El funcionamiento de toda empresa depende de trámites administrativos que se realizan en distintas instituciones del Estado, los cuales pueden consultarse en la plataforma Asisehace.gt, una herramienta capaz de mejorar la competitividad de cualquier organización, pues guía paso a paso cómo hacer estos procedimientos y, de esta manera, evita acciones innecesarias, con lo que las compañías pueden ahorrar tiempo y costos.

Desde cómo inscribir empresas y Sociedades Anónimas, hasta cómo obtener permisos de importación y exportación de productos, el sitio Asisehace.gt detalla los requisitos y lugares a visitar, así como el tiempo y costo promedio para realizar cada trámite. Además, cada proceso contiene el respaldo legal que lo justifica.

Una herramienta a la vanguardia Asisehace.gt forma parte del proyecto eRegulations, desarrollado por la Conferencia de las Naciones Unidas sobre Comercio y Desarrollo (UNCTAD, por su acrónimo en inglés) y se encuentra funcionando en varios países. En Guatemala fue implementado en 2011, con el apoyo económico del Gobierno de Luxemburgo. Se cambió el nombre a Asisehace.gt para hacerlo más amigable con los guatemaltecos.

Con esta herramienta se busca simplificar y documentar los procesos en Guatemala, para guiar a los usuarios y reducir tiempos y costos. Desde PRONACOM creemos firmemente que esta es la clave para el fortalecimiento de las instituciones, tanto públicas como privadas.

La página Asisehace.gt es visitada actualmente por más de 8 mil personas a la semana, quienes consultan más de 300 procesos, en un ejercicio de Gobierno Abierto que busca transparentar la ejecución de las instituciones guatemaltecas y facilitar la operación de las empresas para hacerlas más competitivas.

The function of an entire business depends on administrative procedures that are carried out by certain state institutions, which all can be consulted by visiting “asisehace.gt” This is a tool that can be used to improve the competitiveness of any organization, a step by step guide showing the procedure, that avoids unnecessary actions saving companies time and money.

From registering businesses and anonymous societies, to obtaining importation and exportation permits; “asisehace.gt” provides detailed information on the requirements and locations to visit, along with the average time and cost for each process. Furthermore, each process contains the legal support that justifies it.

A Tool on the Forefront Asisehace.gt forms part of the eRegulations project developed by the United Nations Conference on Trade and Development (UNCTAD), where it finds itself functioning in multiple countries. For Guatemala, it was implemented in 2011 with the economic support from the Luxembourg government, and changing its name to “asisehace.gt” to make more appealing to the Guatemalan people.

Ever since its development, the National Program for Competitiveness –PRONACOMhas been in charge of this platform. This organization coordinates the interinstitutional efforts to improve the country’s business climate into a favorable environment that attracts investment. With this tool, it intends to simplify and document by the country’s process to guide its users reducing time and costs. From Pronacom, we firmly believe this key to strengthen public and private institutions.

The “asisehace.gt” page is currently visited my more than 8,000 people a week, whom require guidance on 300 processes. This is all in the attempt of an Open Government project that seeks the transparency of Guatemalan institutions and facilitate business operations in order to make them more competitive.

Cumplimiento Legal Ambiental El 12 de julio entró en vigencia el nuevo Reglamento de Evaluación, Control y Seguimiento Ambiental, contenido en el Acuerdo Gubernativo No. 137-2016 (en adelante RECSA), lo cual implica otro cambio a la normativa ambiental en el país. En menos de dos años, se aprobaron dos Reglamentos, uno que entró en vigencia en 2015 (Acuerdo Gubernativo No. 60-2015) y otro que no entró en vigencia (Acuerdo Gubernativo No. 20-2016). El nuevo RECSA se encuentra vigente y es de cumplimiento obligatorio.

Este RECSA al igual que sus antecesores, define el procedimiento de aprobación de instrumentos ambientales por parte del Ministerio de Ambiente y Recursos Naturales -la obligatoriedad de los instrumentos ambientales se encuentra regulada en la Ley de Protección y Mejoramiento del Medio Ambiente, desde el año 1986-. Además establece la obligación de contar con una licencia ambiental y un seguro de caución vigente. Es decir, toda actividad, obra, proyecto o industria, deberá cumplir con tres requerimientos: un instrumento ambiental aprobado, una licencia ambiental vigente y un seguro de caución vigente. Lo anterior para todas las etapas de la actividad, obra, proyecto o industria que se trate.

