A BUILT FUTURE TO BE PROUD OF
A
s most of us in the building and construction industry would observe, there has been a lot about our industry in the media recently. Well, let me say that what you will see in this publication, what the industry has produced, and what the industry acknowledges and celebrates, is nothing short of a fabulous building industry story. This publication celebrates and recognises what is best about our industry — it showcases the built environment and its contribution to the social fabric of the community, and we should all be very, very proud. I thought I would give you an overview of the Master Builders Association and an update of several unique projects that the association has been engaged in over the last number of years. The MBA has some 8000 members in NSW and a combined national membership of about 33,000. Master Builders NSW has nine dedicated offices placed throughout regional NSW. It has a dedicated training facility in Norwest Business Park, and most recently the association completed construction of a new
training facility in Ballina, with others planned for Gosford and Wollongong. Master Builders NSW combined with Newcastle MBA directly employs nearly 500 apprentices in NSW through their group training schemes, and the MBA training and education department provides training services to nearly every sector of the industry. I cannot emphasise it enough, it is critical that we as builders encourage our contractors and tradespeople to embrace the engagement of apprentices, through traditional and schoolbased apprenticeship pathways, and drive to make our industry a first-choice career move. We must actively promote the principle that a trade skill is a most worthwhile profession. The MBA has been involved and is committed to a number of unique building industry focused pilot programs. It is now in its second year of a program in partnership with the NSW Government’s Department of Education and four universities, to establish a pathway from trade apprenticeship to bachelor degree. The pilot program includes: • A Pre-apprenticeship program; • A Trade apprenticeship; • A Diploma of Project Management; and • A Bachelor of Construction Management. Participants who complete their trade and the diploma may be eligible for a one-year exemption for the bachelor’s degree, through one of the universities Master Builders has an established relationship with. This pathway program addresses the increase in demand from industry for trade experienced project and site managers.
The Master Builders is also proud to be involved with the Apprenticeship Engagement Forum in the development of a “mathematics in trades” pathway. The program is designed to give high school students a better understanding of mathematics and its application in building and construction. This maths curriculum is being trialled throughout 2019 and 2020 in several NSW high schools for years 10, 11 and 12 students. This year, our industry has produced magnificent quality and exceptional levels of construction with the judges conducting on-site inspections of the projects worth over $1.6 billion. The industry should be very proud of its achievements. On behalf of the Master Builders New South Wales I offer my congratulations to all the entrants and winners. A special mention goes to the 2019 Master Builder of the Year, Yuncken Builders and Project Managers Pty Ltd and to Rick Simmons of One Up Building, awarded Young Builder of the Year. I thank the judges, who I should add, freely donate their time and expertise to examine, evaluate, deliberate and make very difficult decisions when considering all entries received. s this edition of Master Builder goes to print, the industry received a draft copy of the Construction Forestry, Mining, Maritime, Energy Union’s (CFMMEU) NSW Construction Branch, pattern enterprise agreement, 2019-2022.
restrictive works practices that the industry in NSW has never experienced. These include:
In its current form, the agreement seeks a 2.5% wage increase every six months for the duration of the agreement, which is 3 years. Further, the agreement demands an increase to superannuation contributions from 9.5% to 12%, significant increases to redundancy payments, fares allowance, and 24-hour accident and income protection. It is interesting to note that the agreement directs that this payment is to be made to a specific insurance provider, as well as prescribing increases to the premium each year.
• All shift work and overtime are to be paid at double time and, all overtime worked on a Saturday or Sunday (after an employee has worked overtime during a normal week), shall be paid at the rate of triple time.
The agreement also introduces the provision that casual employees are to be paid a 35% loading instead of the award provision of 25%. However, once a casual employee is employed for 6 weeks the loading is to increase to 80%. The draft agreement also provides for the payment of a $3 per week, per employee to an industry-specific drug and alcohol organisation. Increases to productivity and meal allowances are also demanded, as well as increasing the amount of protective clothing to be supplied. The agreement also introduces redundancy benefits for casual employees, as well as paid communication meetings, minimum weekly periods of notice of termination, and two weeks of paid family violence leave. What is different to union agreements of the past, is that this one introduces a number of

