Thankfully, they are very aware of this reality, and the efforts of their board leadership, staff, and member volunteers reflect their strong commitment to making sure this continues to happen. Here, at home, AAOC has four standing committees — Education, Legislative, Membership, and Product & Service Council — whose members actively participate in the assessment of association programs and services. They also contribute to the development of new or the reimagining of existing offerings to help ensure their continued relevance and value to the membership. Our committee members provide a very valuable service, and I appreciate their insight, guidance, and leadership. What I also appreciate is receiving feedback from the membership at large, letting me know how AAOC is doing and providing me with additional insight about the programs and services the association offers. Applicants with a Criminal Record: The Next Protected Class?

A

ssembly Bill 1241 was authored by Assemblymember JonesSawyer. Member Jones-Sawyer represents Assembly District 59, which generally covers parts of downtown Los Angeles. Assembly Bill 1241 (“Bill”) was set to be heard in the Housing and Community Development Committee on January 12, 2022, and in the Judiciary Committee the following day. Clearly, by the time this article is published, the dates will have passed and the decision of the author to NOT to proceed with the bill. However, the issue is very much still alive. As such, it will be imperative for rental property owners and managers to keep a close eye on its progression and a strong possibility of another bill in this area of law and/or regulatory activity. The bill’s intent is to amend several sections of the Government Code to provide the formerly incarcerated an opportunity to receive thorough and fair vetting when seeking rental housing. As a rental housing property owner or manager, the language in this bill is important because the author alleges it offers a fair chance to former wards of the state to find rental housing; it also claims that the bill is not intended to compel, or otherwise require, a rental property owner to provide rental housing to any individual. Proposed Government Code Section 12955.05 says that a rental housing property owner shall not require any applicant for rental housing to inquire about or disclose a criminal record

during the initial application phase; only after successful completion of the initial application assessment may an applicant be requested to complete a criminal background check. And that proposed code section 12955.05 defines a “criminal record” as criminal offender record information as defined by Penal Code section 13102. Section 12955.05 defines “initial application phase”

criminal background check, or evidence of rehabilitation or other mitigating factors, which may include any of the following:

the period before a decision is made to rent or lease a rental housing accommodation, which includes the time during which a person seeking a rental housing accommodation requests, and is provided with, an application and the time during which the assessment of rental history and credit history, the checking of sources of income, and the scheduling of an applicant interview routinely occur.

• Educational attainment or vocational or professional training since conviction, including training received while incarcerated;

If a rental housing property owner considers the denial of an application based on the criminal background check, then the rental housing property owner must provide the applicant with a written statement listing the reasons for the possible denial before making a final decision, within five (5) days of receiving the criminal background check. The applicant is then required to provide notice, either orally or in writing — if requested by the rental housing property owner, of evidence demonstrating an inaccuracy of items within the

• Satisfactory compliance with all terms and conditions of parole or probation; • Employer recommendations related to a person’s postconviction employment;

• Completion of or active participation in rehabilitative treatment, including alcohol or drug treatment; • Letters of recommendation from community organizations, counselors, case managers, teachers, community leaders, parole officers, and probation officers who have observed the person since the person’s conviction; • A person’s familial relationship with a person who may be currently residing in the residential rental housing unit; • The age of the person at the time of the conviction; • Explanation of precedent coercive conditions, including physical, emotional, or sexual abuse,


untreated substance abuse, mental illness, or disability that contributed to the conviction; • The amount of time that has passed since the date of conviction; • Evidence that the individual has maintained a good tenant history before or after the conviction, or both. The rental housing property owner shall then reconsider possible denial; if the denial is final, then the rental housing property owner shall notify the applicant of the final decision in writing no later than five (5) days after receipt of the applicant’s evidence. Additionally, a rental housing property owner is prohibited from seeking, considering, or taking an adverse action from or against an applicant, during any stage of the application process or in the application itself based in whole or in part on any of the following:

consideration of the nature and severity of the crime and the amount of time that has passed since the criminal conduct occurred; • Information pertaining to a conviction that occurred more than seven years before the date of the application for rental housing accommodations. Finally, there are two (2) instances in which a rental housing property

owner is required to provide notice in the application for tenancy. The first is when criminal records are used as part of the screening criteria to evaluate an applicant. The second is when criminal record background check will be requested.

• A previous arrest that did not result in a conviction; • Participation in, or completion of, a diversion or a deferral of judgment program; • A conviction that has been judicially dismissed, expunged, voided, invalidated, or otherwise rendered inoperative, including, but not limited to, as is provided under Section 1203.4, 1203.4a, or 1203.41 of the Penal Code; • A determination or adjudication in the juvenile justice system or information regarding a matter considered in or processed through the juvenile justice system; • Information pertaining to an offense other than a felony or misdemeanor; • A conviction that is not directly related to one or more substantial, legitimate, nondiscriminatory purposes that support the owner’s practice. In determining whether a criminal conviction is directly related, a practice should include February 2022

the basis of the possible denial, or evidence of rehabilitation or other mitigating factors.”

