Words from our president Juan Pablo Carrasco de Groote President En la decimoctava edición de la Revista Business in Action, quisiera resaltar los recientes acontecimientos que afronta nuestro país. Guatemala es un país en el que el comercio, la innovación y la inversión continúan siendo motores de empleo y desarrollo para así lograr una sociedad que busca paz y oportunidades de crecimiento económico.

Es por ello, que considero importante que todos los guatemaltecos estemos a favor del Estado de Derecho, la unidad nacional y la institucionalidad del país. Es de suma importancia el apoyo a la lucha contra la corrupción de manera eficaz, libre e independiente sin importar ideología o partido. Creo que ésta es una batalla indispensable para lograr instituciones transparentes y fuertes de esta manera poder genera desarrollo y prosperidad en Guatemala.

Confiamos en la institucionalidad del país y en que el Estado de Derecho prevalecerá, recordando que ante toda crisis vivida en los últimos años se ha logrado fortalecer la democracia e instituciones en Guatemala.

In the eighteenth edition of Business in Action magazine, I would like to highlight the recent events facing our country. Guatemala is a country where investment, trade and innovation will continue to be the engines of development and employment for the benefit of a society that seeks peace and economic growth opportunities.

That is why I consider it important that all Guatemalans are in favor of the rule of law, national unity and the institutional framework of the country. It is important to support the fight against corruption in an effective, free and independent way, regardless of our ideology or party. I believe that this is an essential battle to achieve transparent and strong institutions able to generate development and prosperity in Guatemala.

We trust the institutional framework of the country and the Rule of Law to prevail. We recall that all the crises experienced in recent years have produced the outcome of strengthened institutions and democracy in Guatemala.

El pasado 11 de agosto se llevó a cabo la novena reunión de Cuerpo Consultivo del Plan de Alianza para la Prosperidad del Triángulo Norte, los temas a tratar fueron: avance en los compromisos, reporte de ejecución presupuestaria y avances del PAPTN en territorio.

la Competitividad, Acisclo Valladares, el equipo de trabajo del PAPTN ha trabajado en procesos de socialización, mapeo de actores, creación de mesas sectoriales de trabajo con el involucramiento de sociedad civil y metas municipales de desarrollo.

Las instituciones gubernamentales continúan con el mismo empeño para avanzar en los distintos compromisos adquiridos entre el Gobierno de Guatemala y Estados Unidos para avanzar en el desarrollo económico del país, reducir la migración, combatir la corrupción, entre otros.

Guatemala ha creado a nivel gubernamental el «Gabinete Especifico para el Plan de Alianza para la Prosperidad» que se espera se reúna en las próximas semanas para impulsar la ejecución de proyectos priorizados y que generen impacto en cualquiera de los 4 ejes estratégicos del PAPTN.

En la reunión el Ministro de Finanzas, Julio Hector Estrada indicó que siguen existiendo aspectos que afectan fuertemente la ejecución de los programas presupuestarios asignados al Plan de Alianza para la Prosperidad, algunos de ellos son la ley de compras y contrataciones del Estado, los hallazgos de la Contraloría General de Cuentas y los candados presupuestarios.

Por lo anterior, a la fecha la ejecución es de 22.5% lo cual representa 1,424.5 millones de quetzales de un total de 6,444.2 millones de quetzales. Dentro de los ministerios con peor ejecución están Ministerio de Comunicaciones y el Ministerio de Desarrollo Social.

Por otra parte, los esfuerzos en los municipios del plan piloto se han incrementado, ya que, según lo informado por el Comisionado Presidencial para

The second meeting of the Consultative Body, 2017 The Ninth Meeting of the Consultative Body of the Alliance for Prosperity Plan for the Northern Triangle took place on August 11, where the following topics were discussed: progress made in commitments in place, budget execution report and progress in the Alliance for Prosperity Plan on the ground.

Guatemalan agencies continue to strive to make progress in the various commitments made by the Governments of Guatemala and the United States to further the economic development of the country, reduce migration rates, and fight corruption, among other things.

In the meeting, the Minister of Finances, Julio Héctor Estrada stated that there continue to be issues that seriously hinder the execution of budgetary programs allocated to the Alliance for Prosperity Plan, among them, the State Procurement Act, the findings by the General Accounts Comptroller and restrictions to the budget.

Due to these issues, budget execution to date is 22.5%, or 1.425 billion quetzals, out of a total of 6.444 billion quetzals in the budget. The Ministries displaying the worst execution are the Ministry of Communications and the Ministry of Social Development.

