Well here we are, October and the start of Q4 of 2024 and this month brings with it two big events in the auto industry, the Philippine International Motor Show and the 12th Philippine Electric Vehicle Summit and they both open on the same day October 24. at usually means there will be quite a few launches to look forward to!
Before all that happens, lets recap the recently launched vehicles in this month’s Fresh out the Box., there’s a quite a lot this time - AION, a new EV brand held their brand launch and their rst two models in the country the AION Y Plus and the AION ES. Audi RS 6 Avant GT, BYD Seagull EV hatchback, JAC JS8 Pro SUV, Honda Civic RS e:HEV, the new Jeep Wrangler Rubicon, e New Kia Carnival, Lamborghini Revuelto a V12 plug-in Hybrid, the Lotus Emeya an electric hyper GT car, Lynk & Co 06 SUV, MINI recently unveiled two new EV’s, the next-gen MINI Cooper and the next-gen MINI Countryman. And a new player in the Philippines, VinFast launched their second model in the country, the VF3 mini EV SUV. Quite exciting right? Something for everybody, and there’s more to come!

e have already seen hydrogen race cars enter the Fuji 2 Hours, Hill Climbs and the akar Rally this year. Hydrogen power is slowly and surely emerging onto the motorsport scene. ext year the world’s first hydrogen championship, Extreme H will be inaugurated. Then by 202 hydrogen prototypes are expected to race at the Le ans 2 Hours.
WWhy would teams shift toward hydrogen? Are hydrogen fuel cells or hydrogen combustion more suited for motorsport?
Hydrogen is an alternative to fossil fuels. It is the most abundant element in the universe, releases approximately three times more energy per unit weight than the likes of gasoline and when used to power vehicles, only emits water and heat.
“Hydrogen engine efficiency is similar to conventional combustion engines,” explains Richard Osborne, global technical expert-sustainable engines at Ricardo, a partner of top-tier motorsport customers delivering competition-ready, proven transmission systems and innovative cross-sector sustainable solutions.
“Hydrogen fuel cells achieve higher efficiencies at low-load operating conditions. At high loads however, considering overall traction efficiency, fuel cells and hydrogen engines are very similar.”
“However, the most important advantage of hydrogen is that there are no carbon emissions at the tailpipe,” continues Osborne. “Even sustainable liquid fuels, which can be carbon neutral on an overall lifecycle basis, still produce CO2 at the tailpipe. That’s why hydrogen is seen as a key alternative.”
Like any conventional internal combustion engine (ICE), hydrogen combustion uses a spark ignition engine to burn a fuel and air mixture which drives reciprocating pistons to generate mechanical power. However, liquid or gaseous hydrogen fuel is used instead of liquid fossil fuels such as gasoline or diesel.
“Hydrogen is a great fuel for combustion because it has high flame speeds and fast combustion which is ideal for motorsport applications,” says Osborne. “It also has a very broad flammability range which means you can run a wide range of air fuel ratios. It requires slightly different materials and compression ratios, but otherwise most of the mechanical, injection and emission systems are very similar to conventional ICEs.”
Hydrogen fuel cells are similar to a battery which consists of an electrolyte, an anode and a cathode.
Liquid or gaseous hydrogen fuel is supplied to the anode and air is supplied to the cathode. At
the anode, a catalyst separates hydrogen molecules into protons and electrons, which take different routes to the cathode. The protons pass through the electrolyte, while the electrons flow through an electrical circuit. Once at the cathode, the electrons and protons combine with the oxygen from the air supply, producing water and heat.
“Hydrogen fuel cell vehicles retain an electric powertrain so will still have inverters providing AC power to motors that drive the wheels through a transmission,” says Temoc Rodriguez, global technical expert – electrified solutions at Ricardo. “But the power is generated by the stacks within the hydrogen fuel cell, instead of a battery.”
But batteries or supercapacitors still have an important role to play. The fast accelerations and decelerations in racing demand energy to be quickly discharged. Unfortunately, fuel cells cannot react this fast because they are limited by the speed of the chemical reactions within the stacks.
