Rich Lombardi’s Heart for Education
With much reflection and admiration, I dedicate this month’s column to longtime AAOC member Rich Lombardi, who passed away on May 28, 2024. Rich was a fixture in the local rental housing and commercial real estate industries for many years and a stalwart advocate and provider of education and professional development. His dedication, passion, and presence will be sorely missed.
I had the distinct pleasure of speaking with Rich for over an hour, just a few days before his passing. We shared and compared many of our philosophies about business, real estate, community service, and our passion for lifelong learning. He suggested that I read The Richest Man in Babylon by George Samuel Clason. I promised him that I would order a copy on Amazon that day and call him the following week to discuss my progress in understanding
the key takeaways from the book.
I was deeply saddened that I was unable to have that conversation with Rich and share one of many key takeaways—that opportunity is the primary source of good luck, a tree that will bear fruit with some perseverance.
To this point, I had shared with Rich during our phone call one of my favorite sayings. “How do you spell luck? ‘W.O.R.K.!!’ He laughed, saying he liked that and would be sure to share it with others. Another important concept is to work hard to seek opportunities before seizing them without procrastination.
Rich and I also spoke about public speaking, something for which he was a strong proponent. He suggested that I consider visiting and joining a local Toastmasters Club, and he recounted fond memories of the constructive lessons and great friendships he had developed there over the years.
To honor his legacy and unwavering support of our Association, and his commitment to lifelong education and the pursuit of knowledge, I am pleased to announce that AAOC will be establishing a scholarship bearing his name that will be used to assist students in their pursuit of knowledge of the property management profession, residential rental property investment, and financial education and stewardship.

Two Successes for the Rental Housing Industry
While the number of residential rental housing bills introduced by the Legislature this year indicates that it has no intention of lifting the boot from the industry’s neck, two harmful bills with legs were recently chopped at the knees.
Some successes come as powerful flash floods wiping out illogical and offensive legislation, while some successes are trickles that eventually erode the foundation.
AB 2216 (Haney), which quickly began being referred to as the “Pet Bill,” was introduced in February 2024 and would have prohibited property owners or their agents from limiting a common household pet (domesticated animal, including but not limited to, a dog or cat, that is commonly kept in the home for pleasure).
Additionally, the “pet bill” would have prohibited property owners or their agents from inquiring about whether the applicant intends on keeping a common household pet or pets in the dwelling unit. Moreover, there
would have been no requirement that a renter inform property owners or their agents of keeping common household pets after that renter had entered a contract for tenancy.
Furthermore, the bill would have prohibited property owners or their agents from collecting additional rent from a tenant who keeps common household pets in the dwelling unit during tenancy.
Additionally, the “pet bill” did not consider a common household pet’s welfare, if its owner works outside the home during a regular 40-hour work week, which would have confined a pet in the home for 8–10 hours without the ability to relieve itself; this could be considered animal cruelty.
The bill also created a distinct notion that renters who are pet owners have superior rights over renters who are not pet owners, which would have undoubtedly affected the quiet enjoyment and resulted in constructive evictions.
Finally, the “pet bill” also conflicted with current law that already outlines
adequate legal requirements pertaining to property owners’ prohibitions on renters’ ability to keep common household pets in a dwelling unit during tenancy.
Arguments trickled down to the legislature over a three-month period that first forced the author to make the following significant amendments:
• Properties with 15 or fewer units would have been exempt.
• Properties with 16 or more units were required to permit one pet. More pets than that can charge $50 per month.
• Property owners would have been permitted to collect an additional security deposit with a $1,000 cap and a pet deposit for carpet cleaning.
• Property owners would have been permitted to demand proof of liability insurance with the landlord being added as an additional insured.

