit to a lot of people in Palm City.” Back to law enforcement being a large municipal service the proposed city of Palm City would have to provide. Haddox said he’d do that by contracting with the Martin County Sheriff’s Office,
City end those directions? The answers could make huge differences in any incorporation talk, because of tax revenue and cost of delivering necessary services, such as law enforcement. Law enforcement alone is a big part of any city budget. “If you’re going to be a city, you have to put your big boy pants on,” Sheriff William Snyder said. Does Palm City go out to the Ronald Reagan Turnpike, Interstate 95, or farther west? Maybe it goes to Southwest Allapatah Road? What about South? Does I-95 form that southern end? Maybe it’s State Road 76A, or the C-44. There’s the U.S. Post Office’s zip code, 34990, one could use to draw Palm City’s borders, or the Census Bureau’s Census Designated Place of Palm City. For purposes of examination, Your Voice News & Views used I-95 to form the southern and western boundaries of a proposed city of Palm City, with the St. Lucie River and county line forming the east and north. “If I had to draw a line around it, that would be pretty much it,” County Commissioner John Haddox said. That’s a pretty valuable bit of real estate. The Martin County Property Appraiser puts the market value at about $3.3 billion.

rather than starting a police department. But, that would take a willing sheriff. “I would say ‘Yes,’” Snyder said. “We would be a much better bang for their buck than starting their own.” Synder said the Sheriff’s Office doesn’t have contracts for providing all law enforcement services in any incorporated area, but does partial services for smaller cities, and has mutual-aid agreements with the Stuart Police Department. “Sewall’s Point and Jupiter Island, we do their major cases and investigations,” the sheriff said. In other counties, newer cities often contract with sheriffs’ departments to provide law enforcement. It’s almost invariably less expensive than starting a police department. Other municipal services a city usually provides in whole or large part are water, sewer and parks. Kryzda said the county would have to continue providing those services to Palm City. “All of our systems now are looped,” she said. “Our systems aren’t stand-alone.” That leaves parks. Kryzda said incorporation advocates would have to consider whether a city of Palm City would purchase those existing parks from the county and operate a parks and recreation department, or leave them
in county hands. “The question for me, as a Palm City resident, is, what’s the benefit?” Kryzda said. “Will my taxes be less?” Likely, no, Ruth Pietrusvewski, Martin County’s tax collector, said. This year Palm City residents are paying, all told, a property tax rate of about $17.10 for every $1,000 of accessed non-exempt property value. That includes the county’s various taxes and other taxing bodies, such as the Martin County School Board. Stuart residents pay about $18.70. The county administrator said the burden of proving whether the proposed city of Palm City would be a good financial decision is something advocates will have to prove to sway many. “I think that if someone is going on this venture, I think the onus on them to come up with those numbers,” she said. Widespread community support would be critical to get the Martin County Commission to go along with members of the Florida Legislature backing bills to create the city of Palm City. The legislature generally authorizes referendums in proposed incorporation areas. But there’s a starting place for advocates, Kryzda said. “In order to do a financial analysis, they’ll have to know what the boundaries are,” she said.

TREASURE COAST — If attorney Robert Kulas could give one piece of advice to the public about estate planning, it would be to have a plan. “Everyone needs an estate plan once they’re 18,” he said. “You should go to an attorney (who) is qualified in estate planning and have a plan in place. Then you don’t have to worry.” Kulas received an undergraduate degree in English literature from the University of Miami, but he soon realized he had to find another area to pursue to make a living. “Right after graduation, I decided I needed to do something else,” he said. “I went to law school.” Kulas, who currently makes his home in Palm City, received his law degree from the Cum-