The new agreement also specifies the introduction of a totally inflexible rostered day off (RDO) system, which fundamentally means that every second Monday must be taken as a rostered day off. There are numerous other restrictive clauses throughout the agreement which impact on the engagement of apprentices and the way they accrue a 36 hour week, the taking of inclement weather, and the installation of personnel hoists. The MBA believes that this is the most restrictive agreement it has seen in decades and we must question the union’s capacity to genuinely negotiate enterprise agreements. With absolutely no productivity offsets, or flexibility in work practices, the industry cannot be blamed for losing total confidence in a union so out touch with community and commercial standards. he Housing Awards showcases the very best in residential construction and attracts a broad cross section of the residential building sector, including project home builders, contract builders, apartment constructors and contractors specialising in additions, alterations and renovations. 2019 saw a record number of projects entered with the judges astounded by the quality of construction, the many building obstacles successfully overcome during the building process, as well as maintaining excellent

ROSS FINNIE Ross’ career within the construction industry has spanned over four decades. Origins in managing numerous projects of varying architectural type, size and complexity to now specialising in WH&S, encompassing environmental and quality issues, has ensured his plenary comprehension of this sphere. He’s a member of numerous organization’s beginning with MBA NSW where he is a Gold member and former divisional president of Northern Suburbs Division, representative of the Council of Management, Legal and Contracts and WorkCover NSW Construction Industry Working Party and Standards Australia Construction Advisory Group. A member also of Resolution Institute Aust, NSCA and former secretary of ARCA. Ross established his own company TREW Enterprises in 1995 specialising in project management, restoration and heritage building work to now focusing specifically in areas of WH&S compliance and training, expert witness and reporting and HSEQ.
PAUL GIRDLER Paul Girdler is a licensed builder with 49 years of experience in the industry and a longterm member of industry associations. Initially working as a contractor, he obtained his Building Certificate in 1988, established his own business and continues undertaking projects across inner Sydney, specialising in residential renovations, extensions and restorations. During his career he has been a part-time teacher designing and teaching Basic Home Maintenance for Petersham TAFE and teaching in the School of Building at Sydney TAFE.
PETER MASIA Peter Masia is a building consultant and building designer, and former licensed building contractor, with over 45 years’ experience in the design and construction of mainly residential projects ranging from alterations/additions/houses to multi-dwelling/multi-level structures. Peter spent 17 years appearing weekly on ABC Radio 702 answering listener’s questions on building matters including 11 years on a Saturday morning program called “The Woodies”. He is co-author of “The Don’t Do It Yourself Handbook” published by ABC Books; and Chief Consultant to “Trade Secrets”, “Save $20,000.00 With A Nail”, and “Fix It Yourself” published by the Readers Digest. Peter is a long-term member of the Master Builders Association, a former MBA Accredited Consultant, and holds a BA from Macquarie University.
MAX MOSHER Max Mosher is an energy consultant and has worked in the energy industry for more than 40 years. He has a wealth of knowledge and experience in relation to solar and energyefficient house design, including energy utilisation in the domestic sector and thermal performance assessments. Max has been a committee member on a Standards Australia Review Committee BD/058 titled “Materials for the Thermal Insulation of Buildings”. He has been on the judging panels for the Building Designers Association Annual Design Awards, the Master Builders Association Excellence in Housing and Construction Awards, the Master Builders Australia National Excellence in Building and Construction Awards, and the Local Government Association Environment Awards. Max is a founding member and former director of the Association of Building Sustainability Assessors (ABSA).

MICHAEL O’DONNELL Michael O’Donnell is a licensed builder, accredited building consultant and is currently vice president of MBA NSW and chairman of the MBA NSW Housing Committee. He is the NSW representative on MBA Australia’s Residential Builders Council and is one of four industry representatives on the NSW government’s Home Building Compensation Fund Underwriting Committee. Michael joined NSW homebuilder Huxley Homes in 1976 and in 1979 took over Huxley Homes’ new Regional Building Division. Michael left Huxley Homes in 1995 and established his own business, MKO Constructions, which specialises in the design and construction of residential extensions, renovations and first-floor additions. Michael has his Diploma in Building and Construction and Diploma in Workplace Training and Assessment.
SIMON PILCHER Simon Pilcher commenced work in the building industry in 1986, joining his family construction company. He completed his Building Certificate course in 1990. Simon is now managing director of C E Pilcher & Son Pty Ltd, a building company with more than 60 years of membership of MBA NSW and which undertakes residential, commercial and industrial construction work. Simon is a past president of the Northern Suburbs division, a recipient of the divisional gold medal and has sat on the MBA of NSW Council of Management since 1994. Simon is currently deputy president of MBA NSW.
STEPHEN RAYNER Stephen Rayner has been a member of the Master Builders Association for 40 years. He is a past president of the MBA Northern Suburbs Division and has been treasurer since 2008. Stephen holds a Carpenter and Joiner Trade Certificate along with a Clerk of Works Certificate. He is the director of Stream Constructions Pty Ltd, which specialises in architect-designed projects, domestic and commercial renovations. During his building career, Stephen was a part-time teacher at Hornsby TAFE, teaching the building component of the Real Estate Certificate. He received the MBA Divisional Gold Member Award in 2012.