Cabe mencionar que el incumplimiento de estos tres requerimientos conlleva la imposición de sanciones administrativas, como multas y de existir contaminación por la actividad, obra, proyecto o industria de que se trate, puede tipificarse el delito de contaminación, el cual conlleva una pena de prisión de 2 a 10 años y multa de Q.3,000 a Q.10,000. ¿Está su empresa cumpliendo?

Environmental Legal Compliance On July 12th of this year, the new Regulation of Evaluation, Control and Environmental Monitoring entered into effect in accordance of the governmental Agreement No. 137-2016, (hereinafter referred as RECSA). This implies another change to environmental regulations within the country. In less than two years two Regulations were approved, one of which was implemented in 2015 (Government Agreement 60-2015) and another not yet in effect (Government Agreement 20-2016). The new RECSA is now in in effect and mandatory.

RECSA, like its predecessors, defines the procedure for approval of environmental instruments by the Ministry of Environment and Natural Resources -the obligation to have an environmental instrument are regulated by the Environmental Protection and Improvement Law from 1986-. It also establishes the obligation to have an environmental license and surety bond in effect. In other word; any activity, work, project or industry, must fulfill three requirements: have an environmental instrument approved, a valid environmental license and surety bond. This is for all stages of the activity, work, project or industry accordingly.

It is worth mentioning that the failure to fulfill any of these three requirements, entails the enforcement of administrative sanctions such as fines. Furthermore, contamination is a crime. If there is any existing contamination brought by the activity, work, project or industry, a prison sentence for 2 to 10 years and a fine of Q.3,000 to Q.10,000 may be enforced. Votaciones en Estados Unidos: más allá de los ataques sobre “bad hombres y nasty women” María Inés Valle Balsells | Coordinadora de Trade Center Amcham

Hemos sido testigos de la inusual contienda electoral en Estados Unidos en el presente año. Entre acusaciones, se debate el futuro del país más importante y poderoso del mundo.

En definitiva, un acontecimiento que marcará el antes y el después no sólo de Norteamérica, sino del resto de países.

Contexto actual: De acuerdo a información reciente, las “votaciones tempranas” presidenciales ya iniciaron en el país, encabezadas por Carolina del Norte. La ventaja, según los sondeos más recientes, se encuentra a favor de Hillary Clinton con 6.5 puntos arriba de Donald Trump. Los “votantes tempranos” representan a más de la mitad de los votantes en los estados decisivos del país tales como Colorado, Carolina del Norte, Florida, Georgia, Arizona y Nevada. Esta situación implica que los candidatos deben tener mucho cuidado en sus acciones, palabras y decisiones, pues un paso en falso podría implicar un momento crítico en los próximos días.

En medio de las expresiones de frustración de los estadounidenses, los factores que opinan puede ser determinantes para elegir 10 Business in Action Noviembre 2016

a sus respectivos candidatos, van desde la experiencia que posee Hillary, el cambio que implica Donald y las políticas que cada uno de ellos aplicará. No obstante, las principales preocupaciones de los votantes son el temperamento de Trump y su poca experiencia en general y con el Congreso.

Por otra parte, a las personas les preocupa la deshonestidad de Clinton y su pasado.

Migración: No es noticia nueva mencionar la polémica que se desata cada vez que ambos candidatos tratan el tema migratorio. Por ejemplo, en el último debate presidencial, Donald Trump acuñó una nueva frase para referirse a los migrantes latinos en Estados Unidos: “ bad hombres”, demostrando la importancia de construir un muro en la frontera de USA y México para contener la inmigración ilegal masiva, deportando a los 11 millones de indocumentados y deteniendo el flujo de las drogas. Una propuesta totalmente distinta a la de Hillary Clinton, quien promete legalizar a millones de indocumentados, plan que no ha indicado cómo llevará a cabo ni con cuáles recursos económicos. Podría decirse que bajo Clinton, continuará la misma tendencia que ha seguido Obama, la cual fue prometer

una cantidad de beneficios a los migrantes, pero que al final del día, ha sido el mandato presidencial bajo el cual ha existido mayor número de deportaciones.

Libre Comercio: En cuanto al libre comercio, ambos candidatos han expresado sus intenciones sobre renegociar los tratados que posee Estados Unidos. Hillary y Donald se encuentran a favor ya sea de renegociar o eliminar determinados tratados.

Por ejemplo, opinan que el TLCAN el no ha sido un éxito. No obstante, el Tratado ha significado el aumento de un 250% de las importaciones estadounidenses a México comparando el año 1994 vs. el 2015. Mientras que la inversión extranjera directa de USA a México desde el año 2000 al 2014, representa más del 45% de toda la inversión que ha llegado del exterior a México. No obstante, Trump argumenta la importancia de rescatar la inversión y los trabajos que se fugaron de USA a México debido al Tratado.

