he 5th of December, King Bhumipol’s birthday, serves as the National Father’s Day and a national holiday. There is a grand celebration at Sanam Luang where important people of the country and Thai citizens gather to pay respect to the King and wish the King a happy birthday with lit candles in their hands while singing songs for the King. Throughout December, you can see almost every street decorated with Thai flags, the King’s pictures and many beautiful flowers. On this day, Thai people also give canna flower, the symbol of Father’s Day, to their fathers and take their fathers out on a special meal.

T

he Phuket King’s Cup Regatta is Asia’s biggest and most popular regatta. More than a regatta, the weeklong event consists of great parties, great sailing and lots of fun.

Inaugurated in 1987 to celebrate the 60th birthday of His Majesty the King of Thailand, the event has been held every year since during the first week of December. In 2006, the event was voted as Yachting Event of the Year at the Christofle Asia Boating Awards. This honour follows a record year in December 2006 with over 100 boats entering the event and with a record media turnout. It is the second consecutive year the Phuket King’s Cup Regatta won this prestigious award. With the Royal Patronage of His Majesty the King, the Regatta is organised by the Phuket King’s Cup Regatta Organizing Committee under the auspices of the Royal Varuna Yacht Club, in conjunction with the Yacht Racing Association of Thailand, the Royal Thai Navy and the Province of Phuket. ven though most Thai people do not celebrate Christmas, there are usually many parties going on. Christmas fairs are held at some markets and you can find a variety of Christmas cards and Christmas trees at every mall around the Kingdom. Some restaurants even celebrate Christmas by giving discounts or special promotions. he word detox has become synonymous with dozens of different types of treatments for removing unhealthy substances from a person’s body. There are many ways to remove these toxins, and therapies have been developed for both general and more specific health improvement. radley Cooper has that hungry look in his eye; that of an actor who knows his time has come even if he can’t quite admit it yet. “I’m so used to working just to work,” he says, “and taking whatever comes.” Like most actors, he’s also highly superstitious. “I remember the first year I acted, I did five bits on TV shows. I called all my friends to watch, and each one, they cut all my stuff out! So after that, I thought, ‘I’m never going to say anything’.” Still, after ten years of such thankless toil in the industry – taking small roles in Nip/Tuck and Alias along the way – all that’s about to change. No question, the last 12 months have been a breakout time for the 35-year-old Cooper. Featuring in the Jim Carrey movie Yes Man and romantic drivel He’s Just Not That into You, he is the de facto star of The Hangover, becoming the most profitable R-rated comedy in Hollywood history. Made for just $35m, this smart story of four guys on an out-of-control stag party in Las Vegas took $459m around the world. “That’s testament to Warner Brothers,” enthuses Cooper. “They marketed the shit out of this movie! They didn’t have to. It wasn’t like it cost a lot to make. There were no big stars at all.” While that’s true, Cooper now looks like one of Hollywood’s brightest prospects. Cooper appeared in one of the mostanticipated remakes in years – The A-Team. Based on the 1980s television show about a quartet of Vietnam veterans on the run from the military, those of a certain age will probably already have been wallowing in nostalgia at the thought of Mr. T as the bling-tastic B A Baracus and George Peppard as the cigar-chomping Hannibal. “I’m amazed at how popular it is,” says Cooper. “All across the United States, someone asks me about The A-Team!” Cooper’s casting as a ladies’ man comes after a year of rumors linking him to just about every eligible lady in Hollywood. After splitting from his actress wife, Jennifer Esposito in 2007, after just ten months of marriage, he became a darling of the US tabloids when he was spied on a date with Jennifer Aniston. But rather echoing the sentiment of the film they starred in together, He’s Just Not That into You, he then reputedly ditched her for Renée Zellweger, who he is still seeing with rumors of marriage in the air.