“Fuel cells cannot split the electrons from the hydrogen molecules fast enough for motorsport,” continues Rodriguez. “It can take a fuel cell 2-3 seconds to go from 0% to 100% power capacity, yet a race car needs to accelerate from 0 to maximum speed within 2 to 3 seconds. So that peak power must come from another energy storage system such as a battery or a supercapacitor.” Wow!
That is why hydrogen fuel cells are typically combined with a battery or supercapacitor. The former provides a consistent background level of power, while the latter delivers the instantaneous power required for the quick transients during acceleration and braking.
Hydrogen is the lightest gas in the universe, so its energy density per unit weight is extremely high. However, its high expansion ratio means its energy density per unit volume is extremely poor. This makes storing hydrogen in tanks on a vehicle a major challenge.
The majority of hydrogen fuel cells store hydrogen gas at 00 bars, with newer vehicles achieving up to 00 bars. However, hydrogen gas occupies around two times more volume than it does in its liquid state, so could liquid hydrogen be the answer?
“This is one of the biggest challenges with fuel cells – how much hydrogen can you realistically store on board?” Rodriguez highlighting. “Using liquid hydrogen instead of gas could help store around 100% more hydrogen, but that comes with its own challenges. Liquid hydrogen needs to be kept at cryogenic temperatures and has to be boiled off before it can be used in the fuel cell. This requires more equipment in the pipeline which
then increases the overall volume and mass of the vehicle.”
“Another way of storing hydrogen, that is currently being researched, is to use solid hydrogen,” Rodriguez adds. “The hydrogen is chemically mixed with a hydride molecule and stored as a solid which achieves similar volumetric densities as liquid hydrogen but without the complexities of maintaining cryogenic temperatures. A heating element in the tanks heats the solid, releasing hydrogen gas which can then be used in the stacks.”
There are no silver bullets in engineering, so as with any emerging technology, there are pros and cons to using hydrogen in motorsport.
From a performance perspective, there is minimal difference between a hydrogen combustion race car and a hydrogen fuel cell race car out on track.
“There is also a weight advantage compared to fully electric race cars,” says Rodriguez. “Battery packs remain heavy which curtails acceleration. Whereas a hydrogen fuel cell, combined with a small capacitor bank, brings the base weight of the car down, so the car can accelerate faster for a similar power capacity, which could lead to more overtaking.”
“Another benefit of hydrogen power, particularly for combustion, is noise,” says Osborne. “Fans continue to criticize the lack of noise from hybrid and electric championships, but hydrogen combustion race cars emit the same sound as conventional ICEs.” Refuel is much faster but the challenge is ensuring safety and integrating it into a pitstop scenario.
The key is to ensure that the hydrogen comes from truly sustainable sources and that the regulations push the boundaries of storage, to encourage suppliers to really drive innovation.
“In motorsport, new technologies are seen as a challenge, not a restriction,” concludes Stuart Cooper, market head of motorsport for Ricardo. “Racing provides a great platform to problem solve new technologies in a competitive environment that’s interesting to spectators.”
“That’s why Ricardo is heavily involved in hydrogen discussions with the FIA and ACO as well as hydrogen projects in many other sectors,” continues Cooper. “We have invested in test, manufacturing, assembly and simulation facilities to develop hydrogen powertrains, whether that be for combustion or fuel cells. There’s no faster way to drive development then by integrating it into a motorsport championship and we’re ready to support customers to do just that.”

Welcoming the busiest part of the year, the Philippine automotive industry made sure that its exit from the ghost month is apparent with a long list of new model introductions in the previous month. Furthering into the Ber-months, here’s a rich selection of new cars that were launched in September.

AION Y Plus and AION ES
One of the spearheads for the electrified mobility shift, AION has officially made its way to the local automotive market. Part of the GAC Group, AION makes its Philippine ingress with two launch models, the Y Plus and ES.