• Renters were prohibited from owning “restricted pets.”
Those amendments, however, were ultimately eroded and the bill’s foundation completely collapsed under the pressure from opposition.
SB 611 (Menjivar), the second bill, was introduced in 2023, amended that May, and then sat on the shelf, unchanged, until June 10, 2024, when it was substantially amended. Essentially, the bill was a gut and amend on the eve of policy hearing in the bill’s second house (the Assembly) without any attempt to discuss amendments with stakeholders, constituents, or property owners of residential rental housing.
The “Rental Advertising Bill” as it is known would have required property owners to advertise all fees prior to identifying and defining them at the time a rental agreement contract is negotiated between a property owner and a renter; including a maximum
monthly utility amount based on household utility consumption for the prior 12-month period, without considering the prior renter’s utility consumption habits or household size.
If a renter interpreted a property owner’s advertisements as not “clear” or “conspicuous,” a renter would have been permitted to use that argument as an affirmative defense against an unlawful detainer action, which essentially would have given all renters an excuse to materially breach a residential rental contract. It also would have permitted renters to challenge the sufficiency of an executed residential rental agreement in the instance a property changed ownership or changed billing service.
The bill would have permitted the attorney general, district attorney, city attorney, or county counsel to seek injunctive relief against property owners based on not advertising fees related to a residential rental unit clearly and conspicuously.
Additionally, the bill would have given renters or their representative the right to inspect records that relate to former renters to confirm an average amount of monthly utility fees. Because the term “representative” was not legally defined, the bill would have actively encouraged tenants’ rights’ groups, being named a tenant’s representative, to demand access to third party private information.
Sixteen days after the “rental advertising bill” was gutted and amended on June 10, 2024, and following a flashflood of arguments pertaining to the bill’s violation of public policy and constitutional rights to privacy, the author deleted all of her amendments.

More Than a Numbers Game
AAOC launched two Calls for Action in June.
First, there was the “Pet Bill” —AB 2216 (Haney, D—San Francisco) which would have severely limited your ability to control the number and types of pets allowed in your units. The bill was effectively killed in the Senate through both a coordinated effort of AAOC members and other rental housing providers contacting their legislators to oppose the bill, and the CalRHA lobbying team—including AAOC’s Ron Kingston—providing arguments and data to the senators that kept it from advancing.
Second, there was the “Rental Advertising Bill”—SB 611 (Menjivar, D—Burbank) which at the time of this writing is slated to be heard in the Assembly Judiciary Committee in early July.
These are two different campaigns realizing quite different strategies, but let us look at the data associated with these campaigns:
For AB 2216, in the first 24 hours over 200 AAOC members sent letters to their elected officials.
For SB 611, in the first 24 hours an average of 160 members sent letters to the members of the Assembly Judiciary Committee
These are decent results for an organization of AAOC’s size—we outpace similarly sized organizations by about 10%—something for which we should certainly be proud.
Advocacy, however, is an ever-evolving art. And if we want to be successful moving forward, we too need to evolve.
AAOC has been evolving its strategies—as mentioned above, these two calls to action employed quite different efforts. On the surface they may seem the same, but what was different is who was targeted to receive our messaging.
Generally, AAOC focuses on contacting the members of the legislature who represent our territory. This was the case with the “Pet Bill” effort—and it worked. For the “Rental Advertising
Bill,” however, we focused on a committee’s membership. This included committee members from all over the state—as well as several members from the AAOC territory including the following Assemblymembers:
• Committee Co-Chair Assemblymember Diane Dixon (R—Newport Beach)
• Assemblymember Blanca Pacheco (D—La Habra)
• Assemblymember Kate Sanchez (R—Rancho Santa Margarita)
The remaining members of the committee represented districts from San Diego to San Francisco—all of
which are outside of AAOC’s territory. This presents several challenges for an organization like AAOC.
Bills used to be killed on the floor of the legislative houses when there was significant opposition. Increasingly, we are finding that approval by a commit-
tee is seen as a signal that the bill has merit when it hits the floor. This means we now need to kill bills in committee.
Legislators, however, like to rely on “input from their constituents.” When it comes to committee policy making, that provides some elected officials with cover to ignore the input of industries that cover many jurisdictions.
To be effective moving forward, we need to break through that mentality.
SOLUTION 1—Increase AAOC’s Engagement
The one commodity that an organization like AAOC has to trade is the trust people have in what we say, and how our members are perceived by the elected officials. The best way to build that trust is a personal connection.
AAOC members like President John Tomlinson, Legislative Committee
Chair Amy Fyling, and others have built great relationships with legislators like Assemblymember Laurie Davies, Senator Josh Newman, and many others. Being able to make that personal connection and make a call is an effective tool in delivering quality information to the elected officials as they make decisions on policies before them.
Many of these relationships have been forged by participating with AAOC for its annual legislative advocacy trip to Sacramento. We invite you to join us at the next one in Spring 2025.
That personal call to a legislator from someone they trust makes all the difference in the world when a critical bill is being debated. And it starts locally. Who do you know?
Look at your city council, or school board, or chamber of commerce where your rental properties are located—who do you know? Building a relationship

