Rent and Price Controls Run Contrary to the Efficient Allocation of Goods and Services.
Local governments, especially cities like Santa Ana, are resorting increasingly to the enactment of counterproductive and economically and operationally damaging legislation that compromises our livelihoods and the investments we have made as rental property owners and housing providers.
As a case in point, The Orange County Register featured an article by Destiny Torres on August 24, 2023, entitled, “Santa Ana launches registry
for new rent control program. Landlords required to register all rental units.” As mandated under the provisions of the “Rent Stabilization and Just Cause Eviction Ordinance” adopted by the city council in November 2022, on September 1, 2023 multifamily and mobile home rent increases in the city of Santa Ana will be capped at 2.54% for 2024.
Christopher J. Neely offered some sage and poignant takeaways in his article, Why Price Controls Should Stay in the History Books. One informed observation is that “A government bureaucracy and law enforcement must be funded to enforce the controls.” Monitoring and enforcement of rent control is the primary reason many cities have enacted rent registry requirements which usually start with a modest fee, that escalates over time. He further comments and accurately states, in my opinion, that “Goods and services are
allocated inefficiently, both in consumption and production.” These two comments resonate with my undergraduate studies in economics at U.C. Berkeley, and the heart of my sentiments on the free market, which is at the core of our capitalistic society. Most particularly, the notion that rewarding those who are innovative, industrious and hardworking is deserving and just.

Constitutional Amendments That Could Change the Way We Do Business
There are many reasons why and ways how a state constitutional or statutory amendment is placed before the electorate. The why and how a constitutional or statutory change in law is presented to and decided by the voters of California is a fine and largely perfect art form. It is truly amazing how these amendments are introduced, marketed, and then either approved or rejected when the people turn out to vote. And for the record, should a constitutional amendment be considered by the legislature as a pre-requisite before it qualifies to be placed on a state ballot, it is not a bill, per se, it is an amendment to the California constitution. A change to our state statutes, on the other hand, may not require the people to vote, just the legislature and governor need to affirmatively take action.
Take for example Proposition 10 and Proposition 21. Those proposed changes in state law were sponsored by the AIDS Healthcare Foundation, and in
each case sought to effectively repeal the 1995 Costa-Hawkins Rental Housing Act which would have allowed local governments to enact and enforce the strictest forms of rent control. Proposition 10 was soundly defeated in 2018, and Proposition 21 failed in 2020 by an even wider margin. The proponents spent an estimated $25 million each time. The real estate industry spent an estimated $80 million in 2018 and 2020 to defeat those two initiatives.
Some people never learn. The AIDS Healthcare Foundation is hoping the third time will be the charm and has qualified its latest anti-Costa-Hawkins Rental Housing Act initiative for the 2024 General Election ballot. We expect the real estate industry to again invest millions in the defense (and the future) of the rental housing industry and show voters why the initiative is bad for the people of California and is particularly bad for affordable housing.
As mentioned above, this is not the sponsors’ first rodeo. This year — not
unlike previous years — the proponents have sponsored bills in the legislature to effectively gut the Costa-Hawkins Rental Housing Act.
The sponsors and bill authors have sought to:
1) Reduce the amount of annual rent increases to half of the consumer price index;
2) Authorize local governments to set increases in rent when a rental unit is re-rented; and
3) Begin to set rent control requirements on rental housing built on and after 1995.
We consider these three legislative proposals (which all failed this year in the legislature) attempts to take down the Costa-Hawkins Rental Housing Act. Incidentally, all three were authored by state senators. In one case, the author presented before a prominent Senate policy committee a pro-rent control measure that was neither completely written nor analyzed, and which most of members of that committee still supported — voting in favor of the “concept.”
By way of background, the Costa Hawkins Rental Housing Act is arguably the most important rental property owner protection law. This latest statewide ballot initiative to effectively repeal this landmark law is known as the “Justice for Renters Act.” The initiative allows local governments to impose rent control on single-family homes and

