Don’t Send Flowers after a Restraining Order Romantic feelings aren’t always reciprocal. If a romance fails and the other person won’t take no for an answer, there are some legal avenues you can pursue, says local judge Gerald A. Williams. WITH FEBRUARY COMES Valentine’s Day and at least some level of pressure to have someone to love. Queen fans (or Glee fans) may be familiar with the lyric “Can anybody find me somebody to love?” However, as most people learned during or after seventh grade, romantic feelings are not always reciprocal. In fact, sometimes they can even become dangerous. So what do you do if a romance fails and the other person won’t leave you alone? In Arizona, you can request an order of protection from any trial court (e.g., justice court, municipal court, superior court) at any time the court is open. You will be asked to complete a form explaining why you feel
This Type of Order or Injunction Doesn’ t Fix Child Custody Some people incorrectly assume that if they appear before one judge in one case, then that judge can also fix their other problems in other cases. It almost never works that way. Most judges do not like to list children as protected parties on either an order of protection or an injunction against harassment. Why? Because these types of court orders are unique in that they are initially issued with the judge hearing from only one side. The rules that govern this area state that these types of orders shall not contain provisions that concern child custody, parenting time, maternity, paternity, child support, or divorce. There is an exception if continued contact would result in a child being endangered; but issues concerning child custody are best resolved in family court.

Cover Up, It’s Freezing! Local meteorologist Shelley Sakala on how to keep your outdoor plants alive when the weather takes a downward turn.
20 || 85086MAGAZINE.com || FEBRUARY 2015
to make sure your plants stay warm and protected throughout the night. Of course, the first step in protecting your plants is to—wait for it—check the weather report. This former weathergirl endorses that strategy wholeheartedly. If the forecast calls for freeze or frost warnings, then break out the blankets and cover that greenery. Come spring, your yard will look fantastic. And your plants will thank you for it. Now, let’s get back to House of Cards.
• Cover plants before sunset to capture the day’s heat. • Leave the coverings on all night and well into the next day. • Remove the coverings once temperatures return to safe levels for your plants. • Allow your plants to soak up the sunlight for awhile, allowing the soil to heat up again. • Repeat the process whenever the nighttime forecast calls for freezing temps.
{
EVERYONE’S HEARD THAT old joke: “If you don’t like the weather in (insert your city), just wait 10 minutes.” Well, that doesn’t really apply in Phoenix—except during the winter. One minute you’re power-walking in shorts and a T-shirt, and the next minute you’re on the couch wrapped in a Snuggie, gripping a mug of Lemon Zinger with two hands. But you know who isn’t wrapped in a Snuggie? Your plants. And bushes. And shrubs. And trees. They’re outside silently screaming because they know nighttime is approaching and you haven’t covered them up. This is when you start calculating how much effort it would take to protect your plants (versus how much time and money you’d spend replacing your soon-to-be-frozen greenery). This ain’t the Circle of Life—it’s just being lazy. Come on, don’t be a plant killer. A few simple steps will keep your yard green and healthy. And chances are you’ve already got the materials you need in your house right now. Spend a little time in the yard tucking in those plants, and you’ll be back on your couch watching House of Cards in no time. While the average low February temperature for Phoenix is 49, the record low is 28—well below the point where plants sustain damage. To prepare your plants for a freeze (temperatures dropping below 32 degrees), you’ll need to cover them at night. Sheets and blankets work best, but you can also use towels, cardboard, or paper. Plastic is somewhat less effective, but if it’s all you’ve got, go for it. The idea is to cover the plants the way you’d cover your dining room table with a tablecloth that reaches all the way to the floor. Create a cave that faces the ground. This lets the ground heat rise up into your “blanket cave” after the sun goes down while sheltering the plants from the falling cold air. It’s an easy fix

