TORINO — Torino residents are crying foul after the Port St. Lucie City Council reversed its decision to deny the construction of a detox center in their neighborhood by accepting a settlement offer with the facility’s developers last week. During its March 10 meeting, council voted 3-1 to settle a lawsuit with Neurogenix Inc. and Another New Life, paving the way for a 70-bed facility drug and rehabilitation facility to be built on a 3.93-acre property located at the northeast corner of Northwest East Torino Parkway and Zenith Drive. The city will not have to pay the plaintiffs’ legal fees if it approves the plan, the settlement agreement states. “We’re moving. We wouldn’t recommend anybody live here ever again,” Torino resident Matthew Brady said at meeting’s end.

PORT ST. LUCIE — A second judge in the Ron Bowen case has recused himself. On March 17, Judge Phillip Yacucci, citing reasons that he knows Mayor Joann Faiella and Ron Bowen personally, said he cannot be Ron Bowen impartial. Yacucci recommended Bowen’s defense find a new judge outside of the county. A new judge and hearing date will set for Bowen’s motion to dismiss will be scheduled in the next couple weeks. ST. LUCIE WEST — A former St. Lucie West Centennial teacher accused of providing and doing drugs with a student was

placed on probation after pleading no contest on several misdemeanor charges last month. Elizabeth Hatzidakis, 33, will serve a year of probation, 100 hours of community service, undergo random drug tests and refrain from contact with her former student. The former lan-

guage arts teacher was arrested on Jan. 31, 2013 and resigned from her position shortly after, Hatzidakis’ Stuart lawyer Barbara Kibbey said. The three misdemeanor charges included contributing to the delinquency of a minor, possession of 20 grams or less of marijuana

and possession of drug paraphernalia. Kibbey said her client is happy to put the case behind her. “She’s extremely happy to have this resolved,” said Kibbey, who added that Hatzidakis is cur-

speak English, but I am not an Englishman, I am not a Canadian, I am not an Australian nor a New Zealander. My nationality and culture is American. So why is a Cuban, Mexican, San Salvadoran, Argentinian, etc., who speaks Spanish called Hispanic? Our government has conveniently put all Spanish-speaking groups into one category. This grouping is causing each to lose its unique identity and be stereotyped in America. Each group has its own unique culture and nationality and all are not Spanish, per se. We should allow these groups to be proud to say where they are from and identify themselves as such. Each group has a unique culture to bring to America. Past immigrants have infused their culture into America, which gave American a culture of diversity. This cultural diversity did not divided us, but made us unique and have developed into one people called Americans’ It is the hope that some persons or organizations take up the banner and allow these immigrants, including their natural born children, to keep their identity and culture and be assimilated in the American culture as all past immigrants have done before. At a Sept. 23 meeting, the council unanimously shot down the plans. The city’s planning and zoning board also denied the project earlier that month by a 5-2 decision. Project developers filed a lawsuit against the city in December. The city, Councilwoman Michelle Berger and Mayor JoAnn Faiella were listed as defendants. The lawsuit sought an unspecified amount of monetary damages due to discrimination under the Americans with Disabilities Act and the federal Fair Housing Act, court documents stated. The site plan met rigorous criteria to

receive a special exception on the institutionally zoned land, but was denied anyway, the lawsuit stated. Recovering drug and alcohol addicts are considered disabled under the Americans with Disabilities Act and are protected under the federal Fair Housing Act. That means there is little a local government can do to stop a sober or group home from opening in a residential area. It also gives municipalities little recourse to deny a detox treatment center on an institutionally zoned lot without being sued. The founder of New Life Addic-

tion Treatment Center will be building the center. New Life currently has six sober homes in the city. The complex will include a 30-bed detox and a rehabilitation center. The first phase is a 9,900-square-foot, one-story building with 30 beds, where patients will stay five to seven days to detox from drugs, planners representing New Life Center said. The second phase is a single-story 14,000-square-foot, 40-bed facility. Group or sober homes do not need approval from the planning and zoning board. But detox and convalescent homes do. The plaintiffs’ West Palm Beach attorney, James Green, said the council made the right choice. “I think the three commissioners in favor of the settlement had the best interest of the city at heart,” Green said. “I wish there were a better way to educate people about why we need substance abuse treatment.” “I think a lot of people have a fear of that which they do not know or understand.” The project will go out to bid soon, but Green couldn’t provide a timeframe. Berger said after consulting outside counsel on the matter, she had no other choice but to settle. “For me, there is no alternate ending here. This isn’t like a story from Disney where we can pick a different ending,” Berger said. “It’s pretty linear. It goes to one ending and it was just a matter of when we get there.” Councilwoman Shannon Martin was not present. The dissenting vote belonged to Faiella. The mayor made a recent trip to Wash-

