ast month, I talked about education being a core service provided by the Apartment Association of Orange County (AAOC), and the importance of members continuing their professional education, no matter how many years they’ve been a rental housing provider.

With the AAOC Trade Show & Conference coming up on Thursday May 5, 2022, I thought I’d shine the spotlight this month on the free educational seminars and maintenance demonstrations that will be presented that day.

The sessions will cover a wide range of topics beneficial to independent rental owners, property management company staff, and other multifamily housing professionals. My Lessor, Not My Lord

T

he Apartment Association of Orange County (AAOC) is proud to sponsor AB 2503, by Assemblymember Cristina Garcia, who represents the cities of Downey, Bellflower, Norwalk, Cerritos, Commerce, and Montebello in the 58th Assembly District.

AB 2503 was introduced upon the principal of equitability with emphasis

on purging an outdated and in the opinion of many, offensive terminology for rental housing providers — “landlord.” In our neck of the woods, “landlord” is often used as a tool to legitimize changes in law that we have to unfortunately oppose.

We believe the term “landlord” started 1066, when the Normans of France conquered England, and William

the Conqueror pronounced himself as King William. The King used a feudal framework of land control to retain political power in lands far away. Under this framework, land was owned by the King; the King gave portions of that land to lords, who then permitted a vassal (tenant) to use smaller portions of the lord’s land — so long as the vassal pledged his allegiance to the lord.1

Feudalism, however, stopped in the 14th century and whilst the lords and their manors had long been forsaken, the idea behind land use continued to mimic an owner/tenant relationship.

As time passed, allegiance was replaced by coin and free will in terms of housing because human beings recognized that housing is vital to human existence.

In 2022, nearly a millennium after King William’s proclamation, the most progressive state in the United States of America continues to use the terms “landlord” and “tenant” to describe the legal parties of a rental agreement. The time is now that these archaic and medieval terms are put back where they belong — in the very distant past.

We use the term “landlord” in contracts, regulation, our system of laws.

But we also use other terms as we have struggled to find an alternative term that is neutral, modern, easily recognized, not offensive, and does not require massive work for anyone to adjust, modify, or interpret existing contracts or decisional law.

Let’s look at where the law needs to be changed that would improve everyone’s approach and viewpoint.

A rental agreement is a contract for tenancy where one person provides a service to another person. In the case of rental housing, a person who owns and/or operates property provides a service to a person who requires property by renting it. Like all other service agreements that reference the parties of a contract as “lessor” and “lessee,” so too should the parties of rental housing be referred.

Additionally, Civil Code section 1940, et seq., (in addition to Civil Code section 51, et seq., Code of Civil Procedure section 1161, et seq., and Government Code section 12955, et seq.) are chapters frequented by attorneys and layman, alike, because it is the state’s rental housing handbook. Yet, while it’s words of guidance must be strictly followed, some are superfluous and burden the creation of a rental agreement because there are several instances of

ambiguity due to the number of different terms using the same definition, and several sections defining terms already defined. We have found that these laws refer to rental property owners as “landlord,“ “housing provider,” “owner,” etc. We cannot think of another area of law relating to real property where there are several words struggling to mean the same thing.

AB 2503 therefore proposes to do the following:

1. Remove “landlord, “property owner,” “owner,” “rental property owner,” and replace with “lessor.”

2. Remove “tenant” and add “lessee.”

3. Remove “agreement” with the term “rental agreement,” when referencing a contract for tenancy.

4. Remove “his,” “he,” “himself,” “his or her,” or “he or she,” and replace Sacramento — continued on page 8

Remove the terms: “owner or owner’s agent,” “landlord or authorized agent,” “landlord,” “landlord, or his or her agent,” “owner or his or her authorized agent,” “landlord or the landlord’s agent,” “landlord or a landlord’s agent,” “owner or landlord,” “landlord or property owner,” “owner,” “owner or an owner’s agent,” “landlord or owner,” “landlord or landlord’s agent,” “lessor,” and replace with “lessor or lessor’s agent.” (C) The term “knowledge” used (located in the second line) in Civil Code section 1940.7, subdivision (b) is misspelled as “knowledcge;” the term should be spelled correctly.

Sacramento — continued from 7 with the following words, as appropriate: “lessee,” “lessee’s,” “the lessee’s,” “the senior citizen’s,” “their,” “an,” “the person’s,” “the lessor or lessor’s agent,” “the party’s,” “lessor’s,” “the lease or rental agreement.”

5. Remove “dwelling,” “unit,” “rental property,” “rental dwelling,” “residential dwelling unit,” “apartment,” and replace with “dwelling unit.”