newer apartments. It also proposes to eliminate the state’s ban on vacancy control, thus allowing cities and counties to regulate rents between tenancies. The initiative would not only repeal Costa-Hawkins, it would also prohibit the state from limiting the right of local governments to maintain, enact or expand residential rent control. Our guess is these attempts to undermine Costa-Hawkins will continue despite the electorate turning down the two previous initiatives, and the legislature approving, and the Governor signing into law, AB 1482 (Chiu) in 2019, the nation’s strongest statewide tenant protection law and rent cap bill for most of California’s multifamily rental housing stock.
Well, not to be deterred, another constitutional amendment was introduced in the Assembly on August 17, 2023, and was successfully voted on by the appropriate policy committee five days later. That amendment is known as
Assembly Constitutional Amendment (ACA) 13 and authored by Assemblymember Christopher Ward (D—San Diego). The most important change it proposes is to state than any voter approval requirement at the state or local level must receive a proportion of votes in favor of that initiative that is equal or greater than the highest voter approval requirement imposed by the initiative for the adoption of any state or local measure. Does that sound a bit confusing? Now, in English: the proposed constitutional amendment would significantly limit the ability of California citizens to seek change through the initiative process by requiring more than a simple majority vote. It would make it much harder to change the law through the initiative process and constrains the ability of California to reign in government’s ability to change the laws such as increases in taxes (real property and parcel taxes for example) or changes that affect other issues including civil rights.
ACA 13 is opposed by a wide range of business groups, including real estate interests, the Howard Jarvis Taxpayers Association, the California Taxpayers Association, and others. The sponsors of the amendment, the California Teachers Association (CTA) finally admitted the reason for sponsoring the amendment was to counter a businessled initiative that will appear on the November 2024 statewide ballot that proposes to place reasonable guardrails around government-led initiatives to increase taxes. So, the truth “be told,” not every constitutional or statutory change in law seeks appropriate justice. That is social justice, civil justice, or any other form of justice.

So Maybe... Some Reservations?
As I settled into the pleather American Airlines provided mitt that would grip me for the next three hours, I embraced the calm comfort of solitude reflecting on a seven-day trip through America’s cold arctic playground of Alaska. Just as I was ready to drift into that solemn respite, I was nudged back into the present by an eager seatmate prepared to spend the entire route ahead becoming my newest friend... or perhaps making me his. I was not truly sure.
And in that last surety I realized I may be the only adult interaction outlet—and that gift of approachability brings the responsibility of sharing with others—especially those in need of an escape from their daily challenges.

Robert was likely on the spectrum as well. Probably a savant when it comes to engineering, but blind to the realities of landlord/tenant law. Perhaps he’s just been lucky, thus far, but those in the industry long enough will tell you that luck eventually runs out.
There were however three things I was sure of—
1. People have always found me approachable—a quality I often enjoy as I get to learn from them. That said, as any frequent traveler will tell you, sometimes you want to just turn it off. For me, this was one of those times.
2. I really wanted to watch the new Anthony Bourdain documentary on the flight.
3. The man was traveling with his special needs child. A gift that requires patience and selflessness that most of us cannot begin to imagine.
So, I dutifully shed my desire for peace, relaxation, or serenity, opting to dive headfirst into an exchange I had not wanted, but hoped would provide some perspective.
But, just as no good deed goes unpunished, perspective comes in many forms.
You see, my seatmate in this journey, Robert we’ll call him, owned rental property—but wasn’t a member of AAOC—or any other apartment association for that matter—because he was an engineer and was certain he could

This may sound strange, but I’m hoping you can outline how to calculate the expiration date when serving a three-day pay or quit notice. I recently sent a notice I drafted to our attorney to start an eviction, but they told me I had miscalculated the dates and they couldn’t file the eviction.
Don’t feel bad. Calculating the time period on a three-day notice is not as easy as you may think, and many people get it wrong. So, let’s go through it. The short answer is, you can serve the notice any day you want, including weekends and holidays. You start counting “day one” on the next business day. Keep in mind that when counting the three days, you may not count weekends or holidays as part of the “three

