TREASURE COAST — The law firm of Lauri J. Goldstein & Associates has filed two suits against attorney Thomas Schmitt with allegations of taking between 140 to 170 files when he vacated the Goldstein office and opened up a new office in Martin County. The most recent motion filed on an emergency basis, to be heard at press time, is trying to stop Schmitt from representing Goldstein’s clients due to his mental instability and the way in which he acquired the clients. In an affidavit filed from the Goldstein’s petition a former client of Schmitt, James Holding, stated “(Schmitt) acted like he was ‘spaced out’, ‘His eyes appeared as he was or had been doing illegal drugs.” Michael Pike, of Pike & Lustig, is representing Goldstein & Associates. In court filings, the firm claims that Schmitt has a documented history of unstable

LUCIE WEST – It went down in history as “The Saturday Night Massacre.” On Oct. 30, 1973, President Richard Nixon ordered Attorney General Elliott Richardson to fire Archibald Cox, the special prosecutor investigating Watergate. Richardson and his deputy, William Ruckelshaus refused and resigned in protest. Solicitor Robert Bork fired Cox. Horace Webb, spokesman for the Justice Department, was in the meetings that led to those events. Today, Webb and his wife Bunny live in PGA Village. Webb just finished a successful year chairing the United Way of St. Lucie County’s annual fundraising campaign. A board member for the organization, he spoke recently about community involvement and his place as an

I haven’t the slightest idea what was in their minds. If they wanted political intelligence on the Democratic Party, they could have paid $15 and gotten on the mailing list.” The events that led to the Richardson resignation were a difficult time. “It was very emotional,” Webb said. “It actually happened on Friday night. Nixon had ordered Elliott Richardson to fire Cox. He would not. At his confirmation hearings, he swore he would not interfere with the work of the Special Prosecutor. If he fired Cox, he would have perjured himself. The next person in line, William Ruckelshaus, said no. At that time, the line of succession at the Justice Department

TREAUSRE COAST — Carl Domino beat a crowded field of Republican hopefuls to run against Democrat Patrick Murphy for the 18th Congressional District in 2014. It’s two years later. Murphy is vacating the seat to run for the Senate, and Domino is back to take another shot at the seat. “I’ve been real lucky in life and lived the American dream,” he said. Domino said he hopes to take what he’s learned from 20 years in the Navy, eight in the Florida Legislature and decades in investments managing to Congress. “I think the three big issues, similar to (2014), are job creation, national security and national debt,” Domino said. Domino said those national issues are really also the most important local issues. He said

cleaning the local waterways — which is often cited as the biggest issue facing the Congressional District — is pretty well decided and Congress’ role at this point is mostly to keep funding for the Indian River Lagoon flowing, he said, which has been coming up on the campaign trail, will likely be long since out of Congress’ influence by the time anyone elected in 2016 takes office in 2017. But, job creation, national security and the national debt, Domino said, will be issues affecting children not yet born on the Treasure Coast. “There’s never been a recovery this late (after a recession),” Domino said. “A lot of it has to do with the iron-fisted regulatory attitude of this administration. The respect for America around the world is disappearing. There are enemies so much worse than two years ago.” Six Republicans — including Domino — have announced their aim to make congressman Pat-

ing it. The Republican field for the 18th Congressional District could run out of elbow and leg room. Just like 2014. Domino is one of six Republicans who’ve announced runs for the district. Four Democrats have announced their aims to keep the seat blue. The congressional district covers St. Lucie and Martin counties, along with a sliver of Palm Beach County’s northern side. The district has a Partisan Voting Index, PVI, of R+3. Florida’s rating is R+2. The R, of course, standing for Republican. Florida’s 22nd District, just south of the 18th District, has a D+3 rating. The D, again of course, meaning Democrat. Any PVI score between R+5 and D+5 is counted as competitive. The “Rothenberg & Gonzales Political Report” puts the seat into its pure toss up category for 2016. It’s one of only 10 congressional districts to get that rating na-

