ENHANCED COMPREHENSIVE

LAND USE PLAN GUIDEBOOK 2013

The Enhanced Comprehensive Land Use Plan Guidebook 2013 is a response to major legislative and environmental shifts affecting land use and resource allocation and management in the country over the last five years. It is also in recognition of the need to mainstream climate change adaptation and disaster risk reduction and the growing demand for the integration of planning for critical resources such as upland, coastal, ancestral domain, biodiversity areas, heritage and urban greening, which are not yet appropriately addressed by existing local enabling policies and planning processes.

CLUP

A CLOSER LOOK...

A TOP-TO-BOTTOM, BOTTOM-UP APPROACH

WHAT IS CLUP FOR CLUP ensure not only the bottom up and participatory aspect of the land use policy but more importantly integrating local and community land use priorities with the national and regional priorities. The Comprehensive Land Use Plan (CLUP) shall determine the specific uses of land and other physical and natural resources, both private and public, within their territorial jurisdiction including urban and urbanizing areas, areas co-managed with the national government and, as appropriate, management plans for ancestral domains, critical watersheds, river basins, and protected areas. The CLUP shall delineate actual boundaries on the ground within the territorial jurisdiction, embody the desired land use patterns of the city, municipality and barangay, translate and integrate sectoral plans, and provide appropriate policies for the detailed land uses within the four land use policy areas.

COMPREHENSIVE LAND USE PLANNING (CLUP) is a constitutionally supported undertaking of the State. The State declares its land use policies and principles in terms of relation to national economy and patrimony as well as its police power for the promotion of public health, public safety, public interest, public order, and general welfare.

The extent of comprehensiveness and the focus of land use planning process as well as the preparation of the CLUP document are defined within the bounds of “land resources” by this provision of UDHA which must be “consistent with the development plan of the area.”

ST R

CLUP F

LAND USE PLAN is the “rationale approach of allocating available land resources as equitably as possible among competing user groups and for different functions consistent with the development plan of the area and the program under this Act” (Section 3(k) of RA 7279).

CE

REPUBLIC ACT 7279 (Urban Development and Housing Act) The Urban Development and Housing Act (UDHA) or RA 7279 gives a clear-cut definition of a Land Use Plan which the local government units (LGUs) are mandated to adopt.

The community is generally included in the CLUP process. Relevant and important data and information pertaining to the drafting of a CLUP will emanate from them. The community is composed of various stakeholders within the planning area such as our fishermen, farmers, the Indigenous Peoples, women, urban poor, the rural poor, the youth, people with disabilities, the senior citizens, the religious group, the investors, our local elected officials and others with stake in the development or growth of the city. Other relevant special studies and sector plans prepared at the national, regional and provincial levels are considered in the CLUP process. Taking cognizance of these plans such as the Barangay Development Plan, strategic agriculture and fisheries development plan, forest land use, coastal, ADSDPP, tourism, industrial development plan, etc. will help identify and reconcile differences and later arrive at equitable and objective proposals. Republic Act 7160 (Local Government Code of 1991) provides the mandate of LGUs on local planning, legislation, implementation, including budgeting, and monitoring. Section 20 of the Local Government Code also states that “The local government units shall, in conformity with existing law, continue to prepare their respective Comprehensive Land Use Plans enacted through zoning ordinances which shall be the primary and dominant bases for the future use of the land resources.” Executive Order 72 was issued providing for the preparation and implementation of the CLUP by the local government units and for the review and approval thereof by the HLURB and the Sangguniang Panlalawigan.
