HOW CAN WE DESCRIBE WHAT HAPPENS WHEN A COMMUNITY IS DISRUPTED BY RAPID DEVELOPMENT?

e have come to reduce the idea of change within a neighborhood to an inevitable causal relationship between gentrification, represented by outside forces, coming into a lower-income community to change the community itself. Developers and high-income residents who move to the community are the enactors of that change; longtime residents are the object. But some neighborhoods demonstrate how they have achieved change from within, well before the forces of developers entered into the mix and houses were being torn down or destroyed. Norris Square is one of those neighborhoods. If you listen to the stories of the longtime residents in pg. 12 of our cover story this week, the neighborhood transformed from an epicenter of the crack epidemic, home to what was once labeled “needle park,” to a community of residents who revitalized many of the public space areas and banded together to beautify vacant lots and fix other aspects of their environment. Now, though, their changes, their creations and building blocks of community, are being literally wiped out by developers. The stories of flooded basement homes and cracked walls, houses torn apart by the ongoing construction in the neighborhood, are not uncommon experiences for longtime residents of neighborhoods that experience what is often referred to as “gentrification”: a term that in some ways obfuscates the brutal, physical impacts of the change that the concept represents. The reality of rapid development brings to mind a quote from the man who shaped the landscape of New York City and who also displaced thousands, if not millions, of people throughout the course of his development and construction designs: “...When you operate in an overbuilt metropolis, you have to hack your way with a meat ax,”
ENGLISH ESPAÑOL said Robert Moses in journalist Robert Caro’s biography of the urban planning giant, “The Power Broker.” Moses was no champion of the preservation of communities, especially when they got in his way, but the language he uses at the very least comes closer to representing the means of gentrification, or what some of that rapid development and turnover looks like on the ground: a force that has in its mind to “hack [its] way with a meat axe.” ”Gentrification” as a word still has some trace of a positive connotation: an indirect if not direct correlation to “coffeeshops” and “wine bars,” according to some ways it has been described in the media, as more affluent residents and businesses move into historically low-income neighborhoods (almost always correlated to demographic shifts, in which white residents move to a neighborhood whose residents have historically been Black, Latino, or from other communities of color). But what is termed gentrification or change in a city neighborhood can also, at times, more closely resemble Robert Moses’ phrasing: a kind of destruction and tearing apart which takes a toll on people, communities, and the environment and stability of the neighborhood as a whole.❚ THE EDITOR

omestic workers, organizers, elected officials, and community leaders gathered at City Hall on Nov. 26 to witness the official signing of the Philadelphia Domestic Workers Bill of Rights, set to take effect in May 2020. Passed unanimously by City Council on Oct. 31, the legislation establishes basic labor protections for the more than 16,000 nannies, housekeepers, and caretakers in Philadelphia. The bill includes: anti-discrimination laws; mandatory written agreements; mandatory meal and rest breaks; the creation of a nine-person board to monitor standards and implementation; and the establishment of a portable paid time off system.

Philadelphia has joined nine states and the city of Seattle in passing protections for domestic workers. “We’re here to celebrate one of the most comprehensive and progressive domestic worker bills of rights in the country. Getting this done has been an amazing victory for the women and men who told their stories,” said Councilwoman María Quiñones-Sánchez at the signing ceremony. The councilwoman, who was the bill’s primary legislative sponsor, noted the importance of not just the bill itself, but the way in which it was crafted: with the input and contribution from domestic workers themselves. Betania Shephard, a domestic worker and leader in the Pennsylvania Domestic Workers Alliance (PDWA), was part of the team that wrote the legislation, which in addition to PDWA included support from Community Legal Services, the Mayor’s Office of Labor, Councilwoman Quiñones-Sánchez and other councilmembers. “I’ve had many bad experiences. I’ve been paid very little, and some clients have been very vulgar,” Shephard said at the ceremony of some of the experiences of mistreatment in the industry which motivated her to fight for a bill of rights.

