The Federal Deposit and Insurance Corporation recently filed a lawsuit in the U.S. District Court against the former CEO and president, Vernon Smith, along with seven others, alleging questionable loan practices that cost the bank more than $8 million before its closure. PLAN from page 1 The proposed changes were sent to the Florida Department of Economic Opportunity by April 26. The department will have 30 days to review them and raise any objections. The county would then have 180 days to submit changes the commission approves to answer state objections. The vote was contentious. Commissioner Doug Smith, Jensen Beach, said at the meeting that many of the proposed changes could affect property values. He questioned whether property owners were aware of the proposed changes and given a chance to air their concerns. “We don’t truly know how many properties are going to be affected by some of these changes,” Smith said, and later added, “Should we not understand who we’re affecting, and should we not notice them?” Other commissioners were visibly impatient with Smith’s request to delay the vote to have time for additional public comments. “That’s enough of this garbage,” Ed Fielding, Stuart, said at the meeting. Commissioner John Haddox, Palm City, moved to approve several of the proposed changes.
In a telephone interview after the meeting, he said that Smith had in previous years approved compplan amendments that had less public participation. “I absolutely feel the process was fair and the public had ample time to bring forth comment and concerns through staff, through commissioners and through (Hurchalla),” he said. “Everybody who wanted to participate in the process in a positive way had every opportunity to participate in the process.” Clyde Dulin, senior planner, said that if the changes are approved by the state and finally adopted by the commission, future major changes to the comp plan would require a super majority, four of five commissioners voting yes. While the comp plan’s 17 chapters will continue to have stated goals covered in them, the second will outline the comp plan’s overarching ones. The proposed changes also require planners to start looking at growing density issues earlier. “When Martin County has only 15 years of available capacity, we’ll start planning for additional capacity,” he said. “When we get to 10 years, we’ll actually expand the capacity.” Hurchalla said no commission-

She advertised that she intended to in August, had meetings that included county staff, and started a website, martincompplan.com, for people to discuss possible comp plan changes. “I don’t know of any way you could have made it more grassroots,” she said.
Hurchalla said the comp plan revisions weren’t one-sided in favor of environmentalists and others opposed to development. “I have had people from the development community who do not altogether trust me sit down with me and help me write it,” she said. “I have had lunch with developers more in the last six months than probably my entire life.”

Finally, an explanation for why fire trucks seem to always show up when people call for ambulances. “The No. 1 question we get asked is why a fire truck accompanies an ambulance on a medical call,” Dan Wouters, division chief at the Martin County Fire Rescue, said. The answer? “You have to go to the (Citizen Fire Academy) to get that,” he said. The county’s next Citizen Fire Academy starts on Wednesday, May 8. The seven-week program meets from 5:30 to 7:30 p.m. “The Fire Academy is a program we started just over a year ago,” Wouters said. “It’s an opportunity for us to educate the members of the public exactly what we offer as a comprehensive department.” Lois Belding of Palm City went to the third academy a few months back. “We got to see all of the equip-

BANK from page 1 man David Barr said. “Georgia has led the way.” According to FDIC records, nationally about 485 banks failed and went into receivership since 2003. A little more than 14 percent, 69, were based in the Sunshine State. Before 2008, it was unusual for banks to fail. From 2003 to 2007, only 10 banks failed. From June 2004 to February 2007, none did. “That’s the longest period in our history that we had no failures,” Barr said. Then 27 banks failed in the second half of 2008, signaling a sea change. In 2009, a rash of bank closures started hitting —140 that year. The bank-closure crisis hit its peak in 2010. That year Riverside was among 157 banks that closed and went into receivership. Another 92 did in 2011. Since the start of 2012, another 59 banks have folded and gone into receivership. Three were added to that list on Friday, April 19. Two were in Florida. Barr said the FDIC starts analyzing the failed banks’ records quickly and communicating about possible legal actions with those it feels contributed to the closures with questionable actions. “There’s a lag time, Barr said. “We have three years under the statute of limitations to file (lawsuits).” Barr said that the FDIC board of directors has authorized 109 lawsuits naming 888 individuals since the wave of bank closures started in the second half of

