Another year of growth and commitment. amendments to the Bankruptcy Code, changes to the Federal Rules of Bankruptcy Procedure, administrative rules or actions, recommendations on proper interpretations of existing law, and other best practices that judges, trustees and lawyers can implement. As with the Chapter 11 Commission, this study is noteworthy for soliciting the views of all stakeholders in the system through a series of open public hearings and transparent participation. A final report will be issued in 2018 — the 40th anniversary of the Bankruptcy Code of 1978.

The past year marked new milestones for the American Bankruptcy Institute as the most respected thought leader in the insolvency community. ABI’s landmark Final Report and Recommendations of the Commission to Study the Reform of Chapter 11 was cited by the U.S. Supreme Court in this spring’s seminal Jevic opinion. The Commission’s recommendations continue to be a positive influence on commercial bankruptcy practice and best practices in the courts. The last year also marked the start of a new, parallel initiative in consumer bankruptcy. The ABI Commission on Consumer Bankruptcy is charged with researching and recommending improvements to the consumer bankruptcy system that can be implemented within its existing structure. These changes might include
accounting, consulting, academia, government and more. Membership in ABI was not required. A steering committee of experienced insolvency leaders and mentors established the criteria for selection and identified the top 40 to be honored during a ceremony at the 2017 Winter Leadership Conference in Palm Springs. “We realize that the demographics of our profession are changing,” said then-ABI President Jeffrey N. Remarks from ABI President Hon. Eugene R. Wedoff. It’s been 12 years since the BAPCPA amendments in 2005, and the consumer economy has changed significantly since then. Outstanding student loan debt in the United States has tripled since BAPCPA.

ABI’s Commission on Consumer Bankruptcy is our most significant thought leadership initiative since the Final Report of the ABI Commission to Study the Reform of Chapter 11 in 2014. Why do it? There’s good reason to doubt that the current Congress, faced with a number of contentious disputes, will take up wholesale reform of consumer bankruptcy. But that’s not what the Commission is aiming for. Instead, the Commission’s charge is to look at discrete issues within the present system and suggest adjustments to make the system work more effectively for all of those it affects.
The Commission is headed by two co-chairs, retired judges William Houston Brown and Elizabeth Perris, who bring a depth of experience in both consumer issues and leadership. There are two ways in which ABI members — and others interested in consumer bankruptcy — can offer help to the Commission. The first is sharing ideas for improvement in consumer practice. Those who actually work in the system are likely to have insights that the Commissioners and committee members are not aware of. New ideas for dealing with the Commission’s issues are essential for enabling it to make the best recommendations. With the help of ABI and its members, there will be much more to report about the Commission’s work in the coming year.

ABI Initiates “40 Under 40” Program This year, ABI launched an exciting initiative to identify and honor 40 individuals who demonstrate remarkable ability, leadership and achievement in the bankruptcy and insolvency community. More than 300 people were nominated, and the 40 honorees — selected by a distinguished panel of judges — represent a broad spectrum of talent. Displaying diversity in race, gender, location and profession, these young leaders have shown that they possess the qualities to lead ABI and its related member professions into the future. This inaugural class of “40 Under 40” will be recognized in a special section of the ABI Journal, and also during a ceremony at the 2017 Winter Leadership Conference. It is anticipated that in succeeding years, ABI will honor a new “class” of 40, providing an ongoing way to identify the best and brightest individuals in the field — and both support and learn from the rising stars in the industry. Solicitations for nominations will be available in January 2018.

The ABI Endowment Fund was created in 1989 to provide resources for research and education to the bankruptcy community and was renamed in 2009 to honor the late Tony Schnelling, a former ABI Vice President-Development. Your gift or pledge allows ABI to meet new requests for funding, which may include studies relating to bankruptcy or insolvency; surveys or other analytical investigation; the education of judges, court personnel, other governmental personnel and the general public; or scholarships and other educational grants.