“Now we have backing and support for when there are abuses,” Shephard said. María del Carmen Díaz, a PDWA organizer and leader who has been fighting for the passage of the bill for over a year, told AL DÍA that she believed the law and movement has already started to make a difference for her and others. “[The abuse] is going to stop it because we’ll now have somewhere to go to complain, someone who represents us,” said del Carmen Díaz. But del Carmen Díaz says that though there is cause for celebration, much work remains. “Now our goal is to fight for a national bill,” said del Carmen Diaz, referencing the Domestic Workers Bill Of Rights Act introduced by Sen. Kamala Harris (D-CA) and Rep. Pramila Jayapal (D-WA) in July. She added that the PDWA will also focus on education and outreach to domestic workers in Philadelphia, to ensure that they are informed about their newly-won rights and protections. n May 20 a flu-ridden 16-year-old from Guatemala writhed in agony for four hours on the floor of a U.S. Border Patrol cell in Weslaco, Texas before he was found dead by his cellmate. His name was Carlos Hernández Vásquez, and the only reason we know it is that ProPublica obtained and released a surveillance video showing his last hours. He is only one of at least six children who have died while under immigration custody since December 2018. The harrowing video shows the boy not moving after 1:39 a.m. He had fallen to the floor face first 15 minutes before. According to published reports, Border Patrol logs say an agent performed
ENGLISH a welfare check at 2:02 a.m., 4:09 a.m., and 5:05 a.m., but didn’t go inside despite police photos showing a large pool of blood around the kid’s head. “To all of us who covered the wars in Central America and know why these young people flee their countries, this is a declaration of war,” said Susanne Ramírez de Arellano, a veteran journalist who covered, among many other horrors, the massacre of El Mozote in El Salvador. “How is this possible? How? Washington has more than blood-stained hands, it has the whole soul. This is murder.” Yes, it is, and it is high time to start calling the horrors inflicted on immigrants by Donald Trump and his corrupt administration by what they really are. ast Monday, Democrat Regina Romero made history by being sworn in as the first woman mayor of Tucson, and the only Latina mayor in the 50 largest cities in the United States. After starting her campaign in 2019, and winning the Democratic nomination, Romero had to face Ed Ackerley, a former Democrat who tried to take the independent field to win conservative votes. Finally, Romero defeated Ackerley by 87,000 votes and has become the city's first woman mayor, and second Hispanic mayor - after Estevan Ochoa, who held office between 1875 and 1876. The new mayor of Tucson is the daughter of immigrants and was the first of six children to graduate from college. In 2007 she was the first Latina to

ince 2012, Hispanics have outpaced all other demographic groups in startup businesses in the United States, while comprising 40% of all minority-owned
businesses. However, despite this dynamic, Latino-owned businesses tend to not only start smaller than their counterparts, but also remain smaller. It costs the community approximately $1.3 trillion when Latino businesses do not grow. “We need Latino-owned businesses to scale up if we are to maximize job creation and wealth in our community,” said Lou Rodriguez, chairman of the Greater Philadelphia Hispanic Chamber of Commerce. With the financial growth and scaling of Hispanic businesses expected to accelerate throughout the next decade, it presents opportunities for Hispanic business owners to succeed, and also for communities to build wealth.

The Greater Philadelphia Hispanic Chamber of Commerce is committed to developing, promoting, and advocating for Hispanic businesses in the Greater Philadelphia region, but also encouraging the advancement and economic growth of the wider U.S. Hispanic community. “We deeply believe that the success of the local and regional economy is inextricably linked to the success of Hispanics,” said Jennifer Rodriguez, president & CEO of the Greater Philadelphia Hispanic Chamber of Commerce. Currently, Philadelphia holds the unfortunate distinction of being the poorest large city in the country, with a 26% poverty rate. The Hispanic community in the city, however, make up 38% of that poverty rate, the highest of any group. It’s long been stated that the long-term solution may lie in education and family-sustaining jobs. “Solving for education is challenging. It requires massive resources and is politically challenging,” said Rodriguez. “Solving for jobs, however, is far more elusive because jobs cannot be created on demand,” she added. The most effective way to tackle this issue has proven to be through entrepreneurship. The more than 4 million Latino-owned businesses in the country generated over $700 billion to the economy in the past year. “The fact is, small businesses continue to be the greatest source of employment in our economy,” said Rodriguez. “If job creation is one of the keys to lifting our city out of poverty, and if small businesses are the engine of growth of our econDECEMBER 11 - 18, 2019
omy, why are we not hyper-focused on helping small businesses succeed?” To advance this very question and help ensure the growth of Hispanic businesses and the Hispanic community, the Hispanic Chamber created the Latino Small Business Agenda for 2020. t’s been 36 years since Carlos Rodriguez called somewhere other than Philadelphia’s Norris Square neighborhood “home.” Before he moved to his current house at 2034 Hancock Street in 2000, Rodriguez lived a block over on Palethorp Street. Like most longtime residents in this predominantly Puerto Rican pocket of Kensington, Rodriguez knows everyone — from the woman on his current block who used to open her home to him when he was a rowdy teenager, to the longtime fishing buddy that still lives on his old street under the care of his wife and grown-up daughter. It’s a neighborhood that welcomed Rodriguez back home in 2004 after a tour in Afghanistan and the place in which he raised his daughter, and now where she raises her children. But it’s changing.
GENTRIFICATION
In the 1980s, with the neighborhood in the stranglehold of the crack epidemic and its park labeled for the needles that littered its grass, houses were sold for $1. Now, firmly within the grasp of gentrification, it’s not uncommon to see a property valued for more than half a million. But the rising sales prices and taxes are only some of the signs of gentrification. They also only appear on paper. The more apparent change upon visiting any neighborhood facing gentrification across the city and country is the constant construction. It’s unrelenting, and

