When I accepted the gavel at the 2018 Annual Spring Meeting, signifying the start of my term as ABI’s President, I spoke about a few things having to do with my vision for ABI. First was a strategic planning process that the organization has undertaken. ABI’s staff and volunteer leadership have an obligation to our members around the globe – present and future – to understand and design the very best services and opportunities for them. To understand how changes in our industry shape what you need from ABI, so the organization can always be a leader in meeting our members’ needs today and tomorrow.
The Legislative Affairs group has partnered with ABI’s Legislation Committee to consider pending legislation such as the HAVEN Act, which proposes to remove veterans’ disability benefits from the calculation of income under the means test. The committee will also, as of this writing, be sending representatives to a meeting of the Judge Advocate General’s Corps in conjunction with an American Bar Association meeting in early 2019.
The other initiative I spoke of was the creation of the ABI Task Force on Veterans’ and Servicemembers’ Affairs. Those who have served are treated less favorably under the U.S. Bankruptcy Code than those who haven’t, and veterans and servicemembers face different challenges in dealing with personal debt issues that civilians don’t encounter. For these reasons, I committed the talents and expertise of ABI’s volunteers to researching and proposing solutions for these problems. The Task Force, under the leadership of former ABI Presidents John Ames and John Penn and two-time ABI Resident Scholar Jack Williams, has assembled more than two dozen enthusiastic volunteers from ABI membership as well as from the public sector. None of this would go as smoothly as it has been without the support of the Task Force’s Reporter, Prof. Nancy Rapoport. Prof. Rapoport was one of the Reporters for the Ethics Task Force and is having a great impact on how effectively things are running.

Dear ABI Members: The American Bankruptcy Institute (ABI) has net assets of almost $15 million. ABI held cash and investments of about $18 million as of December 2017, of which $9 million constituted the Endowment Fund.
ABI maintains three funds — General Operating Funds, General Reserve Funds and the ABI Endowment Fund — and establishes and adheres to prudent guidelines for the reserve levels of the two General Funds. These guidelines are based on industry standards and recommendations from outside financial advisors. The ABI Endowment Fund will continue to be kept in a segregated account, and any expenditures of the principal of the Endowment Fund will continue to require a twothirds majority vote by the Board of Directors under the ABI bylaws.

The 4th Edition of ABI’s European Union Regulation on Insolvency Proceedings was released in the summer and provides a comprehensive introduction to the EIR Recast.
An ABI Conference Meets with a Hurricane
ABI’s 2018 Caribbean Insolvency Symposium had been all set for January 2018 in Puerto Rico. Then, on September 20, 2017, Hurricane Maria slammed into the island territory, knocking out power for months, destroying scores of homes and businesses, and ultimately killing nearly 3,000 people. The resulting damage to the symposium’s host hotel caused the annual conference to be cancelled for the first time. ABI members quickly rallied to help those affected by the disaster and arranged two fundraisers in its place: a cocktail reception on February 1 in Miami, with proceeds donated to the Puerto Rico Recovery Fund, and an ABI Endowment Fund event on April 4 in New York to benefit the Mariano Rivera Foundation. Thanks to the generosity of ABI members, a combined $100,000 was raised to help those in need.

