TREASURE COAST— The law firm of Lauri J. Goldstein & Associates has filed two suits against attorney Thom-
as Schmitt with allegations of taking between 140 to 170 files when he vacated the Goldstein office and opened up a new office in Martin County. The most recent motion filed on an emergency basis, to be heard on July 21, is trying to
stop Schmitt from representing Goldstein’s clients due to his mental instability and the way in which he acquired the clients. In an affidavit filed from the
TREASURE COAST — A much-awaited announcement on her Facebook page wasn’t getting many likes. Palm City’s K.C. Ingram Traylor ended weeks of speculation on Monday, July 13, and said that she’s not running for Congress. Traylor is co-founder of Florida Not All Aboard, the most visible opposition group to All Aboard Florida. “I spoke a lot with (Congressman) Patrick Murphy, and I think this is best,” she said. The local talk-show host caused a stir that rippled around the state when she previously announced on her Facebook page that she was “deeply considering running for Congress.” Among others, the “Sunshine State News” ran a story about her possible congressional run for the 18th Congressional District. Murphy is vacating the seat to run for the Senate. Traylor’s announcement came as news that federal judge Christopher Cooper nixed a request by Department of Transportation lawyers to dismiss lawsuits filed by Indian River and Martin counties.

PALM CITY – Keri Burgess of Palm City believes that every dog and cat deserves a “forever” home. She has been involved in animal rescue for 12 years and volunteers at Dogs and Cats Forever, a no-kill shelter in Fort Pierce. Burgess has fostered more than 300 orphaned puppies. The real estate professional had flexibility in her hours, which came in handy for puppies that had to be hand-fed. “There’s a real need,” she said. “If the puppies are not homefed, they need to be euthanized. The shelters are not set up for overnight staff. You foster an orphaned puppy for nine-10 weeks and then they go up for adoption. They don’t need hand-feeding for the duration. They’re bottle-fed for maybe three weeks. It’s similar for kittens.” The reason she has fostered so many over the years is that an entire litter is orphaned and she often got six or seven puppies at a

Palm City at the heart of growing CRA battle
A
bout 175 to 200 jammed into the John F. Armstrong Wing Auditorium at the Blake Library for a meeting. More stood in the adjacent hallway. About two dozen spoke that recent Monday evening, most with great passion and many with compelling points. Thunderous applause was the order of the evening. An All Aboard Florida public hearing would probably get as many people and as much passion in Martin County. So would an Indian River Lagoon public hearing. But, this meeting was about the county’s Community Redevelopment Agency, CRA, and its seven community redevelopment areas, including Palm City’s along Mapp Road. The vast majority of speakers urged the commission to keep the program created by the County Commission about 15 years ago as it is. A couple spoke against it. Commissioner Anne Scott, Hobe Sound, disappointed many with two sentences at the end of the meeting. “I came here tonight thinking that we were going to have a workshop and in fact ended up coming to a rally,” She said. “Which is not a waste of time, but it isn’t what I thought we needed to do.” The audience — overwhelming-
Patrick McCallister ly made up of CRA supporters — hissed. Among those who say they were baffled and exasperated by Scott’s words is former commission member Ed Ciampi, who represented Palm City 2008 to 2012 and spoke in favor at the meeting of keeping the redevelopment areas. “(Commissioners) are talking about how they’re frustrated with the federal government not listening to them (about All Aboard Florida and Lake Okeechobee discharges),” he said in a phone interview after the meeting. “They‘re talking about how they’re frustrated with (Gov. Rick) Scott not listening to them. They’re complete hypocrites.” Commissioner Scott isn’t direct-

