NOTE from page 1 as the “Establishment Clause.” In May the commission quietly declined to issue a proclamation for the Humanists of the Treasure Coast connected to World Humanist Day, June 21. At the center of the denial was that missing note which ostensibly influenced at least one commissioner’s decision on whether to support the proclamation. County and city governments issue proclamations at almost every meeting. They use the proclamations to recognize and promote everything from National Child Abuse Prevention Month to the accomplishments of local students. A proclamation usually gets little fanfare — the recipients get a reading of it at a meeting, followed by a bit of applause, handshakes, and a photo with smiling commissioners or council members. But proclamations sometimes help raise the awareness of local issues, programs and charities. Martin proclamations have inspired Your Voice stories, such as a recent one about the county’s Drug Court. The new county attorney, Michael Durham, said after speaking to numerous people he’s confident that there were no violations of Sunshine Laws, or promotion of religion over secularism. Rather, he said, the missing note was in the center of
a comedy of errors that exposed problems with how the commission does one of its usually most innocuous jobs — issuing proclamations. “We will be taking a look at this and seeing what changes need to be made,” he said in a telephone interview. Joe Beck, founder and president of the Stuart-based humanist organization, said he understands errors leading to unintended consequences, but would still like that proclamation. “They say there was a mistake, and I say let’s accept that,” he said. “Let’s work together to get a Humanist Recognition Week.” He said that there are other events and dates the commission could use to proclaim a local Humanist Recognition Week. In Beck’s view, it’s a matter of fairness. For the last 12 years, the commission has proclaimed Bible Reading Week for local churches in connection with the annual Bible Reading Marathon at Stuart’s Memorial Park. Last year, the proclamation came with the statement, “Whereas, the Bible has been the foundation for the many blessings from God that we have enjoyed in the United States …” Chairwoman Sarah Heard, Port Salerno, speaking for the commission, declined to issue the requested proclamation for the
local humanist group. David Graham, Martin’s director of administration, told Beck the news. “It is with regret that I inform you that there is a lack of support among the County Commission to support your proclamation request and I have been instructed by the Chairman to withdraw the item from the agenda,” Graham wrote in an email to Beck. “I received no specific reason why the request was denied; but that is the prerogative of the Commissioners.” Turned out that the reason had a lot to do with the handwritten note no one at the county could find by press time. Commissioner John Haddox, Palm City, said he would have signed the proclamation — he’s signed all presented to him since taking office in November. But this one came with the now missing note, which gave him pause. Haddox, who saw the note weeks before he gave a comment, recalled thinking it was written by fellow commissioner, Ed Fielding, Stuart. “The proclamation came across my desk with a note from (a commissioner),” he said in a phone interview. “It was basically saying, ‘I don’t support this resolution.’ I returned (the proclamation) and said, ‘Let this thing run its course.’” He continued, “Before I put my signature on it, I gave it to my
aide and said, ‘Bring it to me last.’ I never saw it again.” Sam Morley, general council of the Florida Press Association, said the missing note raises questions about the commission’s adherence to Sunshine Laws. “In this case the sticky note reflected the views of a board member on an issue pending before the board,” he said in an emailed response to queries. “It was circulated to other board members and another board member acted on the note and indicated his disapproval. The note was part of the deliberations that led to the official action of the board and using the note to avoid deliberating the issue publicly seems to be a violation of the Sunshine Law.” Barbara Petersen, president of the First Amendment Foundation, said in an email that with or without the missing note, passing proclamations for signatures before meetings seemed to steer the commission dangerously close to a legal cliff. “However, the fact that commissioners were to sign the proclamation as a signal of support — and the fact that the proclamation wasn’t put on the agenda due to the lack of sufficient signatures — could be a violation of law,” she wrote. “On page 17 of the ‘2013 Government in the Sunshine Manual’: “Thus,

