First of all, Let us give our praise the almighty God for all his blessings have given us safety, health, peace, and gave us the opportunity to tell all of you a brief program and product of Academic Affairs ALSA LC UNAIR. The Asian Law Students Association is an internationalnon-political association and non- profit association for all law students in Asia. ALSA international comprises 17 national chapters and one of them is ALSA National Chapter Indonesia. ALSA National Chapter Indonesia comprises 14 local chapters which are in universities in Indonesia, one of them is the ALSA Local Chapter Universitas Airlangga, which continues to be a place for progress, quality development, and learning for law student in Indonesia and Asia. ALSA LC UNAIR is not only an association for students, but also as a home for all members, as a place to add relationships and as a place of learning, that could have a great impact on individuals and people around through the activities organized by ALSA LC UNAIR. Public Discussion ALSA LC UNAIR Public Discussion is an innovation work program from Academic Development Division in the form of discussions between students of Faculty of Law, Universitas Airlangga, especially members of ALSA LC UNAIR, the public or the community with the Head of the Legal Aid Foundation (YLBHI) Mrs. Asfinawati, S.H and Lecturers of Criminal Law FH UNAIR Mrs. Amira Paripurna, SH, LL.M., Ph.D. And guided by a Moderator who is a lecturer in Constitutional Law FH UNAIR Mrs. Dwi Rahayu Kristianti, S.H., M.A. The topic of the issues discussed in the discussion were "The Culture of Violence and the Urgency of Ratification of the PKS Bill (Human Rights and Criminal Law Review). The discussions aim is to add insight into the field of law related to the issues being discussed from various perspectives.

Study Club Study Club is an ALSA LC UNAIR work program organized by an Academic Development Division in collaboration with other BEM and BSO at FH UNAIR as a forum for members to prepare themselves for exams. The study club is also taught directly by members of Academic Divison which was held in building B FH UNAIR. This activity is usually carried out a week before the exam takes place.

Seminar and Workshop ALSA LC UNAIR 2019 Seminar ALSA LC UNAIR 2019 was a working program of Academic Development Division ALSA LC UNAIR year of administration 2018/2019, which determined based on The Result of The Local Forum (Musyawarah Lokal) XXV of ALSA LC UNAIR. Therefore, Seminar and Workshop ALSA LC UNAIR 2019 became a working program which must be held once in one period of the management. Generally, Seminar ALSA LC UNAIR comes to develop the function of legal scientific learning and to add the new insights about legal issues especially for ALSA LC UNAIR’s members. Another purpose is as a form of implementation about “4 Pillars of ALSA” especially on the “Academically Committed and Legally Skilled” pillars. In 2019, Seminar ALSA LC UNAIR came with additional activity in the form of “Workshop”. Therefore, there was a changed in the nomenclature of this working program to be “Seminar and Workshop ALSA LC UNAIR 2019”. Seminar and Workshop ALSA LC UNAIR 2019 has a general title that was “The Capital Market and Its Developments”. Both seminar session and workshop session have their own titles. The seminar session has a title “The Challenges of Consumer Protection in Capital Market Disputes” and the workshop session has a title “Margin Trading and Disputes Resolution through Arbitration by Indonesian Capital Market Arbitration Board (BAPMI)”.

Seminar and Workshop ALSA LC UNAIR 2019 was held on September 12, 2019 in Hall 303 Building A Faculty of Law Universitas Airlangga, which was divided into 2 sessions. The first session conducted seminar and the second session conducted workshop. In these events, presented 4 speakers who have various professional backgrounds. The 3 speakers for the seminar session were Mrs. Mas Rahmah (Capital Market Lecturer at Faculty of Law UNAIR); Mr. Rudi Saleh Susetyo (Head of The Consumer Protection Department of the Central Financial Services Authority/OJK); and Mr. Deddy Herlambang (Head of the Capital Market Supervision Section of the Regional IV Financial Services Authority/OJK, East Java). The 1 speaker, who guided the workshop session was Mr. Tri Legono Yanuarachmadi (Executive Director of Indonesian Capital Market Arbitration Board/BAPMI). Also, Mr. Agung Sujatmiko (Capital Market Lecturer at Faculty of Law UNAIR) as the moderator at the seminar session.