ington, D.C., where she lobbied the House to draft legislation that grants municipalities more control over where detox centers are built. “I will not be supporting this tonight only because I would feel like a hypocrite because here I am going to Washington,” Faiella said. “I don’t feel like I’m breaking the law. I’m all for rehabs. I think they do help, I just don’t feel like where it’s going in is an appropriate place.” Torino residents said they felt duped by the rest of the council. “We feel that we have been betrayed. We feel that an agreement was reached at the last council meeting,” Norman Pratt said. “An agreement is a binding exchange whether it is written or oral. All voted a unanimous decision, yet we’re back today reconsidering that decision.” A March 3 memo from Pam Booker, the city’s senior assistant attorney, to city manager Jeff Bremer, said litigation expenditures could range from $500,000 to $3.2 million. Residents called the city’s legal staff incompetent during public comment. “I’m here today to express my outrage and disgust at the dealings that have transpired coming out of city hall,” Armando Rodriguez said. “I reviewed the proposed settlement, and can honestly say that we have the worst attorneys on our staff known to mankind.” Residents vowed to forge on with the fight, threatening a lawsuit of their own. “We will fight. We will sue. We’ll sue not only the facility, but the city,” Diane Goldberg said.

ST. LUCIE WEST — Brandon Berry, a 2006 graduate of St. Lucie West Centennial High School, learned valuable lessons from his experience as a high school football player. A good student, as well as an athlete, he expected college recruiters and coaches to snap him up. His parents paid a national recruiting firm, but even that was not successful. Berry found his own way to

LaSalle University in Pennsylvania, which had a Division I football program. Unfortunately, the school decided to scrap the program, leaving Berry, a freshman, and the other athletes on their own. “LaSalle said they’d honor the freshman year admission,” Berry said. “I came back to the Treasure Coast and sat down with my family. Other schools were calling (LaSalle players), but it put such a bad taste that I was not ready to go back. I trained my focus on my younger brother.” Berry helped younger brother Jesse, a 2010 Centennial gradu-

Jesse Berry will graduate next year with a degree in criminal justice. “If football were gone tomorrow, the school fits him perfectly,” Brandon Berry said. Berry has taken his experience with his brother and turned it into All Out Recruiting. His goal is to help student athletes in all sports to find a place where they can thrive. “The majority of kids say they went to a school for the size or reputation, for the athletics,” Berry said. “Sports are done for everyone, but the degree is for the rest of your life. They need to ask, ‘What’s the class size?’ Does it have the programs they want?’” Before he signs a client, Berry meets with the parents and student. “I want to make sure we’re all on the same page,” he said. “The parents pay for the service and the whole family must understand what’s going on. It’s all about finding them a home for the next four years by making sure they don’t base the decision (solely) on athletics.” Prospective students must and have their academics in order for Berry to take them on. “We can get them into tutoring,” he said. “Most of the time, the kid is capable but they’ve been lazy. We don’t sign until their grades are where they need to be. We also provide SAT and ACT prep.” Berry’s clients work at a private gym with friend Jake Padrick, a former high school teammate who is now All Out Recruiting’s strength and conditioning coach. The program builds strength, speed and mental toughness

on a level they will encounter at college. Berry prepares player profile sheets and highlight videos to submit to schools. He is in touch with colleges throughout the year and sometimes they will contact him about the need for a player at a particular position. Building relationships with colleges is important because the Treasure Coast is not a major recruiting area. Most recruiters tend to go the Miami/Dade area, where there are far more high schools in a smaller geographical area. “Our biggest thing is exposure,” Berry said. “It’s to make sure coaches know they’re here.” Berry’s business has grown though the use of social media and word-of-mouth. He puts his success stories out there and other student athletes contact him. For Brandon Berry, the goal is not how many schools in a particular division he’s managed to place. It is about how many students he’s placed who are going to thrive where they are, even if the unthinkable happens and football disappears. Ned Schuster, publisher of Treasure Coast Sports Journal, follows high school sports in the area. He is impressed with what Brandon Berry does. “He is a great guy,” he said. “He has done a lot for kids all over the Treasure Coast. I can’t speak highly enough about it. I’ve seen him work with kids to get them into schools. the first judge assigned to the case. Previously, the judge presiding over the suspended Port St. Lucie city councilman’s misdemeanor case for an alleged open records law violation recused herself from the case. During a hearing in a St. Lucie County courtroom the morning of Jan. 31, Judge Kathryn Nelson removed herself from the case because of a close friendship with Nora Pffeifer, a lead investigator for the state attorney’s office. Pffeifer was on the defense’s witness list on a motion to dismiss hearing, scheduled for that day. “We’ve been friends since 1990. We’ve traveled together, we’ve been on vacations together,” Nelson told the court. Bowen was present in the courtroom, but had no comment on the case. The case will be reassigned to another judge, which could take a week, Bowen’s attorney, Richard Kibbey said. The motion to dismiss the case will be brought before the new judge, Kibbey said. Bowen’s attorney filed the motion last month. “We’re confident we’re going to win the hearing and if we don’t,

