THE FIGHT CONTINUES
Every day, the AAAA continues to fight for you on issues such as mandatory data sharing and anti-competitive behaviour With all that is going on in the world, you could be forgiven for assuming work on issues such as mandatory data sharing might no longer be a top priority for the AAAA. I am here to tell you unreservedly that this is not the case. In fact, mandatory data sharing and other action against anti-competitive activity remains our number one priority on a day to day basis. We have been actively undertaking numerous activities across 2020 in pursuit of our goal and you can rest assured that while we have been working diligently to support our members through this time of crisis, we have not taken our eye off the ball. Indeed, all at the AAAA remain keenly focused on all possible opportunities for furthering our cause and are actively seeking out ways to drive this message forward with those who can make mandatory data sharing law a reality. For example, the AAAA was recently invited to participate in the Senate’s Inquiry into Holden’s withdrawal from the Australian market and we took this chance to unashamedly talk about data sharing. By doing so, we not only ensured mandatory data sharing law stays on the Federal Government’s agenda, but we also secured a commitment with an official motion in the Senate that calls for the law to be established by the end of 2020. Our dialogue with government is not limited to activities such as this Senate Inquiry either. For instance, I recently wrote to Federal Assistant Treasurer Michael Sukkar asking the Federal Government to set a date for the introduction of mandatory data sharing law. I am pleased to report Minister Sukkar responded
exceptionally positively, stating to me that not only is mandatory data sharing law still important to the Federal Government, but it is even more important than it has ever been. This is greatly encouraging, and I am grateful to the Assistant Treasurer for his commitment, his continued engagement, and his support. At the same time we have been outraged, as I am sure you are also, by the recently announced intent of Mitsubishi to seek ACCC permission to introduce a restrictive 10-year warranty under the ACCC Exclusive Dealing regulatory framework, which will be conditional on consumers not using independent repairers or aftermarket parts. There is no doubt this exclusive dealer notification goes too far – we have long been concerned about extended warranties because consumers already worry they do not have a choice, and now this move straight up says they will not. This is easily the most trade restrictive move we have seen from a car manufacturer and represents the beginning of a practice that I expect, if not stopped now, will flow on to every other major brand in our market. I can tell you wholeheartedly that we will not stand for it and so we have swiftly taken action, coordinating more than 133 major submissions to the Australian Competition and Consumer Commission (ACCC) to formally object to this proposal. Mitsubishi may argue they are only seven percent of the market, but it will not take long before 80 percent is controlled by these extended warranties if we do not act. Moves such as this is why we dedicate so much of our resources to ensuring we are not only always ready to identify these threats but also able to respond quickly, professionally and comprehensively.
We are also fighting on a global level, with myself and AAAA’s Director of Government Relations, Lesley Yates, being Australia’s representatives on the Global Automotive Right to Repair Committee. This Committee most recently met in September, with Canada, South Africa and the US joining us in reporting significant progress in our worldwide labours to protect automotive consumer rights and counter the efforts of large multinational car companies to deny access to critical repair information. I understand that when you aren’t reading about mandatory data sharing every day, it can be easy to think that it isn’t what we are waking up every single day thinking about, but I can assure you that is not the case. No matter what this global pandemic throws at us, mandatory data sharing law and the fight against anti-competitive behaviour remains our number one focus as we know it is absolutely critical to your future success. From taking advantage of opportunities such as the Holden Senate Inquiry to our strong response to Mitsubishi trying to do wrong by consumers and the aftermarket industry, to our regular outreach and dialogue with Ministers, Departments and Associations and our participation in global meetings, there is not a day that goes by that the AAAA isn’t actively fighting for you, your customers, and your Right to Repair. Afterall, having choice is in the best interest of all consumers. It has always been our biggest priority and will continue to be the biggest priority until we get it – I promise you; we will not let up.

OCTOBER OPPORTUNITIES 100,000 NEW APPRENTICESHIP POSITIONS TO LEAD THE COVID-19 AT CAPRICORN ECONOMIC RECOVERY In this column, Capricorn Society’s Group Chief Executive Officer, David Fraser, updates us on all things Capricorn

The Morrison Government will invest an additional $1.2 billion to support Australian businesses to employ 100,000 new apprentices or trainees as part of its COVID-19 economic recovery plan. Since 5 October 2020, businesses who take on a new Australian apprentice are eligible for a 50 percent wage subsidy, regardless of geographic location, occupation, industry or business size. Prime Minister Scott Morrison said apprenticeships are an important pathway to get young people into jobs and to ensure there is a skills pipeline to meet the future needs of employers. “During this pandemic the Federal Government has been focused on supporting and creating jobs as well as identifying the skills we need in the economic rebuild,” the Prime Minister said. “Already 760,000 jobs that were either lost or reduced to zero hours as the COVID crisis hit, have come back into our economy. We want to continue to recover what has been lost and get young people into work. “Whether it’s the manufacturing, housing and construction, arts or mining sectors – this new wage subsidy gives businesses certainty to hire and provides a career path to aspiring, young tradies.” The subsidy is now available to employers of any size or industry, Australia-wide who engage/have engaged an Australian apprentice or trainee from 5 October 2020 until the 100,000 cap is reached. Under the new measure, employers will be eligible for 50 percent of the wages for a new or recommencing apprentice or trainee for the period up to 30 September 2021, up to $7,000 per quarter.
Finally, following on from the release of Capricorn’s State of the Nation report, Capricorn will be hosting a series of webinars that explore some of the more thought-provoking insights from the research.
Minister for Employment, Skills, Small and Family Business, Senator the Hon Michaelia Cash, said the measure builds on the existing $2.8 billion Supporting Apprentices and Trainees wage subsidy that is helping employers to retain their apprentices and trainees.

Assistant Minister for Vocational Education, Training and Apprenticeships, the Hon Steve Irons MP, said the new measures we are announcing today will build on the already significant investment to support apprentices and trainees. “Through the existing Supporting Apprentices and Trainees measure, as many as 90,000 businesses employing around 180,000 apprentices throughout Australia will continue to be supported,” Assistant Minister Irons said. 2020-21 BUDGET BACKS MANUFACTURING The 2020-21 Budget includes significant investment for the Modern Manufacturing Strategy The Morrison Government says it is backing Australian manufacturing, as well as the science and research that underpins it, as part of its Economic Recovery Plan to lead the nation out of the COVID-19 crisis by creating the jobs needed now and for generations to come. The 2020-21 Budget includes an investment of $1.5 billion over four years for the Modern Manufacturing Strategy to allow Australian manufacturers to scale up, compete internationally and create more jobs. Minister for Industry, Science and Technology, Karen Andrews, said the investments highlight the Government’s commitment to making science and technology work for industry, which is a key pillar of the Modern Manufacturing Strategy. “A resilient and competitive manufacturing sector should be at the heart of a modern Australian economy and this Strategy will create jobs, drive our economy forward and make Australia more secure,” Minister Andrews said. “When you combine our new Modern Manufacturing Strategy with the increased funding for the CSIRO, you have a powerful base from which to turbo-charge job creation.” The centrepiece of the Modern Manufacturing Strategy is the $1.3 billion Modern Manufacturing Initiative, which will see the Government strategically invest in projects that help manufacturers to scale up and create jobs. “We are putting our money where our mouth is, to galvanise investment in Australian manufacturing,” Minister Andrews said. The Modern Manufacturing Initiative will support
projects within six National Manufacturing Priorities: resources technology and critical minerals processing, food and beverage, medical products, recycling and clean energy, defence, and space. Industry will be engaged to help develop tailored road maps for each of the priority sectors. The Strategy will also address the competitiveness of individual manufacturers in priority sectors, with a $52.8 million expansion of the Manufacturing Modernisation Fund. Earlier this year the Government invested $48.3 million to support around 200 projects worth $215 million, which are expected to create 2,600 jobs. The COVID-19 crisis has also highlighted supply chain issues and opportunities. A $107.2 million Supply Chain Resilience Initiative will support projects that address an identified supply chain vulnerability. The Budget also includes an additional $459.2 million in funding for the Commonwealth Scientific and Industrial Research Organisation (CSIRO) over four years to address the impacts of COVID-19 on its commercial activities and ensure it is able to continue essential scientific research. The 2020-21 Budget also includes measures to support the goal of Australia becoming a leading digital economy by 2030, with $29.7 million to help Australian businesses better use digital tools to readjust their operations and processes in a post-COVID economy. This investment will accelerate the adoption of digital technologies by businesses, create jobs in sectors with high potential for growth, support
the use of technology to make business regulatory compliance easier, and boost Australia’s influence over the development and deployment of digital standards. The Morrison Government says it is also committed to realising the potential of women in science, technology, engineering and mathematics (STEM). As such, the Budget includes: • $35.9 million to expand the Boosting Female Founders Initiative. • $10 million to extend the successful Women in STEM and Entrepreneurship grants program. • $2 million to extend the Women in STEM Ambassador initiative. This is also an important part of the Government’s Women’s Economic Security Statement. The Government is also building sovereign capability in life-saving nuclear medicines with the Australian Nuclear Science and Technology Organisation (ANSTO) receiving an additional $238.1 million over the next four years. Also recently announced by the Morrison Government is the investment of an additional $1.2 billion to support Australian businesses to employ 100,000 new apprentices or trainees as part of its COVID-19 economic recovery plan. AAAA APPEARS AT HOLDEN SENATE INQUIRY The AAAA successfully championed mandatory data sharing law during the Inquiry AAAA Chief Executive Officer, Stuart Charity, and AAAA Director of Government Relations, Lesley Yates, recently appeared at the ongoing Senate Inquiry into the withdrawal of Holden from the Australian market. Holden is currently the only vehicle manufacturer which is truly sharing data with independent repairers. As part of their submissions, Stuart and Lesley assisted the Inquiry members to understand that Holden’s participation in data sharing means that its withdrawal will not have a noticeable impact or effect on the owners of Holden vehicles, as the Australian auto aftermarket will be able to source parts and provide regular service and repair for these vehicles into the future.
At the same time, they demonstrated to the Inquiry that the Holden withdrawal underscores and amplifies the need to expedite government commitments to introduce mandatory data sharing legislation. To do so, Stuart and Lesley explained to the Inquiry that the withdrawal of any other brands from the Australian market in the future will leave the owners of these vehicles without the ability to choose their preferred repairer, driving up the costs of car ownership and potentially rendering people’s assets worthless. The AAAA’s efforts to shine the spotlight on mandatory data sharing on the Senate floor proved successful, with Stuart and Lesley’s message not only well received but also followed up with a

