IT HAS BEEN AN HONOR to serve our profession in the role of AOPA President for the past twelve months. It’s a tremendous responsibility that has been shared by many talented and dedicated colleagues before my tenure. 2018 was not without it’s challenges, but the feeling that stands out most upon reflection is not one of struggle, it is one of success. I am fortunate to share the responsibilities of leading this organization with a strong, dynamic Board. One that has embraced a renewed spirit of collaboration and inclusivity, with an intentional eye towards diversity. All of healthcare has been under constant transition these past few years as our country has sought to bring better solutions to the cost and delivery of care and the number of people covered by adequate health insurance. The orthotics and prosthetics profession, like many other healthcare professions, has struggled to balance doing more with less, while continuing to ensure the best possible care for our patients. Diligence in efforts to protect the services O&P professionals provide to their patients has never been more important. AOPA’s advocacy has delivered some incredible victories in 2018. First, we can celebrate the legislation signed into law by the President on February 8, 2018 which mandated that orthotists and prosthetists notes be included in the patient’s medical record for purposes of determining medical necessity. Secondly, the interagency workgroup working on the flawed lower limb Local Coverage Determination proposal that would have forced a 1970s level of care on amputees was withdrawn and the current Local Coverage Determination continues. And finally, the highly disruptive “Dear Physician Letter” from August 2011 has been retired, removed, and replaced with a revised version that acknowledges the notes of O&P practitioners as part of the medical record for medical review purposes. Another important AOPA advocacy effort in 2018 focused on ensuring that the VA continued to allow Veterans to exercise their choice for private sector care. AOPA was also successful in arguing against a 14% Medicare rate reduction on diabetic shoe inserts. This positive outcome also set a precedent for other codes where new technology may replace older fabrication methods. Research has become a key strategic issue for our members, and AOPA has become a leader in funding O&P research. The Prosthetics 2020 initiative continues sponsoring research to ensure prosthetics are properly positioned for the future value-driven healthcare system.
Research is needed to improve future reimbursements and to match appropriate technology to patient needs. One important project under way explores the health economic benefits of allowing patients with K 2 functional levels to receive microprocessor prostheses. AOPA has proposed this project for possible partnership with the Center for Medicare and Medicaid Innovation (CMMI), which tests models that improve care, lower costs and better align payment systems to support patient centered practices. Through the Orthotics 2020 initiative, AOPA, O&P manufacturers, patient care facilities and others have committed grant funds for clinical research in four areas: osteoarthritis, stroke, traumatic spinal injuries and plagiocephaly. The work of the fifth work group on scoliosis is beginning. O&P needs a stronger research basis on the value of orthotic services to support future reimbursement.

A written report serves as documentation and communicates what the results mean for the patient. The Outcome Assessment & Reporting System (OARS) is currently in beta testing. Change is inevitable in any organization. A few changes of note in 2018 include an amendment to the bylaws, approved by Membership, changing the word “eligible” in reference to affiliate locations to “assessed.” AOPA’s Board and members believe this will encourage fairness in support of AOPA through dues. Renewal of all affiliate locations reflects the value each O&P business receives from AOPA’s advocacy and research on important reimbursement issues. AO PA 2018 A NNUA L REP O RT |

Due to unforeseen circumstances, our president-elect withdrew from AOPA’s board. As a result, as your currently serving president I agreed to serve another year with the invaluable commitment from your Immediate Past President, Michael Oros to also serve another year, while Jeff Lutz, President-Elect, prepared for his new role. Our longtime Executive Director, Tom Fise, concluded his tenure with AOPA after twelve challenging but hugely successful years on behalf of our O&P community. The profession benefitted tremendously from Tom’s leadership.

Looking forward to 2019, we will continue to address the challenges facing the profession. AOPA has enjoyed considerable success this past year on longstanding issues, and we will continue to work hard to support the profession on reimbursement issues and to support technological advancements for our patients. The need to collaborate on all of our advocacy, research, and education initiatives with all key stakeholders—AOPA,