Cooper met the Bridget Jones star on Case 39, a long-delayed thriller about an idealistic social worker fighting to save a young girl that is finally receiving a belated release in the UK in March. “It’s good,” says Cooper. “It’s actually good.” He sounds convinced, at least, even if the studio evidently isn’t. Does it bother him when films get shelved? “Less and less the older I get. I’m used to it. The basic objective is to enjoy the experience while I’m doing it and everything after that is out of my control.” So was the experience good here? “Very much so. I got to know Renée, who I really like very much,” he replies, looking a little sheepish. The couple have reportedly just bought a $4m house together in the Hollywood hills.

That’s when I knew that I wanted to be an actor. I always wanted to play roles rather than actually do them. I always wanted to be an actor ever since I was a kid.

Before Case 39, Cooper played the title role of All About Steve, a nutty Sandra Bullock comedy in which she plays an eccentric crossword puzzle addict who becomes convinced that a CNN cameraman is her true love. “I shot that movie three years ago. I’ll look like a little baby when it comes out,” says Cooper. After trotting out the usual hyperbole about working with Bullock – “amazing”, “incredible”, “wonderful” all spew from his mouth – he tells me that it’s where he first worked with Ken Jeong, who plays a naked – and very angry – gangster who accosts Cooper’s character in The Hangover. “I never would’ve thought that three months later I’d have his naked genitals flapping around my neck.” The Philadelphia-born Cooper wasn’t always so confident in himself. By his own admission, he hardly stood out in his early years. “I wasn’t the smartest person in school, I wasn’t the coolest kid. I really didn’t have anything going on.” A sports jock, he most certainly was not, though he was intrigued by them. “I was fascinated by those guys because they were so obviously jerks and didn’t hide that fact,” he recalls. “But they somehow had this power; that the rules of the universe didn’t apply to them.”

At least then, Cooper wasn’t quite the alpha male type, despite being the son of a stockbroker who worked for Merrill Lynch. Did he ever consider following suit? “No, but I always wanted to play a stockbroker in a movie. That’s when I knew that I wanted to be an actor. I always wanted to play roles rather than actually do them. I always wanted to be an actor ever since I was a kid,” he says. So how did he know? “It wasn’t even a question. I just knew. People would say, ‘What do you want to be, Bradley?’ and I’d always reply, ‘I want to be an actor’.” Not that it came easily. While undertaking a degree in English at Georgetown University, he shied away from doing theatre. “I don’t think I ever stepped foot onstage. I was so scared of talking in front of people.” After graduating, Cooper applied for a Masters at the Actors Studio at the New School University in New York and got accepted. “I think they let a lot of people in,” he smiles. His early forays into professional acting – the ones that didn’t hit the cutting-room floor – were hardly auspicious, initially becoming the host of the Lonely Planet series Treks in a Wild World. As he puts it, “There’s been plenty of that rejection and hopes that aren’t fulfilled.”

It’s a very intimate thing you go through, shooting a movie. You find out whether you really like somebody, or you very much dislike somebody pretty fast. It’s like doing a sport together.

In 2005, Cooper gained the role of Will Tippin in Alias and gradually began to establish himself, notably featuring alongside Vince Vaughn and Owen Wilson in the hit 2005 comedy Wedding Crashers. He even finally got over his stage fright, “For me, it’s a hundred times harder than acting in film or television,” he says. Worse was to come. By 2007, when Cooper shot a number of movies, including All About Steve, He’s Just Not That into You and Yes Man all at the same time, as well as several episodes of the popular show Nip/Tuck, he admits he was facing burnout. “I felt like, ‘I’ve got to not do anything. Going from movie set to movie set, I’m not really living. I don’t know what I’m bringing to roles anymore. I really do feel like I want to live’.” Since then, he’s deliberately slowed his work-rate down – just shooting The Hangover in 2008 and The A-Team and Valentine’s Day last year.