The AION Y Plus is a spacious and stylish SUV, designed for families who prioritize luxury and performance, while boasting an impressive driving range. For urban commuters and those looking for an energy-efficient option for long-distance travel. The Y Plus features an impressive 490km driving range that could be topped up via a Type 2 EV charging port.
Answering the segment of the local market which still has love for sedans, AION enters the Philippines with its ES model. ES is a full-electric sedan that boasts style and efficiency. The five-seater electric sedan comes with a 442km driving range.
As per AION Philippines, additional models that answer to the local demand of the market, are set to be introduced in the future.
The recent addition of Audi Philippine has surely made wagon fanboys delighted. Not just any wagon model, the Philippine market has officially welcomed the Audi RS 6 Avant GT.
The RS 6 Avant GT is a limited-edition Audi that exudes raw power with luxurious sophistication. Powering this buff wagon is a 4.0L TFSI twin-turbocharged V8 engine, rated to output an impressive 630 horsepower and 850 Nm of torque. This eight banger mill gives the RS 6 Avant GT the acceleration performance of going from 0 to 100 km/h in just 3.3 seconds. Limited to only 660 units around the world, the RS 6 Avant GT stands out with an aggressive exterior styling that carries a colorway reminiscent of its Quattro predecessor. With a striking pass-through roof edge spoiler, redesigned rear diffuser, and exclusive 22-inch wheels, the vehicle is as visually stunning as it is powerful. High-gloss black accents on the Singleframe grille and air intakes amplify its sporty appearance, while lightweight carbon fiber elements contribute to its aerodynamic efficiency.
BYD Seagull Audi RS 6 Avant GT
Further solidifying its mark in the local automotive industry as the purveyors of electric mobility, BYD Cars Philippines and ACMobility launched the BYD Seagull. The Seagull features a compact yet spacious design, measuring 3,780mm in length, 1,715mm in width, and 1,580mm in height. This makes it ideal for urban environments where maneuverability is key, complemented by a tight 4.95m turn radius. Its exterior is enhanced with striking LED bar tail lamps, power-adjustable heated side mirrors, and stylish 16” alloy wheels, ensuring that practicality does not come at the expense of visual appeal.
The BYD Seagull is powered by a 75 PS permanent magnet synchronous motor with 135 Nm of torque. Its juice comes from a state-of-the-art BYD Blade Battery Pack, providing an impressive range of 300 kilometers on a single charge. The Seagull supports both DC and AC charging, with a maximum charging rate of 30kW DC and 6.6kW AC, making it convenient for various charging scenarios. As for its performance, the Seagull goes from 0 to 50 km/h in just 4.9 seconds and achieves a top speed of 130 km/h.
JAC JS8 PRO
Aiming to raise the bar in the SUV segment, Astara officially launched the all-new JAC JS8 PRO. The allnew seven-seater JS8 PRO is the brand’s follow-up to its flagship JS6 model launched earlier this year.
The All-New JAC JS8 PRO boasts a bold yet refined exterior design from every angle. At the front, automatic LED headlights and LED daytime running lights flank an assertive grille adorned with sleek black trim and silver inserts. Complementing its dynamic design are the upward-sloping window line, black fender trim, and striking two-tone 19-inch alloy wheels, all suit the JS8 PRO’s 160 mm ground clearance that adds to its commanding presence on the road.
Powering the JS8 PRO is powered by a highly advanced turbocharged 1.5-liter direct-injection inline-4 gasoline engine that delivers an impressive 182 horsepower and 300 Newton-meters of torque. This powertrain is paired with a responsive 7-speed dualclutch transmission.
Honda Civic RS e:HEV
Yes, the first-ever electrified Civic in the Philippines. Honda Cars Philippines, Inc. officially brings in the hybrid electric edition of its most iconic nameplate, the Honda Civic RS e:HEV. Powered by the same hybrid powertrain found in the CR-V RS e:HEV, the Civic RS e:HEV is powered by a 2.0-liter e:HEV hybrid electric engine that is rated to output 184
horsepower and 315 Nm torque.