Sacramento — continued from 7 manager whose practice is to request a criminal background check for the purpose of consideration for tenancy is required to modify the application process. The modification pertains, generally, to a select number of individuals who have criminal records; yet, because of new and stringent notification requirements, rental housing property owners or managers will be required to modify every application to cover for the potential instance in which an applicant with a criminal record may be applying for tenancy. This puts an extra burden on the rental property housing owners and managers as it pertains not only the application, but with the entire process of considering whether to rent to someone with a criminal record.

If a rental housing property owner intends to request an applicant to undergo a criminal background check, then the following language would have been required to be provided to the applicant and should be included in all applications during the initial application phase. “The owner of this property is requesting a criminal background check. If your application does not satisfy the property’s criteria with respect to criminal records, you will have three days after the possible denial to provide orally, or in writing if so, requested by the owner of the property, evidence demonstrating the inaccuracy of the item or items within your criminal record that form the basis of the possible denial, or evidence of rehabilitation or other mitigating factors.”

Recommendation

If a rental housing property owner considers criminal records as part of the screening criteria to evaluate whether an applicant may reside on the premises, then the following language would have been required and would have mandated the following language in applications to rent residential real property: “This property will conduct a criminal background check as the final part of the screening process. You are not required, and the owner of the property may not require you, to disclose a criminal record until your application has satisfied all of the property’s other screening criteria, unless otherwise required by state or federal law. If your application does not satisfy the property’s criteria with respect to criminal records, you will have three days after the possible denial to provide orally, or in writing if so requested by the owner of the property, evidence demonstrating the inaccuracy of the item or items within your criminal record that form

Additionally, the bill would have required that all rental housing property owners and managers should develop a new policy, new forms, and a calendaring system pertaining to the accurate and appropriate handling of the application process when a criminal record is received. Rental housing property owners and managers should request that any applicant that has a criminal record to provide the evidence of inaccuracy, rehabilitation, or other mitigating factors in writing only. As such, it is recommended that all rental housing property owners and managers create new documents addressing the applicant’s requirements to continue the application process. We, however, had a much different opinion. It would have required owners to adopt an artificial, lengthy, costly, and burdensome five (5) step application process in order to fill any vacancy. • Phase One: During the “initial

application assessment phase,” tenants may be screened, but criminal history questions and background checks are off limits. • Phase Two: After the initial assessment phase, landlords are allowed to ask about criminal history and perform a criminal background check. • Phase Three: Landlord must then provide a written statement to any applicant he or she wishes to deny tenancy explaining his or her decision. • Phase Four: A landlord must then give any applicant who was denied tenancy 14 days to respond with evidence demonstrating the inaccuracy of a criminal record, or evidence of rehabilitation or mitigation. • Phase Five: If a landlord receives a response from an applicant, the landlord must delay making a final decision for a “reasonable period,” and reconsider his or her decision in light of the new information. Only after going through these five phases is a landlord allowed to deny tenancy based on criminal convictions. In our opinion, the bill would have forced owners to hold units off the market for no less than a month; the five-phase application process is unprecedented and unwarranted; it creates a new, protected class of individuals that have voluntarily made a choice; and lays open a question of new, uninsurable actions. Redistricting Brings Stability to Election Process

I

t took six years, a complete change in how elections are conducted, the advent of a practice known as ballot harvesting, three years of consistently partisan news, and the single most polarizing president in recent memory to clearly demonstrate just how safely drawn California’s legislative districts truly are. The districts of the 2000s (2000 and 2010) were almost completely safe the entire time they were in place. And

except for a bit of a Republican blip following “Contract with America” messaging in 1994, representation of our districts during the 1990s didn’t change hands between the parties much either. That is how impactful the redistricting process is — that in 30 years we’ve only seen a few seats switch parties (and sometimes switch back the next election). Through three impeachments, housing crises, the “dot com” bubble, 9/11, Iraq/Afghanistan war,

Benghazi, Russiagate, and other major political events during this time, very few changes in political representation have occurred locally — due in large part to redistricting. It brings stability to the election process and facilitates more consistent representation of communities. I think most people would prefer this to the potential for drastic changes every two years and helterskelter representation that could cause more harm than good for the commu-

nities and people being served. To facilitate a more balanced redistricting process in California, that avoids legislative gerrymandering and other political gamesmanship that historically benefitted the political party in power at the time, California voters in 2008 and 2010 approved measures to create a 14-member redistricting com-

mission comprised of five Republicans, five Democrats, and four individuals with either a third party or no party affiliation. The commission adopted California’s new legislative maps in December, and with the redistricting processes now complete, let’s take a look at how Orange County’s Congressional, State

Legislative, and County supervisorial districts will look for the next 10 years. We’ll take a look at Riverside County’s districts in a future article, when comparable maps are available.

