2023 AUCTION YEAR IN REVIEW 2023 was a memorable year for our company with Artvisory extremely busy with large and complex single-owner auctions, where we acted for vendors in three different states, bringing our national buyer database to each event.

Single-Owner Auctions

We started the year in country Victoria with the memorable auction at the vast Yaloak Estate – for Polo legend Mr Peter Yunghanns. A record-breaking auction result was achieved for a small oil painting by A.H. Fullwood, which sold for a multiple estimate $151,680 inc. BP, and it was one of the great art discovery stories of the

year. The painting had for decades been overlooked and undervalued, until Artvisory, with the help of academic Dr Gary Wersky, researched the work and were then able to reveal the picture’s importance within the broader context of the history of Australian art. This fabulous story was covered in detail by the Australian Financial review.

We then headed off to Sydney for the auction for respected business identities Ann Sherry AO and Michael Hogan in their spectacular Sydney Mansion – The Abbey, where we sold their art and antiques collections, led by the sale of an Andy Warhol edition of Mao for AUD$79,608.00 inc. BP.

Unquestionably the strongest result of the year for any antiques-based auction, was for the traditional antiques collection formed by the late Bruce and Judith Terry at their magnificent home, Teychel in Moule Avenue, Brighton. Sales for the Terry family by Artvisory ended up at close to AUD$1.2 million inc. BP.

Gaining coverage in the UK based Antique Trade Gazette, this auction produced some spectacular prices for English Georgian furniture, and it’s been a while since Georgian furniture has made auction headlines.

Then in October in Sydney and Woy-Woy, we presented to market the massive and complex collection, in two parts, of the late Bruce Kerr, acting under instructions from his wife and fellow-collector Janet Matthews. This was one of the largest collections we have ever seen of Australian Colonial antiques and European antiques and its result, being close to AUD$1.2 million in sales, would make it one of the top overall results ever for this category. Later in October it was good to re-kindle our relationships with our strong Tasmanian clientele, when we held the auction for Dr Robert Fisher in a spectacular venue.

We thank Penny Clive for being our gracious host for the time we spent in Hobart cataloguing, photographing and then displaying, and ultimately auctioning and dispatching Dr Fisher’s antiques collection. We were also pleased to end the calendar year posting the two highest grossing single-owner auctions held in Australia in 2023. First and foremost, Artvisory are single-owner auction specialists, and we already have two very major collections contracted for 2024.

Chinese and Asian Arts

In the field of Chinese and Asian art, Artvisory further cemented its position as the auction house of choice, especially for the sale of Chinese ceramics and works of art. Two auctions were held this last year with world-class fully illustrated catalogues.

The December auction featured a private collection consigned from Japan and this was a great vote of confidence not only in the Australian market for Chinese arts, but in our company as well and we were pleased to see some very good results for this vendor.

Australian and International Art

Artvisory had a very strong year for Art sales with some very significant results that are worth reflecting on. As well as the AH Fullwood discovery, already covered here, (sold for AUD$151,860.00 inc. BP). Artvisory also auctioned Andy Warhol’s iconic image of Mick Jagger in September for $150,000 inc. BP, and Keith Haring’s Pop Shop IV series for 150,000 inc. BP.

The last two results being posted within the very successful new category 'Exceptional in Australia' which proved itself a very good showcase for the best of the best, not only for applied arts, but also for Australian and International Art.

Exceptional in Australia

2023 saw Artvisory launch a new and exciting category called 'Exceptional in Australia'. Filling the gap for vendors who want to sell the best of what is available in Australia to an International market, where very fine and rare art and antiques are carefully researched and catalogued by recognised experts and where the auction catalogue is not lessened by lower value and lesser quality items.

Sales of close to AUD$1 million were achieved by only 35 lots. Every item had at least a full-page illustration and fully researched essays, and in many cases, double-page spreads and the concept was a resounding success and will be repeated in 2024. LEFT

Welcome to 2024 and what a way to start the new calendar year with this the Robert Burke porcelain collection. A truly remarkable collection it is and an auction that will stand out Internationally, as it is rare to see such a collection come to the market anywhere in the world. Paul recalls that it was the accountant at Sotheby’s Australia, Brenda Sheedy, who first struck up a friendship with Robert Burke and it was through Brenda that Paul first come across Robert, back in the early 1990s, some thirty years ago now. Robert Burke kept his collection private in Australia and many in the antiques business didn’t know him. But some of the world’s top English ceramics dealers, would visit Australia and vanish off to see him, with an air of mystery. Who was this major buyer that they came to see from so far away? To some Robert was known only as the Tamworth pharmacist who was believed to have a good collection. Boy did he have a good collection! When Paul made his first visit to see Robert’s collection, he simply could not believe what he was seeing, within the multitude of antique china-display cabinets that Bob housed his collection within.