A FLOODED BASEMENT
Rodriguez’s problems started in 2017, when longtime neighbor, and City Council representative for the 7th Councilman District, María Quiñones-Sánchez sold her house at 2038 Hancock Street to a new owner for $400,000. In addition to the house at 2038 Hancock, the new owner also purchased the land in between his and Rodriguez’s house to plant a garden. It previously served as a common space and is the site for a storm drain. To accommodate the garden, a developer brought in by the new owner raised the earth around the house and storm drain. “In some spots, it’s raised as high as nine inches,” said Rodriguez. As a result, his house now sits at the bottom of a slight incline, and acts as a collection pool for water when it rains. To add insult to injury, Rodriguez alleges that the developer also did not install the correct-size drains on the house and thinks the excess water from the roof has damaged the storm drain in the former common space. “It creates a waterfall that goes straight to the ground,” said Rodriguez. “And where is the water going to go?” It goes to his property. He’s installed a makeshift drain in order to subvert some of the water to a drain in his backyard, but the rest goes to the one in his basement.

In one spot, storm water pours through the same hole as electrical wiring. Rodriguez fears one day it could catch fire. “It puts my wife, daughter, son-in-law and nieces in danger,” he said. He is not alone in his fear of the future in the neighborhood.
SHAKY FOUNDATIONS
Just one block south of his house, on the adjacent Palethorp Street, lives Wanda Santiago with her elderly mother and father. Santiago has lived in their current house on Palethorp for 20 years and in Norris Square for her whole life. She lives with her parents and is their primary caretaker. Her father struggles with mobility in the aftermath of a stroke that paralyzed one side of his body. When AL DÍA visited Santiago’s house in August, her father was in hospice care. At first, Santiago says she welcomed the development coming to her block. “I’m all for beautifying our neighborhood,” she said. But in a short time, that opinion changed as she saw what she described as “aggressive building” from the arriving construction crews. One night, she came home from work to find her house covered with a plastic sheet. While building a basement on the lot next to her house, construction had disrupted her house’s foundation. “It was completely separated from the pavement,” recalled Santiago. She and her parents were ordered to evacuate, which was anything but simple because of her father’s condition. The fire department aided their safe flight. “Thankfully, we made it out in time,” said Santiago. In the aftermath, the house was visited by agents from Philadelphia’s Licenses and Inspections Office to survey the damage. They didn’t condemn it, and

Santiago and her parents returned home after a few days. But the house they went back to was not the same. In addition to the cast-iron gate that protected their backyard being removed, so was the ramp that allowed her dad to get out of the house. A part of the wall in her basement was also separated from the foundation. When she confronted the neighboring developer about the ramp, he promised to install another one for her. It never materialized. He is one of many, she says, to have promised her something and not followed through. “Everybody had a solution, but nobody kept their word,” she said. The house’s state left Santiago in an uncertain situation when AL DÍA visited in August. “It’s been terrible for us,” she said. Santiago especially feels for her father, who can no longer leave the house without a ramp. “Imagine somebody telling you: ‘You can’t come out,’” she said. She especially worries for a medical emergency

given his fragile medical state. “I said I would just drag him out if I had to,” said Santiago.