early with politically ambitious community leaders will put you in the position of influence as they climb the political ladder and move up from city council or county supervisor to the state legislature or Congress.
Or maybe you know someone currently running for state or local office. Not only should you connect with them—bring them to AAOC’s attention so we can build a rapport with them as well. This is your industry, your community, your investments—let’s protect them together.
SOLUTION 2—Update Your Data with AAOC
Politics may not be everyone’s game —we get that. However, that doesn’t mean you should ignore it. Perhaps Pericles put it best—Just because you do not take an interest in politics doesn’t mean politics won’t take an interest in you.
One of our most effective ways of communicating the importance of protecting the multifamily housing industry is by connecting our legislators with the number of lives their policies would impact.
That comes down to Data.
AAOC relies on its members to tell us a few key factors about their business:
• How many rental units you own/ manage/service
• Where your rental units are located
Many of you may have wondered why we need that information.
We ask because we need this data for when we meet with legislators, so
we can quantify how many of their constituents would be negatively affected by their votes, and we can demonstrate how much reach we have in their district.
We ask because we know that a legislator may try and ignore your call if you aren’t a constituent, but that they will listen if they know you are a business owner from their community who interacts with a number of voters in their district.
We ask because we know that as we continue to move forward legislatively, we need to demonstrate our strength as an industry, and that is backed up with the data we can provide to them.
We ask because having more complete data in our database means we can better represent you.
So, as we evolve in our legislative advocacy, we are asking you to provide updated and accurate member information so that we can better represent you.

CONCLUSION—Let’s Up Those Numbers!
We want you to be involved in what we do, and we know that you know your business far better than any elected official ever does. So, I will leave you with one last thought about why you should care about politics. From our old friend, Aristotle—Those that deem politics beneath their diginity are doomed to be governed by those of lesser talents.