days,” nor can the notice expire on a weekend or holiday. Let’s take, for example, a notice served on a Monday. “Day one” would be Tuesday (assuming it isn’t a holiday) and the notice would expire on Thursday at 11:59 p.m. If the tenant failed to tender the payment within that time period, you could file the eviction as early as that Friday. If the notice was served on a Tuesday, day one would be Wednesday and the notice would then expire Friday night at 11:59 p.m. In that case, you could file the eviction the following Monday. However, if the notice was served on a Wednesday, “day one” would be Thursday, “day two” would be Friday, and Monday would be “day three.” The notice would expire at 11:59 that evening. In that case, you couldn’t file the eviction until Tuesday morning at the earliest. Logically then, if the notice is served on a Friday, day one would be Monday and it would expire on Wednesday night at 11:59 p.m. You could then file the eviction on Thursday. See? That wasn’t so hard, but it can be a little confusing.
Are the rules for calculating the time period for a thirty- or sixty-day notice to vacate the same as the rules for calculating time for a three-day notice to pay rent or quit?
No, not really. The only similarity with a three-day notice is that in both cases, the calculation time for a thirty- or sixty-day notice excludes the date of
service and “day one” is the next day. However, unlike a three-day notice to pay or quit, you simply count out thirty or sixty consecutive calendar days from day one and you may count weekends and holidays in the time period. If the tenant fails to vacate on or before the thirtieth or sixtieth day (provided it isn’t a weekend or holiday), you may file an eviction right away. If the notice expires on a weekend or holiday, the expiration date will roll over to the next business day.
One of our “challenging” tenants who is on a month-to-month agreement recently sent me a thirty-day notice of termination, telling my wife and I that she would be vacating on the 10th of next month which, is only 20 days’ notice. Since the rent is due on the first of the month, can we require the tenant to have given thirty-days’ notice on the first of the month?
A tenant on a month-to-month tenancy can terminate their tenancy at any time. California law requires thirty days’ notice unless the tenant and landlord have a shorter time period in the agreement. However, the tenant is responsible for the entire thirty days’ notice, even if they provided less than thirty days’ notice and left in less than thirty days. In other words, you are permitted to charge them 30 days’ rent, even if they returned possession in less than thirty days.
We have a tenant who gave us a thirty-day notice to vacate and asked whether we would use her security deposit as the last month’s rent. We told her we can’t agree to that and, as you might imagine, she got pretty angry. Coincidentally, her apartment and the adjacent unit flooded the very next day. When the plumber went in to look at the situation, he found a partial roll of toilet paper stuffed deep into her toilet. He’s certain this is the source of the flood and he took pictures and wrote his findings in his report. Is there anything we can do about it? God knows what damage she will continue to inflict during her last few weeks.
Yes. You don’t have to wait until the end of the thirty days. Instead, you can immediately serve a three-day notice to quit based upon her actions. If she fails to leave in the three-day period, you can file the eviction right away. You should also take pictures of both units and file a police report for the damage.
We have a young couple who has leased their apartment from us for several years now. Generally, they are quiet and a nice addition to the building. However, their friends are a different story, and every time they come around, they create problems. For example, they drive into the parking lot with their music blasting and leave it cranked up while they wait for our tenants to come out. They also like to hang out at the pool and make disparaging comments to the neighboring tenants who are trying to relax and enjoy the facilities they pay for. Recently, they’ve gotten a bit more obnoxious by speeding through the parking lot and doing “burn outs” when they leave. Our other tenants have started to complain and are rightfully concerned about their safety. We’ve tried to address the situation with our tenants, but they simply tell us they can’t control their friends’ activity and that we have to address it with their friends. Is that true? Are they entirely off the hook for their friends’ behaviors?
No, that’s not true. California law, as well as most leases, state that tenants are responsible for the actions and conduct of their guests as if the tenant themselves had engaged in the conduct. If the friends are creating problems or violating the rental agreement, the tenant is in breach and you may serve a notice to cure covenants or quit. If their friends continue to cause problems after the notice expires, you can file an eviction.