ALSA Courtlike Debate Championship (ACDC)

ALSA Courtlike Debate Championship or ACDC is an annual event held by ALSA LC UNAIR under the English Development Division in an effort to introduce law studies to high school students. ACDC uses a joined concept of Asian parliamentary debate and moot court and aims to develop and enhance high school students’ analytic, linguistic, logical thinking capabilities, and further encourage their self-confidence by using today's method of debate competition. Each team consisted of two students. This year’s ACDC XI focused on the topic of environmental law and was held in three days starting from January 31 2020 to February 2 2020. Participants from across Java attended the opening ceremony and technical meeting on the first day, followed by elimination round held on the second day. On third day, four teams with the highest points compete for the final round and teams who didn’t proceed to the final round compete in “ACDC Race”, a fun rally games competition that encourages participants to visit various landmarks in Surabaya. It was then followed by the closing ceremony and the announcement of winners of the competition. ACDC XI 2020 was won by SMAN 5 Surabaya, followed by SMAN 1 Bojonegoro in second place and SMA Islam PB Soedirman in third place.

INMOOT.

Internal Moot Court is a collaboration project between ALSA and KPS (Komunitas Peradilan Semu), it is a competition for the freshman of law students. The purpose of this competition is to introduce the world of moot court in their early stage of college and help them with the basic skills. Like how to solve

cases,

correctly

reading

the

norms

and

applying it in a form of documents. As in the other side, the fun part is that you get the chance to wear those cool court robes like real judges, lawyers or prosecutors. Usually held at the end of the year just right after a few months of the first semester, for this year of 2020 it will be held in December due to the current pandemic. The participants will be divided in groups with at least a mentor for each group that is in charge to assist and guide them all the way from the first day of practice until the competition has officially closed.

When there is a competition, there is a winner. Just the same as the national version, in Internal Moot Court Competition there is a title for the best judges, advocates, or prosecutors even for the best documents, mentor and the best shout out groups. We hope this competition could make a great impact for those who participated to learn more legal skills, also build their interest and find their passion in moot court so maybe somewhere in the future there is a possibility for them joining the National Moot Court Competition as the delegates.

AIMCC. For the international event we have ALSA International Moot Court Competition or known as AIMCC, an annual Moot Court Competition under the theme of International Investment Arbitration. Last year this competition was organized in Bangkok, Thailand. In 2020 unfortunately, due to the outbreak of Covid-19 the event got cancelled. It's supposed to be held in Vietnam this time around. However, it substituted with another competition that is FDI Moot. FDI Moot is an abbreviation for Foreign Direct Investment International Arbitration Moot. It was initiated in 2006 by The Center for International Legal Studies (CILS), Suffolk University Boston, Pepperdine University, DIS, and King’s College London. The competition itself focuses on investor-state disputes, participated by universities all over the world. For this year, the case is on environmental disputes. Originally it was scheduled to be held in Seoul, South Korea. But due to the pandemic situation that makes offline activity almost impossible, it will be held online starting from 1st June 2020 until 15th October 2020. This competition has a different approach in solving and presenting their result of the cases because of the system they are using is arbitration. It required a lot of research and ability to make an argument that based on the side the participants choose in the case. Thus, who wants to have international competition experience this will be a great opportunity to gain experiences as well as study or improve some skills such as speech skills, research skills, language skills, etc. Those abilities are definitely useful for law students to have, especially the one who wants to be a lawyer.

MOOTCOURT CLASS. Our new Project this year is Moot Court Class. Moot Court Class’ purpose is to be a new platform to learn more details about criminal law from the point of view of the professionals. From there we hope members of ALSA LC UNAIR would be benefited by knowing how to implement their knowledge into a form of real legal documents and updated about today’s law issues in court. In this class, members of ALSA LC UNAIR get the chance to learn about criminal law directly from the professionals like judges, lawyers, prosecutors, etc. The first Moot Court Class was successfully held on 20th April 2020 with 46 participants discussing step by step regarding charges and pleadings from alumnus of ALSA LC UNAIR that currently working as a lawyer, Mr. Leonardus S. Sagala, S.H., M.H. and Prosecutor Ms. Nurma Rosyida, S.H.. The participants are allowed to ask their own questions to the speakers in the Q&A session. This new project can hopefully bring out good results in helping law students of University of Airlangga become a student that has extensive knowledge on the criminal law section.

KEDAULATAN NEGARA ATAS WILAYAH LAUT DALAM RANGKA PENYELESAIAN SENGKETA PENCEMARAN LAUT SECARA MEDIASI.