OVERVIEW OF ACCOMPLISHMENTS
ORTHOTISTS AND PROSTHETISTS NOTES This past year has been marked with important legislative and regulatory progress on several longstanding legislative priorities. 2018 started with a legislative victory when Congress recognized the orthotist’s and prosthetist’s notes as being part of a patient’s medical record for purposes of medical necessity. This provision was a key component of the O&P Medicare Improvements Act (H.R. 2599/S.1191) and by pushing this section as a stand-alone item, it was signed into law as part of a Bipartisan Budget Act of 2018 that passed in February. By this change becoming statute, we have provided confirmation that both orthotist and prosthetist notes will be considered by CMS to be officially part of the patient’s medical record for purposes of medical necessity, and with potential assistance with RAC and pre-payment audits.
RETIREMENT OF DRAFT LCD POLICY ARTICLE After a sustained effort by AOPA, the O&P Alliance and others, CMS concurred with its Lower Limb Interagency Workgroup’s recommendation that the draft LCD and Policy Article for Lower Limb Prostheses, initially released on July 16, 2015, should be removed from the DME MAC websites and that the current LCD and Policy Article should remain in force for the immediate future. In June, the DME MACs released a joint publication announcing the retirement of both the draft LCD and Policy Article. The removal of the Draft LCD has been a major goal of AOPA and our lobbying efforts since it was introduced in 2015, because of limitations it put on patient care and reimbursement.
VETERANS CARE
DEAR PHYSICIAN LETTER Four DME MACs published an announcement that the “Dear Physician Letter” on lower limb prosthetics is being retired due to guidance from CMS. While the retirement of the “Dear Physician” letter does not mean that DME MACs will no longer require physician documentation to support claims for artificial limbs, it is a clear indication that they acknowledge and understand that the provisions of the original “Dear Physician letter” are no longer consistent with the law and therefore are not a prerequisite and cannot be used as the sole justification for denying a Medicare claim.

The Department of Veterans Affairs published a proposed rule to “reorganize and update” the regulations on prosthetics and rehabilitative items and services for veterans. AOPA opposed this significant threat to longstanding VA policy and care to veterans. The rule was in direct conflict with the Veteran’s Access, Choice, and Accountability Act of 2014. AOPA sought, received, and submitted to the VA a legal opinion highlighting the longstanding legal commitment by the VA to permit many Vets to exercise their choice for private sector care. After soliciting membership to assist in responding to this VA rule, more than 250members submitted comments through AOPAvotes, whilst AOPA also published an ad in Politico to highlight the inconsistency of the proposal with the concept of“choice” for veterans. Upwards of 80% or more of the prosthetic services are provided to veterans through private O&P practices. A shift to the delivery of care to the VA clinic would result is many millions of dollars in lost revenue. Some O&P practices rely on VA business to sustain their practice. While we await final word, we are confident that the VA rule will not go forward in any form close to what was proposed in October 2017.
OVERVIEW OF ACCOMPLISHMENTS

CO-OP USERS DIABETIC SHOE INSERTS AOPA spent many months in 2017 and 2018 challenging CMS’s attempts to reimburse less for diabetic shoe inserts based on fabrication methods, and achieved another victory when CMS agreed to its continuation of reimbursement with the new milled from scan shoe insert codes at the same level paid for A5513. This positive outcome sets a precedent for other codes where new technology may replace older fabrication methods. Initially, Medicare was not going to cover direct milled inserts at all. This could have meant the potential loss of millions of dollars of revenue. When CMS decided to cover diabetic shoe inserts, they proposed a 14% rate reduction which would have had a significant impact on revenue, prior to AOPA’s intervention and strong advocacy.
ESSENTIAL HEALTH BENEFITS AOPA submitted comments twice to CMS expressing the need to protect orthotic and prosthetic care within the scope of essential health benefits under the Patient Protection and Affordable Care Act. First, when CMS was deciding how it would provide flexibility to states to define essential health benefits, AOPA emphasized that orthoses and prostheses must remain essential health benefits and any action by CMS that restricts or reduces access to O&P services is not in the best interest of quality patient care. Later, in 2018, we responded with similar arguments with respect to CMS’ proposal to change the definition of the term “employer” as it relates to association health plans and whether those plans would cover essential health benefits.

QUALIFIED PROVIDER PROVISIONS – BIPA 427 Late last year, CMS announced that it had withdrawn the proposed rule that represented the first step in creating regulations that would implement the qualified provider provisions for prostheses and custom fabricated orthoses legislated in section 427 of the Benefits Improvement and Protection Act of 2000 (BIPA). While the proposed rule was far from perfect we had hoped that issues that were of significant concern to several provider groups, who viewed the proposed rule as a threat to their ability to continue to provide services within their scope of practice, could have been addressed through changes in a final rule rather than through the complete withdrawal of the proposed rule. But within the context of last year’s changes in administration and the priority the administration placed on regulatory burdens on businesses, the opposition from several high-profile provider groups, and the restrictive language that would significantly limit certain providers from continuing to provide custom orthoses and prostheses resulted in the proposed rule’s withdrawal. Currently, we are still without regulations to implement a law that was passed more than 18 years ago. And lack of this rule exposes the Medicare population to no regulation regarding what qualifications are required to provide custom orthotic and prosthetic services. AOPA advocates for members in every meeting and venue where we can offer our input, and we will continue to fight for members. AO PA 2018 A NNUA L REP O RT |