ly related to Gov. Scott. The County Commission met for a regular meeting the day after the Community Redevelopment Agency workshop — its first — and a few CRA opponents took their turns speaking in a quieter, friendlier forum. “Please take a long hard look at the CRA spending and do what is fair with my tax dollars,” local activist Jackie Trancynger said at the regular commission meeting. Palm City’s Donna Melzer, a former commissioner, said at the meeting she’s made a public-information request for a list of all the CRA projects’ expenditures, but none exists. County staff is attempting to assemble one, Taryn Krizda, county administrator, told Your Voice News & Views. She said projects were not noted to have been CRA-related in much of the paperwork. That, she said, has created a herculean task to satisfy public and commissioner requests for accounting. What is a CRA? The Florida Legislature created community redevelopment areas with the Community Redevelopment Act in 1969. CRAs are special zones that local governments can create to keep some property-tax dollars to fund projects to spur economic development for eliminating blight. The word “blight” carries different meanings in the act than is usually understood. In short, under the act, “blight” means that an area is falling into comparative neglect and is developing more slowly than areas around it. In theory, funded projects entice new businesses and residents into development areas, which increases property values and tax collections. In a development area, county taxes paid on property values higher than what they were the base year — when the area was established — stay in that dis-
trict for economic development and blight elimination. It’s called Tax Increment Financing, TIF. In Martin the amount of that money redevelopment areas retain for projects is between 50 and 95 percent. The commission annually decides the rate. This year the rate is 75 percent. What can be done with that money varies from county to county. It’s often used to adding infrastructure, such as sewage, to an area. Sometimes it’s used for building parks that act as the centerpiece of pedestrian designing. Outside Martin, Tax Increment Financing has been used for funding block parties, such as Holly Hill with Hogs on the Hill. That was an attempt to attract bikers from Daytona Beach during Bike Week. The taxable value of included properties in Palm City’s CRA’s base year, 2002, was about $93.6 million. Today, it’s about $125 million. The redevelopment area will sunset in 2033 if future commissions don’t extend it. Its central aim was creation of the Mapp Road Town Center Design, a New Urbanism plan for a quasi-downtown redesign of the roadway. The Old Palm City CRA extends along Mapp Road to the St. Lucie River from Martin Downs to All American boulevards, along with a western extension along Martin Highway to High Meadow Avenue. In all, the CRA has 610 acres. It has about $1.4 million for projects, such as a recent proposed Mapp Road resurfacing and bike lanes addition the commission nixed in a 3-2 vote in April. That money can go back to the general fund if not used in the Old Palm City development area. CRA opponents have advocated for just that, pointing to the county’s about $250 million infrastructure maintenance backlog as the reason. There are also redevelopment areas in Indiantown, Hobe

Expert Answers to your Health & Fitness Questions Question: What’s the best way to reduce belly fat? I’ve been walking 2 miles every day, but it just hasn’t been as effective as I thought it would be. What do you recommend? Answer: Start strength training 3 or 4 days a week. Most of us are familiar with the concept of weight training for building muscle, but what you may not know is that strength training is a great way to burn calories and target abdominal fat. Lifting weights speeds your metabolism and causes you to burn more calories all day long. Walking only burns calories while you are actually walking. In one study, researchers followed a group of women who lifted weights three times a week for 16 weeks. At the end of that time, the women significantly decreased abdominal fat, increased muscle strength, and significantly lowered their BMI and body fat percentages. Do more strength training and you will have a leaner body and a flatter belly. Question: A friend of mine is in the midst of a two-week break
from all forms of exercise. Are there any benefits to doing this? Answer: You have to remember that, although we don’t typically think of it this way, exercise is a form of stress. And if you’re following a comprehensive training program, you’re probably working out four, five, or even six days a week, in addition to all of your other daily and weekly activities. If this is the case, a one or two-week layoff can be just what your body needs. It will let you recharge, and likely increase your motivation and desire to exercise. The other potential benefit is the
A Closet Full of Clothes
fact that people often come back to the gym, only to find that they are stronger than when they left. Don’t forget, you’re growing and getting stronger during periods of rest and recovery, so this really isn’t all that shocking. If you’ve been training consistently for a long time, give it a try. It certainly can’t hurt! Keep in mind; this does not apply to those who are working out in a more limited way. If you only hit the gym two or three times a week for 30-60 minutes, you don’t need an extended break. Question: I read that Kettlebells burns more calories than any other workout. Is that true? Answer: No, that is FALSE. Kettlebell swings train strength, power, and cardio all in one. That makes them very effective for energy expenditure, but there are plenty of other exercises that also challenge strength, power, and cardio. Some body weight examples include: burpees, plyo lunges, and stance jacks, to name a few. Of course, those come with a higher price to pay for your joints. With kettlebell swings, the
potential energy is transferred to the bell, whereas with burpees, etc., the potential energy is transferred to the body. So, the downside to body weight exercises is the toll they take on your joints. But from an energy expenditure perspective, they both render a high caloric burn. Be leery of any workout that claims to be “the best” for burning calories. The thing to always keep in mind is that you’ll get out of it what you put in to it. Wounded veteran runs for Congress Patrick McCallister STAFF WRITER