On the other hand, efforts in pilot plan municipalities are on the rise since, as the Presidential Commissioner for Competitiveness Acisclo Valladares stated, the Alliance for Progress work team has engaged in raising awareness, mapping stakeholders, and creating sector-wide work groups with the involvement of civil society and considering municipal development goals.

Guatemala created the government’s «Specific Cabinet for the Alliance for Prosperity Plan» that is expected to meet in coming weeks to promote prioritized projects which generate impact in any one of the 4 strategic pillars of the Prosperity Plan.

¿Cuál es el objetivo principal de World Vision?

World Vision es una organización de ayuda humanitaria con presencia en más de 100 países. Nuestro trabajo se enfoca en lograr el bienestar y protección de la niñez implementando programas de desarrollo transformador.

Trabajamos por quienes son lo más importante de la sociedad; quienes mañana serán la fuerza laboral del país. Por ello, necesitamos a todos y en especial al sector empresarial para fortalecer el capital social.

Since World Vision arrived in Guatemala more than 40 years ago with the purpose of contributing to the reduction of poverty and injustice by responding to the needs and the situation of the country, through proven models and programs.

Tenemos grandes retos, uno de ellos es la protección integral de los niños y jóvenes. En julio de este año lanzamos la campaña “Necesitamos a todo el Mundo para eliminar la Violencia contra la Niñez”, la cual tiene como objetivo articular los esfuerzos de toda Guatemala para lograr un impacto real y sostenible en el bienestar de la niñez. Queremos dejarle un desafío a los empresarios que quieran involucrarse: SUMATE a la causa, COMPARTE el mensaje, APORTA recursos.

Interview What is the main objective of World Vision?

World Vision is a humanitarian aid organization with presence in more than 100 countries. Our work focuses on achieving the welfare and protection of children by implementing programs of transformative development.

We work for those who are the most important in society; who tomorrow will be the country’s labor force. That is why we need all, and especially the business sector, to strengthen social capital. We know that there are no successful companies in failed societies.

Which were the achievements in 2017?

That experience has made us a reference in the theme of childhood, youth and adolescence being a source of constant consultation by the different sectors of civil society.

In recent months we have expanded and strengthened our relationship with international donors such as USAID through the awarding of two important projects that support the comprehensive development of vulnerable youth.

What are the new projects for this 2017?

We have great challenges, one of them is the comprehensive protection of children and young people. In July this year we launched the “We Need the World to Eliminate Violence Against Children” campaign, which aims to articulate the efforts of all of Guatemala to achieve a real and sustainable impact on the wellbeing of children. We want to challenge entrepreneurs who want to get involved: SUMATE the cause, SHARE the message, SUPPORT resources.

Reformas de normas laborales Federico Zelada Cifuentes |Cristina Sandoval Saravia Abogados Asociados de Consortium Legal Guatemala

Durante el mes de junio del presente año entraron en vigencia las reformas al Código de Trabajo aprobadas por el Congreso de la República mediante el Decreto 7-2017.

Dichas reformas, fundamentalmente relacionadas con los procedimientos de supervisión encomendados a la Inspección General de Trabajo, se suman a una serie de normas que han sido o serán emitidas en el futuro próximo, tendientes a modernizar las instituciones laborales guatemaltecas. A modo de ejemplo se cita la reciente reforma en materia de salud y seguridad ocupacional que igualmente fue tratada en la conferencia organizada por AMCHAM el 22 de agosto del presente año o bien la entrada en vigencia del Convenio 177 de la Organización Internacional del Trabajo relativo al Trabajo a tiempo parcial.

Las reformas al Código de Trabajo recién aprobadas constituyen fundamentalmente un intento por fortalecer a la Inspección de Trabajo, otorgándole en apariencia, mayores facultades de fiscalización, ampliando sus atribuciones y concediéndole poder sancionatorio, cuya constitucionalidad, dicho sea de paso, es discutible.

Sin embargo, la citada reforma deja de lado aspectos tan fundamentales como lo son los recursos técnicos y económicos y la capacitación con que deben contar los Inspectores de Trabajo para poder efectuar

sus labores, aspectos que permitirían “real y efectivamente” conseguir un fortalecimiento de dicha autoridad administrativa. Parece contradictorio que una reforma en materia de derecho del trabajo atienda más a la forma, que a la realidad concreta y tangible que impera en Guatemala, el mismo caso que el Acuerdo Gubernativo 229-2014 y reformas, sobre salud y seguridad ocupacional, normativa que resulta poco adaptable a la realidad nacional, aunque debe reconocerse que todas las recientes reformas en materia laboral han sido producto del diálogo y consenso sectorial que seguramente serán pilares fundamentales del desarrollo futuro del respeto a los derechos laborales en nuestro país.