5 able construction practice, residents are urged by the city to contact its Licenses and Inspections Office, which intakes complaints through Philly’s 311 service. Ask Santiago about L&I, and she puts them on the growing list of individuals and organizations who have let her down. Rodriguez takes a harsher stance. “Licenses and inspections is not with us,” he said. After failing in his attempt to confront his neighbor, Rodriguez called L&I to inspect the damage done to his house. According to him, an agent came, inspected the property and left without filing a report. “They didn’t see anything wrong,” said Rodriguez. Experiences like these spread in a community like Norris Square, where everyone talks to one another. Combine that with experiences of not hearing anything back about inquiries and it leaves the impression that the city is in ca-

La postura de Rodriguez es aún más dura. “La Oficina de licencias e inspecciones no está de nuestro lado”, dijo. Luego de su fracasado intento

LA SITUACIÓN ACTUAL
Según Karen Guss, directora de comunicaciones para la Oficina de Licencias e Inspecciones, el departamento recibe más de 60,000 quejas anualmente. Para el manejo de las mismas, la oficina cuenta con 167 empleados divididos en cuatro unidades: construccion, cumplimiento del códigos, respuesta a emergencias, y auditorias e investigaciones. La unidad de construcción es la más grandes de estas cuatro unidades, conformada por 80 empleados que se aseguran que los desarrolladores cuenten con los permisos correctos. Luego sigue el cumplimiento de códigos, con 70 empleados, a cargo de asegurarse que las estructuras existentes estén actualizadas en cuanto a los códigos (como el código de incendios”. La unidad de respuesta a emergencias cuenta con 15 empleados que se encargan de situaciones parecidas a las de la casa de Santiago y las demoliciones. Actualmente la unidad de auditorías e investigaciones cuenta con dos empleados a cargo de realizar visitas no anunciadas a los sitios de construcción para asegurarse que los contratistas cumplan sus requerimientos. “Es difícil”, dijo Guss. No obstante, dijo que la Oficina de Licencias e Inspecciones usará su financiamiento adicional,

According to Karen Guss, the communications director for L&I, the department intakes more than 60,000 complaints on an annual basis. To handle that, the office has 167 employees split into four units: construction, code enforcement, emergency response and audits and investigations. Construction is the largest of the four units, with 80 employees who makes sure developers have proper permits. Code enforcement is next with 70 employees, and ensures existing structures are up to date on codes (like the fire code). In the emergency response unit there are 15 employees that handle situations much like the one at Santiago’s house and demolitions. There are currently only two employees in the audits and investigations unit, charged with making unannounced visits to construction sites to make sure contractors are following their requirements. “It’s tough,” said Guss. However, she said that L&I will use its additional funding under the mayor’s 2020 budget to expand its audits and investigations unit to 10 employees. In addition, due to reporting done by The Philadelphia Inquirer, L&I has also announced plans to expand its permitting requirements, water-damage inspection

Much of The Inquirer’s reporting happened in Fishtown, just south of Norris Square. Its articles brought up another challenge Norris Square has struggled with: legal representation. Unlike Fishtown, where the income has gone up in tandem with property tax, Norris Square’s median income still sits south of $30,000. Fishtown residents with problems can — and have — sued developers for damages. That option isn’t as accessible for many farther north, Guss acknowledged. “So even if we can get the developer out, that resident has to live with the damage done unless they can get a lawyer,” said Guss. “And that costs money.” As a potential solution to lack of legal representation, L&I Commissioner David Perri told The Inquirer that he hopes to see a fund similar to that set aside for victims of eviction to get free legal counsel, set up for those with damaged houses because of construction. As in recent debates on tax abatement, however, City Council can only compromise in the face of the developers. ❚

policies that would limit the increase in the average temperature of the planet to 1.5ºC, in order to prevent the planet from rising to 2ºC, which could be even more devastating, exacerbating the sadly common natural catastrophes. Mega-droughts like the one Chile has suffered for ten years, severe floods that drown countries like Peru as its glaciers melt, and much more violent and continuous cyclones than Maria or Dorian, who hit the Bahamas this year, are all examples of natural disasters fueled by climate change. In addition to the rise in sea level due to the melting of the poles, one of the consequences of global warming also affects opulent and high-polluter countries like the United States. "The climate risk index shows that climate change has disastrous effects, especially for poor countries, but also causes increasingly serious damage in industrialized countries."
The devastation has become "democratic", as the climate tragedy is spreading to countries like Germany, where 1,800 people died during a heat-
wave, and Japan, which is one of the top rankings of places most damaged by climate change, with almost 1,300 deaths from extreme temperatures, torrential rains last summer and the destructive passage of Typhoon Hagibis in September. "The climate risk index shows that climate change has disastrous effects, especially for poor countries, but also causes increasingly serious damage in industrialized countries," said David Eckstein, a consultant for Germanwatch, the German organization in charge of conducting the study, which is yet another alarm for action against change.
AND WHAT ABOUT THE POOREST COUNTRIES?
In order to save other green things beyond bills, UN experts hope that the 200 countries
that signed the Paris Agreement –which is to replace the Kyoto Protocols in 2020– will reduce their emissions by 45% in the next ten years, reaching zero by 2050. The question remains as to how to transform economies such as Latin America that depend mainly on fossil fuels. On the other hand, the funding that's been dedicated to the reconstruction of places devastated by the harsh stalking of hurricanes and floods is still shallow. Are there any support mechanisms? That's a discussion still pending, especially since President Trump not only announced the U.S. withdrawal from the Paris Agreement –alleging that it is a maneuver of the rest to "take advantage" of the most powerful country in the world– but seems to have completely forgotten about Puerto Rico.❚

