hree issues ago, at the conclusion of our Feb. 5 edition featuring a dive into Julían Castro’s run for president and its importance for the future of Latinos in politics and as a voice of power in this country, our editor-and-chief Hernán Guaracao asked this of 2020 and beyond: “Is this going to be, finally, the decade of Latinos?” But before we talk in decades, the focus should be squarely on 2020. Because if there’s anything we’ve learned while reporting the cover story this week, it’s that there’s still plenty of work to be done. Speaking of the cover story, the idea started with a phone call about three weeks ago. A reader and new resident to Philadelphia called us to ask if we knew any places she could volunteer to get Latinos to vote in the city.

ENGLISH We remiss to say that at that moment we couldn’t give her an answer, but we sure as hell were going to find out. After getting off the phone with our lost reader, we hopped into action calling every community organization we knew across the city to ask about their plan for engaging Latino voters. For most that got back to us, the answer was “yes”, but the details were often still fuzzy. Not only is there a presidential election in 2020 where Latinos can make a major impact, but it’s also a census year — where again, Latinos will make a major impact. That balancing act is tough, and many organizations are grouping the census and election together to get the word out for both. But at the very least, it’s a definite point of emphasis for all we talked to in 2020. Beyond Philly, there are many national organizations you’ll also read about this week engaging Latino voters across the country and presidential candidates (at least the ones that want to win) are making Latino voters a central part of their campaign strategies. Before the 2020s are the decade of Latinos, the year 2020 must be the year of Latinos. THE EDITOR

Pero antes de que hablemos en décadas, nuestro enfoque debería estar directamente en el 2020. Porque si hay algo que hemos aprendido al escribir la historia de la portada esta semana es que todavía hay mucho trabajo por hacer. Hablando de la historia de portada, la idea comenzó con una llamada telefónica hace unas tres semanas. Una lectora y nueva residente de Filadelfia nos llamó para preguntarnos si conocíamos algún lugar donde pudiera ofrecerse como voluntaria para que los latinos votaran en la ciudad.

he Latino vote will be decisive in the coming elections.” We have been hearing this for a long time now, but so far it hasn’t been more than wishful thinking. And without a doubt, Donald Trump --who has managed to make corruption mainstream-- will use every dirty trick in his lengthy and despicable repertoire to avoid a large Latino participation. In any case, it’s wise to be careful what you wish for, because a massive Latino turnout on election day may not guarantee the victory of the best (or the less bad) candidate. After all, 29% of (self-hating?) Latinos voted for Donald Trump in 2016, and he has much enthusiastic support among Florida and Texas Latino voters. Yet, what is real is that demographics support the idea that this time Hispanics can really become the ones elect-

ENGLISH ing the next president, whoever that may be. For the first time, there are more Latino than Black potential voters, emphasis on “potential” since the Latino community failure to show up at the ballot box is historic. More than half of the 27 million eligible Latino voters did not exercise their rights in 2016. It is encouraging that Latino support for Bernie Sanders keeps growing and becoming more solid, something that was tested in Nevada last Saturday for the first time. "We believe health care is a human right for all people," Sanders said at a rally two weeks ago, a message that resonated with Hispanic voters, especially the younger ones. "We are going to take on the greed of the insurance companies and the drug companies and we are going to pass a Medicare for All single-payer program." The fact is that according to a Pew Research Center poll of Democratic and Democratic-leaning voters last month, Sanders had the edge among Latinos nationally: 30% favored the Vermont Senator, 22% supported Biden, 11% backed Massachusetts Sen. Elizabeth Warren. All the other candidates were in low single digits. This, of course, is encouraging, but no one should rest on those laurels. Count on Trump to use every dirty trick in the book to disrupt Latino support for Sanders, who has been the favorite in ten polls at the time of writing this column. And do not dismiss the heavily pro-Trump Cuban-American vote in Florida, shameful as it is.

