Buying a property at auction If you’re keen on a property that’s going to auction, preparation is everything. A successful bid means you are immediately committed to buy the property; you cannot seek legal advice, arrange finance or even get the property valued or inspected when the auction is over. That means you need to do all your due diligence in advance of auction day. Before the auction (usually after you’ve viewed the property), the real estate agent working for the seller should provide you with a copy of the terms and contract of sale, which sets out what chattels will be included with the property. This document will also tell you the amount of the deposit to be paid by the successful bidder, and when the balance of the payment must be made. These documents should be checked by your lawyer. You should consider having the property checked (preferably by a qualified inspector who has professional indemnity insurance and carries out their work in accordance with the New Zealand Property Inspection Standards and obtain an up-to-date Land Information Memorandum (LIM) from the local council. It’s a good idea to get a valuation of the property, especially as you
are likely to require one if you need a loan. Some websites provide free estimated market values that may be useful. There’s a lot to take in at an auction and it’s easy to feel overwhelmed. If you can, go along to one as an observer to see how the process works before you actually want to buy. Remember that the auctioneer is working for the seller and they want to get the highest

You have purchased a new home and the settlement date is approaching: now what? The sold sticker is up, and you have made a selfie for Facebook “check out my new home.” It’s all organised. There is one last thing to consider before you start planning where everything is going, and that’s your pre-settlement inspection. Don’t expect, make sure you book this ahead of time. It is recommended that the property inspection takes place within a few days of settlement, but it is best to be done when the house is empty (although this is not always possible).
What does your sale and purchase agreement say about a pre-inspection? 3.2 provides that: “If the property is sold with vacant possession, then subject to the rights of any tenants of the property, the vendor shall permit the purchaser or any person authorised by the purchaser in writing, upon reasonable notice: 1.

Using the right pipes Gully traps are a hot topic in Mid Canterbury at the moment.

In November the Ashburton District Council launched the Right Pipe project, which involves inspecting the drainage systems of all residential properties in the urban Ashburton area to ensure stormwater runoff is draining into the correct pipe network. Many Mid Canterbury properties have gully traps that are lower than what is legally required under the New Zealand Building Act. Each residential building must have at least one gully trap. It is a basin in the ground which receives piped wastewater from your kitchen, bathroom and laundry before it is emptied into the sewer and one gully trap may receive discharge pipes
from several outlets. The basin has a water seal to prevent sewer odours reaching the surface. The top or surround is raised above the ground level to prevent stormwater and other foreign matter entering the sewer. If a drainage system becomes blocked, the gully trap provides the point where sewage can overflow outside the building, instead of building up inside the pipe and overflowing inside the building. The council is a few months into the Right Pipe project and has been inspecting properties around the district. Property owners will be notified of the scheduled date and time of the inspection and advised of the results, including whether their drainage system meets the required standards and what work, if any, is needed to get it up to standard. The Building Code says your gully trap surrounds must be 25mm above a paved surface or 100mm above unpaved or garden surfaces. Gully traps must have an overflow rim at least 150mm below the overflow level of the lowest fixture served by the system.

They must also be located within the legal boundary of the land on which the building stands, prevent surface water from entering the trap, be constructed so the grate will lift to allow access and have at least one discharge pipe feeding into it to maintain the water seal. If your gully trap is not the right height, there are low cost options you can do. If your gully trap is a modern plastic type you can install a plastic gully trap riser that is simply fitted over the gully trap with a sealant around the edges and wall to keep stormwater out. Another option is to install a

precast concrete surround that is mortered into place and around the edges and end wall to keep stormwater out. Both options are readily available from local suppliers or hardware stores. Installing a concrete surround onto a soil or garden area will require a concrete base boxed up and allowed to set, then mortered into place. Clean the surface first and unless you lay bricks for a living, take the time to mask up the gully trap surround and around the area using a good quality pre-mixed morter. Install the surround into place and wipe off any excess.