PRI CANCELLED The show was to have been held in Indianapolis in December In a statement released on September 16, PRI President Dr Jamie Meyer announced that the 2020 Performance Racing Industry Trade Show has been cancelled. “Despite the great efforts of PRI staff, the city of Indianapolis, and industry members from around the world to produce a first-class event for motorsports professionals, PRI made the tough decision to cancel the 2020 PRI Trade Show. While this is quite a setback for the racing industry, I do want to take this opportunity to share some insights with you,” Dr Meyer said in the statement.
“Getting this far was only possible through the hard work of our partners at Visit Indy and the Indiana Convention Center, as well as the people of Indianapolis. And while we certainly respect the tough job that local public health officials have in keeping their community safe, it became clear that we wouldn’t be able to provide a trade show environment in 2020 with the business and networking opportunities you’ve come to expect. “Our goal will always be to deliver a world-class event that helps racing and performance businesses succeed, and we share your disappointment over the outcome of this year’s show. HSP PLANS VICTORIAN MEGA FACTORY The innovative ute accessories company is looking to bring back Aussie manufacturing HSP 4x4 Accessories has announced plans to establish a Victorian manufacturing hub including a ‘mega factory.’ Negotiations are currently underway for a 200,000 square metre parcel of land in the Goulburn Valley region of Victoria, on which HSP plans to eventually establish a number of factories. While the company currently employs 40 staff across its Melbourne and Alexandria locations, its ambitious plans could eventually see it double or triple staff numbers. “I would say the state of Aussie manufacturing right now is concerning, but also hopeful,” HSP 4x4 Accessories Director, Massih Aimaq, said. “If we look back at the 50s and 60s where manufacturing in Australia was at its peak, we had just shy of 30 percent of the economy employed in manufacturing which is four times our current figures. “In saying this, there are incredible opportunities to bring back manufacturing to Australia and really push some good products out to the world. “We want to be a part of this, and so we are currently in the planning stages for our new manufacturing hub. “We feel so lucky to be in Australia, and even if there are uncertainties throughout the world, the only way we will overcome these is by pushing forward. We think it is so sad to see some companies who were Australian manufacturers move some or all of their business overseas – we think that now is a better time than ever to have confidence in our economy.” With its plans, HSP hopes to deliver much-needed jobs to its community.

AAAA LEADS INDUSTRY CHARGE AGAINST ANTI-COMPETITIVE PROPOSAL The AAAA and 133 of its members have rallied together to ensure the most trade-restrictive proposal seen in recent times is rejected by the ACCC
Mitsubishi Motors Australia Limited (MMAL) has lodged an exclusive dealing notification with the ACCC, seeking permission to introduce a 10-year warranty for purchasers of new Mitsubishi vehicles which requires all servicing to be conducted by a Mitsubishi dealer. As the practice of putting conditions on warranties is prohibited, Mitsubishi has asked the ACCC for an exemption from Australian Consumer Law (ACL). In response, the AAAA has moved quickly to file its own comprehensive and legally-based objection to the notification; encourage and assist its member base to file their own submissions; gain an extension to October 9 for those submissions; and reach out to other parts suppliers and repair groups to ensure they were aware and able to register their own opposition. AAAA Director of Government Relations, Lesley Yates, spearheaded the AAAA’s campaign; working around the clock ahead of the October 9 deadline for submissions with the support of the AAAA and its partner, Industry Legal Group. At the time of printing this edition of AAAM Magazine (October 16), a decision was yet to be made by the ACCC on this issue, but it is expected one will be made public before the end of October 2020. “If this application is waved through by the ACCC this would set a very dangerous precedent that would most likely be followed by other car brands and would have a damaging impact on the aftermarket industry and on consumers,” Yates said. “This intention to restrict customer choice is a significant threat to our industry and requires consumers to trade away their statutory rights to avoid potential issues with one of their most valuable assets while reinforcing the myth that the only protection a consumer has on their vehicle is under a manufacturers’ warranty. “Everyone at the AAAA and many of our members have worked exceptionally hard to show the ACCC what will happen to competition and to consumer rights if this notification is allowed to stand. “We have been greatly encouraged to have so many of our members of all sizes, locations and specialities come together to stand side by side with us in this critical fight. Well over 100 member businesses, despite their individual competitive
interests, have pulled together to protect consumer rights and the future of our industry and we are very thankful for their efforts. “It is our hope that the ACCC will seek to reinforce the competitive nature of our market and not restrict consumer choice or reduce consumer rights. We now eagerly wait to see if our work, and the amazing work of our members and other interested parties, has been enough to sway the ACCC away from facilitating this terrible move by Mitsubishi Motors.” Pedders, Bapcor, J&F Motors and Davies, Craig are four of the 133 members who have joined the AAAA in this important fight. “Pedders Suspension and Brakes would like to pass on its thanks to the AAAA staff and members for their quick and decisive action in regards to the MMAL 10-year warranty application,” Pedders Suspension and Brakes Director, Mark Pedder, said. Mark, who is also Chairman of the AAAA board, continued, “this has the real potential to set a precedent for other manufacturers to follow and without the support of the Association plus the enormous ground swell of support from Industry this would now be a reality. To Stuart, Lesley and all at the AAAA, it is great to know you have our backs so we can continue to forge forward even through difficult times.” Bapcor Limited Chief Executive Officer and Managing Director, Darryl Abotomey, echoed Mark’s comments. “We believe this warranty offer and the conditions linked to it places consumers in a situation where they are restricted from having any choice of who can service and repair their cars,” Darryl, said. “The vehicle manufacturers will know these customers are forced to always service their vehicles directly with them for that entire period
or their customers will risk losing their warranty. In the end consumers will be paying more for their car servicing as it is well known that servicing a car at a dealer is more costly and less convenient for most compared to using independent workshops. “We are proud to stand alongside our team members, fellow AAAA members and Australian motorists in raising our concerns against this latest move by a vehicle manufacturer to lock out independent repairers.” J&F Motors Director, Steven Grocl, agrees that it is important to avoid a precedent that could undo the work of the Right to Repair campaign. “If this exclusive dealing notification is allowed to proceed it is highly likely that most other manufacturers will follow suit, therefore preventing Independent Repairers from competing on an even playing field and undoing all of the previous hard work. Subsequently this will threaten the future for Independent Repairers as an industry,” Steven said. Australian Electric Fan and Electric Water Pump Manufacturer Davies, Craig was another pleased with how the industry has pulled together for this cause. “Davies, Craig sees this proposed scheme as a vastly broader public issue given such relationships are highly susceptible to abuses of power and can be seen as a form of entrapment. CLASSIC AND VINTAGE CARS MEAN JOBS In this COVID-19 crisis we need all the jobs we can get Research by the Australian Historic Vehicles Interest Group (AHVIG) shows that old car owners spend $5,000 a year on average on maintenance, restoration, storage, transportation and so on. It says the restoration of some cars can cost many hundreds of thousands of dollars, all going to small businesses with many of these being located in regional Australia. AHVIG says the luxury car tax blocks the importation of many historic cars and costs Australian jobs. It states its research has also found that imports of cars which are more than 30 years old contributed only $1.1 m annually to government import taxes over the last decade. As such, it says that instead of protecting jobs for local car manufacturers, this tax is now costing Australian jobs.
To correct this anomaly, the Historic Vehicle movement is asking for the removal of luxury car tax from the importation of cars over 30 years old. It says this will help create jobs that the Prime Minister is looking for and states that the Federal Treasurer’s office has been supplied with all the data to justify this exemption. The UK reportedly has a similar number of Historic Vehicles on the road and their “cottage industry” contributes over four billion pounds per year to the UK economy. AAAA CALLS ON FEDERAL GOVERNMENT TO SET A DATE FOR RIGHT TO REPAIR The new law is now expected before the end of 2020 The Australian Automotive Aftermarket Association (AAAA) wants the Federal Government to set a date for the introduction of the mandatory scheme for the sharing of vehicle service and repair information. In October last year, the Federal Assistant Treasurer Michael Sukkar committed the Federal Government to establish a new law that would compel car manufacturers to share mechanical repair and service information with the auto repair sector on fair and reasonable commercial terms. The Minister’s decision to commit to a standalone law was based on a mandatory system as recommended by the Australian Competition and Consumer Commission in 2017 after it found considerable consumer detriment and potential abuse of market power could now occur and that existing voluntary systems are ineffective. The new law is now expected before the end of 2020 and it will be designed to provide a fairer playing field for the repair and service of the 74 brands of vehicles available in Australia in an industry worth $25 billion annually. AAAA Chief Executive Officer, Stuart Charity, said he was encouraged by recent communication from the Assistant Treasurer which said in part that: “Progressing the Motor Vehicle Scheme remains a priority for me and for the Government. As the Government’s priorities are now shifting toward the recovery of the Australian economy, supporting small businesses, such as independent repairers, is as important as ever.” Stuart said he was grateful for Minister Sukkar’s commitment, his continued engagement with the industry, and his support for the new Motor Vehicle Scheme. “I know COVID-19 has the government occupied but now more than ever 30,000 independent repairers and workshops need access to this information so they can recover from the economic consequences of the pandemic quicker,” Stuart said. Stuart and AAAA Director of Government Relations, Lesley Yates, are Australia’s representatives on the Global Automotive Right to Repair Committee. The committee met earlier this month to collaborate in the worldwide movement for automotive consumer rights and to counter the efforts of large multinational car companies preventing consumer efforts to repair products by denying access to critical repair information. Canada, South Africa, and the US all reported significant progress.
“Australia is on the verge of a new law to protect Australia’s 18 million car owners from the potential price gouging that can occur when drivers must return to the car dealer for repair and service,” Stuart said. “The amount of control that vehicle manufacturers exert over the aftermarket is a global issue. Every nation is working to limit the power these companies have to capture the consumer for the life of the vehicle, reducing competition and driving up the price of car ownership. “What we are looking to do in Australia is nothing more than the Americans have had in place for the past eight years. “Both the authorised dealers and the independent sector continue to operate in parallel offering choice and quality services to consumers who are free to select a repairer based on their own preferences and circumstances. “No car owner should be forced to take the car back to a dealer because the car manufacturers have artificially manipulated the market by withholding software updates and reinitialisation codes.” Stuart said another compelling reason to have the change come into effect as soon as possible was the massive increase in the sale of used vehicles. “Most industry experts believe the increase is because commuters are preferring to drive to and from work rather than risk infection while taking public transport,” Stuart said. “We are really pleased to be hearing that this law will happen before the end of this year. “We expect that with no international travel, Australians will be getting into their cars and exploring the country over the Christmas holidays. “Our members have suffered significant decreases in their turnover for the past six months and getting the scheme in place before Christmas will be vital for them to get back to a sustainable commercial position and more importantly, to support Australian families to travel safely in reliable, well serviced vehicles.” For more information, visit www.aaaa.com.au