TREASURE COAST — The Treasure Coast community is fortunate to have many citizens with a shared commitment to charitable giving. Nothing exemplifies this more than the philanthropic efforts of the residents of Harbour Ridge Yacht & Country Club. At their recent fundraising gala in February, the Harbour Ridge community raised more than $75,000 for SafeSpace, a local nonprofit organization and the only certified domestic violence outreach center on the Treasure Coast. This marks the sixth year that Harbour Ridge has hosted the event to raise funds for SafeSpace — all totaled Harbour Ridge residents have raised more than $600,000 for the organization through this annual effort and charitable endowments. The event is coordinated by the residents in Harbour Ridge, who not only organize the logistical details but also provide sponsorships and donate silent auction items, such as vacation stays and original artwork created by members. Event co-chairs, Karen Boyle and Kathleen Powell, along with committee members, Susie Chase, Dot Coblentz, Sandi Dahl, Diane Greenawalt, Lynn Greenho, Hardy Mowry, Carol Weissman, and Barbara Wolff, coordinated the event that included dinner, a silent auction, and entertainment by renowned concert pianist, Hyperion Knight. “The event sells out every year,” said Harbour Ridge resident and Committee Chair, Karen Boyle. “Our members are passionate about supporting SafeSpace, an organization that provides critical services for our community.” Harbour Ridge has a long history of supporting SafeSpace that started when residents began collecting items for the women and children at the SafeSpace shelter. The relation-

ship was solidified when Harbour Ridge residents Douglass and Patricia Stewart donated $1 million and encouraged their friends to help pay for a new SafeSpace shelter that opened in April 2008. SafeSpace operates programs in Martin, St. Lucie, and Indian River counties where families are provided with a safe environment through emergency shelter and outreach services. Hatzidakis was also charged with one felony count of possession of oxycodone. If Hatzidakis completes a drug diversion program she is currently enrolled in, the charge will be dismissed. The investigation began when the St. Lucie County Sheriff’s Office was contacted by the student’s father. A sheriff’s investigation revealed Hatzidakis purchased drugs from the student and used drugs and drank beer with the student at her home. A warrant affidavit stated that the 17-year-old boy had been supplying Hatzidakis with prescription pills since June 2012. “The activity began at school with simple flirtation between him and ‘Mz. Hatz’ and eventually turned into daily text and phone conversations between the two,” according to the affidavit. The boy said on June 13, 2012, he picked up 30-mg Oxycodone pills for Hatzidakis. Oxycodone, referred to as “Blues” on the street, is an oral medication

ST. LUCIE WEST — Autopsy results on a body found floating in a retention pond in a St. Lucie West apartment complex last week are incomplete pending the results of a toxicology report, which can take several weeks, police said. An autopsy on the body of Jakiya Gordon, 24, was performed on March 10 by a St. Lucie County medical examiner, who found no signs of trauma or evidence of foul play. Gordon’s body was found floating in a retention pond on March 8 in the Sanctuary Apartments located on Northwest Rabbit Run Way in St. Lucie West. Gordon, who was staying with

friends at the complex, was last seen on March 3 by a friend, Port St. Lucie Police Master Sgt. Frank Sabol said. “Gordon and some friends were hanging out,” Sabol said. “He went out to smoke and for whatever reason, never came back.” Sabol believes Gordon’s body was in the pond for several days, possibly since the day he went missing. “It’s not an accurate science, but the medical examiner said (Gordon’s body is) consistent with a few days in the water,” Sabol said. A criminal records search in St. Lucie County shows Gordon was charged with a misdemeanor count of petty theft in 2010 and was sentenced to a maximum confinement of 45 days and 83 hours of community service. Until the toxicology results are in, the investigation will remain open.

The lecture will inform attendees about common invasive ornamental plants, and offer alternative Florida native plants for use in landscapes. Wilson has 26 years of experience in teaching and research. A national award-winning educator and research scientist, her research is widely published in prestigious scientific journals. Her research focuses on characterizing the invasive potential of ornamental plants and prop-

TRADITION — Aldo Burga has been playing tennis most of his life. The Lima, Peru native came to the United States in 1987 on a tennis scholarship to Indian River Community College, as it was known then. He was a worldranked junior player, standing in the top 10. For the past 22 years, he has been a teaching pro at The Legacy Golf & Tennis Club

and for 18 years, he has been the director of the tennis programs there. The Tradition resident has continued to compete, as well as teach. He has been named a Florida Division Player of the Year by the United States Professional Tennis Association and captured the group’s national singles title in the Men’s 40 division in 2009. Burga has trained with top professionals including Jennifer

The tennis star was studying at IRCC when back problems halted his professional career. He went on to earn an associate degree from Palm Beach Community College and a bachelor’s degree in history from Florida Atlantic University. “I always have my nose in a book,” he said. “I’ve read all of the ‘Game of Thrones,’ books and I’m also a political junkie.”