he’d like to get Congress considering the idea of expanding upon the Veterans Choice Act, which passed last summer and increased the opportunities for veterans to seek care outside of the VHA. Indeed, Mast would like to see the VHA eliminated and Congress to budget money for veterans to seek healthcare in the community. He said last year’s VA scandal that forced the resignation of Secretary Eric Shinseki is all the evidence needed that VA medical centers are broken beyond repair. “The Department of Veterans Affairs matters a large amount locally, and matters a large amount nationally,” Mast said. There are slightly more than 60,000 veterans in the district, and veterans have an above-average voting rate, so this can become an important election issue. The only catastrophically-disabled, combat-wounded veteran from the War on Terrorism serving in the House of Representatives is Illinois Congresswoman Tammy Duckworth, said Joe Violante, national legislative director of the Disabled American Veterans.

TREASURE COAST — The Hutchinson Island resident is wrapping up his last semester at Harvard studying economics, so he thought it’d be a perfect time to run for Congress. Brian Mast lost his legs to an IED in Afghanistan, but said that wasn’t the end of his service to America. “For me, personally and I think anyone who’s survived, I’d like to believe I was spared,” he said. “I hope that the best defense I can give the United States of America is still ahead of me.” Mast is one of six Republican candidates who’ve announced runs for the 18th Congressional District, which covers St. Lucie and Martin counties, along with a sliver of Palm Beach’s northern side. Incumbent Patrick Murphy is vacating the seat to run for the Senate. Mast said his run for Congress started at Walter Reed National Military Medical Center shortly after he was injured in September, 2010. He said education is his highest political priority. “An issue that’s top to any area of the country is education,” he said. “Education to me obviously has a local effect, but I consider it to be a very real national security (issue).” Mast didn’t expand much on education, saying that he’s still researching. Nevertheless, he said education is a major part of his congressional aspirations. “Locally, education is such an important issue,” Mast said. “It’s what allows someone to advance to the next stage of life.” Mast said issues such as the long-term health of the Indian River Lagoon are tied to education. He said the better educated a populace is, the more likely individuals will understand complex issues and find workable solutions. Another important issue to Mast is the Veterans Health Administration, VHA, the healthcare portion of the Department of Veterans Affairs, VA. Mast said

Usually their immune systems are weakened. Two of my own dogs were orphaned. One has an immune deficiency and the other is fine.” The third of the dogs she and husband Brian own was rescued. Brian found him abandoned with two gunshot wounds. She fostered him back to health and a home was found, but Burgess couldn’t let him go. “He’d been through so much, so I kept him,” she said. Burgess said that there are two important things people need to know about their pets. “The first is that people need to spay or neuter,” she said. “It is the answer to overfilled kill shelters. If people were responsible pet owners, it would change animal rescue. There are enough low cost or free programs. We gave out 125 certificates to Dogs and Cats Forever. There are programs out there.” The second important thing people need to realize is that they must make arrangements for their pets if they cannot care for them any longer.
www.YourVoiceWeekly.com
“There are senior animals that are being surrendered,” she said. “People need to make a plan. We’re an aging population and people are dying prior to their animals with no plan in place. It’s a serious problem. People assume family will take it in. We see it every single week. If it’s a kill shelter, they’re between 12-15 and not really adoptable because of age. Most people don’t want to adopt a 10-year-old dog. We can’t take every one.” Dogs and Cats Forever is in the process of building a Senior Sanctuary for dogs in the shelter who are “aging out” and for incoming senior animals. “It will be a quiet place,” Burgess said. “The dogs get very upset when people walk up and down the halls. It’s a more quiet environment and they’re not interrupted. We haven’t broken ground. It’s still in the planning stages. For older adults worried about what might happen to their pets if they become incapacitated or die, Burgess said that leaving something to a facility to pay for the pet’s care takes some of the burden off the shelter. Burgess cites the example of a pet owner who left her estate to her nephew, but the house went to the shelter, along with the dog. The pet was adopted and the house sold and the proceeds donated to the shelter. Sometimes, volunteers at the
shelter have the opportunity to turn a bad experience into a positive. “I had someone reach out to me two weeks ago,” Burgess said. “There was a blue nose pit bull in Okeechobee. It had been bred to its brother by a backyard breeder. They had shot the brother and were getting ready to shoot the sister. She was nine months old and had had at least three litters. Someone called me. “The owners wouldn’t allow me to come to the home. My main concern was for the animal. I met and picked up the dog in a public area. She’s adorable, but she was in poor health. She’d been overbred. She’s as sweet as she can be. She’s had full medical attention. Her name is Brandi. I’m looking for a foster home. She could be adopted.” These days, Burgess is a manager at ReMax of Stuart and her schedule has less flexibility. While she doesn’t foster anymore, she spends every weekend at the shelter, helping anyway that she can. She has a good reason. “Every dog at the shelter is my dog,” she said. “Every time they get adopted, I get emotional.” Dogs & Cats Forever is located at 4600 Selvitz Road, Fort Pierce. Lung cancer is the number one cancer killer. Symptoms usually appear in the latest stages, when it is the deadliest. Low-dose CT lung cancer screening programs for current and former smokers can detect lung cancer at the earliest stages before symptoms appear, improving the cure rate to as high as 90 percent.