2008. Not all of the named individuals were directors and officers. Some are individuals that provided professional services, such as law firms. “If our board of directors authorizes a lawsuit, our staff will put together very detailed claims and file it in district court,” Barr said. “The defendants know it’s coming at that point. If they wish to settle, we can settle and not name them in the suit. If all the parties (named in a potential suit) get together and want to settle, we can do that.” The FDIC has filed 54 suits against directors and officers of failed banks in recent years. Additionally, the FDIC turns over any evidence of criminal wrongdoing to the Department of Justice. In its suit against former directors and officers at Riverside, the FDIC named Cindy Robbins, Ray Horton, Robert McCarthy, Timothy McGuire, Susan Sproul, Steve Strickland and John Williams. Among other allegations, the FDIC claimed in its suit Smith participated in making loans that violated policies the bank adopted in 2006 after an independent auditor discovered too many loans had been secured against stocks held by Riverside’s holding company. “By approving stock-secured loans in violation of Loan Policy

The complaint claims that by 2009 Riverside charged off more than $16 million of outstanding balances secured by affiliate stock, which exasperated undercapitalization. Among the defaults were loans that violated the 2006 policy made to Smith’s son and daughter. According to the complain,
about $2.3 million of $2.5 million of loans made to Smith’s daughter — called K.P. in the suit — were charged off. The FDIC claims another $1.2 million of loans totaling about $1.33 million made to Smith’s son —called C.S. in the suit — were charged off. Riverside National Bank, which Smith founded in 1982, had 60 branches in 10 Florida counties when it closed. An unidentified woman at Smith’s home phone number responded to a Your Voice News & Views request to speak to him by saying, “Vernon won’t want to comment.”

PALM CITY — For psychologist Phil Cromer, fitness is a family affair. Cromer, a runner, is married to Dr. Julie Cromer, a Vero Beach dentist who runs and trains bootcamp style. Julie’s father, dentist John Cairns, and her sisters have run the Boston Marathon or Iron Man competitions. The Cairns also own the Jungle Club in Vero Beach. Cromer’s 8-year-old son, Kai, occasionally runs with him and the two younger sons, Koa, 3, and Kona, 10 months, are often at the sidelines, cheering him on. For Cromer, beginning a running regimen came, in part, from seeing his wife’s family in action. “As I saw them running and competing and doing these fantastic achievements, I couldn’t stand on the sidelines,” he said. “Running is something I’ve always done on in an informal basis, but
I’ve become more serious in recent years.” Cromer now manages the dental practice run by his wife and father-in-law, but he served for several years as director of counseling at the Jupiter campus of Florida Atlantic University. He would often meet stressed, frustrated students. “Students would come in and share their frustration and lack of motivation,” Cromer said. “Running not only keeps you in shape, it’s such a motivator and stress reliever.” When he began running seriously, Cromer got involved with the Treasure Coast Breakfast Club. Looking at their Facebook page, he could find out when people were running and what races were scheduled. “On Thursday or Friday, if I’m thinking of a long run on the weekend, I’ll ask who’s running Saturday at 4 a.m.,” Cromer said.

“You get at least half a dozen people. I run most evenings, but most are out at 4:30-5 a.m., running all over Martin County. The group is just so dedicated. I’ve met a lot of people in the community.” Cromer has been thinking about his goals for the next few months. “Last year, I set personal records in every race I ran, from a 5k 10k, half marathon and marathon,” he said. “I’d like to do that again. “I’d like to qualify for the Boston Marathon. I plan to run in the Jacksonville Bank race (in late fall) and target my qualifying time.
“Boston dictates what races qualify and what do not. Jacksonville is one of those qualifying races. For someone my age, 41, and gender, I have to run a 3-hour, 15-minute marathon. I’m going to be working hard over the summer.” Cromer said that everyone has a different training style. “It’s smart to choose shorter races to gauge where your speed and endurance is,” he said. “The key to training is a long run on the weekends. The more you race, the more comfortable you get with your abilities. I do shorter mileage, eight to 10 miles three to four times a week, and 15-21 miles on the weekend.”

Cromer and he and his wife are thinking about running the Miami half marathon together and Kai, who completed a 5k race in October, wants to do another one. Kai also has bigger ambitions. “I ran a half marathon recently and he asked me if he could,” Cromer said. “I said, ‘Lets’ work on the 5k.’ I like his enthusiasm, but I told him, ‘baby steps.’” All of the Cromers love going to races. “It’s good for kids and families to go out and experience the racing environment,” Cromer said. “It’s good for kids to see parents exercising, having good habits and being part of something bigger. The kids and their mom wait for me at the finish line. They get the medals.” Cromer said he has come to appreciate fitness with three young boys. “When you have three boys, it’s important to keep them moving,” he said. “We’re busy, but that’s the way we like it. We’re always planning something and doing something. The youngest is just learning to walk. He does his speed training in his walker, chasing his brothers.” While much of the family’s running is about fun and family as well as fitness, Cromer has a more serious message. “It’s fun, but the psychologist