She has worked on numerous home titles including Grand Designs Australia, Pool + Spa, Period Home Living, BuildHome, Poolside, Kit Homes Yearbook, Master Builders Association Excellence in Housing Awards Annual, Renovate, Kitchens and Bathrooms Quarterly and Home Design. JOHN WORTHINGTON John Worthington has been a member of the Master Builders Association of NSW since 1976. He graduated from Sydney Technical College in 1971 and holds a building certificate and building diploma. He also received a Timber Pest Certificate from TAFE in 1989, Master of Dispute Resolution from the University of Technology in 1998, Professional Certificate in Arbitration and Mediation from the University of Adelaide in 1999, Accredited Certifier Program (BSAP) from the University of Technology Sydney in 2004, and was nationally accredited by the Institute of Arbitrators and Mediators 2008. He was chairman of the Building Consultants Council from 2009 for nine years and a member of the Council of Management of the MBA for eight years. John is currently engaged as a mediator, builder, building consultant acting as an expert witness in the Consumer Trader & Tenancy Tribunal and the court system in Australia. John was also “the builder” on the ABC television program “The Home Show” for four years from 1990.

rought to life on Sydney’s stunning Northern Beaches, this outstanding residence is far from a conventional shape and represents 42 months of hard work for the team who brought the incredibly difficult project to fruition.
in this area of Sydney, logistics presented difficulties, especially when carrying out Class 1 and 2 concrete work. Each pour had to be designed for truck lag and pouring issues.
The ‘Noguchi’-shaped skylight to the main barbecue deck adds a real feature, but perhaps the most striking element is the DeHavilland DC3 plane wing over the entrance. This plane was built in California in 1938, and served during World War II. It made its way to Bankstown, Sydney, was damaged in a storm, was shipped to Oberon, back to Bankstown and was then purchased by the homeowner. Managing director of Yuncken Builders & Project Managers, Chris Yuncken, supervised the two-metre shortening of the wing, which originally held onto the plane fuselage courtesy of 365 bolts. After 12 months of modifications and special shipping preparations, the wing arrived on site, was craned into pre-prepared position, and bolted onto two steel columns off the entrance hallway. This was just one of many very complex design-and-construct issues. The site required significant underpinning, piling, rock anchoring and shotcrete works. This process alone, including excavation and Level 1 footing beams and slab, took 12 months.
The Yuncken team installed a large tower crane, which had to be lifted into a 10m x 10m x 1.5m solid concrete base, supported by 12m x 9m vertical micropiles and 4m x 12m horizontal micropiles. The large tower crane base then became the base pond for a three-level water feature, for which Chris designed the hydraulics. To support the 200-tonne crane, Chris designed a platform using steel to support the downhill outriggers. This meant that the road wasn’t blocked and issues with permits and the Sydney bus route were avoided. This support structure was later removed, and the concrete columns and footings support now support the elevated driveway, another challenging aspect of the build. Due to the size of the large trees proposed for the Jamie Durie-designed garden, the only way to bring them in was by helicopter. Yuncken arranged a barge for the trees, some from the Northern Territory and more than 150 years old, to sit in Pittwater, and the helicopter ferried them into prepared positions.

This project involved the extensions and renovations to an original 1930s Byron Bay home and the construction of a separate granny flat in the rear yard that was sympathetic to the design and features of the original home. The new studio cottage has been constructed to a superior quality and reflects a respect for the original home and area.