t was a virtual tie in Iowa between South Bend Mayor Pete Buttigieg and Vermont Senator Bernie Sanders. Despite Buttigieg claiming victory by a percentage point, both candidates took 11 delegates each to lead the pack of Democratic presidential hopefuls. The former South Bend mayor spent heavily in the fourth quarter heading into Iowa and looks to have taken a significant chunk of Vice President Joe Biden’s support in his path to the slimmest of victories in a caucus marred by errors. However, Sanders’ path to 11 delegates was likely aided by the 180 turn his campaign’s pulling off in its approach towards engaging voters of color. In 2016, Sanders’ message caught fire on the backs of a predominantly white, young and pro-

ENGLISH gressive audience, but he still polled well behind Hillary Clinton among black and Latino communities. For example, in Texas, where the electorate for the Democratic primary was majority Latino in 2016, Sanders polled behind Clinton in the community two to one, according to exit polls gathered by The New York Times. Latinos are expected to again make up the majority of the Texas Democratic electorate in 2020, and across the country, Latinos are estimated to constitute 32 million eligible voters to be the largest nonwhite minority voting bloc. And so far, Sanders’ campaign has put in the work to engage Latino voters. In addition to hiring more diverse campaign staff, he has also more openly discussed issues that strike the heart of Latino voters, including economic equality and racial justice. In Iowa, his campaign also made significant efforts to distribute its literature in Spanish to Spanish-speaking households in the state, and Sanders was also the only Democratic top-tier presidential candidate to appear at an October presidential town hall hosted by the League of United Latin American Citizens (LULAC).

According to an analysis done by The Hill’s Rafael Bernal, Sanders cleaned up the other candidates when it came to the Latino vote. In Iowa’s 12 Hispanic-majority caucuses, Sanders got more than 66% of the raw vote. The next highest percentage was Biden, with close to 11% of the vote. Of those 12 caucus sites, four were Spanish-speaking only, and
he won 428 votes there compared to 14 splits between the remaining candidates. Now, the 12 Hispanic-majority precincts sat in a sea of more than 1,700 sites in the state and across the country at various satellite locations, but the Latino population gets more numerous and meaningful in states like Texas and California. Both represent significant numbers of delegates and will be decided on Super Tuesday, on March 3. In New Hampshire, Latinos again represent a small percent-
age of the population like in Iowa, but they’ll play more of a role at the next caucus in Nevada — where the Latino population is just under 30%. Despite the lack of Latinos for him to connect within New Hampshire, Sanders was still the favorite in most polls thanks to his victory there in 2016. He was followed by Buttigieg and Sen. Amy Klobuchar, who just edges out Sen. Elizabeth Warren and Joe Biden for third. In the end, he had just enough to edge out Buttigieg, but like Iowa, still left with the same amount of delegates at nine. The only other candidate to win any delegates was third-place Klobuchar, who won six. Warren and Biden finished in a distant fourth and fifth, respectively, and entrepreneur Andrew Yang officially ended his campaign after a second poor showing in the Granite State.

espite the president’s best efforts to limit the influx of immigrants into the U.S., there’s still a budding population of newly-naturalized citizens that could swing the 2020 elections for or against him. According to a new report released on Feb. 5 by the National Partnership for New Americans (NPNA), 5.3 million newly-naturalized U.S. citizens will be eligible to vote in the 2020 elections. The report’s title, “Naturalize Now, Vote Tomorrow”, coincides with the launch of NPNA’s nationwide campaign encouraging newly-naturalized citizens across the country to get civically engaged. In the same vein as the report, the campaign will focus on getting newly-naturalized citizens to vote

ENGLISH and spawning voter registration drives targeting their various communities. According to estimates in the report, 2020 will see 860,000 more newly-naturalized citizens become eligible to vote. It also found that 3.1 million became eligible between 2016 — President Donald Trump’s election — and the end of 2019. Not only that, but where these newly-naturalized citizens settled is also a key point of emphasis. Of the roughly 11 swing states identified going into the 2020 election, seven appear in the top 15 in terms of eligible, newly-naturalized voters. They are (from most to least): Florida - 614,122, Texas - 493,023, Georgia - 130,075, Pennsylvania 128,672, North Carolina - 98,937, Arizona - 86,131, Michigan - 81,925. It is through these numbers that the report also concluded that the newly-naturalized voting bloc could have the power to sway the upcoming presidential, midterm and state elections. For perspective on the presidential race, in 2016, Hillary Clinton lost Arizona and Pennsylvania by less than 100,000 votes (less than 50,000 in PA), and Florida and Michigan by just over 100,000.