Dear Maintenance Men:

Our residents are complaining that the laundry room dryer is not drying the clothes in a timely manner. We checked the dryer and there is plenty of heat being generated. What do you think the issue is? Sherri

Dear Sherri:

You are describing a classic clogged dryer exhaust hose or line. In a laundry room scenario, there are sometimes long exhaust tubes, and these tubes will accumulate lint over the years. This will make the dryer’s exhaust very difficult to work efficiently. Luckily, this is a very easy DIY fix! 1. Go to a Home Depot or a Lowes Home Improvement store and purchase a dryer duct cleaning kit. Most kits are good to clean about 12 feet of ductwork and extra lengths of rods are sometimes available if your ducts are longer.

3. This is a good time to replace the flexible tube between the dryer and the wall or hard exhaust tube. 4. Connect the brush that came with the vent cleaning kit with the first section of cleaning rod. The cleaning kit comes with a number of cleaning rods and a brush. 5. Connect the first section of the cleaning rod to a drill motor set on low. Push the brush into the exhaust tube in the wall or along the floor. Using the drill motor to turn the brush in a clockwise rotation. If the dryer is difficult to access, start the cleaning from the far end of the exhaust tube and work your way to the dryer. Pro Tip: If the dryer is connected to the tube and you are starting the cleaning from the outside going in, turn on the dryer on “Air Dry.” The air pressure will help push the lint out the tube as you clean the tube with the brush.

6. Continuing with the clockwise rotation, pull the brush out and clean off the accumulated lint. Attach a second rod to the first one. Again, turn the drill motor in a clockwise rotation at all times. If you reverse the rotation, the rods could come loose in the exhaust tube.

7. Keep adding rods until the brush comes out the other side or end of the exhaust tube. Extra rods can be purchased or attack the exhaust tube from both ends if you don’t have quite enough rods. 8. Reconnect the dryer flex hose to the exhaust tube. Turn on the dryer to “Air Dry” and allow the force of the air to push out any remaining lint and dust. The Dryer Vent Tube should be cleaned once a year. A cogged tube is both a fire hazard and waste of expensive power.

I’m doing some preventive maintenance with spring coming up. I’m considering installing ceiling fans in my units to help my residents keep cool in summer and save energy. Is this a good plan? Sam

Dear Sam:

Personally, we love ceiling fans and encourage their use. Most people feel cooler with a fan moving the air, but that increased comfort doesn’t always result in their lowering the air conditioning thermostat. We don’t believe the fans will actually lower the temperature of a warm apartment significantly, but it does look good spinning there and will give the appearance of cooling. Given a choice, a potential resident will most likely choose a unit with a ceiling fan. If you really want to lower utility bills and cool the units at the same time, install a powered, temperature-


controlled attic fan and/or attic insulation. Insulation alone will have a dramatic effect and often the utility companies or cities have programs to provide and install the insulation at little or no cost to the owner. All that being said, yes, good plan!

Dear Maintenance Men:

I have a laundry room problem. I am forever repairing drywall holes that have been kicked in. How can I stop the tenants/kids/visitors, etc. from abusing my laundry room? Steve

the laundry room walls. T-111 plywood comes in a 4x8 sheet and has vertical lines running through it. Typically, T-111 is used for garage door sheathing and building siding. Installation is fairly straight forward. We cut the plywood in half, producing 4x4 sheets. These are then screwed to the wall at every 16” or at each wall stud. The lines should be vertical. Then install a 1x4 plank to trim the top of the sheet along with a plank at the bottom as replacement for the base coving. Caulk all

seams and edges, then paint with primer and enamel paint of choice. Meeting recap — continued from 14 in January (20 years after SB 732 became state law) that rental-housing providers distribute to all prospective renters, a just-completed state booklet on preventing dampness and mold in apartments. Other topics covered included a reminder about the property tax reassessment provisions of Proposition 19 and the handling of inter-generational transfers of property, as well as AB 468 and efforts to address the issue of fraudulent emotional support animal documentation. COVID-19, of course, continues to be a major issue for rental-housing providers, and there are many who have questions about the resumption of unlawful detainers, as well as their options for collecting back rent that is owed by their tenants.