Aside from the exterior updates, more particularly in the front fascia, the new Civic RS e:HEV comes equipped with the latest generation of Honda CONNECT, now with more features that enhance interaction between the owner and the vehicle through a smartphone app. Google Automotive Services are also integrated, providing additional personalization options.
Along with the arrival of the Civic RS e:HEV is Honda’s first two-wheeled battery electric vehicle, the all-new EM1 e: that is powered by the Honda Mobile Power Pack e: and equipped with highquality lithium-ion battery.
Jeep Wrangler Rubicon
Inchcape Philippines, the Jeep official distributor in the Philippines, officially launched the latest iteration of the Jeep Wrangler Rubicon. The latest evolution of the iconic SUV stays true to the Wrangler formula and delivers the freedom to go anywhere and do anything. It wears a more commanding signature seven-slot Jeep grille, new infotainment system, bigger tires, upgraded off-road features, luxurious and premium seats, and enhanced topnotch safety features.
Regarded as the most powerful Wrangler generation ever, the new Wrangler Rubicon is powered by a 2.0-liter turbocharged inline four-cylinder engine, mated with an eightspeed automatic transmission that produces an impressive maximum power of 268 horsepower and 400 nm torque.
Taking its reputation as one of the most off-road capable models in the market, the new Wrangler Rubicon is fully loaded with 4×4 features and heavy duty components such as the new 4:1 Rock-Trac HD Full Time 4WD System, Dana M220 Wide Full Floating Rear Axle, Dana M210 Wide Heavy Duty Tube Front Axle, E-Locker Front and Rear Axle, 4.10 Rear Axle Ratio, Front Disconnecting Stabilizer Bar, Performance Suspension, High Clearance Fender Flares, Rock Protection Sill Rails, Skid Plates, Aux Switches, Integrated Off-Road Camera, with Integrated Washer, and front and rear tow hooks.
Kia Carnival
The premium MPV category of the market has been stirred with excitement with the arrival of the new Kia Carnival. The latest iteration of the premium MPV model has been meticulously engineered to elevate mobility of those with the most discerning taste who are either modern executives or family-oriented individuals.
First to be noticed on the new Carnival is its redefined Tiger Nose Grill that exudes strong, sophisticated presence. The front fascia features unique vertical lamps and the captivating Star Map Daytime Running Lights (DRL) for enhanced visibility and a signature identity.
Under the hood, the new Kia Carnival features a 2.2-liter Smartstream turbo diesel engine with an 8-speed automatic transmission. It produces 202 PS and 440 Nm of torque, channeled to the front wheels. The Carnival offers four driving modes—Normal, Eco, Sport, and Smart—to further customize the driving experience.
Lamborghini Revuelto
Lamborghini Manila officially unveiled the Lamborghini Revuelto. Ushering the new age of supercars, the latest Lamborghini model is the first super sports car to feature a V12 hybrid plug-in powertrain making it a HPEV or High Performance Electrified Vehicle.
The powertrain combines high-specific power elements: the new 128 CV/liter combustion engine works synergically with two front axial flux motors that deliver an outstanding weightto-power ratio, with a radial flux electric motor positioned above the first eight-speed double-clutch gearbox debuting on a 12-cylinder Lamborghini. The three electric motors are powered by a lithium-ion high-specific power (4500 W/kg) battery pack that also supports a fully-electric drive mode.
The new Revuelto promises to deliver performance figures that edges its segment. It features acceleration performance of going from 0-100 km/h in only 2.5 seconds, 0-200 km/h in less than 7 seconds, and achieving top speed of over 350 km/h.
Lotus Emeya
The Autohub Group has officially brought in the all-new Lotus Emeya. Known as the first electric hyper-GT car from Lotus, the Emeya is the latest addition to the British marque’s lineup of next-generation hyper electric vehicles.
The car brings together Lotus’ design and engineering DNA, with the latest cutting-edge technologies setting a new benchmark for what it means to drive an electric car. The Emeya boasts a range of advanced active aerodynamic features to enhance speed and performance.