This is a very impressive build. There are many interesting elements to be seen from the one-tonne steel letterbox, the 6m-high steel-framed light shaft for the staircase to the cantilevered steel balconies made from 16mm plates, all installed with exacting detail.
Initially, this may look like a simple off-form concrete structure, however, there were many fine examples of excellence in achieving the architectural design and quality of finishes. Exposed concrete may not be to everyone’s taste, however, the execution and precision of services infrastructure was met in spades. It incorporates a host of beautiful features, such as off-form concrete ceiling soffits and high ceilings. The judges particularly admired the stunning pool and rooftop entertaining area, while inside, the internal timber floors and bathroom finishes are of the highest standard. The main house has three wings containing bedrooms, entertaining and living areas using a range of materials — a zinc roof, sandstone walls, timber and glass. Great detail and workmanship can be seen as you walk around this very impressive house.

A most accomplished execution of a demanding design that required subtly complex details on a large scale. The builder was up to the task to produce an exceptional result. A dramatic and beautifully crafted steel staircase in this project typified the flawless finishes generally.
A meticulously documented and sophisticated architectural design requiring, among many other fine details, an existing timber floor frame to be removed from beneath the entire timber-framed dwelling and replaced with suspended concrete. This was just one of the many challenges faced by the builder in order to achieve this wonderful result. A credit to the builder.

This design relied on an extensive use of cedar and teak, flawlessly joined and a multi-planed symmetrical metal roof as a feature. The builder was up to the challenge, producing a beautifully crafted result. Exceptional building work.

On the first floor there is a spectacular living area and outside courtyard with garden.
A combination of heritage conservation and construction, One Avon Pymble in Sydney offers 168 apartments over three residential pavilions ranging from five to seven levels, as well as a reinvigorated heritage house which is now as a communal area for the residents and houses a library, gym, and recreational areas. Growthbuilt has developed landscape gardens to enhance and complete the nearby north shore blue gum forest.

They have been designed to ensure good solar access and control, privacy, natural light, ventilation and accessibility. A well supervised construction with high quality workmanship in the brickwork as well as all the standard of finishes.
The judges were particularly impressed with the standard of finish achieved in Stage 3 of the HammondCare Miranda complex project and the way the builder coped with particular challenges the site presented, prior to and during the construction of these 33 generous two- and three-bedroom independent living units. The builder’s craftsmanship does justice to all the timbers on display. A delight to behold.
A perfectly finished 52-tonne steep pitched concrete roof and offform concrete ceiling with little visible means of support in a suburban backyard. An astonishing achievement by an excellent young builder.

For the winning Best Use of Bricks project in Queenscliff, Impero turned to Victorian-based brick manufacturer Krause Bricks. The builder utilised cream-faced bricks to the entrance and two side elevations, and the curved brick walls are an imposing feature to the beautiful building. The bricks were individually cut and laid in a soldier course as a curved feature on the three elevations.
This is a very impressive build. There are many interesting elements to be seen from the one-tonne steel letterbox, the 6m-high steel-framed light shaft for the staircase to the cantilevered steel balconies made from 16mm plates, all installed with exacting detail.

This pool is square, however features radius corners to the external wall. It was designed to nestle into existing gardens and hedges that required careful excavation. All surfaces were tiled and with radius curved walls above ground, the concrete, formwork, tile preparation and mosaic tiling were installed to an extremely high level. Raising the pool out of the ground allowed the external walls to become a design feature.
Senator Pools has successfully created a compact, elegant courtyard pool that responds to the site’s contour constraints. The outdoor space design includes a 1.8m-deep plunge pool, set 600mm above the finished courtyard at the rear of the home and 600mm below the level at the rear boundary. The glass panel provides both aesthetic relief to the bulk of the pool structure and is appealing when viewed from within the home.

This L-shaped pool, as part of a modern extension to a beautiful Federation house, has a very deep section and a separate area with steps and seating. A pool window allows a great view of the deep end from the downstairs rumpus room. Artesian Pools incorporated a variety of materials, including tiles, stone and polished concrete. Ezarri Space Capricorn glass mosaic pool tiles blend in perfectly with the gardens.
Built to take advantage of beautiful views over Brisbane Waters and the surrounding bush, this pool and spa are on a very steep block. Thanks to the cantilevered design with infinity edges on two sides, the water runs through pebbles in the dry gutters and down to a retention tank under the pool. The pool can be accessed from the house level and has a large adjacent entertaining area inside the pool enclosure.