UPDATES TO SPECIALISED CLASSES OF MVR WORK New Certificate II specialised classes of motor vehicle repair work introduced in NSW There have recently been changes to the scope of work and qualifications required in some repair classes in New South Wales, including the removal of wheel balancing from the steering, suspension, and wheel alignment repair class. The changes commenced on 1 September 2020 following the publication of the Motor Dealers and Repairers Amendment (Tradesperson’s Certificate) Regulation on 19 June 2020. The Amendment Regulation introduces specialised classes of motor vehicle repair work to allow employees to work unsupervised for certain types of motor vehicle repair work only; and permits employees with a relevant Certificate II qualification to apply for a tradesperson’s certificate under the Act. Employees who apply for a tradesperson’s certificate with a Certificate II qualification will be permitted to perform repair work in one (or more) of the new specialised classes of repair work only. NSW Fair Trading said the changes – which are part of the Better Business Reforms package which aims to create opportunities for small businesses by reducing costs and complexity without reducing consumer protections – will reduce the cost and time required to qualify for a tradesperson’s certificate because employees will no longer have to obtain unnecessary qualifications for work they will not perform. The following classes of repair work have been introduced: electrical accessory fitting; exhaust repair; glazing; radiator repair and steering, suspension and wheel alignment (this does
not include work done on hybrid and electric vehicles, where a Certificate III qualification is still required.) The classes of electrical accessory fitting and glazing have however been withdrawn and will not come into force until November 2021. Tradespersons who do not currently hold a relevant tradesperson’s certificate but want to do glazing work or electrical accessory fitting work will therefore need to complete the prescribed qualification and obtain a tradesperson’s certificate by 1 November 2021. “It is great to see the New South Wales government introducing these initiatives as there is interest in our industry in more formalised and nationally accredited training, however unfortunately this has been done without industry consultation which has meant there are some issues with some Certificates not currently existing,” AAAA Director – Government Relations and Advocacy, Lesley Yates, said. “There is a lot of good in what has been introduced, but also some downsides. For instance, for those positions that previously required a Certificate III but now require only a Certificate II, this is a great opportunity for workers and employers. However, for positions where previously no Certificate was needed, there are now some new obstacles for hiring in this area. “With industry consultation we feel we could be doing some of these things in an even greater capacity like we have with other states such as Western Australia, and we look forward to working with the New South Wales government on future
developments to ensure they are as effective as possible.” Mike Carnemolla of 313 Automotive in Sydney welcomed the changes. “Under the previous award system, I couldn’t employ someone just to do tyres – they had to be a qualified mechanic or an apprentice mechanic. Unfortunately we have been seeing second and third year apprentices who could only change tyres as that was all they had done – they were missing out on the varied learning opportunities they should have been experiencing in those years. Or on the other hand, you had highly qualified mechanics whose skills were being greatly underutilised,” Mike said. “Now, you can employ someone under that award to do a specific task which I think is really good and is elevating qualified mechanics to the pedestal they should be on.” More information about Certificate II and III licensing requirements, including the scope of work for the new classes of repair work, is on the NSW Fair Trading website. TERRAIN TAMER OPENS CAPE TOWN BRANCH The South African warehouse is the seventh international warehouse for the company Australian 4WD parts brand Terrain Tamer has recently opened an exciting large-scale branch in the Cape Town suburb of Bellville to service the wider African community. Still owned and operated by Frank Hutchinson, who started the company in Melbourne in 1969, Terrain Tamer’s origin was found in supplying 4WD parts to tour operators who took tourists through rough, uncharted terrain in the Australian outback, to destinations such as Uluru. The company now boasts a product range of over 40,000 unique part numbers, essentially formed by parts that will keep a 4WD running, right through the gearbox, transfer case, CV joints, filters, suspension, bearing kits, brake, clutch and thousands of other parts. SERVICING SMALL FLEETS ACA Research, our partner in the AAAA Aftermarket Dashboard, says average fleet lives are being extended, marking an opportunity for the aftermarket In 2019, Australian fleet buyers bought almost 440,000 new vehicles. 2020 is obviously a different story though, with YTD sales to business down to just over 260,000 new vehicles. While the final number will vary depending on how the final quarter of this year plays out, this leaves fleet sales down about 100,000 units year on year. Given this decline, fleets will obviously be extending the life of their existing assets, which suggests an opportunity for the aftermarket. This is however only one part of the story, as we need to understand their existing fleet to know how much of an opportunity there truly is. According to the upcoming ACA Research Fleet Insights research, there are now 460,000 Australian businesses that own and operate company vehicles. Between them, they have almost four million vehicles on Australian roads. When it comes to managing these fleets, we spend a lot of time talking about the larger ones (typically 20+ vehicles), but the reality is that it is hard for an independent workshop to meet all of their needs. Let’s have a look then at the smaller end of the market. There are about 400,000 businesses with less than 10 vehicles, but they still have almost 1 million passenger, light and heavy commercial vehicles, so how are they servicing them? Looking at the data in Chart One, we can see that the servicing splits out three ways:

This is a good result for the aftermarket and demonstrates that many independent and chain workshops are already effectively tapping into the fleet market. As we have seen before, this includes a mix of independent and chain workshops, as well as mobile mechanics. Given fleets cannot afford to have their vehicles off the road for extended periods of time, that feels like one area to keep an eye on over the next few years. Similarly, there might be interest in servicing outside of typical business hours, or pick-up and drop-off services, to avoid employees losing time during the day. Looking at the other major fleet servicing expenses, we can see an even stronger skew to the aftermarket when it comes to replacing or repairing tyres, with more than three quarters of our fleets preferring aftermarket workshops. The key point this demonstrates is that around half of the fleets taking their vehicles back to the dealership for servicing are still interacting with the aftermarket when it comes to tyres – does this provide an opportunity to expand the relationship into other areas of vehicle maintenance?

Based on the data in chart two, we know that aftermarket providers are getting a solid share of fleet business. To do that consistently, they are obviously providing a good service, and we can see that reflected in the satisfaction scores. As shown in chart three, aftermarket workshops
Ultimately, while the aftermarket already has a strong position in the fleet market, COVID-19 has disrupted many of the plans fleets had going into this year. As we move towards 2021 though, there is a significant opportunity to grow fleet business, with independent and chain workshops well placed to cater to these customers. As we’ve said before, it then becomes a case of understanding your local community, so you can tailor your specific services to their needs. AUTOMECHANIKA SHANGHAI 2020 INTRODUCES NEW DIGITAL PLATFORM Automechanika Shanghai will be one of the few large-scale automotive trade shows held in 2020 Automechanika Shanghai is tackling global sourcing needs for the automotive industry by launching AMS Live, a new integrated platform that looks beyond the geographical boundaries of onsite and online participation. The value-added service will be available from the 30th of November to the 6th of December 2020 and will run alongside the physical show itself. DBA RECOGNISED FOR DRIVING AUTOMOTIVE INNOVATION The company has received a grant to develop a word-first brake disc rotor Disc Brakes Australia has been awarded an Automotive Innovation Lab Access Grant in excess of $100k by the Australian Federal Government for a new research project in the field of disc rotor thermodynamics and pillar design. The project will reportedly deliver a brake disc rotor that is a world first in its specific design, which DBA says will allow it to generate a first mover advantage and maintain its position as a global leader in brake rotors. Faculty resources and facilities of the School of Mechanical and Manufacturing Engineering at the University of New South Wales (UNSW) are being utilised to conduct computational fluid dynamics studies coupled with materials investigations, to complete the initial design prove-out process. Real-time dynamic simulation will then be undertaken before prototype testing commences at Melbourne’s state-of-the-art Automotive Innovation Centre (AIC), which was launched by the AAAA in 2019. Through its long-standing affiliation with the AAAA, DBA will be utilising the full range of the AIC’s services and equipment, including robotics, 3D scanning, and advanced workshop equipment. Final product testing will then be conducted at the 1000-hectare Australian Automotive Research Centre (AARC) proving ground near Anglesea, Victoria; consisting of road tests, potential product modification and ADR compliance testing.

COVID-19 FAST TRACKING DESTIGMATISATION OF MENTAL HEALTH IN AUTOMOTIVE Increasing usage of mental health services indicates people are increasingly likely to seek help While many understand the impact the workplace can have on people’s mental health, and conversely, how mental health illnesses can impact productivity and relationships at work, many business managers and team leaders don’t have the tools, strategies and confidence to best manage mental health issues and create a mentally healthy workplace.

As part of the AAAA’s commitment to mental health support for the automotive aftermarket industry, the peak body for automotive businesses recently arranged a special presentation from Beyond Blue, with contribution from GPC Asia Pacific and Bapcor representatives.
From Beyond Blue, Michael shared that the organisation had seen a significant increase this year in the number of helpline calls and visits to website resources – including its Coronavirus Mental Wellbeing Support Service. Beyond Blue has responded to a 30 to 40 percent increase in demand – which peaked at 60 percent in May – for their counselling service and other mental health support organisations have also seen similar trends.
The webinar not only provided insights and advice but also unveiled signs the pandemic is helping to break down barriers around mental illnesses in the automotive industry and across society. Facilitated by AAAA Chief Executive Officer, Stuart Charity, this member-exclusive webinar featured three stand-out speakers on mental health in the workplace: Beyond Blue Workplace Engagement Manager, Michael O’Hanlon; GPC Asia Pacific People and Culture Executive General Manager, Aileen Hayes; and Bapcor Executive General Manager for Human Resources, Alison Laing. “Changes in how society, workplaces and individuals view and deal with mental health issues is going to be a continual process over many years, but we are encouraged by the changes we are seeing,” Stuart said. “This webinar was full of fantastic, thought

Although these increases certainly underscore the challenging times we are facing, they also indicate that people are increasingly likely to seek help, which is a big change from previous years and catastrophic events. It appears that COVID-19 is serving to fast-track a significant increase in awareness, understanding and normalisation of mental health illness. Michael also emphasised that for small business owners and managers, getting to know employees is more important than ever. Even small inroads in this domain can make a profound difference for employees and break down barriers that can more easily enable conversations around mental health. Alison and Aileen agreed with this recommendation, stating that a key to successfully supporting team members with mental health is to ‘get to know your people’. The closer working relationships seen in smaller business settings allow managers to identify changes in behaviour and demeanour and perhaps more easily enable them to ask, ‘are you ok?’ This can lead to a supportive conversation that can help resolve issues or the employee can be guided toward professional help services. Both HR experts shared that you don’t need to be a mental health expert or psychologist to provide support that is helpful and relevant. Providing contact details for Beyond Blue or other organisations such as LifeLine and The Black Dog Institute allows you to refer your staff member to an expert quickly and easily. Aileen advocated that all businesses should visit Beyond Blue’s website.
“Businesses of any size can benefit from the fantastic free resources provided by Beyond Blue,” Aileen said. Such resources help business owners and managers to carefully step through conversations that they may be nervous about with some confidence and peace of mind. Alison and Aileen shared that they have seen increased anxiety across their organisations because of uncertainty about the future, corresponding with an increased usage of their respective employee assistance program hotlines. While everyone is impacted by the pandemic, everyone’s experience of it is different. “Across society, and depending on businesses, roles and locations, people seem to be overwhelmed. Some are working harder than ever before while others have no work,” Alison said. “We will continue to promote mental health across the industry through our communication channels, member services such as webinars and our Employer Assist hotline. The importance of this issue can’t be underestimated,” Stuart said. A CHANGING AUSTRALIAN CAR PARC Continuing from last monthâ&#x20AC;&#x2122;s article about the changing automotive landscape, in this article we take a deeper dive into the composition of the Australian car parc and its effects on the aftermarket with the help of ACA Research and a number of our members Looking at the top makes and models across the past 15 years (based on the vehicles registered as at the start of 2020), there are some key trends that can be called out and will impact the aftermarket. Before we do that though, we need to recognise the position of strength that Toyota has achieved in the Australian market. Looking back at vehicles first registered in 2004, Holden is clearly number one, some 30,000 cars ahead of Toyota and Ford. Fast forward 15 years though, and Toyota has more than twice as many registrations in 2019 as Holden and Ford combined.
single year, from an aftermarket perspective it is more important to know how these numbers stack up over time. Splitting our data out into five-year blocks lets us see how this evolves, telling us which makes are most likely to currently be turning up in aftermarket workshops, and which we can expect to see in the future. When planning for the future, the key focus for the aftermarket (other than Toyota) should be brands that are heavily skewed to newer vehicles. These are the ones that will either come out of warranty, or change hands in the next few years,
that we should also call out Kia (46 percent of registrations in the last five years) and Isuzu with 52 percent of registrations in this period as brands that should be supported by aftermarket manufacturers, wholesalers, retailers, and workshop operators.
ACA Research reminds us that we need to remember though that this is not just about Holden and Ford. While they were starting to decline, other brands such as Mazda, Hyundai and Kia have all moved more strongly into market, building up their presence. Toyota has however managed to maintain its position against all comers, outperforming its closest competitor by a relatively consistent margin over the past decade. While it is interesting to look at performance in a