Por otra parte, la financiación que hasta ahora se dedica a la reconstrucción de los lugares desolados por el inclemente acecho de huracanes e inundaciones es todavía somera. ¿Qué mecanismos de apoyo existen para ellos? Eso es algo que habrán de discutir, aunque no lo tengan nada sencillo. Sobre todo porque el presidente de Estados Unidos, Donald Trump, anunció a principios del mes pasado su retirada del Acuerdo de París, poco menos que alegando que es una maniobra del resto para “aprovecharse" del país más poderoso del mundo.❚

Although the details of the Safe Third Country Agreement that Guatemala signed with the U.S. remain undefined, the U.S. has already begun to deport migrants from other countries to Guatemala. A Honduran man was the first to be sent to Guatemala from the U.S. in the middle of November. As of Dec. 3, it has been reported that two other Hondurans and one Salvadoran have been sent to Guatemala. According to sources close to trade talks, officials don’t expect planned U.S.-China tariffs to take full effect on Dec. 15, as planned. It is expected that China could prohibit import of some American goods with an “unreliable entity” list of American companies. Ahead of the deadline, China has exempted some U.S. soybean and pork products from tariffs usually imposed on U.S. imports. (EST) Conditions of Sheriff’s Sale for JUDICIAL/FORECLOSURE SALE Ten percent of the highest bid for each property auctioned off shall be deposited in certified check, attorney’s check or money order with the Sheriff by each bidder when his bid is registered, provided that in no case shall less than Six Hundred Dollars ($600.00) be deposited, otherwise upon failure or refusal to make such deposit, the bidder shall lose all benefit of his bid and the property may be offered again and sold unless a second bid has been registered, then, the second highest bidder will take the property at the highest bid price. Additionally, where there is active bidding, the highest bidder, and the second highest bidder, if any must post the entire amount of the cost of the distribution policy for the property at the time of sale by certified check, attorney’s check or money order with the Sheriff. The Sheriff reserves the right to reject any certified check, attorney’s check or money order that on its face has an expired use date and is presented for payment of the deposit. The balance of the purchase money must be deposited in certified check, attorney’s check or money order together with a Deed poll for execution by the highest bidder to the Sheriff at his office within 30 days from the time of the sale. An extension of time for an additional 30 days may be granted at the discretion of the Sheriff upon receipt of written request from the buyer requesting the same, except when a second bidder has been duly registered. Also, if the first bidder does not complete settlement with the Sheriff within the thirty (30) day time limit and a second bid was registered at the sale, the second bidder shall be granted the same thirty (30) day time limit to make settlement with the Sheriff on his second bid. Thereafter, the Sheriff shall be at liberty to return the writ to court. A second bid must be registered on any property immediately after it is sold. The second bidder must present the same amount of deposit that the highest bidder delivers to the Sheriff at the sale. An extension of time under no circumstances will be granted or honored by the Sheriff whenever a second bid is registered on a property at the sale. The first bid or opening bid on each property shall be set by the City of Philadelphia. In no event will the successful bidder be allowed to settle on the property unless all the Sheriff’s costs are paid notwithstanding the final bid. The deposit by any bidder who fails to comply with the above conditions of sale shall be forfeited and the funds will be applied to the Sheriff’s cost, then to any municipal claims that the City of Philadelphia has on the property. No personal checks, drafts or promises to pay will be accepted in lieu of certified checks, attorney’s checks or money orders made payable to the Sheriff of Philadelphia County.