Freedom Pools’ winning design was built completely out of ground with a 2.8m-high infinity edge, while a black waterline tile and glass bead in the pebble mix gives the pool an aqua look against the gum trees. ne of the greatest difficulties’ builders face is keeping the work site safe and clean during the building process but the Gerni ATTIX 33 M-Class Industrial dust extractor takes care of that problem. Fire regulations and full-scale testing to ease compliance fears --------------------------------------------------------------------
In 2017 Grenfell Tower, a residential block in West London, caught fire with catastrophic consequences. Gaining worldwide attention, the tragedy rightly put a global focus on building product fire compliance. -------------------------------------------------------------------ccording to a subsequent inquiry, the presence of cladding that didn’t meet local building regulations was a major cause of the fire engulfing the building. What started on the fourth floor when a malfunctioning fridge caught fire, quickly spread to higher floors with the assistance of the combustible material. From a global perspective, the Grenfell Tower tragedy wasn’t the first incident of its type. Similar fires had occurred elsewhere, including here in Australia. For example, the Lacrosse Tower in Melbourne’s Docklands was found by the Metropolitan Fire Brigade to have non-compliant combustible cladding following the fire in 2014. And more recently, in February this year, the 43-storey Neo200 in Spencer Street, Melbourne. These incidents, and anecdotal concerns about the presence of non-compliant building materials of all types, forced the Australian governments to act. A recent audit by the Victorian Government, identified 500 buildings in need of rectifications to replace non-compliant cladding; and prompted it to announce a $600 million plan to address the problem. Despite this sum, some say more needs to be spent and claim the identified buildings don’t represent the full scale of the problem. More, they say, will need to be done. Apart from identifying and removing non-compliant product, from this point on, it is important that the problem does not become worse. Every effort must be made to prevent the installation of more noncompliant product on new or renovated buildings.
A
New Regulations For its part, the Australian Building Codes Board has acted to update and strengthen the National Construction Code in 2016 and 2019. According to the new changes, many internal walls and building façade walls comprising of composite systems with linings must meet fire test requirements to ISO 9705 and/or AS 5113/BS 8414, which are full-scale tests, to demonstrate fire compliance. Despite these new requirements being in

specifiers, engineers, builders and certifiers to ensure that a compliant product is used. Likewise, this responsibility also extends to building product manufacturers/suppliers to ensure they carry the full suite of the latest tests as required by Australia’s building code regulations. Important to note is that there has been no real change to the way industry certifies and confirms product compliance, and with non-compliant building products still being used in projects, this means that the building and construction industry as a whole must remain vigilant. The registration of the Training Contract provides the SBAT with a Training Contract Identification Number or TCID, which remains with the apprentice for the duration of their training. First, RCC took stock of where things were at using the Black Dog Institute’s audit tool. They scored 26 out of a possible 80 overall.