making them more likely to move out of dealer workshops. Given they are likely to have travelled 40 â&#x20AC;&#x201C; 75,000km in that time, they will also be getting to more significant servicing milestones, which has implications when it comes to the parts required. Brands that particularly stand out on this measure are Mazda, Hyundai and Mitsubishi (ranked second to fourth in registrations in the past five years), as well as Volkswagen and Subaru at the bottom end of the top 10. Looking beyond this list, ACA Research notes

Applying a similar logic to vehicle models, it is again no surprise that growth is coming from SUVs, utes, or small cars. While the Hilux is our leader regardless, the third placed Commodore and sixth placed Falcon are clearly on the way down. Similarly, even though the Mazda 3 has over 100,000 registrations â&#x20AC;&#x201C; it was down to 14,967 in 2019, dropping it out of the top 10. Given the CX-3 is performing well, and Mazda now also has the CX-30 in market, it this trend that is likely to continue to trend down going forward. Looking at the models on the way up, the Ford Ranger and Mazda CX5 both stand out, heavily weighted to the last five years. If we only consider the last five years, the Nissan X-Trail and VW Golf would both also jump into the top 10, with more than 90,000 registrations during that period. The industry needs to consider these shifts, understanding the consumers who own these vehicles, and their needs (now and into the future).

Ultimately, this all brings us back to the same point. The Australian car parc is changing, with some traditional makes and models in decline. This needs to be factored into business planning, so the aftermarket can cater to tomorrow’s customer, and not just those that we are seeing today. Also, while we do often talk in terms of servicing and maintenance, this is clearly much broader, with growth in sectors like recreational 4WD parts and accessories. Speaking with AAAA members, it is clear that already the effects of this changing landscape is being felt and adaptions are already being made. For South Australia’s Blackwood Dyno Tune and Service, the ‘typical vehicle’ they service has most certainly been changing over time. “We have seen a significant increase of European and Korean vehicles at Blackwood Dyno Tune and Service, along with what has been an expected decrease in Australian brands,” Blackwood Dyno Tune and Service Manager, Michelle Monserrat, said. “To keep ahead of these changes, our technicians are continuously updating their skills, particularly in relation to diesel engines. Training that relates to the latest diagnostic equipment and techniques has also been essential for our team, due to the variety of vehicles we see on a day to day basis. “The range of oil and coolants we keep on hand has also grown dramatically over the past 15 years in response to car parc changes, and we have
also been sourcing parts from a larger selection of suppliers, which sometimes includes genuine. Parts availability can be very limited in some cases, so forward planning is key to meeting the expectations of our customers. “No matter what the future holds, we believe the future success of our business will be reliant on good quality specialised training programs, the right tools and access to OE manufacturer data.” For Australian Clutch Services, a shift in not only applications but also technology is being experienced, with greater moves expected to come. “There has been a slight change in our most popular kit sales with a shift from Australian built to European and Korean vehicles, however our range has also developed significantly over this time and clutch components generally wear over long periods so the full effects are yet to be seen,” ACS Managing Director, Brenton Jordan, said. “Whilst clutch technology has continued to evolve alongside the changes to the car parc, we have seen a shift towards more advanced actuation and clutch technology as well as the shift in the associated applications. “The changing market has also brought significant opportunities for us, particularly in our performance division where we have launched world first performance upgrades for applications such as the Hyundai i30N. We have also been working hard to offer the largest range of Dual Clutch Transmission clutch components and tools and can already see a significant shift in that direction. “While our product development process can be influenced by a number of factors, I can say that with more European, Korean and Chinese vehicles in the market, one of the biggest changes we have experienced is the timeframe between the vehicle being available in other markets and its availability in Australia. “Sometimes we are able to develop the product before the vehicle is available in the Australian market and other times, we are forced to wait for a test vehicle to arrive here. We have also found that there are opportunities to develop products before any other manufacturer simply by being proactive and looking for areas of the market that are not being effectively covered such as heavy duty upgrades for Chinese and Korean built vehicles. “Every aspect of our business, from engineering and quality control through to logistics, marketing and sales have seen changes.” Bendix is another AAAA member which has succeeded through various car parc evolutions. “The first Bendix brake pads back in the 60s were very simple – they were an OE design on the early Holden, just a rectangular shaped pad with guide pins. We still sell them today, but the materials then were very simple compared to what you see now,” Bendix Manager of Product Engineering, Andrew French, said.
“Over the decades we have adapted and expanded to the evolving market and today we offer a lot of different products, as we develop product segments based on the market’s needs. As such, the growing diversity of the car parc has been one of our challenges over the years. “The 4WD market for instance is quite frankly it is going nuts and with people using them for so many different things, it is not about having just one 4WD box and it has one formulation, it is about having up to seven formulations depending on the vehicle type. “Looking ahead to the next 20 years we expect there may be more electric vehicles and hybrids, there will be increased focus on the environment, and a continuing focus on the user experience. We also expect further evolution in product weight loss and changing materials as vehicles are getting heavier – if you take the old Holdens of the 60s they were about a tonne, and today the SUVs are around three tonne.” For Pedders Suspension and Brakes, a long history of investing in R and D has allowed it to pivot quickly. “We have seen a shift over the last five to ten years away from sports and performance to SUV, 4WD and light commercials and Pedders was quick to identify and adapt to these changes. As such we have been able to tailor superior products for this changing automotive aftermarket,” Pedders Suspension and Brakes Managing Director, Scott Pedder, said. “In particular, solutions that meet the needs of carrying extra weight on a vehicle as a result of more cargo, accessories or towing requirements have been a key growth area for Pedders. “With more than 40 new products released by Pedders every year on average, it is no surprise that our R&D team has grown considerably over the last few years and we are constantly updating our strict processes (including adherence to ISO guidelines) to ensure the quality and relevance of our products in a changing market. “Pedders will continue to capitalise on our strong R&D capabilities, which allows us to continuously release new products to the market. Iconic Australian battery manufacturer Century Batteries continues to power ahead in 2020 with the roll out of a new look product range and extended warranty offer as part of the company’s commitment to manufacturing in Australia In September Century Batteries unveiled its new state-of-the-art plate making machine, which will increase battery production by 20 percent to more than 1.3 million batteries a year: production rates never before seen at the factory. Proving it had more up its sleeve, recently the company also unveiled a range of enhancements to its product portfolio, including a series of new product introductions, new branding and extended warranties across the majority of the Century product range. Low Pressure EGR (LPEGR) explained: Opus IVS explains that the LP EGR system is used on EU5 and EU6 market vehicles only. The LP system takes exhaust gases from the exit of the Diesel Particulate Filter (DPF) system and mixes it with the fresh air intake into the turbocharger. The gases are transported from the DPF outlet to the LP EGR cooler via a pipe. The LP cooler has no bypass mode, and so only cools. There is a simple mesh filter fitted before the gasses reach the outlet of the cooler that prevents larger particles of soot etc from entering the turbo charger system. The mesh filter is a nonserviceable component. The cooled gases are then directed through the LP EGR valve, via a butterfly flap. The valve consists of a tube between the fresh air duct and the turbocharger, with the butterfly valve covering the EGR inlet, in the center bottom of the EGR valve. The butterfly valve opens into the fresh air stream, promoting both thorough mixing before the gas enters the turbocharger, and also provides ‘suction’ to drive the LP EGR gas through the system. Possible Causes: • Excessive undetected soot in the DPF • Charged air induction system leak • Low pressure EGR cooler blocked/filter blocked 24

• Low pressure EGR valve mechanical integrity • Low pressure EGR differential pressure sensor mechanical integrity • Connector is disconnected, connector pin is backed out, connector pin corrosion • Vehicle is fitted with Two EGR valves, a LP and HP unit. One is DPF side to turbo the other is exhaust manifold to intake manifold. Repair: 1. Using a HP smoke detector, visually inspect the air intake system for leaks. Repair any that are found. 2. If there are no signs of soot particles, this is not the cause of the customer’s concern. 3. Remove low pressure EGR cooler housing lid and visually inspect for soot particles. 4. Is the cooler blocked? Opus IVS has seen filters internally block as per the image shown to the top right. This would require a new filter set (LR126126) and cleaning of the EGR/Throttle body and the Low pressure EGR cooler. 5. Look at low pressure EGR pipe on the nearside – is it blocked? 6. Look for signs of sooting around the clamp. 7. Is there black soot around the tail pipe? 8. Loosen the SCR assembly, look up into the cooler and check for excessive levels of soot. 9. Check to see if the DPF/SCR canister is cracked internally. 10. Using the JLR process, change the LP EGR and cooler. 11. Change cooler pressure sensor and SCR/DPF unit. The pressure sensor is bolted to the intake side of the engine, it looks like a DPF pressure sensor, one goes to the cooler pack and the longer pipe goes to cooling unit this measures the pressure either side of the unit. 12. If the cooler also shows signs of being excessively blocked, then the cooler may need replacing as well. 13. The DPF may also need inspecting for cracks that can draw in air from the outside causing excessive sooting. 14. After the repair, reconfigure existing PCM with latest software using a dealer tool.
Replacement Kit Where possible, visually inspect downstream of the DPF and LPEGR exhaust pipe for soot using a bore scope or visually check with the exhaust separated and look for soot content in the exhaust system. If soot is not visible downstream of the DPF and the LPEGR exhaust pipe, then do not replace the DPF.