Robert Burke lent a number of pieces from his collection to the National Gallery of Victoria for their significant 1984/5 exhibition: Flowers and Fables, A survey of Chelsea porcelain, 1745-1769, wouldn’t it be great to see some of these pieces find their way into our permanent national collections. One thing we are sure of, is that this idea would have brought great delight to Robert. This really is a remarkable opportunity for everyone, especially those interested in the history of ceramics, to visit and preview this collection, the like of which we have never seen in person in this country. We are extremely honoured to have been instructed to handle Robert Burke's collection on behalf of his family and we welcome everyone to come and marvel at this most wonderful collection. Robert Francis (RF) Burke 10 October 1932 – 22 March 2022

Affectionately known as Bob or Bobby. Bob Burke was a revered, wellknown identity in the Tamworth (NSW) area, recognised as a remarkable Pharmacist, long serving Rotarian, state tennis representative, outstanding footballer, a distinguished academic and local philanthropist, as President of Treloar Park Tennis Club with over 40 years of service to the club. Bob was known to have an international reputation for his fine porcelain. Bob was the middle child of five of Joe and Ivy Burke. He had two sisters and along with his two brothers was educated at Christian Brothers College, Tamworth. In 1947 he received an NSW Education Bursary for his secondary education and went on to become Dux of CBC College. Bob had successfully completed Latin in the Leaving Certificate after progressing his secondary education in an accelerated program for his age. In those days a pharmacist needed to have a pass in Latin in the High School Leaving Certificate standard as doctors wrote all prescriptions in coded Latin. After completing his secondary education Bob went on to obtain a Ph.C. (Pharmaceutical Chemist) award, or a B. Pharm. (Bachelor of Pharmacy) degree at the University of Sydney at only 18 years of age. Topping the Sydney University course again before he turned 18, was an outstanding feat, but more so as Bob also attained 100/100 in his final examinations and was duly decorated with the Chancellor’s Medal for Dux in that year and for outstanding academic excellence. Bob received a letter of congratulations from the then Federated Pharmaceutical Services Guild (now Pharmacy Guild of Australia) which read ‘Bob you are now in a position to name where you would like to practice Pharmacy’. Though at 18 there was still one obstacle to overcome. Bob needed to be ‘apprenticed’ and indentured to a practising registered pharmacist

(usually for one year) before he could solely be registered at 21 years of age. He was the youngest pharmacist to ever graduate at the age of 18 and was indentured for 3 years. In 1950 Bob worked at Mussons Pharmacy on Macquarie Street, Sydney for the prescribed indentured period before returning to Tamworth and working for Cyrill Cahill, of Cahills Chemist. Mussons provided Bob many opportunities to experience compounding ointments especially working on prescriptions for the nearby Sydney Eye Hospital. Developing ointments became a passion for Bob and this experience provided him skills to identify many skin irritations and suitable topical ointments which he became known for. Bob was recognised for his own mixtures of Koflin, Ilma wax, Cabolic Oil tincture, ‘Pink ointment’ amongst many other sought-after products Bob developed. As well as being competent in his academic studies, Bob was an accomplished tennis player who went on to play tennis at the NSW Country Championships. Whilst studying at university Bob played tennis for clubs at Crow’s Nest and further on Sydney’s North Shore often winning the championship tournaments. He was also a very good footballer alongside the Burke brothers. Cyrill Cahill of Cahills Tamworth had been a pharmacist for forty years. In 1962, he sold his pharmacy business to Bob. Bob had worked for Cyrill Cahill as a fully qualified pharmacist for the previous nine years and continued to trade as “Cahill’s Great Northern Pharmacy on the corner of Brisbane and Peel Street Tamworth. Bob purchased his own premises in 1971, returning to Cyril Cahill’s original shop at 305 Peel Street where Cahills is still operating today.

In the 36 years Cyrill Cahill operated his pharmacy, it was a store recognised for what used to be an appealing feature of old-time pharmacies - the huge glass containers of varying shapes, filled with coloured water within the timber lined store. When acquiring Cyrill Cahill’s business, Bob became the custodian of many vintage apothecary pharmacy porcelain jars and bottles, and he relished the opportunity to collect. Hence began Bob’s interest in lidded jars with waisted bodies, domed lids, finials decorated with medicinal plants and inscriptions and a love for their production, design and history which would launch Bob on a path of collecting porcelain. Bob decorated his pharmacy windows with these large bottles and apothecary porcelain chemist jars. He was known for pouring many hours into his decorating, curating displays, and beautifully arranging gondalas. Australian pharmacies had now become more like American ‘drug stores’ than British ‘chemist shops’ whereas the British pharmacists tended to sell only medicines and the like, the Americans and Australians began stocking all sorts of other products as well, including cosmetics, photographic materials, and confectionery. Bob toyed with these options over time, and he led the way by stocking every reputable cosmetic brand including Innoxa, Helena Rubenstein, Revlon and Elizabeth Arden. He was always the businessman looking for ideas where he could develop and diversify his business. In September 1965 he was the first NSW Pharmacist to introduce a digital cash register ready for the introduction of decimal currency. With the opportunity to travel, Bob often returned to Tamworth with grand plans and new-found knowledge from abroad. Bob at one time incorporated many concept shops within his pharmacies. He had an on-site Kodak 1- hour developing lab, carried various jewellery labels including George Jenssen and Taka and when Darrell Lea stores closed in 2012, Bob incorporated Darrell Lea into his repertoire of products. ‘If you can’t have the chocolate, you love… buy a slice of the company’ was Bob’s answer. Key to pinpointing where he found his love of antiques, are the many handwritten letters on lightweight, air mail paper from friends he made on those trips to the United Kingdom and other European countries. Many he corresponded with for decades who introduced him to the American Ceramic Circle and the English Ceramic Circle. Through these acquaintances, Bob became familiar with Worcester and Chelsea and the preferred pieces that would ‘complement’ a collection primarily because of the provenance of the piece. These letters were written by like-minded people Bob befriended who opened his world to the production of porcelain from the 1700 and 1800’s and the special ‘finds’ these friends wrote about that truly gave him a taste and appetite.