Pengaturan secara internasional tentang kedaulatan negara di laut baru di mulai pada konferensi Kodifikasi Hukum Internasional oleh Liga Bangsa-Bangsa (LBB) pada tahun 1930 yang membicarakan tentang nationality, laut teritorial dan tanggung jawab negara. Pada saat itu sudah di capai kesepakatan bahwa suatu negara mempunyai kedaulatan terhadap laut yang ada di dekat wilayah daratannya yaitu laut teritorial. Pencemaran laut menurut PP No. 19 Tahun 1999 tentang Pengendalian Pencemaran dan/atau Perusakan Laut mempunyai pengertian atau definisi sebagai masuknya atau dimasukkannya makhluk hidup, zat, energi, dan/atau komponen lain ke dalam lingkungan laut oleh kegiatan manusia sehingga kualitasnya turun sampai tingkat tertentu yang menyebabkan lingkungan laut tidak sesuai lagi dengan baku mutu dan/atau fungsinya. Konvensi hukum laut 1982 meminta agar setiap negara untuk melakukan upaya-upaya untuk mencegah, menanggulangi dan mengendalikan pencemaran lingkungan laut dari setiap sumber pencemaran seperti pencemaran dari pembuangan limbah berbahaya dan beracun serta berasal dari sumber dataran, dumping, dari kapal, dari instansi eksplorasi dan eksploitasi. Dalam kegiatan tersebut, setiap negara harus melakukan kerjasama baik kerjasama regional maupun global yang diatur sesuai dalam pasal 197 – 201 Konvensi Hukum Laut Internasional 1982.

Setiap masalah internasional bisa di selesaikan dengan cara mediasi yang tentunya baik bagi kedua negara, menyelesaikan permasalahan dengan damai. Mediasi merupakan suatu cara penyelesaian sengketa dalam hukum internasional dengan melibatkan pihak ketuga, yaitu suatu negara yang netral dan independen sehingga dapat memberikan saran yang tidak memihak salah satu negara pihak sengketa. Pihak ketiga memberikan saran kepada kedua belah pihak yang tengah bersengketa untuk melakukan negosisasi ulang, dan perlu di ketahui bahwa mediasi merupakan tingkat lanjut penyelesaian sengketa hukum internasuonal setelah negosiasi.


TERMINOLOGI KLASIK : Constitutio, Politeia, dan Nomoi. Konstitusi sangat berkaitan erat dengan istilah politeia dalam perkataan Yunani Kuno dan constitution dalam bahasa Latin. Kedua perkataan tersebut yang menjadi awal mula gagasan konstitutionalisme. Pada zaman Yunani Kuno, pengertian konstitusi bersifat materiil. Namun, perbedaan antara konstitusi dan hukum biasa dapat dilihat dari pembedaan oleh Aristoteles terhadap pengertian politeia yang dapat disepadankan dengan istilah konstitusi dan nomoi

Kedua, konstitusi dalam arti jus publicum regni, yaitu the public law of the realm. Di samping itu, Cicero berpendapat bahwa konstitusi republik bukanlah hasil kerja satu waktu ataupun satu orang, melainkan kerja kolektif dan akumulatif. Dengan demikian, jika dilihat dari sudut etimologi, konstitusi dan konstitusionalisme dapat ditelusuri pada perkembangan pengertian dan penggunaan istilah politeia dalam bahasa Yunani dan constitution dalam bahasa Latin, serta hubungan di antara keduanya di sepanjang sejarah pemikiran maupun pengalaman praktik kehidupan kenegaraan dan hukum. Dengan demikian, konstitusi dianggap “mendahului” dan “mengatasi”

Pemberi Bantuan Hukum (PBH) Sebagai Wujud Konstitusionalisme. Negara Kesatuan Republik Indonesia ialah negara hukum (rechtstaat) bukan negara kekuasaan (machstaat), hal ini termaktub dalam pasal 1 ayat (3) konstitusi RI yaitu UUD NRI 1945. Konsep dari Indonesia sebagai negara hukum dituangkan dalam dasar negara yang bermuatkan asas legalitas, perlindungan hak asasi manusia (HAM), pembagian kekuasaan, dan tanggung jawab negara. Salah satu wujud konstitusionalisme dapat dilihat melalui sisi pelaksanaan secara nyata tanggung jawab negara dan perlindungan hak asasi manusia. Contohnya dengan adanya fasilitas atau organ yang bergerak dalam bidang bantuan hukum. Bidang bantuan hukum ini menjadi penting sebab setiap warga negara Indonesia berhak untuk mendapatkan akses sebaik-baiknya terhadap bantuan hukum. Namun pada praktiknya tidak semua orang mampu membayar jasa ahli hukum. Maka dari itu pemerintah berdasarkan amanat Pasal 27 ayat (1) dan Pasal 28D ayat (1) UUD NRI tahun 1945 mengimplementasikannya