6. Make other related non-substantive changes for the purposes of clarity, uniformity, and reduction of redundancy. For example: (A) the term “property” is used to describe both a “dwelling unit” in multifamily rental housing and single-family rental housing. “Property” also is used to describe the multifamily rental housing complex including the land, common areas, etc. When a lessee rents a multifamily dwelling unit, the lessee does not have a right to possess or access the entire “property.” When a lessee rents a single-family rental housing, the lessee does have a right to possess and access the entire “property.”

Additionally, some codes use the term “premises” to describe a “dwelling unit” in multifamily rental housing. Therefore, the term “property” should be removed and replaced with “premises,” when referencing a rented dwelling unit in multifamily rental housing. (B)

7. Make a comprehensive overhaul of the offensive terms that are vastly outdated by replacing those terms with acceptable and neutral terms that are customarily used in commercial real property and other service contracts.

Conclusion

The legislature, and tenant groups alike, have a general distaste for the term “landlord” and more often than not create a narrative that all residential rental property owners and managers have capital in droves, enough so to throw “chump change” at attorneys to hustle tenants. The reality, however, is painted in a different light, captured from an angle that many forget when the view is clouded in bureaucracy. The reality is this — without “tenants” there are no property owners or managers — full stop.

Lessors desire lessees at full capacity because lessees are an integral part of a “well-oiled machine.”

And while it is known that some property owners cater to the likes of Robin Leach’s “Rich and Famous,” these few are not representative of those who house the public. The average fee to retain a California “landlord/tenant” attorney is $250.00 per hour; not including the fees, costs, or rent loss associated with an appeal; or a judge’s

discretion to limit, or grant, fees to a prevailing party due to lease provision language.

In the current climate, lessors are just trying to make sense of the onslaught of increased legislative burdens being placed on lessors due to California’s housing crisis. And to keep up, lessors have increased their attorney fee consumption since the passing of AB 1482 (statutes of 2019) just to maintain legal compliance.

It’s time now, for lessors and lessees to begin reaching across the table to shake hands in compromise for the greater good — housing Californians; otherwise, like a family court judge, the legislature will decide how the residential rental housing industry operates, and it isn’t likely lessors or lessees will appreciate the government’s “handholding,” especially when both parties are required to release private information to governmental departments in order to find/provide housing. Yes, you got that right — these types of bills are being proposed by some legislators this legislative session.

AB 2503 could be a new era in residential rental housing because the genesis offers neutral and equitable titles to parties entered into a contract for rental housing; and uniformity and clarity of the law that can be deciphered by either party for a clearer understanding of the law and legal consequences as they pertain to both parties of rental “contract.”

Giving both lessors and lessees the ability to understand the law empowers either party to feel confident when protecting their housing and contractual interests without a fear of financial burden based on additional and sometimes exorbitant legal costs and fees.

ooking at the breadth of issues we face in the multifamily housing industry here in California can be daunting. This year alone there are proposals at both the local and statewide levels seeking to – • Declare housing a human right – effectively socializing all property • Define renter’s debt as consumer debt – making it possible for judicial discharge • Mandate installation of electric vehicle charging stations in multifamily properties • Ban credit checks from being used in a rental application Those, of course, join our old friends: • Instituting a statewide rental registry • Banning the box for felons on rental applications • Further eviction protections for domestic abusers When you look at these proposals, it is easy to sit back and ask, “Why would anyone want to be involved in this industry in this state?”

Then you hear about policies like those in Texas, Florida, and other states where it seems one is able to remove problematic tenants from their communities with the speed and efficiency of an ejector seat in a James Bond movie.

Maybe instead of Aston Martin, for us it’s really Austin Martin. I know — Dad joke.

I know in my role with the association I have come across that feeling — often.

But it turns out we are not alone.

Not by a long shot.

The National Apartment Association (NAA) held its “Advocate!” conference in Washington, D.C. in March — bringing together industry leaders from around the country. One of the meetings featured an extensive discussion on the housing policies we are all facing. The idea behind this was if we can share and troubleshoot the issues and tactics, we can defeat the policies nationwide.

I kind of anticipated that our colleagues from San Diego, Santa Barbara, Los Angeles, the Bay Area and other areas would be the lead villain of this horror story.

“Back in St. Louis, we are talking about rent control — thanks to our friends from Minnesota.”

“I’d like for us to discuss this notion of “housing as a right,” chimed in a colleague from Buffalo.

“Outlawing security deposits is becoming an issue for us,” one Texan threw out there.