PLAN from page A4 berland School of Law at Samford University in Birmingham, Ala., and started in private practice. “After seven or eight years, I was tired of litigation, divorces and fighting,” he said “I decided to see what I could do where people would leave my office feeling good.” He decided estate planning was the best way to help his clients. “People come in worried about what happens,” he said. “By setting up an estate plan, we’re able to ease their concerns. A plan in place gives peace of mind.” Kulas said that 60 percent of the people in the United States have no estate plan and no will. While most of his clients are retired, he can set up plans for families with children over 18, who are, of course, legally adults. The plans can give the parents power of attorney and the right to make medical decisions if something happens to the adult child. Planning for the unexpected is a message Kulas conveys to all his clients. Spouses often come in and tell him that they are leaving assets to each other. “If they own jointly, assets go to the survivor,” he said. “What happens when the second one passes, or if they die in a common disaster? What happens if one dies and the other is incapacitated? It could end up in court. “We try to cover as far as we can. Most people say they want assets to go to kids, but what if one child predeceases the parents? There are a lot of decisions to make to make sure it’s the way they want. Lots of things
may or may not happen. You need to trust who you’re working with and tell them the facts. Clients may not have thought of something. We need to talk and discuss it so we can bring points up.” Kulas acknowledges that this is not an easy topic for most people. “People don’t want to talk about death or taxes,” he said. “It needs to be addressed.” To that end, the practice offers seminars to the public. “We give an education so when they do come in, they are prepared,” he said. “It’s usually a story about a married couple with a couple of kids and the things that may or may not happen.” In the initial consultation with prospective clients, Kulas talks about goals, about what they would want if they became incapacitated or died. If the person becomes a client, they go into financial details and discuss trusts, wills, and the very important Health Care Power of Attorney, specifying who will make health care decisions for a person if they are unable to do so. “This is more important than a will because it’s while you’re still here,” Kulas said. “We use them while you’re alive. You need to talk to your spouse and kids about burial instructions, if there is a specific burial place and where assets are located. It’s important for the people who will take over to know it. Kids often have no idea. “We counsel our clients to talk to their spouses,” he said. “Sometimes, the spouse has never written a check. We tell them that if one is handling the finances, let the other do it, with supervision, for a while and know

Your Voice chief photographer Mitch Kloorfain takes a turn in the pilot’s seat Outside our Florida community, autumn is acknowledged by apple picking, changing leaves and rotating the summer clothes for winter wear. Our version of autumn is signified by local fall festivals, slightly Mitch ‘Crash’ Kloorfain cooler temperatures and the engine sounds overhead from several days of practice and performances of the annual Stuart Air Show. Since 2003, I have been lucky enough to be included in the flights made by the participating pilots during Media Day on the Thursday leading up to the weekend. The concept is simple. Print media, television media and Internet media are invited to send their strongest-stomached on-air personalities, writers and photographers to capture some epic images to invite some hype to the show. In other words, this is like a Christmas present to me. My life experiences of flight are minimal at best. The CRA, adopted in 2002, includes 610 acres, and has about $1.3 million available for projects, which can circumstantially be combined with grants and other county dollars. The area is nestled along Mapp Road from Southwest Rio Vista Way south to Southwest All American Boulevard. It goes from the St. Lucie River South Fork west to a few blocks past Mapp. There’s a western extension nestled along Southwest 34th and Southwest 36th streets to Southwest Berry Avenue. In a CRA some county taxes paid on property values higher than what they were in a base year — when the area was established — stay in that district for economic development and blight elimination for a set period of time. It’s called Tax Increment Financing, TIF. Since there are no train tracks in Palm City, All Aboard Florida’s proposed wouldn’t seem to affect the community. Until one considers the many boaters. There’s a train bridge nestled between the Roosevelt, U.S. Highway 1, and the Dixie Highway bridges in Stuart. A few times a day, a siren warns boaters that the train bridge will soon close. When it
tailer hadn’t filed an application to develop at a 28-acre site, nestled between Martin Highway, High Meadow Avenue and the Ronald Reagan Turnpike. At the pre-application meeting in March, there was discussion about Costco building a 150,000-square-foot, warehouse-style store with more than 650 parking spaces there. County Commissioner John Haddox said nine months of seeming quiet from Costco doesn’t mean the membership retailer has put Palm City on a back shelf. “They’re still around and I understand they have taken a greater interest and may be moving forward on a possible development application,” Haddox said. The County’s Community Redevelopment Agency, or CRA, has spent a good part of this year discussing amendments to the decade-old Mapp Road Town Center Design. In February, The Old Palm City Neighborhood Advisory Committee unanimously agreed to recommend that the county commission acting as the Community Redevelopment Agency to adopt a Mapp Road Town design that included divided service roads with on-street parking, landscaping, bicycle lanes and 8-foot sidewalks that allow water to seep right