De los aproximadamente 11 estados indecisos identificados para las elecciones de 2020, siete aparecen entre los 15 primeros en términos de votantes elegibles y recién naturalizados. Son (de mayor a menor): Florida – 614.122, Texas – 493.023, Georgia – 130.075, Pennsylvania – 128.672, Carolina del Norte – 98.937, Arizona – 86.131, Michigan – 81.925. A
t a time when Jim Crow laws segregated and vilified Americans in the South, and when there were marches and sit-ins across the country, the civil rights struggle was in full force. While the African-American community fought for its civil rights, the Latino community did the same. Some Latino civil rights organizations emerged from the efforts of U.S. organizations, while others joined the African-American community in forming a coalition. Born to a Mexican father and an Irish mother in 1940, Maria Varela is a name that many people may not know, but she was very influential in documenting the struggle for civil rights of both African Americans and Latinos. Varela's first involvement in the social justice scene was as a member of the Young Christian Students (YCS) in high school and college. The organization traveled around the country urging Catholic students to support the Civil Rights Movement and the sit-ins, in which Varela became involved after her college graduation. In 1963 she met a recruiter from the Student Nonviolent Coordinating Committee (SNCC), where she would eventually FEBRUARY 26 - MARCH 4, 2020
ENGLISH work as an organizer, educator, writer, and photographer from 1963 to 1967. Founded in April 1960, SNCC was a locally based student organization dedicated to nonviolent direct action tactics to promote civil rights. Initially assigned to Selma, Alabama, and due to dissatisfaction with white middle class representations in most literary materials, Varela began creating training materials that reflected black lifestyles and experiences. After Dallas County Sheriff Jim Clark shut down Selma's program by arresting project staff, Varela moved to Mississippi in response to requests for training materials from SNCC. Through these materials, Varela showed the image of Black people as leaders of change in their segregated communities. One of the responsibilities of SNCC photographers was to record the protests in the hope that the presence of the cameras would reduce and limit police violence, or document it. In June 1966, Varela was assigned to cover the Meredith March Against Fear in Mississippi, a 19day demonstration led by civil rights activist James Meredith to promote black voter registration and challenge entrenched racism. The slogan of the march was "Black Power.” "The media implied that 'black power' was imposed on the southern rural movement by urban-raised black militants," Varela reflected. "Through the lens, I saw differently. Mirrored in the eyes of that youth was a strength and pride that had been freed from within," he added. Throughout the 1960s and 1970s, Varela documented events related to social justice such as the 1968 Poor People's Campaign, the first Chicano Youth Conference, and the Chicano movement. Now, at 80, her work has been included in several books and photo exhibitions presented in galleries and museums around the country.

uring the 2018 midterm, 27% of the Latinos who went to the polls were first-time voters and most were younger than 30 years old. Fast forward two years and one-in-ten Latino voters will be 18-23 years old. Added to the growing number of young Latinos now eligible to vote is the fact that more Latinos have become naturalized citizens, leading to the exponential increase of eligible Latino voters. In 2012, only 48% of Latinos were eligible to vote. In 2020, that percentage has jumped to 79%. The drastic increase in eligible voters can be linked to President Trump’s rhetoric on the Latino community during his presidential campaign. Sixty-two percent of all Latinx voters lean towards the Democratic Party, but according to the Pew Research Center, nearly two-thirds of millennial Latinos, who were aged 18 to 35 in 2016, said they supported Hillary Clinton in the last election not because they agree with her, but rather because it was “a vote against Donald Trump.” It’s a statement that was supported by 55% of the Latinx voters across all ages in 2016, and has prompted 52% of Latino voters to put “a lot of thought” on who they are going to elect in 2020. We can cite numbers all day about how the Latino population is present and has grown in areas of the country it had never been before, but what they mean is that Latinos will play a major role in who gets elected come November. The question remains, though, whether eligible Latino voters will register and cast their ballot on Election Day. Take the City of Brotherly Love, for example.