TRADITION – GNC’s “Franchisee of the Year” award winner Albert Paetzig is moving into the Tradition location and gearing up for a grand reopening intended to bring new life to the storefront. Nine years ago when Paetzig was in search of a career that would allow him to spend more time with his young son, he went all in on a GNC franchise in Stuart, a move that Paetzig now says changed his life. I put my house up for collateral,” Paetzig said. “The economy was tanking, the store was hollow, but I saw opportunity.” Since nursing the ailing vitamin store back to life at the Stuart location, Paetzig has gone from owning one to five stores in a two-year period. The Florida Division of Elections lists only Domino and Negron on the Republican side, so far. On the Democratic side, Stuart’s John “Juan” Xuna, Palm Beach Garden’s Johnathan Chan and two Palm Beach County commissioners are running. The commissioners are Melissa McKinlay and Pricilla Taylor. Xuna is the only Democratic candidate the state lists so far. “There’s also good Democrats in this time,” Domino said. Most candidates will likely aim to qualify by petition. Vicki Davis, Martin County’s Supervisor

of Elections, said candidates for the 18th Congressional District who want to qualify by petition need to gather 4,854 signatures by next year. She said signers are free in primaries and general elections, 2016, to vote for candidates other than those they signed qualifying petitions for. It only means that a petition signer is helping a candidate qualify for a run without having to pay the filing fee, 6 percent of the annual salary of the office sought. The current salary of a rankand-file member of Congress is $174,000. It’s been that since 2009. Those who don’t collect the needed signatures would have to pay nearly $10,500 to qualify. Domino is married to Sharon, and they have teenaged twins, Reagan and Mason. He is 71. He is working on putting up a website and social-media pages for this campaign.

Larry Lee (D-Fort Pierce) requiring the Office of Early Learning to establish a five-year Literacy Jump-Start pilot project in St. Lucie County to provide emergent literacy instruction to low-income, at-risk children. The five-year program would begin with 25 indigent 2- and 3-year-old children who live in subsidized housing in Fort Pierce’s northwest neighborhoods. Literacy jump-start will be operated by a nonprofit organization under the oversight of Early Learning Coalition and based in a housing project.

Commissioner Tod Mowery said he was also pleased with the appropriation for the veterans nursing home. “I was glad to see that they continued this funding at $2 million for one of the last portions of new construction at Tradition,” Mowery said. In September, Scott and his Cabinet unanimously approved a county-owned, 28.5-acre site at the western end of Tradition Parkway for the state’s seventh veterans nursing home. The $2 million appropriated in the new state budget will be added to $17 million from the state’s Veterans Administration. Another $30 million would come from the U.S. Department of Veterans Affairs. The region the facility would serve -- all of St. Lucie, Martin, Indian River, Okeechobee and Highlands counties, plus portions of five neighboring counties -- has an estimated 211,647 veterans, nearly half of which are age 65 and older, according to the VA.

No money for bioresearch Johnson and Mowery each expressed disappointment that the governor vetoed $2.5 million appropriations for both the in Torrey Pines and Vaccine & Gene Therapy institutes and $250,000 for expansion of the Navy SEAL Museum in Fort Pierce, which draws 60,000 visitors a year. “Previously, the governor has assisted in the support of them (the bioresearch institutes) being here,” Johnson said. “They’ve not gotten the funding they’ve needed on a consistent basis but I am hoping they will get funding next year.” St. Lucie County projects among the $27 million in water projects the governor vetoed totaled about $1.8 million, about half of that for the Culvert Replacement Project. “He (Scott) was across the board with his cuts,” Mowery said, adding that the biggest “disgruntled aspect” was the failure of the Medicaid expansion proposal. Mowery said he also would have liked to see the $10 million for railroad quiet zones included in the budget, but he noted that “the Senate President (Andy Gardiner, an Orlando Republican) couldn’t get $10 million he wanted for a University of Florida project.”