Dear Maintenance Men:
While doing maintenance on a vacant unit, I discovered the bathroom door would not close properly. The door seems to no longer fit the frame. How do I fix this issue? Paul
Dear Paul:
This issue could be one of two problems. The first (and least likely) is the settling of the foundation. However, if this were true, you would most likely find other signs of a settling foundation, such as cracked walls and other doors not closing properly. So, the most likely culprit would be a loose door hinge. Often, the door hinge screws only go about an inch deep, and they may have backed out a bit. A quick solution would be to check if they are tight. A loose hinge will allow the door to sag out of alignment with the door frame. A more permanent fix is to remove the original screws and replace them with much longer screws. The longer screws will go through the door frame and penetrate the rough opening two by fours
behind the door frame. By reaching the rough opening wood, the longer screws will pull the door frame in, pulling the door back into alignment. Check the top and bottom hinges, and only apply enough pressure to get the job done.

When is the best time to do an annual roof inspection? Can you give me some pointers as what to look for when I inspect the roof? Tom
Dear Tom:
The best time is before it rains! However, we find summer and fall to be the most prudent time to inspect and repair the roof. In other words, don’t wait to do roofing work after the first rains of winter. The roofing contractors will be very busy, and costs may go up, or you may have to wait in line for the work to get done. Inspect the roof during the summer and fall and get the roofing work done before it becomes an emergency. During the roof inspection, pay close attention to the flashing. Flashing
is used to transition between the roofing material and the building or a change in roofing direction or angle. Flashing can also be found where pipes or a chimney come up through the roof. The flashing is sealed with roofing tar and water leaks can form when the sealing tar cracks or separates from the building or the flashing material. Look for curled up roof edges on composition roofs, low spots on flat roofs and bird nests in tile roofs. Check all roof drains and cut away any tree branches that are touching or overhanging the roof. While you are inspecting the roof, check the gutters. Winter storms have a way of loosening gutters and filling them with gunk, thereby causing them to lose their pitch and pool water. Pooling or overflowing gutters can deteriorate fascia boards and siding.
Dear Maintenance Men:
I have a bathroom sink that drains slowly. I have already snaked the drain and found no stoppage. When I
remove the pop-up assembly and have an open drain, water whooshes down with no problem. However, with the pop-up in place, water backs up into the sink and drains very slowly. How do I fix this issue? Katherine
Dear Katherine:
Most bathroom sinks have an overflow hole near the top edge of the sink. This hole serves two purposes: 1) Acts as a safety drain to keep the sink from overflowing should the water rise above a certain level in the sink; and 2) The overflow hole also serves as an air vent for the sink when the water levels are above the pop-up plug. The overflow hole allows air to escape through the drain and the water to evacuate more efficiently.
What has happened is hair, toothpaste, grime, etc. have built up and sealed off the overflow drain where it exits just below the pop-up assembly plug. Most snakes are too big to go through the overflow drain. Alternatively, a speedometer cable will work great or even a long zip tie will work. Push the cable or zip tie down through the overflow hole at the top of the sink and push any gunk out into the drain. Use water to help push the debris out the overflow drain, a funnel works great to direct a good flow of water. If you cannot access the overflow to drain, you will need to disassemble the main drain assembly to gain access to the overflow drain exit. Once the overflow drain has good airflow, the sink should drain a bit faster. If this does not solve the problem completely, look at restricting the water flow coming out of the faucet. Use a restrictive aerator to cut down on the GPM of the faucet.

Going the Extra Mile Ten Tips to Earn Your Residents’ Goodwill.