In Philadelphia, according to its 2018 primary election statistics, there are close to 70,000 registered Latino voters. That’s compared to a total population of a little more than 220,000, per July 2018 census estimates. A majority of the work to reach Philly’s Latino voters ahead of November 2020 falls to the many community organizations in contact with Latino communities throughout the city. When some were asked about their engagement plans, many efforts grouped the census and voter registration together for 2020. For example, long time nonprofit Congreso de Latinos Unidos has plans to host a joint census and voter registration event sometime in April to engage members of the community. According to Julia Rivera, director of external affairs at Con-

Early ideas involve a civic day to engage the student body almost 100% of which is Latino about their roles as U.S. citizens.

The majority of Philly’s Latinos are Puerto Rican, a deeply-rooted community which has only grown since more than 900 Puerto Ricans moved to Philadelphia in the aftermath of Hurricane Maria which hit the island in Sept. 2017. In Pennsylvania alone, 521,000 Latinx will be eligible to vote this year, which includes naturalized citizens. According to the U.S. Census Bureau, as of 2016, Puerto Ricans accounted for approximately half of the total Latino population in Pennsylvania, and the state was home to the fourth-highest Puerto Rican population in the country, numbering 444,263. The numbers show that engaging Puerto Rican voters in Philadelphia and Pennsylvania as a whole is a key aspect of the presence of the Latino vote in the upcoming elections. To that end, local grassroots organization Philly Boricuas has been working to engage Puerto Ricans in voting and pressuring elected officials to meet the demands and needs of Puerto Ricans both on and off the island. Though the group has recently focused more on earthquake relief efforts for Puerto Rico, since they had their first public meeting on Oct. 26 the group has pushed for local Puerto Ricans to exercise their vote.

But some say it’s an uphill battle to ensure Puerto Rican voter turnout.

THE BORICUA VOTE: A DECISIVE FACTOR NATIONWIDE
Since the Jones-Shafroth Act, in 1917, Puerto Ricans have been U.S citizens, and those living on the mainland are eligible to vote in the presidential election. The more than 3 million Puerto Ricans residing on the island are eligible to vote only during the primaries. In the last decade, the number of Puerto Ricans living in the mainland has increased dramatically, turning them into the fastest-growing Hispanic-origin group, with 9.5% Latinx identifying as Boricuas — a figure that grew after both Hurricane Irma and María hit the island later that year, forcing thousands of Puerto Ricans to evacuate to the U.S. Data from the Pew Research Center says that of the 6 million Puerto Ricans who make up the diaspora, based on 2013 statistics, more than half will be eligible to vote in the 2020 elections. It’s a telling statistic that could impact states like Florida where, according to the Puerto Rico Report, close to 1.3 million Boricuas live. If Puerto Rican nationals eligible to vote do so, the result could potentially alter the outcome of the swing state, where in 2016 Trump defeated Clinton by less than 113,000 votes.

But compared to other Hispanic groups in the Sunshine State, Puerto Ricans have a lower voter turnout, with one study finding that just 62% of the 180,000 Puerto Ricans surveyed voted in 2016. Groups like Vamos4PR are trying to counter low participation among Boricua voters on the mainland. The action organization does not participate in direct voter registration, but instead works with national organizations already focused on Latino voter registration — including VotoLatino, Power Latinx, Mi Familia Vota, and more — to provide the education that can spur eligible Puerto Rican voters to make informed decisions. “Our main goal is to really focus on voter education and engagement and we believe that that will lead to a substantial increase in voter participation,”

