WORDS FROM OUR PRESIDENT Juan Pablo Carrasco de Groote President En la edición de la Revista Business in Action de marzo se destacan varios temas de interés para el sector empresarial, pero en esta quiero resaltar uno de los eventos que realizamos que fue el “Premio de Contribución a la Comunidad”.

Dicho galardón reconoce desde hace 13 años las empresas sociales que implementan programas de beneficio social y brinda apoyo en el desarrollo de distintas áreas de las comunidades del país.

In the edition of Business in Action Magazine in March, several issues of interest to the business sector are highlighted, but in this edition I want to highlight one of the events we carried out that was named the “Contribution to the Community Award”. El comercio internacional es una plataforma cambiante, y con cada cambio de reglas, surgen nuevos ganadores y perdedores en diferentes industrias y regiones en el mundo.

Con la cancelación del Acuerdo Transpacífico de Cooperación Económica (conocido como TPP por sus siglas en inglés), por parte de la administración del presidente Donald Trump, se ha dado un cambio importante que beneficiará en corto plazo, a varios productos de Guatemala.

El TPP sugería otorgar beneficios de entrada con cero arancel a Estados Unidos; compitiendo directamente con Guatemala en algunas industrias, lo cual se proyectaba como un cambio negativo al comercio entre Guatemala y su socio del norte.

El mercado de Estados Unidos representa el principal socio comercial de Guatemala, al exportar US$3,465.3 millones en el año 2016, según el Banco de Guatemala, el cual ha crecido significativamente los últimos 10 años por los beneficios comerciales recibidos en el DR-CAFTA. El sector de vestuario y textil de Guatemala es el mayor sector exportador a este país y un modelo a seguir por otras industrias, al exportar US$1,394.00 millones de dólares en prendas de vestir y textiles según OTEXA (Office of Textiles & Apparel). Con la cancelación del TPP, se espera que la relación comercial con Estados Unidos se solidifique aún más, ya que varios importadores que estaban analizando la posibilidad en colocar producción en Vietnam por los beneficios que ofrecía este tratado, están renovando su interés en la región centroamericana, y en Guatemala

en especial; al tener una cadena de abastecimiento integrada, que permite tener una industria flexible, productiva y de alto valor agregado.

The TPP and its impact on the Clothing and Textile Industry International trading is a changing platform, and with every change of rules, there are both winners and losers within all industries and regions of the world.

With President Trump withdrawing the US from the Trans-Pacific Partnership (Also known as TPP), this has been a significant change that will benefit Guatemala shortterm. Under the TPP agreement it suggested it would eliminate tariffs on certain products and industries entering the US; in turn hurting said “Guatemalan” products and industries. With that said, it was clear to project a negative impact on trade between Guatemala and its northern partner.

The Unites States market is Guatemala’s biggest trade partner. According to the Bank of Guatemala, in 2016, exports totaled USD$3,465.3 millions; something that has significantly increased over the past 10 years due to the commercial benefits given under the DR_CAFTA agreement.

The Guatemalan clothing and textile sector is actually the biggest among everything that is exported to the US. According to the OTEXA (Office of Textiles & Apparel), a total of US$1,394. Million worth of clothing and textiles was exported in 2016. Something that all industries truly strive to follow and reach one day. Now with the cancelation of the TPP agreement, we expect the commercial relationship with the US to become even stronger. In fact, several importers were considering and analyzing the option of moving production to Vietnam because of the benefits that would have been given. But they are now repositioning their focus back to the Central American region; especially in Guatemala in order to have an integrated supply chain that can handle a flexible, productive and high valued industry.

Furthermore, the industry relies on the APPAREL SOURCING SHOW, which is the only event of its kind within the DR_CAFTA region www.apparelexpo.com. This actually provides the ideal opportunity to show our main trade partner the advantages of producing in nearby countries. The Commercial Attaches of Investment and Tourism - PACIT- will continue to promote the clothing and textiles industry within the United States through its offices in New York, Miami, and Los Angeles.

In 2016, one of our most important achievements in Tipic S.A. was to obtain the International Certification ASME. This represented for our company the opening of new markets at international level and thanks to this benefit we are obtaining favorable results.

