IDR&IDCP Registration (Architect’s act)

DEFINITION AND/OR DISCOVERY

The Code of Conduct outlines the standard of professional conduct and self discipline required of Interior Designers in the interest of the public. There are 5 Codes of Conduct prescribed in the Architect’s Act, they include:

1. Objective of the Code

2 Compliance w th Acts and rules

3 4 Faithfu d scharge of duties and obligations

Integrity

The interior design industry in Malaysia revo ves around two key components: the Interior Designer Registration (IDR) and Interior Des gn Consultancy Practice (IDCP)

1 Interior Designer Registration (IDR)

This is a voluntary program overseen by the Board of Architects Malaysia (LAM), designed to ensure interior designers possess the necessary qual fications and maintain professional standards. It is not legally required but offers credib lity n the profession The steps for registration nclude:

• • Completing a relevant degree or diploma in interior design (such as MIID student membership)

Gaining at least 2 years of working experience under a registered interior des gner and submitting a logbook documenting this experience

Undergoing an interview assessment

Successfully passing a written exam nation

2 Interior Design Consultancy Practice (IDCP)

Unlike IDR, reg stering under IDCP is mandatory for those wishing to offer professional consu tancy services in interior des gn

• Mandatory Registration:

Interior designers must register with the Board of Architects Malaysia (LAM) to offer professional consultancy services legally.

• Regulatory Compl ance & Liability:

Registration ensures designers comply with industry standards, maintain professional sm, and are legally accountable for their work

• Access to Larger Projects:

Registered consultancies can handle more signif cant projects, including government tenders, which often require IDCP registration for eligibi ity

Many interior des gners choose to register w th the Malaysian Inst tute of Interior Designers (MIID) to gain recognition, as well as access to va uable

2 Forms Of Practice (Architect’s act)

resources and networking opportunities. Ult mately, the decision to reg ster depends on each designer’s career goals and preferences

In the interior design industry, there are several forms of practice that interior designers can engage in, depend ng on their reg stration status, business model, and professional goals These include:

• So e Proprietorship:

To establish a sole proprietorship, the owner needs to submit an application and pay the relevant fees. The business wil be registered n the proprietor’s name, using their persona identification. In this model, the owner s solely accountable for all assets, liabil ties, and taxes

Advantages: Affordable and simple, Freedom and flexibility, Most company profits and losses are managed by the sole proprietorship.

Disadvantages: The owner would assume personal liability, ack of financ al control and difficulty tracking expenses

• Partnership:

Establishing a partnersh p requires fi ling out an application and paying the necessary fees. The person registering the bus ness must hold a valid license ID, and the company name usually combines the names of the partners or uses an acronym. In this structure, each partner shares responsibility for business decis ons and assets The partnership itself is not taxed directly on profits; nstead, profits are divided among partners and taxed as personal income

Advantages: Access to more ideas and resources, ability to share initial costs, and a greater potentia for growth and expand

Disadvantages: Conflict between ideas, unlimited liability, and the need to negotiate how profits are shared

• Body Corporate:

A body corporate for interior design must register if its board comprises qualified inter or designers or architects and meets the requ red paid-up capital Dai y operations should be overseen by an inter or designer or a designated individual selected by the board The company name must be suitable, free from ostentatious or misleading elements, and may nclude the names or nitials of the directors Furthermore, if the company offers multiple professional services, it must adhere to the Company Act 1965 and relevant regulations for approval

Advantages: Easier access to bank loans and financing, company assets are kept separate from personal ones, and shareholders have voting rights Capital can be raised by selling shares

3 Code of Conduct & Special Provisions for ID + COE

Disadvantages: Competitors may access company information, control and ownership issue, regular shareholder meetings are required, and decisionmaking processes are more complex

In my view, a business model is crucial for outlining a company s structure, ensuring its capacity to create, deliver, and capture value that positively impacts society and the environment Additionally, a we l-defined business model helps identify target markets and revenue streams, guiding strategic decisions that enhance sustainability and long-term success

