‘Contingencies will ensure UK that critical flows move’ By Joy Orlek SA Transport and Allied Workers’ Union members last week rejected Transnet’s revised wage settlement package, the main element of which included an 11% increase on pensionable earnings, and on Monday downed tools nationwide. Utatu, one of the other two recognised unions, however indicated that it would not strike and undertook to consult its membership on the revised settlement. Satawu has indicated that it will consult its members on the offer during the strike. According to Transnet

acting CEO Chris Wells, Satawu represents 39% of workers in the bargaining unit while Utatu represents 45%. “Accordingly, we expect the impact of a Satawu strike to be less than expected,” he said on Monday, “and the company’s command centres throughout the country are geared to move priority commodities to ensure that the economy runs with minimal disruptions.” FTW sources confirmed that operations had ground to a halt at the Port of Durban on Monday morning. Imminent Lapse of AntiDumping Duties In a Government Gazette dated 07 May 2010 a notice appeared in respect of the imminent lapse of anti-dumping duties for: (i) chicken meat portions originating in or imported from the United States of America (USA) – tariff subheading 0207.14; (ii) carbon black originating in or imported from Thailand – tariff heading 28.03; (iii) paperboard originating in or imported from South Korea (Korea) – tariff subheading 4810.92; and (iv) drawn glass and float glass originating in or imported from Indonesia – tariff subheading 7005.29. The application was lodged by the International Trade Administration Commission of South Africa (Itac). Manufacturers in the Sacu of any of the abovementioned products are required to submit substantiated information indicating that the expiry of the anti-dumping duty would likely lead to the continuation or recurrence of dumping and

UAL launches direct Nigeria call As it celebrates the end of its first year in SA, Universal Africa Lines (UAL), the specialist shipping line to the West African oil and gas fields, has opened a direct shipping route to Nigeria. This makes UALSA the first breakbulk shipping service from SA to call directly on Nigeria, according to MD Haakon R Østad. “Previously the line’s ships

dotted down in Durban, Cape Town, Walvis Bay, Lobito, Luanda (Sonils), Soyo, Pointe Noire, Port Gentil, Malabo, and Onne (Port Harcourt). “Now Nigeria’s main port at Lagos joins the list.” The line's customers are from industries as diverse as steel, paper, explosives, heavy equipment manufacturing, construction material and chemicals. “Their numbers have

increased sufficiently over 12 months to provide a solid basis for growth, starting with the Nigerian connection,” said R Østad. The first direct sailing to Nigeria will be at the end of this month (May), starting in Durban and calling on Cape Town and Walvis Bay before sailing into Apapa harbour, Lagos, 12 days later. Claims soar from R182m to R532m Insurer survives most volatile year in 54-year history The trade debt insurer, Credit Guarantee Insurance Corporation (CGIC), says it has weathered the storm of what it describes as the most up-and-down period in its existence. Commenting on its results for the financial year ended December 31, 2009, MD Mike Truter

said: “The past eighteen months have been the most volatile period in the 54-year history of Credit Guarantee.” Defaulting SA debtor companies accounted for the majority of the commercial claims in 2009 – which soared from R182-million in 2008 to

over R532-m. The largest of these was an amount of R60-m on the failure of an unnamed buying group in the household goods sector. “Substantial export claims were also paid on defaulting importers elsewhere in the world,” Truter added, “the biggest

being in respect of a transaction with a steel importer in the USA which resulted in Credit Guarantee paying an indemnity of over R40-m.” He added that it was clear that many of the company’s clients would not have survived the recession had they not insured their

trade debt risk against nonpayment. “But,” he told FTW, “despite the prevailing economic cycle, we still paid ‘no-claim’ bonuses exceeding R55.1-m to clients on the domestic front and R13.5-m to export clients, indicating that it was not all ‘Armageddon’.”

Will Gama soon be back at his post? Uncertainty surrounds future of TPT/TFR CEO posts By Alan Peat Two of the subsidiaries of parastatal transport group, Transnet, will have to stay without a full-time CEO until the end of an internal disciplinary hearing, according to Transnet spokesman, John Dludlu. This, he told FTW, was the one involving Siyabonga Gama, the CEO of Transnet’s railway unit until he was suspended seven months ago pending a disciplinary process relating to alleged tender irregularities – primarily surrounding the R900-million contract for purchasing 50 locomotives. The public enterprises minister, Barbara Hogan, revealed to the press at the time that, in the locomotive deal with the Electro-Motive Sibanye