CRA from page 6 Sound, Jensen Beach, Port Salerno, Rio and Golden Gate, in Stuart. Why are CRAs controversial? Shortly after the current commission members took their offices in late 2012 they disbanded the Community Redevelopment Agency and assumed its duties. Additionally, the commission disbanded the neighborhood advisory committees, which propose and evaluate projects to recommend to the commission acting as the redevelopment agency. The commission later reformed the committees, including the Old Palm City Neighborhood Advisory Committee. The public comments at the regular commission meeting led to a heated board discussion.
Commissioner John Haddox emphatically defended the community redevelopment agency and areas. He said community sentiment clearly favored them, as was seen at the Monday evening workshop. “The community spoke loud and clear last night,” he said. But, folks such as Ciampi believe the controversy swirling around the agency and areas is manufactured by people who want to discourage any growth in Martin County. Ciampi said he supported dividing the duties of the Community Redevelopment Agency — which considers neighborhood advisory committee recommendations — from the commission. Under the arrangement, the redevelopment agency made recommendations to the commission after hearing from

the neighborhood advisory committees. “I was part of the commission that voted to create the (Community Redevelopment Agency),” Ciampi said. “Sarah (Heard) fought that tooth and nail.” Heard also voted against reconstituting the neighborhood advisory committees in 2013. In recent months, Heard, who represents Port Salerno, has been the most vocal CRA critic on the commission. At the regular commission meeting, she made her strongest recent statements yet against them. “I’m not ignorant,” Heard said. “I understand the genesis of the CRAs and I understand why the boundaries were drawn the way that they were.” Heard added, “I understand that one of the purposes of the CRAs was to get out

from under the regulations of the (Martin County Comprehensive Growth Management Plan).” The commission adopted the Comp Plan, as it’s popularly known, in 1990. It’s the guiding document for development in Martin County, and is unusually stringent. In a talk after the meetings, Haddox said he simply doesn’t believe the community redevelopment areas are an end run on the Comp Plan regulations as critics claim. “I don’t think it was an intentional way to get around the Comp Plan,” he said. “It’s in the Comp Plan. I don’t believe someone said, ‘Let’s put this in the Comp Plan, so we can do this, this and this.”

MAST from page 8 “We have a few combat vets, but I know none of them (besides Duckworth) are missing any limbs,” he said. “Besides Tammy, I don’t think there’s (any veteran with disabilities) from the current wars.” Congress has shifted over the years from being veteran dominated. About four decades ago nearly 75 percent of congressmen were military veterans. Congress now has 81 representatives who served in the military, or about 18.5 percent. There are 13 members of the Senate who served in uniform. There are about 21.2 million veterans in the U.S., or about 7 percent of the population. Florida has four veterans serving in the House: Vern Buchanan, Ron DeSantis, John Fleming, and Richard Nugent. Of them, DeSantis is the only one who served after Sept. 11, 2001. Senator Bill Nelson is also an Army veteran. The congressional district covers St. Lucie and Martin counties, along with a sliver of Palm Beach County’s northern side. The district has a Cook Partisan Voting Index, PVI, of R+3. Florida’s rating is R+2. The R, of course, standing for Republican. Florida’s 22nd District, just south of the 18th District, has a D+3 rating. The D, again of course, meaning

Democrat. Any Cook PVI score between R+5 and D+5 is counted as competitive. The “Rothenberg & Gonzales Political Report” puts the seat into its pure toss up category for 2016. It’s one of only 10 congressional districts to get that rating nationwide. On the Republican side, Martin County School Board member Rebecca Negron, St. Lucie County Commissioner Tod Mowery, along with former State Representative Carl Domino, Mast, Paul Spain and Rick Kozell have all announced candidacies. The Florida Division of Elections lists only Domino and Negron on the Republican side, so far. Others are expected to join the Republican primary field. On the Democratic side, Stuart’s John “Juan” Xuna, Palm Beach Garden’s Johnathan Chan and two Palm Beach County commissioners are running. The commissioners are Melissa McKinlay and Priscilla Taylor. Xuna is the only Democratic candidate the state lists so far. Mast is a recent Treasure Coast resident. He resided in Broward County until finding a home in Martin County recently. He said that his family has been looking to relocated to the Treasure Coast for a couple years. For more about Mast, see his Facebook page, or visit www.mastforcongress.com.