Labor Standards Reforms The amendments to the Labor Code passed

by Congress came into force through Decree 7-2017 in the month of June of this year.

These amendments, fundamentally related to the supervision procedures entrusted to the General Labor Inspectorate, are in addition to a number of norms that have been or will be issued in the near future, aimed at modernizing Guatemalan labor institutions. An example is the recent reform in occupational health and safety,

which was also discussed at the conference organized by AMCHAM on August 22nd of this year, or the entry into force of Convention 177 of the International Labor Organization related to part-time work.

The recently approved amendments to the Labor Code are basically an attempt to give more robustness to the Labor Inspectorate, by, in appearance, empowering it more, by expanding its responsibilities and granting it sanctioning authority, the constitutionality of which, by the way, is debatable.

However, this amendment leaves fundamental aspects outside of the framework, such as the technical and economic resources and the training that Labor Inspectors need to be able to carry out these duties, and which would “really and effectively” accomplish the strengthening of this agency. It seems contradictory that Labor Law amendments addresses more the form that the specific and tangible reality that prevails in Guatemala.

This is the same case as Government Resolution 229-2014 and its amendments on Occupational Health and Safety which is hardly applicable to the country’s reality, although it should be recognized that every recent labor amendment has been the result of sector-wide dialogue and consensus that will surely be fundamental pillars for the future development of respect for labor rights in our country.

10 años apoyando PyMEs Ana Chan | Gerente de Asuntos Corporativos de Walmart.

Walmart de México y Centroamérica cumple una década de impulsar el programa “Una Mano para Crecer”, en el cual se promueve el desarrollo de pequeñas y medianas empresas con el fin de que puedan convertirse en proveedores de los diferentes formatos de la cadena: Walmart, Maxi Despensa, Paiz y Despensa Familiar.

En el 2007, Walmart realizó una investigación con 150 empresas para conocer las necesidades de las PyMEs para lograr incorporarse como proveedores. Los resultados indicaban que las pequeñas y medianas empresas requerían apoyo en capacitación continua, agilidad en trámites, financiamiento y acceso al mercado. Es así como surgió el programa “Una mano para Crecer”.

para mejorar el desempeño de su negocio y fortalecer sus conocimientos en temas de administración, productividad y marketing.

En el último año, Walmart a través de su operación en Guatemala invirtió US$9 millones 989 mil en productos de cuidado personal, textiles, alimentos, entre otros.

A nivel centroamericano de las 425 PyMEs registradas, 163 son lideradas por mujeres. En Guatemala, de las 132 PyMEs que pertenecen a este programa, 50 son dirigidas por mujeres.

“Al impulsar el desarrollo local contribuimos a la economía de los países donde operamos. Con gran satisfacción hemos visto cómo pequeñas empresas han evolucionado, hemos sido testigos del trabajo arduo, la convicción y el compromiso que han llevado a las familias emprendedoras a salir adelante, a mejorar la calidad de sus productos, aumentar la producción y como resultado ser una fuente de empleo para más guatemaltecos.

A nivel regional, más de un 50% de proveedores son PyMEs”, comentó Ana Chan, Gerente de Asuntos Corporativos.

Como parte del apoyo integral a PyMEs, en el 2016 surgió la iniciativa “Adopta una PyME”, cuyo objetivo es mejorar las condiciones comerciales de los proveedores para que desarrollen sus capacidades operativas, financieras y logísticas. Para ello, son apadrinados por asociados quienes los asesoran y dan seguimiento constante a los resultados y retos que enfrentan día con día.

En Guatemala, durante la primera generación del programa, participaron 53 PyMEs de las categorías de abarrotes y consumo, destacándose 22 que obtuvieron excelentes resultados en ventas y alcanzaron un crecimiento significativo.

GUATEMALA IN ACTION

CASO DE ÉXITO MAQUINGUA S,A.

Maquingua S,A es una pequeña empresa guatemalteca, que inició hace 1 año produciendo variedad de salsas, y avena molida. Su creadora es Miriam de Gómez.

Ella y su esposo, luego de un viaje a Estados Unidos, empezaron a buscar la forma de acercar a los guatemaltecos que viven fuera del país los sabores que recuerdan con nostalgia.

Inicialmente su producción era para la familia y amigos, los constantes elogios del sabor y calidad de su producto los motivaron a emprender un negocio propio.