Los más de 3 millones de puertorriqueños que residen en la isla sólo tienen derecho de votar en las elecciones primarias. Durante la última década, el número de puertorriqueños que
vive en el continente estadounidense ha aumentado de forma dramática, convirtiéndolos en el grupo de origen hispano de crecimiento más rápido, con 9,5% de los latinos identificándose como boricuas —cifra que aumentó tanto después del huracán Irma como del huracán María que golpearon a la isla en 2017 y obligaron a miles de puertorriqueños a evacuar para dirigirse a los EE. UU. ENGLISH Javier Cuebas, executive director of Vamos4PR, told AL DÍA. The network, born out of labor unions in 2015, is focused on economic injustice, and looks specifically at issues faced by Puerto Rico in the aftermath of Hurricane Maria and the recent earthquakes, as well as what Cuebas calls the “man-made” disaster of the restructuring of Puerto Rico’s debt. The organization worked in Florida and Wisconsin during the 2018 midterm elections, and is now looking to make a difference in the Keystone State by educating and engaging PA Puerto Rican voters. According to Cuebas, this demographic can be divided into two groups: “low-propensity voters”, Puerto Ricans who have lived in cities like Reading, Allentown, and in the Lehigh Valley Area for three or more generations but have not been politically engaged; and “new arrivals,” or Puerto Ricans who recently moved to the mainland in the aftermath of Hurricane Maria. Approximately 2,000 Puerto Rican families moved to Pennsylvania after Hurricane Maria, making it the state with the second-highest number of Puerto Ricans displaced by the natural disaster. Cuebas believes that the more that the Puerto Rican community understands the power of their numbers both locally and nationally, the better. “Once people realize the power they have in numbers, they get that extra level of motivation,” he said. Cuebas acknowledged that it’s been “a very hard two years for Puerto Rico.” Though some Puerto Ricans Vamos4PR speaks with might feel disenchanted with the political process, Cuebas said that the goal is that voters walk away from their conversation saying, “‘Ok, my vote is going to matter.” The end goal is not only that eligible Puerto Rican voters come to the polls, but also that they stay engaged politically and hold officials accountable to their promises after elections. “Once people understand the connection between them voting and being able to prevent some of the challenges that they have gone through, it makes a big difference,” Cuebas said. As a multilingual gastroenterologist, Che — fluent in Vietnamese and Spanish — focuses on ensuring people from all communities, especially Vietnamese and Latino communities, know about risk factors and prevention methods for colorectal cancer, and get access to screenings. Here are five facts about colorectal cancer prevention and screenings that Dr. Che shared with AL DÍA in a recent conversation.
COLORECTAL CANCER SCREENINGS DON’T JUST PROVIDE EARLY DETECTION OF CANCER — THEY CAN ACTUALLY PREVENT CANCER FROM DEVELOPING.
“We go in and do a colonoscopy, and we’re looking for something called polyps, which are abnormal growths that can grow over time and become a colon cancer. And at that time of the colonoscopy, you can take that out and prevent colon cancer at that moment. There’s no other type of cancer that’s possible,” Che says.

ENGLISH a colonoscopy to prevent colon cancer because that’s the number one risk factor for it,” Che says. She recommends getting a colonoscopy once every ten years once you turn 50. If you have a family history of colon cancer, then you might want to start getting screenings at an even younger age. If you are found to have pre-cancerous polyps, then your doctor might recommend that following their removal you have more frequent screenings, every 3 to 5 years.
A COLONOSCOPY SHOULD NOT BE PAINFUL. “Patients are asleep for the procedure, and often they wake up and they say, ‘Doctor, that was it?’, or they didn’t even realize the procedure was done already because they were asleep,” Che says. She recommends speaking with your primary care physician about your fears or reservations about the procedure.
TALK TO YOUR PHYSICIAN — AND, IF YOU CAN, FIND A PROVIDER WHO CAN SPEAK TO YOU IN THE LANGUAGE YOU FEEL MOST COMFORTABLE SPEAKING. Che speaks both Vietnamese and Spanish, in addition to English, and says that as a doctor, she can see how important it is for patients to be able to talk to their doctor in their native language, if possible. “When it comes to something as personal as having a colonoscopy...explaining that in their own language provides such a comfort level,” Che says. She notes that Spanish-speaking patients will feel especially comfortable where she works at Temple Health’s Northeastern campus, as nearly all of the staff speaks Spanish.