Nature loving student earns a week at sleep-away camp FOR YOUR VOICE NEWS & VIEWS
PALM CITY — Last fall, Piper’s Landing Garden Club held an essay contest for students at Palm City Elementary School. The winner was awarded a one-week scholarship to Wekivia Youth Camp, a sleep-away nature camp near Orlando run by the Florida Federation of Garden Clubs. Palm City Elementary student Mallory Schweitzer was the lucky winner, and in early July members of Piper’s Landing Garden Club gave her an official celebratory send-off, with the goal of sharing their love of nature with our future generation. The Piper’s Landing Garden Club coordinated the sponsorship with Palm City Elementary School, specifically with Science Teacher Mrs. Bullock, Principal Mrs. Marin and Guidance Counselor Ms. Freese, to evaluate and select a student who would most benefit from Wekiva Youth Camp. Students were asked to submit an essay detailing why they wanted to attend Wekiva Youth Camp. Mallory was the first student to submit her application and was
soon selected as the recipient of the youth camp sponsorship. “As summer drew near, we all eagerly anticipated the camp and the adventure that Mallory would soon embark upon,” said Elaine Matts, member of Piper’s Landing Garden Club. “Finally, the big day arrived and we sent Mallory off with hugs, a few fun gifts, and lots of joyful wishes. We now look forward to her return so she can share with us all of the knowledge she acquired during the week she attended this very special and unique camp.” Wekiva is a sleep-away nature camp, located within Wekiva Springs State Park in Central Florida, designed to instill a love and respect for Florida’s natural environment through education, conservation and preservation. The Florida Federation of Garden Clubs, of which Piper’s Landing Garden Club is a member, sponsors Wekiva, making it the camp of choice for garden club sponsorships statewide. Nightingale Options built on nursing hope STAFF WRITER
pmccallister@YourVoiceWeekly.com
TREASURE COAST — Yvonne “Sue” Stutzke describes her business in one sentence. “I help people age at home if that’s what they want,” she said. To understand Nightingale Options, you have to start with Sue. She’d raised her children and was looking to give her life new air. “I always wanted to be a nurse,” she said. “I have a supportive husband. At age 40, I went to nursing school and loved it.” She graduated in 1993 and saw a need for a healthcare option on the Treasure Coast. “I really felt there was a need for private-duty (nurses) taking care of people in their homes,” she said. There were already folks doing the Medicare variety, which was
usually short-term. Sue worked for such a company. In 1998, she opened Nightingale to give folks more ways to get healthcare and help at home. Sue said what Nightingale really does is give people the chance to live to the fullest just as they are. “No matter what age you are, you can have hope if you have supportive people who care,” she said. “One of the greatest things we give people is hope.” Sue is inspired by Mother of Modern Nursing, Florence Nightingale. The Victorian British woman revolutionized nursing starting at the Crimean War field hospitals, where her institution of hygiene practices, such as handwashing, is credited with greatly reducing death rates. She’s pictured as The Lady with the Lamp, the image of her checking on wounded soldiers at night. The Times famously wrote:

