Buyers beware. The process of selling and buying real estate can be overwhelming and stressful especially when considering the amount of preparation and paperwork involved in these transactions.

• Take care of the negotiation process and provide guidance with the paperwork involved. Are purchasers better protected when purchasing through real estate professionals? Most certainly they are. This is especially so if the purchaser lacks sufficient experience in purchasing real estate. Generally, selling property privately is not classified as being in the trade, and therefore these activities are often not covered by the Fair Trading Act 1986. What this then means for consumers (the purchaser) is that if a private seller misrepresents the property or fails to disclose important facts about the property, then the only remedy available is in court action, which can lead to considerable cost and time delays, with no guaranteed outcome.

Most sellers in New Zealand still rely on real estate professionals to sell their property rather than selling privately. The reasons for this can vary, but many property owners clearly feel that a real estate professional can: • Help market their property efficiently and effectively to attract potential buyers.

More importantly to consider is that the onus of proof in these court actions lies solely with the person bringing the claim. By way of comparison, if the property was offered in trade, via a real estate agent, then an option exists for a complaint to be made to the Commerce Commission. Under the Fair Trading Act, the Commerce Commission has the role to enforce

this Act by investigating and prosecuting agents. The Commission can also ask the Court to order compensation for a consumer who has suffered loss. The Consumer Law Reform Bill proposes to take this step further and include an additional provision under the Fair Trading Act which will place the onus on the person making the representation, (i.e. the agent)

Upgrading the ‘Man cave’ From a far-out space lair to a pigskin paradise and you've got one-of-a-kind spaces for the man of the house that are beyond cool. In the past five or so years I have noticed the addition of the man cave in homes is on the rise. No longer are the men in our lives confined to the garage, many homes now have dedicated ‘man-space’ often these are multipurpose spaces that are no longer hidden away in an outdoor shed.

This space of course is still open in most cases to the entire household but remains the guy’s area to set up and use as he likes. Here are some handy tips about creating your own man cave 1. G et a good look at what you are working with, imagine what you want the room to look like and be realistic in your goals for the space and function of the room. 2. C hoose a ‘look’ for the room, do you want to create a hunting haven or a functional second living room with some decidedly male features. 3. M easure everything, there is no point buying that massive pool

table online only to find that you can’t fit it in the door and even if you could it would dwarf the entire room. Try using graph paper and drawing things to a ¼ or ½ scale, this will allow you to plan your Man Cave in detail. 4. Make a weekend out of it, get some friends over hit the hardware store and have at it. Sometimes a different perspective can be the difference between a great renovation and an epic fail. 5. D on’t be afraid of the second hand store, Mid Canterbury has many used goods stores on offer and if you take your time you can find some real bargains that

will give your Man Cave some character. 6. I f you require plumbing, electrical or other heavy duty work contact a professional. A DIY botch up can be the talk of the Christmas table for years, you are better of getting help in the beginning it will save you money in the long run. Creating the perfect space can take time so don’t be afraid to leave space once you have finished the base of the room. This not only leaves you room to improve but leaves your family and friends the opportunity to give you fantastic Man Cave gifts for the foreseeable future.