At least in the case of The Hangover, it worked. After years of playing the best friend to the leading man, in films like Failure to Launch, he finally got to play the best friend who’s really the leading man. Following a particularly wild bachelor night in Vegas that involves strippers, babies and Mike Tyson’s pet tiger, his character, Phil, spends the film looking for the groom that he’s lost just one night before he’s due to get married. His own drunken antics sound almost as entertaining. “There was always one moment in the night where I would go, ‘It’s time to get naked!’” he grins. “And it was usually in the wintertime, when I’d want to run out in the snow.”

Shortly after touching down at Ulusaba’s private airstrip we were greeted by the General Manager who offered us a cooling glass of champagne before escorting us to our sumptuous accommodation. Regarded as one of the top five game reserves in South Africa, guests can share their time between the two lodges at Ulusaba Rock Lodge and Safari Lodge. Rock Lodge is perched high on the summit of a koppie and provides panoramic views over miles of bush, the wildlife roaming within and the beauty of the lowveld below, all set against a backdrop of the Drakensberg Mountain range far in the distance. It seemed only natural that our suite, Makwela Dawn was named after such an important member of the community. Even our bathtub was strategically placed, so we could lie back and watch a different kind of world go by. Cubs (children) of all ages are welcome at Rock Lodge and will be invited to take part in Ulusaba’s Cub’s Club. Because Rock Lodge is small and intimate, and because they know each ‘Cub’ is different, they do not operate a set programme. Instead they offer a fantastic range of activities, such as treasure hunts, that are tailored to each child or group. On arrival all Cubs will be given a Cub’s Club backpack which contains lots of little goodies to help keep them entertained and to help to educate them about the African bush.

Our stay at Ulusaba included all meals and unlimited drinks. They had a particularly impressive wine list too, including a number of top South African vintages and classic French champagnes from their now legendary “Safari Wine Cellar”. Dinner was always a feast, and their talented chefs carefully prepared each meal of African dishes alongside a fine selection of international choices ... all cooked to perfection. At Ulusaba you can also dine at a traditional African braai – a barbecue under the stars. This was always an experience to behold! On returning from game drives we would always unwind in the Aroma Boma Spa or take a dip in the freshwater swimming pools with a cool drink that’s just as refreshing. And after the sun disappeared over the horizon, guests would experience the unparalleled beauty of the African night sky with a little star gazing before bed. With spectacular views over the bushveld, even the gym at Ulusaba often provided an alternative mode of relaxation. Our exciting adventure in the African bush started here. A fully trained and experienced ranger and tracker would take the guests on a game drive twice a day, both lasting for approximately 3½ hours and traversing an area of 13,500 hectares. The more adventurous would also take a daily guided walking safari after breakfast, where you could learn more about the medicinal properties of plants, local customs and fascinating facts about the wildlife. From the very moment we set out we would feel the adrenaline rush as we anticipated the wildlife we would encounter just as they should be ... in the wild. A snap of a branch to our left and then a rustle of leaves ... our hearts were beating fast with excitement as our tracker signalled us to stop. We smiled in anticipation. All visitors have to be kept a safe distance from the wildlife so following our tracker’s command, we all waited silently. It was a welcome break after close to three hours trekking through the thick undergrowth of the bush, so we took advantage of the free moment to catch our breath. For guests wanting to find out more about the area surrounding Ulusaba, you could get a bird’s eye view of the region by helicopter and visit the Blyde River Canyon – the world’s third deepest. Explore the local Shangaan village, where your contributions go entirely to fund charitable projects, or stargaze at Ulusaba’s bush observatory for fantastic views of the night sky!

Our tracker signalled and ahead of us we could see a pair of cheetah slumped in the grass, the mother watching over her three young cubs as they played contentedly in the warmth of the morning sun.

Tax implications of fractional ownership by Paul Ashburn

Fractional ownership of holiday homes is a relatively new concept in Thailand. It offers the benefits of owning a holiday home for a fraction of the cost. The tax considerations for fractional property owners are similar in many respects to traditional ownership of real estate in Thailand.