Joint Venture, it was alleged that Gama “failed to give effect to a condition determined by the Transnet board in concluding and implementing the contract”. She said the ElectroMotive Sibanye Joint Venture had been paid about R550-million since the deal was signed in May 2007. Also according to Hogan, the security company linked to the communications minister was paid R55million by Transnet under a contract awarded by Gama. Hogan confirmed that he was authorised to sign off only on contracts worth up to R10-m. That meant that both Transnet Freight Rail (TFR) and Transnet Port Terminals (TPT) were without fulltime bosses, because immediately after the Gama suspension, Chris Wells,

himself “acting” group CE of Transnet , did a bit of employment card-shuffling. He put temporary CEs in place to head up the rail and port terminals operations. Tau Morwe, the CE of TPT, agreed to act as CE of TFR pending the finalisation of the disciplinary process. At the same time, Karl Socikwa, Transnet’s group executive (commercial), was named as acting interim head for TPT. Dludlu said that this would be the case until the Gama issue was decided, and the independent external arbitrator made his findings public. Information forwarded to FTW on behalf of Lunga Ngcobo, media liaison officer of TPT, confirmed that this was also the case at the terminal operators. However, although he

“knew nothing official”, Dludlu alerted FTW to a press report in that day’s Business Report. In it writer Slindile Khanyile said that the newspaper had “established” that Gama had “won his arbitration hearing and is due back at work in two months”. But neither Dludlu nor

Gama’s attorney, Themba Langa, would confirm or deny this – with Langa being quoted as saying he knew nothing about the rumour. “The arbitrator told us that he is still busy with the judgment and I think it is fair to wait for him to finish,” he added. To be continued.

King Shaka equipped with ‘latest and greatest’ By Alan Peat The air cargo terminal at the newly-opened King Shaka International Airport in KwaZulu Natal is furnished with all the latest and greatest in equipment and systems. Trading under the banner of Dube TradePort, the terminal’s access controls, scanning systems and physical layout are designed with high security in mind. It has space for 202 aircraft unit loading devices (ULD), of which 48 are temperaturecontrolled. The handling of international cargo is the sole responsibility of Worldwide Flight Services (WFS), while domestic cargo is handled by either the national carrier, SAA, or Express Air Services (EAS). The terminal, which has direct air-side access, allows fast movement of both export and import cargo. It is initially capable of handling 100 000-tonnes of cargo

a year, and has room for expansion to a two million tonne total. Offering ease of flow, the terminal uses the fully automated, elevating transfer vehicle (ETV) – a Germandesigned-and-manufactured system. Large bulk is handled mechanically, while courier goods are handled through an express system. Developed by the same German company, the cargo inventory control system is fed track-and-trace information from barcode scanners fitted to all the moving and stationary equipment – and keeps an accurate record of all the freight movements throughout the building. The SA Revenue Service (Sars) customs, meantime, uses an X-ray system to examine cargo – allowing officials to immediately release or retain the products. WFS uses the “Cargo Spot” system to manage its freight business in SA – a sophisticated cargo

Transnet is actively lobbying government for the premises of the old Durban Airport as a second port for Durban. According to Pumi Motsoahae, a Transnet planning specialist, feasibility studies and other research around the use of the land have been completed and a proposal has been handed in to relevant authorities. “We are proposing that the old airport site be converted into a second port for Durban. It will not be a difficult transition and by providing basic port infrastructure we can develop a facility that will ease a lot of pressure on the Durban port,” said Motsoahae. Government earlier this year appointed a task team to look at what the best option would be for the land use of the old airport, which is considered prime property. Various proposals from private companies have been received to buy the land. This includes one from Comair who wanted to operate its own airport from the site. “We know there are contenders

for the land, but we believe that Transnet has developed a clear and structured proposal. We are putting in major efforts to try to secure this land and to convince government that a second port is the way for the future.” Motsoahae said plans for the port would include a car terminal as well as a 16-berth container terminal.