PROSTHETICS 2020 In the next year, AOPA will continue to ensure that prosthetics are properly positioned for the future value-driven healthcare economy with four key goals – (1) improve the future reimbursement for lower extremity prosthetics (LEP); (2) match appropriate technology to patient needs instead of payer forced lowest cost technology to all patients; (3) define new patient segments benefitting from LEP technology; and (4) separate the O&P profession from DME in the minds of payers. Current plans include further outreach to the CMS Center for Medicare and Medicaid Innovation (CMMI) relating to K-Levels.
CMS INNOVATION CENTER PROPOSAL On the heels of the remarkable results from the RAND Corporation report, Economic Value of Transfemoral Prosthetics, AOPA is working with the Center for Medicare and Medicaid Innovation on a three-part proposal that would explore the health economic benefits of allowing patients with activity level designations lower than K3 to receive microprocessor-controlled prostheses. The proposal also seeks to explore opportunities to expand prosthetists’ scope of practice on certain elements of clinical care, such as monitoring weight change, pain level, medication compliance for coordination with the patient’s primary care provider, with an incremental increase in prosthetist payment. The Center for Medicare and Medicaid Innovation, also known as the CMS Innovation Center, allows the Medicare and Medicaid programs to test models that improve care, lower costs, and better align payment systems to support patient-centered practices.

2020 ORTHOTICS 2020 AOPA has a commitment for clinical research that can answer some of the most important and profound issues about Orthotics, via the new Orthotics 2020 program. This year, AOPA and our many partners among O&P manufacturers, patient care companies, and other entities committed to funding grants—in amounts of up to $60,000-$75,000—in four clinical areas: Osteoarthritis, Stroke, Traumatic Spinal Injuries, and Plagiocephaly. We also created a workgroup for the fifth category, Scoliosis, and developed a critical appraisal of topics and a draft RFP for this category. Stakeholder subgroups for each of the categories met in 2018 to review submissions and grant awards were announced this past summer. AOPA is transitioning Orthotics 2020 into a vital enterprise to protect the orthotic services, upon which patients depend, from attack by payers, and to begin populating a stronger research basis around issues on the value of the orthotic services we offer to patients. In partnership with the Center for O&P Learning & Evidence-Based Practice (COPL), AOPA awarded pilot grants for up to $15,000-$30,000 for six O&P topics in addition to Orthotics 2020 grants.
OVERVIEW OF ACCOMPLISHMENTS
LIMB LOSS AND PRESERVATION REGISTRY The National Institutes of Health (NIH) has awarded the Mayo Clinic and chief investigator, Kenton Kaufman, PhD, a five-year contract for five million dollars to develop a limb loss and preservation registry. AOPA has supported this effort since its inception through the funding of an initial exploration process and grant proposal and is committed to supporting the sustainability of the registry, moving forward.
CONSENSUS CONFERENCE ON PROSTHETIC INTERVENTION FOR TRANSTIBIAL AMPUTEES
The registry will include electronic health records of U.S. adults and children, and will begin piloting hospital data in late 2019, with the expectation of a fully-operational registry by the end of 2020. It will be the first registry of people living with limb loss and will greatly expand the knowledge base for research to improve prevention, treatment and rehabilitation for this patient population.
On September 6, 2018, O&P’s brightest minds gathered at AOPA Headquarters for a daylong consensus conference to discuss existing literature and research gaps in the topic area of prosthetic intervention for trans-tibial amputees. The group produced an initial draft consensus statement focused on the health, economic and quality of life benefits of advanced transtibial prostheses, subject to the process of securing a final sign-off. The panel of subject area experts included Phil Stevens, MEd, CPO, FAAOP; Brian Kaluf, BSE, CP; Ken Kaufman, PhD.; Silvia Raschke, PhD; Brian J. Hafner; Jason Highsmith PhD; David Boone, PhD; Doug Smith, MD; Andreas Kannenberg, MD; Robert Gailey, PhD; Knut Lechler; Saeed Zahedi; Jim Campbell, PhD and Hangsheng Liu, PhD. A final consensus statement is expected to be issued.
OUTCOME ASSESSMENT REPORTING SYSTEM (OARS) This year AOPA worked with Dr. David Boone, MPH, PhD, and a group of computer science engineering students from the University of Washington, to develop an application that will walk a clinician through an outcome measure instrument, with written and video instructions, and create a report, which will include what the result means for the patient with references to the science supporting the measure. This report can then be printed or downloaded as a PDF for the patient’s record. Beta-testing the Outcome Assessment Reporting System (OARS) is in the beginning stages.

