Battle brews over payment of depot overstay fees BY Alan Peat There is a potential battle brewing between the shipping lines and SA’s major container depot operators, SA Container Depots (SACD), as the depot giant stands by its legal rights to charge container operators for overstay storage fees, and the lines disagree. And, lurking in the wings as the
private sector argument occupies the centre stage, is the State Warehouse – a not-so-innocent party in the issue. In a lengthy case presented to FTW by Graham Peinke, MD of SACD, he was adamant that, from the inception of containerisation in SA in 1977, container depots were always paid storage charges by container operators for containers and cargo stored.
Nothing really interfered with this arrangement until 2007 when a legal opinion was presented by Hester Hopkins, then an international customs consultant with Durban attorneys, Shepstone & Wylie, and published in FTW. This suggested that customers no longer had to pay storage on goods that had been detained for whatever reason after a period of 28 days.
“This opinion,” said Peinke, “is fundamentally flawed as it took no account whatsoever of the contracting terms between customers and container depots. “When a container operator (CO) – and that includes shipping lines and NVOCCs – stores containers with a container depot it enters into an agreement with the depot by which it agrees to pay rental to the depot for storage

By Joy Orlek The implementation of a single bond covering all customs activities is one of the latest proposals from SA Revenue Service. Comments on the proposal, which is likely to simplify procedures for all

involved, will close at the end of this month. “At present, if you’re a client of Sars, you require a different bond for each client type for which you are registered,” Andre Erasmus of Deloitte explained. “For example, if you wish to hold your own deferment account
with Sars and at the same time are registered under a Schedule 3 rebate item while also operating a bond store, you’ll need a separate bond or surety for each, calculated separately, based on your duty and/or VAT exposure on each. You may therefore end up with three or four different sureties.” The new proposal will allow the holder to apply for one surety to cover all the different types of bonds, says Erasmus. “We’ve dealt with clients who have to manage four or five different bonds. What’s more, over the years the values have changed so if you have one bond that’s much higher and needs to be updated once a year, it makes sense.” While there are no time lines for implementation, unless there are objections, implementation shouldn’t take too long, in his view. The only sticking point could be administrative. “Sars has a number of policies with regard to bonds and sureties and these will all need to be changed to accommodate the new concept,” he said.
Logistics major records loss When you are the world's largest package delivery company and a major in supply chain and freight services you must expect to get hit by a global slump. And UPS has just recorded that doleful story in its first quarter results. The company’s turnover dropped back 14.17% to US$10.9-billion from US$12.7-bn in the first
quarter of 08. This was accompanied by a 51.81% plunge in its operating profits to US$718million from US$1.49-bn last year. It was all the result of its average daily volume of parcels dropping 3.9% – from 15.13-m-a-day to 14.54-m. UPS is practising the usual cost-cutting exercises, including slimming its
worldwide workforce – allowing it to become what UPS chairman and CEO Scott Davis described as “an even leaner, more efficient enterprise”. But he is optimistic about the company’s future. “UPS is making many improvements that are sustainable when the economic climate strengthens,” he said.
MOL profits down In line with the global crisis, the group profits of Japan’s second largest shipping line, Mitsui OSK Line (MOL) – which is a major player on the SA trades with the Far East, Europe and South America – took a serious nose-dive in the 2008/09 financial year (ending March 31, 2009). It recorded a painful 33.3% year-on-year profit drop to US$1.3-billion from US$1.9bn. This from a lesser 4.1% slip in its turnover from US$20-bn to US$18-bn. The global slump, bunker costs, seriously slipping freight rates and a stronger yen combined to reduce gains, said a line statement. MOL's container division was one of the worse performers in the group’s

multifarious shipping activities. It suffered a US$241-million loss, as container sales fell 6.9% to US$6.6-bn. Noting this “significant” profit drop in the containership segment, the MOL report said that it had laid up surplus vessels to reduce space and offset the fall in trade. “We also took action to minimise losses and routes where competition is intense and profitability difficult or impossible. “However, freight rates on all routes, including Asia Europe, dropped while cargo volume declined and competition increased, and our cost-cutting efforts did not offset the falling rates.”