Duringer provided a refresher on the COVID 19 Tenant Relief Act (AB 832) and reminded the audience that we are still in the “recovery” period — which ends on March 31, 2022. He stressed that residents who are experiencing difficulties paying the rent must apply with the state “Housing is Key” rent relief program before any legal action can be taken by the housing provider. He encouraged everyone to keep a detailed log of their conversations with the state and noting the case number provided. When it comes to collecting back rent that is owed, once notices are served, housing providers have the option of pursuing legal action through a civil lawsuit or small claims court. Duringer indicated that each option has its pros and cons, and legal counsel should be sought to determine the best course of action. Also discussed was the Santa Ana rent control and just cause eviction ordinances that took effect last November. With rents in the city now capped at 3 percent or 80% of CPI (whichever is least), housing providers must now go through a petition and appeal process if they wish to increase rents above the cap. Duringer explained that it is a long and expensive process for the investigation to occur, with an

uncertain and possible dubious outcome. Duringer recommended that housing providers in Santa Ana implement month-to-month agreements. The webinar concluded with a variety of “trends” and “issues” to watch and monitor in 2022, including: further attempts to restrict criminal background checks for resident screenings; providing taxpayer-funded legal representation for tenants; clarification of rules regarding the differentiation of emotional support and service animals, and the ever-looming efforts to enact more restrictive rent control and just eviction requirements beyond what has already occurred in Santa Ana. Will your Building be 1-of-16 Red-Tagged? Evaluate your apartment building for earthquake risk

N

obody knows exactly where or when the next major earthquake will strike, but we do know that quakes are inevitable in California and many other states. It’s also clear what types of buildings will likely suffer the most damage from seismic shaking. Beyond these basic points, it’s always best to assess your apartment building’s specific risks by having it inspected by a qualified engineering team to identify its unique strengths and weaknesses. Building failure is the primary cause of death, injury, and property loss suffered from earthquakes. Many structures considered safe 25 or more years ago have since been proven very vulnerable to violent ground movement experienced during major quakes. Even smaller quakes can weaken buildings over time to cause critical failures. Scientists and engineers have pinpointed five main building types that present significant risks to building owners, tenants and communities.

Earthquake risks in Orange County

Active earthquake faults in Orange County run along the coast and mountain ranges, hitting places such as Huntington Beach and Yorba Linda. And the hillside communities of Laguna Beach, San Clemente and Santiago Canyon are prone to landslides that can be triggered in a major earthquake, potentially undermining the foundation of a building, or sliding into one. Liquefaction areas can be found throughout the county, most notably wherever water flows either above or below the ground such as in the aquifer-rich region of central and coastal Orange County, Garden Grove, Santa Ana, Irvine, Huntington Beach, and Yorba Linda, to name a few. Given these findings, income property owners should consider several economic factors when weighing the cost benefits of a seismic retrofit. These factors include potential loss of income, loss of equity, bankruptcy, and liability associated with damage, death and injury caused by earthquakes.

Officials estimate there are as many as 300,000 structures in Southern California standing today that could crumble or collapse in an earthquake. These numbers equate to one in every 16 buildings, according to a United States Geological Service assessment. In fact, buildings in the Greater Los Angeles area (which encompasses Los Angeles, Orange, Riverside, San Bernardino and Ventura counties) have up to a 5% chance of being damaged by an earthquake this year, according to the USGS. These vulnerable structures include but are not limited to: • Soft-story structures built before 1978 • Unreinforced masonry built before 1933 • Concrete tilt-up built before 1980 • Non-ductile concrete built before 1977 • Steel moment frame built before 1996 If your building falls within one of these categories, you should arrange for an engineering study to assess the structure’s unique circumstances, which will include its structural design and composition, as well as soils composition and proximity to nearby fault lines.

Hideaway desks, swivel lighting and sound-reducing materials are becoming in-demand features to support those who work from home. In fact, searches for “vibey lighting” have increased by 400%, illustrating the desire people have for that in their home.

When your back is up against the wall and you need a good plumber, look no further, you just found one. In 1990, I realized what my purpose in life was. I started my plumbing career as a plumbing apprentice with a local plumbing company. I quickly moved up the ranks as a newly recognized plumber. Being fascinated with big repair jobs, I would team up with other plumbers to do re-pipe and major repair work, learning the trade and sharpening my people skills with our customers. These skills are critical to pinpoint the repair but most importantly to charge a fair amount to the customer for their specific need. Over the years, I continued to work for plumbing companies and mastered my plumbing skills. In 2020, I began to take my plumbing career in a different direction. I purchased a plumbing van and studied for my contractors’ license while continuing to work a regular job. This consisted of all types of handy work but plumbing was always the main focus of my career. In August 2021, I took my exams and received my contractors’ license. Next came all the steps in setting up my business. It felt like a dream. By October 15, 2022, I was ready for business! To this day I still feel a rush when a customer calls me for my professional services. What a great honor it is to serve my customers in need.