As for its performance, the Lotus Emeya packs up to 905 hp to its wheels which enables acceleration performance of going from 0-100 km/h in just under 2.8 seconds, and 0-200 km/h in 9 seconds.
More than just astounding performance, the Lotus Emeya has been designed to offer usability perfect for daily driving. Cabin spaces of up to 509 liters, frunk space of 31 liters capacity, ambient interior lighting, and massage seats with various modes, just to name a few riding comfort features of the hyper-GT electric car.
This latest offering from Lynk & Co Philippines holds importance to its fulllineup as it is the brand’s most attainable offering yet. Meet the Lynk & Co 06 SUV Hyper Core+. The newest Lynk & Co model aims to appeal to a wide range of Filipino car buyers who are in the market for a stylish, safe, yet, affordable SUV model.
Packed with fresh exterior styling combined with sophisticated interior design, the 06 SUV Hyper Core+ also offers top notch safety features which give astounding value for money for any car buyer. As for its driving dynamics, powering the 06 SUV Hyper Core+ is a four-cylinder 1.5-liter turbocharged engine capable of producing 181Ps and 290 Nm of torque.
Lynk & Co 06 MINI Cooper and Countryman
The Autohub Group officially launched the latest iterations of the Cooper and Countryman models of the iconic British marque. But aside from the impressive updates, the latest MINIs mark an important milestone in the brand’s history in the Philippines as it starts the brand’s journey to the new era of now offering electrified options to the local market.
The New All-Electric MINI Cooper delivers an enhanced go-kart feel with its 160 kW motor and a range of up to 402 kilometers. The New MINI Countryman, featuring allwheel drive and a 230 kW motor, promises a powerful and adventurous driving experience with a range of up to 433 kilometers.
VinFast VF 3
Following its Philippine brand launch, VinFast Auto expanded its lineup with a stylish mini electric SUV, the VF 3. Now available for pre-orders, the Philippines is the first country aside from Vietnam to sell the quirky electric SUV.
The VF 3 boasts a compact design with dimensions of 3,190 x 1,679 x 1,622 mm and a wheelbase of 2,075 mm, perfectly suited for city roads in the Philippines. It is equipped with 16inch alloy wheels, providing an impressive ground clearance of 191 mm, allowing for smooth navigation across various terrains.
The Vinfast VF 3 is powered by a 32 kW electric motor that is rated to output a maximum torque of 110 Nm. Feeding power to the electric motor is a 18.64 kWh lithium-ion battery which packers up to 210 km driving range on a full charge. Suitable for daily driving duties, the VF 3 features fast charging that can achieve charging from 10% to 70% in just 36 minutes.

OMODA Philippines’ E5 Electric Crossover SUV is now AAP EV Certified
OMODA Philippines proudly announces that its first fullyelectric crossover SUV, the OMODA E5, has been officially certified by the Automobile Association of the Philippines (AAP) after successfully completing an efficiency run to validate its published range of 430 kilometers.
Two OMODA E5 units were tested under strict parameters: starting with a 100% battery charge and standard OEM equipment. Tire pressure was set to 42 psi, and the vehicles maintained a speed range of 60 to 100 kph where conditions allowed, adhering to legal speed limits on highways, city, and provincial roads. Each vehicle carried three
passengers and 10 kg of cargo. Despite being set to an energy-saving mode with the highest regenerative braking settings, the passengers had control over the air conditioning and blower settings to simulate real-world usage. Other vehicle features, such as headlamps, wipers, and the infotainment system, were also used based on passenger preferences. Additionally, adaptive cruise control was engaged throughout the drive.
Throughout the nearly 13-hour drive, the OMODA E5 maintained a cruising speed of 80 km/h and reached a peak of 90 km/h when necessary. The efficiency run covered
six key destinations: Shell Mampalasan, NLEX Balagtas, Petron TPLEX NB, Clean Beach Coffee, Poro Point Lighthouse, and Shell TPLEX Rosario.