E-learning courses meet learnership requirements School of Shipping has launched a locally developed e-learning platform for the freight industry that meets the requirements of learnerships from the Transport Seta, says School of Shipping e-learning director Colin Doyle. “It is already being used to facilitate training of new learners and those on existing learnerships as well as private students who have chosen to study via computer rather than in a lecture-based environment,” he told FTW. “Students study at their own pace from home, an office computer or even an internet café, with built-in checks that indicate when assignments are due. There are also alerts for employees if learners or students are experiencing difficulties,” he said. People can now receive their tutorials from anywhere in the world and complete assignments which are then marked by accredited

uses a yellow and red card format to indicate overdue material. The yellow card allows some leeway for action by the learner but a red card reflects that material is grossly overdue and, in effect, red flags both the learner and the relevant human resources personnel of employers. “People are fitting their studies into sometimes busy schedules, so we have adopted an almost fun approach to alerts using the sporting yellow and red card system. However, the overall objective is the serious business of enabling learners, existing staff and others to advance in the world of freight forwarding with quality education,” he said. Doyle believes the School of Shipping acts as an end to end e-learning enabler by providing accredited course material and administering e-learning courses on behalf of companies.

Logistics sector faring fair By Alan Peat A total of 347 companies going bung in March represented a 16.8% year-on-year increase in company and CC liquidations – and could be an amelioration in the sharply deteriorating trend that has blighted the business landscape over the past six months, according to Luke Doig, senior manager of investments and economic services at Credit Guarantee Insurance Corporation (CGIC). In his analysis of the liquidation stats for FTW, Doig noted that there was a total of 1 008 liquidations in the first quarter – still some 46.7% above the 687 in the same quarter in 2008. “But,” he said, “both January and February this year were very near to 70% yearon-year growth, and the latest 16.8% figure might indicate an easing off.”

Separating out the March figures for the sector, Doig found that the failure rate of six firms was unchanged from a year earlier. “Also, the year-to-date (YTD) total of 19 firms is marginally above the 18 recorded in Q1’08,” he said. He also felt that the interest rate relief of a cumulative 350 base points (bpots) – allowing prime to be cut to 12% from a peak of 15.5% – would help both ailing individuals and businesses. “Added to this,” Doig said, “the first few days of May have seen an over-recovery on both petrol and diesel which may hint at a cut in early June. “Note however that, at present, this is solely due to the stronger exchange rate, with
crude oil prices remaining sticky at above US$50 per barrel.” There are other possible signs of a bottoming in the current downcycle. Doig noted the tentative pickup in the leading business cycle indicator for February – to 106.6 from 105.9 in January. Also the ‘expected business conditions’ component of the Investec purchasing managers’ index (PMI) creeping up to 48.3 in April from 46.6 in March. “This is however still below the 50 level which represents net optimism,” he said. “It would be folly to think we are out of the woods yet. Lower debt servicing costs are allowing for a realignment of spending patterns as opposed to prompting a resurgence in demand, and the impact of falling employment and crimped consumption levels will require more than just a few quarters to be rectified.”

Wilhelmsen opens Maputo office Wilhelmsen Ships Service has opened an office in Maputo, Mozambique to cater for increased traffic through the port. The company believes that if the fragile political agreement in Zimbabwe holds and the Zimbabwe economy improves, imports and exports through Mozambique will soar. “Increased pressure on South African ports has also encouraged more operators to send cargo through Maputo to inland destinations. The shorter distance to the main mining areas of South Africa make this a cost-effective route for both imports and exports inland,” said regional vice president for Africa, Middle East and Black Sea, Knut Brathagen. Bus operators and taxi associations are in agreement that a rapid bus system is the best way to solve congestion on South Africa’s roads, but who should own it remains a contentious issue. Speaking at the Transport Forum at the University of Johannesburg on Thursday, Braam de Jong, senior operations executive for Putco, said there was no doubt that an improved public transport system was needed to ease congestion and more buses were definitely the way to do that. He, however, said that the City of Joburg’s Rea Vaya BRT project had not left only taxi owners up in arms. “The city did not adhere to the their memorandum of understanding with us. They did not bring bus operators and taxi owners together to talk and they did not respond to the comments we made.” Describing the BRT in Joburg as a “make up as you go” system, De Jong said there was much cause for concern. “They have developed and revised the first phase of this project without any bus operator involvement.” PK Thiba, national executive council member of Santaco agreed, saying taxis had never been opposed to BRT, but were not going to watch their livelihoods being taken from them by a system that had not been thought through.