En 2016, Maquingua a través del programa de Una Mano para Crecer logró ingresar como proveedor de Walmart y Paiz con dos productos, La Chilera -Salsa Chiltepe y La Chilera - Salsa Chipotle.

“El programa Una Mano para Crecer de Walmart nos abrió la puerta a conocimientos y experiencias nuevas”, Miriam de Gómez, fundadora Maquingua S, A. Hoy en día la PyME ha podido generar empleos directos e indirectos, busca crear oportunidades de trabajo para mujeres mayores de 35. Actualmente comercializa 4 productos, y tienen otros cuatro en desarrollo.

Walmart, 10 years providing support for SMEs Walmart México and Central America celebrate one decade of promoting their program “Una Mano para Crecer” (“A Hand to Grow”) that encourage the development of small and medium size companies to turn them into suppliers of the chain’s different formats: Walmart, Maxi Despensa, Paiz and Despensa Familiar.

In 2007, Walmart surveyed 150 companies to learn what SMEs needed to do to become suppliers. The results indicated that small and medium-size companies require continuous training, streamlined procedures, funding and market access.

This is how the program “Una Mano para Crecer” (“A Hand to Grow”) came to be.

Thanks to this program, entrepreneurs receive support and training to improve the performance of their business and to build their knowledge in management, productivity and marketing.

SUCCESS CASE MAQUINGUA S,A.

Maquingua S,A is a small Guatemalan Company that about a year ago started to produce a number of sauces and milled oats. After a trip to the United States, Miriam de Gómez and her husband became interested in bringing the flavors that Guatemalans living abroad remember with nostalgia closer to them.

They started producing for family and friends; the constant praise for the great flavor and quality of their products encouraged them to start this business.

In 2016, Maquingua became a Walmart and Paiz supplier through Una Mano para Crecer, with two products: La Chilera – Chiltepe Chili Sauce, and La Chilera Chipotle Chili Sauce.

Walmart’s “Una Mano para Crecer” opened the door for us to knowledge and new experiences” Miriam the Gómez, founder of Maquingua, S.A. commented.

This small Company is now able to offer direct and indirect employment and is looking to offer work opportunities to women over 35 years of age. They currently market 4 products and have four more under development.

El concepto de innovación y desarrollo tecnológico en las empresas ha cambiado en los últimos años, la mayoría hoy en día busca tener los productos o planes de negocio más innovadores para incursionar en nuevos mercados, en la mayoría de los casos se busca la caracterización de los productos o servicios con el fin de introducirse a mercados internacionales.

El mercado estadounidense, por ejemplo, provee herramientas enfocadas en el desarrollo tecnológico de las empresas, así como también requiere proveedores de vanguardia que alcancen los requerimientos de grandes multinacionales y clientes exigentes.

AmCham en colaboración con Silicon Valley Forum busca impulsar las ambiciones de nuevos empresarios en conducir su negocio en Estados Unidos y Silicon Valley, conocer el ecosistema, practicas innovadoras, tecnologías emergentes y establecer contactos clave.

Por lo anterior, hemos trabajado en la planificación de una misión académica y comercial que se llevará a cabo en el corazón de Silicon Valley. La delegación será llevada a través de un viaje emocionante, inspirador y educativo en el que visitaran y escucharan a representantes de empresas de talla mundial asociadas con startups, venture capital, angel investment y otros.

Silicon Valley alberga a más de 5300 startups, 500 firmas de venture capital, 400 millones de dólares provenientes de angel investment y 23 billones de dólares en venture capital.

Dentro de los lugares que visitara la delegación se encuentra: Uber, Universidad de Stanford, Airbnb, Google, Microsoft, 500 Startups y otras.

Innovation and Business Development The concept of innovation and technological development in business has changed in recent years. Nowadays, the majority of people seek to obtain the most innovative business products or plans to enter new markets. In most cases the aim is to characterize products or services in order to venture into international markets.

For example, the United States market provides tools that focus on the companies’ technological development; this market looks for innovative suppliers who meet the standards of large multinationals and demanding customers.

AmCham, in collaboration with Silicon Valley Forum, seeks to encourage the ambitions of new entrepreneurs of running their business in the U.S. and Silicon Valley, as well as to help them to understand the ecosystem, innovative practices, emerging technologies, and establishing valuable contacts.

Consequently, we have worked in the planning of an academic and trade mission that will take place in the heart of Silicon Valley. The delegation will go through an exciting, inspiring, and educational journey in which they will visit and listen to representatives of world-class leading companies associated with startups, venture capital, angel investment, and others.