Emailed response from county attorney Thank you for giving me some time to look into this matter and gather some facts. I know it is a little late, but I wanted the information to be correct, and this took so more time. I will just bullet point the information, you have the context based upon our discussions. As to the sunshine matter involving the sticky note. After talking to several staff members, it is clear that a staff member wrote the note and put it on a folder in order to communicate with another staff member regarding the proclamation. The folder with the proclamation was then provided to that staff member who was not available to receive it and to remove the
NOTE from page 3 a procedure whereby a board takes official action by circulating a memorandum for each board member to sign whether the board member approves or disapproves of a particular issue, violates the Sunshine Law.’” She added, “This would seem to be the case here, correct? The county employee told the group that the commission ‘declined to support the proposed proclamation’ — in other words, the commission took action by circulating the proposed proclamation among themselves. Based on the Blair opinion, this would appear to be violation of the Sunshine Law.” Which goes to the heart of why Heard declined to put the pro-
sticky note. The folder with the sticky was then provided to another Commissioner. As a result there was the appearance that a Commissioner was communicating with another Commissioner through a sticky note about a proclamation. However, in fact, the communication was between staff members not Commissioners. The Commissioner in receipt of the folder with the sticky note inadvertently got the message. Additionally, no Commissioner saw anyone draft the note. Thus based upon the facts there is no impression of a sunshine violation. As to the public record matter regarding the sticky note. The sticky note would be a public
posed proclamation on the June 4 agenda. “It came to my attention, two commissioners refused to sign it,” she said in a telephone interview. “It was my decision that lackluster approval for a proclamation was worse than none. I decided we wouldn’t issue a proclamation.” That note, Durham said after interviewing numerous people, was written by a county employee, not a commissioner as Haddox recalled, for other county employees, not commissioners. Therefore, he said, the action is well clear of violating Sunshine Laws. He said county employees who remember seeing it have verified the note indicated that Fielding wouldn’t sign the proclamation. Durham also said that Fielding

Graham said he’s never seen it happen in 12 years. “It’s never happened before with me,” he said. “I can’t speak to (what may have happened) before my time.” However innocuous and perfunctory, proclamations are official acts that go on commission agendas and require votes. Under Sunshine Laws, elected officials can’t discuss with each other items that will be on meeting agendas, although one-way communications about them are generally allowed. For example, a commissioner could send a memorandum to others about a fact-finding tour he or she took of a property in the center of a rezoning question. Those communications are generally available for public examination. Durham, who started as the county attorney in April, said that current proclamation procedures have been around for awhile, but do seem to steer uncomfortably close to the appearance of Sunshine violations. “By passing them among themselves and signing them, they’re telling each other how they’ll likely vote,” he said in the telephone interview. And there’s the question about whether the commission accidently violated the First Amendment’s prohibition against showing religious preferences by supporting Bible Reading Week,