Tips for Defining Your Market Do your research to figure out who your ideal client is. By Matthew Toren
ONE OF THE biggest mistakes that business owners make when starting out is skipping over market research. Many well-intentioned entrepreneurs fall in love with their business or idea, and in their excitement to get started, they simply pass over doing real market research. Whether it’s service based or product based, you need to do your research to figure out who your ideal client is. Don’t skip this
important step that will give you a vital snapshot of the feasibility of your idea to help clients. After all, if you’re going into business, or even if you’re already in business, you should be doing it to serve the needs or solve a problem for people. The great thing about taking the time to do your research is that while you’re in business to serve, you’ll end up seeing a direct correlation to sales when what you provide helps people.
Here are tips for how you can get started defining your market. Define Your Industry What industry are you getting into? You’re going to need to know the rules, norms, vocabulary, and general state of the industry you’re about to enter, so do your homework and figure this out. It’s not good enough to fake it—you’ll want to be able to talk the talk in meetings with clients and also as you network and build relationships with other businesses. Take the time to learn all you can.
Here are a few tips on how:
• What are the top three books written about your industry or market? A simple Google or Amazon search will produce the most popular, highest-grossing book sales for industry-relevant options. Buy the top three and read them. • Who are the top leaders in your industry? You can research them at the global or national level, but also be sure to include your local authorities. Even if they’re smaller fish in the overall industry pond, they could have valuable insights. Now, research any articles, press, or interviews that pertain to them and read those. What about any books they’ve written or conferences they’ve attended? What they’re talking about and where they’re going are good indicators of what you should know and where you need to be attending to stay on top of the relevant changes in your industry.
22 || 85086MAGAZINE.com || FEBRUARY 2015
Define Your Purpose If you’ve heard the buzzworthy Simon Sinek TED Talk called “Start with Why” then you already know the importance of this idea. If you haven’t, watch it, and then sit down with a pad of paper and start brainstorming why you’re in business or about to go into business. Make sure you aren’t going off the rails with “how” you do what you do; stay focused purely on why you do what you do. The how will follow; don’t worry about that just yet.
Define The Feeling of Your Business When you know why do you what you do, your business still needs to answer some more questions. As you know from your own experiences, how you feel during your interaction and continued exposure to a business or brand is why you choose to love them or leave them. Loyal United Airlines customers are walking away from the airline en masse this year since the company changed its MileagePlus Program. Devoted Nordstrom shoppers will continue to return to the upscale retailer because of their excellent service and no-questions-asked return policies for clients. All these continued interactions with a business can define you for good or bad in your client’s eyes, so establish how you want your business to feel for your target market and make sure you stick to ensuring that the feeling stays.
Professional Profiles ASK THE ATTORNEY
Kerrie Droban
Q: Do I really need an attorney to handle my divorce? We agree on everything. A: Usually, yes. If one spouse hires an attorney, you will be at an extreme disadvantage if you decide to represent yourself. You will be held to the same standard as a lawyer and expected to litigate the case and be as knowledgeable about the law. Even if you and your spouse agree to the equitable division of assets, legal decision-making authority and parenting time, it’s sound to hire a lawyer to draft up your agreements and ensure that your mutual contract is not only enforceable but fair.

FAVORITES Author/writer: Joel Osteen and Joyce Meyer. Escape: The beach, San Diego. Meal in town: There are lots of fabulous places to eat here in the Valley, but I gravitate to Joe’s Crab Shack’s steamed lobster pot—bib and all! Movie: There are so many, many wonderful movies out there, but it would have to be a chick flick. I’m torn between Chocolat with Johnny Depp (which I really relate to) and The Notebook, which parallels my life. Musician/band: I love all types of music genres, but Christian music tops my list, and my favorite band has to be Mercy Me. Annual event: Well, my birthday! Of course!