If soot is visible downstream of the DPF and the LPEGR exhaust pipe, replace the DPF. Also be sure to visually check for any potential signs of cracking or leaks. BILSTEIN’S ULTIMATE TEST BED Suspension company’s ingenuity drives 24-hour race comeback It has been said time and time again that motorsport is the ultimate test bed for automotive development, and you will be hard pressed to find a racing test much more gruelling than the 24hour race at the Nürburgring. It is agreed widely in the industry that the Nürburgring is probably not comparable with any other race in the world, with many stating that no race track is more challenging than the “Green Hell.” Nowhere else do as many vehicles start as here. Nowhere else can you find such extreme weather events as here in the Vulkaneifel region. And no other race in the world writes as many stories as the legendary Eifel race. They are stories of boundless passion and absolute dedication. One such story unfolded recently for the Bilsteindriven Haupt Racing Team (HRT). On the Thursday evening of the event, two and a half hours into night qualifying for the 2020 24-hour race, the Number 2 Bilstein-wrapped Mercedes-AMG GT3 of the newly formed HRT suffered heavy damage not long after Nico Bastain set one of the fastest laps of the session before handing over to co-driver, Yelmer Buurman. Thankfully Yelmer was unhurt; however the same could not be said for the GT3 which had crashed into a guard rail after control was lost on a wet track on one of the fastest sections of the Nordschleife. At first it seemed the journey had come to a premature end for the HRT outfit, however instead Bilstein and its team ensured this was

not to be the case despite the entire paddock agreeing it seemed the race had already claimed its first prominent victim. A new Bilstein livery order was rushed overnight to HRT while a whole new race began in the Bilstein motorsport truck on-track. While they awaited the chance to examine the damaged GT3, Bilstein Head of Motorsports Road Racing Engineering, Daniel Pitsch, and his team were left considering which nuances still had to be adjusted so that Bilstein’s technology would again be two seconds faster on the Nordschleife than the competition and questioning what has possibly broken down and needing to be repaired. Amazingly, despite the crash occurring at more than 200km/h, only one Bilstein Evo RT had “conked out” and for Daniel, this was not too much of a surprise. “Our new Bilstein Evo R shock absorbers have very high strength, making them very stable,” Daniel said. “And this despite the fact that we placed great emphasis on weight optimisation during development.” When it comes to performance, Daniel says the brand-new Evo RT shock absorbers are beyond reproach anyway. “Hydraulically and technically, we are also using the proven Bilstein principle for our new fiveway system: large areas and low pressures for maximum performance,” Daniel said. And so, the technicians got to work in the Bilstein
motorsport truck, quickly building new shock absorbers for the Bilstein GT3. On the other side of the street in Meuspath, the phones were also running hot and the tools were being used at the speed of light, because a new chassis from Affalterbach was organised and brought to the workshop by “night jump.” In record time, the still usable components of the damaged vehicle were installed and the replacement livery affixed on the vehicle with many helping hands during the following day.

It was a night in which technology partner Bilstein and racing team HRT become one unit, ready to re-join the running by Friday afternoon after 14 hours of tireless teamwork in a move many thought impossible. Nico Bastian took the wheel for the return to the track, completing the first functional test and completing important set-up during the first top qualifying session. A qualifying position of 20th was recorded, although the Number 2 still laid claim to the fifth
fastest time for the event overall. After the HRT mechanics had fought so sacrificially for their comeback, it was up to the drivers Nico, Yulmer, Hubert Haupt and Phillip Ellis on Saturday to do the same and make up ground. And they did so in an impressive way.
from Saturday to Sunday, the Mercedes-AMG in Bilstein colours resumed the race in the morning in eleventh place. By the end of the race, the team had fought its way into the top 10 and finished the 24-hour race at the NĂźrburgring 2020 in ninth place.
In the first third of the race, they conquered place after place before an interruption of the race due to bad weather stopped their progress.
Not surprisingly, Bilstein reflects on this race as a comeback that will probably be talked about â&#x20AC;&#x153;on the ringâ&#x20AC;? for many years to come.

MAF Sensors The mass air flow sensor measures the amount of air volume flowing into a car’s engine and sends the electronic control unit (ECU) a voltage that represents the airflow. “Our improved air flow meter features a new sensing element bypass structure, which significantly reduces contamination of the sensing element for more accurate detection,” Con said. “Our plug-in type sensors allow for easy installation, while being smaller, lighter and easier to mount; and its platinum wire sensing element responds quickly to changes in air flow.”

CTEK MXTS 40 CTEK says it leads the way on battery maintenance With almost 50 percent of all vehicles arriving in the workshop with a battery that needs attention, it is important to ensure the battery is properly supported by dedicated battery support equipment. “Battery Support is vital for the supply of ‘clean’ constant voltage for vehicle diagnostics and programming,” CTEK Asia Pacific Director of Sales and Marketing, Robert Briggs, said. “By opting to use a stand-alone battery charger, or not providing any sort of battery support at all, workshops are risking programming failures and damage to vehicle ECUs that can affect workshop efficiency, profitability and reputation.” CTEK explains choosing the right equipment is important for the modern workshop for the following reasons: • Voltage specific: diagnostic work, flashing and reprogramming requires a fixed voltage and ripple free current throughout. For many vehicles, a specified voltage is required across the vehicle system before it will even start communication with diagnostic and/or reprogramming equipment. 38

• Reaction: during diagnostic and flashing and reprogramming work there may be certain ‘spikes’ in power demands. In order to maintain constant voltage across vehicle systems, any battery support needs to react immediately to avoid voltage drop that can result in diagnostic or programming failure or damage to vehicle ECUs. CTEK says a standard battery charger/maintainer will not react quickly enough. • Using a battery charger: however smart a standard battery charger/maintainer is, it will be working on pre-programmed charging algorithms that will see voltage rise and fall to achieve optimum charge levels – good for charging but not so good when constant voltage is required. This means there may be certain times when battery voltage is above (and of course below) operating levels for diagnostic work, flashing and reprogramming. • De-rating: battery support units deliver high levels of power over a relatively long period of time, and therefore they can generate a lot of heat which can make a unit de-rate. De-rating is where the unit will reduce output levels and charge levels, and at really high temperatures
reduce current output – this can affect the unit’s ability to maintain battery voltage. PROJECTOR HEADLIGHTS NEED DIFFERENT BULBS JW Speaker offers the EVO4000 projector optimised bulb Projector headlights have been with us since the 1980s where they were used in luxury vehicles to deliver an improved performance over traditional reflector style headlights. The combination of the elliptical reflector and the projector lens, which acts as a magnifying glass concentrating the light, creates a more intense pattern in front of the vehicle. This concentration of light has the effect of making the headlight look brighter. Projector headlights also have a more defined, glare reducing, cut-off compared with reflectors, making them safer for oncoming drivers. “Projector headlights were primarily developed for HID Xenon globes for a couple of reasons,” Invision Sales Managing Director, Wayne Blackman, said. “Firstly, the precise cut-off beam ensured no glare to oncoming drivers as Xenon is substantially brighter than Halogen. “Secondly, the regulations require that Xenon lights are self-adjusting and the compact nature of the projector lamps allowed for easy fitting of servo motors to control the aiming of the lamp either

dynamically or in some cases through a manual switch controlled by the driver. “The design and look of the projector headlights were appealing and they have been adopted by many car manufacturers but using halogen globes. “The negative is that projector headlights don’t perform well with Halogen globes as the light source.” The lighting engineers at JW Speaker understood this and saw LED as the opportunity to create a light source that would see the full potential of projector technology being achieved. The specifically designed projector LED bulb has a V-shaped configuration which is very different to the two-sided LED bulb used in reflector style headlights. The way the light is being reflected and then directed into the glass lens has a two-fold effect. FLEETGUARD FILTERS WITH NANONET Cummins says: there’s media, and then there’s media Today’s tougher governmental regulations mean fuel systems have to be more efficient. These stringent standards have led to the use of High Pressure Common Rail (HPCR) fuel injection systems which require ultra-clean fuel. HPCR systems are more susceptible to damage by contaminants because of smaller component clearances, meaning that clean fuel is more important than ever. STEERING: BRAKE JUDDER TIPS From TRW TRW has provided the following information about brake judder, defined as rotational vibrations of the steering wheel that can occur during braking, usually accompanied by a booming noise. Depending on the cause, it can be divided into thermal judder, which occurs during deceleration from high speeds, and cold judder, which can occur at any speed.
Hot/thermal judder ‘Thermal judder’ is a booming noise in a frequency range between 100 and 250 Hz. The intensity of the booming can vary during deceleration but does not affect braking. It is normally accompanied by vibrations in the steering wheel and a pulsation in the brake pedal. The effects of hot judder can usually be identified by a circular arrangement of spots on the friction surfaces of the brake disc. This martensite formation is harder than the basic structure of the disc material and can be removed only by machining. When repairing a disc with martensitic spots, make sure to completely remove the hardened areas without reaching or falling short of the minimum thickness of the brake disc.
Cold judder ‘Cold judder’ occurs during normal braking and can be identified by pulsation in the brake pedal, torque fluctuations in the steering wheel and/or vibration of axle and chassis components. Cold judder can occur virtually every time the brake is applied, regardless of temperature, and has a much lower frequency range (about five to 50 HZ) than thermal judder. These noises can be louder or quieter depending on the speed. The main cause of cold judder is the thickness variation in the brake discs. Defective bearing parts and wheel imbalances can also increase the effect, as with thermal juddering.
Analysis In most cases, judder is caused by several factors, making it difficult to clearly identify the root cause. Below are some general steps to follow: • Determine whether the judder is coming from the front or rear axle. • Check brake components (brake pedal, brake booster, master cylinder, brake lines, brake hoses, wheel brakes). If replacing components, make sure to replace brake pads and brake discs, brake drums and brake shoes in complete axle sets. • Check the wheels for balance, axial runout, radial runout and the condition of the tyre tread. • Check the axle settings, wheel suspension, steering components and adjust/ repair as necessary. WORLD-FIRST HYDRAULIC ABS TESTING TECHNOLOGY Invented by local manufacturing innovator, Injectronics Injectronics says it has invented a world-first technology that fully function tests both the electronic and hydraulic components within the Anti-lock Braking System (ABS) modules. Injectronics’ in-house research and development team has reportedly exclusively designed and developed the Electronic and Hydraulic ABS Tester (eHAT) equipment that accurately diagnoses faults within the ABS modules and hydraulic brake boosters. Uniquely testing the electronic and hydraulic components, eHAT performs comprehensive full function analysis that includes pump motor current, valve actuation operation, accumulator function, pressure sensor and speed sensor input testing. It says this meant that hydraulic blocks were generally replaced with a new or second-hand unit without truly understanding what the problem was or whether it could be fixed. Now, the eHAT system checks hydraulic circuits by feeding brake fluid through the ABS hydraulics. COMPUTER-BASED BOSCH DAS 3000 CALIBRATION DEVICE Complete professional solution for efficient adjustment and calibration of front radars and cameras An increasing number of modern passenger cars, vans and LCVs are equipped with driver assistance systems which detect critical situations via camera systems and radar sensors, warning the driver and intervening in case of imminent danger. EGR ROLLTRAC New smart electric roll cover launched by EGR Group EGR Group has launched the EGR RollTrac – a smart electric roll cover for dual cab utes. EGR Group says the new EGR RollTrack is “described as the world’s best electric tonneau cover that fully integrates into a vehicle’s electrical system.” The cover features a lightly textured black powder coat, is both water resistant and scratch resistant, and boasts a host of design features to keep cargo safe and secure from the harsh conditions in Australia. EGR RollTrac has reportedly been tested in extreme conditions to OEM standards to deliver what EGR Group calls the best all-weather performance. The cover only works when the vehicle is unlocked, and a smart ECU-controlled operation is pre-programmed to the vehicle and includes onboard fail safes to prevent using valuable energy if the vehicle battery is running low. A manual override feature is included, and an automatic internal LED light provides visibility in the rear in poor lighting conditions.