The Code of Conduct outlines the eth cal and profess onal standards that interior des gners n Ma aysia should adhere to, as developed by the Ma aysian Institute of Architects (MIA). This code promotes professiona ism and integrity in the interior des gn practice Key components of the Code, as prescribed in the Architects Act, include:

1 Objective of the Code: Establishing a clear purpose for ethical practice

2. Compliance with Acts and Rules: Adhering to relevant laws and regulations

3 Faithful Discharge of Duties and Obligations: Fu fill ng professional responsibilities diligently.

4. Integrity: Upholding honesty and moral principles in all dealings.

5 Respect for the Legitimate Rights and Interests of Others: Acknowledging and valuing the rights of clients, colleagues, and stakeholders

Condition of engagement (COE)

against AI, they must nnovate and adapt to clients' needs by using advanced tools and efficient inspection methods. It's also crucial for designers to protect their nterests by taking responsibility for issues, safeguarding their copyrights, and ensuring t mely payment.

Stronger aws and regulations are needed to protect their financial and intellectual rights By adhering to the Code, designers can gain recognition from clients and peers, highlighting the importance of high professiona standards. The Code also addresses key issues like conflicts of interest and confidentiality, allowing professional associations like MIA to take disciplinary action against violators

In Malaysia, the Bu ld ng Plan Subm ssion process is regulated by loca authorities and includes the BP CCC (Building Plan - Certificate of Complet on and Compliance) It involves several key steps:

Procedure of building plan submission

• Planning Permission Application

- Submitted to the Loca Planning Authority for approval to ensure the project complies w th local regulations

• Building Plan Application

-Once p anning approval is received, detailed bui ding plans are submitted to ensure alignment with the approved planning permission

• Certificate of Completion & Compliance (CCC)

- Obtained after construction, certifying that the bui ding is constructed according to approved plans and is fit for use

• Notification to Start Work

- Before construction begins, relevant authorities are informed, a lowing them to monitor progress and ensure regulations are followed.

• Inspections

- Interim and final inspections are conducted by local authorities to confirm compliance w th safety and building standards

• Submission of CCC & G (G1-G21) Deposit Form

- his final step confirms that the project meets al requirements, allowing for occupancy.

For interior designers, the Building Plan Submission process ensures that interior layouts meet safety, health, and legal standards, making the space funct onal and comp iant with regulations This process covers aspects like fire safety, ventilat on, accessibility, and space planning, ensuring that the design aligns with building codes. By following it, designers avoid legal issues, ensure smooth project execution, and provide clients w th spaces that are both safe and approved for use

7 Space, Light & Ventilat on (UBBL)

The UBBL (Uniform Build ng By-Laws) outlines a comprehensive set of regulations to ensure that buildings in Malays a are safe, functional, and comfortable for occupants These regulat ons cover many aspects of bui ding design and construction, inc uding the allocation of space, natural ight, and ventilat on Proper space p anning ensures ease of movement and functiona ity, while adequate ight and ventilation contribute to a healthy and pleasant

8 Active Fire Safety & Evacuation (UBBL)

indoor environment These elements p ay a key role in enhancing the overal comfort, safety, and sustainab lity of buildings

1. Space Requirements

• • For residential buildings, UBBL mandates that open spaces must be equal to at least 1/3 of the built area

For commercia bui d ngs, projections like balconies or sun shades can extend up to 1 meter over open space, and 1/10 of the built area must be allocated for open space.

• 2. Ventilation

Spaces like corr dors, stairwe ls, and rooms must meet m n mum size standards to al ow for proper movement and safety.

1. Ventilation is critical for maintaining indoor air quality UBBL specifies vent lation rates based on room use, requir ng fresh a r circulation and the installation of exhaust systems, especially in kitchens and bathrooms.