On the home front, when Tamworth Council granted land to the Tamworth Tennis Club at Treloar Park, Bob as Club President, and an avid player and member together with his builder friend, Johann “John” Dunst, worked tirelessly to realise the initial plan to build a tennis centre with 12 courts and a clubhouse. In all this work, the Club used its own money without grants and without the need to borrow under Bob’s leadership. He personally, financed many aspects of construction along with John as builder. On the court and in the clubhouse, John and Bob were a formidable team. John, originally from Austria coerced Bob to travel, rest and ‘live’. In doing so travel provided Bob many opportunities to explore the culture, history, and art world of Europe. When the Treloar Tennis Club was due to be opened, it was on one such visit to Austria where Bob and John had the opportunity to travel to Kitzbuhel, to meet with the then, very young Yvonne Goolagong and Margaret Court whom Bob invited to travel to Tamworth for an exhibition game at Treloar Park. This cemented Treloar Park to be recognised as only second at the time, to White City in Sydney, as an outstanding tennis centre running a well patronized Easter tennis tournament. Before he died in March 2022, Bob was back in contact with Goolagong Cawley and Court to again invite them back to Tamworth for the launch of the current refurbished Treloar Park, the new acquisition by Tamworth West Leagues Club. As a pharmacist, often Bob worked very full retail hours up until Christmas then took the opportunity to travel from Boxing Day for a few weeks to visit the UK and some other European destinations and to personally explore the porcelain world. He regularly did this up until 1988. By this time, he had connected with Robert and Judy Jones of R & J Jones Antiques and the Woollahra Trading Company. Robert shared his knowledge of dealers in surrounding areas and together they would road trip. Initially, Bob would collect period furniture and have them sent in a container via sea which took months to arrive in Tamworth. Bob recorded his purchases in a carbon copy invoice book to acquit information for BADA and VAT claims. Bob followed the purchase history of who was acquiring ‘what’ pieces. He subscribed to receive many, many catalogues and hardcover books referencing Worcester and Chelsea. He prided himself on purchasing very special pieces that due to the colour, design, the artist or in the case of James Giles, the London Atelier, the exquisite ‘marks’ on the pieces. It was the provenance that made the purchase desirable and the fact he curated purchases which complemented the porcelain sets within his 16 extraordinary cabinets. He was often affectionately referred to as ‘Bob, aka James Giles’. His handwritten notes record his efforts drawing the Giles’ marks and other distinguishable antique feature symbols for his own recall.

Bob felt he was in the position to acquire very special pieces and he never quibbled at what was required to lock in certain pieces. Mrs Anne George, and later Mark Law, of Albert Amor, St James, London were dealers who looked after Bob. As well, over the years he dealt with Robyn Robb, Robert Jones, Roy Twigg, Pat Daniels, Russell Brookes and Paul Sumner and many other Australian and internationally based auction houses and dealers represented in the catalogue. If Bob, returned to the pharmacy late at night with the intention of tweaking the displays and turning on the shop lights; it was primarily the time he called London dealers to just keep abreast of what pieces were on the market and express interest in pieces he had received photos of via Her Majesty’s Royal Mail. With the advent of the internet, it hastened the whole purchase process for him. Bob was not averse to trapping someone into pulling up a website and scrolling what was available and printing copies for him to peruse. The collection was Bob’s escape. He dusted, polished, and re-arranged the cabinets and staggered the pieces to the best advantage. It was a very special night to be included in a soiree, for an intimate viewing of Bob’s Collection as an invited guest. Together Bob hosted gatherings in the Burke family home in Tamworth that boasted an exquisite setting, purposefully arranged, separate to the family living areas. Bob’s mother and sister who still occupied the home, together with his two other siblings and their respective partners, availed guests, who enjoyed a night of beautiful hospitality, awe inspiring antique history talks, prepared by Bob. He poured over every aspect of each (new) piece. One night was never enough and many felt enchanted at the opportunity to do it all over again. As Bob remained a bachelor all his life, for the younger nieces and nephews, a 20-minute visit lasted 3 hours as he incessantly wanted all to partake in the love of his porcelain and the stories they told. If Bob heard of anyone travelling to London, he was very keen and blasé about them collecting a piece of porcelain and bringing it back to Tamworth for him. ‘Merely’ he said, ‘just put it in your carry-on’. Many proudly felt they had the honour of being a ‘antique mule’ for Bob Burke. Bob’s interests went beyond pharmacy and his antique collection. He was President of the Rotary Club of Tamworth North from 1974-1975 and was also recognised as a Paul Harris Fellow. The highest award in Rotary is the Paul Harris Award. It is given to a Rotarian or a member of the community that has made an outstanding contribution to the community. Bob was extremely proud to be acknowledged with this award in esteemed company of many other Tamworth businessmen. Bob went on to open a second Pharmacy with his sister Janet under the brand banner of Thrift Chemist, Kmart Plaza in 1981. Prior to the rise of discount pharmacies, he was the only registered pharmacist to own two pharmacies in NSW. Together with Janet his sister, who was a Women’s