Love At First Sight?
LOVE STORY: Scott’s work took him to the Colorado National Golf Club where Lindsay was working at the time. He accidentally left his laptop in the bar and called the golf shop to see if someone could grab it, and Lindsay obliged him. The next evening, Scott and his co-workers invited her to join them for dinner in Boulder, and the rest is history. They dated long distance for about a year and decided it was time to take their relationship to the next level, so Lindsay moved down to Arizona.
“IT WAS LOVE AT FIRST SIGHT. I JUST KNEW THAT THERE WAS SOMETHING DIFFERENT ABOUT THIS GIRL AND NEEDED TO GET TO KNOW HER BETTER.”—Scott
IDEAL DATE: They are homebodies, so their idea of a perfect date is cooking a crazy new meal together at home and watching a movie afterward.
Love At First Sight?
KEY TO ROMANTIC SUCCESS: For Scott, the key to romantic success is understanding each other’s love language. Lindsay says, “It’s always telling each other you love one another as well as showing each other affection each and every day.” WHY THE COUPLE CHOOSE ANTHEM GOLF & COUNTRY CLUB AS THEIR WEDDING VENUE: After working at the club for over two years, Lindsay knew it was the perfect place. “Not only is the Anthem club absolutely beautiful, but it also has different size spaces that worked well with the style of the wedding we wanted. Not to mention the staff is awesome and is like family,” Lindsay says.

CHRIS FORT AND JAMIE COTTRELL FORT AGE: 50 and 37 OCCUPATIONS: Sales executive and financial advisor LOVE STORY: “I’m not sure if it was love at first sight, but there was a mutual attraction. For Chris, it could have been physical or perhaps a sweet smile,” says Jamie, who described her then future husband’s gentlemanly manner of holding the door open for her with a smile and a greeting as she walked into an office complex. “I didn’t think much of it at the time, but after a few more days of sporadic coincidence of having this very handsome guy catching the door for me, it made an impression on me,” she says. Jamie was impressed by Chris’s genuine manners, and the gallant act of holding the door for her sparked conversation. This led to a great friendship, which over time became a much deeper connection.

IDEAL DATE: The pair enjoys spending quality time together no matter what they’re doing. KEY TO ROMANTIC SUCCESS: They agree that the key to continued romantic success is communication and respect. WHY THE COUPLE CHOOSE ANTHEM GOLF & COUNTRY CLUB AS THEIR WEDDING VENUE: Both Chris and Jamie think the setting at the Anthem Country Club is absolutely breathtaking. They also like the fact that event coordinator Kathy Cuaderno took care of all of the little details and even provided them with a vendor package. “The ease of planning was ideal for our busy lifestyle,” Jamie says.

RYAN AND BETHANY CUADERNO AGES: 28 and 22 OCCUPATIONS: Accountant and full-time student LOVE STORY: Ryan and Bethany’s families were long time friends. “We have the same birthday, July 13, so sometimes our families would sing happy birthday to both of us on our family vacations. But because of our six-year age difference, as kids we didn't think twice about each other,” says Bethany, who moved to California after high school. It wasn’t until a family beach vacation a couple years later that sparks started to fly. After two months of dating, Ryan told Bethany he loved her and wanted to marry her. “It was a dream for both of us to fall in the love way we did,” she says. IDEAL DATE: The pair love going out to dinner, followed by anything adventurous or spontaneous. KEY TO ROMANTIC SUCCESS: For the Cuadernos, the key to romantic success is to take a practical and spiritual approach. “Spiritually we believe that making Jesus the center of our home will keep us together...and not only together, but happily together,” says Bethany. The couple also counts fun things like water fights and impromptu dancing around the house as important. “We also never go a day without skipping our kiss good night and saying ‘I love you,’” says Bethany. WHY THE COUPLE CHOOSE ANTHEM GOLF & COUNTRY CLUB AS THEIR WEDDING VENUE: “My sophomore year of high school I attended a wedding held at the Anthem Golf and Country Club; it was absolutely the most beautiful wedding I had ever seen. Ever since then I knew I wanted to have my wedding there,” says Bethany. FEBRUARY 2015