“Mandatory EV charging stations and set aside parking spaces” “Forbidding evictions” “Tenant first right of purchase with 180-day refusal period” Tacoma…Phoenix…Nashville…

behind these efforts, origins of the issue — and the groups promoting the policies in each area. We heard about studies to counter the arguments, polling strategies to find messaging, and even how to coach our colleagues and elected officials on how to fight the pressures to pass these issues. The interaction was amazing.

The collective knowledge of how to respond to these issues was immense – and seeing the sharing occur between regions helped clarify the one thing we all needed to have reaffirmed.

We are not alone.

What’s more, NAA has responded with a series of resources, programs, and tools for us to meet these needs.

Questions & Answers I have a tenant who has not paid rent since the COVID-19 Pandemic began. I was told that I could not evict for unpaid rent during the COVID-19 Pandemic. Can I evict based on the tenant’s failure to pay rent? If I evict for failure to pay rent, do I still, as a housing provider, have to apply for rental assistance?

Yes and Yes. The last few years have been a confusing period for all involved in this industry. There seems to be a new law every couple of months, and it can be hard, at times, to keep up with.

But, as of October 1, 2021, housing providers are once again able to evict tenants based on failure to pay rent, regardless of COVID-19 hardship.

However, this comes with some caveats. You can only evict for unpaid rent that became due on or after October 1, 2021. In addition, as part of the broad tenant protections enacted in California in response to the COVID-19 Pandemic, state law requires that landlords apply for rental assistance and wait 20 days for the tenant to respond before filing a

complaint in court. In short, yes, you can evict based on unpaid rent, but only for rent due on or after October 1, 2021, and you need to apply for rental assistance for any amount claimed in the notice to pay. Note: This law requiring you to apply for rental assistance prior to eviction is currently set to expire on March 31, 2022. If the law is not extended, you will no longer need to apply for rental assistance to evict a tenant for unpaid rent.

I have an eviction case pending against a tenant based on nonpayment of rent. I completed an application for rental assistance, but the tenant did not complete his part of the application. On the day of trial the tenant appeared and showed the judge a pending a rental assistance application that I have never seen before. The judge continued the trial. What does this mean?

Can I not evict the tenant, even though he did not complete his rental assistance application that I sent him?

The short answer is that as of right now, the court will not award you possession of the premises in rent-based cases if there is a pending rental application.

Thus, even if the rental assistance application is untimely (not completed within 20 days of the notice) the courts are still not going forward with trials if there is pending rental application. One of the most frequent topics of questions we receive at the Duringer Law Group, PLC is regarding the status of rental assistance and, specifically, how to deal with Housing Is Key. As discussed above, state law requires housing providers to apply for rental assistance before they can proceed with an eviction case based on unpaid rent. Most housing providers have had direct dealings with Housing is Key or a local agency and know the rental assistance program is far from efficient. We are seeing many AAOC members and clients do their part by creating a rental assistance application only to have the application sit unanswered by the tenant. Then, after waiting the 20 days, filing their complaint, and appearing at trial, the tenant then presents his or her own pending rental assistance application.

This results in wasted time and expense.

In an ideal world, your tenant’s application would be automatically linked with your application, but that is not the case in reality. To fix this problem and prevent this confusion, the best way to figure out whether there is pending application is to be proactive by contacting your tenant and/or the

rental assistance agency to inquire about the tenant’s application. Being proactive is the best way to prevent wasted time and expense. In addition, the saying “the squeaky wheel gets the grease” is very true in this setting.

Constantly calling and inquiring about the status of your application may ultimately help move the process along and ensure that the rental assistance agency has all the information it needs to process your application.

Now trial is continued, and I have the rental assistance application linked, what’s next?

The current law prohibiting rent-based evictions when there is a pending rental assistance application remains in effect until March 31, 2022. This date may be extended, however, as of the date of this article, the law has not been extended.

This same law requires mandatory status conferences set no more than 15 days apart, in which the court is to be notified of the status of the rental assistance application. As such, many cases are currently stuck in eviction purgatory with status conferences set every few weeks. Unfortunately, this is likely to continue as long as the current law is

in place. However, once the law expires, application status will no longer be relevant and your case will proceed. We are doing everything in our power to ensure this law does not get extended and expires at the end of March.

My tenant recently moved out and I was told that I cannot use the security deposit to cover unpaid rent during the COVID-19 protected period, is that true?

No. Once the tenant has vacated the property, you may apply any remaining balance of the security deposit to unpaid rent. With that said, where some confusion may lie is that there was a new law enacted in response to the COVID-19 Pandemic that prohibits a housing provider from applying the security deposit to unpaid rent while the tenant is still in possession. Therefore, if the tenant is in still possession, the security deposit cannot be used for unpaid rent. Conversely, there is no restriction once the tenant has vacated.