Teaching tennis has become Burga’s focus. His youngest student is 5 and his oldest 90. “She’s amazing,” he said. “I work with everybody. I make people feel they can enjoy it and make improvements and get some exercise.” Burga’s students are not limited to Legacy residents. He works with many junior players and said that the Treasure Coast has an abundance of talented juniors. Many are from area high schools, including South Fork in Stuart and John Carroll and Lincoln Park Academy in Fort Pierce. Burga runs a junior summer camp for kids from 6-16.

“Kids come all day Monday to Thursday,” he said. “We play tennis, go swimming and play more tennis. There are juniors from all over the area. Everyone is welcome to attend. We take kids from beginners to tournament players.” Burga said the Treasure Coast is a great area for tennis professionals. He works with fellow professionals Dan Caragata and Mike Birzon at Legacy, and he has good relations with pros from other clubs. “There is a small, close community of teaching professionals on the Treasure Coast,” he said. “We help each other. We had a benefit

for the American Cancer Society and raised over $8,000 with teaching pros from the area.” Burga said tennis has changed a great deal in the last 25 years. “I’m 5- feet-10 and when I played, other players were 5-feet10 to 6 feet,” he said. Now, male or female, they’re 6-feet-2 and up. The nutrition, equipment and serving are better. The training is so much more precise. There’s gym work and conditioning. Plans for the 22nd Annual United Veterans of St. Lucie County, Inc. Golf Classic are under way, and organizers are scouting out both golfers and sponsors. Vincent LaValle, Port St. Lucie, a retired Air Force master sergeant, is the national director of the American Military Retirees Association, and he is chairman of the golf tournament. He said the tournament will take place April 26 at Fairwinds Golf Course, Fort Pierce, and he wants to get the word out to meet the goal of “supporting thousands who have unconditionally gave their all, their youth, and fearlessly served to provide the free nation we live in today for you to work and prosper” (from a letter sent out to potential participants). “One hundred percent of our income from this tournament will go toward funding vans so we can transport our disabled veterans to the VA Medical Center (Palm Beach) for free,” LaValle said. “This is our big event of the year.

PORT ST. LUCIE –- Sarah Bartal is vice president of Espressivo, a group formed to celebrate choral music. The St. Lucie West resident is music educator at Barnabas Church Academy in Port St. Lucie, but she travels to West Palm Beach to sing with the choral group founded in 2012. They will perform at St. Bernadette Church as part of the church concert series March 30. The ensemble performed at the church last spring and was asked to be a part of concert series for this season. Bartal said that most of the members are music educators. “It was started by two Palm Beach County teachers,’ she said. “Once they started teaching, they stopped singing the choral music they enjoyed. You empty yourself out to your students,

They had been looking for venues in which to perform. “You work on concerts for weeks and weeks and perform them once,” Bartal said. “Why not look for other places? The Treasure Coast Youth Symphony was playing, and they asked me to play the harp. I met Tom Bold (director of the series) and asked how to get involved.” The group will perform nine psalms by Thomas Tallis, “Notre Pere,” by Maurice Durufle, “In Remembrance” by Jeffery Ames, “Musicks Empire” by Lloyd Pfautsch, “Sicut Cervus” by Palestrina, “Quisque Eris” and “Jerusalem” by Michael McGlynn, “When Lilacs Last in the Dooryard Bloom’d” by Ethan McGrath, “Gloria” by Cesar Carrillo, “I See the Heavens” by Andrea Ransey, “Ukrainian Alleluia” by Craig Courtney and “Dawn” by Eric Barnum. The last piece will feature a solo on clarinet by Katie Kovalsky, the wife of Espressivo member Alex Kovalsky. With the exception of piano and clarinet, there will be no other musical accompaniment. “We try to remain as a cappella as possible,” Bartal said. “At most, there is a piano and clari-

net. The rest of the time, it’s just our voices.” While membership in the group is open, a certain level of proficiency is required. “We have open auditions before each concert,” Bartal said. “When we’re rehearsing new repertoire, if someone is interested in jumping in, special arrangements can be made. They must be able to read music. We call ourselves semi-professional, and singers must be of at least collegiate caliber.” The group performs two concerts a year, but they are flexible. If a church calls at Christmas time and wants some singers, they will try to accommodate them. For Sarah Bartal, it is all about the love for this ancient musical form. “There is a small choral sound lacking in Florida and on the Treasure Coast,” she said. “We’re a unique little gem.” Espressivo comes to St Bernadette Church, 350 California Blvd, Port St. Lucie, March 30 at 4 p.m. Tickets are $20.