International Hockey Umpire and Technical delegate, nominated as an official at the Seoul Olympics of 1988; they contributed to the construction of Tamworth Hockey Association’s synthetic turf fields in Tamworth. Bob stood steadfast to his mother Ivy until her death in 1991 and again was Janet’s carer as her health prematurely declined. Through those years he remained in Tamworth and had very few trips overseas. The preparation undertaken to sell the RF Burke Collection has been monumental. As a family we honour the importance this collection held to Bob. It is a measure of many things in his life. The success he had as a distinguished businessman in Tamworth, the love of fine things and the beauty, skill and craftsmanship and the joy of the occasion where this lifestyle was enjoyed. Bob was a man of service to his customers and the general community at large. He was generous of heart and showed dignity to all he encompassed. Many benefitted from his kindness and generosity. This catalogue is a final salute to Robert Francis Burke. We celebrate the man who was a son, brother, uncle, friend, and colleague. The RF Burke Collection here is realised for the first time and offered in its entirety under the label that Bob would be immensely proud of. We extend an invitation for those with a similar love to that of Bob, who appreciate how significant this collection is, to warmly share a part of Bob’s life that this collection embodies, in what will always be precious memories, significant in our Burke Family story. ‘His antiques carried no dust; those memories will last forever.’ Although some people think that ‘winning solves everything, you still have to put in that effort to become someone of distinction. That was Bob. But more so, he was one to live by the motto ‘work hard in silence, let success be your noise’. Quote adapted from Mary Lou Retton an American retired gymnast. ‘A trophy carries no dust. Memories last forever.’ ‘It doesn’t matter how many awards or accolades you have accumulated throughout your lifetime. It is the memories you share with your loved ones, friends, colleagues, and fans who supported your journey. Auction catalogues can be viewed on the Artvisory website www.artvisory.com.au approximately three weeks prior to the published date of an Auction.

Artvisory offers four options for bidding at our Auctions:

Printed catalogues will be available complimentary at the auction viewing and can be express posted (within Australia) prior to the viewing for $20AUD.

If this is your first-time bidding in person at an Artvisory auction you will be required to register with us, which requires you to fill out a buyer registration form in person at the viewing.

The Auction viewing is open to the public and generally takes place during the three days prior to the Auction date, from 11am–5pm at the advertised location/s in the Auction catalogue.

To facilitate this, please bring along your Government issued photo identification, such as a driver’s licence or passport as this is the only form of identification that will be accepted.

Lot Descriptions

Please make sure you register in the name you want your final invoice to be made out to, as invoices once issued cannot be changed, and in certain cases a deposit may be required before you can bid.

The Lot/Catalogue descriptions provide the overall information of an item including size, date or age, medium, attribution, quantity and if known, provenance.

Estimates The estimate accompanies each lot in the printed and online catalogue. This estimate takes into consideration the quality, condition, rarity, condition and provenance of the item. Each estimate also has a reserve, and the reserve is the undisclosed and confidential amount set at or below the low estimate. Please note the reserve will never exceed the low estimate at Artvisory.

Absentee Bidding

Cash payments must be deposited direct to the Company Trust account via any Commonwealth Bank Branch, and goods can be released upon supplying the deposit receipt.

Absentee bidding offers convenience if you are unable to attend an Auction in person, bid over the telephone, or if you wish to stick to your budget.

Personal, Company and Bank cheques are not accepted. All payment options and Company Trust Account details are included on the invoice that is emailed to you after the Auction if you are a successful bidder.

An absentee bid should be set at the maximum amount you wish to bid on the lot/s you are interested in purchasing. Should the lot/s be knocked down at an amount lower than the bid recorded on your form, the lot will be sold to you for the lesser hammer price plus Buyers Premium. If identical bids are received for the same lot, then the first bid received by Artvisory will take precedence.

All items must be paid for in full and collected within the collection times advertised for each individual Auction. If items are not collected within this time frame then Artvisory reserves the right to charge removal, storage and release fees.