Some employees feel more comfortable talking to a mate or colleague than a manager when they’re feeling stressed or down. So RCC has trained about 3,700 employees and subcontractors with General Awareness [mental health] Training, 120 “Connectors” and 30 employees in ASIST suicide prevention through Mates in Construction. A Connector is someone trained with skills to keep someone in crisis safe, and help connect them to professional support. This program is based on the idea that “suicide prevention is everyone’s business”, meaning if the construction industry in Australia is going to make real change to reduce suicide then it can’t be left to mental health professionals, but rather everyone in the industry must play their part. The company chose Mates in Construction, because their messaging and approach is tailored to their industry and extends support to the subcontractor market also. Although the training has only been delivered recently the feedback has been positive. Employees have also been more proactive in reaching out to managers and the wellbeing team and managers are finding it helpful to know when someone in their team is facing challenges because they can check in with them and support them more effectively. Important Changes to the Security of Payment Regime Commence 21 October 2019 Significant changes to the New South Wales Security of Payment regime under the Building and Construction Industry Security of Payment Act (Act) will commence on 21 October 2019. The changes are mostly contractor friendly, are many in number and quite fundamental to the operation of the security of payment regime in New South Wales.
“This is a payment claim made under The Building and Construction Industry Security of Payment Act” [or words very similar to that]. If the payment claim does not bear that endorsement then it will not be a payment claim under the Act. The upshot of that is that the payment claim will not qualify for the Act’s regime of rapid determination and enforcement.
This article focuses on the legislative changes in so far as they will impact head and sub contractors. The changes will apply to payment claims made under contracts entered into on or after 21 October 2019.
There can be sound reasons why a contractor may prefer not to burn its powder on a payment claim under the Act. The reinstatement of the requirement for the endorsement provides more options for contractors and less room for equivocation.
Endorsement of Payment Claims
Due dates for payment
A payment claim issued under contracts entered into on or after 21 October 2019 will need to bear the endorsement that it is a payment claim made under Act, i.e. the words:
The only change in the due dates for payment of payment claims is a reduction of the maximum period permissible for a head contractor to pay a sub contractor. For
contracts entered into on or after 21 October 2019 this is reduced from 30 business days to 20 business days, which is not less than 28 calendar days and therefore still a substantial period. It is likely that many subcontracts will need to be amended to reflect this change. If however, the head contract is with the principal who resides in or proposes to reside in the subject premises, to be known as a “owneroccupied construction contract”, the maximum time for payment of claims by subcontractors remains 10 business days after the payment claim is made. These maximum due dates for payment relate to all payment claims, whether or not the payment claim bears the endorsement that it is a payment claim made under the Act. application of section 8 of the Act which establishes the “reference date” for payment claims. Section 8 will be replaced for contracts entered into on or after 21 October 2019 with a very simple clause providing: “A person who, under a construction contract, has undertaken to carry out construction work or to supply related goods and services is entitled to receive a progress payment”. The date from which a payment claim may be served will be fixed by section 13 as: a) On and from the last day of the month in which the construction work was first carried out; and then b) The last day of each subsequent month. As was previously the case, an earlier date can be agreed under the contract. Perhaps one of the most significant changes from the previous position is that there will no longer be doubt as to a contractor’s right to make a claim once the contract is terminated. The new section 13 (1C) makes it clear that a payment claim may be served on and from the date of termination. Much adjudicator’s time and legal costs will be saved by this express entitlement. To avoid argument and uncertainty, the amending act provides that a payment claim may include work carried out in a previous month. The fact that a payment claim does not include any work undertaken in the month that the payment claim will be academic, if that issue was ever any more than a quarrelsome argument. Withdrawal of adjudication applications The amendments make additional provision for the withdrawal of adjudication applications. A claimant will be entitled to withdraw its adjudication application at any time before the application is determined. There is however one caveat. If an adjudicator has been appointed and the respondent objects to the withdrawal, then, if the adjudicator forms the opinion that it is in the interests of justice to uphold the objection, the withdrawal will be of no effect. Circumstances where an adjudicator may consider it to be in the interests of justice to uphold the objection might involve repeated withdrawals causing inconvenience and cost to the respondent perhaps tantamount to abuse of process or where the respondent presses for a
determination in the interests of certainty.

Claimants in liquidation A claimant to which a liquidator has been appointed will not be able to serve a valid payment claim under the Act. Further, any adjudication application not finally determined before the date the liquidation commences is taken to have been withdrawn on the day a liquidator is appointed.
They will also be exposed to prosecution for failure to provide supporting statements with payment claims under the Act or providing supporting statements that are misleading in a material respect. Miscellaneous reforms
The appointment of a trustee in bankruptcy is not addressed by the amendments, nor is the appointment of an administrator.
Many of the penalties under the Act will increase, some by a factor of 5.
Time for the adjudicator to make a determination Rather than the 10 business day period always commencing on the date the adjudicator gives notice of acceptance of his or her nomination on the adjudication application, if a payment schedule were provided, the 10 business days will commence on either the date the respondent lodges the adjudication response or if no adjudication response is lodged, the end of the period within which the respondent was entitled to lodge a response. This has the potential to increase the time allowed for an adjudicator to determine an adjudication considerably, particularly if there is material delay in providing the respondent with a copy of the adjudication application. If no payment schedule was provided in time then the 10 business day period will still be counted starting from the day the adjudicator notifies the parties he or she accepts the nomination (i.e. no change). Increased liability of head contractors The maximum penalties to which head contractors are exposed for offences around supporting statements will increase markedly. For example, where a head contractor serves: • a security of payment clam without a supporting statement; or • a supporting statement knowing that statement to be false or misleading in a material particular, the head contractor will be exposed to a fine of up to 1,000 penalty units (currently $110,000) where it is a corporation (up from a maximum fine of $22,000).
Courts will have greater flexibility in the orders that may be made in challenges to adjudication determinations. In particular, if only part of the determination is found to be jurisdictionally defective, that part may be set aside and the balance of the determination confirmed. Previously the court was constrained to an all or nothing approach. Fair Trading’s investigative powers have been enhanced with greater powers to require information to be disclosed and enhanced powers of entry. Where Fair Trading is of the opinion that that offence is under the Act have been committed, its officers will be able to issue penalty notices (on the spot fines), as opposed to prosecuting the offence through the courts, thus streamlining the prosecution process. The fines can be appealed, but the costs and inconvenience of doing so will tend toward more timely and cost effective enforcement. What was not reformed It was anticipated by some that the changes would reduce the threshold for retention trust accounts to be maintained by head contractors from $20 million to $10 million. However, that can has been ‘kicked down the road’ perhaps until the next flurry of amendments, the timing for which is not yet known. The amendments do not introduce statutory trusts beyond the existing retention trust obligations for head contractors. Statutory trusts are under consideration and the Department has sought submissions from stakeholders. We expect there will be more news in respect of statutory trusts later this year or maybe in 2020.