ST. LUCIE COUNTY — The City recently received a $68,942 grant award for the Sunrise Theatre from the Florida Department of State’s Division of Cultural Affairs under the General Program Support category. GPS funding is designed to support activities of an organization that is realizing its stated mission and furthering the state’s cultural objectives. The grant is to further the theatre’s ability to conduct, create, produce, present, stage, or sponsor cultural exhibits, performances, educational programs, or events. According to Mayor Linda Hudson, “Our beautiful fully-restored Sunrise Theatre for the Performing Arts is an essential social, eco-

nomic, cultural and educational engine. Traffic generated by performances, educational offerings and summer camps spur millions of dollars in positive economic impact for restaurants, hotels and retailers in our great city.” For the 2014-2015 Season, the Sunrise Theatre reached $2.7 million in ticket sales. The theatre, now approaching its 10th season, has seen continued growth and development every year in terms of attendance, ticket sales, memberships, number and diversity of programs offered. Though dollars and cents are crucial to any business, Paetzig says customer service and building a passionate team is what keeps the numbers moving in the right direction. “We’re family operated, we have good, good customer service, and that’s something that is going obsolete in these big box stores,” Paetzig said. “GNC does a great job putting out amazing products, but we have to go back to basics.” To keep customers returning for an “experience” Paetzig says his store provides them with a caring and knowledgeable staff. Giant superstores and online competitors can offer competitive prices, Paetzig stated, but they don’t come with in store consultants like Paetzig’s GNCs do. “Everybody I hire has a passion for living a healthy life. When you walk into a store, you’re talking to people who work out,

who take care of their bodies,” Paetzig said. “Whether a customer is someone who lifts weights or has arthritis someone will be able to talk to you and help you find the right products.” Paetzig’s senior store manager Jordan Miller said Paetzig treats his employees like he expects his employees to treat customers, with respect. “We’re not just a number to him, he really cares,” Miller said. “I’ve gone from one to two to four to now five stores with him now, and he definitely has the formula down for success.” Miller is one of 16 total employees that will be working under Paetzig once the Tradition store is in full swing. But Miller said he does not believe Paetzig will stop at just five stores. “I look forward to where we’re going in the future, we’re nowhere near done.” The Tradition GNC is currently open for business, but Paetzig plans to advertise details for a grand reopening event in the near future. As part of the celebration, Paetzig said the entire store will be 25 to 30 percent off from Friday, July 17, through the end of August. LUCIE WEST — St. Lucie County commissioners continue to put road blocks in front of the All Aboard Florida high-speed passenger train that could come barreling down the Treasure Coast at the risk and expense of communities like St. Lucie County starting in 2017. At the St. Lucie County Commissioners meeting on July 7, commissioners voted unanimously to accept a Critical Assessment, spelling out in more than 500 pages the “serious deficiencies” of the Draft Environmental Impact Statement (DEIS) set forth by All Aboard Florida owners, Florida East Coast Industries (FECI), in September of last year. In addition, Public Works director Donald West presented holes found in All Aboard Florida’s 90-percent plan handed over to the County in April.

A letter submitted on July 7 to the Federal Rail Administration by Tallahassee-based environmental lawyer Segundo J. Fernandez on behalf of the county summarizes the deficiencies. Fernandez also calls the Administration to “reject” the DEIS and put a final draft on hold until all “deficiencies have been cured.” All Aboard Florida will connect Orlando to Miami with stops in West Palm Beach and Fort Lauderdale. Official plans show 32 trains per day could come speeding down the tracks, in some places reaching up to 110 miles per hour. Eleven crossings in St. Lucie County will be affected by the project, according to West. Though concerned government entities cannot vote down the private project, many are teaming up to ensure communities are physically and financially protected from the dangers a high speed rail could bring.

The backstory is that no one at the time knew the emotional and physical condition of the president. We didn’t know if he were irrational or ill. “If the president decided to fire Bob Bork, he could appoint anyone as attorney general for 30 days. That person would be bound to do whatever the president wanted to do. There was no end to what you can conjure up with your own appointees.” In the end, Robert Bork fired Cox, a move that Webb said cost Bork a Supreme Court seat. From the break-in at the Watergate to the Nixon resignation two years later, Webb was on the inside. “My wife thought I was having an affair with a reporter for the Washington Star,” he said with a laugh. “Whenever Woodward and Bernstein broke a story for The Washington Post, the phone rang at 1 or 2 a.m. and a sweet voice asked for me. She was fact-checking.” It was a difficult time. “We didn’t know what would happen,” he said, “It was virgin territory for politics. As it turned out, it was a time in our history that was exciting, nerve-wrack-