does, boats on one side or the other of the very low bridge have to wait to pass. Florida East Coast Industries, which owns the rail lines running over the train bridge and through Stuart, is working to start All Aboard Florida, a 235mile, privately-owned passenger train service from Miami to Orlando International Airport in 2016. The company only plans to have stops in Fort Lauderdale and West Palm Beach. If current plans are realized, the service will run 32 high-speed trains a day north and south. Those 32 trains a day, Palm City boat captains say, will effectively cut off the community’s boaters from the Indian River and Atlantic Ocean with frequent bridge closings. The town hall meetings started in February. Norton estimates that about 150 attended the first. There were more town halls in March, and April. They attracted about 100 each, she said. The last one, September, had a much thinner turnout. Martin Sheriff William Snyder, Commissioner John Haddox, and other dignitaries have spoken at the meetings. The meeting will be at the Palm City Community Center, 2701 S.W. Cornell Ave., Charlie Leighton Park, from 6 to 8 p.m.

Commissioner Haddox: Clarification in order on ‘Palm City, Inc.‘ story Editor’s note: We received word over the weekend that County Commissioner John Haddox was not happy with the story he was quoted in that appeared in last week’s edition of Your Voice News & Views. While we stand by our writer’s work, there are times when a source becomes relaxed in an interview and doesn’t realize a remark offered in jest may not come off as humorous in blackand-white. Here, we are offering Haddox — who, incidentally, is
one of our favorite officials to work with at Your Voice because he’s always been a straight shooter — space in this week’s paper to clarify any misunderstanding readers may have inferred from the story.

hen I read the Your Voice News & Views story entitled, “Palm City, Inc.,” (Oct. 31, 2014) I was pretty irritated. Very irritated, to be perfectly honest. Many of the comments the reporter attributed to me were incom-

Some, like my joke about volunteering to serve as a newly incorporated Palm City administrator or my crack about 714, were represented as sincere remarks rather than what they were — off-the-cuff attempts at humor. However, before you think this is just another politician denying

a statement or sidestepping controversy, let me stress right away that it is not. In fact, it is the opposite. I definitely understand the frustration behind the talk of incorporating Palm City. When I was elected two years ago to represent District 5 on the Martin County Commission, I was idealistic and optimistic. I thought I could breech longstanding stalemates by showing sincerity and respect and finding common ground. I soon learned that it is not that simple. But I’m still happy and upbeat about what lies ahead, and that’s overwhelmingly due to the input, ideas and feedback I get from meeting almost daily with my constituents. Those constituents include owners of small mom-and-pops to CEOs of big businesses, retirees, families and young people looking to make Martin County their home now rather than feeling forced to leave in order to find a good career. It is my interaction with Palm City and Indiantown residents — Your Voice News & Views readers — that gets me even more excited about the opportunity to preserve what we all love about Martin County while still attracting economic endeavors that help create good jobs, support business growth, and most importantly increase our tax base.
YOUR
VIEW
If you tune in regularly to MC20, you know that even though as county commissioners we each respect one another and get along reasonably well, things get heated at times. My fellow commissioners are intelligent and accomplished individuals with plenty of professional experience and often competing visions for Martin County’s economy. Compromise is never easy. It often takes many hours of deliberation and debate. I’ve won some, such as getting the Customs office at Witham Field passed and helping forge an agreement with Jupiter Island on managing and funding the St. Lucie Inlet. I’ve also lost some, such as the proposed Jensen Beach mooring field and the septic tank capacity I supported for agri-businesses. Sometimes it was a draw. When rewrites on the comprehensive plan — many of which I voted to support — called for setbacks that harm marine businesses, I sat down with the affected parties, learned their concerns and hashed out a compromise that slow-growth leaders could sup-
port. Looking at the prospect of Palm City incorporating, it’s easy to understand both sides of the argument. Maintaining the status quo offers the benefits of stability and predictability, the 714 corridor, with its proximity to I-95 and the Turnpike, holds promising long-term growth potential. Right now, the bigger question is not the merits of incorporation, but the concerns of the citizens who feel incorporation is a more attractive option than county management. What do we as a county government need to do differently to prevent citizens feeling alienated to the point of drastic action? Fortunately, in my frequent meetings with constituents — both supporters and detractors — I’ve heard quite a bit. As much as I enjoy meeting with constituents, it’s even better when those same citizens come to the county chambers and address the commission in person. It’s these strong showings of public engagement — not my idealism or optimism — that make political compromise in Martin County possible. These showings of public support may even make any talk of incorporation unnecessary.