DOMESTIC VIOLENCE With the constant, alarming media reports about domestic violence, Australians are acutely mindful of the impact it is having on families, friends and the broader community.
T
here is strong political and community pressure to focus on the importance of dealing with this ongoing social issue. In August 2019 both federal and state governments released the Fourth Action Plan of the National Plan to Reduce Violence against Women and their Children 2010-2022. It is reported that every week at least one woman is killed by a partner or former partner and every two minutes, the Australian police deal with an incident of domestic violence. Twelve women are hospitalised every day due to domestic violence. Domestic and family violence is the leading contributor to death, disability and ill-health among Australian women aged between 15 and 44. The reality is that domestic violence is not just
a private matter, it has significant impact all aspects of our lives and others — including the workplace. The impact and cost on workplaces is significant, with the annual cost to employers by 2021/2022 projected to be $235 million. Common costs and impacts affecting employees and the workplace include decreased performance and productivity, increased absenteeism and reduced morale. What is domestic and family violence? Domestic violence includes a wide range of controlling and coercive behaviours such as physical assault, sexual assault, verbal abuse, emotional abuse, financial abuse. Domestic violence can also be perpetrated through the use of technology and social media, or social

abuse when a person is isolated from their family and friends. There is also spiritual abuse when the individual is prevented from practicing their religion. It is not always easy to identify if you (or someone you know) is experiencing domestic violence or is in an abusive relationship. The following definitions give more insight into what is now understood to be domestic and family violence: Physical abuse Physical abuse happens when a person uses physical force against another person. It can start slowly and inconspicuously — for example, throwing an object or a slap and often gets more intense or worse over time.

The above listed behaviours are typical of the jealousy, possessiveness, put downs, threats and violence that occur in domestic violence and abusive relationships. Can men be affected? Domestic violence is not just isolated to women – it impacts men too. In Australia there are approximately 1 in 13 men who have experienced domestic violence since the age of 15. It is not always easy to identify when a person
It is estimated that between 55 - 70% of women experiencing domestic violence are currently in the workplace. This means that one in six female workers are affected, which in turn affects a significant number of workplaces and therefore, indirectly being impacted by domestic violence. Given the compelling impact that this issue is having on workplaces it is important that employers understand their legal obligations.

Social abuse occurs when someone insults or humiliates you in front of other people, keeps you isolated from family and friends, or controls what you do and where you go.

The 2019 MBA Northern Regions Building Awards were held on Saturday July 27 at Ballina RSL, with over 300 guests in attendance.
T
he awards acknowledged those who have gone above and beyond in the industry over the past 12 months, with local photographer, Paul Tuthill, capturing the evening. The judges for the evening, Ian Anderson and Warren Porter, were both impressed by the quality of workmanship and innovation employed by all of the entrants. From Port Macquarie in the south, to Burleigh Heads just over the Queensland border and everywhere in between - both Mr Anderson and Mr Porter went beyond the call of duty to evaluate and judge each and every entry on a consistent basis. With a record number of entries this year, the judging time spanned over four weeks with six to eight projects inspected per day and a mountain of paper work to follow. Yet the hard work paid off, with the winners of each category in the 2019 MBA Northern Regions Building Awards having won deservingly. Congratulations to all applicants and winners.