The reason we have the Establishment Clause is the idea of religious liberty.” But while humanism might have theological implications, it isn’t a religion. Durham said Fielding was aware of that fact when he declined to sign the proclamation. In a previous interview, Beck said that most secular humanists are either agnostic or atheist, but not always. “Humanism is basically a rational, compassionate, human-centered way of life,” Beck said. “Humanists strive to live fulfilling lives that aspire to help humanity without reference to a god, supernatural creatures, or religion.” However, Beck said the commission’s willingness to proclaim Bible Reading Week compels it to recognize humanists’ requests. “It would be wiser for cities and counties not to be involved in Bible Reading Week, or National Prayer Day, but since they’re involved the Constitution requires they give equal treatment to all others,” he said. ummer isn’t here yet, but it’s getting close. And for many people, the arrival of summer means it’s time for swimming at the local pool or lake. If you’re just a casual swimmer, you probably don’t have to adjust your diet before jumping in. But that’s not the case with competitive swimmers, who must constantly watch what they eat and drink, particularly in the days and hours preceding their races. While you may not ever have to concern yourself with your 400-meter individual medley “splits,” you can learn a lot from swimmers’ consumption patterns — particularly if you’re an investor. students in grades 4 to 10, math for those in grades 4 to 8, science for those in grades 5 and 8, along with end-of-course assessments for algebra 1, geometry, biology 1 and U.S. History. Statewide, students made gains in all areas, particularly in biology and geometry. Martin’s ninth- and 10th-graders had the third-highest reading scores in the state for their respective groups. The seventh-graders were fifth-highest and eighth-graders sixth in reading. Additionally, all of the county’s middle-school students who took the Algebra I end-of-course assessment passed. Statewide, 64 percent of students taking the algebra 1 assessment for the first time scored achievement level 3 or higher. In other words, passed the test. That’s up from 58 percent last year. Ninety-nine percent of the district’s middle-school students who took the geometry end-ofcourse exam passed, too. Statewide, 64 percent of students taking the geometry exam for the first time passed, an 8 percent increase over last year. In biology, the school district ranked seventh. There are 67 counties and school districts in the state. Tracey Miller, executive director of instructional services, said Martin has implemented several programs to help students with reading, which increases performance in all subjects. “Any time you put an emphasis on something, you’re going to improve,” she said. Miller said Martin also uses a lot of progress monitoring, repeatedly giving students the same exams throughout courses. If students don’t improve on exams as their classes cover the subject, teachers know early on to seek remedies. Miller compared it to regularly stepping on a weight scale to measure the effects of food and exercise habits.
Tracey Miller, executive director of instructional services, said Martin has implemented several programs to help students with reading, which increases performance in all subjects. “Any time you put an emphasis on something, you’re going to improve,” she said. “Getting on the scale doesn’t make you lose weight,” she said. “You have to use that information.” DiTerlizzi — whose district includes Palm City, Citrus Grove and Bessey Creek elementary schools, along with Hidden Oaks Middle — said he believes a number of things contributed to Martin’s good performance in the state’s evaluation tests. He said parent volunteerism is an important one. DiTerlizzi said they gave many of the 165,000 volunteer hours at Martin’s schools this school year. “That all goes to tell you the mindset of our community,” he said. “Parent involvement in their child’s education is paramount.” The state is phasing out the FCAT as it’s implementing the Common Core standards and increasing emphasis on end-ofcourse assessment exams. In the 2014-2015 school year, the test that was started in 1998 will be almost completely replaced by one meeting standards for the Partnership for Assessment of Readiness for College and Careers. Some students will still have the science portion of the FCAT. The FCAT replaced the State Student Assessment Test and High School Competency Test. The FCAT became an important component in the state’s formula for grading districts. The department of education has given Martin an A rating for more than a decade. Martin has about 19,000 students in 22 schools, including two charter schools.

MARTIN COUNTY — In May, the Tobacco Free Partnership of Martin County presented its annual Tobacco Prevention Awards to local community leaders at the organization’s quarterly meeting. The Tobacco Prevention Awards are presented each year to groups or individuals who have made an exceptional contribution towards one of the goals of the Tobacco Free Partnership. The 2013 Community Champion Award was shared by Stuart City Commissioner Kelli Glass Leighton and Stuart Mayor Eula Clarke for their work on a resolution encouraging retailers to stop the sale of flavored tobacco products that target children and teenagers. It would appear the Humanists should reach out to individual commissioners and have conversations directly regarding the matter. Often more dialogue is better than less. It is apparent that each Commissioner recognizes that the federal and state establishment clauses respectively were and are intended to protect against government sponsorship, financial support, or active involvement of government in religious activity.

MARTIN COUNTY —Seacoast National Bank has partnered with the Council on Aging of Martin County at the Kane Center to collect donations of pet food. All Martin County Seacoast branches are participating throughout the summer until Aug. 30. Pet food donations will be distributed to homebound seniors who receive Meals on Wheels through the Council on Aging.
“For many seniors, their pets are their only family and their beloved daily companions,” said Cathy Knowles, manager of Meal Services for the Council on Aging at the Kane Center. “Those who are on limited incomes or those who have no transportation often struggle to buy pet food. We want to ensure that the seniors and their pets receive proper nutrition.” Martin County branches of Seacoast National Bank have donation boxes in the lobby

