Special team reaches Jammu to arrest Khan Srinagar, Feb 08: A special team of Jammu and Kashmir police Saturday conducted raids in winter capital to arrest former Health Minister, Shabir Ahmad Khan, who is facing charges of molesting a lady doctor at his office in winter secretariat last week. Official sources told GNS that an eight member team from Srinagar led by a Deputy Superintendent conducted raids at some parts in Jammu to nab former Health Minister, Shabir Ahmad Khan, who has been booked under Sections 354 (assault or use of criminal force against a woman with intent to outrage her modesty) and 509 (a word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code (IPC) by police. While the DSP flew to Jammu, other team members, sources said, reached the winter capital this evening and started manhunt to nab the accused, who is believed to be on the run to evade arrest. Geelani arrested after returning from Delhi Srinagar, Feb 8: Hurriyat Conference Chairman Syed Ali Geelani was arrested at Srinagar Airport on Saturday as he arrived from Delhi after treatment. The chief spokesman of Geelani’s Hurriyat, told KNS that Geelani was taken to his residence by a large police party from Airport and was kept under house arrest. “Large police party since morning guarded the Huriyat office and they neither allow anyone to go inside nor they allow us to leave.”Ayaz added KNS that he continues remain confined at his office from the last three days. A Tavera vehicle bearing registration number JK03C/8792 and a Santro car bearing registration number Jk03B/6781 collided at National Highway near Padshahi Bagh, Anantnag. In this incident driver of the Santro car Ali Mohammad son of Ghulam Nabi resident of Mahid Wopzan got injured. The injured was shifted to Sub District Hospital Bijbehara. Asking the passing out graduates and post-graduates from the higher institutions of learning and universities to venture in the new phase of their life with confidence, resolve and firm belief of making their mark in the fields they choose for career, Chief Minister, Omar Abdullah Saturday told them to be fully prepared to face challenges and bring laurels to all they belong. “You have been fully imparted education and skills and you have to prove your calibre and mettle to shine-bright your parents, your Institutions and your State”, he told the students at the 4th Convocation of Mata Vaishno Devi University (SMVDU) in his address, here this morning. President calls for increased investment in higher education Mumbai, Feb 8: President Pranab Mukherjee has called for increased investment in higher education. He said it should be affordable and accessible. He was speaking at the Diamond Jubilee celebration of the Kishinchand Chellaram College of Mumbai. Mukherjee quoted Banjamin Franklin and Otto Van Bismark to reiterate that investment in education earns the highest return. He said the time has come for India to recover the lost ground and become a world leader in education once again. He lamented the fact that today India’s institutes of higher learning are no longer counted

among the best. Cabinet approves amendments to strengthen the J&K Panchayat Raj Act 1989 JAMMU, FEBUARY 08: In a major decision, the Cabinet which met here under the Chairmanship of Chief Minister, Omar Abdullah approved amendments to various sections of the Panchayati Raj Act to accommodate various demands within the overall frame work of the Jammu and Kashmir Panchayat Raj Act 1989. The amendments provide for the Election of Chairman and Vice Chairman of a District Planning and Development Board by the

members of the Board from among themselves. The amendments also provide for the Chairman of a Block Development Council to be elected by the Sarpanchs and Panchs of the concerned block from among themselves. It also provides for reservation in respect of the SC and ST categories to the extent of their population in specific constituency and to the extent of 33% for women. The amendment also provides for reduction in the age of candidates for

contesting elections for the positions of Panchs and Sarpanchs from 25 to 21 years. The Cabinet also approved the Jammu and Kashmir Ombudsman for Panchayats Bill, 2014 for introduction in the State Legislature during the ensuing session. It also approved the Jammu and Kashmir Maintenance and Welfare of Parents and Senior Citizens Bill, 2014 for its introduction and enactment in the State Legislature during the ensuing session.

SRINAGAR, FEB 08: The Minister for Rural Development and Panchayats Ali Mohammad Sagar today conducted an extensive tour of the Srinagar city to take stock of the essentials, besides on spot redressal of the problems being confronted by the people of the different areas. He was accompanied by senior officers of various departments like CAPD, PHE, PDD, SMC, Health and R & B. The Minister while interacting with people at different localities told them that the Government has already passed the instructions to ensure that a foolproof mechanism is put in place, so that the problems confronting the people are solved within the shortest possible time. He said that the Government is committed to provide better facilities to the people especially during the harsh winter months. Sagar also directed the PDD officers to put in place a mechanism by which the consumers get adequate supply of power. He said that strict orders should be passed by which the schedule is strictly adhered to, so

that the people do not face any unnecessary power cuts. While inspecting the ration depots in different areas of the Srinagar City, the Minister asked the CAPD Officers to provide adequate supply of rations during the winters. He was told that 42000, 2000, 2800quintals of rice, atta and sugar respectively have been distributed among the people during the Ist week of the current month. He was also told that 10. 56 lakh litres of K.Oil have also been given to the consumers, besides 1.78 lakh LPG cylinders are available and adequate supply of food grains and other essential items is available. Sagar also inaugurated a CAPD Ration Depot at Reashi Mohalla in Khanyar Constituency, which would cater to a large population of the area and its catchments. While interacting with the people living in the vicinity of Dal in Rishi Mohalla, Abhi Nowpura, Miskeenbagh and other areas the Minister assured them that their demands regarding their various issues would be taken up with LAWDA and redressed properly, so that the problems confronting them would be solved.