REPEATED CSC HOLDEN CRUZE FAILURES Exedy Australia has received reports of repeated concentric slave cylinder failures in Holden Cruze models Exedy says these failures are occurring during bleeding of the hydraulic circuit following clutch replacement and initial investigations confirmed the replacement clutch and dual mass flywheel were like for like with the originals. A focus on the overall clutch operating system was undertaken and inspection of the failed slave cylinders found them to have over-stroked, causing fluid to leak from the front of the cylinder body. As the hydraulic circuit under normal condition operates with a 1:1 fluid transfer, the over-stroking of the cylinders indicate an obstruction within the hydraulic circuit. Exedy says further discussions with the workshop revealed the clutch master cylinder had already been replaced in an effort to eliminate this as a contributing factor. The circuit had also been flushed several times to rule out contamination, leaving only the hydraulic delivery line and associated fittings as areas for concern. After further detailed inspection, Exedy was able to verify that during removal of the original
concentric slave cylinder, a rubber seal/grommet situated on the end of the inlet fitting had dislodged and remained within the bleeder fitting (or elbow) of the hydraulic delivery line. The vehicle was successfully re-assembled and drove away following removal of this obstruction. Exedy explains while it is possible for fluid to pass into the cylinder during the bleeding process, forced fitment of the replacement concentric slave cylinder (including new grommet) had subsequently created a check valve like situation. In this condition where the fluid could not return back through delivery line, the end result is that the cylinder over fills and leaks because it has exceeded its limit of travel. PAO-BASED OILS Ariazone and The Refrigerant Company say they have been pioneering new practices in auto air conditioning for more than 20 years Ariazone says that twenty years ago, following 15 years of research and development, The Refrigerant Company pioneered the use of PAObased oils in refrigeration. Size of the condenser Does size matter? Davies, Craig says yes – stating that the larger the condenser, the better as you want to fill as much of the radiator core size as possible. Mechanical or electric fans? Which is more efficient in an air conditioning system? Davies, Craig says airflow supplied by a mechanical fan changes with engine RPM and can be insufficient at low-engine rpm while also absorbing horsepower. It says the key is air flow and that either of Davies, Craig Thermatic Electric Fans (14-inch high performance or 16-inch Electric Fan) mounted flush with the radiator core and set up as ‘pullers’, requiring a minimum of 2100 CFM ft3/min of airflow, will be sufficient. Further, it says if you can also install a ‘pusher’ fan as a secondary fan on the condenser core, this will increase the air-conditioning performance at low speeds or at idle (for instance, in traffic). With most cars and light trucks, Davies, Craig says the installation of one of its Thermatic Electric Fans is a great choice to free up horsepower and decrease fuel consumption.
Evaporator size What determines the size of an air conditioner evaporator? Davies, Craig says you should install the largest unit possible that will fit into the available
space, keeping in mind that when the system is on high and working to its maximum capacity-say, on a 40°c day, it is easier to turn the A/C down than to turn it up.
Suggested modifications Are there any suggested engine/cooling system modifications necessary when adding air conditioning? Davies, Craig says you should ensure you have a high-performance, high CFM ft3/min Davies, Craig Thermatic Electric Fan, and a high volume flowing mechanical water pump. Alternatively, it suggests you install a suitable Davies, Craig Electric Water Pump and, finally, at least a double row aluminium radiator. Should you select the Davies, Craig Electric Water Pump, Davies, Craig says you should opt for the Combo Pack which offers the LCD EWP/ Fan Controller. The digital ‘adjustable thermostat’ controls the coolant flow commensurate with engine temperature.
Internal or external? Most vehicles today have some form of factoryfitted transmission oil cooler. These may be adequate for normal driving, but Davies, Craig says they can prove to be inadequate under heavy load or towing conditions. As such, Davies, Craig recommends an external or auxiliary Davies, Craig Transmission Oil Cooler which transfers damaging heat.
Interior modifications Engine heat and outside heat must be kept out of the vehicle’s interior. Efficient air-conditioning systems assisted by tinted windows, proper weatherstrip and door/glass seals will also help isolate the interior and lessen the load on the A/C system.
Most common installation errors Davies, Craig says not preparing for air conditioning in the planning stages, lack of insulation, not allowing for appropriate space, overcharging or undercharging the A/C system, not seeking advice from a fully qualified specialist, and under-sizing the evaporator to the vehicle are just some of the most common installation errors that it sees. MILD TO HEAVY HEADLIGHT RESTORATION KITS From Invision Sales Whilst the headlights of many cars are heavily damaged and require a full restoration that includes fine grade sanding, many suffer from mild damage and are still functional but have a slight amount of yellowing. Invision says this yellowing looks pretty bad on a nice clean car and if not treated, will continue to deteriorate. To meet the needs of these two levels of damage, Invision has introduced a new product that is designed to restore mildly damaged headlights to as new condition. It says it is faster and cheaper than a full headlight restoration, so you can make great margin on the service. “Most of today’s vehicles feature headlights that wrap over with a horizontal surface at the top that will display damage after a few years,” Invision Sales Managing Director, Wayne Blackman, said. “The first sign of damage is a slight yellowing across the top of the lens which is easily fixed with this new product.” The program is now clearly divided into two categories, Mild and Heavy. EV ACCESSORIES Different from traditional aftermarket items The amazing technology being developed in the electric vehicle sector is sparking some very cool aftermarket accessories, particularly for lucky Tesla owners. As discussed in the Performance edition earlier this year, traditional accessories like chrome delete kits, wheel centre caps and ceramic paint is commonplace. Many EV drivers are also installing wireless phone charging pads, floor mats, roof racks and, as developed by EVolution, tow bars. What’s interesting though, are the EV early adopters designing accessories to enhance the performance and pleasure of silent, low-emission driving. EVUp says its specialist EV mechanic at its Melbourne workshop recently installed an American-designed and manufactured microdisplay that fits snugly within the Tesla Model 3 and Y dashboard air vent, without cluttering the minimalistic aesthetic of the interior.
This modular wifi unit can show a huge range of different signals from a Tesla, but is programmed for the client to show the battery power bargraph, battery kW, speed, motor torque and a torque bargraph. While versions of drag performance meters have been around forever, the Tesla microdisplay is a crowd-tested LED bargraph that’s been grassroots prototyped by an enterprising Tesla owner. EVUp says if it can be modified and applied to other EVs and the highly visual style could help drivers new to electric driving feel more confident about the most common concern: battery state of charge. From a workshop perspective, starting to think about how you’ll service the growing EV market is important. EVUp says its ownership data from FCAI figures shows a low 0.1 percent market share for electric and plug in hybrid electric vehicles in 2020, but a huge annual compound growth rate of over 70 percent.

TRICO TECH MULTIFIT BEAM BLADES Not all beam blades wipers are created equal Trico explains while some brands require 20-30+ SKUs to cater for today’s modern Australian car parc, Trico Tech allows workshops to dramatically reduce inventory with upwards of 70 percent less SKUs to cover more than 96 percent of demand with just 11 part numbers. AUSSIE INNOVATORS LEADING THE EV CHARGE Many in the automotive industry will be familiar with OE and aftermarket product manufacturer Lumen Up until very recently this family-owned Australian business’ latest venture, Lumen Freedom, has been a closely guarded secret. “Lumen, the traditional side of the business, has been manufacturing genuine accessories, wiring harnesses, and a range of electronic components for more than 30 years,” Lumen Freedom General Manager, Rod Wilson, said. “Lumen is always looking to stay ahead of the curve.” In 2016 a separate company, Lumen Freedom, was established specifically to drive innovation in Wireless Electric Vehicle Charging (WEVC). In the same year, Lumen Freedom secured a license from Qualcomm for the development of WEVC. Since that time, Witricity from Boston in the USA bought the patents from Qualcomm and added these to its already extensive portfolio of patents, ensuring Witricity as the preeminent Patent holder in this area. Lumen Freedom now holds a license with Witricity for the development of WEVC. Over the ensuring years, Lumen Freedom has been approached by many car companies as news of its innovative wireless charging technology started to gain traction in boardrooms across the globe. “Due to the sensitive nature surrounding the IP of our wireless charging system, we have basically been working in total secrecy since 2016,” Rod said. “Car companies want to keep their plans under
wraps, and it’s only in the last six to eight weeks that we’ve been able to come out from the shadows and share our successes in this space.” In what is truly a win for Aussie ingenuity and hard work, Lumen Freedom has been awarded the first and only original equipment contract for fitment of a wireless charging system in the world. “We have 40 world-class engineers onsite in our Hallam facility, all of whom are dedicated to developing our wireless charging technology,” Rod said. “We see this as disruptive technology 101 and are committed to driving innovation in the Electric Vehicle Recharging market.” Lumen Freedom is the only company in the world to receive full UL and IEC certification for its wireless charging system. “We’re punching well above our weight and
are determined to keep ahead of the pack of development in this highly technical space,” Rod commented. “In the future, you’ll see vehicle to grid and vehicle to home. As access to wireless charging becomes more widespread, you’ll be able to go home with a full battery and switch to running your LEDs, your TV, and other things in your house, or feed it back into the grid from your vehicle battery. “This technology is evolving now and is under test.” In addition to being heavily embedded with several car companies, Lumen Freedom is also working closely with energy providers and infrastructure companies to speed up the transition from internal combustion to electric-powered vehicles. “The majority of our work is focused on overseas markets at the moment,” Rod explained. “We are involved with customers in the UK, USA, Europe and China; with more recent enquiries coming from Brazil, Israel and India.” Lumen has 12 facilities globally and says it is well placed to support the uptake of WEVC. Currently, petrol and diesel excise generate approximately 16 billion dollars a year in federal taxes, but the transition to EV transportation is on the move, with wireless charging technology driving it forward at an ever-increasing rate. “The transition to EV transport inevitable,” Rod said. “The world is making electric cars, there are billions of dollars being invested, and they’re coming, like it or not.” When compared to traditional internal combustionpowered vehicles, the reduction in operating costs is significant. On average, electric vehicles cost three to four dollars per 100 kilometers to run, while running