EDUCATION AOPA’s varied educational opportunities guide and support members on the path to providing exceptional patient care.
AOPA provides face to face and distance learning opportunities in educational presentations at the Annual National Assembly, AOPA’s coding and billing seminars, and online education through AOPAversity. But in addition to these opportunities, we continue to make advances with platforms such as the AOPA Co-OP, a reimbursement, coding and policy resource. This members-only online resource serves as a collection of concise, but detailed information with links to supporting documentation about the topics most important to our members. The platform’s key subject areas include Medicare, Medicaid, VA, DOD, Commercial Payors, Data/ Evidence, Compliance, State Matters, Good Practices and Trending Topics. The crowdsourcing component of this project allows AOPA to garner the vast knowledge

MOBILITY SAVES Mobility Saves remains our ongoing campaign, which continues to grow on social media, with more than 21,200 “likes” on Facebook “likes” on Facebook, 2,500 Twitter followers, and 160 connections on LinkedIn. The emphasis of the campaign and website has been on the addition of new content, including videos, blog posts, and infographics and support documents for research projects like Dobson DaVanzo and RAND which AOPA has commissioned and/or conducted.

LEADERSHIP CONFERENCE
This year, we held our third Leadership Conference with featured presentations from Alison Cernich, PhD, Bill Stainton, and former Congressman Jason Altmire. Attendance this year included owners, CEOs, COOs, and other senior leadership of AOPA member companies. Dedicated O&P professionals took a weekend to share their thoughts, ideas and often terrific solutions about O&P’s future. Leadership Forum Attendees
O&P POLITICAL ACTION COMMITTEE This year’s PAC fundraiser event had the theme of “Party with a Purpose.” Last year’s Prohibition-themed evening was such a success that we decided to go back in time once again—this year we celebrated the 1970s with a night filled with food, disco tunes, dancing, sunset harbor views, and much more! By supporting the PAC, members make it possible for us to support and promote the legislators who have played such important roles as O&P allies on the Hill. From Rep. Roskam, Rep. Bishop, and Sen. Cardin, to those who have helped in the efforts this past year on matters such as recognizing the notes of orthotists and prosthetists as well as supporting H.R. 4772 and H.R. 2599, including Reps. Glenn Thompson (R-PA), Mike Thompson (D-CA), Peter King (R-NY), Dutch Ruppersberger (D-MD), Erik Paulsen (R-MN), Brett Guthrie (R-KY), Michael Kelly (R-PA), Kevin Brady (RTX), and Richard Neal (D-MA) and Senators Chuck Grassley (R-IA), Mark Warner (D-VA), Bill Cassidy (R- LA), Orrin Hatch (R-UT), Ron Wyden (D-OR), and Tammy Duckworth (D-IL).
POLICY FORUM Ninety-Six O&P professionals and patients visited Capitol Hill during AOPA’s 2018 Policy Forum and met with their Representatives and Senators. Attendees encouraged lawmakers to support the Medicare O&P Improvement Act. While the clinical notes provision was one part of the bill and was part of a Bipartisan Budget Act of 2018, seven provisions remain that have not been enacted. Attendees also requested support for additional funding for O&P research
and education, expressed the importance of veterans’ choice, and took the opportunity to share other issues facing their patients and their businesses. The impact of these visits is not always immediate, but the cumulative effect of hearing from patients, clinicians, manufacturers, and AOPA and other O&P organizations is how we get lawmakers to share our concerns and recognize our responsibility in the rehabilitative process. This is the premier opportunity in our field each year to hear and see first-hand where these important issues and processes stand and what we need for our patients.

AOPA sponsored its 2nd annual Healthcare Compliance & Ethics Week on November 4-10 with scheduled educational webinars, daily compliance tips, and daily questions that allow companies to win daily prizes, including office packs, cash prizes, and resource guides. Resources, including free webinars were available for the 2018 celebration.
O&P PAC DONORS
Corporate Compliance & Ethics Week is an initiative of the Health Care Compliance Association. 2017 was the first year AOPA partnered with HCCA to celebrate Healthcare Compliance & Ethics Week with its members. HCCA is a member-based association for compliance professionals in the healthcare provider field.
NONDISCRIMINATION/ ANTI-HARASSMENT IN THE WORKPLACE In response to increasing awareness of issues involving harassment in the O&P profession, and after developing its own Nondiscrimination/AntiHarassment in the Workplace policy, AOPA has endorsed an Open Letter on Harassment drafted by members of the O&P Alliance, which include AOPA, AAOP, NAAOP, ABC, BOC and NCOPE. AOPA believes that the best defense against harassment is prevention and will increase its efforts to offer resources and education focused on providing safe environments for employees, to minimize offensive behavior and prevent future harassment in the workplace.