Srinagar, Feb 8: Ghulam Nabi Ratanpuri, National Conference Member Parliament on Saturday said that if government is interested in transparency and truth it must have the forensic examination of all the antechambers in all the government offices. In a statement issued to KNS, he said that law and order machinery must also check the antecedents of frequent female visitors to the offices of politicians, bureaucrats and police officers, their motives, the people they visit and the nature of their relations with the visitors. The MP suggested the scrutiny of CCTV footage of the public offices to uncover the nexus between pimps, power brokers and Dalals of different hues. He said that exploitation of hapless Kashmir woman continues on a very large scale, the rot is much deeper and can't be put under carpet for long. Ratanpuri lamented that the observations of Justice (retd.) Bashir Ahmed Kirmani in the infamous sex scandal, and thereafter in many fora did not evoke the required response. The separatist leadership failed on this front too and looked the other way. “They demand just sacrifices from a battered and brutalised society and ignoring the fallout of their selfish agenda they actively contribute to dehumanisation and disempowerment of Kashmir.” He said that last year when he met Syed Ali Shah Geelani in Delhi and later in Srinagar also, he discussed this and other social issues with him in detail. He requested him to use his influence to address these severe issues which are eating into the vitals of the society and not to dedicate all his energy to strikes. “A person of Geelani Sahib's stature, knowledge and dedication to moral values, if convinced that all what Justice Kirmani has observed is based on facts, would definitely give first preference to address such moral decadence. So it is imperative upon those whom he believes that Geelani Sahib is told the whole truth,” Ratanpuri observed. (KNS)

Srinagar, Feb 8: Terming the latest arrest spree of youth and political leaders as atrocious and undemocratic Peoples Democratic Party (PDP) Saturday said such repressive methods deepen the existing level of alienation among the people. In a statement issued to KNS, the party Chief Spokesperson, Naeem Akhtar said the ruling government can’t silence the genuine voices of people, who are fighting for justice and democratic rights, by such barbaric methods. He said instead of providing a genuine democratic space to the young people, political opponents and relating with them, the government is resorting to crackdown to stifle the voice of dissent. He said instead of real ‘hand holding of the youth’, Omar Abdullah is handcuffing and subjecting them to humiliation and inhuman treatment inside the police lockups thus making their lives miserable. “By lodging FIRs against more than 10

Pulwama shuts for second day against random arrests Pulwama, Feb 8: A complete shutdown was observed for the second consecutive day in South Kashmir’s Pulwama district on Saturday against the random arrest of youth during late night raids in the district. Sources said that in wake of possible protests on the first death anniversary of Muhammad Afzal Guroo,Police have arrested at least 28 youth during nocturnal raids in different areas of Pulwama. Police sources CNS that all the arrested youth are allegedly involved in different incidents of stone-pelting. Reports said that people in Pulwama district observed a complete shutdown against the random arrests of youth. Shops, tutorial institutions, and business establishments remained closed while traffic was off from the road. Scores of youth resorted to stone-pelting at Rajpora and

Muran Chowk of the district and reportedly damaged the windowpanes of some police vehicles, however, police exercised restraint and did not retaliate. People alleged that police randomly raided the houses during the dead of night and arrested various youth. An Empowered Consumer is an Asset to the Nation