Horace Walpole wrote of a previous Masquerade at Ranelagh in a letter to Horace Mann sent from Strawberry Hill on 3 May 1749: 'In one quarter, was a May-pole dressed with garlands and people dancing round it to a tabor and pipe and rustic music, all masqued, as were all the various bands of music that were disposed in different parts of the garden; some like huntsmen with French horns, some like peasants, and a troop of harlequins and scaramouches in the little open temple on the mount... Yvonne Hackenbroch, The Irwin Untermeyer Collection, figure 39, plates 29.3 for a figure of a Chinese boy relating to this figure his robes similarly painted to this figure. The distinctive scroll base to this figure is also unrecorded. This figure is not recorded in the literature but fits well within a small group of Chelsea red anchor figures modelled in the Chinese style by Joseph Willems. The group includes two similar models of three Chinese musicians attended by a boy, one in the Victoria and Albert Museum (Museum Number C.40-1974) and the other illustrated by Yvonne Hackenbroch, The Irwin Untermyer Collection (1957), fig 39, pls. 29-3. The outer garment of one of the three adult musicians on the Untermyer example is painted with florets which are very similar to those on the dress of the present lot. Other figures within the group include a pair of Chinese boy musicians on tree stumps, illustrated by Elizabeth Adams, Chelsea Porcelain (2001), fig 9.1, p. 119, another Chinese boy musician from the same series sold Bonhams, London, 6 June 2007, lot 211, and a perhaps slightly earlier pair of a Chinaman and a man wearing a Chinese mask, illustrated by Peter Bradshaw, 18th Century English Porcelain Figures (1981), p. 106. The present lot is the only figure in the group to exhibit the distinctive scrolled base. $5,000–8,000

Terms and Conditions of Sale The terms and conditions of sale listed here contain the policies of Artvisory Pty Ltd. They are the terms on which Artvisory Pty Ltd and the Seller contract with the Buyer. They may be amended by printed Saleroom Notices or oral announcements made before and during the sale. By bidding at auction you agree to be bound by these terms.

b)

1. Background to the Terms used in these Conditions The conditions that are listed below contain terms that are used regularly and may need explanation. They are as follows: “the Buyer” means the person with the highest bid accepted by the Auctioneer “the Lot” means any item depicted within the sale for auction and in particular the item or items described against any lot number in the catalogue. “the Hammer price” means the amount of the highest bid accepted by the auctioneer in relation to a lot

Images are measured height by width (sight size). Illustrations are provided only as a guide and should not be relied upon as a true representation of colour or condition. Images are not shown at a standard scale. Mention is rarely made of frames (which may be provided as supplementary images on the website) which do not form part of the lot as described in the printed catalogue.

“the Buyers Premium” means the charge payable by the Buyer to the auction house as a percentage of the hammer price. “the Reserve” means the lowest amount at which Artvisory has agreed with the Seller that the lot can be sold. “Forgery” means an item constituting an imitation originally conceived and executed as a whole, with a fraudulent intention to deceive as to authorship, origin, age, period, culture or source, where the correct description as to such matters is not reflected by the description in the catalogue. Accordingly no lot shall be capable of being a forgery by reason of any damage or restoration work of any kind (Including re-painting). “the insured value” means the amount that Artvisory in its absolute discretion from time to time shall consider the value for which a lot should be covered for insurance (whether or not insurance is arranged by Artvisory.)

Catalogue and other Descriptions All statements by Artvisory in the catalogue entry for the property or in the condition report, or made orally or in writing elsewhere, are statements of opinion and are not to be relied upon as statements of fact. Such statements do not constitute a representation, warranty or assumption of liability by Artvisory of any kind. References in the catalogue entry to the condition report to damage or restoration are for guidance only and should be evaluated by personal inspection by the bidder or a knowledgeable representative. The absence of such a reference does not imply that an item is free from defects or restoration, nor does a reference to particular defects imply the absence of any others. Estimates of the selling price should not be relied on as a statement that this is the price at which the item will sell or it’s value for any other purpose. Neither Artvisory nor The Seller is responsible for any errors or omissions in the catalogue or any supplemental material.

c)

Buyers Responsibility All property is sold “as is” without representation or warranty of any kind by Artvisory or the Seller. Buyers are responsible for satisfying themselves concerning the condition of the property and the matters referred to in the catalogue by requesting a condition report No lot to be rejected if, subsequent to the sale, it has been immersed in liquid or treated by any other process unless the Auctioneer’s permission to subject the lot to such immersion or treatment has first been obtained in writing.

2. Artvisory Auctions as Agent Except as otherwise stated Artvisory Pty Ltd acts as agent for the Seller.

4. At the Sale

The contract for the sale of the property is therefore made between the Seller and the Buyer.

a)

Refusal of Admission Artvisory reserves the right at our complete discretion to refuse admission to the auction premises or participation in any auction and to reject any bid.

b)

Registration before Bidding Any prospective new buyer must complete and sign a registration form and provide photo-identification before bidding. Artvisory may request bank, trade or other financial references to substantiate this registration.