For the current year, we have as main objective to penetrate still further in the Sugar and food Industry, since these industries represent much of the progress of the country and we want to be part of it.

TIPIC S.A. main activity is based on the transformation of steel and the realization of metal structures projects. The DAGAS Brand has a presence in Guatemala and Honduras, with the objective of commercializing Liquefied Petroleum Gas (LPG). With 13 years of having started operations, it currently has 14% of the Guatemalan market in the distribution of Gas Propane.

Our primary objective is to bring good service and performance to both Guatemalan households and industry, to grow and be recognized as the main distributor of LPG in Guatemala.

La Marca DAGAS, tiene presencia en Guatemala y Honduras, con el objetivo de comercializar Gas Licuado de Petróleo GLP, actualmente se tiene un 14% del mercado guatemalteco en la distribución de Gas Propano, con 13 años de haber iniciado las operaciones.

Nuestro objetivo primordial es llevar buen servicio y rendimiento tanto a los hogares guatemaltecos, como a la Industria, tener crecimiento y ser reconocidos como el principal distribuidor de GLP en Guatemala.

With the social work, Dagas has been characterized to support different activities such as Telethon (FUNDABIEN) and Cuadernos con Corazón. Likewise, it actively participates in supporting CONRED in the event of natural catastrophes.

The Campaign, “a stove instead of a tree”, together with the Mexican embassy, supports the donation of stoves to schools in different departments and municipalities of Guatemala, to avoid deforestation in the country and preserve forests and the environment.

En la actualidad, hemos sido testigos del crecimiento e importancia que han generado las franquicias en varios países. Incluso, algunos autores y expertos llegan a denominarlo como “El modelo del siglo XXI”. Sin embargo, si analizamos en la historia, las franquicias poseen más de 100 años, pero fue hasta en los años 30’s cuando el concepto se extendió en Estados Unidos.

Es muy común creer que éste únicamente se acopla a empresas grandes. Sin embargo, dicha tendencia ha cambiado, puesto que, incluso, compañías de menor tamaño ha podido desarrollar sus micro franquicias.

Alrededor del mundo, países como Estados Unidos, Australia o China han sido ejemplo de economías que se han inclinado por desarrollar el más grande número de franquicias. En el caso de América Latina, México, Colombia, Argentina y Brasil representan los países con mayor número de ellas.

En Guatemala, este concepto lleva unos 15 años de estar funcionado. Y encontramos franquicias que van desde restaurantes, venta de motos, farmacias, hasta cafeterías. Se estima, de acuerdo a la Asociación Guatemalteca de Franquicias, que hay unas 300 marcas de franquicias en Guatemala, de las cuales 100 son marcas locales.

Lo cual, ayuda a evitar cometer errores desde un inicio. Y, además, permite tomar experiencia.

El modelo trae consigo una serie de ventajas tales como:

El “know-how” de la marca, pues al momento de adquirirla el franquiciado, lo que se está haciendo es adquiriendo una serie de conocimientos y aprendizajes que benefician, en gran parte, al éxito.

Como parte del auge de las franquicias, el 6 y 7 de marzo, se llevó a cabo en Guatemala el “Encuentro Internacional de Franquicias”, el cual busca brindar charlas en temas relacionados a las franquicias y potencializar a 26 marcas guatemaltecas como franquicias para empresarios interesados en adquirirlas.

Reasons to Choose Them Nowadays, we have witnessed the growth and importance of franchises in many countries. Some experts call it “the prototype of the XXI Century”.

Nevertheless, if we analyze the history, franchises have been with us for more than a 100 years, but since the 1930’s, this idea was developed in the U.S. Frequently, people think it only works for large companies. However, such tendency has changed, because even smaller companies have been able to develop their micro franchises.

Across the globe, countries like the U.S., Australia or China have been good examples of economies which have developed the biggest number of franchises. In the case of Latin America, Mexico, Colombia, Argentina and Brazil are the countries with the majority of them.

In Guatemala, this issue has been working for almost 15 years. We find franchises of restaurants, motorcycle sales, pharmacies and even coffee shops.

According to the Guatemalan Franchises Association, there are some 300 franchises trade marks in Guatemala, where a 100 are local trademarks.

The know-how of the trade mark, because at the moment of obtaining the franchisee, you also acquire a series of knowledge and learning that benefit in order to success.

