misleading statement is followed by two blank lines allowing the defendant to write in anything he or she desires. Those lines are there to raise defenses, which can be the proper subject of a garnishment hearing; but those issues usually do not appear in justice courts. For example, a defendant can claim that the creditor does not have a valid judgment because the judgment is from a court in another state and the spouse was not a part of that lawsuit. A defendant can also allege that a judgment is being improperly enforced against community property because it was a separate debt and none of the debt was incurred on behalf of the marital community. There may not be much that can be done to change the language of the mandated garnishment forms because they are statutory. A.R.S. § 12-1598.16. However, at least for justice courts in Maricopa County, we are likely going to add an additional warning stating that the factual basis for the judgment cannot be attacked during a garnishment hearing. The main and often only purpose of a wage garnishment hearing is for the court to determine whether, based on clear and convincing evidence, that the amount being withheld would cause “the judgment debtor or his family” to “suffer extreme economic hardship.” A.R.S. § 12-1598.10(F). If so, then the amount of the nonexempt withholding can be reduced from 25 percent to not less than 15 percent. If you want to challenge a basis for the judgment, you will need to file a motion to set aside the judgment. It will follow a process that is separate from any garnishment action.

What Employers Need to Know About Garnishments If you receive a writ of garnishment from a court concerning one of your employees, don’t ignore it. An employer is required to complete and to file a Garnishee’s Answer with the court. If an employer fails to follow the legal requirements of a garnishment, then it can be held in contempt. A.R.S. § 12-1598.13(B). Possible penalties for the employer include being held responsible for the employee’s debt, additional attorney’s fees, and court costs. An employer should not forward any funds to the creditor until it receives an Order of Continuing Lien from the court. If the garnishment is completed or is discharged, then the employer must return any withheld earnings to their employee.

After pulling my kids away from their iPads over winter break, last month my family and I morphed from city dwellers into road warriors—in less than 24 hours might I add. It was New Year’s weekend and most of northern Arizona was expecting a snowstorm. Not accustomed to driving in winter elements and being a mom with two kids, I probably would have been a total wreck if it weren’t for having the Jeep at my disposal. So, we grabbed our snow gear, loaded up the Jeep, and started our adventure. The kids’ agenda was simple. They wanted to go sledding, battle to the death with snowballs, and build a snowman. That we did. Once I felt the confidence behind the wheel and the awesome handling of the Jeep, my agenda quickly expanded to doing donuts in the snow and selfishly cutting our snow ball fight short to take the long way back home from Fort Tuthill through Sedona. The kids didn’t seem to mind that we were off to yet another destination. Stopping along 89A, my husband poured the kids a cup of hot cocoa from a Thermos and we were back on the winding, white road. We stopped in Oak Creek Canyon for lunch and with plenty of daylight, we decided to spend more time in Sedona and take the Jeep off-road. If you’ve lived in Arizona for a fair amount of time, you’ve probably heard of Schnebly Hill Road. If you own a 4x4 vehicle with high enough ground clearance, you might have even ventured along the east side of Oak Creek Canyon. That or you own a really durable pair of hiking boots and took the route by foot, because regular vehicles are prohibited. With the pavement in the rearview mirror, I shifted into 4L and told the kids to hang on! Within minutes we were sharing the road with a Jeep Renegade (there comes that friendly wave I was talking about earlier). Then another…and another. It was like being in the sea and the only fish around were Jeeps! Now I get it, it’s a Jeep thing. I’ve read about it, I’ve even heard Jeep owners talk about it, but after getting behind the wheel of one and taking on boulders as if they were pebbles, I really get it! Thinking back to my time spent in the Jeep, it’s genuinely an American icon that embodies the freedoms we have and the spirit to truly be able to go anywhere and do anything.

HEARD MUSEUM A celebration of Native American art and culture. By Julie Carlson

THERE’S ALWAYS SOMETHING new happening at the Heard Museum. If the museum’s been on your must explore list or you haven’t been there in a while, then take a trip to downtown Phoenix and check it out. The Heard’s mission is to educate visitors and promote greater public understanding of the arts, heritage, and culture of the indigenous peoples of the Americas, with an emphasis on American Indian tribes and other cultures of the Southwest. The 130,000-square-foot museum was founded in 1929 by Dwight B. and Maie Bartlett Heard. The couple, originally from