By the conclusion of the run, the first vehicle achieved a final battery state of 2%, with 8 km of remaining range, covering a total of 442.7 km. The second vehicle finished with a 7% battery state and 28 km of remaining range, totaling 428.8 km. On average, the test vehicles recorded a range of 435 kilometers, surpassing the published range of 430 km.

Toyota endorses first model End-of-Life vehicle dismantler in the PH
Automotive leader Toyota has endorsed En Tsumugi ELV Dismantler Corporation as a model End-of-Life Vehicle (ELV) dismantling facility, the first of its kind in the country, located in Mexico, Pampanga.
A wholly-owned venture of the Hung family – owner of local metal recycling companies Supreme Mile Trading Corp. (SMTC) and CoroCrown Corporation, En Tsumugi is a result of a pilot project led by Japanese ELV dismantler Tsuruoka Co., Ltd. and financially supported by Japan International Cooperation Agency (JICA). Several Japanese businesses, including Toyota Motor Corporation (Toyota) and Mitsui & Co., Ltd., provided business development and technical assistance.
The establishment of En Tsumugi is a significant milestone in the Philippine automotive industry’s push for a responsible management system for ELVs, or those vehicles with components classified by the local authorities as waste. The facility, open to various car makes, will serve as a benchmark in further developing the local recycling industry while promoting environmental sustainability and the adoption of best practices and foreign expertise. Through its local unit, Toyota Motor Philippines Corporation (TMP), Toyota’s involvement in the project includes providing technical support in various areas, such as environmental compliance, facility design, dismantling methodology,
equipment requirements, and hazardous waste management.
Furthermore, TMP donated five ELVs, including one hybrid electric vehicle, to En Tsumugi as training units for further equipping and enhancing of the facility’s capabilities.
TOYOTA GLOBAL 100 DISMANTLERS PROJECT
“The establishment of a
local ELV dismantler aligns with the goals of the ‘Toyota Global 100 Dismantlers Project,’ which aims to establish a network of proper ELV dismantling facilities worldwide,” said TMP President Masando Hashimoto during the inauguration ceremony of En Tsumugi in Pampanga. The project seeks to address the environmental challenges posed by ELVs,
such as pollution and resource depletion, by promoting proper dismantling and recycling practices, which also contributes to reducing greenhouse gas emissions.
At the same event, TMP bestowed its Certificate of Gratitude to En Tsumugi. Hashimoto also mentioned that En Tsumugi is the fourth (4th) ELV dismantler in the Southeast Asian region to receive this endorsement, following similar facilities in Thailand, Vietnam, and Malaysia.
Toyota implements the Toyota Global 100 Dismantlers Project as part of its efforts towards “Establishing a Recyclingbased Society and System” under the Toyota Environmental Challenge 2050, which was globally introduced in 2015.
BYD CarsPH, ACMobility support Typhoon Carina victims
BYD Cars Philippines, in partnership with ACMobility, the official distributor of BYD vehicles in the Philippines, has committed to donate $100 to victims of Super Typhoon Carina for every BYD Sealion 6 DM-i sold between July 25, 2024, and December 31, 2024.
This initiative is part of a broader campaign to assist communities affected by the typhoon, underscoring both companies’ dedication to social responsibility. ACMobility was among the first responders in the disaster relief efforts, distributing essential goods to over 100 families in Dela Paz, Pasig City, on July 26. Employees and volunteers from ACMobility, BYD Cars Philippines, and affiliate agencies participated in the relief efforts.

The BYD Sealion 6 DM-i: High Performance Meets Responsibility

Impact of Super Typhoon Carina
Super Typhoon Carina, internationally known as Typhoon Gaemi, caused widespread devastation across the Philippines, with the National Disaster Risk Reduction and Management
Council (NDRRMC) reporting that over 1.3 million Filipinos were affected.
The hardest-hit areas included the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM), where over half a million residents experienced significant property damage. Around 211,000 people were displaced, seeking refuge in evacuation centers as floods and landslides ravaged their homes.