As a psychologist, marathon runner and father, Phil Cromer saw the tragic events in Boston through several different lenses. He spoke on April 18 about how the bombings at this year’s Boston Marathon would affect his plans to try to qualify to run in the race next year. “It’s one of those things,” he said. “It’s so important to rally around an activity that has so many positives. This is such a tragedy. I’m going to continue to train for Boston, and if I qualify, I’m going. Things like this can happen anywhere and my family will absolutely go.” Cromer’s oldest son, Kai, is 8,
the same age as Martin Richard, who died watching his father at the finish line. While he wants his family to come to Boston with him, there are concerns. “I would like to have my family there, but I’m not sure in what capacity,” he said. “It’s hard to say if I’d have them at the finish line or along the route. That 8-yearold could have been mine. We’ve talked about it as a family. It’s important to let kids know they are safe. Life does continue. We don’t want to make kids so paranoid that they’re afraid to be around groups. “I spoke to my 8-year-old and told him that he is safe, that bad things sometimes happen to good people and that it’s important to move on. Good people don’t cower.”

Foster family finds love hundreds of times By Patrick McCallister Staff writer pmccallister@yourvoiceweekly.com Brian and Rose Bailey thought they’d try their hand at foster parenting for a little bit. That was in 1982. “I adopted myself right out of the system,” she said. “My husband and I were foster parents for 23 years.” State rules forbid families with five or more children from being foster homes. The mid-50s couple is now adoptive parents with a household of seven trials, tribulations, tests of faith, needed school supplies … and love. Bailey co-facilitates classes and mentors younger foster parents for United for Families. “In the process of the 23 years, we adopted eight children,” Bailey said. “My children range in age from 30 to 8.” Kenneth Bailey is among the adopted children. The 25-year-old is on his second year in the Army and recently married Jacqueline. He went into foster care shortly after birth, and the Baileys adopted him when he was a toddler. Bailey said he hasn’t met his birth parents, to his knowledge, but would like to in the future. He said the Baileys, however, will always be Mom and Dad. “I was always in a big family,” he said. “I love a big family, the hustle and bustle.” United for Families is a private agency that provides foster homes and other services for the Department of Children and Families four-county Circuit 19, which includes St. Lucie and Martin counties. The event, which is free and includes a complimentary breakfast, will be from 8:30 a.m. to 10 a.m. The annual event is to tell folks about what foster parenting is and is not. Circuit 19 has 98 foster homes. At the beginning of the year, there were 104. Twenty-three of them ceased being foster homes, some due to adoptions, and 17 were added. The DCF wants an additional 14 foster homes in the four-county circuit. Last summer the DCF launched Fostering Florida’s Future, a public-awareness campaign aimed at increasing the number of foster homes in the state by about 1,200. Dennis Miles, regional managing director of the department’s Southeast Region, said the state’s added about 900 since then. Additionally, the department is overhauling the foster-care system and making it easier for foster parents to normalize the children’s lives. Bailey said her husband and she fostered more than 100 children. About 85 percent, she estimates, were reunited with their families. About 10 percent were adopted. Another 5 percent aged out of the system. She still regularly hears from many of them. “That’s so hard when they
leave,” she said. “I never was good at that. Every one that left took a piece of my heart.” She has a tip for would-be foster parents: “Reunification is our No. 1 goal,” Bailey said. “Embrace the whole family. It’s not just the child, it’s the whole family you must embrace.” She said some of the parents whose children she fostered are now friends. However, Bailey was not always comfortable with reunifications. “I had to rely on my faith and hand it over to God to get through it,” she said. Bailey said most children are in foster care for one to two years. The younger Bailey urges people to consider fostering. “You give (children) a second shot at life,” he said. “Right now, they’re in a tough situation.” He said the transition to a foster home does seem to be harder for some children than others. “At first, they were like, I want to be left alone,” he said. physicians observed how cold affected fat cells. “For years, frostbite victims had permanent loss of fat layers,” Hughes said. “Children who ate a lot of popsicles had dimples in their cheeks from a similar loss of fat.” CoolSculpting involves positioning the device on the body. It draws the bulge up between two cooling panels. There is a sensation of being pulled, to make sure the selected tissue is efficiently cooled. “It has the results of liposuction,” Hughes said. “The fat cells are killed. It removes 15-20 percent of a fat layer.” Results from the procedure being to appear approximately three weeks after treatment and are most noticeable after one to three months. The body takes that time to flush out the fat cells and it may do that for up to six months. The fat cells are eliminated, so if healthy eating and exercise habit are maintained, the results should remain. Patients who are interested in the procedure can come in for a free consultation. To illustrate: If you owned mostly bonds, and interest rates rose sharply, the value of your bonds would likely drop, and your portfolio could take a big hit. But if you owned stocks, bonds, government securities, certificates of deposit (CDs) and other investment vehicles, the rise in interest rates would probably affect your portfolio less significantly. Unfortunately, many investors think that if they own a few stocks and a bond, they’re diversified. But you can actually extend your diversification through many levels — and you should. For the equity portion of your portfolio, try to own stocks representing many market sectors and industries. Also, consider international stocks. And rather than just owning U.S. Treasury bonds, consider corporate bonds and municipal bonds, and diversify your fixed-income holdings further by purchasing short-term, intermediate-term and long-term bonds. Work with your financial advisor to determine the mix of asset classes and investments that are appropriate for your fi-
nancial goals and objectives. How you ultimately diversify your portfolio depends on your risk tolerance, time horizon and long-term goals — there’s no one “correct” asset mix for everyone. And over time, your diversification needs may change. To cite one example, as you enter your retirement years, you may need to increase your percentage of income-producing investments while possibly reducing the amount of growth investments you own. These growth-oriented investments tend to be more volatile, and you may want less volatility during your retirement. However, even during retirement, you will need to own a certain percentage of growth investments to provide you with the growth potential you’ll need to stay ahead of inflation. Keep in mind that diversification can’t guarantee a profit or protect against loss. Nonetheless, building a diversified portfolio may help take some of the volatility out of investing — so look for diversification opportunities whenever possible. STUART — Performers have big hearts. They will often stage concerts or shows as fundrasiers or entertainment for worthy causes. Often, a performer has a particular organization that captures his interest. Artists Helping All is a group of local performers who donate their time and talent to any nonprofit group in Martin and
St. Lucie counties. They provide entertainment, at no cost, and tailored for a specific event. If a nonprofit is planning an event and needs entertainment, AHA is ready to serve. AHA came about in 2012, when Gale Baker, a playwright, author, jazz musician and actor directed the show “Ballroom” at the Barn Theatre. Several of the performers discovered that they