3. Before the Sale Examination of Property Prospective Buyers are strongly advised to examine in person any property in which they are interested before the Auction takes place. Neither Artvisory nor the Seller provides any guarantee in relation to the nature of the property apart from the Limited warranty in the paragraph below. The property is otherwise sold “AS IS”

Bidding as a Principal When making a bid, a bidder is accepting personal liability to pay the purchase price including the buyers premium and all applicable taxes, plus all other applicable charges, unless it has been explicitly agreed in writing with Artvisory before the commencement of the sale that the bidder is acting as agent on behalf of an identified third party acceptable to Artvisory and that Artvisory will only look to the principal for payment.

d)

International Registrations All International clients not known to Artvisory will be required to scan through an accredited form of photo identification and pay a deposit at our discretion in cleared funds into Artvisory’s account at least 24 hours before the commencement of the auction. Bids will not be accepted without this deposit. Artvisory also reserves the right to request any additional forms of identification prior to registering an overseas bid. This deposit can be made using a credit card, however the balance of any purchase price in excess of $5,000 can not be charged to this card without prior arrangement. This deposit is redeemable against any auction purchase.

e)

Absentee bids Artvisory will use reasonable efforts to execute written bids delivered to us AT LEAST 24 Hours before the sale for the convenience of those clients who are unable to attend the auction in person. If we receive identical written bids on a particular lot, and at the auction these are the highest bids on that lot, then the lot will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors or omissions which may arise. It is the bidder’s responsibility to check with Artvisory after the auction if they were successful. Unlimited or “Buy” bids will not be accepted.

f)

Telephone bids Priority will be given to overseas and interstate bidders. Please refer to the catalogue for the Telephone Bids form. Arrangements for this service must be confirmed AT LEAST 24 HOURS PRIOR to the auction commencing. Artvisory accepts no responsibility whatsoever for any errors or failure to execute bids. In telephone bidding the buyer agrees to be bound by all terms and conditions listed here and accepts that Artvisory cannot be held responsible for any miscommunications in the process. The success of telephone bidding cannot be guaranteed due to circumstances that are unforeseen. Buyers should be aware of the risk and accept the consequences should contact be unsuccessful at the time of Auction. You must advise Artvisory of the lots in question and you will be assumed to be a buyer at the minimum price of 75% of estimate (ie. reserve) for all such lots. Artvisory will advise Telephone Bidders who have registered at least 24 hours before the auction of any relevant changes to descriptions, withdrawals or any other sale room notices.

Foreign buyers should note that all transactions are in Australian dollars so there may be a small exchange rate risk. The costs associated with acquiring a good certificate will be carried by the purchaser. If the item turns out to be forged or otherwise incorrectly described, all reasonable costs will be borne by the vendor.

All values expressed in Artvisory Pty Ltd catalogues (in any format) are in Australian Dollars (AU$). All bids, “hammer price”, “reserves”, “Buyers Premium” and other expressions of value are understood by all parties to be in Australian Dollars (AU$) unless otherwise specified.

G) Online Bidding Artvisory offers an online bidding service via Invaluable.com. When bidding online the buyer agrees to be bound by all terms and conditions listed here by Artvisory and agrees to pay any fees charged in regard to any purchases made via Invaluable.com. Artvisory accepts no responsibility for any errors, failure to execute bids or any other miscommunications regarding this process. It is the online bidder’s responsibility to ensure the accuracy of the relevant information regarding bids, lot numbers and contact details.

5. After the Sale a)

Buyers Premium In addition to the hammer price, the buyer agrees to pay to Artvisory the buyer's premium. The buyer’s premium is 26% of the hammer price plus GST. (Goods and Services Tax) where applicable.

b)

Payment and passing of title The buyer must pay to the company trust account managed by KK Partners Pty Ltd Chartered Accountants the full amount due (comprising the hammer price, buyer's premium and any applicable taxes and GST) not later than 3 days after the auction date.

H) Reserves Unless otherwise indicated, all lots are offered subject to a reserve, which is the confidential minimum price below which the Lot will not be sold. The reserve will not exceed the low estimate printed in the catalogue. The auctioneer may open the bidding on any Lot below the reserve by placing a bid on behalf of the Seller. The auctioneer may continue to bid on behalf of seller up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders. I)

The buyer will not acquire title for the lot until Artvisory receives full payment in cleared funds, and no goods under any circumstances will be released without confirmation of cleared funds received. This applies even if the buyer wishes to send items interstate or overseas. Payment can be made by direct transfer, cash (not exceeding $5,000AUD, if wishing to pay more than $5,000AUD then this must be deposited directly into the company trust account and bank receipt supplied) and Eftpos (please check your daily limit). Payments can also be made by credit card in person with a 1.43% (inc GST) merchant fee for Visa, Mastercard and American Express. Credit card payments where the card-holder is not present, can not be accepted unless a scanned image of the card and signature is supplied (that corresponds with the supplied signature on the bidding or registration forms). Personal cheques are only accepted with prior arrangement and funds must be cleared before goods will be released. Bank cheques are subject to three days clearance.