Questions & Answers
I’m in the middle of the first eviction I’ve had in a long time, and on the day of trial, the tenant shows up with some bankruptcy paperwork that he filed on the morning of the trial. He stood in the hallway telling me I should agree to let him stay three more months (rent free, of course) because the bankruptcy stops me from moving forward with my eviction and, he claims, I now have to start all over. Long story short, the judge asked me how long of a continuance I wanted, so I asked for two weeks to figure this situation out. Is that true? Do I have to start my eviction all over?
In short, no. The act of filing bankruptcy does, in fact, place a “stay”, (a pause) on your eviction case but it does not mean you have to start over. There are a couple of ways this can play out. If the tenant fails to file their paperwork with the bankruptcy court, their bankruptcy case will be dismissed and, provided you take a copy of the dismissal to court to show the judge, you will be able to proceed as usual. The other way this commonly plays out is by filing a “motion for relief from stay” with the bankruptcy judge who will set a hearing to hear your motion. Provided your paperwork is done correctly, the judge should “lift the stay” and allow you to move forward with your case. Once you have a copy of the Order lifting the stay, you can return to eviction court and move forward with your trial. Be aware, however, that it usually takes around 30 days to draft your paperwork, have it filed, have the hearing,
and get the bankruptcy judge to sign the Order lifting the stay. So, you will likely need another short continuance to work through the entire process which you should not attempt without the assistance of an experienced attorney.
I recently had an applicant meet me at the property and, to my surprise, she spoke very little English. In fact, it might be more accurate to say she spoke no English at all. Come to find out I had been speaking with her 19 year old daughter over the phone who was with her at the walk-through. The daughter says she won’t be living there, so I am a bit concerned about having her mother sign a lease written in English. Would it be enforceable? Can she say later she didn’t understand it? How do I protect myself in this situation?
California law states where you and an applicant discuss a lease or written month-to-month rental agreement primarily in another language, (e.g., Spanish, Chinese, Tagalog, Vietnamese, or Korean) the landlord or their agent must give the applicant an unsigned version of the rental agreement in the language in which you discussed (negotiated) the agreement before asking them to sign the English version. However, as is generally the case, there is an exception. Specifically, when the applicant provides their own translator who is an adult (18 years old or older) and who speaks and reads both English and the particular language in which
the agreement was negotiated, fluently, you are permitted to supply them with an English only version of the lease without a concern about the enforceability of the agreement. In your case, the applicant’s 19 year old daughter fits the bill.
Recently I had an applicant turn in his application for an apartment I advertised. In the section on my application that asks whether the applicant has ever been convicted of a felony, he checked “no”. However, when I ran him on the Megan’s Law website, sure enough, he popped up for a felony conviction “against a minor”. Seems lately I’ve heard a lot of people telling me I can’t deny him for his felony conviction, but I’m very concerned about it, due to the fact that I have minor children in other units. Is there anything I can do to protect myself if I deny his application?
The California Civil Rights Department (CRD) regulations create a complicated system for asking about, using, or even considering an applicant’s criminal history. Still, there is an exception to this challenge called a “legally sufficient justification,” but be very careful.
First, be sure to apply your tenant screening criteria consistently to all applicants. You are still permitted to consider applicants’ financial ability to honor their tenancy obligations, their
prior tenancy and credit history, whether they’ve been evicted before, (most records are sealed, so this can pose a real challenge) and whether the prospect will place other tenants or the property at risk of harm.
When evaluating an applicant with a criminal history, you must determine the nature and extent of the conviction. You can start by asking the applicant about it directly. What were the circumstances surrounding the conviction? How long ago was the conviction entered? Were there any mitigating factors? You may also request a criminal background report, but some areas, such as Los Angeles, are now removing the dates of birth from conviction records, making it impossible to confirm you are reviewing the correct records. Still, a conviction for a violent crime against an individual or real property may be sufficient to deny the applicant.
In your case, the applicant appears to have lied about the felony conviction. An applicant who lies on the application, (e.g., by saying he or she was not convicted when they really were) can be declined for providing false information.
Additionally, there may often be other reasons for a denial which would allow you to avoid a Fair Housing complaint for “disparate impact discrimination” based on the criminal conviction. Often, the circumstances leading to the conviction can be seen in other areas of the applicant’s life. For example, many people with a history of felony convictions also have a poor credit or a checkered tenant history. By using those factors to deny the applicant rather than the conviction itself, you steer clear of allegations that you improperly denied someone without following the proper procedures and protocols. It would be wise to look at those types of disqualifiers first, before denying an applicant based on a criminal conviction.
REAL ESTATE
Last month I had to make a sink repair in a tenant’s apartment, and I figured I’d check the adjoining unit to see if it needed the same repair. I sent a text message to the neighboring tenant who replied and said it was okay to go into the unit. Luckily, there were no problems, so I left and thought nothing of it. About two weeks later, I get a call from his wife yelling at me that I had no right to go into their unit because my notice was improper and that she now intends to sue me in small claims court for some personal property she claims is missing, …unless I discount her rent by the value of the missing property. Really? Did I do something wrong in this situation?
In general, a landlord or their agent can enter an apartment upon 24 hours’ notice, “to make necessary or agreed repairs, decorations, alterations, or improvements [and to] supply necessary or agreed services…”. The notice has to be served and, in the event you

