Code Compliance certificate. This building consent authority must have granted the building consent. Another building consent authority may issue a code compliance certificate, but only if both the owner and that building consent authority agree. When to issue Once any fees (including any development contribution owing) have been paid and all matters for consideration outlined below have been considered, the building consent authority must issue a code compliance certificate on form 7 of the Building (Forms) Regulations 2004.
Ray Knight Today’s Real Estate comment covers a topic which Real Estate Salespeople come across on a regular basis and that is the property that they are selling or listing upon investigation has not had a Code Compliance issued by the Local Authority. The following is a detailed outline of the Code Compliance Certificate process and the implications of non compliance with the Building Act. While it may seem somewhat boring, the fact that a C.C.C has not been issued for a particular property may stop a transfer of title, in plain terms, no sale. CODE COMPLIANCE CERTIFICATES (CCC'S)
The code compliance certificate provisions under the Building Act came into force on March 31, 2005. A code compliance certificate is a formal statement issued under section 95 of the Act, that building work carried out under a building consent complies with that building consent. The Act introduces a number of changes surrounding the application for, and processing and issuing, of code compliance certificates. Major changes include that: • the code compliance certificate is issued if the building work complies with the building consent • only the building consent authority that granted the building consent can issue the code compliance certificate (unless an agreement is made) • at the expiry of 2 years from the date the consent was granted the building consent authority must decide on whether to issue a code compliance certificate. The decision must be made within 20 days of the expiry (or a further agreed period). • interim code compliance certificates can no longer be issued • it is an offence to use or permit the use of public premises affected by building work that has no code compliance certificate, certificate for public use or certificate of acceptance • it is an offence for a residential property developer to transfer a household unit without a code compliance certificate. This does not apply to contracts entered into
prior to 30 November 2004. When undertaking a final inspection for a code compliance certificate, a building consent authority will need to ensure the building consent documents accurately reflect the work on the site. This application must be on Form 6 from the Building (Forms) Regulations 2004. It must include generic information as well as the following. • Evidence of ownership (certificate of title, lease, sale and purchase agreement). • Details of authority from the owner if an agent of an owner applies for the code compliance certificate. • Details of the people who undertook the work, including registration numbers if applicable. The Act requires this form to be accompanied by certificates relating to any gas fitting or prescribed electrical work (energy work) that has been carried out. PROCESSING AN APPLICATION FOR A CODE COMPLIANCE CERTIFICATE
Processing time The building consent authority has 20 working days in which to decide whether to issue the code compliance certificate, following either: • the application for a code compliance certificate, or • expiration of the 2-year or agreed period since the date the building consent was granted (if no application has been made). If either party considers 20 working days to be insufficient time, the building consent authority and the owner may agree on a further period of time. The building consent authority must then decide whether to issue a code compliance certificate within the agreed time-frame. Within the 20 working days or agreed period, the building consent authority can reasonably request further information about the application for a code compliance
certificate. If this is the case, then the time period is suspended until the building consent authority receives that information. ISSUING A CODE COMPLIANCE CERTIFICATE

Stencil art How to make fun stencil art on your walls WHAT YOU NEED
1. Wall Pattern Stencil Kit 2. Sample board (poster board, cardboard etc) 3. Latex or acrylic paints, including basecoat paint 4. Dense foam roller with rounded ends, stencil brushes 5. Regular nap roller and sash brush for basecoating 6. Paint tray and large styrofoam plates 7. Low tack painter's tape, spray adhesive (optional) 8. Cutting Edge Stencil Level (optional) 9. Paper towels or rag, cleaning tools & liquid soap 10. Step ladder Always remember to sample your technique first. Use a wall in the garage, a piece of cardboard, or even an old pizza box as your sample surface. Next, make sure your walls are clean, dust free and in good condition. Any cracks or chips should be repaired, filled, primed and painted prior to stencilling. Basecoat your surface in your desired latex flat colour. You'll need at least two coats of basecoat for good coverage. Your base coat should be fully dried for at least 24 hours prior to stencilling. Position the stencil on the wall and tape it to the surface with a few pieces of low tack blue painters tape. Make sure you do not use regular white masking tape as it's too sticky for most painted surfaces and will likely pull off the base paint when you remove your stencil. You can also use a spray adhesive
to achieve even cleaner and crisper edges Now pour some acrylic or latex paint onto a foam plate. You don't need much, about 2-3 tablespoons of paint is enough to start with. Have your dense foam roller (or stencil brush) ready. Load your foam roller by rolling it into the paint a few times until it absorbs most or all of it. Use only dense foam rollers with rounded edges. Then blot off the excess paint on a folded paper towel by rolling it back and forth a couple times. There should be no visible paint on the roller surface; it should look almost dry. Remember, it's better to have less paint on your roller than too much paint. Any water-based paint should work. STENCILLING WITH A ROLLER
Roll the stencil with your roller using light to medium pressure. Excessive pressure may cause paint seepage under the stencil. Be careful not to roll over the outside edges of the stencil. Strategically placing blue masking tape on the narrowest edges can help prevent "roll-overs". You can easily check how you're doing by carefully un-taping and lifting one corner of the stencil and taking a peek. Do you like what you see? Is it enough pressure or can it use a little more paint? If it's too pale, just put the stencil back and roll it a couple more times back and forth, slightly adding more pressure. When stencilling lighter colours over darker colours, you may need two coats to achieve good coverage. Let the first coat dry for a couple of minutes and then roll the stencil again. Make sure the stencil got even paint coverage before removing it unless you want a faded, antique look. Now remove the stencil and enjoy your artwork!

When it comes to planting, look for a spot with full sun and partial shade. You’ll also need soil that’s moist, and with a ph around 6-7 (if it’s too low, add lime). I also recommend digging in some compost or a good general fertiliser like nitrophoska blue. Plant each seedling about 20cm apart. If you’ve been following my advice recently, you’ll know to plant them in between your brassicas (cauliflower, broccoli, etc.) as spinach neatly fills in the gaps needed for these slow-growers. Want a constant supply of this dinner-time staple? Plant more every couple of weeks. As your plants begin to flourish, look out for slugs and snails. You might want to try our fool-proof beer bait which is sure to put paid to those critters. Once it’s ready to harvest, you’ll realise how handy it is to have in your own back yard. Rather than buying in bulk at the store, you can simply pick off the leaves as you need them. The younger, outer ones will have a slightly gentler flavour compared to the more mature inner leaves, so try experimenting with the taste. Pick the leaves often, even if you’re not eating them. This will ensure the plant doesn’t become overgrown with leaves and inhibit its growth. I bet you’ll love saying goodbye to the overpriced, plasticwrapped variety, and hello to home-grown goodness.