KARL AND CHRIS FUERSTENAU AGES: 53 and 52 OCCUPATIONS: Production manager and portfolio administrator
CHAD AND BRANNAN MIRR AGES: 40 and 36 OCCUPATIONS: VP sales, revenue cycle technologies and stayat-home mom/personal trainer LOVE STORY: In 2005, both Chad and Brannan had recently removed themselves from difficult relationships. At the time, Chad traveled a lot for work and Brannan was teaching first grade while also taking classes to obtain her master’s degree. With minimal time on their hands to “run into” their future mates, they resorted to an online dating website. This gave them an opportunity to get to know each other prior to meeting in person. Their first date was dinner and drinks at the Kona Grill in Chandler. Chad proposed to Brannan in her classroom a year and a half after their first date, and they got married in Maui in 2008. IDEAL DATE: During the winter months, the couple delights in a day trip to Snowbowl to go snowboarding. They have intimate conversations on the lift, race to the bottom of the mountain, warm up with a drink in the lodge, and then repeat! THE KEY TO ROMANTIC SUCCESS: Keep score—but of good stuff! “It is so easy to keep score of the things your partner does wrong or doesn’t do at all, e.g., leaves dirty clothes lying on the floor or forgets to pick up milk on the way home from work. Instead, keep score of the good things your partner does and most certainly show your appreciation, e.g., filled up your gas tank or surprised you with tickets to see your favorite band,” Brannan says. The Mirrs actually keep a scoreboard on their fridge to keep track of all these nice gestures!
LOVE STORY: Karl and Chris met in Denver, Colorado in 1989. They were introduced to each other at a neighborhood restaurant by mutual friends where Chris would go for Happy Hour with co-workers. Karl had worked with some of the same people who currently worked with Chris. When they met in October, Karl was in a leg cast and wearing shorts, with snow on the ground, and Chris thought he was crazy wearing shorts that time of year. They ran into each other a few times after their first introduction but didn’t really get a chance to spend much time together. Karl was being kept busy caring for his 4-year-old daughter, of whom he had sole custody. With the holidays around the corner, Chris’s office was having a Christmas party, and since she had moved to Denver only a few months before, she didn’t really know many people other than those she worked with. So Chris took a chance and called Karl to invite him to her Christmas party, figuring he knew most of her coworkers so it would be fun for both. They went on one movie date before the party to get to know each other and really hit it off. Since going to that Christmas party, they’ve been inseparable ever since. IDEAL DATE: The pair enjoys going out to dinner, sharing each other’s day, and making each other laugh. KEY TO ROMANTIC SUCCESS: Karl and Chris count never taking each other for granted as paramount to their relationship. Communication and appreciation are also key, along with daily showing kindness, respect, and affection towards each other.
Love At First Sight? “CHAD CAPTURED MY ATTENTION IMMEDIATELY WITH HIS GOOD LOOKS, BUT HE REELED ME IN WITH HIS WITTINESS AND CHARM!”—Brannan

How does Nioxin work?
Cleanse, Condition, and Treatment Step 1: Cleansers help to clear away the sebum and environmental residue that contribute to clogged follicles, leaving the scalp in a healthy condition. Step 2: Conditioners restore moisture and elasticity, which are vital to hair that is prone to breakage. Leave on 3–5 minutes, and rinse. Unless you want the top of your head to shine like your dress shoes, avoid a vigorous towel rub! Blot with a towel instead. Step 3: Scalp treatments are loaded with antioxidants and botanicals that thicken each hair strand while refreshing the scalp. These are applied to the areas that are thinnest. Gently massage treatment onto scalp, and style as usual. As a bonus, a thermal protection is found in all treatments! For additional treatment of progressively thinning hair, Nioxin’s intensive-therapy Hair Booster can be used a few times per day. I consider this the Miracle Grow for hair!
Which Nioxin System is Designed for You?
Fine Hair (Volumizing cleanser, lightweight conditioner, and leave-in treatment to refresh or protect scalp with white tea extract, humectants, and peppermint oil; amplifies texture and provides healthy shine to natural hair and moisture balance to chemically treated hair.) System 1: natural, non-chemically treated hair—early stages of thinning. System 2: natural, non-chemically treated hair—noticeably thinning. System 3: Chemically treated hair—early stages of thinning. (With SPF 15) System 4: Chemically treated hair—noticeable thinning. (With SPF 15) Medium/Coarse (Moisturizing cleanser, smoothing conditioner, and leave-in treatment to refresh or protect scalp; contains silk amino acids and kukui nut oil that provide a balance of moisture and smoothing control to natural or chemically treated hair.) System 5: natural or chemically treated hair—early stages of thinning. (With SPF 15) System 6: natural or chemically treated hair—noticeable thinning. (With SPF 15) If you’re wondering if Nioxin is right for you, consider their proven performance. Their products don’t cure thinning or promote hair growth, but they will take what you have, no matter your hair type, and provide you with thicker, denser-looking hair. Fall back in love with your hair, even if some of it has gone down the drain.