Dear Maintenance Men:
What are some things I should think about when it comes to my Apartment Building Disaster Preparedness Plan? We have already sent kits and instructions to our residents to keep them safe, but how do I prepare the physical building in case of disaster? Jason
Dear Jason:
Great job on making sure your residents are prepared. A quick list for our readers of what should be in your family disaster preparedness kit: flashlight with batteries; canned goods; one gallon of water, per person; a knife; medications; and blankets—at a minimum. Now, this works o.k. for a family, but it may not be appropriate for the actual apartment building. The residents may very well shelter in place during a disaster and be fine. What may be in danger is your property! Start with a bit of preventive disaster maintenance.
1. Locate the main water shut-off valve
and any minor shut-off valves. Make sure the valves are in working order. If they are gate valves, it might be time to upgrade them to ball valves. Old gate valves are notorious for breaking valve stems at the moment you need them to work.
2. Locate and clearly mark the main electrical panel.
3. Locate and mark the main sewer clean-out. Run a mainline snake or hydro jet at least once a year. A Friday evening main back-up is a disaster.
4. Locate and mark the main gas or fuel oil shut-off valve.
5. Write down and post this information in a public area of your apartment building, including emergency phone numbers and how to get hold of management. Alternatively, post this information on the inside of a kitchen cabinet door in each rental unit.
Dear Maintenance Men:
I have a large brick patio with a number of flower containers on the brickwork. The gardener is not careful enough when he waters, and this has resulted in some calcification of the bricks. I want to clean up the patio bricks and remove the calcium buildup with a solution that will not kill the grass surrounding the patio. Thanks for your advice. Douglas
Dear Douglas:
There are a number of methods to getting rid of calcium build up on your bricks. However, any product that will not harm the grass might not be strong enough to remove the build-up. Limeaway in a spray bottle and a brush would be the easiest and safest to try first. If Limeaway does not work, try a solution of muriatic acid (pool acid) and water. This mixture will kill any grass it contacts, so work sparingly with a sponge or brush. Be careful as muriatic acid is strong and will etch the concrete and brickwork. Wear rubber gloves and eye protection. Mix a small amount of acid into a bucket of water, increasing the ratio of acid and water until the calcium starts to break down. Work on a small area with lots of rinsing water to dilute the cleaning solution as you go. After you remove the calcium, sealing the bricks will help keep the calcium build-up from coming back.

Dear Robert:
The single greatest consumer of water in your landscape is the turf. Reduce the grass area to ease the burden on water. Creating a drought tolerant landscape will change the appearance of your property and cost you less money in water and maintenance. Xeriscaping is a term for a water conserving landscape. As mentioned above, the benefits of Xeriscaping are water saving, low maintenance, pesticide free, pollution free (no lawnmowers) and use of local native plants. You might want to consider using ornamental grasses, as they are drought tolerant, look great and give your landscape a bit of vertical dimension. Succulents, of course, are great at conserving water. Flax and Delphiniums Iris are a few perennials to use. Marigolds, Mexican Sunflowers, Phlox and Vinca Passion are annuals that will work well. As for shrubs, look at Japanese Black Pine, Mountain Currant, Sassafras, Honeysuckles, etc., and good trees are Acacia, Gray Birch, Monterey Cypress, Eucalyptus, Fig, Juniper, and Amur Maple to name a few.
Be sure to provide good drainage and use plants native to your area for best results.

All In One, Not One Size Fits All
If you don’t use software to manage your assets, not to worry. Zillow has launched an advertising platform that allows you to advertise, screen and accept payments online. Just sign up and you have immediate access. They allow small property owners to participate in base-level features without cost but charge mid-sized owners and up a modest fee in comparison to the resources it provides. I am a huge fan and paying customer both personally and professionally. I always thought Zillow was just a funny word, but perhaps it translates to “floodgates” in some foreign language. It certainly does from an application/interest perspective. With advertising, people seem to forget that their customers are often using the same sites and technology that they are. I’ve not seen the science behind it, but I believe that because Zillow offers a no nonsense, information and location-driven approach to searching for housing and housing information, that it makes the site and app more appealing and easy to use.

Now that you’re generating and tracking your leads, you need to convert them into leases. Not personally, of course. No, thanks in part to services like Meet Elise and Nurture Boss, you have the power of AI working on your behalf around-the-clock. Sending emails, text messages and other follow-up
notes to encourage—and in some cases, incentivize—a response. This brilliant technology sorts and follows up with your leads and tours, answers questions and drives applications and leases at your site. If you’re as skeptical as I once was, try it out and you’ll see. This is the real deal. We’d love to believe that our leasing offices are following up with each and every lead, but they’re not. In today’s day and age, where we are spending more on advertising in order to get top rents, you owe yourself the proper lead management and follow-up in order to capitalize on your advertising investment. It sounds like a lot— and it can be—but it drives revenue and creates efficiencies in your ad spend. These may be some of the more exciting solutions available today, but no doubt, next month or next year, there will be new resources and new solutions to help you achieve your goals. As with any technology, strategy or system, it is important to stay current and in-tune with market solutions so that you don’t fall behind. Fortunately, the solutions referenced herein make it easy and relatively cost-effective to do that.