En cuanto al DR-CAFTA, Donald no ha mencionado ningún punto al respecto, pues su enfoque es el TLCAN. No obstante, Hillary, desde el inicio de la negociación del www.amchamguate.com

Tratado, se negó a apoyarlo, indicando que el acuerdo perjudica a los trabajadores y fábricas en Estados Unidos. Sin embargo, votó, en su momento, a favor de los tratados comerciales con Chile y Singapur en el entendido que beneficiarían a los USA. El impacto en Guatemala: Para nuestro país, los temas fundamentales son la migración y el comercio.

Durante el reciente año, el presidente Barack Obama mencionó que se ha incrementado el número de migrantes centroamericanos en Estados Unidos. El porcentaje aumentó 23% durante el año fiscal, sumando 408 mil 870 inmigrantes ilegales. No obstante, en el caso específico de Guatemala, entre el 1 de octubre del año 2015 y el 20 de agosto del año 2016, USA deportó a 29 mil 289 guatemaltecos.

Una alternativa a la problemática se basa en la Alianza para la Prosperidad, misma que busca ser una política integral en el Triángulo Norte de Centroamérica, desincentivando la migración masiva de centroamericanos hacia USA. En cuanto al comercio, recordemos que Estados Unidos es el principal socio comercial de Guatemala. La idea es que ambos candidatos comprendan que a medida que USA se cierre a nuevas oportunidades comerciales, el país se verá en desventaja y con carente liderazgo en el comercio internacional, no solamente con Guatemala o la región DR-CAFTA en sí.

Un muro o una campaña anti-tratados comerciales no serán las soluciones ideales para sacar adelante a la economía estadounidense. Requiere ir más allá de las puertas cerradas a la globalización, la xenofobia o los enfrentamientos. Se trata de planes congruentes, serios e inteligentes los que deben afrontar.

It is definitely an event that will set a “before and after” of the U.S., as well as for the rest of the countries.

Current Context: According to recent information, “early presidential elections” have already started in the country, led by North Carolina. With regard to recent polls, Hillary Clinton leads Donald J. Trump on 6.5 points. “Early voters” represent more than half of voters in the sized States of the country such as Colorado, North Carolina, Florida, Georgia, Arizona and Nevada. This situation involves that both candidates should be very careful with their actions, words and decisions, because a wrong step would imply a critical moment during the coming days.

Within the expression of frustration of the U.S. citizens, the issues that they comment could be determinant to select their candidates, and it all goes from Hillary’s experience, the change that implies Donald and the policies that each one of them will apply. Nevertheless, main concerns of the voters are Trump’s temperament and his lack of experience in general and especially with the Congress. On the other hand, people are worried about the dishonesty of Clinton and her past.

Trump said a new phrase to Latino migrants in the U.S.: “Bad hombres” in order to demonstrate the importance of building a wall at the U.S. and Mexico border to stop massive illegal immigration, deporting 11 million undocumented migrants to stop drug smuggling. Hillary has a completely different proposal, she promises to legalize millions of undocumented migrants, same that she has not even explained how to accomplish it neither the economical resources to do it. We could say that with Hillary, the same tendency of Obama will be going on; same that promised benefits for migrants, but at the end, under the Obama’s administration there have been more deportations than ever.

Free Trade: in respect of free trade, both candidates have expressed their intentions to renegotiate the U.S. agreements. Hillary and Donald are both in favor to renegotiate or eliminate some agreements. For example, they both agreed that the NAFTA has not been successful. Nevertheless, this agreement has increased a 250% the U.S. imports to Mexico, compared to the year 1994 vs. 2015. Meanwhile, the foreign direct investment from the U.S. to Mexico since the year 2000-2014, represents more than 45% of all the investment that has entered to Mexico. However, Trump emphasizes in

TRADE & INVESTMENT rescuing investment and jobs that were lost due to this agreement with that country.

Regarding the DR-CAFTA, Donald has not mentioned any point about it, because he is focused on the NAFTA. On the other hand, Hillary never supported this agreement since the beginning of the negotiations, pointing out that this agreement undermined workers and factories in the U.S. However, she voted in favor of the agreements with Chile and Singapore, which benefited the U.S. Effect in Guatemala: For our country, the fundamental issues are migration and trade.