memberikan

bantuan

melalui organisasi terakreditasi yang tersebar diseluruh Indonesia yang disebut Pemberi Bantuan Hukum (PBH). Eksistensi PBH diatur melalui UU No.16 Tahun 2011 tentang Bantuan Hukum. Sedangkan hak atas bantuan hukum sendiri telah tertuang dalam Kovenan Internasional tentang Hak-Hak Sipil dan Politik yang telah diratifikasi Indonesia lewat UU No.12 tahun 2005. Bantuan hukum cuma-cuma terhadap warga miskin juga disebutkan dalam Pasal 22 UU No.18 tahun 2003 tentang Advokat. Kegiatan PBH di lapangan dilakukan oleh mereka yang disebut Paralegal

berjalan

dengan

sumber

dana

APBN.

Mekanismenya, PBH membantu warga miskin menghadapi masalah hukum mereka, dan biaya yang dikeluarkan PBH ditagih ke Badan Pembinaan Hukum Nasional. Berdasarkan SK Kementrian Hukum dan HAM, hingga kini terdapat 524 PBH yang dinyatakan lolos verifikasi dan akreditasi untuk memberikan bantuan hukum terhitung periode 2019-2021. Evaluasi atas verifikasi dan akreditasi itu dilakukan setiap tiga tahun. Terdapat tiga kategori PBH berdasarkan kriteria yang dibuat oleh Kementerian Hukum dan HAM, yang terbaik adalah kategori A, kemudian kategori B, dan kategori C.

PENGALIHAN HAK CIPTA (ASSIGNMENT) DALAM PENGEKSPLOITASIAN HAK KEKAYAAN INTELEKTUAL

Pengalihan hak cipta (assignment) merupakan salah satu bentuk dari pengeksploitasian Hak Kekayaan Intelektual, pengalihan tersebut dalam bentuk hak ekonomi, yang telah diatur dalam Pasal 16 Ayat (2) Undang-Undang Republik Indonesia Nomor 28 Tahun 2014. Berdasarkan penjelasan dari Pasal 16 Ayat (2) Undang-Undang Republik Indonesia Nomor 28 Tahun 2014, suatu pengalihan hak cipta harus dilakukan secara jelas dan tertulis, baik dengan atau tanpa akta notaris. Berikut macam-macam pengalihan dari hak cipta : a) Pewarisan Adanya pembatasan ini dilakukan agar ahli waris tidak menggunakan haknya secara sewenang-wenang. Dan apabila seluruh keluarga dari pewaris telah tiada maka harta peninggalan akan menjadi milik negara. b) Hibah Berdasarkan Kompilasi Hukum Islam, hibah adalah pemberian suatu benda secara sukarela dan tanpa imbalan dari seseorang kepada orang lain yang masih hidup untuk dimiliki. c) Wakaf Berdasarkan Kompilasi Hukum Islam , wakaf adalah perbuatan hukum seseorang atau kelompok orang atau badan hukum yang memisahkan sebagian dari benda miliknya dan melembagakannya untuk selama-lamanya guna kepentingan ibadat atau keperluan umum lainnya sesuai dengan ajaran Islam. d) Wasiat Berdasarkan Kompilasi Hukum Islam, wasiat adalah pemberian suatu benda dari pewaris kepada orang lain atau lembaga yang akan berlaku setelah pewaris meninggal dunia. e) Perjanjian Tertulis Adanya kesepakatan para pihak sebelum melakukan pengalihan suatu hak cipta. f) Sebab Lain yang Dibenarkan Sesuai Dengan Ketentuan Perundang-Udangan Yakni, pengalihan yang disebabkan oleh putusan pengadilan yang telah memperoleh kekuatan hukum tetap, merger, akuisisi, atau pembubaran perusahaan atau badan hukum dimana terjadi penggabungan atau pemisahan aset perusahaan.