'Haulier negligence raises premiums' By Joy Orlek A recent FTW article that highlighted the alarming increase in truck hijacking caused by the sloppy procedures adopted by hauliers in employing foreign nationals, galvanised one of our readers into action. “Surely the simple solution would be for the insurers to lay out a protocol to be adopted and used

strictly by the employers, failing which the cover on the goods and the vehicle would be voided,” said John Bewsey. “When their own money is on the line, watch how quickly the employer will do the job properly,” said Bewsey, who sent his suggestions to Mike Brews, chief operating officer of insurers Associated Marine. “I also feel indignant about this negligent behaviour

because if the insurance company loses money they react by increasing their premiums to all of us – so I end up paying for some of this irresponsibility,” Bewsey added. “Whilst we have noticed the increase in claims where foreign nationals are employed, we are currently investigating whether or not the problem is with the particular haulage company or with foreign nationals

New Swazi airport reaffirms ‘white elephant’ status By James Hall The winning football team will have hoisted the Fifa World Cup at least a month before the now-declared opening date of Swaziland’s new international airport, a costly and controversial project whose original raison d’étre was to serve visitors to the games. “The airport will be

operational in August,” Prime Minister Sibusiso Dlamini told reporters last week. However, the terminal building won’t be completed until year’s end at the earliest. Construction is under way at Sikhupe, 45 minutes east of Manzini. Key to the project is a divided highway connecting to Manzini, but no date has been set to commence construction.

Meanwhile, airport costs have escalated from an original estimate of R1.5 billion to R7.5 billion. This is consistent with the ballooning costs of Swazi public works projects, like the new Mbabane by-pass road. The IMF says that given Swaziland’s commercial realities and governmental budgetary limits the airport is an extravagance

that is unnecessary and unaffordable. The new airport’s main runway is finished. It has been built to accommodate wide-bodied planes, which Swaziland’s current airport at Matsapha cannot handle. Blocks and debris cover the tarmac to prevent premature usage by planes. The problem is, once the stones are removed, no airline has

committed itself to use the facility. A source at the only airline currently serving Swaziland said flights would have no choice but to relocate to Sikhupe if government moves customs officers there from Matsapha. Airfreight couriers will have to factor an additional hour road travel time to Matsapha from Sikhupe.

Revised import duty for wheat approved

When are you entitled to duty refunds? … and liability for incorrect determination Our Supreme Court of Appeal recently had the opportunity in 3M South Africa v Sars 2010 ZA SCA 20 to consider two very important aspects of the Customs & Excise Act, No. 91 of 1964, being: • An importer’s entitlement to refunds – or rather the date from which an importer would be entitled to such refunds. • An importer’s liability for arrear import duty arising from an incorrect determination by the Commissioner In respect of the refunds, the Supreme Court of Appeal decided that an importer must appeal (what it perceives to be) a wrong tariff determination by the Commissioner, otherwise his entitlement to

a refund (for over-payments of duty) would be limited to a period of two years preceding the date of the new (correct) determination. Of course it then becomes extremely important for importers to appeal against incorrect tariff determinations, otherwise he could be severely prejudiced if there are delays in obtaining a correct determination. In respect of liability for arrear import duty, the Supreme Court of Appeal decided that the Commissioner could not rely on or seek to enforce its own mistakes. In other words, the Commissioner cannot recover customs duty retrospectively, where the

under-payments of Customs duty were the result of an incorrect tariff determination by the Commissioner. In this case, 3M South Africa imported mats intended for the export market. The Commissioner issued an (incorrect) tariff determination on 11 June 1990, and new determinations during April 1991 (incorrect) and January 2006 (finally correct), respectively. Following the new determinations, the Commissioner sought to recover under-payments in duty from 3M South Africa, and tried to limit 3M South Africa’s entitlement to refunds for exported consignments.

After an investigation into a revised import duty for wheat and wheaten flour by the International Trade Administration Commission (Itac), its recommendations have been approved by the minister of trade and industry – and were implemented by the SA Revenue Service (Sars) from April 30. This followed the application last year by Grain SA for an increase in the domestic dollarbased reference price of wheat, classifiable under import tariff subheading 1001.90, from US$157/ ton to US$260/ton. According to Siyabulela Tsengiwe, Itac chief commissioner, it was found that there had been a sharp increase in

wheat imports since the 2007/08 season. “We considered the cost and price differentials between domestically produced wheat and that produced in the major wheatproducing countries,” he said. “Also that input costs have been rising and that major differences exist in the competitive position of the different wheatproducing regions.” The commission took into account both the low profitability of farmers and the impact of a rise in duty on bread prices, and its impact on consumers, particularly the poor. It decided that the appropriate level of tariff protection was US$215/ton.

To afford what is perceived as an unrealistic increase demanded by labour, Transnet has several options open, he said. “We could increase tariffs, but that’s not appropriate

in view of the increasing pressure from customers and our shareholder to promote volume growth and stimulate the economy. “Reducing capex is also not an option since critical capital investment is necessary to address the ageing asset base and create capacity for future economic growth in South Africa.” The third option would be to reduce head count to accommodate the three times CPI demand from the unions. “What separates us from the unions is the issue of affordability,” said Maharaj.