Reflecting on the final stages of estate administration and closure, especially now that over a year has passed since my father’s death, brings a blend of relief and introspection. The journey as a successor trustee has been profound, marked by both achievements and hard lessons that have significantly shaped my perspective on legacy and estate planning.
In my previous article, I openly discussed some of the pivotal mistakes we encountered before and after my father’s passing. Admitting these missteps was a necessary but challenging process, requiring me to confront the realities of estate planning: its complexities, emotional toll, and unforeseen challenges. These issues, such as the failure of “correct” communication, the oversight of late-life changes, and navigating mental health declines, are detailed in the archive.
The final stages of estate administration brought closure but also unveiled new challenges. Here are some key milestones we navigated, each with its own complexities:
• Closing Accounts and Transferring Assets: This involved consolidating bank accounts, transferring investments, and ensuring all financial assets were properly re-registered.
• Finalizing Tax Matters: Completing and filing my father’s final income tax return and estate tax return, if applicable, to settle any outstanding tax liabilities.
• Conducting Audits and Reviews: Performing a thorough audit of financial records and estate transactions to ensure accuracy and compliance with legal requirements.
Emotionally, this phase was a time of reflection and reconciliation for my family. We revisited memories, honored my father’s wishes, and navigated any remaining disagreements or uncertainties. These moments reinforced the significance of open communication and empathy among family members— critical elements often overlooked in the legal and financial aspects of estate planning.
Throughout this journey, I’ve come to value professional guidance and expertise immensely. decide to mail it, you must add an additional five days for mailing, making it six days total. In this case, you sent a text message which, by itself, may be considered insufficient. However, because the tenant replied and gave you actual permission to enter, the insufficient text message is irrelevant, and your entry is perfectly legal.
A landlord may always enter an apartment, (even without 24 hours’ notice) if the tenant gives them permission. In the future, you should consider taking someone with you to act as a witness when you go in, especially on such short notice and under these circumstances.
A witness will insulate you against claims of “missing” personal property.
With regard to her attempt to extort you for some free rent, don’t give in to her demand. If you do, you will set a precedent for demanding rent concessions for any little thing that pops into
her mind. Rather, defend yourself vigorously if she files a small claims action, and be prepared to present the tenant’s reply text message to the judge as evidence of the fact that her husband gave you permission to enter.

Victory for Charter Beach Cities in Ruling on SB 9
In a landmark decision, a Superior Court judge has dealt a significant blow to state control over local development. The ruling deemed a California law allowing multifamily buildings on single-family lots unconstitutional. Senate Bill 9 (SB 9), enacted in January 2022, permitted the splitting of single-family lots into two, each accommodating two homes, without necessitating a public process.
This ruling was a victory for the charter cities of Redondo Beach, Carson, Torrance, Whittier and Del Mar and sets a precedent for other beach communities like Santa Monica, Huntington Beach and Newport Beach that are opposed to Sacramento imposing laws that will create higher population density.
Advocates of SB 9, including affordable housing proponents and developers, saw it as a solution to California’s housing crisis. However, opponents, particularly those advocating for controlled growth, foresaw its potential to disrupt single-family neighborhoods.
In a detailed 12-page judgment, Los Angeles County Superior Court Judge Curtis A. Kin articulated that while the state can supersede local laws for matters of “statewide concern,” SB 9 lacked a clear connection to affordable housing. He stated, “The court finds that SB 9 is neither reasonably related to ensuring access to affordable housing nor narrowly tailored to avoid unnecessary interference in local governments.” As such, Kin ruled SB 9 unconstitutional, citing a violation of the ‘home rule’ doctrine.
The decision has been hailed as a monumental victory for charter cities across California because it signifies a triumph over what many perceive as government overreach from Sacramento. In beach communities like Redondo Beach, the ruling comes as a relief. Cities such as Redondo Beach and Huntington Beach share a desire to maintain their laid-back beach atmosphere without succumbing to overcrowding. SB 9 threatened to disrupt this balance, potentially transforming tranquil neighborhoods into high-density areas.
For developers and investors eyeing profits from lot splits, the ruling delivers a setback. The hope of making use of SB 9’s provisions for housing development and financial gain is dashed. However, for residents concerned about preserving the character and charm of their communities, it is a welcomed outcome.
Despite differing opinions on SB 9, its demise in the courtroom represents a win for all stakeholders. It safeguards local autonomy in decision-making regarding development, ensuring that communities retain control over their housing landscape. Moreover, it reaffirms the principle of home rule, preventing undue interference from state mandates that lack a clear nexus to the stated objective of addressing housing affordability.
In the ongoing struggle between government mandates and property rights, the recent victory in the courtroom over SB 9 resonates deeply with