C

onsumer Protection Act, was enacted in 1986. The Consumer Protection Act provides for effective safeguards to consumers against various types of exploitations and unfair dealings, relying mainly on compensatory rather than a disciplinary or preventive approach. With a large consumer base of 1.27 billion ( 52% males and 48% females) constituting nearly 17.31% of the world’s population, the demography of Indian consumer shows an interesting pattern pointing towards a young consumer base which believes in market mechanism. 30 % of the population lives in urban areas and the rest in rural. The diversity itself is a major challenge for any consumer protection regime. The Constitution of India provides for protection of rights of an individual and also enjoins the State to adhere to the Directive Principles. The source of consumer rights lies in the Fundamental Rights enshrined in our constitution. The Consumer Protection Act provides for protection of the basic rights of a consumer. Consumer Movement in India Though the consumer movement in India is as old as the trade and commerce, yet, there was no systematic movement in the country for safeguarding the interests of consumers till the Consumer Protection Act was enacted in 1986, based on the United Nations guidelines with the objective of providing better protection of consumers’ interests. The Act applies to all goods and services unless specifically exempted, and covers private, public, and cooperative sectors and provides for speedy and inexpensive adjudication. The Act also provides for setting up of Consumer Councils to promote consumer welfare. The Act seeks to promote and protect the following six rights of the consumers: · The right to be protected against marketing of goods and services which are hazardous to life and property; · The right to be informed about the quality, quantity, potency, purity, standard and price of goods and services, as the case may be, to protect the consumer against unfair trade practices; · The right to be assured of access to a variety of goods and services at competitive prices; · The right to be heard and assured that consumer interest will receive due consideration at appropriate forums; · The right to seek redressal against unfair or restrictive trade practices or unscrupulous exploitation of consumers; · The right to consumer education. The Consumer Protection Act The Consumer Protection Act, 1986 lays down the rights of the consumers and provides for promotion and protection of the rights of the consumers. The first and the

only Act of its kind in India, it has enabled ordinary consumers to secure less expensive and often speedy redressal of their grievances. The Act mandates establishment of Consumer Protection Councils at the Centre as well as in each State and District, with a view to promoting consumer awareness. The provisions of this Act cover ‘goods’ as well as ‘services’. The goods are those which are manufactured or produced and sold to consumers through wholesalers and retailers. The services are in the nature of transport, telephone, electricity, housing, banking, insurance, medical treatment, etc. A written complaint, can be filed before the District Consumer Forum for goods/services valued upto Rs.20 lakh, State Commission for value upto Rs one crore and the National Commission for value above Rs one crore, in respect of defects in goods or deficiency in service. The service can be of any description and the illustrations given above are only indicative. However, no complaint can be filed for alleged deficiency in any service that is rendered free of charge or under a contract of personal service. The remedy under the Consumer Protection Act is an alternative in addition to that already available to the aggrieved persons/consumers by way of civil suit. In the complaint/appeal/petition submitted under the Act, a consumer is not required to pay any court fees but only a nominal fee. Consumer Fora proceedings are summary in nature. The endeavour is made to grant relief to the aggrieved consumer as quickly as in the quickest possible, keeping in mind the provisions of the Act which lay down time schedule for disposal of cases. If a consumer is not satisfied by the decision of a District Forum, he can appeal to the State Commission. Against the order of the State Commission a consumer can come to the National Commission. Government Initiatives · ‘Jago Grahak Jago’ Though the consumer movement is slowly gaining ground in our country as the success of consumer movement mainly depends upon the level of consumer awareness generated in the country by educating the consumers about their rights and responsibilities. Within India itself, the level of consumer awareness varies from State to State depending upon the level of literacy and the social awareness of the people. Educating more than 120 crores people of various categories of population, particularly those in rural areas where consumers are more susceptible to exploitation, on various subject matters of consumers interests being dealt by different Ministries / Departments, is a herculean task. For the 11th plan the scheme has received an allocation of Rs. 409 crores to launch an effective Multi- Media campaign. The scheme under the brand name of ‘Jago

Grahak Jago’ has carved out a niche for itself. For the 12th plan an allocation of Rs. 409.29 crores has been made. Consumer Welfare Fund The Central Excise and Salt Act, 1944 (1 of 1944) was amended in 1991 to enable the Central Government to create the Consumer Welfare Fund where the money, which is not refundable to the manufacturers etc., is credited. The money credited to the Fund is to be utilized by the Central Government for the welfare of the consumers in accordance with the Rules framed. The fund has been set up by the Department of Revenue, but the Ministry of Consumer Affairs, Food and Public Distribution will operate it.The overall objective of the consumer Welfare Fund is to provide financial assistance to promote and protect the welfare of the consumers and strengthen the voluntary consumer movement in the country particularly in the rural areas. Consumer Clubs This scheme was launched in 2002, according to which a consumer club shall be set up in each Middle/High/Higher Secondary school/college affiliated to a government recognized Board/University. This scheme has been decentralised and transferred to the Governments of States/UTs with effect from 1.04.2004. All interested NGO/VCOs shall apply to the Nodal Officer in the Food, PD & Consumer Welfare Department of the respective States/UTs. Promoting Research This scheme has been launched with a view to sponsor research and evaluation studies in the field of consumer welfare to provide solution to the practical problems being faced by the consumers, to sponsor seminars/workshops/ conferences on the consumer related topics, and to have necessary inputs for the formulation of policy/programme/scheme for the protection and welfare of the consumers. The Indian Institute of Public Administration, New Delhi, has been identified as the nodal organization to administer the scheme. National Consumer Helpline A National Consumer Helpline project has been established in collaboration with Delhi University, Department of Commerce. Consumers can call from anywhere in India to the number 1XXX-XX-4000 from MTNL/BSNL lines free of charge and get advice regarding their problem as a consumer. The Helpline has been formally launched on 15.3.2005 on the World Consumer Rights Day and is functional on all working days from 9.30 A.M to 5.30 P.M. CORE Centre The Consumer Online Resources and Empowerment Centre has been conceived to function as the most scientific and effective system of collection, dissemina-