PALM CITY — For 19 years, Palm City Grill has been serving oneof-a-kind dishes with a made-forTV, family-like atmosphere rarely found in real life. Manager Gail Rhine, who’s been with the establishment since its beginning, said she makes it a point to personally welcome new guests and regulars alike.
“It brings a homeyness to the restaurant experience. We don’t like it to be stark,” Rhine said. “During our training one of the owners said he’d like to make this like ‘Cheers,’” and I think we do strive to make that happen.” It’s clear that mission was accomplished and is made evident by witnessing the staff’s interaction with guests. Steven Beers and the establishment’s five owners with instilling its staff of 50 with stellar customer service values. The five also own and run Palm City Grill in St. Lucie West, Prawnbroker Grill, Shrimpers and the Black Marlin, as well as five additional restaurants on Florida’s west coast. “We don’t view our clientele as customers, they’re extended family members that just come home to visit, that’s all,” Rhine said. In fact, regulars receive birthday and anniversary cards with discount coupons. And anyone who’d like to keep up with seasonal appetizers and entrees are included on an emailing list, so they can drop by to dine on their favorite dish. One of those menu rarities customers are alerted to is the mouth-watering Palm City Chowder, which was created right in the back kitchen. The soup is made with shrimp, cream, a splash of sherry and imitation crab meat. Rhine describes it as a seafood bisque with mushroom and dill. A must-try starter is the Palm City Escargot baked in mushroom caps with artichoke heart, roasted red pepper, brandy, garlic butter and mozzarella cheese. The delicacy doesn’t get much better than the Palm City way. One of the restaurant’s most popular entrees is the Horseradish Crusted Grouper. One bite and it’s obvious why. The dish comes with a hearty serving of pan-seared grouper with horseradish, panko crumbs, lemon, orange and lime zest, then topped with vanilla rum butter and flash-fried leeks. The fruity zest makes the dish a great summer meal. The locally caught grouper comes straight from New England Fish Market in Jensen Beach, Rhine said. Other fish on the menu always comes from a 100-mile radius, Rhine said. A recommended side with the grouper is the Tropical Sweet Potato made with whipped sweet potatoes, vanilla, butter, brown
sugar and pecans. Another great entree is the Scallops Beurre Blanc made with pan-seared diver scallops, which are bigger in size than sea scallops. The scallops are served on sautéed spinach, capers, a lemon buerre blanc sauce and diced tomatoes. The colorful dish is also a visual treat. The restaurant also offers an array of craft beers and an exotic wine list. Two years ago, Palm City Grill began hosting a wine tasting once a month during the seasonal months of October through March. Guests are treated to a five-course dining experience paired with different, international and domestic wines for $60$75 per person, service included, said beverage program director, Jason Daniels. Daniels said he uses his Ph.D. in history to educate guests about the process of growing and producing wine. Daniels also teaches guests about the geographic regions each wine originates from. The successful program was launched to broaden the palettes of patrons. The restaurant served strictly California wine before the program was introduced, Daniels said. “It was both in part to broaden our perspective on wine and the staff’s perspective on wine and also to kind of broaden our clientele’s perspective,” Daniels said. Palm City Grill now offers red and white wines from regions including Northern Italy and Australia to South Africa and New Zealand. Arts leagues join forces for summer STUART — Creating art can be a solitary pursuit. One of the great joys for artists is to know that others have enjoyed their work. For the last few years, several arts organizations in Martin County, including the Palm City Art Associates, Hobe Sound Fine Arts League, Art Associates of Martin County and the Jensen Beach Art League, have joined forces to produce a juried exhibition of the best works of their members. The show, entitled “Color Me Creative,” will be on display at the Court House Cultural Center in Stuart from June 14-Aug. 16. The summer show was conceived three years ago when Sharon Ferina of the Art Associates of Martin County, Nancy Steinberg of the Palm City Arts Associates and Carol Kepp of the Hobe Sound Fine Arts League met and decided to coordinate their efforts. They met with the Arts Council of Martin County and became members of the Gallery Committee. A summer art show was planned with members of the three groups; the Jensen Beach Art league joined in the following

year. Artists from member organizations may enter two original works in any medium for consideration by the three judges. They are Nancy Dillen, art professor emeritus at Brevard Community College, Joel Johnson, whose work is on display at the Vero Beach Museum of Art, and Ozzie Monzon, past deputy director of the Elliott Museum. The judges will determine which works will appear in the exhibition. Most of the works displayed will be available for purchase during the show. For Sharon Ferina, the show is a wonderful opportunity for Martin County artists. “We love it,” she said. “It gives local artists a chance to show in this prestigious spot. It’s a colorful summer show and everybody gets excited. There are not a lot of places to hang your art locally. We’ve lost galleries. They will feature an artist, but the average artist won’t have a chance. There are volunteer docents to explain the work. It’s a wonderful opportunity and I’m glad we’ve been able to carry it forward.” While the leagues have joined together for this show, each has individual members who enjoy getting together to discuss art and learn from others.