The typhoon also severely impacted the agricultural sector, affecting the livelihoods of at least 1,400 farmers. The damage to crops amounted to P9.7 million, while destruction to irrigation systems reached P6.5 million. Non-agricultural infrastructure also suffered, with losses estimated at almost P1.3 million.
“Our hearts go out to the families affected by this calamity,” Palanca added.
Supreme Court: Lemon Law Not the Only Option for Defective Brand-New Vehicles
But the Supreme Court denied the petition to have the entire vehicle replaced with a new one deciding that DTI does not have scope of jurisdiction.
The Supreme Court has ruled that buyers of defective brandnew vehicles are not limited to just the Philippine Lemon Law when seeking remedies. Consumers can enforce their rights under various laws, including the Lemon Law, the Consumer Act of the Philippines, or any other applicable legislation.
In a decision written by Associate Justice Antonio Kho, Jr., the Court’s Second Division clarified that vehicle owners dealing with issues on brand-new purchases have multiple avenues for recourse. This ruling stemmed from a 2016 case involving Marilou Tan, who purchased a Toyota Fortuner from Toyota dealer.
Immediately after the purchase, Marilou’s husband noticed that the vehicle displayed jerky movements when shifting gears. Concerned, Marilou had the car inspected by the dealer, which found that the transmission assembly might need to be replaced or the Engine Control Unit (ECU) reprogrammed, both offered at no extra cost. However, Marilou refused these repairs, instead demanding either a replacement vehicle or a refund.
The dealer argued that under Republic Act No. 10642, also known as the Philippine Lemon Law, they were entitled to attempt repairs up to four times before replacing the car. The Lemon Law governs defective brand-new vehicles in the Philippines,
requiring consumers to report defects within the first 12 months or 20,000 kilometers of use, whichever comes first.
Dissatisfied, Marilou took the case to the Department of Trade and Industry (DTI), citing Republic Act No. 7394, the Consumer Act of the Philippines. Under this law, consumers have the right to a replacement or refund if a defect cannot be resolved within 30 days. During the DTI proceedings, Marilou eventually agreed to let the dealer reprogram the ECU, which fixed the shifting issue.
Despite this resolution, the DTI ruled in favor of Marilou, ordering the
dealer to either replace the vehicle or refund the purchase price. Unhappy with the decision, the dealer appealed to the Court of Appeals (CA), which ultimately sided with the appeal.
The CA argued that the Lemon Law and the Consumer Act conflicted with each other. While the Consumer Act grants suppliers a 30-day window to fix defects, the Lemon Law provides manufacturers, distributors, or dealers the opportunity to make up to four repair attempts. Given that Marilou’s case involved a brand-new car, the CA concluded that the Lemon Law took precedence over
the Consumer Act, as it specifically deals with new vehicles, while the latter applies more broadly to consumer products in general. Under legal principles, a special law (Lemon Law) generally overrides a general law (Consumer Act).
Following the CA decision, the DTI Secretary pursued the case further, bringing the matter to the Supreme Court.
Although the Court acknowledged that Marilou’s vehicle issue had already been resolved through the ECU reprogramming, it took the opportunity to clarify the law for future cases. The Supreme Court
emphasized that the Philippine Lemon Law is not the exclusive remedy for defective brand-new vehicles.
“Nothing prevents a consumer from availing of the remedies under RA 7394 [Consumer Act] or any other law, even if the complaint is about a brand-new vehicle,” the Court stated. “RA 10642 [Lemon Law] is an alternative remedy granted to the consumer, and they are free to enforce their rights under the Consumer Act or any other applicable law.”
However, the Supreme Court dismissed the case, stating that the DTI Secretary was not the appropriate party to file the petition. Nonetheless, the ruling serves as a significant precedent for future disputes, affirming that consumers can seek protection under various laws and are not bound solely by the provisions of the Lemon Law.