ABC observes strong demand for certified specialists
The American Board of Certification (ABC) is the nation’s premier legal specialty certification organization, certifying attorneys as specialists in business bankruptcy, consumer bankruptcy and creditors’ rights law. The ABC serves the public interest by allowing potential clients to make an informed decision in selecting bankruptcy and creditors’ rights counsel. ABC certification encourages attorneys to strive toward excellence and recognizes those attorneys who have met the ABC’s rigorous standards. The ABC is sponsored by ABI and the Commercial Law League of America (CLLA), and all three ABC certification programs are accredited by the American Bar Association and many states. ABC certification is available to all qualified attorneys without regard to membership in ABI or CLLA. The ABC continues to see strong demand for certified specialists from the public. The ABC website, www.abcworld.org, is continuously being updated and improved, with the most recent changes designed to make it easier
for attorneys to complete applications for certification (and recertification). The American Bankruptcy Institute has an ABC Prep Course designed specifically to assist certification applicants with exam study. The course is available to ABI members for $295 at www. abi.org/abcprep. There are also six hours of CLE credit available when an applicant takes the course. More than 300 men and women were nominated, representing a remarkably diverse mix of race, gender, location, profession and firm size. The inaugural 2017 Class continues to forge ahead in the insolvency industry, and more than 85 percent have since taken on active roles in ABI this past year: • One was appointed as a bankruptcy judge. • Nine had speaking roles at ABI’s 2018 Annual Spring Meeting in April in Washington, D.C. • Five were invited to join advisory boards for regional ABI programs. • Several had speaking roles at ABI’s VALCON conference in May 2018. • Several have had speaking roles on ABILive webinars. • The editors of the 2017 Best of ABI book series are both honorees. • Ten participated in the planning of ABI’s Mid-Level Professional Development Program (November 2018). • One co-chaired a joint Canadian Bar/ABI program (June 2018). • One co-chaired ABI’s Caribbean Insolvency Symposium (February 2018). • One co-authored the cover story in the February issue of the ABI Journal. • Four became ABI Journal associate editors. • One became a member of ABC’s Board of Directors. • Three became active members of ABI’s Consumer Bankruptcy Committee. • Several have taken on new leadership positions in other ABI committees. Building on that success, the 2018 pool of nominees — 330 in all — represent 178 firms and include individuals from the United Kingdom, Canada, Greece and the Cayman Islands.
This year’s winners will receive their awards at the 2018 Winter Leadership Conference in Scottsdale, Ariz., Dec. 6-8, 2018. As part of that ceremony, the honorees will hear a presentation by Molly Bloom, whose story was the subject of the movie Molly’s Game.

Rochelle’s Daily Wire: Exclusive to ABI Members As of late September 2018, Bill Rochelle, ABI’s Editor-atLarge, has analyzed over 950 opinions of some 550 judges. Between 2016 and 2017, page views nearly doubled, from 74K to 132K. Each “Daily Wire,” delivered by email, has a very high open rate (52.71%), with about a third of users sharing content, and it has gained a substantial and loyal following, particularly among the judicial community. There are rumors that some bankruptcy judges boast proudly of being “Rochelled” — i.e., of having their decisions be the subject of Bill’s features. An RDW article from April 25, 2018, “Violation of Discharge Is Now Difficult to Prove in the Ninth Circuit,” was twice cited in a petition for a rehearing en banc in the case of In re Taggart. Many judges echo the sentiments stated in a recent note from U.S. Chief Bankruptcy Judge Janice D. Loyd (W.D. Okla.): “I enjoy reading your daily reviews of cases. It is how I start each morning, actually.” Bill has also recorded video segments on new Supreme Court matters and has been active in public speaking at both ABI and industry events, such as the Jay Westbrook Seminar, the American College of Bankruptcy in Kansas City, the Southern District of Texas Bar and the Southeast Bankruptcy Law Institute. HELPING The Next Generation with CARE
Retired Bankruptcy Judge Mary Grace Diehl (right) received CARE’s first Lifetime Achievement Award, presented by Board Chair Lynn Tavenner (Tavenner & Beran, PLC), for her years of service to CARE.
CARE’s year began with a major restructuring of its board of directors. The board voted to divide into two groups: a Governing Board and an Advisory Board. Members of the Governing Board include private law firm representatives and corporations. The Advisory Board is comprised of bankruptcy court judges and individuals representing nonprofit organizations. The distinction was made for fundraising purposes; fundraising is now the primary responsibility of the Governing Board.
CARE’s first Lifetime Achievement Award was presented to Hon. Mary Grace Diehl (ret.) at CARE’s annual Financial Literacy Celebration to recognize her many years of volunteer service to the CARE Atlanta Chapter. The event was held in conjunction with ABI’s Annual Spring Meeting in Washington, D.C. The Volunteer of the Year, Rising Star and Chapter of the Year awards were presented at a reception at the Winter Leadership Conference in Scottsdale, Ariz.
CARE continued to grow with the creation of 15 new chapters across the country and now has a presence in 37 states. CARE’s growth would not be possible without its many dedicated volunteers across the country, its boards of directors and the support of the American Bankruptcy Institute.