I

n its simplest form, the legal ownership of the property may be structured so all owners are registered as the owners on the ownership documents. In Thailand, developers selling to a mainly foreign audience are likely to consider using a legal structure that sees indirect ownership of the property being offered instead. The ability to structure real estate holdings tax effectively in Thailand is largely governed by the nature of the development, i.e. landed villas, condos or apartments – which unlike condos are not deeded properties – and the legal structure that is being used to ´sell´ the property to the foreigner. The basic ingredients of the legal structure for selling fractional ownership in Thai property to foreigners can often be similar; long term leases with renewal options if freehold is not permitted; a Thai special purpose vehicle (SPV ) to hold land, condo units or apartment buildings that the foreign buyer cannot own in their own name; and offshore companies in tax haven jurisdictions to act as a collective ownership vehicle for foreign owners. Sometimes the structuring stops there. How well the structure has been fine tuned from both a financial and tax perspective will influence the amount of tax paid by the developer and future owners.

Effective tax planning for selling fractional ownership in Thai properties using an offshore vehicle as the collective owner involves financial modeling and an appreciation of the Revenue Department´s approach if the whole structure comes under scrutiny. For example, the use of offshore companies in tax havens to act as a collective owner of a Thai SPV is often abused. At the outset it will have a real practical benefit – which is not tax related. The offshore company will have an advantage of operating under a legal framework that is more familiar to foreign owners, and will allow greater flexibility to arrange the articles and rules of association between the owners. Of course, being in a tax haven also allows the affairs of the company to be organized in a tax-free manner so it acts as a conduit with no related tax leakage. In fractional models where deeded ownership is not offered, a Thai SPV may be employed in the property holding structure. In general, Thai law does not provide for special entities to be created to hold properties. One exception is the ability to establish Thai RE ITs under securities laws, but these are subject to a number of qualifying conditions.

Thai limited companies are therefore used as SPV s in fractional models where deeded ownership is not offered. Achieving tax neutrality in the Thai SPV , or something close to it, should be an important goal. Where a Thai SPV is used in the ownership structure, prospective buyers should try to evaluate how well the developer has structured the financial affairs of the company from a tax compliance perspective. Given that Thais are free to own real estate in Thailand, you would think that a fractional ownership model targeting Thai buyers would be structured on the basis that their names will appear on the title deed. But could the tax consequences of deeded ownership and the apparent tax advantages of indirect ownership via a foreign company win them over in the end? Apart from the obvious advantage of legally avoiding the transfer taxes and fees that apply to transfers of immovable property registered in Thailand, there are also remittance rules that apply to foreign sourced income that may work to the advantage of a Thai fractional owner. If the owner sells their fractional interest, there is no doubt that a gain made from the sale of shares in the offshore company would be assessable for personal income tax purposes under the Revenue Code. However, the gain is only taxable in Thailand if it is remitted into Thailand in the same year the gain is made. Correctly structured, Thai tax residents can legally pay no Thai income tax on the disposal of their fractional interest. It will be interesting to see how effective the legal structures used for fractional property ownership in Thailand will be in managing the tax issues for both the developer and buyers.

a realistic power source. Each of the micro gas-turbines weighs just 35kg and produces 70kW of power at a constant 80,000rpm.

From whatever angle you look at the C-X75 it is stunning, with powerful, but elegant, sculptured flowing curves and a deep front grille that will be the face of all new Jags, flanked by long sleek headlights.

The energy created by the turbines is stored in the batteries and is transmitted to the wheels using four independent electric motors. Using individual motors has benefits in terms of weight-saving and distribution, packaging and efficiency. Each motor weighs just 50kg but produces 145kW (195bhp) of power and an astonishing combined total torque output of 1,600Nm (1180lb/ft).