The group can put on everything from variety shows to murder mysteries. For an April 6 fundraiser for the Hobe Sound Animal Protection League, the performers staged “A Celebration of Cats.” Anna McNeely, who performed on Broadway in the original version of the hit show “Cats,” was guest artist. A fundraiser for the Rosann Gregory Cancer Foundation on April 13 featured the original musical “Murder at the Café Chat Noir,” written by Baker and composer Max Mercury. The core group is joined by a cadre of dancers, singers and actors including Betty Ann Dingman, Slade Walter, Josephine Lovaglia, Lance Holbrook, Chris Mazzella, Stacey Fox, Betty Dallas, Donna Verfaille, Gary Smith, Merilee Lawrence, Nick Wood, Jamie Gall and Beverly Westphal. When an event is scheduled, the group rehearses once a week, often at the clubhouse in the condominium community in Stuart where Baker lives. As an event nears, they rehearse more frequently. The group has put together a list of requirements for organizations wanting entertainment. No money changes hands. Every-
thing is done on a volunteer basis. The group does not produce shows, advertise events or sell tickets. All groups with 501(c)(3) charters are eligible. The performers do not pick and choose the groups they serve. AHA provides its own costumes, unless the group requires a specific theme. If specific costumes are required, the group asks that the organization provide them or provide a budget for them. For themed events that are not in the group’s repertoire, AHA requires from four to six weeks notice to write and rehearse new material. The performers can work on a stage or dance floor and only require “decent” lighting and an adequate sound system. They do reserve the right to examine the system. If necessary, the organization is asked to provide sufficient equipment. AHA requires that it be mentioned in any press releases about the event. For Gale Baker, it is all about giving back while doing something special. “The giving back is the biggest part, but you get a group of people who can give back with something they know how to do and enjoy doing.” Performers interested in working with Artists Helping All and non-profit groups interested in having event entertainment should contact Gale Baker at neongale@ gmail.com.