A specialized guide from the franchisee that helps to get into the best way in order to avoid errors.

Training about the development and the star-up of the trademark. It helps to avoid errors since the beginning and allows the acquisition experience.

Brand positioning, which allows the growth, bigger economic income and the capacity to create new products or services.

Furthermore, it is important to know that trademarks that want to offer their franchises should count with: Operation manuals that explain the know-how of the company.

A contract with rights and liabilities of each party (franchiser and franchisee).

Régimen Migratorio en Guatemala Carmen Escobar| AmCham´s President of the Migration Law Committee y Mayora & Mayora

Existe una clasificación de residencias en Guatemala que le permiten al extranjero ingresar al país desde cualquier parte del mundo, o bien legalizar su situación al encontrarse en el país. Los extranjeros que ingresen al territorio nacional podrán hacerlo bajo las siguientes categorías migratorias: a) No residentes: Estos se clasifican en: I) Personas en Tránsito y II) Turistas o Visitantes. b) Residentes: Estos se clasifican en: I) Residentes Temporales y II) Residentes Permanentes.

No Residentes: Se consideran personas en tránsito a los extranjeros que ingresen al país por cualquier lugar autorizado para el tránsito migratorio y cuya permanencia no podrá exceder de setenta y dos horas.

Se consideran turistas o visitantes los extranjeros que ingresen al país con fines lícitos, propósito de inmigración o residencia, por razones que no impliquen remuneración alguna y por un plazo no mayor de noventa días, prorrogables por una sola vez por otro período igual. La Dirección General de Migración cuando lo considere necesario podrá exigir a los turistas o visitantes que acrediten que tienen los medios económicos suficientes para subsistir decorosamente durante su permanencia en Guatemala, y que le permitan regresar al país de su procedencia o a cualquier otro. Durante su estadía en territorio guatemalteco, los turistas o visitantes no podrán ocupar ningún puesto de trabajo público o privado, ni establecerse comercialmente.

Residentes: Se consideran residentes temporales, a los extranjeros que se les autorice la permanencia en el país por el período de dos años, con el fin de dedicarse a cualquier actividad lícita en forma temporal.

Los residentes temporales pueden realizar un trabajo remunerado o invertir en el país siempre que el capital sea producto de actividades lícitas. Y se consideran residentes permanentes a los extranjeros que previo cumplimiento de los requisitos establecidos en ley, constituyan su domicilio en Guatemala, podrán optar por ella los extranjeros que se encuentren en cualquiera de las siguientes condiciones: 1) Pensionados o rentistas; 2) Inversionistas; 3) Cónyuge e hijos menores o solteros de las personas mencionadas en los numerales anteriores; 4) Familiares extranjeros de nacionales, entendiéndose como tales al cónyuge, hijos y padres, cuando no les corresponda la nacionalidad guatemalteca, de conformidad con la ley; 5) Residentes temporales y 6) Personas que calificadamente demuestren actuaciones destacadas en los campos de la ciencia, tecnología, las artes y el deporte.

There is a classification of residences in Guatemala that allow the foreigner to enter the country from anywhere in the world, or to legalize their situation when they are in the country. Foreigners entering the national territory may do so under the following migratory categories: a) Nonresidents: These are classified as: I) Persons in Transit and II) Tourists or Visitors.

B) Residents: These are classified as: I) Temporary Residents and II) Permanent Residents.

No residents: Persons in transit are considered to be foreigners who enter the country through any place authorized for migratory transit and whose stay cannot exceed seventytwo hours. Foreigners who enter the country for lawful purposes, immigration or residence purposes, are considered as tourists or visitors, for reasons that do not imply any remuneration and for a period not exceeding ninety days, extendable only once for another equal period. The General Directorate of Migration, when it deems it necessary, may require tourists or visitors to prove that they have the economic means to subsist during their stay in Guatemala and to return to their country of origin or to any other country. During their stay in Guatemalan territory, tourists or visitors may not occupy any public or private job, nor establish themselves commercially.

Residents: Temporary residents are considered foreigners who are allowed to stay in the country for a period of two years, in order to engage in any lawful activity on a temporary basis. Temporary residents may perform paid work or invest in the country provided that the capital is the product of licit activities.