The side profile, with its huge air vents, oozes speed, but the sensational rear end stops you in your tracks. The inside is just as amazing where its aircraft inspired cockpit that wraps around the driver and unique materials that have been used. Don’t get me wrong there is still leather, but it is blended with high–tech materials such as a textured, molded rubber and soft neoprene found in sports clothing, polished aluminum and a new, light mesh finish inside that lights up like a hologram.

Because each wheel is driven by its own electric motor, the C-X75 is a true four-wheel drive – with all the traction, grip and safety benefits that entails – without the weight disadvantages of a purely mechanical set-up. Inherent in this drive train is the ability to independently vector torque to each wheel across the full speed range. This offers potential benefits in terms of stability and control, creating an infinitely and instantaneously adjustable traction and stability control system.

Developed in partnership with Bladon Jets, the miniaturized turbine blades – the first viable axial-flow micro-turbine – increases the compression and efficiency of micro gasturbines to the point at which they can be viewed as

The four-wheel drive supercar is capable of running in purely electric (zero tailpipe emissions) mode for 110km (68 miles) on a six-hour domestic plug-in charge. The innovative, lightweight micro gas-turbines are also capable of very quickly and efficiently recharging the Lithium-ion batteries, giving the car a theoretical range of 900km (560 miles). This remarkable range-extension system is a result of Jaguar’s research engineers adopting a clean-sheet approach to the question of powering the supercars of the future.

A new interface for the driver has also been created for the C-X75 using high-resolution TFT screens. Building on Jaguar’s 10-year expertise in touch screen technology, the Jaguar Co-Pilot display in the centre console supports the driver in extracting the full potential of the C-X75 by seamlessly managing information.

The C-X75 turns to the very latest evolution of a pioneering British technology: the gas turbine. With the seats fixed, the steering wheel, controls, main binnacle and pedal box all adjust towards the driver. The seats are attached to the bulkhead as in a single-seat racing car, and air to feed the turbines passes smoothly around them via channels in the structure of the body. The main driver information screen is housed within the instrument binnacle. Needles float on the periphery of the twin cowls and sweep round the outer edge to display the status and rpm of the two turbines. The design team combined designs from instrumentation in the new XJ saloon with those from fighter aircraft to create virtual 3D ‘gimbals’ around which the gauges wrap and rotate to provide status updates Aerodynamics have always played a large part in Jaguar design with the late designer Malcolm Sayer elevating it into an art form in cars such as the XJ13, the prototype from which the C-X75 draws inspiration. Jaguar has increased the design’s aerodynamic efficiency dramatically by opening the front grille and brake cooling vents only when necessary. At the rear corners of the car, vertical control surfaces automatically engage at higher speeds to direct airflow aft of the rear wheels for increased stability and efficiency. The Jaguar C-X75 stole the show and has shown the world what can be done with continuous research and development.

Raam has 10 years experience in kiteboard teaching and is an International Kiteboarding Organization (IKO) certified instructor. KBA is certified by the IKO; certifying more than 2,000 students/instructors every year and carries a 2,000,000£ insurance. Koh Samui is one of the top places to learn to kiteboard throughout the world. The flat shallow water with sandy bottom combined with a steady wind invites the best kiteboarding learning experience possible. Couple the wide, long uncrowded beaches of a tropical island with good wind and flat water – and you have a winner! And, there are no nasty marine animals, waves or currents to watch out for here. Raam enthuses, “When it’s a windy day, it’s like kiteboarding has been sent from above. We have shallow sandy bays with outlying reefs which protect the inner bay and keep the water flat, like glass. For the intermediate students, the reef waves will keep you busy as will the flat water in the bays either side of the teaching lagoon. The beach is fine sand and free from tourists and swimmers.” KBA offers a three day course for a beginner which includes all the equipment to start their adventure. Raam says Samui is the best location, but other KBA locations are great as well. The course is recommended for anyone wishing to learn the skills needed to have a safe and fun start to kiteboarding. By the end of the course the student should be “water starting” with the board and have gained enough confidence with the kite and board to go out on their own. Upon completion the student also receives an IKO certification that certifies their level as ‘intermediate.’ With good instruction most people enjoy an incredibly fast learning curve; however, without instruction, trying to learn kiteboarding can be frustrating and dangerous. An instructor can provide feedback, share local knowledge, maximize safety and customize instruction to individual needs. Raam recommends a student spend 4-5 hours flying a “2 line stunt kite.” He explains that having kite flying skills makes the learning curve a lot quicker and more fun - and flying the kite is at least 80% of kiteboarding. Having great kite skills will make board riding easier, safer and more fun, reports Raam.