I have tenant who just moved in and stopped paying rent. Do I have to complete a rental assistance application in order to

I have an old wood fence that separates my property from the neighbors. We will be splitting the cost of replacement. My question, however, is how do I avoid post rot? The old fence posts rotted prematurely and caused the fence to lean. Mark

Dear Mark:

Your problem is most likely poor drainage. The posts rot away because of excessive moisture. For a long-term installation, use either redwood or pressure treated lumber. Dig your posthole at least 6 inches deeper than normal.

Fill the bottom six inches of the hole with ½” sized gravel. Then, set your post in place, level it and pour in another 2 or 3 inches of gravel. Fill the balance of the hole with Ready-Mix or Post-Mix concrete. Taper the top of the wet concrete at a slight angle to the post; that will help drain water away from the post. For added protection, you

may want to consider waterproofing your post with Thompson’s Water Seal or roofing tar. That should help keep your post healthy for much longer.

Check at your local home improvement center for ideas along with these brand names to look for: Westlock, Hamilton Sinkler, Schlage, Baldwin, Kwikset.

I hear the term “Aging in Place” and wondered as an apartment owner, what I could do to market to this growing segment of our population? What should I do to make my property more “Aging in Place” friendly? Sanford

Dear Sanford :

Baby Boomers are 25 percent of the population. The first of the Boomers turned 65 in 2011, and the last will turn 65 in 2029. We heard on the radio the other day that 85 is the new 75, and so on down the line. That is a large, healthy aging group! They are not going to go quietly into a nursing home which means, as apartment owners and managers, we need to prepare for this group.

Aging in place means bigger showers with wider doors, taller toilets, grab bars and bath sinks that will accommodate wheelchairs. This does not mean turning our units into institutions; there are many stylish accommodations to fit a number of needs. For example, a grab bar capable of supporting 250 pounds does not need to look like it came out of a hospital. Grab bars come in a variety colors and designs.

Many will double as towel bars and be virtually invisible to their primary purpose unless needed. A larger shower stall

also will look opulent and practical at the same time. Replace old two handle faucets in the kitchen and bathroom for single handle or touch faucets. Consider installing anti-skid flooring in the bathroom and tub/shower area. A few other items might be contrasting color edging for the counter tops along with rounded edge and corners. Replace all doorknobs with lever handles for ease of use. This is a small sample of the things you can do to stay competitive in a growing market while not making

changes that younger generations would find objectionable.

Assistance Animals Revisited: Recent Guidance — Recent Regulations

A

pril is Fair Housing Month, during which we will mark the 54th anniversary of the passage of the federal Fair Housing Act (FHA). The law being over a half-century old does not mean that its interpretation and application does not continue to evolve. The FHA has been amended twice; once in 1974 and again in 1988. Later this year will come the 34th anniversary of those 1988 amendments to the FHA that added provisions to ensure equal, or at least improved, access to housing for people with disabilities. Just as with other aspects of law, when it comes to the FHA’s disability-specific provisions, their interpretation and application are not static. Evidence of that fact is shown by the U.S. Department of Housing and Urban Development’s Office of Fair Housing and Equal Opportunity’s (FHEO) issuance of updated guidance on assistance animals on January 28th 2020. That update came just 4 weeks after the introduction of California’s first fair housing regulations, which can be found in Title 2 of the California Code of Regulations (CCR), starting at section 12005. That January 2020 introduction of regulations was the first phase of developing comprehensive regulations that will eventually address most aspects of fair housing law.

Among the topics addressed in the first phase is that of assistance animals.

Because it has been six years since our agency last authored an article on assistance animals, and because issues

with assistance animals are prevalent in fair housing matters, it is a good time to both cover these more recent developments and to review some of the general aspects of the topic. By way of a reminder, it’s important to point out that while the Americans with Disabilities Act (ADA) is perhaps a more widely-known law addressing rights for people with disabilities, when it comes to housing it is the disabilityspecific provisions of the FHA and not the ADA that are the applicable law.

Also, as part of revisiting the topic of assistance animals and in order to have an appropriate understanding of terminology, it is good to present some definitions that appear either as part of California’s Fair Employment and Housing Act (FEHA) or the new California regulations.

First, disability is defined in FEHA as a physical or mental impairment that limits one or more of a person’s major life activities. Major life activities are broadly construed and include numerous physical, mental, and social activities and working. Disability also includes a record of having such an impairment or being regarded as having such an impairment. Overall, this is a somewhat broader definition than the federal one, which uses the words ‘substantially limits’.