County Sheriff’s Office. They committed crimes, got caught, and had assets seized from them. “We’ve seized about $550,000,” the sheriff said. After what Snyder emphasized was “due process,” that money went into the county’s Law Enforcement Trust Fund. He’s aggressively acted to pump it up. “When we took office about 22 months ago, we had $47,000,” he said. The County Commission has to approve any purchases, or other expenditures, from the fund. “I can’t go out and buy anything I like,” Snyder said. “It’s a check and balance.” The county can’t use the fund to buy patrol cars, uniforms, or pay for most training. It’s limited to funding special equipment and programs. However, 15 percent must go to drug abuse and treatment programs. The Martin sheriff gets a lot of solicitations from all over the country for that part of it. He sticks to giving that portion of the fund to local organizations. “Every dime is spent locally,” he said. The command post started with the Fire Rescue’s donated chassis heading up to Tomoka Correctional Institution in Daytona Beach. There inmates enrolled in PRIDE, Prison Rehabilitative

Mitch Kloorfain/chief photographer The Aeroshell Aerobatic Team returned to the Stuart Air Show to demonstrate their precision team flying skills for two days last weekend. I forgot to take a few photos at first. I can hear the chatter between Thorstenson and the tower at the airport and then he turns his attention to me. I had mentioned earlier that one of the images I wanted to capture would be something where the plane is inverted and I would have the ground on top and the sky below. He was quick to accommodate and we cruised inverted for some time while I snapped a collection

of images. Thorstenson righted the plane and trimmed the flaps to level us off and asked five words I may not soon forget. “Would you like to fly?” Silly, overworked pilot, I thought, I AM flying. Did he forget I was back here? Then it hit me. He said “Would you like to fly?” not, “Would you like to be flown?”

walking on a wing, you could just step over to the next plane. After assessing who their passengers are, they decide how much of their aerobatic maneuvers they will showcase. After my meeting with T-28 ‘Trojan’ retired U.S. Navy pilot Mick Thorstenson, he seemed happy to have been given free rein to fly in any direction and speed his little pilot heart wanted. Thorstenson asked if I had ever flown before, and like a sinner in a church confessional I blurted out that I was 10 for 10 in crash landings on a flight simulator I used to use. I crashed all 10 times. We started with what had become a very familiar lesson in safety precautions, with heavy emphasis on the word “shouldn’t” when saying “We shouldn’t have to use these.” Thorstenson helped strap me into the parachute harnesses. Thorstenson also shared the history of this Navy T-28, built in 1956, and how it is the absolute best of all the T-28 aircrafts flying today. (This would play heavily on me in just a few short minutes). We take off from Witham Field heading west. I got so lost in looking for familiar landmarks,

“The control stick in front of you is all you need. The plane is yours,” he said. With that, I slowly moved the stick to the left and went left. Same thing happened on the right side. “That was great. Thanks for the opportunity,” I said though our headphone comm device. “You can roll it if you want,” he said, probably sensing I would want just a bit more. He wasn’t wrong. My next instructions were to bring us down to 3,500 feet and head toward the coast so we could come around and land. I looked at the display in front of me with 16 circular dials of instrumentation, only looking for the one they told Karen Black’s character in ‘Airport 1975’ to look for when she had to convert from
flight attendant to pilot in order to land a Boeing 747 after the pilot had been injured. I found the altimeter. I gently pushed the stick forward until we hit that mark and leveled off. During all that sensation overload of piloting for the first time, I was taking some photos as well to document the experience. Thorstenson took the controls back for the landing, having recalled my perfect execution of crashing every time in an older simulator. Before leaving, I thanked my pilot, took a few photos on the ground and he asked what simulator I had used. I told him it was on Atari in 1984. I think he may have thought it was something less arcade-like. Mitch Kloorfain is the chief photographer for Veteran Voice and Your Voice News & Views.