Auctioneers Discretion The Auctioneer has the right at his absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he may decide, to withdraw or divide any lot, to combine any two or more lots and, in the case or error or dispute and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to re-offer and resell the item in dispute. If any dispute arises after the sale, then Artvisory’s sale record is conclusive. Successful bid and passing of risk Subject to the auctioneer’s discretion, the highest bidder accepted by the auctioneer will be the buyer and the striking of his hammer marks the acceptance of the highest bid and the conclusion of a contract for sale between the Seller and the Buyer. Risk and responsibility for the lot (including frames or glass where relevant) passes immediately to the Buyer.

The buyer is responsible for any bank fees and charges applicable for the transfer of funds into Artvisory’s company trust account. c)

K) Indicative Bidding steps, etc. Artvisory reserves the right to refuse any bid, withdraw any lot from sale, to place a reserve on any lot and to advance the bidding according to the following, at the auctioneers discretion: Increment Amount

Collection of Purchases & Insurance Artvisory is entitled to retain items sold until all amounts due to us have been received in full in good cleared funds. Subject to this, the Buyer shall collect purchased lots within 3 days from the date of the sale unless otherwise agreed in writing between Artvisory and the Buyer. At the fall of the hammer, insurance is the responsibility of the purchaser.

Packing, Handling and shipping Artvisory will be able to suggest local, national and international carriers and takes no responsibility whatsoever for the actions of any recommended third party carrier. Artvisory can pack and handle goods purchased at the auction by agreement, however will take no responsibility for damage, a charge may be made for this service. All packing, shipping, insurance, postage & associated charges will be borne by the purchaser. Cultural heritage Export Licences Unless otherwise agreed by us in writing, the fact that the buyer wishes to apply for an export licence does not affect his or her obligation to make full payment immediately, nor our right to charge interest or storage charges on late payment. It is the Buyer’s responsibility to check Australia’s Protection of Moveable Cultural Heritage Act 1986 before purchase. If the Buyer requests Artvisory to apply

for an export licence then we shall be entitled to charge a fee for this service. We shall not be obliged to rescind a sale nor to refund any interest or other expenses incurred by the Buyer where payment is made by the Buyer in circumstances where an export licence is not granted. f)

Remedies for non-payment If the Buyer fails to make full payment immediately, Artvisory is entitled to exercise one or more of the following rights or remedies (in addition to asserting any other rights or remedies available under the law) i)

to charge interest at such a rate as we shall reasonably decide

ii)

to hold the defaulting Buyer liable for the total amount due and to commence legal proceedings for it’s recovery along with interest, legal fees and costs to the fullest extent permitted under applicable law

iii)

to cancel the sale

iv) to resell the property publicly or privately on such terms as we see fit v)

to pay the Seller an amount up to the net proceeds payable in respect of the amount bid by the defaulting Buyer. In these circumstances the defaulting Buyer can have no claim upon Artvisory in the event that the item(s) are sold for an amount greater than the original invoiced amount.

vi) to set off against any amounts which Artvisory may owe the Buyer in any other transactions, the outstanding amount remaining unpaid by the Buyer. vii) where several amounts are owed by the Buyer to us, in respect of different transactions, to apply any amount paid to discharge any amount owed in respect of any particular transaction, whether or not the Buyer so directs. viii) to reject at any future auction any bids made by or on behalf of the Buyer or to obtain a deposit from the Buyer prior to accepting any bids. ix) to exercise all the rights and remedies of a person holding security over any property in our possession owned by the Buyer whether by way of pledge, security interest or in any other way, to the fullest extent permitted by the law of the place where such property is located. The Buyer will be deemed to have been granted such security to us and we may retain such property as collateral security for such Buyer’s obligations to us. x)

to take such other action as Artvisory deem necessary or appropriate If we do sell the property under paragraph (iv), then the defaulting Buyer shall be liable for payment of any deficiency between the total amount originally due to us and the price obtained upon reselling as well as for all costs, expenses, damages, legal fees and commissions and premiums of whatever kinds associated with both sales or otherwise arising from the default. If we pay any amount to the Seller under paragraph (v) the Buyer acknowledges that Artvisory shall have all of the rights of the Seller, however arising, to pursue the Buyer for such amount.

Failure to collect purchases Where purchases are not collected within 3 days from the sale date, whether or not payment has been made, we shall be permitted to remove the property to a warehouse at the buyer’s expense, and only release the items after payment in full has been made of removal, storage handling, insurance and any other costs incurred, together with payment of all other amounts due to us.

6. Extent of Artvisory Liability Artvisory agrees to refund the purchase price in the circumstances of the Limited Warranty set out in paragraph 7 below. Apart from that, neither the Seller nor we, nor any of our employees or agents are responsible for the correctness of any statement of whatever kind concerning any lot, whether written or oral, nor for any other errors or omissions in description or for any faults or defects in any lots. Except as stated in paragraph 7 below, neither the Seller ourselves, our officers, agents or employees give any representation warranty or guarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose, description, size, quality, condition, attribution, authenticity, rarity, importance, medium, provenance, exhibition history, literature or historical relevance. Except as required by local law any warranty of any kind is excluded by this paragraph.