he second Alternative Ownership Conference Hotels and Resorts Asia Pacific (AOCAP) opened its doors today in Phuket to both local and international delegates. The two-day conference, held 11th and 12th October, welcomes leading Gurus in the field of Shared Ownership from around the world.

In Asia Pacific, Vacation Ownership uptake by both buyers and resort operators is on an upward trend. One of the most recent announcements in the region is from Thailand hospitality group, Minor International, who are launching their Anantara Vacation Club in Thailand initially, with an Asia Pacific roll out to follow.

AOCAP organisers have brought top speakers and leaders in the Shared Ownership industry, from Europe, Africa, USA and Asia Pacific, to Phuket to share their knowledge and insight with conference delegates.

Fractional Ownership and Private Residence Clubs are a much newer concept in Asia Pacific and have attracted a number of leading real estate developers to adapt such business models, including Absolute Developments - the pioneer in Phuket with their Absolute Bangla Suites fractional offering launched in 2008 and now their new PRC The Beach Samui - and more recently with Raimon Land launching Private Residence Clubs at a number of their luxury developments in Thailand.

Koh Phi Phi Phi Phi Island, once considered one of the most beautiful island groups in the world, is located half-way between Phuket and Krabi and is part of the Koh Phi Phi – Had Nopparat National Park, that covers 390 sqkm in Krabi Province. In former times the local people called this island “Pulau Piapi”. This derives from the language of the sea gypsies, with the first word meaning an island and “Piapi” being the name of a plant growing in the mangrove forests. During the centuries the name changed to Phi Phi. 3

Koh Panyee is a small island. Most of it is huge, almost vertical, limestone cliffs. The hundreds of huts, shacks, restaurants and houses where the villagers live are built on stilts over the surrounding shallow sea. No one seems quite sure how many wooden and concrete piles hold up this extraordinary community, but it is certainly a fascinating and unique feat of informal engineering.

3. Koh Racha The Racha (or Raya) islands, some 12 km south of Phuket, are best known as excellent diving and snorkelling daytrip destinations. Racha Yai reveals itself in splendid fashion, with most arrivals landing onto a strip of fine white sand tucked deep into the long, U-shaped main bay, called Ao Tawan Tok or Ao Bungalow. The water here is clear and perfect for snorkelling, though the bay gets quite busy with visiting boats in the afternoons.

4. Koh Kai The island is blessed with some relatively untouched coral life. But be warned the best stuff is 100 meters out. If you are not feeling the most energetic, ask the captain to give you a lift to the Northwest reef, drift southwards taking in the best of the massive barrel sponges and Black-tip reef sharks, It’s part of a pair of islands found one third of the way from Loh Jak, Koh Yao Yai and Phuket. It’s brother island Koh Kai Nog is also spectacular, but as it is larger, tends to be frequented more by speedboats.

5. Koh Naka Naka Yai features only one small village on its west side, but having recently caught the attention of some major resort operations no less than 3 projects are in the works here. In a very short space of time, the island is rapidly changing from a fishing village into a fairly exclusive resort location. Most of Naka Yai’s beaches are broad and sandy, and along its eastern shores the views out across Phang Nga Bay are simply breathtaking. The longest beach on the east side has chairs and umbrellas for rent, plus a small snack counter.