It proved that even with that level or attack on our form of government, it survived.” Webb said that he and Bunny used Watergate as an object lesson for their own children. “The operative phrase was, ‘It’s the cover-up.’ I think we have repeated to our sons and grandchildren to get them to understand to do the right thing in the first place. It’s not the crime, it’s the cover-up. We told our children to tell the truth. Otherwise, you have to tell a lie and then another lie. The cover-up begins a process from which you can’t recover.” Webb played another role in an historic event of the 1970s, the standoff between the Oglala Sioux Tribe and the U.S. government at Wounded Knee, South Dakota, in 1973. “It was scary,” Webb said. “I returned in one piece from Vietnam and I was a civilian, standing at Wounded Knee, South Dakota, getting shot at.” Webb was working for Attorney General Richard Kleindienst and got called into Kleindienst’s office. “He said there was a situation at a place called Wounded Knee and I should go and handle the media,” he added. “He said that a plane left for Denver at 1 p.m. I wound up in a motel at

The Webbs had long planned to move to Florida. “We decided to buy property in 1998,” he said. “My wife had an aunt and uncle in this area. They were part of a group that lived in New York. to the Board. All Aboard Florida’s 90-percent plan neglects to include crucial safety features, West said. While the Federal Rail Administration recommends sealed corridor treatments, sensing devices that detect stalled vehicles, and monitoring for non-functional gates and signals, All Aboard Florida plans suggest few of the safety recommendations will be shouldered by the company. Further, the cost of maintaining the County’s 11 rail crossings could swell from $2.5 million to upwards of $6.4 million with the increased track plans, West said. Initially, brand new crossings will not need heavy maintenance, but “down the road” in as little as “five years,” it could be very costly to the county. “This is the most disturbing document I have ever read in my entire life,” said Commissioner Chris Dzadovsky. “I’m afraid they’re going to run a safety operation that will kill people.” In addition to All Aboard Florida’s apparent failure to meet safety recommendations at the crossings, Dzadovsky said he is concerned about open tracks between the crossings. Pedestrians who are accustomed to seeing slower freight trains may think they have time to cross, but mis-

Fernandez addressed the Board on the matter of the DEIS. “I am an environmental lawyer” Fernandez said, “This is the worst DEIS I have ever seen on a project of this magnitude.” Fernandez argued that there is sufficient, fact-based evidence that shows what All Aboard Florida is representing in its DEIS is “wrong.” The initiative that the County has taken to review and challenge the DEIS is what All Aboard Florida should have done and what the Federal Rail Administration should have confirmed. But instead, the County in conjunction with neighboring local governments have found a “total failure” in at least four areas and could have found more given the time and resources, according to Fernandez. “The EIS draft was issued in Sept. 2014 after a two-year period of study, with about 40 different experts,” Fernandez said. “But it’s pretty amazing that it is completely flawed and deficient.” St. Lucie County was still awaiting All Aboard Florida’s final EIS, a document that has been pushed back several times, as of 12 p.m. on Tuesday, July 21, according to County Attorney McIntyre.

I thought I’d died and gone to heaven. Seven hundred dollars bought me a membership. I could come down to play for the weekend. It was cheaper for me to buy a Super Saver round trip fare from Newark to West Palm. It was $99. I could rent a car, drive to Port St. Lucie, play Saturday and Sunday and fly back and it was cheaper than to play in New York or New Jersey. The weekend cost me $300.” The couple found a lot in PGA Village and decided to build a home. “It was quite pleasant, rural but not so rural that needed services weren’t readily available,” he said. “We built a house and settled here. We lured two of our three sons. was no better. We decided to pick one or two organizations and see what we could contribute. I used the old Marine Corps ethic, ‘Lead, follow or get out of the way.’ We want to contribute as much as we can because we care. If, in our later years, we can make a positive difference by allowing our experiences to be of value to others, we’d be satisfied and pleased.” Webb is active in his homeowners association at Sabal Creek and in the United Way, while Mrs. Webb serves on the community campaign committee for Tradition Medical Center and serves on the Martin Health System’s Foundation Board. She is also on the boards of Kids Connected by Design and the Backus Gallery and Museum. Both Webbs recognize they have been very fortunate. “Not everyone has had the chances we’ve had,” Webb said. “My wife was the daughter of a diplomat and that broadened her background enormously. We don’t seek the limelight, and whatever happens, happens. In a press release, Schmitt said, “While it’s true that my estranged wife, who has suffered herself from severe psychological problems most of her life and has been in treatment for many years, did attempt to have me committed involuntarily.” In the press release, Schmitt notes that while he could have been involuntarily held for evaluation up to 72 hours, he was released within 24. Additionally, the suit alleges that Schmitt took numerous clients with him with unethical, and possibly illegal, methods. The suit also alleges that Schmidt covertly