Billed as the “fastest McLaren road car ever,” the hand-built Speedtail Hyper-GT has Lumen Freedom’s wireless charging receiver unit built into the nose of its 5.2m-long, 1430kg carbon-fibre body. This on-board unit corresponds with a ground pad, measuring roughly 66cm wide and 78cm long and weighing 26kg, which comes standard with the purchase of the Hyper-GT. “The ground assembly element is a derivative of our 11kW system, which can be de-rated to suit the consumers’ needs and the specific requirements of the vehicle,” Rod said. “Charging times for this vehicle to reach full charge are very short, with power transfer efficiencies at the same levels as plug-in cabled chargers.” costs for internal combustion vehicles often exceed 12 dollars per 100 kilometers. Lumen Freedom says the environmental benefits are unquestionable. “If you look at the service costs of an internal combustion engine vehicle compared to electric vehicles, electric vehicles are one percent of the cost,” Rod added. Currently, there are three wireless charging technologies: static, semi-dynamic, and dynamic. Dynamic charging allows electric vehicles to be charged wirelessly at highway speeds of 100+ kilometers an hour and has been proven successful in an experimental program run over several years called “Fabric” in Versailles, France. “Dynamic wireless charging is a game-changer,” Rod said. “Imagine driving from Melbourne to Sydney and you get a notification on your car that you have 120 kilometers left in your battery. “Then you are notified by your onboard GPS or an appropriate road sign indicating that there is a 50-kilometer charge zone coming up in two kilometers, just like an overtaking lane. “When you hit the charging zone, you just move into the green zone and recharge without having to pause your trip.” Lumen Freedom is part of several consortiums overseas evaluating semi-dynamic charging technology with taxi fleets, with expected positive results. “If you consider how taxis rotate through airports, our semi-dynamic wireless charging system is fit for purpose,” Rod explained. “As the taxis move through the rank, they go over our semi-dynamic charging pads. You can’t have a plug-in charging system for electric taxis because
you can’t have someone jumping out every two seconds to plug in their car and move along the lane or the rank.” The UK has already flagged that the iconic London Taxis will go zero emissions in the future, so Lumen Freedom’s semi-dynamic charging system is a natural fit. Lumen Freedom says the world is embracing wireless charging technology, noting that plug-in charging stations are intrusive, and councils overseas are resistant to install plug-in stations in the future as they are considered ugly and add to urban visual pollution. “Plug-in charging stations get graffitied, damaged, and they are dirty and maintenance-hungry,” Rod said. “People cut the cable and sell the copper. If you try and utilise existing parallel parking spaces, you have got to pull the cable across the roof of the car to the other side if you have got an offset plug. “Cities are forced to invest in expensive dedicated plots of City real estate to accommodate plug-in stations; and handicapped drivers are unable to perform the plug-in requirements and are greatly disadvantaged. “Our wireless charging systems eliminate all these issues.” As the world transitions to Autonomous Mobility, Wireless Charging completes the circle of integration, eliminating the need for any human intervention. One of the most exciting projects in which the team at Lumen Freedom has delivered is the 2020 McLaren Speedtail Hyper-GT – a hybrid hyper sports car that is the first vehicle in the world to rely solely on wireless charging. “It utilises Formula 1 racing technology, with a powerful internal combustion engine paired with

The automotive industry has changed as technology has advanced and what used to require purely mechanical skills now demands skills in electronic programming, researching, and vehicle specific training. The TAFE can assist members of the automotive aftermarket who are looking to take on apprentices with relevant skills. It achieves this by connecting them with students who have completed Certificate II preapprenticeship training and who are seeking employment. The TAFE can also provide ongoing guidance and support. This is particularly relevant given the Federal Government’s announcements out of the recent Budget around subsidies for industry to employ apprentices and trainees (see page 6 of this magazine). WORKPLACE DIVERSITY PROJECT In this article, AAA Magazine discusses Tradeswomen Australia’s recently launched Mental Health Pilot project with its Managing Director, Fiona McDonald As announced in September’s AAA Magazine, Tradeswomen Australia is currently piloting a project which explores how increasing diversity within automotive workplaces can drive improvements in mental health and wellbeing while reducing mental injury. The industry-first Workplace Diversity Project aims to support automotive businesses to create environments that embrace diversity and inclusion through their recruitment, employee support, and workplace practices. “The aim of the project is to support automotive industry executive teams and management to improve the mental health and wellbeing of their frontline workers and to reduce preventable injury,” Tradeswomen Australia Managing Director, Fiona McDonald, said. “Each year, 7,200 Australians are compensated for work-related mental health conditions, equating to around six percent of workers’ compensation claims, and approximately $543 million is paid in workers’ compensation for workrelated mental health conditions. “During 2010-11 and 2014-15, one out of every 1,470 full-time employees claimed for a mental health condition every year. Forty one percent of claims were caused by harassment, bullying or exposure to violence; 91 percent were attributed to mental stress; and 60 percent of claims were awarded to workers aged 40 and over. “Work-related mental health conditions have become a major concern in Australian workplaces due to the negative impact on individual employees, and the costs associated with the long periods away from work that are typical of these claims. “In addition, COVID-19 has certainly been tough on the automotive industry. The long-term
impacts on workers and employer’s mental health and wellbeing is yet to be measured, but already we know the industry has experienced job loss, slowdowns in maintenance repairs and sales. “It is obviously a critical time to be thinking about how you can support yourself and your employees.” Fiona asserts that workplace diversity, and in particular gender diversity, is a key element that this program from Tradeswomen Australia will seek to address as part of its efforts to turn the mental health tide in the automotive industry. “The 2019 ‘One of the Boy’s?’ report by Dr Sarah Oxenbridge, Professor Rae Cooper and Professor Marian Baird – which highlighted the work and career experiences of Australian women in the automotive trades – found that women represented just 15 percent of motor vehicle parts interpreters, 1.1 percent of motor mechanics and 0.8 percent of panel beaters,” Fiona explains. “While conducting our new project, Tradeswomen Australia is consolidating the research and project outcomes from past attempts to increase the participation of women in automotive workplaces. “There are many examples of the benefits of gender diversity and increasing female participation in the automotive industry – just one example can be found by looking at Omnitracs, a fleet management solutions company that found female truck drivers get into fewer preventable accidents than men and generally drive more cautiously. They also state that they found women are less likely to quit driving, which is particularly critical as turnover rates among truck drivers reach 95 percent.” The Workplace Diversity Project will support 100 automotive managers and 500 workers, with the backing of Worksafe Victoria’s WorkWell Mental Health Improvement Fund. “Our project aims to create long term culture change by assessing the work-related factors that impact mental health,” Fiona explained. “Tradeswomen Australia will measure the relationship between diversity, mental health and wellbeing during the program; and employers and workers engaged in the program will be supported by us to build a robust support system and improve on existing policies and procedures. “As part of the program, 100 automotive managers will receive a mentor to assist in the implementation of the support system and 500 workers will gain access to free training and resources to support them at work.” Fiona says it is her expectation that the 100

participating workshops will record greater staff retention and a reduction in workplace accidents alongside the improved mental health and wellbeing of workers. Tradeswomen Australia is working closely with key major industry bodies including the AMA Group, WPC Group, VACC, MEGT, G Force and the AAAA, and will be increasing engagement with small to large businesses during the project. “We are proud to interact with all levels of the industry from young apprentices to small and large automotive businesses to major organisations such as the AAAA,” Fiona said. Those who sign up for the project will be contacted by a Tradeswomen Australia Industry Liaison Officer to welcome them to the program and answer any questions they may have. Workshops will be asked to nominate a manager and at least five workers to partake in the program. WHEN DOES THE REPAIRER’S LIEN APPLY? The repairer’s lien is a right under the common law that may assist a business to secure payment by customers However, this common law right does not apply in all circumstances. It is important to have an understanding of when the repairer’s lien applies to assist your business to retain vehicles lawfully. For example, it is highly unlikely the repairer’s lien will apply where a vehicle is only assessed to diagnose the issue and repair work is not conducted despite the skilled work involved in making the assessment. It is important to note that this article considers the common law repairer’s lien, it does not consider a lien agreed to under contract which may apply differently to the common law repairer’s lien.
What is a repairer’s lien? For a mechanic, the repairer’s lien enables a mechanic to retain a vehicle as security for payment for improvements made to the vehicle. Put simply the mechanic can refuse to provide the customer with the vehicle until the customer pays the invoice but only if all the required elements are satisfied.
What elements must be satisfied for the repairer’s lien to apply? Generally, the elements required to establish that a repairer’s lien applies are: • a repairer receives goods for repair/ improvement; and • the goods have been provided by the owner or a person with authority; and • the goods have been repaired/improved (or increased in value), by a person with the required skills; and • possession of the goods has remained with the repairer at all times.
The requirement for improvement In order for the repairer’s lien to apply, an improvement must be made to the vehicle. Caselaw distinguishes between ‘improvement’ and ‘maintenance,’ noting that a lien arises where a vehicle is improved or increased in value, but not where the good is merely maintained (even where labour and skill are expended in maintaining the good). Putting this in terms of work on a vehicle, although assessing a vehicle to identify the issue required to be repaired is skilled work there is a high risk that if the repairer retains the vehicle where repair work has not been conducted that the repairer unlawfully retains the vehicle as it is highly likely the repairer’s lien will not apply. Retaining the vehicle in the possession of the business If the business releases the vehicle so that the business no longer has possession of the vehicle, then the repairer’s lien is lost. The vehicle cannot be retrieved at a later time. For this reason, it is important that the business does not release the vehicle before payment is made.
What if the customer also has other outstanding debts? The repairer’s lien only extends to work carried out on the vehicle and cannot be used to obtain payment for the customer’s other outstanding debts, including outstanding debts relating to the same vehicle.
Storage fees cannot be charged The repairer’s lien does not give the repairer the
right to charge the customer storage fees. If the business would like to have this option, then this should be appropriately addressed through the terms and conditions of the business.
Disposal of the vehicle The repairer’s lien does not give the repairer the right to dispose of the vehicle. If the repairer is considering disposing of the vehicle the repairer should consult the uncollected goods legislative regime applicable to the state or territory in which the business is located.