tion and redressal of consumer related information and complaints. It was launched on the World Consumer Day i.e. on 15th March, 2005. Consumers can now register their complaints in the CORE Centre through the website www.core.nic.in. They can also have access to wealth of information regarding Consumer issues through this website. State Consumer Welfare Fund States/UTs have to set up their own Consumer Welfare Fund by making a onetime contribution of an amount proportionate to the number of districts, by the Centre (Department of Consumer Affairs) and the State Government in the ratio 50:50 (Centre : State). In case of special category States, like North Eastern States, Sikkim, J&K, Uttaranchal A&N Islands and Lakshdweep the ratio will be 90:10 (Centre : State). National Consumer policy Increased global trade and the development of Internet have provided new opportunities for consumers, leading to new forms of unfair and unethical business practices. With the change in the global scenario and the market dynamics the consumers have also changed. Children and young adults and women – who often lack experience as consumers – are more significant forces in markets, as are the growing number of older adults who sometimes face unique marketplace challenges. This requires consumer protection authorities to be more vigilant and active. The sophistication of retail markets is increasing the role of consumers. The greater empowerment of consumers has also led to greater responsibilities for them to manage their own affairs. Here comes the need to make suitable policy prescriptions to protect consumer rights. The draft National Consumer policy envisages to promote the rights and interests of consumers and ensure a high level of consumer protection, contributing to protecting the health, safety and economic interests of consumers as well as promoting their right to information, education and to organise themselves to safeguard their interests. It will endeavour to achieve effective implementation of various consumer welfare schemes through progressive consumer related legislations and active participation of all stakeholders; Central and State Governments, academic and research institutions, schools and colleges, voluntary consumer organizations and civil society, business and above all the consumers themselves to create an effective consumer movement in the country. An empowered consumer is an asset to the nation and therefore today, it is widely acknowledged that the level of consumer awareness and protection is one of the major indicators of development in any country.

‘UMEED’ Rekindles Desire for Better Life

t is a common belief that gold is as dear to women, as a son to a mother. Same is true for a girl from village Lar of district Ganderbal, some 30 kms from Srinagar. In her early twenties, Ruksana, too nursed a desire to wear gold ear-rings. Coming from a poor family – her father a daily-wager and she herself earning a few hundred per month through knitting – their monthly earnings was hardly enough to meet the family expenses. So to save money that could fetch her golden ear-rings seemed like a herculean task. In June this year, as part of Centresponsored ‘Umeed’ project, an initiative of the National Rural Livelihoods Mission (NRLM), Self Help Groups (SHGs) started to function in Lar block of Ganderbal and few other areas of State, with an aim to alleviate poverty, particularly among women. And by the end of June, Lar block was successfully running 246 SHGs having 10-12 women per group. Each woman of the Self Help Group made a weekly contribution of not less than Rs 25 to a common pool, from where they could borrow money. cleared the decks for constitution of 90,000 Self Help Groups and enrolment of nine lakh rural women in the State. Ruksana also enrolled in one of the SHGs in Lar block and

much sought after ear rings. The Central Government also extended all professional assistance for the success of the Umeed project by deploying Primary

Resource Persons from Andhra Pradesh in J&K to train the local girls and women. Pertinently, SHGs are a success story in Andhra Pradesh running since 1950. As a positive development, 246 SHGs in Lar block made a whopping saving of Rs 6,97868 from June 2013 to September 2013 and disbursed Rs 3,34,250 in internal lending to the depositors. Ruksana, while taking benefit of the internal lending, took a loan of Rs 10,000 in August to buy gold ear-rings. Flaunting her priced possession she said “It is all because of SHGs that I could buy the golden ring. I thank the Government for this,” The Central Government has sanctioned an amount of Rs 7,500 crore for J&K under NRLM. The scheme is launched in the State with an increased allocation from Rs 110 crore to Rs 755 crore. With the allocation for the current year being about Rs 30.38 crore. A special emphasis is to be given to two-third of the families in the State under the ambit of the scheme with the target of 90,000 women Self Help Groups over a period of five years. Officials said there is special dispensation of allocating the funds on the pattern of 90:10 (Centre-state share) whereas in the rest of the country it is on the pattern of 75:25.