In an interview, Heard said that she doesn’t advocate eliminating the redevelopment agency or areas as her critics charge. “I don’t object to the CRAs,” she said. “They’re not working the way they’re supposed to be.” Heard said she’d like to shrink the size of the redevelopment areas. She pointed out that the western extension of the Palm City CRA, along Martin Highway, makes no sense to her, and suggested it was a “tax grab.” Additionally, Heard said she’d like a clearer accounting of redevelopment agency expenditures. The commission already must approve them. Haddox said that the CRA supporters delivered a message with consequences at the recent workshop. “(Opponents are) backing off and figuring out that they can’t kill the CRAs,” he said. “It’s too political.” What’s next for CRAs? Perhaps recent battles over the county-funded Business Development Board of Martin County provides a blueprint for what may happen with the Community Redevelopment Agency and areas. In 2013, commissioners seemed poised to shut off funding to the BDB.
“We should put our foot down and do it today.” Commissioner Scott, said at an April 2013 commission meeting. A 2009 contract started the BDB at $625,000 a year and by 2013 it was up $643,000, due to contractual increases. None of that sat well with the commission after the 2012 elections. Members were uptight that the contract provided no visible accountability for the BDB to show what it was accomplishing with that $643,000. In a 3-2 vote, the commission suspended contractual payments to the business board. Haddox worked with business board opponents and supporters to work up a compromise. By December the county and board inked a new contract worth $430,000 the first year. That dropped to $340,000 in the second and $260,000 in the third years. Additionally, the county agreed to match some private funding the BDB developed in the second and third years to a maximum of an additional $100,000 a year. The aim was to ultimately remove the BDB from the county’s general-fund budget. The county gets about $260,000 in occupational license fees a year, and the commission hopes to make that the exclusive source of the BDB’s funding.

protectors of our beaches and waterways,” said Craig Ahal, KMB president. “It is always inspiring to go to different sites during this coastal cleanup and see the mass of people with garbage bags, gloves, pick-up sticks and data cards, combing the coastal waterfront and beaches and removing debris that can cause harm to marine life. It’s an important task and wouldn’t happen without the support of our volunteers.” The cleanup efforts are a vital part of motivating people to do something tangible in their community — to remove trash and debris from beaches and waterways. More importantly, the cleanup educates people to become aware of the problems associated with litter and challenges citizens to change the behaviors that cause the pollution in the first place. Last year, over 2,000 KMB volunteers removed more than 41,000 pounds of litter and marine debris from our shorelines. “Every piece of trash that is picked up during the cleanup should be a challenge for change,” said Allison Schutes, marine debris specialist of Ocean Conservancy’s Trash Free Seas program. “The trash that tops our top 10 list every year — things like cigarette butts, bags and bottle caps — include disposable plastics meant for one-time usage. These items simply do not belong in our natural environment.” Groups and individuals are welcome to join the cleanup effort at Stuart Beach, but KMB encourages volunteers to sign up in advance to clean the beach or waterway of their choice to ensure clean waterways all over Martin County. All volunteers are invited to attend a volunteer appreciation party at Stuart Beach from 10 a.m. to 12 p.m. to thank volunteers, sponsors and community supporters. The event will feature food, drinks and family-friendly

“The background scoop is the government and All Aboard Florida joined in to dismiss our lawsuit and the judge denied that pending discovery,” Michael Durham, Martin’s county attorney, said in a telephone interview. What that means is All Aboard Florida will likely have to turn over financial reports critics have long wanted public. Martin was the second county to take legal action against the federal government related to All Aboard Florida, the proposed high-speed passenger rail that would stretch from Miami to Orlando mostly on existing Florida East Coast Industry tracks. The route cuts a swath through the Treasure Coast, but the train isn’t slated to stop here. Last year the company submitted an Environmental Impact Statement to the Federal Railroad Administration as part of the process for securing an about $1.5 billion Railroad Rehabilitation & Improvement Financing loan from the federal government. In late December, the U.S. Department of Transportation gave All Aboard Florida permission to sell about $1.75 billion in bonds that would be issued through Florida Development Finance Corp. bonds haven’t been approved by the state agency yet. There are numerous reports that the FDFC might discuss All Aboard Florida’s request to sell the private activity bonds later this month. That would be at a July 21 meeting at the Enterprise Florida Orlando office, 800 N.
Magnolia Ave., Suite 1100. However, Beth Frady, director of public relations at Enterprise Florida, said the reports are wrong. “It’s not going to be on that agenda at all,” she said. Those proposed private-activity bonds are at the crux of Martin County’s lawsuit against the U.S. Department of Transportation. In legal filings the county claims that the department acted beyond its authority by giving permission for their sale. In February the County Commission created a $1.4 million fund for battling All Aboard Florida. In April Durham gave permission to pull up to $250,000 from the fund to hire McDermott Will & Emery, a Washington D.C. law firm. The day before Martin created its fund, the Indian River County Commission created a $2.7 million fund. St. Lucie County created a $500,000 fund in May. Eric Gill, St. Lucie’s public information officer, said the county retained environmental lawyer Segundo Fernandez with part of its fund. Fernandez recently presented the County Commission with a 500-page report about the anticipated affects All Aboard Florid would have on St. Lucie. “What they did was go through the (Environmental Impact Statement) and came up with a little more then 500 pages of issues we feel need to be addressed before the project moves forward,” Gill said. Gill said that the commission is poised to join other counties in filing suits against federal agencies if they’re needed.