When a resident speaks positively about an apartment community within their circle, it can send the community potential leads.
Achieving this goal is complex as each situation is unique, and there can be multiple factors beyond an onsite team’s control when resolving a resident’s needs. Yet, there is a common resident expectation: An attentive team who works to resolve the matter as soon as possible and communicates frequently with them throughout the process.
When it comes to crisis situations, an ace up an onsite team’s sleeve is the goodwill they have earned by delighting their residents in small ways on a dayto-day basis. The key to delivering a
personalized and exemplary living experience typically lies not in the grand act but in the unassuming actions performed repeatedly and daily during the life cycle of a resident.
As the leader of a team who has responded to close to 800,000 multifamily reviews by residents, prospects, guests, employees and suppliers, I have gathered insight into what truly delights and disappoints them. There is no better source than hearing from residents themselves about how the community can leave a long-lasting favorable impression.
When your reputation falls like dominoes
As analyzed by J Turner Research’s AI tool, the top complaints in over 300,000 multifamily reviews relate to customer service, communication, financial issues, maintenance service, condition of the apartment and security.
Often, these complaints have a domino effect, where one unpleasant event or interaction with a team member, unresolved maintenance request or an unanswered inquiry acts as a trigger for an outpouring of issues a resident has with the property.
“Do not live here. I had two car break-ins while living here, so I never felt safe. Once there was a homeless man walking my hall, knocking on doors, since the secure gates never work in the hallways and garage. (Company) towed my car from the resident garage once, and I had to fight to get them to remove the fee. Nonexistent maintenance—routine requests are rarely addressed. Unit wasn’t move-in ready—trash everywhere, dust, paint cans, etc…”
In this review, the break-in led to an
outburst in which the resident documented several “problems” with the property.
“I have lived here for over a year and renewed for another year before the new management company came in. I am not a big fan of the changes the new management has added. We now have to pay monthly for a locker system that most deliverers don’t even use. I have had numerous packages stolen or gone lost. Will not renew once my contract is over. Rent increases also go up a couple of hundred dollars as well.”
While the root cause is the monthly charge for the locker system, the reviewer has taken this opportunity to complain about management as well as the rent increase.
“The (company) has made it impossible to resolve issues with the office staff, due to reducing operating hours and an automated phone system to an off-site call center that is unable to offer
any sort of ‘problem-solving.”
With companies focusing heavily on automation and centralization, these types of reviews have become more common.
Small Steps, Big Impact
Excellent customer service begins the moment a prospect calls the community or steps foot on the premises. A subtle tweak in daily interactions with residents can go a long way in fostering a strong sense of belonging and loyalty to the community.
“In our industry right now, it’s important that we hyper-focus on customer service and our residents’ needs, staying professional and continuing to remember that every resident is unique,” said Devin Lusk, Director of Marketing for American Landmark. “It’s so important to approach each interaction with empathy and an open mind. Building those strong relationships can lead to such a higher resident satisfaction.”
The following are tips mentioned by
residents as compliments in four- and five-star reviews that can inspire you to take a fresh approach to seemingly mundane daily tasks.
Tip 1: Be timely, knowledgeable and patient with every prospect.
“I was particularly impressed with (name)’s prompt response time and her ability to answer all my questions thoroughly and patiently. Her knowledge of the leasing industry and her willingness to go above and beyond to ensure my satisfaction really made a difference.”
While an onsite team works frequently with prospects, the process isn’t routine for the potential resident. Many come armed with a list of questions and will assess not only what you say but how you say it. Be transparent, thorough and patient with all who cross your threshold.