Penerapan NonConviction Based Aset Forfeiture Dalam TPPU Di Indonesia

Pencucian Uang adalah istilah yang digunakan dalam menjelaskan aktivitas, dalam hal menguraikan atau memindahkan asal usul yang tidak sah menjadi seolah olah sah, sehingga sumber asalnya tidak dapat diusut ataupun dideteksi. Konsep Non-Conviction Based Aset Forfeiture, pada hakikatnya merupakan tindakan merampas aset pelaku kejahatan tanpa adanya proses hukum terlebih dahulu. Perampasan melalui jalur perdata ini dipilih, karena perampasan pidana yang sudah ada harus dikaitkan dengan kesalahan terdakwa. Dalam artian, aset tersebut harus terbukti sebagai hasil dari tindak pidana, baru negara dapat mengambil tindak seperti melakukan perampasan terhadap aset tersebut.

Diterapkannya prinsip NCB (NonConviction Based) dalam konsep perampasan aset TPPU di Indonesia hadir sebagai inovasi yang diperkenalkan oleh World Bank melalui United Nations Convenant Againts Corruption (UNCAC) tahun 2003 untuk mengatasi berkembangnya kejahatan pencucian uang yang semakin beragam modusnya. Penerapan prinsip NCB dalam konsep Aset Recovery dalam TPPU di Indonesia dalam penerapannya menemui hambatan cukup besar, yaitu: 1. Peraturan perundang-undangan yang berlaku saat ini masih memiliki keterbatasan dalam upaya pendeteksian TPPU, dan 2. Masih terdapat beragam penafsiran atas beberapa rumusan norma dalam peraturan perundang-undangan mengenai TPPU yang berlaku saat ini. Solusi utama dalam permasalahan ini yaitu segara dilakukannya pengesahan RUU Perampasan Aset Tindak Pidana dimana telah menjadi PROLEGNAS 20152019, sebagai keabsahan dan kepastian hukum atas perampasan aset dengan prinsip NCB dalam TPPU di Indonesia. Lalu, pentingnya kebutuhan untuk merekonstruksi sistem hukum pidana di Indonesia dengan mengatur mengenai penyitaan dan perampasan hasil dan instrumen tindak pidana di dalam suatu undang-undang. Pengaturan tersebut selain harus komprehensif juga harus diintegrasi dengan pengaturan lain agar undang-undang yang akan disusun bisa dilaksanakan secara efektif dan mampu memberikan kepastian hukum serta jaminan perlindungan hukum kepada masyarakat.


A Way to Prevent Sexual Harassment in Universities.

It is such a pity when sexual harassment occurs in universities in Indonesia. Instead of the campus, as the facilitator and mediator between the communities, following up on the cases immediately, the cases has been spread on social media first and it becomes public consumption. Based on Komnas Perempuan’s 2020 annual record, there are 24% (3602 cases) sexual harassment occurred throughout 2019.[1] This indicates that sexual harassment happens everywhere, universities should not wait for a victim before taking action, they should have had specific rules related to acts of sexual harassment against women within the scope of their institution, thus, if an act of sexual harassment occurred in universities, it can be handled according to the procedure applied and does not lead to alleviating the problems for the sake of maintaining the good reputation of the universities, since it will create new complexities in the future (such as the spread of the sexual harassment cases through social media).

One preventive effort to be developed by society and the government, through the rapid development of social media is by creating an educational based platform related to sexual harassment and violence. In this regard, the newly released platform on February 21, 2020, namely Hasanuddin University Anti – Sexual Harassment Committee, is one of the examples as a result of the student's initiative from various faculties, to become an independent committee working on the issue of the occurred sexual harassment, to educate, to provide advocacy and counseling for the entire civitas academica. It will certainly be an effective way for Indonesia to prevent sexual harassment in universities, if it can be improved with more innovations to educate society about sexual harassment by utilizing social media.

A phenomena of sexual harassment especially around campus area supposed to be a priority discussion, in the face of verbal and non-verbal abuse from college friend and even from lecturer. It’s unfortunate that the case was abandoned because there was no mechanism in campus that didn’t want to get their good named tarnished, even the stigma silent means yes to the victim without regard for the approval of the victim. Top priority Bill Draft on the Elimination of Sexual Violence passed. In the future cases of sexual assault can be solved with a clear legal umbrella.

Under Article 1 Numbers 1 of the Bill Draft on the Elimination of Sexual Violence, defined clear definition of sexual harassment, so there is no illdefined of sexual harassment itself. Then, under article 4 of the Bill Draft on the Elimination of Sexual Violence there are prevention, handling, protection for handling of victims and sexual harasser. Bill Draft on the Elimination of Sexual Violence could be an affirmation of a legal gap to the protection of the victim. So affirmation, correcting the criminal ordinance or justice system that has been affront to the victim. For humanity’s dignity especially for victims of sexual harassment around the campus.