Chicago, desired to share their love of Native American Art and culture with the residents and visitors of the Valley. The Heard has kept its promise by doing so since it first opened its doors more than 80 years ago. Throughout the years, the Heard has undergone various changes, but has always stayed true to its roots by showcasing American Indian fine art, artifacts, and hosting special events within the hallowed halls of their 12 exhibition galleries. There’s been a lot of recent construction at the Heard. The Billie Jane Baguley Library and Archives, which houses over 25,000 resources on American Indian Artists has been under con-

it necessary to immigrate to Spain. O’Conor did so at age 18, rising eventually to the rank of brigadier general before his death four years after the founding of Tucson. Then there were the seven Sisters of St. Joseph, those intrepid women who left St. Louis and headed for Tucson by way of San Francisco in 1870 to establish an academy for girls next to San Agustin Church. They battled seasickness on the steamer during the journey down from the City by the Bay to San Diego, followed by an uncomfortable carriage ride to Yuma. On the lonely road to Tucson they were terrified by howls of “wolves” (actually they were coyotes) and moments of uneasiness during the frequent marriage proposals they endured from lonely men along the way. They endured, as does the St. Joseph’s Academy they established. My favorite “Luck of the Irish” story comes not from Arizona but from Virginia City, Nevada. John Mackay and Jack O'Brian, two Irish immigrants, were strolling into the boom town of Virginia City when Mackay said to O'Brian, "Jack, how much money have ya got?" O'Brian turned his pockets inside out, "Not a penny," he said, "How much ya got in yours?" Mackay pulled out a fifty cent piece, examined it, then threw it out into the chaparral. "Now," Mackay said with a wide grin, "we

can walk into town like Irish gentlemen." The two worked in the mines and invested their earnings. In 1873, they invested in a mining property with two other Irishmen, James Fair and James Flood. For ten months they dug into the mountain, finally hitting a thin vein of silver, which soon pinched out. They searched and found it again, and soon the vein widened to 20 feet, then 50. Soon it expanded into a vein 20 feet high, 50 feet wide and 120 feet long of almost pure gold and silver. Incidentally, a foot-wide vein was considered rich. In some places, their vein was three hundred feet wide. The four Irishmen, Mackay, Fair, Flood, and O'Brian became known as the "Bonanza Kings" in the annals of mining in the Old West. Mackay was famous for his honesty, fair dealings with his employees, and generosity, especially to the charities. The Mackay School of Mines at the University of Nevada in Reno is one of his legacies. These are but a few of the Irish who left an indelible mark on the history of Arizona and the West. The real “Luck of the Irish” was to be born Irish, for theirs is the proud story of a people who were maligned, ridiculed, and made the victims of ethnic cleansing. By sheer determination, hard work and perseverance, they were able to overcome.

Why driving with your pet on your lap is a serious road hazard. By Ann Kelly

WHILE DRIVING UNDER the influence was once the major focus of safety on the road, distracted driving of all kinds has gained national attention in recent years. Texting and driving has proven to be the latest serious road hazard; it has cost a number of lives, and 42 states have developed laws and campaigns against it. Now many states are focusing their attention on a new threat— one that has gone under the radar thus far, but may prove to be as dangerous as texting and driving. This one involves the widely practiced habit of driving with a pet on one’s lap.

Why it’s a problem There are no real statistics to say exactly how many crashes and other traffic incidents pets on laps cause each year. However, the

AAA Foundation for Traffic Safety notes that taking your eyes off the road for just two seconds doubles your chance of a crash, and two seconds is all it would take for a frightened or excited pet to jump up on you, claw you, climb up onto the dashboard, or worse, crawl under the brake pedal.

The facts A 2011 AAA and Kurgo survey sought to ferret out the truth about how and why people drive with their pets, as well as any potential distractions their furry friends might potentially cause. The findings were interesting, to say the least; nearly 60 percent of respondents had driven with their pets in the last month, and 31 percent admitted to being distracted by their pet while driving. Create your own exercise obstacle course using household supplies. Use soup cans in place of dumbbells, a stepping stool for step exercises, a broom to hop back and forth over, and a coffee table for push-ups or triceps dips. Show your children that at any time and anywhere, they can do a workout. You don’t need to spend countless hours in a gym to be healthy and get results.

Mondays: Take a family walk. Tuesdays: Alternate 10 jumping jacks and dribble a basketball 20 times. Wednesdays: Play catch with a Frisbee. Thursdays: Get outside and create challenges for your kids. Try frog jumps, skipping races, and running backwards across the yard. Fridays: Have a dance party. Turn up the music and shake it! Saturdays: Plant a garden or do yard work. Sundays: Take a bike ride or hike.

As a family, create a plan to exercise. Make a chart for every day of the week and designate an exercise to check off when completed. For example:

WEIGHT-LOSS IS a topic that will always be surrounded by new trends or supplements that may guarantee fast and easy results. The buzz of garcinia cambogia has increased as celebrities have openly advocated for its use to shed pounds quickly. Before beginning any weight-loss agent, it is always important to ask the following three questions: What is it? Does it actually work? And, most importantly, is it safe?

What is it? Garcinia cambogia can be found growing on trees native to India or Southeast Asia. These pumpkin shaped fruits have rinds rich in hydroxycitric acid (HCA), which is believed to be the active component contributing to weight loss. HCA is thought to block the action of citrate lyase, an enzyme involved in a pathway resulting in fat and cholesterol production. It’s also been suggested that HCA can increase serotonin production, which contributes to suppressing food desires. Gar-