Tip 2: Offer solutions to ease the burden of move-in.
“Admin was super friendly and helpful, they supplied us with a dolly and elevator key to make this move easier for us. Our apartment was filled with cute swag as well!”
Moving into a new apartment home can be daunting, and this onsite team made it pleasurable! The investment was minimal—they made the whole task of lugging household items easy by providing a dolly and elevator key, and it resulted in a favorable impression and rewarded the community with a positive online rating.
Tip 3: Don’t forget the small things that make life easier for a resident.
“Staff spent the week cleaning out the dryer vents in all the apartments! They truly care about taking care of the property and residents.”
Whether it’s cleaning the dryer vents, changing an AC filter or replacing a lightbulb, you can earn the goodwill of your residents when quickly resolving these items.
Tip 4: Follow up with your resident after their maintenance work order is resolved.
“The manager (name) is awesome! When maintenance completes a work order, I get a follow-up text making sure it was completed to my liking.”
Apartment residents realize they are at the mercy of the onsite team when it
comes to the condition of their homes. Yet they’re often paying thousands for this “privilege.” A follow-up text or email illustrates that you don’t take them for granted.
Tip 5: Resolve conflicts with empathy and fairness.
“(Name) is the best thing that has ever happened to our community. She is understanding and attentive to our needs. She’s patient with her residents and very good about calming the situations down that come to her office. She seeks resolutions that are just and fair. She also has integrity.”
Residents want their concerns to be heard—especially in difficult situations. Be sure your team listens well and responds with constructive recommendations that illustrate you care.
“It is crucial to empathize with residents without reacting emotionally. Avoid setting unrealistic expectations in the heat of the moment that may be difficult to meet later on,” said Alex Rippy, National Director of Leasing for GMH Communities. “Strive to establish clear expectations and a wellthought-out path forward—even if it doesn’t please everyone but points in a positive direction, and don’t forget to follow up to ensure effectiveness.”
Tip 6: I’m watching you: Always be pleasant and courteous.
“It is rare to find a team so engaged in their jobs and attentive to the residents. All members of the office team
are pleasant and courteous whenever I run across them in the community.”
Have your team regularly walk through the community and engage residents with a nod, wave or brief chat. When a resident comes by the office, stand and greet them, perhaps, offer a beverage. Don’t check your phone or watch—do your best to listen attentively.
Tip 7: There is no such thing as too much communication.
“They notify you of everything going on around you with shut-off notices. They never leave you in the [dark] about anything.”
Many complaints are borne from a lack of communication between the onsite team and residents. Don’t make them wonder if their service request will be resolved and/or why the water suddenly shut off. If you don’t communicate, they will fill the void with the idea that you don’t care.
Lusk said an open line of communication is key. “Encourage your residents to reach out and respond to them promptly and professionally to build a positive and genuine relationship,” she said. “Practicing active listening and understanding your residents is so important. It’s made such a difference with our teams on site when it comes to difficult situations.”
Tip 8: Address those seasonal issues in your community.
“The maintenance team does a good job of keeping the sidewalks salted and
shoveled during snowy winters.”
Every season comes with distinct challenges, and geography may compound them. In the South, summer often is brutal; for the Northeast, winter can be treacherous. By providing consistent service during extreme weather, you can win over your residents.
Tip 9: Provide a courtesy patrol to enhance the feeling of safety.
“I like how we do have security that comes by a few times daily to check the area and make sure everything is secured, safe and quiet!”
Unfortunately, crime has no single address. Bolster your residents’ sense of well-being by providing courtesy patrol services.
Tip 10: The little extras can reap big rewards from a former resident.
“I love (name) that works at the reception desk! I recently moved out… she was very kind in offering her help to take care of my mailbox until the new resident comes into my former apartment. Thank you!”
A kind gesture, an understanding word and taking care of mundane tasks can make a huge difference to a resident. They will remember these actions during lease renewal, perhaps even overlooking other areas of dissatisfaction.
There are no shortcuts to acing the resident experience: It requires the right attitude, persistence and corporate support. Rippy advises property managers to “step back, actively listen, ask questions, conduct research and return to the conversation armed with accurate information and a resolution that satisfies the problem’s origin.”
Consistently performing the small things right for your residents will help earn their trust which will ultimately enhance renewals, increase referrals and foster a spotless reputation for the community.