Second, the new regulations define an assistance animal as including both service animals and support animals, and makes clear that an assistance animal is not a pet. Rather, “[i]t is an animal that

works, provides assistance, or performs tasks for the benefit of an individual with a disability, or provides emotional, cognitive, or similar support that alleviates one or more identified symptoms or effects of an individual’s disability” [See 2 CCR §12005(d)]. The regulations go on define service animals as those that “are trained to perform specific tasks to assist individuals with disabilities, including individuals with mental health disabilities. Service animals do not need to be professionally trained or certified, but may be trained by the individual with a disability or another individual.” They describe some specific examples of service animals, and make clear that they include animals in training, whether being trained by individuals with disabilities, persons assisting individuals with disabilities, or authorized trainers.

They also define support animals as those “that provide emotional, cognitive, or other similar support to an individual with a disability. A support animal does not need to be trained or certified. Support animals are also known as comfort animals or emotional support animals.”

Recall that a request by a housing occupant for permission to have an assistance animal is part of the broader concept of various requests for a reasonable accommodation of a person’s disability. Fair housing law makes it unlawful for a housing provider to refuse to make an accommodation that Assistance Animals — continued on page 18

Assistance Animals — continued from 16 apparent or observable disability, ments under penalty of perjury, or to a person with a disability may need in order to have equal opportunity to enjoy and use a dwelling. Also recall that the granting of a reasonable accommodation cannot be conditioned on the payment of a fee or any other exaction [see 2 CCR §12280].

With that background in hand we can move to a look at FHEO’s 2020 guidance, which is entitled Assessing a Person’s Request to Have an Animal as a Reasonable Accommodation Under the Fair Housing Act (available online at https://tinyurl.com/HUDAssistance-Animals-2020). Although this guidance is given respecting the federal law, California housing providers should read it with FEHA and state the regulations in mind. The guidance is intended to offer housing providers a set of best practices for complying with the FHA when assessing requests for reasonable accommodations to keep animals in housing. It replaces previous guidance issued in 2013, but still needs to be read together with other HUD fair housing regulations and guidance.

It is divided into two parts; one that addresses assessing a request to have an assistance animal, and another addressing the documentation that might reasonably be requested by a provider. To be clear, unlike the California regulations, this guidance does not have the force and effect of law and is not meant to bind the public in any way.

To help guide the assessment of a request by an individual for an assistance animal, it first lays out a ‘question tree’ specific to whether or not an animal is a service animal under provisions of the ADA. If it is, and its presence does not pose a direct threat to the health or safety of other individuals, it must be allowed in the housing, including in common areas. If the question tree does not determine it to be an ADAdefined service animal, then the guidance describes further analysis, again utilizing a question tree. The questions deal with whether a person has an

whether a housing provider has otherwise been made aware that the person has a disability, and whether the provider has been provided information on how the animal benefits the person with respect to their disability. Clearly an accommodation doesn’t have to be made to individuals who do not have a disability or for who the animal is not needed to allow them an equal opportunity to use and enjoy their dwelling.

However, if in following this analytical process housing providers initially conclude that they do not have to grant the accommodation, they would be wise to engage in a good-faith dialogue with the requestor, which is called the “interactive process”, before definitively denying a request. That interactive process is presented at page 7 of the Joint Statement of the Department of Housing and Urban Development and the Department of Justice, Reasonable Accommodations Under the Fair Housing Act (available online at https:// tinyurl.com/HUD-D OJ-JointStatement). The 2020 guidance also includes other general considerations related to a housing provider’s actions in processing a reasonable accommodation request, either for assistance animals specifically or other reasonable accommodations more generally.

The part of the 2020 guidance on documenting an individual’s need for an assistance animal seeks to provide best practices for that process. It offers a summary of information that a housing provider may need to know from a third party verifier or information source about an individual’s need for the animal. It focuses on health care professionals, but providers should view this guidance in the context that the HUD/DOJ Joint Statement, at pages 13–14, identifies a variety of sources that may provide credible and adequate information. The Statement reminds housing providers they may not require a health care professional or other third party to use a specific form, to provide notarized statements, to make state-

provide an individual’s diagnosis or other details about the nature or severity of a person’s physical or mental impairments.

The 2020 guidance cautions that information relating to a person’s disability and health conditions must be kept confidential and cannot be shared with other persons unless the information is needed for evaluating whether to grant or deny a reasonable accommodation request or unless disclosure is required by law. It recommends that information from third parties be based on their personal knowledge of the requestor — i.e., knowledge used to diagnose, advise, counsel, treat, or provide health care or other disabilityrelated services. Ideally that third party will include detail such as whether there is a professional relationship involving the provision of health care or disability-related services, the date of the last interaction with the person, whether the person has a physical or mental impairment that limits a major life activity, what type of animal the person is requesting to be approved, and how that animal benefits the person. While this and other information might be the ideal, housing providers should not insist on a specific check list of items before considering or granting a request for an animal. If basic, credible information has been provided to allow a determination that the animal is needed, the request should be approved.