In addition to in-person conversations with your doctor, Che says anyone can find great information online about your gastroenterological health. Recomienda que se haga una colonoscopia una vez cada diez años, al cumplir los 50 años. Si tiene un historial familiar de cáncer de colon, entonces podría empezar a hacerse las pruebas de detección a una edad aún más temprana. Si se descubre que tiene pólipos precancerosos, su médico podría recomendarle que después de su extirpación se haga revisiones más frecuentes, cada 3 a 5 años.

Recomienda que hable con su médico de cabecera sobre sus temores o reservas acerca del procedimiento.
"Cuando se trata de algo tan personal como hacerse una colonoscopia... explicar eso en el propio idioma proporciona un nivel de comodidad enorme", dice Che. As our country has grown, so has its diversity, with more people speaking languages other than English and immigrants bringing their languages with them to the United States. This diversity of languages means that many residents in the country may speak another language, such as Spanish, as their first language. The U.S. Census Bureau is looking to hire up to 500,000 temporary workers for the 2020 Census. In order to make sure that everyone is counted, the U.S. Census Bureau is highly encouraging bilingual applicants. Why are bilingual applicants valuable? Having people who are bilingual help conduct the census ensures that it will be conducted accurately.

ENGLISH Census takers make an important impact in their community because they go door-to-door collecting responses from households who have not yet responded online, by mail or by phone. They have to gain residents’ trust, and they can do so by talking in a language that is comfortable for residents. Additionally, they ensure the census is properly conducted by interviewing residents in their preferred language. So if you are a bilingual applicant, what do you need to know? First, the U.S. Census Bureau requires that all applicants in the 50 States and in Washington D.C. be able to speak, read, and write in English. For applicants living in Puerto Rico, census takers are required to speak Spanish, but they do not have to speak English. However, other positions require that applicants be able to speak in both English and Spanish.
Additionally, the application for the 2020 Census is only in English in the U.S. However, in Puerto Rico, the application is in Spanish. As part of the application process, there are assessment questions which ask applicants about their education, work and other experience they have that relates to positive job performance. The assessment questions can be completed in English or in Spanish. However, if an applicant chooses to answer the questions in Spanish, they will be asked to take an English proficiency test. This is to help the Bureau determine how well applicants can read and comprehend English. For applicants in Puerto Rico, they must take the English proficiency test if they are interested in positions other than census takers.

Para los solicitantes en Puerto Rico, necesitan tomar la prueba de dominio de inglés, si les interesa conseguir otro puesto diferente al de censista.

As Tesla and SpaceX founder Elon Musk prepares to colonize Mars by 2050, other companies are also looking for ways to have a "stratospheric" presence by bringing their advertising light-years away from Earth. It's something that, according to Mexicans Carlos Mariscal and César Serrano, founders of Dereum Labs, will be necessary in the not-too-distant future, since the economy will be interplanetary. In

Some claim that man's 1969 moon landing was filmed in a studio, often citing the waving American flag in space as evidence of a farce, even though the conspiracy was later debunked. These same skeptics would be shocked to know that the next thing to wave on the moon will be the logo, colors, and typography of a brand. Although we still don't know what brand it will be, it's positive
Dereum Labs will display its logo on its Jaguar-1 mission, which will transport a space exploration vehicle to establish a base on the Moon's surface and whose design can be altered according to the needs of the sponsor. This mission, which they define as "the first commercial flight to the moon," is just the first phase of a much larger project to transport a robot and telecommunications infrastructure to the Moon by 2035 and begin delivering products and services from there. As NASA proposes its Artemis, the Moon would be-
come a "pilot" colony for an even bigger landing, which would take place on Mars by 2055. "The companies that invest can adapt the cargo (that they want to take to the Moon) so that it has an iconic shape for their company; that is, a can, a shoe or a messenger box," Mariscal explained to Xataka. Space advertising is nothing new. In 2012, Red Bull sponsored the first stratospheric jump, and a few months ago, Pepsi announced its collaboration with the Russian company StarRocket to orbit small advertising satellites with its logo. It seems like even the stars of the future will be clouded with annoying pop-up ads of companies. If aliens do exist, will they end up as tired of advertising interruptions and invasive ads as we are?