arranged to move attorneys, paralegals and cases to a new firm, Kogan, DiSalvo & Schmitt. “The value of cases is in the millions of dollars,” Pike said in a telephone interview. In 2013 Goldstein accepted a voluntary 91-day suspension after a Florida Bar Association investigation started in 201l. The investigation was into Goldstein taking the case for a Port St. Lucie woman who’d fallen at a Long John Silvers in Kentucky. The firm wasn’t licensed to practice in Kentucky, and also missed filing deadlines. In the recent suits against Schmitt and others, the Goldstein firm claims that Schmitt was responsible for the case that led

to the voluntary suspension, but Goldstein accepted responsibility because she was his supervising attorney. The hearing July 21 is an emergency motion to protect clients, as of press time court proceedings are in session. A telephone receptionist at Kogan, DiSalvo & Schmitt said Schmitt is no longer with the firm. In a short telephone interview, Schmitt said he’d worked with attorney Lauri Goldstein for five years and lost confidence in her. Goldstein said, “I am saddened by the lies that have been said about me and the betrayal of a colleague but I am staying strong for my family and my clients.”

TREASURE COAST – The Riverside Theatre has announced its schedule of shows for the 20152016 season and the schedule features Broadway hits, comedy and witty dialogue. First up is “Swinging on a Star", on the Stark Stage, from Oct. 27Nov. 15. The show features the lyrics of Johnny Burke, one of the most influential lyricists whose name you may not know. Burke’s most famous collaboration was with Jimmy Van Heusen. The lyricist wrote for more than 20 Bing Crosby movies and won an Academy Award for “Swinging on a Star.” The show travels from a 1920s speakeasy to the Bowery to USO clubs and to Manhattan super clubs in the 1950s. It highlights music from the “Road” movies and songs like “Pennies from heaven,” “Moonlight Becomes You,” and “Going My Way.” For those who enjoyed “I Love a Piano”, “Swinging on a Star" is sure to please. The first show of the 2016 is a modern classic, “A Chorus Line.” The show won nine Tony Awards including Best Musical and the Pulitzer Prize for Drama. It is one of the longest-running musicals in Broadway history and features a Marvin Hamlisch score with songs like “What I Did for Love”

The family is dysfunctional and the comedy absurd as the four interact. Another Broadway classic is on tap March 8-27 on the Stark Stage as the Riverside presents “Hello Dolly!” The megahit won 10 Tony Awards, including Best Musical. The music and lyrics by Jerry Herman feature show-stoppers like the title song, “Before the Parade Passes By,” and “It Only Takes a Moment.” Next up is a thought-provoking work by Mark St. Germain, “Freud’s last Session.” The play runs from March 22-April 3 on the Waxlax Stage and tells of a meeting in Sigmund Freud’s home between Freud and writer C.S. Lewis. Lewis, who had satirized Freud in a recent book, expects to hear about that and is soon surprised by the agenda Freud has set. The witty dialogue touches on love, religion, politics and life itself. The final show of the season is “Sister Act,” which will be presented April 12-May 1 on the Stark Stage. This high-energy show was nominated for five tony Awards and features music by Oscar and Tony winner Alan Menken. It tells

the story of disco diva Deloris Van Cartier, who witnesses a murder and is placed in protective custody in a convent. In a statement, Allen Cornell, the Riverside’s producing artistic director, said that they hoped to build on this past season’s success. “We were thrilled with the great success achieved this past season. ‘Crazy for You’, ‘West Side Story’ and ‘Side by Side by Sondheim’ achieved many sold-out performances. ‘West Side Story’ also earned record status as the first show in Riverside’s history to sell more than $1 million in ticket sales. “Without the critical acclaim and support of our audiences, none of us could boast that here in Vero Beach, there is a local theater that has grown to be America’s largest professional theater in a small town.