3 Lighting:

2. UBBL emphasizes the importance of natural ight, encouraging the use of bui ding orientation, w ndow placement, and reflective materials to enhance daylight access This reduces energy use and improves the quality of ndoor environments

By effic ently ut lizing space, it can ensure comfortable and practical env ronments. Maximizing natura light not only enhances the ambiance but a so reduces energy consumption. Proper ventilation is key to maintaining healthy indoor air quality, prevent ng issues ike mold and condensation. Adher ng to UBBL guidelines ensures these aspects meet regulatory standards Close col aboration with architects and eng neers is vital to seamlessly ntegrate space plann ng, light ng, and ventilation into the overa l bu lding design, resulting in wel -balanced, compl ant inter ors

Active fire safety and evacuation protocols are cr tical for safeguard ng occupants in the event of a f re Malaysia's Uniform Building By-Laws (UBBL) estab ish detailed fire safety regulat ons for different building types, including non-industrial, industr al, commercial, and high-r se structures. These regulations focus on three key areas: fire prevention, fire detection, and safe evacuation.

Key Phases

1. Fire Prevention:

- Use fire-resistant materia s in construction

- Design proper escape routes

- Install automatic fire detection, alarms, and extingu shing systems like sprinklers, hose reels, and manual extinguishers

2. Fire Detection:

- Employ smoke detectors, alarms, and heat sensors

- Ensure control room coordination for timely fire alerts and sprinkler activation.

3. Fire Evacuation:

- Provide well-lit exit routes, emergency lights, and accessible doors

- Establish safe assemb y points and fire ifts for emergencies

Interior designers play a key ro e in incorporating fire safety into their designs.

Designers ensure the use of fire-resistant mater als, create clear evacuation routes, and nclude proper emergency lighting to enhance building safety By comb ning these safety features with the design’s aesthetics, designers can create spaces that are both visually appea ing and safe for occupants

Topic: Threats to the Interior Design profession

Abstract: With the rise of unregistered firms offering architectural and interior design services through social media in Malaysia, professionals face growing challenges. These firms often undercut registered companies, utilizing unlicensed designers and architects, creating risks for clients and undermining industry standards. At the same time rapid advancements in technology, including AI, are threatening to replace traditional roles in design.

How can the architectural and interior design professions navigate these twin threats illegal practices and automation while ensuring they remain relevant, innovative, and in demand? What strategies can be employed to maintain professional integrity, embrace technology, and ensure sustainable growth in a shifting landscape? Discuss.

FORUM 2: Completion

and Compliance Certificate

(CCC)

TOPIC: Local Authority

ABSTRACT: A Completion and Compliance Certificate (CCC) is an essential legal document issued by the local authorities in Malaysia It signifies that a building project has been completed according to approved plans and complies with Malaysian building codes, regulations, and safety standards In Malaysia it is mandatory to obtain a CCC before a property can be legally occupied CCC confirms that a building is safe for occupation, emphasizing public safety It also highlights the complexities and diligence involved in the application process underlining the importance of transparency, adherence to regulations, and cooperation between developers and local authorities to ensure that structures meet the highest standards of safety and compliance

These processes are often time-consuming, requiring significant administrative work and adherence to strict guidelines In many cases, project timelines are short placing additional pressure on architects and developers to meet the requirements within limited timeframes This situation makes it difficult for professionals to focus on creating high-quality designs, as a large portion of their efforts are devoted to navigating these submission processes

Here is a portion of the actual exam question in the recent LAM IDLE Exam:

Which part of the question refers to CCC? What do you think about the IDLE exam?

How is CCC relevant for Interior Designers? Can we submit the Building Plan (BP) and CCC to the Local Authorities? Who is the PSP? Is a CCC still valid when a renovation/alteration to the original plans are done? How will you advise your client?

INTRODUCTION

Objective: This assignment allows students to apply their knowledgegainedinProject1intotheirindividualprojectsin AIAD2. Each regulatory, legislative, and technical provision must be illustrated into an informative report presentation with dimensions, drawings (including isometrics) and materials where necessary. Students’ design shall not change or be influenced by the laws due to both module’stimeconstrainfactor, instead, itactsasanoverall guideline to address the next forthcoming steps before finalizing the building plans. Thus, students are asked to identify non-compliance by marking an (x) and describing the next course of action for design rectification.