Los conspiranoicos que afirman que la llegada del hombre a la Luna en 1969 se rodó en un estudio de cine, a menudo utilizan como prueba que la bandera estadounidense ondea en las imágenes aunque en el satélite no haya viento. Estos mismos escépticos de la historia se quedarían de piedra al saber que lo próximo que ondeará en el satélite será el logotipo, los colores y la tipografía de una marca. ¿Cuál? Todavía se desconoce, pero la llevará Dereum Labs en su misión Jaguar-1, con la que trasladará un vehículo de exploración espacial que permita establecer una base en la superficie lunar y cuyo diseño podrá alterarse en función de las necesidades del patrocinador. Esta misión, que definen como “el primer lanzamiento comercial a la Luna”, es tan sólo la primera etapa de un proyecto mucho más amplio para transportar una infraestructura de robots y telecomunicaciones al satélite para 2035 y comenzar a ofrecer productos y servicios desde allí. rown v. Board of Education (1954), which held that the racial segregation of schools was unconstitutional, is known as the landmark case for civil rights in public education. Not as well known, though, is the trial that came nearly a decade prior to that decision, which set the stage for the case that would definitively prohibit racial segregation in public education. The Mendez v. Westminster trial was the first court case in the U.S. to hold that school segregation is unconstitutional and violates the 14th Amendment. In 1943, the Mendez family moved to Westminster, a small town outside of Los Angeles, California. When the Mendez children tried to enroll at the 17th Street Elementary School, they were turned down due to their race. However, their cousins were enrolled in the school with no issue, due to their lighter skin complexion and surname, Vidaurri. During this time period, Mexican-Americans were considered “white” and primarily went to segregated white schools. The Mendez family had previously gone to white schools without mishaps, until moving to Westminster, when they were told to go to “Mexican school” farther away from their home. As a result, Mendez family patriarch Gonzalo Mendez, with the support of the League of United Latin American Citizens (LULAC) and four other Mexican-American families, filed a class-action federal lawsuit against Westminster and other segregated schools in Orange County, insisting that not only his children but all Mexican-American students have access to an equal, quality education.

Mendez hired Los Angeles civil rights attorney David Marcus, who was the first attorney to put forth the argument that segregating K-12 students based on race, nationality or ethnic background violated the 14th Amendment of the Constitution. Marcus also introduced evidence that segregating students based on their ethnicity was harmful, as it could hinder the students’ ability to learn English, and also presented a level of inferiority. Joel Ogle, the attorney for Orange County, defended the school district on the basis that the federal courts had no authority to decide K-12 education cases, due to it being a state matter. He also argued that “Mexican schools” were necessary for helping students who weren’t fluent in English or familiar with American values and customs, making them equal to “white schools.” On Feb. 18, 1946, Judge Paul J. McCormick ruled in favor of the Mexican-American parents. In his decision, he dismissed Ogle’s claim that federal courts had no jurisdiction in state education cases. He noted that segregating students for as long as eight grades would make it more difficult to learn English, and that school districts had typically assigned children with Spanish surnames to segregated schools regardless of their ability to speak English. Judge McCormick argued that these sweeping efforts to segregate Mexican-American students violated the “equal protection” rights of Mexican-American citizens. In response, the Orange County school districts appealed Judge McCormick’s decision to the U.S. Ninth Court of Appeals in San Francisco. On April 14, 1947, the federal court judges ruled 7-0 to uphold Judge McCormick’s decision. It was this case that opened the doors towards civil rights in public education across the United States.