ur community recently experienced a great victory: St. Lucie County was selected to be the location of the new state VA nursing facility. This was made possible due to the hard work, patience, and our community’s dedication to the well-being of our veterans. This achievement demonstrates the power of community effort, with leaders coming together across the federal, state, and local levels to prioritize our veterans and their care. It is a well-deserved victory for the Treasure Coast community and local veterans. The service area of this new facility is home to over 200,000 veterans, half of whom are seniors over the age of 65. These are men and women who have fought for our country; they are our neighbors, our family, and our heroes. Too often the phrase, “Support Our Troops” is thought to be limited to those men and women currently fighting; however, we

MURPHY from page A16 community, we recognized this issue and came together to fight for a solution. The solution was recognized the day St. Lucie County secured this much-needed facility for our senior veterans across the Treasure Coast. Our achievement here demonstrates that this community truly understands the meaning behind “Support Our Troops.” I was honored to be part of this tremendous effort. On behalf of our veterans, I wrote a letter to the Florida Department of Veterans Affairs urging that St. Lucie County be awarded this facility. In Congress, I advocated to the House Committee on Veterans Affairs, highlighting the pressing need for a nursing facility to provide care for hundreds of thousands of aging seniors in the area. As a community, we successfully urged Florida Governor Rick Scott and the Florida Cabinet to swiftly approve FDVA’s selection of St. Lucie County. In my role as your Congressman, I have the privilege to meet with our nation’s heroes and thank them for their service. From recently meeting with local veterans at the World War II Memorial during an honor flight commemorating the 70th anniversary of the D-Day invasion and welcoming home local heroes from their

Honor Flights, to visiting with our active duty troops still stationed in Afghanistan over Memorial Day, these humbling experiences remind me how much members of our military have sacrificed in service to our nation. The best way to pay tribute to this sacrifice is to make sure that our veterans, troops, and military families get the care, support, and benefits that they have earned and deserve. I am proud that this community has done that by fighting on their behalf for this much-needed facility. This facility will allow them the opportunity to be cared for as they age right here at home. Furthermore, the new VA nursing home will do more than merely provide health care follow-up assistance, and long-term care services to our veterans. In addition to these services, the future 120-bed facility will bring nearly 200 jobs to the Treasure Coast. As this victory was a community effort, it is only fitting that the entire community will benefit from the new facility. U.S. Rep. Patrick E. Murphy represents Florida’s District 18.

Meetings have never been a strong favorite of mine, and I probably will take many hits for stating this, but according to the size of your organization, sometimes meetings can plan your way out of being productive and getting desired results. Three days after hearing something, only around 10 percent of the subject is retained. If you couple this lack of retention with the labor cost of having a meeting outside of normal work hours, plus any lunch or refreshments that you might provide, meetings can be high in cost without the business getting a good return on the investment. There are many things that you will inevitably have to meet about, but choose your meetings wisely and remember a few tips to keep the meetings as beneficial as possible. If you have a meeting, have a defined agenda and follow it. This will keep things on subject and prevent the gathering from turning into a gripe-fest. It will also allow you to keep up the pace and complete the meeting in a timely fashion. Also, try visual aids and handouts to go along with the meeting topic. Retention of the subject matter is greatly increased when spoken instruction is accompanied with the visual. Schedule enough time to allow for questions/feedback at the end of the meeting. If anything is brought up that you don’t know how to address, or if any new items are brought up for discussion, assure the group that you will have to get back with them on the subject. Group meetings aren’t the time to shoot from the hip if you aren’t prepared with accurate information. You will find if you give erroneous information, the retention of that information by the employees will approach 100 percent. Think productively when it comes to dissemination of information in your office. Is a meeting the best way to get out info? If
Bill Hughes you have interoffice email, a bullet point memo may take care of things. According to the size and number of sites you have for your business, electronic communication may work best. Use technology to your advantage. Products are out there now where you can have virtual meetings, cutting down on repetition, unproductive breaks in a day, and travel expense. Sometimes you can plan all you want for a new procedure, policy or product implementation in your office, but the best plans have to be general and flexible enough to realize you may have to change things once the change is implemented. As much as you might not like it, some changes have to be implemented, one to three people at a time, just due to the nature of the subject. A good example is implementation of a secure patient communications system. A large group meeting could be held and everyone be shown how to do it by projector/ PowerPoint, etc., but usually these things are best conveyed one on one or in small groups. Another advantage to communicating/training incrementally is that you can perfect the training, develop the procedures needed and work out some of the bugs prior to putting the final procedures/policies in place for usage of the new methods. Once everyone has been instructed individually or in small groups, then the whole group can be brought together with a projector and re-

Contagious diseases: What Florida employers need to know
TIRED OF WAITING AN HOUR TO SEE THE DOCTOR FOR ONLY 10 MINUTES?