MARTIN COUNTY — There is good news coinciding with the 2015 hurricane season. For the first time since its creation in 1993, the Florida Hurricane Catastrophe Fund (CAT Fund) has enough liquidity to cover the $17 billion statutory coverage, according to state data released last month. Claims paying estimates provided to the CAT Fund Advisory Council show the program will have $12.8 billion in cash on hand at the end of 2015. Two years ago, the CAT Fund began transferring risk and now has $4.2 billion in pre event bonds and private reinsurance; providing the $17 billion capacity to pay claims for the 2015 hurricane season. We, as most local chambers of commerce, led by the Florida Chamber of Commerce have supported transferring risk to the
private reinsurance market to aid in the fiscal health of the fund. However, it’s not over — there’s more work to be done. According to the data, while the CAT Fund is now in a better position to protect insurers from their initial season of losses, it could still experience trouble if a second season of storms occurs. The claims paying estimate data released last month did examine the fund’s capacity for a second season of storms. The report assumes that the fund would not use pre-event bonding in the first season, and instead would turn to the market for bonds leaving the pre event bonding to finance a second season of storms. The estimated bonding capacity of the CAT Fund is $7.7 billion, which is down $600 million from the October 2014 estimate. This would allow the fund to pay only 69 percent of its obligation for the

Thomas Schmitt led to the voluntary suspension, but Goldstein accepted responsibility because she was his supervising attorney. The Tuesday hearing is for an emergency motion for leave to protect clients. A telephone receptionist at Kogan, DiSalvo & Schmitt said Schmitt is no longer with the firm. In a short telephone interview, Schmitt said he’d worked with attorney Lauri Goldstein for five years and lost confidence in her. Goldstein said, “I am saddened by the lies that have been said about me and the betrayal of a colleague but I am staying strong for my family and my clients.” She continued, “If any of my old clients have any questions or would like to hear the truth, I would ask that they call me.”

Goldstein’s petition a former client of Schmitt, James Holding, stated “(Schmitt) acted like he was ‘spaced out’, ‘His eyes appeared as he was or had been doing illegal drugs.” Michael Pike, of Pike & Lustig, is representing Goldstein & Associates. In court filings, the firm claims that Schmitt has a documented history of unstable actions indicative of mental-health issues, bankruptcy and restraining orders. He abruptly left it in March. The filings read: “Schmitt’s wife had him Baker Acted the week of June 22, 2015 whereby the Martin County Sheriff’s Department placed him in a Sheriff’s vehicle and Schmitt was thereafter admitted to Port St. Lucie Hospital.” Baker Act is a shorthand for the Florida Mental Health Act of 1971 which permits law-enforcement officers to transport subjects they feel could be a threat to themselves or others to designated mental-health facilities for evaluation and possible reference to civil court for involuntary treatment. In a press release, Schmitt said, “While it’s true that my estranged wife, who has suffered herself from severe psychological problems most of her life and has been in treatment for many years, did attempt to have me committed involuntarily.” In the press release, Schmitt notes that while he could have been involuntarily held for evaluation up to 72 hours, he was released within 24. Additionally, the suit alleges that Schmitt took numerous clients with him with unethical, and possibly illegal, methods. The suit also alleges that Schmidt covertly arranged to move attorneys, paralegals and cases to a new firm, Kogan DiSalvo & Schmitt. “The value of cases is in the millions of dollars,” Pike said in a telephone interview. In 2013 Goldstein accepted a voluntary 91-day suspension after a Florida Bar Association investigation started in 201l. The investigation was into Goldstein taking the case for a Port St. Lucie woman who’d fallen at a Long John Silvers in Kentucky. The firm wasn’t licensed to practice in Kentucky, and also missed filing deadlines. In the recent suits against Schmitt and others, the Goldstein firm claims that Schmitt was responsible for the case that

that these horses are all rescues, many of whom arrived in terrible condition, underweight, suffering with nutrition issues and in need of a lot of love and special attention. Recently ERAF rescued three horses that were slaughter-bound. They were literally on trucks headed to the slaughterhouse when word reached board members of ERAF of their impending death. Arrangements were quickly made to transport them to ERAF. Because of this, the mission of ERAF has been expanded to specifically include slaughter-bound horses. The original mission specified abused, abandoned and neglected horses. Once the horses are at ERAF, they receive all the necessary veterinarian care, nutritional support, grooming, dental care and training to rehabilitate them. In many cases, the horses have been so poorly treated that they no longer trust humans and often have severe behavior issues.