housing providers and property owners. Just as the ruling defended the rights of charter cities to regulate their development, there’s a parallel desire for similar victories in the realm of landlord-tenant laws. Homelessness in Orange County: The Calculus for Rental Housing Investors
Sadly, homelessness has become a fact of life in most cities and counties across America, and Orange County is no exception.
A January 2024 “Point in Time” count, placed Orange County’s homeless population at 7,322 (4,173 living on the streets and 3,149 temporarily housed in shelters). The previous count, conducted in 2022, totaled just 5,718 homeless individuals, meaning there’s been a 28% increase over the past two years.
The homeless count in Orange County had actually declined between 2019 and 2022 prior to the upswing in the 2024 count. Comparing the 2019 count (6,860 homeless) to 2024 (7,322) shows a net 7% increase over the past five years. However one may slice and dice the numbers though, it still amounts to a sizeable homeless population living within the county.
That said, there are major efforts underway to counteract the problem. Orange County United Way, which is at the very center of the fight, has developed a detailed plan with its public and private partners to combat and, hopefully, eradicate homelessness in our county eventually.
One aspect of the plan, as many AAOC members are aware, is the use of vacant apartment units for qualified individuals, families and veterans to end their homelessness. This is where rental housing investors fit into the equation. The program, Welcome
Home OC (WHOC), has been quite successful, but ironically, while the funding for the program has been fully secured—funding is generally the toughest part of solving societal issues—it’s actually a shortage of available apartment units that is preventing the program from fully flowering.
This raises the question of why apartment owners would or should consider making any of their units available to be part of this housing initiative.
Possible answers to that question are discussed below, but we’ll first note here that AAOC and its members have played a prominent role in WHOC from its 2019 launch to the present. Of the 1,075 individuals who have been housed to date, 32% went into units owned or managed by AAOC members. Furthermore, AAOC staff and volunteers were part of the initial design of the program.
As to components of WHOC that could be appealing to rental housing owners:
• Landlords get a ready to move in tenant who has met qualifications to receive a Public Housing Authority Housing Choice Voucher; this would be particularly beneficial during times of higher vacancy;
• Vouchers generally cover a very large portion of a WHOC tenant’s monthly rent and are paid directly to the landlord; market rent can be
charged if within designated limits;
• WHOC provides an up to double security deposit to the landlord;
• The landlord’s own lease is used;
• A WHOC loss mitigation fund is available to the landlord should there be any lost rent beyond the security deposit, any damages to the unit, or any legal costs incurred;
• During the first lease term, tenants have a case manager, plus additional “wraparound supportive services” to assist them, and landlords have direct access to WHOC staff throughout the tenant’s residency as well as access to the damage and loss mitigation fund for up to three years;
• An estimated 80% of WHOC tenants retain permanent housing after their first year of lease, with most renewing the same unit in year two, according to Kristine Peters, WHOC Program Director at Orange County United Way
• No evictions have occurred during year one of any WHOC placed tenancy;

Seven years ago, we went door-todoor pitching our first rent coverage product to real estate operators across New York City with the goal of protecting operators against losses from rent defaults, vacancies, holdovers, and damages. Most initially passed, questioning our ability to secure their billion-dollar rent rolls. Finally, one of the largest privately held real estate investment companies in the world allowed us to guarantee their new lease up — a 1,175-unit luxury rental property in midtown Manhattan. That changed everything.
Today, TheGuarantors is available in over 1.5 million rental homes across the country. We’re backed by multiple A-rated insurance carriers and employ 200 people in eight countries around the world building the next generation of rent and deposit protection products.
Not all other players in the industry have been so fortunate. Many companies around us are shrinking in size. Rounds of layoffs, followed by heartfelt LinkedIn appeals by the newly unemployed, are all too common. Dedicated
to the county for police, medical and emergency services is roughly cut in half, which would save the county an estimated $42 million per year if homelessness were eliminated in Orange County.

employees find themselves on the losing team in someone else’s game.