QUEENSLAND CRIMINALISES WAGE THEFT On the 9th of September, the Queensland Parliament passed the Criminal Code and Other Legislation (Wage Theft) Amendment Act 2020 (Wage Theft Act), criminalising wage theft The Wage Theft Act amends the Queensland Criminal Code (Code) and other legislation. The Code was amended on the 14th of September 2020. Now employers who commit wage theft may face criminal prosecution and a penalty of imprisonment.
What is wage theft? Generally, a person will commit the crime of ‘stealing’ if they fail to pay an employee (or a person on behalf of the employee) an amount payable to the employee (or other person) in relation to the performance of work by the employee. This may include wage theft through, for example, underpayment of wages for hours worked, unauthorised deductions, unpaid superannuation, withholding entitlements and underpayment through intentionally misclassifying workers under an award or by a sham contract.
Who investigates the crime? Queensland Police has been given jurisdiction to investigate claims of wage theft. Workers can make a complaint to the Queensland Police who will consider the information provided in the complaint when deciding whether to investigate whether a crime of wage theft has been committed and initiate prosecution. However, the Queensland Police do not pursue and recover unpaid wages.
What is the maximum penalty? The Wage Theft Act amends the Code to add the following punishment for wage theft from 14 September 2020: Stealing by employers If the offender is or was an employer and the thing stolen is the property of a person who is or was the offender’s employee, the offender is liable to imprisonment for 10 years.
The Office of Industrial Relations has stated that the amendments to the Code are intended to “capture deliberate, intentional behaviour leading to under or non-payment of entitlements as a criminal offence” and not honest mistakes.
Further the Wage Theft Act amends the definition of fraud in the Code to include when the offender is or was an employer of the victim.
However, judicial consideration is required to understand the scope of wage theft claims.
The maximum penalty for employers who defraud their employees is 14 years of imprisonment.
An individual employer or a corporation may be charged with wage theft. While both individuals and corporations may face financial penalties, the penalty of imprisonment will apply to individuals. Where the employer is a corporation, it is important to note that other persons (e.g. a director or company officer) may be found liable if they aid, counsel or procure the employer to commit wage theft.
What about other states and territories? Victoria and the ACT have already criminalised wage theft and Western Australia has introduced a bill to address wage theft.
What do employers need to do? Employers must ensure that they are paying their employees in accordance with their legal obligations. The 34th edition of Summernats (Summernats 34) has been rescheduled to January 2022, but as always the Summernats team is moving forward positively and has announced an exciting program of events for 2021. “Summernats has made the difficult decision to re-schedule Summernats 34 to January 2022,” Summernats Managing Director, Andy Lopez, said. “ACT Health is using Exhibition Park as a COVID19 testing facility until the end of November and can’t confirm we’ll have our venue back, which is an unmanageable risk to our event. Combined with ACT Health’s recently released protocols that exclude outdoor multi-day festival events of more than 5,000 people, a pathway to a January Summernats is impossible. “We’ve fought really hard for our event for the last six months, but we just can’t find a way to get it over the line. NEW MOTORSPORT AUSTRALIA PRESIDENT ANNOUNCED Andrew Fraser will take over the role from 1 January 2021 The Motorsport Australia Board has unanimously elected Andrew Fraser as President from 1 January 2021, following the impending retirement of current President, Andrew Papadopoulos. Papadopoulos announced his retirement in late August, to take effect on 31 December 2020. In accordance with Motorsport Australia’s Constitution, the Board fills the casual vacancy before the next scheduled election is held in October 2021. Having sat on the Board of Motorsport Australia since 2001, Andrew Papadopoulos will leave an impressive legacy. Upon his retirement, he will become the longest serving Director and join the late John Large as the longest serving President in the organisation’s history. “I am certainly proud of what we have achieved as a Board in the past 20 years, and during my Presidency of this wonderful organisation, which means so much to me,” Andrew Papadopoulos said. A lifelong motorsport fan whose family has been in the motor vehicle industry for generations, Andrew Fraser has significant sports governance experience, including as a former Commissioner
of the Australian Sports Commission. Previously he has served in executive and governance roles in rugby league in Australia and New Zealand. A former Deputy Premier and Treasurer of Queensland, he is also currently the Chair of SunSuper and Orange Sky Australia. SAVE ON SERVICING With new Greasable Pins ARB has added an additional range of serviceable components to its Old Man Emu suspension packages for leaf spring vehicles. ARB explains that your suspension is one of the hardest working components of your 4WD – regardless of whether you are cruising down the freeway or traversing your favourite off road track, your suspension is always working. Due to their mechanical nature, suspension components require an additional level of servicing and maintenance to prolong their life and ensure the optimal level of performance. Pins and shackles are used in all vehicles which utilise leaf spring suspension; most commonly found on the rear axle of modern utes. Pins and shackles are the parts which affix the front and rear of the leaf springs to the chassis; swivelling and swinging, these components allow the springs to lengthen and contract. While some common moving parts like wheel hubs are kept operational with bearings, others (including many suspension components) are lubricated with greased polyurethane bushes (sleeves). To maximise the life of these parts, regular servicing is required by keeping the area clean and replenishing old grease. In the case of a standard leaf spring, this is generally undertaken by completely detaching the spring from the chassis at both ends; a job that requires no less than a car jack, wheel stands, tools and time.
A streamlined solution By using greasable pins and shackles, ARB says servicing Old Man Emu leaf spring suspension becomes that much quicker and easier. It explains that with the simple use of a grease gun, Old Man Emu greasable pins and shackles can be serviced on the vehicle without the removal of suspension parts or additional tools (other than a grease gun). So, whether you are looking at installing a new suspension package or are looking at a way to reduce the cost associated with ongoing servicing of your current leaf spring set up, ARB says it is worth considering upgrading to Old Man Emu greasable pins and shackles. ARB has offered greasable shackles for the most popular 4WDs for many years as well as a small number of greasable pins for select vehicles. In late 2019 ARB released greaseable pins to suit a range of popular 4x4 utes including current model Ranger, HiLux, D-Max and Colorado with
additional product due to be released soon to support other current and older vehicles. ARB recommends having your suspension bushes lubricated no less than every 5,000kms for normal on-road use and as regularly as every 2,500kms for offroad use. While leaf springs (with ARB’s maintenance-free liners) should be serviced every 10,000km or 12 months for general on-road use or every 5,000kms or six months for offroad use. ARB explains that servicing is more than just greasing and includes checking wear on all components including bushes, shock absorbers, springs, spring seats and more. It warns that it is an unfortunate reality that some vehicle manufacturers’ workshops will not service aftermarket suspension; so, while you might be getting your 4WD serviced as per the service book, it states it is worth checking with your service centre that your suspension is getting the attention it needs. SUZUKI JIMNY GJ 2018+ GVM UPGRADE Ironman 4x4 says it now offers the first and only federally approved GVM Upgrade to suit Suzuki Jimny GJ 2018+ Released to the market on the 18th of September, Ironman 4x4 explains its GVM kit provides Suzuki Jimny owners with more loading capacity for accessories and gear to cater for their towing and off-road needs. NEW UPPER CONTROL ARMS From Terrain Tamer Terrain Tamer has recently released a range of Upper Control Arms for vehicles with Independent Front Suspension. IFS systems traditionally allow only a very small adjustment range for successful wheel alignment, and Terrain Tamer says this has proven to be particularly true of lifted vehicles, causing issues with camber, caster, ball joint articulation and clearance of the coil assembly. The Terrain Tamer Upper Control Arm reportedly provides a solution for any lifted IFS vehicle up to 70mm, allowing greater clearance to the coil assembly and more articulation of the arm, thanks to its extended length. The design of the arm allows the shock absorber to restrict full droop, minimising any strain put on the ball joint when the vehicle is lifted. Terrain Tamer says they also provide an increase in caster level and negative camber, working to correct any issues by compensating for body roll and distortion and tyre roll when cornering, improving turn-in response and increased directional stability. AAAA PUTS SENATE SPOTLIGHT ON MANDATORY DATA SHARING In this article, ARCA’s Mike Smith takes a look at the recent Holden Senate Inquiry and how the AAAA used this opportunity to promote the importance of mandatory data sharing As you may have heard, the Senate recently launched an official Inquiry into Holden and its withdrawal from the Australia market. This Inquiry may have been largely prompted by questions about what happens to consumers and their ability to service their Holden vehicles following the vehicle manufacturer’s withdrawal, but it also provided the AAAA with an important opportunity to raise the issue of mandatory data sharing. Ironically, Holden is the only vehicle manufacturer that has been truly sharing service and repair information with independent repairers under the voluntary data sharing scheme. So of course while everyone at ARCA and the AAAA are sympathetic about what has happened to the authorised Holden dealers and how they have been treated in terms of their ongoing commercial viability, we know that Holden’s withdrawal will not ultimately stop Holden owners (I too drive a VF Commodore) from having their cars serviced or repaired, as independent repairers have access to the required data to undertake this work for them. What Holden’s withdrawal has highlighted is the risks to consumers that exist if other vehicle manufacturers, who are not participating in data sharing and will continue to refuse to do so until a mandatory data sharing law is in place, decide to withdraw from the market. These consumers will be left high and dry, with independent repairers severely hobbled from providing service and repairs to them without access to the requisite information. It was with this key message that AAAA’s Chief Executive Officer, Stuart Charity, and AAAA Director of Government Relations, Lesley Yates, attended the Senate Inquiry lead by Senator Pratt and Senator O’Neill, and I am pleased to report that they were very successful in putting mandatory data sharing law in the spotlight at this hearing. Not only was their message well received on the
day of their appearance, it was followed up with a formal Senate Motion which states that they want to see mandatory data sharing law in place before the end of this year – undoubtably another positive step forward in our fight for the right to data for independent workshops throughout Australia. The AAAA’s appearance also ensured the correct information about how OEMs are sharing their data was put forward, given it is in the interest of others to give the impression that vehicle manufacturers as a whole are sharing their data when we all know this not to be the case. It may be hard at times to keep the issue of mandatory data sharing out there, but workshops should be assured that ARCA and the AAAA remain totally focused on this campaign and our action in the Senate recently is just one example of the continuous work that is going on to make sure the law becomes a reality, and soon. In our participation in the Senate Inquiry and in our fight for mandatory data sharing law in general, we have been very grateful for the support of Senator Pratt and Senator O’Neill. Both Senator Pratt and Senator O’Neill have been very encouraging of our efforts and when I asked them to comment on these issues following AAAA’s participation in their Inquiry, they were emphatic in their statements of support. “It is unsurprising that mandatory data sharing became a prominent issue during the inquiry proceedings so far, given the Government has yet to act on a promise to introduce a mandatory data sharing code,” Senator Pratt said. “As highlighted in the AAAA’s submission to the inquiry, the ACCC reported in 2017 that competitive aftermarkets for repairs and servicing are in the best interest of Australian vehicle owners. “Consumers should have the ability to choose their local independent repairer and those independent repairers should be able to compete on an even playing field.” Senator O’Neill in particular was passionate about her calls for change. “Labor went to the last election with a mandatory data sharing code. This Government has not done a thing in relation to data sharing. This is the same Government who chose multinational car manufacturers over Holden dealers across Australia and they are taking the same approach with data sharing for independent mechanics,” Senator O’Neill said.

Their local member is the Deputy Prime Minister and I am pretty confident that he would have no idea the struggles they are going through. “This Government is all talk. The National party claim to stand up for regional Australians but they can’t even help out to acknowledge the role that small business such as independent mechanics have to play across regional Australia. “I call on Michael McCormack to actually stop chasing the headlines. It’s time for the Nationals leader to listen to small businesses across Australia. Start with the mechanics in your own backyard, Mr McCormack.” We have also been pleased to have the support of Federal Assistant Treasurer, Michael Sukkar, who recently stated in a return letter to Stuart that mandatory data sharing law is more important than ever (for more on this, please see page 10 of this magazine).