If such information is arguably lacking then the provider should use the interactive process to see if that information can be made available.

One important statement in the 2020 guidance, which is also found in the California regulations, addresses documentation from the Internet. It states that in “HUD’s experience, such documentation from the Internet is not, by itself, sufficient to reliably establish that an individual has a nonobservable disability or disability-related Assistance Animals — continued on page 20

Assistance Animals — continued from 18 not to be information from a reliable requests an additional support animal, need for an assistance animal.” This information typically comes from web sites that sell so-called certificates, registrations, and licensing documents for assistance animals to anyone who answers certain questions or participates in a short interview and pays a fee. However, the guidance goes on to remind, that by contrast to those web sites, many legitimate, licensed health care professionals deliver services remotely, including over the Internet.

Therefore information from an online provider should not be automatically rejected, but an interactive process to either determine the information’s credibility or to augment such information should first be pursued. The California regulations go further by including the statement that a “certification from an online service that does not include an individualized assessment [as defined] from a medical professional is presumptively considered

third party.” However, the regulations also caution that a person presenting such a certification should be given an opportunity to provide additional information that would meet the verification requirements the regulations set out before a request for reasonable accommodation is denied.

Space here does not allow complete detail on the California regulations on assistance animals, which run to three pages. However, among others, a few important standards they set down include that: no breed, size, or weight limitations may be applied to an assistance animal; animal vests, identification cards, or certificates are not in and of themselves documentation of either disability or the need for a reasonable accommodation; and, an individual may have more than one assistance animal.

For the last, each animal must be individually determined to meet the requirements. Also, when an individual already has a support animal and

Tax-Time Check-In

or many apartment owners, April 15 is seen as the finish line.

You tally up your income and your expenses, turn those numbers over to your tax advisor and you are basically done. (Well, all but for maybe writing a check.)

However, the reality is that with all those numbers and figures in hand, now is the time to put on your investor hat and do some serious analyzing.

This is particularly true today, as we see a return to normalcy.

You may be feeling much more confident about the future. Although some owners got hit hard with delinquencies and non-payment of rents due, various rental assistance programs helped minimize losses.

And, as COVID-19 restrictions regarding evictions have been lifted, the opportunities to bring in new residents have expanded as well. However, turn-over also means less income for at least a period of time, and the expense of getting the apartment “rent ready.”

Some important decisions need to be made. Although you may have just written checks to the IRS and to the Franchise Tax Board, there may be a need for further expenditures.

First and foremost, you need to honestly evaluate the condition of your property. Have certain maintenance items and repairs been ignored? With everyone living pretty much in a lockdown mode for almost two years, how has the exterior appearance weathered?

Is paint needed? What about the land-

scaping? More importantly are there any broken steps, shifts in the cement sidewalks or other potential liabilities that have gone unnoticed or unmentioned?

Now is the time to start prioritizing and putting numbers to what needs to be accomplished. Trip-and-fall risks and other such liabilities always go to the top of the list. How appearances impact your current and prospective residents should be evaluated, too.

If you are experiencing turnover or are expecting to have to re-rent one or more units in the near future, appearances can go a long way in helping to attract more thoughtful tenants. Well maintained exteriors demonstrate that you, as the owner/manager take pride in your property and that, in turn, often engenders a stronger sense of caring among your residents.

Yes, vacancy rates are very low, and you may be able to re-rent any vacant apartment without putting in much time, effort, or money. However, are you really doing yourself a service, or are you simply kicking the can down the road?

This is when wearing your investor’s hat becomes important. What do you see happening within the next two or three years? What are your long-term goals? Think about your answers on two different levels — both for your property and for yourself.

When you ignore or postpone repairs and maintenance tasks, they do not simply disappear. More than likely, the deterioration continues and, over

time, the cost to make the fix may double or triple. Also to be considered are the unseen costs of what happens when your residents no longer respect where they live.

Certainly, getting work done and making repairs is apt to be challenging.

Scarcity of items and of reliable labor remains an ongoing issue. However, the reality is that there may be no improvement in the situation for quite a while.