7. Limited Warranty Subject to the terms and conditions of this paragraph, the Seller warrants for the period of thirty days from the date of the sale that any property described in this catalogue (noting such description may be amended by any saleroom notice or announcement) which is stated without qualification to be the work of a named author or authorship is authentic and not a forgery. The term “Author” or “authorship” refers to the creator of the property or to the period, culture, source, or origin as the case may be, with which the creation of such property is identified in the catalogue. The warranty is subject to the following: i)

it does not apply where a) the catalogue description or saleroom notice corresponded to the generally accepted opinion of scholars and experts at the date of the sale or fairly indicated that there was a conflict of opinions, or b) correct identification of a lot can be demonstrated only by means of a scientific process not generally accepted for use until after publication of the catalogue or a process which at the date of the publication of the catalogue was unreasonably expensive or impractical or likely to have caused damage to the property. the benefits of the warranty are not assignable and shall apply only to the original buyer of the lot as shown on the invoice originally issued by Artvisory when the lot was sold at Auction. the Original Buyer must have remained the owner of the lot without disposing of any interest in it to any third party

iv) The Buyer’s sole and exclusive remedy against the Seller in place of any other remedy which might be available, is the cancellation of the sale and the refund of the original purchase price paid for the lot less the buyers premium which is non refundable. Neither the Seller nor Artvisory will be liable for

any special, incidental nor consequential damages including, without limitation, loss of profits not for interest.

Overseas buyers and buyers non-resident in Australia will not be charged GST on both hammer price and premiums under the following conditions:

The Buyer must give written notice of claim to us within thirty days of the date of the Auction. The Seller shall have the right, to require the Buyer to obtain two written opinions by recognised experts in the field, mutually acceptable to the Buyer and Artvisory to decide whether or not to cancel the sale under warranty.

The invoice supplied by Artvisory for purchases will be regarded as a Tax invoice for GST purposes.

14. Resale Royalty Scheme

8. Severability

Under the legal obligations of the Resale Royalty Scheme for Visual Artists Act 2009, sellers must provide the following information to comply with the act:

If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the Conditions shall continue to be valid to the fullest extent permitted by law.

9. Copyright The copyright of all images, illustrations and written material produced by Artvisory relating to a lot including the contents of this catalogue, is and shall remain the property at all times of Artvisory and shall not be used by the Buyer, nor by anyone else without our prior written consent. Artvisory and the Seller make no representation or warranty that the Buyer of a property will acquire any copyright or other reproduction rights in it.

10. Law and Jurisdiction These terms and conditions and any matters concerned with the foregoing fall within the exclusive jurisdiction of the courts of the state in which the auction is held.

11. Pre-Sale Estimates Artvisory publishes with each catalogue our opinion as to the estimated price range for each lot. These estimates are approximate prices only and are not intended to be definitive. They are prepared well in advance of the sale and may be subject to revision. Interested parties should contact Artvisory prior to auction for updated pre-sale estimates and starting prices.

12. Sale results Artvisory will provide auction results, which will be available as soon as possible after the sale. Results will include buyer’s premium. These results will be posted at www.artvisory.com.au.

13. Goods and Service Tax In accordance with A New Tax System (Goods and Services Tax) Act 1999 Artvisory Auctions will collect on behalf of the Australian tax office (ATO) a Goods and Service Tax (GST) of 10% on all applicable transactions. GST is applicable on the hammer price in the case where the seller is selling property that is owned by an entity registered for GST. GST is also applicable on the hammer price in the case where the seller is not an Australian resident. These lots are denoted by a dagger symbol † placed next to the estimate. GST is also applicable on the buyer’s premium.

was the artwork acquired after 8 June 2010?

is the sale/reserve price (including GST) $1,000 or more?

is the artist from Australia or a country listed in the Regulations to the Act?

is the artist alive, or deceased less than 70 years?

The seller: i)

acknowledges that he or she understands his or her legal obligations under the Resale Royalty for Visual Artists Act 2009 (the Act);

ii)

undertakes to comply with all requirements of the Act, including by providing its agent, the company, with accurate information sufficient for compliance with sections 28 and 29 of the Act;

iii)

undertakes to indemnify the company for any loss incurred by the company as a result of the vendor’s failure to comply with any of the vendor’s legal obligations under the Act; and

iv) acknowledges that if he or she fails to comply with any of his or her legal obligations under the Act, the company may provide the vendor’s name and contact details to Copyright Agency Limited (CAL). Lots subject to payment of the Resale Royalty Scheme will be denoted by the §. The Australian Resale Royalty is a flat rate of 5% on the hammer price (including GST). The Australian Resale Royalty is payable by the buyer in addition to the buyers premium plus any applicable GST.