Waterproofing – combating the issues We’ve all heard the statistics around defects caused by waterproofing failures.

o help builders better understand the best practice approach to waterproofing to ensure it doesn’t fail, we’ve hosted a range of events in the region. Over the last four months, the Illawarra and Cronulla/Sutherland Region have benefited from a variety of internal and external waterproofing courses, as well as a waterproofing seminar with key note speaker Bill Straw who, along with his MBA Waterproofing Committee colleagues, created the MBA Waterproofing guides. It’s evident that every member who attends one of these events has found the course profoundly useful in some way. Mend were kind enough to host the July Safework Breakfast where members had an opportunity to hear from local SafeWork Inspector, Stephen Cooper. he popular event returned to the City Beach Function Centre, where more than 70 builders received 12 CPD points at the completion of the day. The broken airconditioning tested the few guys who turned up in short sleeves for a while, but the quickly-fixed system soon returned the room to comfortable levels. Fortunately the presenters kept things warm by presenting a number of “hot” topics including legislative changes for builders (MBA), waterproofing for builders (April Remedial Services), bush fire protection (Bushfire Consulting Services) and technical advice on building with cross laminated timbers (XLam Australia).

When you know the numbers you can take control not just with costs but with the overall framework of costs, scope, quality and time. Don’t be persuaded by other people’s ideas and their expectation of the costs. Have a thorough and bottom up approach of your costs, and be comfortable in knowing your costs.
Similarly, with trillions of dollars invested in property and building assets in Australia, regulation could improve building quality and longevity with independent building inspections and related improvements.
Have good systems with estimating, job costing and accounting that allow you to know the numbers.
For the future in building, we see a continuation of the trend of more work being done off site. This can offer better quality, cost effectiveness including connection with automation and future robotics and faster programmes. Building Information Modelling or a similar simpler process, improve project delivery.
Manage expectations Managing client expectations is at the top of the project tree of managing expectations in the project. We have a client-centred focus and prioritise project delivery on quality, time and costs.

SOO 1 and 3 – Agony to Ecstasy
T
he first State Of Origin fixture for 2019 was celebrated by 80 plus guests in the members’ room of the Newcastle MBA Building. The spit roast was a big hit but the night ended on a somber note with a win to the cane toads. What started as a celebration at half time turned in to a big disappointment as the Queenslanders stormed home. The highlight for the night was Peter Murphy’s win in the pass the ball competition. Revenge was sweet when over 90 members and guests packed the MBA members room for State of Origin 3. Prawns, oysters, chicken and
sausage rolls were the big ticket menu items that were devoured within 30 minutes by the eager crowd. The attendance numbers have grown dramatically over the six years the event has been held and the night was generously sponsored by Newcastle MBA Group Apprentices with everyone enjoying the exciting standard of football and a Blues’ victory . MBA’s Luke Reeves did an excellent job as compere and with the running of the lucky door prizes and pass the ball competition in SOO 1 but deserted Newcastle for a comfy corporate box for the decider. Brett Lester was also a key
figure with his skill in manning and controlling the popular bar in both origin events. Kerri Richards, Ashleigh O’Brien and Arthur Hawkins also dedicated a great deal of time and effort to ensuring the success of both nights. It was great to see so many members, their apprentices and staff come together to enjoy such a well organised and sociable event. The seafood appears to be the major attraction based on sheer numbers who attended but we will test that theory again next year. Get ready for a Blue’s dynasty.

e heard from Pat Conaghan MP, Member for Cowper and Brian Seidler, the Executive Director of MBA NSW.
Pat gave an update on the latest infrastructure spending in the Hastings and wider electorate. He also discussed strategies for small business and youth employment. The Government is aware of the skills job shortage in the construction industry and have plans in place to address the problem. Pat also talked about the success of the

For even more design flexibility, the system offers height adjustment from 17mm to 1070mm, millimetre by millimetre if required. This allows for unsightly services to be concealed under the floor while still offering access for maintenance of the waterproofing membrane and drainage systems.
In commercial urban environments where space is at an ever-higher premium, a building’s roof level is potentially a rich source of usable space. Buzon say their Pedestal System can be used to maximise a roof’s potential, both hiding all manner of services and protecting roof substrates from the elements, maximising integrity and longevity.
The pedestals are extremely strong as they are precision-engineered from high strength, UV resistant, recycled polypropylene and capable of supporting loads of more than 1000kg each. At roof level, this load is evenly spread by the wide base area of each unit, making them ideal for installation on any waterproofing membrane without causing damage, they can even be used directly over insulation material. The Buzon Pedestal System is also simple to install. Desired height is achieved by thread adjustment, which is lockable when reached and a range of interchangeable spacer tabs of 2mm, 3mm, 4.5mm, 6mm, 8mm and 10mm, allow for precise gaps between pavers and provide positive drainage without any concern of ponding or flooding.