“She is a ‘ministering angel’ without any exaggeration in these hospitals, and as her slender form glides quietly along each corridor, every poor fellow’s face softens with gratitude at the sight of her. When all the medical officers have retired for the night and silence and darkness have settled down upon those miles of prostrate sick, she may be observed alone, with a little lamp in her hand, making her solitary rounds.” Sue said what makes Nightingale’s story more remarkable is 772-465-8110 the medical and social reformer could have lived a life of leisure. “She came from a very wealthy family and she chose to give her life to taking care of people,” Sue said. In her hero’s spirit, Sue has her business and associates involved at the Charles & Rae Kane Center, Stuart, home of Martin County’s Council on Aging. “We take care of some of their clients through grants at a reduced rate,” Sue said. Through her work Sue knows the struggles of families with Alzheimer’s. One of the loneliest aspects of the disease, she said, is it becomes increasingly
difficult for families to enjoy a simple dinner out. “At Christmas time, we give a sit-down dinner for all the adult daycare (clients) and their families,” Sue said. Sue also likes talking to groups of women when she can. “I like to encourage women,” she said. “If they have a dream, it’s never too late to do it.” Sue graduated at the top of her competitive nursing class. Her business — that didn’t come easy either. “This isn’t a franchise,” she said. “I didn’t buy a package.” Rather, Sue did what she’s extraordinary at — she listened and built a business on what clients told her. Nightingale, which directly and indirectly employs about 175 through its various services, serves Indian River, St. Lucie, Martin and Palm Beach counties. The company can help folks a few hours a week, or 24 hours a day, for a few weeks, or years. It’s at 8134 S.E. Federal Highway, Hobe Sound. “We’ve taken care of people for 10 years or more,” she said. “Many people are making the choice that they want to stay at home (as they age).” For more, visit www.nightingaleprivatecare.com, or call (772) 245-8390.

ST. LUCIE WEST/TRADITION
Summer at Lyric stays cool STAFF WRITER
skoppel@YourVoiceWeekly.com
STUART – It’s summer in the city and there aren’t as many entertainment opportunities around as there are during the season. The Lyric Theatre is doing its part, with several events for hot summer afternoons or evenings, including more entries in the Art Cinema series, an appearance by singer Taylor Dayne and a late-summer concert by the Southern rock group, the Outlaws. On July 23, the Lyric will hold a screening of “Life Itself.” This documentary, based on the Roger Ebert memoir, is directed by Steve James, director of “Hoop Dreams,” and produced by directors Martin Scorsese and Steve Zaillian. It recounts the world of the famed film critic and social commentator, from his days as a Pulitzer-prize-winning film critic for the Chicago Sun-Times to his battles with cancer that took away his speech but not his love for life. The film runs 120 minutes and was a selection at the Cannes Film Festival. July 30 brings “5 Flights Up,” starring Diane Keaton and Morgan Freeman and based on Jill Ciment’s novel, “Heroic Measures.” The two Oscar winners teamed up for the first time in this Richard Loncraine film about a long-mar-
ried couple who live in a Brooklyn apartment that’s a five-floor walkup. When they discover that it is getting harder to walk up the stairs, and find out how much their apartment is worth, they decide to sell it and move to Manhattan. Cynthia Nixon plays a real estate agent who introduces the couple to the reality of Manhattan real estate as the couple discovers just how little $1 million buys. The 92-minute film is rated PG13. It was an official selection at the 2014 Tribeca Film Festival. Trailers for both films are available on the Lyric website. The Lyric Film Society makes these films possible, and Film Society memberships are available for $100 annually. These entitle members to discounted tickets at $6. Supporting memberships at $250 provide one free ticket to all films. Pop star Taylor Dayne, who has sold more than 75 million singles and albums, will headline Dancin’ in the Streets on the Lyric stage Aug. 22. The Grammy-nominated artist is also a songwriter, having co-written the Tina Turner hit, “Whatever You Want.” It’s a complete change of pace when the Lyric welcomes the Outlaws Aug. 29. The group has gone through several incarnations, losing founding members Frank O’Keefe, Billy Jones and Hughie