The Ebola hemorrhagic virus has come into the spotlight recently due to an outbreak in Africa and few cases in the United States. Employers must be aware of potential liability when it comes to Ebola and other contagious diseases in the workplace. Some contagious diseases are easily transmitted through the air, such as influenza or the measles virus. Ebola, however, is only transmitted through direct contact with broken skin or mucous membranes, with an infected individual’s blood or bodily fluids, and objects that have come into contact with those fluids.

which may cause serious injury or death. Under the “multi-employer workplace doctrine,” OSHA will issue citations to a host employer if another employer’s staff members are exposed, or the host employer created or exposed the other employees to the hazard. If a citation has been issued, OSHA will expect the employer to implement a response plan, based upon a “hazard assessment” of potential exposure at the workplace. Training, sanitation, and prevention techniques are some ways to comply with the Act. Employers must offer any employees that have been exposed free medical evaluation and treatment by a licensed health care provider.

DISEASES from page A20 activities of an individual (e.g., breathing, working, speaking), which is chronic in nature. The Florida Human Rights Act adopts this definition implicitly. Ebola, which is expected to involve temporary infection, would not qualify as a “disability.” However, if an employee develops a disability as a result of the infection and cannot return to the same work duties, then an employer must identify any available accommodations which do not cause undue hardship to the employer, or whether the employee’s disability presents a direct threat to the health or safety of other employees. Employers must keep employees’ health information confidential in compliance with the ADA. Employers may only ask current employees medical questions when there are concrete reasons to believe that the employee cannot perform the job or poses a risk to workplace safety due to a medical condition.
FMLA considerations Employers with more than 50 employees must provide up to 12 weeks of unpaid leave for an employee or her spouse, child, or parent who have a “serious health condition.” Although there are so few cases of Ebola in the United States, it is likely to qualify for coverage under the FMLA. The CDC recommends removal of infected employees from the workplace during the disease’s incubation period (two-21 days) to prevent transmission. If an employee exhausts her FMLA leave time before recovering from the virus, then an employer may extend the time, but is not required to do so under the FMLA.
Premises liability A landowner, who is also an employer, who permits third parties to enter its premises for business purposes, owes a duty of “reasonable care” to protect such individuals against hazards that are not “open and obvious.” If an employer knows, or should reasonably know, that there is an infected individual on the premises, there may be a duty to warn others of the potential health hazard or to prevent access to certain facility areas. If the building ventilation system or bathroom facilities may become contaminated with a contagious disease, the employer may have an obligation to prevent such contamination through enhanced sanitation measures. An employer-landowner should look to its employment or lease agreements to determine its legal duty for sanitation and security. See a labor and employment attorney for further guidance.
Liability for disability benefits An employee may be exposed
YOUR VOICE NEWS & VIEWS • PALM CITY & TESORO • NOVEMBER 7, 2014 • A25 to the disease in the course of employment, which the employee must prove with competent medical evidence. In this case, an employee is entitled to temporary disability benefits, reasonable medical treatment, and an award for any resulting permanent disability.
Whistleblower Act protection An employee who complains that she is in imminent danger at the workplace due to the actual or probable presence of the disease is engaging in “protected activity” for purposes of the WBA. As such, the employee cannot be subject to adverse action for refusal to work until the employer can establish that there is no hazard or that its response plan will reasonably protect the employee from exposure.
Is your business at risk? Some industries are at a higher risk of exposure to contagious diseases. Exposure may be more likely in some industries, such as health care, emergency response, and transportation; or where employees who have or are expected to travel to and from western Africa or other geographical areas where the disease has been identified. If your company is at risk, your may need to consider: Methods to protect your employees and others from potential exposure; methods to protect employees before they travel to areas known to have experienced contagious diseases; and procedures to follow when these employees return from such areas, such as quarantine or a fitness for duty medical examination, or remote work during the incubation period if the employee exhibits any symptoms. Consult with the Florida Department of Health at DiseaseControl@flhealth.gov for guidance on a preventative or responsive plan to reduce exposure. She added, “While effectively serving all cultures and ages with ease, non-judgment and excellent connection, Maria is a tireless advocate for families and is masterful at collaborating with the program’s partners and connecting people to whatever resources they need to enhance their life circumstances.” In addition to her outstanding job performance, Velasco demonstrates other skills and attributes that have contributed to creating this high quality, strength-based Healthy Families Martin-Okeechobee program including her resourcefulness, commitment to the families she serves, collaboration with community partners, excellent relationships with co-workers and willingness to always take on additional duties. She is also a certified Infant Massage instructor, working with both English and Spanish-Speaking Families. Kane Center Cabaret Nov. 16. “At 46, I’ve relaxed into the fact that I’m known for my voice,” he said. “I hope the audience will appreciate all the expressiveness that goes with singing. That’s my signature. Anybody can stand and sing, but I act while singing every song. Even with a ballad like “I Don’t Send Roses” by Jerry Herman, which is beautiful to listen to, in my own way, I’ll be playing the character. I will be
communicating with the audience on an acting level.” For his Kane Cabaret performance, LeGette will sing a compilation of songs from his cabaret acts, including songs from “Oy Vey, It’s Broadway” a tribute to Jewish influence on musical theater. “There will be Frank Sinatra tunes, but it’s Broadway-themed and there will be a lot of ‘Fiddler’ from ‘Oy Vey,’ he said. “It will be