As an apartment owner, you must also keep in mind that you are operating under a “new norm” with many more restrictions. As our AAOC legislative advocates dreaded, the passage of AB 1482 was only the beginning. Today, in Orange County, we are facing even tighter rent limitations as Santa Ana’s Rent Stabilization Ordinance garners ever-growing support in neighboring communities.

So, what do you do? Much depends upon your ability and willingness to spend the money as well as on your own priorities. Maybe you want to do some travelling. Can you realistically make that happen if you are still managing the property on your own?

Perhaps professional management is the answer, but is there sufficient cash flow for that to happen?

To be considered, as well, is your end game or exit strategy. Next month we will delve a little further into that subject with a look at what is happening in the marketplace, particularly in Tax Time — continued on page 30

Emergency Housing Vouchers Now Cover More Rent; Provide More Leasing Options for Housing Providers Special from Orange County United Way

ecently, the Orange County Housing Authority (OCHA) announced that some housing vouchers will now cover hundreds of dollars more in rent, enabling even more housing providers to fill vacancies and take advantage of valuable incentives through the WelcomeHomeOCSM housing navigation program.

Empowered by Orange County United Way, WelcomeHomeOC is an innovative program that is good for your business by providing valuable incentives and benefits, and good for our community by helping to end homelessness for our neighbors in need.

Housing voucher payment standards are calculated as a percentage of HUD’s Fair Market Rents (FMRs) and can range from 90%–120% of the FMR. For Emergency Housing Vouchers, OCHA has increased the payment standards to the maximum of 120% for all areas of the county (except Anaheim, Santa Ana, and Garden Grove). That is

a 12–29% increase over previous payment standards, depending on rental location and size.

This is great news for rental housing providers, as even more market rate units can now qualify to be considered for the many incentives offered through WelcomeHomeOC. Five years ago, a property marketer’s job was a lot simpler. An internet listing service (ILS) or a property website was likely enough for property marketers to attract renters. Now, it’s a whole different ball game. Renters bounce between search results, social pages, a property’s website, talking to their friends and reading reviews, all before deciding whether a tour is worthwhile. If your property makes it through their initial research phase, then they start engaging with properties via email, chat, and phone. When they reach out, they expect a prompt response and knowledgeable staff. Renters have options.

Competition is high. In turn, apartment marketers have to put their best foot forward along every step of renters’ winding journey to a new home.

The following are four things to

know about how the renter search has changed and what to do about it.

1. Properties must stand out in search results.

The days when apartment seekers only considered a couple of communities are over. Google identifies the apartment search landscape as one of the most competitive categories. Half of renters are seeking information for six or more properties at a time. A quarter of apartment seekers are looking at 10 or more apartment communities.

What does this mean for apartment communities? It means that properties should strive to take up as much real estate in search results as they can. At the beginning of a search, renters search broad terms like “Apartments Atlanta.” Typically, the top four or five listings for broad searches are ILS’, meaning having a presence on an ILS is critical to getting on prospective residents’ initial consideration set.

However, as a prospective resident

becomes more familiar with the area and conducts neighborhood-specific searches like “Virginia Highlands apartments,” then ILS results become less visible. With more specific searches, property websites and Google My Business listings start appearing more in both paid and organic listings. If you really want to stand out from the crowd on the first page of search results, you need to have a paid and an organic strategy in place.

2. Google Business Profiles and reviews build trust with renters (and Google).

Reading reviews is second nature to today’s consumers. This extends to the rental search as well. Renters want to get a sense for what it’s like to live at a property from real residents.

Savvy renters look not only at the quantity of reviews, but also the recency and relevance of the ratings to develop an accurate picture of a community.

BrightLocal lists reviews as the second most impactful factor to increasing search rankings. A good place to collect reviews is your Google Business Profile (GBP). A recent RentPath study confirmed that properties with completed GBPs— including descriptions, hours and photos—garnered 67% more views, as well as 112% more renter actions.

Case-in-point: Consistent review and listing management earns the trust of renters and search engines for easier leasing (Just make sure you’re responding to your reviews!).

3. Responsiveness can make the difference between signing a lease or losing a resident.

Renters have high expectations when it comes to timely, personalized and consistent service. Their experience with companies like Zappos, Amazon, Uber and GrubHub inform what they expect from apartment communities.

Renters expect to be able to communicate in their preferred communication channels and they expect quick and clear responses from properties. A slow response gives a competing property a leg up on earning a prospective resident’s favor.

However, responding to renters via text, email, chat and phone, all while fielding resident requests is easier said than done. Leaning on technology here can take the pressure off onsite staff and delight prospective residents.

Virtual leasing centers can handle the influx of inquiries and keep renters happy with around-the-clock support.