Security Deposits are a True Protection: Vote NO on AB 12

Ana and Joe really wanted our apartment and did their best to qualify. They did not have much rental history, having lived on a military base. To account for this, we asked for three months’ rent in advance, and they agreed.
They immediately began causing problems. They ignored our parking rules, were noisy at late hours, and consistently unwilling to cooperate when our managers discussed the problems.
They brought in a large German shepherd, and then claimed it was a comfort animal. The rules regarding comfort animals are so strict that we were intimidated into accepting. Ana claimed she needed the comfort animal so she could work at her job. However, they left the animal alone in the apartment all day, refuting Ana’s claim. The
dog frequently disturbed the neighbors. They did not pick up the dog feces, causing a stench in the backyard that drifted to their neighbors.
By the time they used up their advance rent, we realized we needed to evict them. We gave them a termination of tenancy with five weeks advance notice. We also offered them an additional 30 days of tenancy if they signed their own Notice of Intent to Move out, hoping the long notice would enable them to find another residence more easily.
They started to pay rent late with various excuses. Eventually, we were driven to file an eviction lawsuit. As soon as they were served with the papers, they gave us the keys. They had actually moved out quietly weeks before, and left the dog alone in the apartment.
Both the apartment and yard were full of dog feces. Their dog had left behind an unbearable stench and a flea problem. The carpets were ruined and had to be replaced. They destroyed the glass door to the back yard, which the
manufacturer replaced, at an estimated cost of $1,000.
The apartment cost us $1400 to clean and repair, $2200 in unpaid rents, and a $760 discounted attorney fee. After deducting the $2000 security deposit, we lost $2300.
In a perfect world, these instances don’t happen, but we do not live in a perfect world. This is why legislation like AB 12 will not protect housing providers. We need to be able to recoup losses when tenants are dishonest.
We should not have rented to this family. However, mistakes are made, and from time to time renters engage in this sort of destructive behavior. The tools of strict tenant screening, ability to require large security deposits (which can discourage a problem tenant), and effective eviction laws are necessary to preserve safe, clean, and orderly apartment communities. I urge legislators to vote NO on AB 12 and to protect housing providers like myself so that we can avoid horror stories like this one.
Protecting Orange County Against Disaster
Orange County’s economy is robust: leading most other U.S. counties, many states—even some countries—in terms of output.
The region’s gross domestic product, standing at $288 billion in 2021, surpassed that of Oregon and New Zealand.
As one of the leading economic powerhouse counties in the nation, are we doing what we should to protect that position?
The key to good business
Resilience to adversity is an essential part of any successful business strategy.
It’s what determines whether an operation can ride out a crisis or economic slowdown.
We saw that first-hand during the early shutdowns of the COVID-19 pandemic. The virus raged into our communities unexpectedly, much like an earthquake would, and the impacts were very much the same: lives lost, thousands hospitalized, businesses shuttered, jobs lost, and economic shutdown.
Losses from an earthquake disaster would likely be more dramatic. We witnessed the potential for earthquake disaster in 1994. The Northridge earthquake jolted Southern California a mere 10 to 20 seconds, delivering a 6.7-magnitude blind-reverse thrust event that struck with brutal force, causing more than $67 billion in widespread damage, and untold economic loss.
Catastrophic modeling performed by RMS, Inc., concluded that if a quake
the size of Northridge was to strike today, it would cause more than $155 billion in total economic losses—comparable to that of Hurricane Katrina, which cost the nation $148 billion.
How big will ‘The Big One’ be?
“Northridge was not a big quake,” Seismologist Lucy Jones told NBC News. “… If we had the same quake on another fault, we’d have way more damage.”
A larger quake could decimate the local economy, experts believe. Businesses would close, people would not be able to get to work, and an exodus of residents would flee, leaving the region behind for others to rebuild.
Seismologists say stress along the San Andreas fault has been building with little relief since the mid-1800s. The next “Big One”—which could come at any moment—could be of a magnitude of 7.5 or more, they say. Such a quake would rip along the fault and displace it by an average of 9 feet.
Is your apartment building ready for that?
There are three steps you can take to fortify business operations and protect your bottom line. These strategies should be followed by any operation, large or small.
1. Know your business’ vulnerabilities: Businesses are extremely vulnerable to the risks presented by earthquakes. Loss of cash flow, equipment and inventory, workforce and market share are all serious risks. Add

2. Create a plan for earthquake resilience: Evaluate the safety of your buildings to make sure that structural and non-structural issues are secure.
3. Consider the benefits of a seismic retrofit. Recent research by Structural Engineer Keith Porter, PhD, called retrofits “a very costeffective investment.” He stated every dollar spent in retrofitting soft-story structures can save property owners up to $32.
The bottom line is that seismic retrofits clearly make good economic sense. Numerous professional organizations and leading engineering experts recommend that if your building is vulnerable, seismic retrofits are the smart way to do business.