MARTIN COUNTY — Few performers are able to make a career solely from their art, but actor and singer Wayne LeGette has managed to do just that. The Florida native has spent time in New York, but he has carved an impressive career in theater and music in his home state. “When I was younger, friends in New York were working day jobs and auditioning and auditioning and auditioning,” he said. “I was going from show to show to show. I was making a career out of being a working actor.” LeGette trained at New York’s National Shakespeare Conservatory, but musical theater beckoned. “I was one of those kids in fifth or sixth grade who they discovered could sing,” he said. “I’ve been singing ever since. While I have done as many straight plays as musicals, the South Florida community likes me doing musicals.” LeGette, who has won two Carbonell Awards, South Florida’s equivalent of the Tony Awards, appeared in “The Full Monty” and “A Christmas Story,” at the Maltz Jupiter Theatre, Moliere’s “Tartuffe” at the Gulfshore Playhouse, and “Fiddler on the Roof” at the freeFall Theatre. In the last few years, he has put together a cabaret act that he brings to the
Broadway and a little bit of top 40 standards.” This is not LeGette’s first trip to the Kane Center. He performed there several years ago, in a Valentine’s Day duet concert with Shelley Keelor. Now that he has his own cabaret act, he is enjoying being his own boss. “I’m finding it so rewarding,” he said. “Shelley has always told me, ‘You’ll find a great reward for your soul. I performed at a cabaret in Sarasota and there were 35 seats. There was a lot of personal interaction and a reception afterward. In regional theater, you rehearse, open, and get reviewed. That’s the only feedback. In this case, I stood for 30 minutes and listened to exactly what they thought, the things that you always wanted a theater critic to say.” The Kane Center is considerably larger, but LeGette finds it comfortable. “It has fantastic acoustics,” he said. “I’m thrilled with my piano player, Mark Galsky. It’s nice to be up on a raised stage. It hearkens back to years in regional theater. There’s a little distance from the audience, so I can lose myself in the material and still look out and interact with others. It’s a good size, a perfect little venue.” The Kane Center, 900 S.E. Salerno Road, Stuart, presents the Kane Cabaret, featuring Wayne LeGette, Nov. 16 at 2 p.m. Tickets are $15. Order online at the website, www.kanecenter.org, or call (772) 223-7807.

Discount Office Furniture makes $1000 Donation to Treasure Coast Foodbank
Jerry Block of Discount Office Furniture got into the holiday spirit early this year by making a $1000 donation to the Treasure Coast Food Bank. He had read the brochure from the food bank that indicated that for every dollar donated the food bank could provide 7 meals for a needy individual or family. He thought it would be great to be able to provide 7000 meals for local Treasure Coast residents. He also offered a challenge to other area business owners to make a donation to the food bank. “Nobody should have to ever go hungry, let alone during the holidays” Jerry said. “Let’s help the food bank get the job done”