During the current year, President Barack Obama mentioned that the number of Central American migrants has increased in the U.S. During the fiscal year, it was increased in a 23%, with a total amount of 408,870 illegal migrants. However, in the specific case of Guatemala, between October 1st of the year 2015 and August 20th of the year 2016, the U.S. has deported 29,289 Guatemalans.

A solution for this problem is based on the A4P same that is looking forward to be a comprehensive policy for the Central America Northern Triangle discouraging the massive migration of illegal undocumented people to the U.S. With regard to trade, the U.S. is the main trading partner to Guatemala. The idea is that both candidates will understand that in the way that the U.S. stops any new trade opportunities, the country will be in disadvantage with less leadership in international trade, not only with Guatemala or the DR-CAFTA Region.

A wall or an anti-trade agreements campaign will not be the solutions for a successful economy in the U.S. It means to go further above closing doors to globalization, xenophobia or conflicts. It is all about consistent, serious and intelligent plans.

NDG se fundó en el año 2006 y actualmente opera dos escuelas primarias y un instituto básico que proporcionan educación de alta calidad a 430 niños y sus familias en las localidades de Ciudad Vieja y San Lorenzo el Cubo, Sacatepéquez.

NDG provee educación integral que se extiende más allá del aula tradicional en tres niveles: los estudiantes, sus familias y la comunidad. Tenemos la ambición de lograr la sostenibilidad de la organización y de la comunidad, a través de iniciar y apoyar negocios sociales y promover el espíritu de emprendimiento. Cambio Language School, un negocio social en Antigua, incorpora esto a través de proveer ingresos consistentes y sostenibles a NDG como 100% de sus ganancias van directamente a las escuelas.

NDG trae cambios a la educación de Guatemala, enfatizando en nuevos conceptos y métodos de aprendizaje que sitúan a nuestros estudiantes por delante de sus compañeros en escuelas públicas. NDG se enfoca en el pensamiento crítico y la discusión en la aula, así como expresión artística y el aprendizaje de un idioma extranjero.

Más allá del aula, NDG cuenta con departamentos de Trabajo Social y Psicología, así como un programa de nutrición y salud. Las trabajadoras sociales desarrollan programas que benefician la comunidad en un sentido amplio. Algunos ejemplos de estos programas son: Alcohólicos Anónimos, grupos de apoyo para madres solteras y nuevos padres y como talleres de educación y salud sexual. Por su parte, los estudiantes identificados con déficit de atención o trastornos psicológicos

están inscritos en terapia individual o grupal con la psicóloga del centro educativo, donde trabajan juntos para identificar los asuntos que afectan al niño y proponer soluciones.

Con respecto al programa de nutrición y salud, una nutricionista experta diseñó el menú de las escuelas donde se provee refracciones y almuerzos diarios a cada estudiante, cubriendo el 80% de sus necesidades nutricionales diarias. A través de este programa también proveemos cepillos de dientes, pasta de dientes, y jabón para el aseo personal diario de nuestros estudiantes.

Beyond the classroom, NDG provides a Social Work and Psychology Department, as well as a Nutrition and Health Program. Social Workers host many programs that benefit the community, a few of which include; Alcoholics Anonymous for family members of alcoholics, support groups for single mothers and new parents, as well as sexual health workshops. Students who are identified as needing extra care are enrolled into a regular group or individual therapy session with a psychologist where they work together to address the issues affecting the child and identify solutions.

Niños De Guatemala (NDG) was founded in 2006 and empowers communities in marginalized areas of Guatemala. It currently operates two primary schools and a middle school that provide high-quality education to over 450 children.

There are many ways to get involved with NDG, such as a volunteer program, individual sponsorship, our Social Business Cambio Language School, and a Corporate Social Responsibility program. By supporting NDG’s programs, you have the chance to help build communities which are educated, empowered, and entrepreneurial.

NDG’s education extends beyond the traditional classroom across three levels: students, their families, and the community.

NDG aims to be sustainable at the organizational and community level through initiating and supporting social business activities and fostering an entrepreneurial spirit. Cambio Language School, a social business in Antigua, embodies this through providing consistent, sustainable income for NDG as100% of its profits go directly to our schools.

NDG brings change to Guatemalan education by building upon national standards, emphasizing new concepts and learning methods that are placing students ahead of their peers in public schools. NDG believes in stressing critical thinking and discussion in the classroom, as well as artistic expression and foreign language acquisition.

An expert nutritionist designed the menu in our schools to provide the students with a snack and lunch each day, covering over 80 percent of their daily nutritional needs. The health program also entails the provision of toothbrushes, toothpaste and soap that students use each school day.