Chronicles of an Executor: Navigating the Turbulent Skies of Estate Administration —Suspended in Free-Fall
Last month, I introduced the first of a new series of articles about becoming successor trustee and executor of my father’s estate. I likened this undertaking to a skydiving adventure—a daunting experience that demands preparation, resilience and adaptability.
Confident in the work already done to ensure a smooth transition, the reality has been somewhat different. As with skydiving, although you learn from the experts and practice on the ground, once you are in the plane and taking the jump, you realize you are on your own, and the experience is much more overwhelming than you anticipated.
I am now in a time of controlled descent, waiting through a required 120-day period, during which any potential beneficiaries can come forward and contest the trust.
For Type-A personalities, doing nothing leaves you feeling uncomfortable. Every day, the urge to expedite tasks and accomplish goals clashes with the realization that the circumstances demand patience and restraint.
Because there is nothing you can do, time moves even more slowly. “Hurry up and wait” takes on new meaning as I grapple with a sense of impending urgency, coupled with the knowledge that certain aspects of what may or may not happen are beyond my control.
During this long stretch of suspended free-fall, I am learning to have faith in the strength of our preparations and the efficacy of the decisions made.
One of the cornerstones of our success has been assembling a team of trusted experts. The roster includes a tax attorney, CPA, estate attorney, and financial advisor. These individuals have not only provided important insights, they have also become invaluable allies in helping me to navigate the intricacies of estate administration.
While the specifics of our strategy must remain confidential, suffice it to say that the resources and planning instruments such as appropriate trusts, operating entities/structures and agreements, and other tools provided by these experts have proven indispensable. If you have not already done so, make sure that you engage with professional experts.
Remember, too, that this is not necessarily a one-and-done consultation. New laws and rulings can impact decisions made previously. So can any change in your personal life, as well as in the lives of your heirs. Periodically, you need to review the strategies and instruments as to their continued efficacy both legally and on the more personal level of serving the legacy that you have worked so hard to build for the benefit of your family and others.
As with any journey, there are always a few overlooked details. In my situation, a more meticulous approach to digital organization and using technology to manage passwords and logins would have alleviated a few hiccups.
Also, in hindsight, one key advisor was missing from our team. While

The complexities arising from differences in blended families, cultural backgrounds, generational gaps, faiths, socio-economic statuses, and even political affiliations underscore the need for an adept facilitator. It is all too easy to ignore these differences and hope for the best, but my experience dictates that this approach is much more likely to lead to turmoil. The importance of professional help to navigate unanticipated issues and disputes cannot be stressed enough.
Then, there are all of those seemingly unimportant questions left unasked. More on that topic and other key considerations will follow as I continue to share my experiences along this journey of “Navigating the Turbulent Skies of Estate Administration.”
As has become a personal mantra, remember that even in the face of uncertainty, we can find the strength to soar.

The Eviction Case Game-Changer You Can’t Afford to Forget!
It’s difficult to keep up with all the changing rent control laws, and politicians have structured many of the laws so that tenants have the advantage, even if they have violated their rental agreement. While there are lots of local rent control laws that vary by city, one law that is consistent across the state of California is that when you purchase a residential income property, you must serve the tenants with the proper change of ownership notice, otherwise, you technically do not have the right to collect rent.
In most instances, if you haven’t served proper notice, it won’t be an issue and the tenants will pay you rent regardless. However, should something happen, and a tenant does not pay rent and you want to move forward with an eviction case, if you haven’t served the proper change of ownership notice, you will likely lose your case. Tenant attorneys know the laws and are adept at using them to have cases thrown out.
This also applies if you change from individual ownership to an LLC or a corporation. That kind of change requires its own specific notice that needs to be provided to the tenant. If you don’t give the proper notice, again, you are likely to lose a case to collect unpaid rent.
Even when tenants violate their rental agreements, the legislative landscape often favors them, which makes it imperative to be well-informed. Ensuring a strong legal position in an eviction case is crucial for property
owners and adhering to proper procedural requirements is essential for safeguarding your rights. I find an ounce of prevention is worth a pound of cure, so when I represent a buyer who is purchasing a rental property, I always make sure to include all this information for the buyer at the close of escrow.
In addition to the notice—and most property owners don’t like this—under the law you must identify who the owner is, or who is an authorized agent for the property, and you must have a physical address where the tenants can serve you with notices or legal processes. You cannot have a P.O. box. You must have the name of a person, their telephone number, and a specific address.
There have been many instances where the owner has lost the case, even though the tenant had been paying them for years, they know the owner’s name, address and phone number, but this notice wasn’t served. This kind of legal outcome has become so common, and the laws so complicated, and often specific, that I provide annual compliance audits to all my clients to minimize their risk and ensure a sound legal footing. In some cases, this has meant preparing notices and serving them to current tenants as a courtesy notice to update their records.
