Is there any particular reason why Jacinda Ardern announced her Cabinet reshuffle of the housing portfolios on the 27th of June? Probably not. But a cynic might draw the conclusion that she did so to attract attention away from the devastating effects of a piece of legislation, passed in Parliament the previous day, which ushers in one of the biggest changes in housing policy in years. Bigger than KiwBuild, bigger than the decision to dump capital gains tax, bigger than the ban on foreign buyers. If you missed it, you’re not alone. So did almost everyone else. Indeed, nothing in the name of the bill gave any indication of what was hidden away in its small print. But introduced under the innocuous name of the Taxation (Annual Rates for 2019–20, GST Offshore Supplier Registration, and Remedial Matters) Bill were provisions that have ended the ability of property investors to offset rental losses against other income. In doing so, this bill will unquestionably have a greater impact on the supply of rental accommodation in New Zealand than any other housing legislation passed, in this country, in the past half century. Let me explain why. Up until this bill was passed, property investors who made a loss on a rental property could offset that loss against other income which, for most investors, was from a small business or a nine to five job. This means that someone who owned a rental property on which interest, insurance, rates, maintenance and other costs exceeded the income from rent on the property could either deduct the difference (the loss) from their other taxable income, or be eligible for a refund if they had already paid tax elsewhere. It isn’t a subsidy or a loophole, it’s a standard tax practice that is applied broadly against hundreds of thousands of businesses across New Zealand and

is based on the principle that the costs associated with establishing and running a business should be deductible from overall income. But not anymore. With the passage of this new bill rental property tax losses will now be ring-fenced, which means that they can be used only to offset taxable income from rent. That might sound reasonable – until you realise that investment property in the major metropolitan centres (including Auckland and Wellington) generally makes a loss for up to 10 years before it starts making a profit. In a sense, such property investors are actually subsidising their tenants – a claim which will draw howls of outrage from the usual quarters, but is nevertheless, true. Even with the previous ability to claim losses against other income, many landlords are still out of pocket for years. According to Inland Revenue,

116,000 property owners declared an average property investment loss of $7138 on earnings in the 2016/17 year. The introduction of this draconian legislation means that these people will now not only make a loss but will also pay over $2000 more in tax, per year, than they should. At the same time, the Government will pocket a windfall of over $230 million, per year, by not refunding investors for overpaid tax. The consequences of this law change are entirely predictable. Some landlords will look to recover this additional cost through the most obvious source – rent. This means that rents will rise even more at a time when we’ve already seen higher rent increases, over the past two years, than we saw in the previous 10. Others will see this as the final straw in a hostile rental environment which has already seen their costs increased

through new legislative and compliance requirements. Those investors will sell up and leave the market, meaning that the supply of rental accommodation will drop at precisely the time when the country needs more rental housing than ever before. Most alarmingly, this will provide yet another reason not to invest in rental property in the first place - a turn of events which will certainly compound an already serious market shortage. Taken in context with the Government’s other rental housing policies and initiatives, it would be difficult to deliberately design a set of policies which would more effectively destroy the rental sector and remove the incentives which have made private citizens the dominant providers of rental accommodation, in this country, for over half a century. You’ve been warned.

For most Kiwis, your home is probably the single biggest purchase you’ll ever make. It’s a stressful process and it makes sense that you’d want to secure insurance to protect yourselves and your new home from natural disaster, fire or any other accidental events. Real Estate Authority (REA) chief executive Kevin Lampen-Smith, says: “Adding insurance near the top of your checklist when hunting for a house is now very important as the insurance market is changing. A bank or lender will want proof that you have arranged property insurance before settlement, even if you have conditional pre-approval with your finances”. To work out if a property can be insured, contact different insurance companies to get a quote. It can also be a good idea to talk to an insurance broker. They are independent insurance experts, who work for you and are not attached to an insurance company. They will give you advice on what might be best for your situation – identifying risks and recommending cost-effective solutions. “If you already have contents insurance, get in touch with your insurer first to see if they’ll offer you property insurance,” says Lampen-Smith. Insurers often ask lots of questions about your personal insurance history and whether you (or anyone who will be living at the property) have any criminal convictions. “This is because they want to be sure

that you are a ‘good risk’, especially since this will be your first home. Having an existing relationship with an insurer means that you have already been assessed in this way,” Lampen-Smith says. An insurer will want to know as much as possible about the property you want to buy – its address, age, condition, size and the materials it is made from. If the house is being sold by a licensed real estate agent, they should be able to help you out with this information. “You can ask the agent if the property is currently insured and whether there have been any issues with the property that could affect its chances of being reinsured in the future,” Lampen-Smith says. “If you are aware of other risks to the property that an insurer is unlikely to know about, such as landslip issues – even if there has not been any damage to the home yet – you need to tell the insurer when applying for a quote or for cover. For example, if the house is in an area that has been flooded before, an insurer may limit or exclude any cover for flood damage. If this is the case, it’s better to know as early as possible,” Lampen-Smith says. “You can contact the Earthquake Commission (EQC) directly to see what information they might have on record regarding potential damage to the property from natural disasters.” “I also suggest seeking legal advice before signing a sale and purchase agreement as you may need to make

confirmation of insurance an important condition of your offer,” says Lampen-Smith. There are a few different types of insurance – ‘sum insured’ is the most common in New Zealand. The Insurance Council of New Zealand (ICNZ) has a great guide to house and contents insurance, which runs through the options. Insurance companies are reassessing how they cover coastal or clifftop properties or properties in low lying areas that may suffer from seawater inundation due to the increasing risk of environmental damage or rising sea levels. This means that the cost of premiums may increase, exclusions may be added, or insurance cover may be withdrawn for some properties as the risk changes. EQC doesn’t cover damage to land from coastal erosion (although it does cover storm and flood damage to land) or damage to residential structures or contents from storms, floods or coastal erosion. “While earthquake damage is covered by EQC, you must have private home insurance first to qualify for it,” Lampen-Smith says. The premium you pay is broken down into the cover that goes to the company and a levy that goes to EQC and Fire and Emergency NZ. From 1 July 2019, EQC no longer covers contents – affecting policy holders on the anniversary date of their existing policy, which is generally the annual renewal date, or if you take out a new policy. “If an insurer agrees to cover a prop-