This decision highlights the Court’s commitment to ensuring consumer rights are protected, giving vehicle owners more flexibility in resolving issues with defective vehicles. Whether consumers choose to rely on the Lemon Law, the Consumer Act, or other laws, they now have clear guidance on the options available to them in such cases.

ZACH DAVID LANDS POINTSEARNING 10TH IN RAIN-HIT 2024 FRECA ROUND 8
Unable to replicate his strong form from Imola and with a bit of bad luck, it was a tough weekend for Zachary ‘Zach’ David at the Red Bull Ring. But in the end, the Malta-licensed Filipino driver was able to wrestle a Top 10 result on Sunday in Round 8 of the Formula Regional European Championship by Alpine (FRECA).
All 3 R-ace GP drivers struggled with pace throughout Testing and were all over the time sheets in the very wet conditions. Unfortunately, despite the team’s best e orts, their fortunes failed to improve in Saturday Qualifying. David atspotted his front right tire early in the session,
making it di cult for him to set a fast lap. His best e ort could only yield 12th fastest in Group A, which put him P23 on the grid just a few places behind teammate Tuukka Taponen.
David had a lot of work to do in Race 1 as he was starting close to the back. A quick launch o the line saw the #20 R-ace GP entry shoot up to P20 a er 1 corner then climbed several more places to P15 a few turns later. However, his stellar start to the race ended just as fast when another driver made an error in the tricky conditions and collided with David. This sadly forced him into a DNF before completing a single lap.
As with previous rounds, David sought
payback on Sunday. He was able to set a fast time early on during Group A Qualifying right before the rain came down hard. While the others were caught out by the sudden downpour, his time earned him P6 on the grid ahead of his R-ace GP teammates and with a clear shot at the leaders.
Another clean getaway gave David the chance to gain 2 places at the start and was ghting for a podium position a er only 2 laps. But then, some bad luck struck, with Rafael Camara of Prema Racing locking up and crashing into David’s rear. Although he was able to continue, the contact adversely a ected his car as Race 2 progressed and proved to be harder and
harder to defend with an ailing car. It then became damage limitation mode for David who crossed the nish line in 9th with a couple of points in the bag.
The Formula Regional European Championship by Alpine (FRECA) will now head to the Circuit de BarcelonaCatalunya in Spain for the penultimate round of 2024. Meanwhile, Zack David maintains his position in 11th in the Drivers’ Standings.

he 2024 Gulf Top Driver Challenge, spearheaded by Tuason Racing and supported by Gulf Oil Philippines, has concluded, leaving an indelible mark on the Philippine motorsport scene. This competition, launched at the Manila International Auto Show (MIAS) on April 6, 2024, and culminating at Clark International Speedway on August 24, 2024, was more than just a race—it was a rigorous search for the next motorsport star.
Participants were put through their paces in a multi-stage competition that tested not only their driving skills but also their mental toughness, adaptability, and strategic thinking. The event included a series of challenging stages—starting with simulator trials, moving
on to karting at EKart Raceway, and then to a Basic Racing Class at Clark International Speedway. The nal showdown was held in the high-performance TRS Formula V1 race car, where only the best would prevail.
Out of an initial pool of ten talented drivers, three emerged as top contenders: Clarence Ancheta, a 19-year-old former kart racer; Russel Reyes, a 22-year-old Racing Data Analyst and sim racing champion; and Jahan Kalam, a 36-year-old seasoned amateur racer with deep roots in Tuason Racing. These three faced o in an intense nal round at Clark, where every second counted.
Ultimately, it was Russel Reyes who clinched the title of 2024 Gulf Top Driver
Challenge champion with a nal time of 28.50 seconds, displaying unmatched skill and composure under pressure. His victory not only earned him the prestigious title but also an all-expense-paid trip to the 2024 F1 Singapore Grand Prix, where he will have the unique opportunity to meet the Williams F1 Team.

The stage is set for another thrilling season of the country’s fastest race series as the SEAOIL Radical Challenge Philippines returns to the tracks this September. The 2024 season will feature two race categories and introduce a new event partner, BPI, adding even more excitement to the competition.