Ten arrested in hostage drama A hostage drama outside the Table Bay harbour on Tuesday morning led to the arrest of 10 crew members who were holding a Taiwanese fishing vessel captain and his officer hostage. All the president’s men … and women BY Staff reporter The big news as this issue went to press on Monday morning was the new cabinet announced on Sunday by President Jacob Zuma. Key members for the trade and transport sector include: • Minister of Trade and Industry, Rob Davies, with deputies Thandi Tobias and Maria Ntuli. Born in 1948, Davies was previously deputy minister of trade and industry. He holds a Bachelor of Commerce degree from Rhodes University and Master of Social Science and Doctor of Philosophy degrees, both from the University of Sussex. • Minister of Transport, Sbusiso Joel Ndebele, and deputy Jeremy Cronin. Born in 1948 at Rorke's Drift, KwaZulu-Natal, Ndebele was previously KZN premier. He was also one of the longest-serving transport MECs in the country, with two terms from 1994 to 2004.
According to the Natal Witness, several projects he pioneered in KZN were adopted both nationally and by other provinces. For example the Asiphephe Road Safety project was the basis for the national Arrive Alive campaign. The Renaissance Road upgrading programme, which got local communities involved in maintaining roads in their areas as a way of generating income, went national as did the Vukuzakhe emerging contractors’ project. He also pioneered taxi cities and taxi co-operatives. He holds two Bachelor of Arts degrees from the University of SA. Previous transport minister, Jeff Radebe, has been appointed Minister of Justice and Constitutional Development. • Minister of Public Enterprises, Barbara Hogan, with deputy Enoch Godongwana. Battle brews From page 1 to a State Warehouse. “However,” said Peinke, “typically the State Warehouse does not have space for these containers. This then affects the depots, because – if the State Warehouse does not have space – the act provides that a depot may be deemed a State Warehouse by customs. The depot would then have to retain the overstay containers, but now in the guise of a State Warehouse.” Hopkins’ opinion was that – when depots become deemed State Warehouses in terms of the act – the contract between the CO and the depot automatically terminates. This prevents the depot from charging the CO rental on overstay containers.
‘Container operators remain obliged to pay rentals for overstay containers, even when the container depots become deemed State Warehouses.’ Hopkins also suggested that the depots were only entitled to rental from the State itself in terms of the act, and that they were no longer allowed to charge rental to COs once they became deemed State Warehouses. Not so, said Andrew Pike of logistics and maritime transport attorneys, Andrew Pike & Associates, and legal adviser to SACD. “The COs remain liable to pay storage fees charged by the depot for the overstay container/s, as the act in no way overrides the trading terms,” he told FTW. “This is because the latter are agreed to by both parties and are not in conflict with legislation. The trading terms of some of the depots, in fact, specifically state that the contract continues, even
after the depot has been deemed to be a State Warehouse.” And, as for the State Warehouse paying these virtual state warehouses (VSWs) for storage, Peinke laughed it off – telling FTW that SACD hadn’t received a single buck from the State for its surrogate SW role. Pike agreed. “The reality,” he said, “is that few, if any depots, have ever received rental from the State when they have been used as deemed State Warehouses.” But his opinion – supported by that of FTW’s legal adviser on maritime issues, Andrew Robinson, director of Deneys Reitz – is that it is clear that it was not the intention of the legislature to discard or override a legitimate commercial contract between the CO and the depot. “If this were allowed,” said Pike, “the depot would be greatly prejudiced as potentially no equitable compensation would be received for usage of its storage facilities.” What it all boils down to, according to Peinke, is that the container operators remain obliged to pay rentals for overstay containers, even when the container depots become deemed State Warehouses. “It’s that plain and simple,” he added. While the depot operators agreed with the lines’ desire to have their containers returned to them promptly, they argued with Hopkins’ assertion that the act did not apply to the containers, but rather to the goods inside. Pike said that, if this were true, it would then follow that the depot could charge storage for the goods themselves, using its own commercial rates. “Therefore,” he added, “even if the proposal were correct it would not take away the COs’ liability to the depots for storage charges because both the containers and the goods inside them are subject to the trading terms of the depots.”