Apartments in a Post-Apocalyptic Economy

N

ot to overly dramatize, but does it not feel like we’ve all been enduring a shitstorm (‘scuse my language) of historic proportions?

First it was COVID and the chaos it engendered; then, just as the day-today impact of the virus seemingly began to abate, Russia invades Ukraine, turning the world on its ear; and on top of that we’re now grappling with the reality that inflation — running at 7.9% year over year through Feb 2022 — has infiltrated the economy on a scale not seen in forty years.

With these calamities raining down, what’s an investor to do — buy, sell, or hold?

More to the point for AAOC members, the core question is, “how will rental housing fare versus other asset classes amidst these abnormally adverse circumstances and how will it be positioned when the dust settles?“ (and yes, I do believe that we’ll eventually get back to some semblance of order and stability.)

Apartments are, and will continue to be for the foreseeable future, a survivor. Their proven resilience in an economic firestorm is a reason that those preferring a lower risk portfolio may wish to hunker down with multifamily while riding out the turbulence.

In short, in the middle of a crisis when the highest priority is survival and simply getting through extreme conditions intact, rental housing seems a sound play. Certainly stocks, bonds, commodities and other publicly traded

securities are fundamental asset classes that normally would and should be part of a balanced investment portfolio, but their prices on any given day are subject to significantly more volatility than are those of rental housing.

Multifamily assets thus can be thought of as a kind of hedge investment in the present world.

As discussed below, the adjacent chart illustrates just how effectively apartments have so far toughed it out under untoward conditions the past two years (we note that our Q4 2021 chart pre-dates the outbreak of war in Ukraine).

Occupancy rates

Apartments in Orange County reflected an astounding 98.8% occupancy rate at year end 2021, while nationwide occupancy weighed in at 97.4%, a similarly stupefying figure.

Yes, as we all know, pressing housing shortages across the country account for these unprecedented occupancy numbers, but the reality is that it will take years to correct the imbalance, which provides somewhat of a vacancy cushion for the future.

Rent growth

The pace of annual rent growth locally and across the nation is in turbo charge mode: 16.7% year over year in OC and 13.8% nationally. Obviously, this is not a healthy situation for the millions of Americans renters, and it bespeaks of unsettling socio-economic implications for society. But, that said, April 2022

the situation such as it is does nevertheless augur well for apartment investors. Breakneck speed rent growth will eventually slow, but these rental housing income streams have inertia that will take time to slacken.

[To clarify a point concerning 16.7% annual OC rent growth in light of the state’s 10% annual rent increase limits, keep in mind that the law does not apply to many rental situations (e.g. units 15 years old or less and most rerentals after voluntary move outs.]

Valuation metrics

In the throes of the frazzled marketplace, apartment values finished 2021 at or near all-time highs by virtually all measures (cap rate, gross rent multiplier, price per unit, price per square foot), a testament to the extremely sturdy nature of the asset class.

Eventually multifamily pricing will moderate or perhaps even decline — but can anyone name an asset class that’s 100% bullet proof?

Bottom line

At some point we’ll emerge from these particularly challenging times and enter a “post-apocalyptic” phase.

In the aftermath, rental housing will still be a bedrock, forever in-demand industry serving the fundamental human need for shelter. So, while apartments may not be the most glamorous or highest yielding of asset classes, they do appear to be among the most reliable to take into the foxhole with you until the smoke clears.

Schluter Systems — So Many Shower Options!

Prefabricated Shower Trays Custom tiled showers continue to grow in popularity as homeowners strive to create spaces that reflect their specific needs and desires. Each one is a little bit different. To help create these unique spaces more easily, Schluter-Systems has prefabricated, sloped trays for showers with the KERDIDRAIN point drain and KERDI-LINE linear drain. Various tray options make it much easier to choose a tray that suits the size of the shower. All Schluter shower trays feature integrated KERDI waterproofing on the top of the tray.

Shower areas must be made completely waterproof before tiles are installed, so trays with the waterproof membrane pre-installed remove a step from the construction process.

These shower trays easily integrate with Schluter drains and waterproof walls to construct a completely waterproof and vapor-tight environment.

Going Curbless in the Shower!

Curbless shower areas have also exploded in popularity in recent years. They have become a very popular design choice for aesthetic reasons and to assist homeowners with aging in place or managing reduced mobility. One of the challenges when constructing curbless showers is to effectively manage height changes between the bathroom floor and the shower floor. To make this process easier, Schluter also has shower trays with reduced thickness. These KERDISHOWER-TT trays feature perimeter heights of 1” or less to simplify the design and construction of curbless shower entries. This change in tray design will allow more people to have curbless showers installed in their homes.