occurring, then it’s automatically safe and effective, right? Well, not exactly. Although creatine has been shown to have modest benefits for short bursts of intense, repetitive exercises usually lasting less than 30 seconds—weight lifting or sprinting, for instance—it doesn’t seem to have significant benefits on endurance or aerobic exercise. According to the Mayo Clinic, there have been several ”high-quality” studies that have shown an increase in muscle mass with the use of creatine, but evidence is really lacking when it comes to other aspects of athleticperformance enhancement. You may be thinking that the increased muscle mass is exactly what young athletes are looking for, but it’s important to note that most studies that have been conducted involved adults over the age of 18. In fact, most of the studies have been performed in a laboratory and not on athletes at all, and have shown the most benefit in people ages 20 and older. Along with its potential lack of effectiveness, there are also negative side effects that can occur (see the table below). So what do you do with your young athletes who want to enhance their athletic performance? For one, you tell them there is never going to be a “magic” quick fix. According to Todd Durkin, the founder and CEO of Fitness Quest 10 and an internationally recognized trainer and coach, “the reason to steer young athletes away from creatine and other supplements is that its effectiveness for performance enhancement is so minimal compared to proper sleep, good nutrition, and commitment to a training program.” If they want to enhance their athletic performance, they should really start with the following:
Sleep: At least eight hours per night. Our bodies heal, repair, and build while at rest. Getting a good night’s sleep will enable the body to repair and grow the muscles that have been exercised as well as provide the energy for high-intensity workouts.
Eat a healthy diet: Maintaining a well-balanced diet that contains proteins, complex carbohydrates, and unsaturated fats can help with overall health and provide the nutrients needed to provide the building blocks for growing muscles.
Maintain a consistent, welldeveloped training program: Find a routine that is safe, challenging, and well rounded. Professional advice and training can be sought out, but the key is consistency. A properly designed routine along with complete dedication to overall health will provide young athletes with the results they’re looking for. More importantly, it will set them up with the foundation for a healthy lifestyle. FEBRUARY 2015

Train like an Athlete
Photos by Stephanie Heymann, stephanieheymannphotography.com
Engage in challenging workouts that focus on more than calories burned or time logged in at the gym. EVERYONE HAS THE ability to train like an athlete. It simply involves training your mind for performance. Athletes tend to focus more on skill improvement, movement, strength, agility, and flexibility rather than on calories or time spent in the gym. They engage in workouts that consistently challenge them. As a result,

they naturally get fit and toned without overthinking it. Keith Poole, former NFL football player and owner of Keith Poole Training Zone, says, “You don’t have to be preparing for the Olympic trials or signing on to a professional sports team to increase your athleticism. Training like an athlete
requires you to develop a committed mind-set of improvement and success and incorporate a variety of explosive and diverse skill-based exercises into your routine.” So, are you ready to train like an athlete? Include these four drills into your workout one or two times a week.
SUICIDES Setup: You will need a starting line or a cone plus three additional sprint lines. Action: Sprint to the first cone and touch, and then sprint back to the start. Next, sprint to the second cone and then back to the start. Each sprint will be twice as long as the last. Repeat until all cones have been touched.
STEP-UPS Setup: Place foot on step, tire, or bench approximately 6 inches high. Action: Alternate stepping up and down as fast as you can for 30 seconds. Switch your lead foot halfway through your set.
