advocate against the use of plastic, he has not used a single plastic drinking straw or shopping bag in more than 10 years. This, and his love for composting has allowed him to reduce his household waste to less than 2 kilos for the whole year of 2014.” BY way of introduction, it is but just and proper to make mention of the “Mendiola Massacre” where some twenty-two farmers from the then and now still infamous Hacienda Luisita were gunned without mercy, without reservation during the reign of the then President. And some time later, this was replaced by the “Tarlac Massacre” when some seven farmers—one kind old Aglipayan bishop included—were all shot to death for staging a strike against the Hacienda labor mismanagement. And to make such a disgusting composite phenomena really historical, there was a Chief Justice who dared apply the law to the same Hacienda and the result was called “Impeachment”—not only placing the Legislative Department under the command of Malacañang but also making the Supreme Court fearful in treating the Executive Department as an equal branch of government as provided by no less than the Constitution of the Land. The inc o m i n g government— be this before or after 2016— has much to do as well as to undo in favor of the People of the Philippines in the pursuit of truth for the emergence of justice and reign of peace, but definitely not through dissemination of lies, the promotion of inequity, the instigation of hostilities such as the composition and promotion of the now debatable if not infamous BBL. Hence: Please: Do not promote the OFW phenomenon for the material gains of the State at the expenses, worries and separation of families. Stop such detrimental invention as PPP whereby privatization of public utilities promote private profits – not public welfare. Do away with taxation unlimited under different titles but with the same victims such as the poor, the miserable people. Please: Do away with the now famous KKK – a title that desecrates the original, noble and heroic individuals the letters stand for. Get rid of the incarnation of graft and corruption through the infamous DAP and PDAF. And no more official reception and accompaniment of any Napoles figure. Please: Do stop making the Philippines a Gambling Republic. In the same way, get rid of the proliferation of the local Drug Industry. And stop women trafficking plus child prostitution due to the lack of the means of decent livelihood, on account of the lack of proper education. Please: Do not prefer to see how cars are made with big and continuous foreign profits, instead of giving honor and showing bereavement for wasted lives and desecrated bodies. And do away with an inverted socio-economic progress where the rich become richer and the poor emerge even poorer. Please: No more Luneta Massacre. No more Atimonan Massacre. No more Mamasapano Massacre. Enough is enough. No wonder then there is the increasing people’s clamor for someone’s resignation! Leave them alone! They will do better! __________________ *His Excellency, Oscar V. Cruz, D.D., is the archbishop-emeritus of the Archdiocese of Lingayen-Dagupan (Pangasinan). OPINION balikasonline@yahoo.com
Right and wrong AS a leading member of the Cabinet, Justice Secretary Leila de Lima can rightly be accused of involvement in a Malacañang-orchestrated effort to shield President Benigno S. C. Aquino III from liability for the poorlyplanned, badly-executed Oplan Exodus when she practically described the Senate report on that debacle as “hasty and reckless.” That doesn’t make everything she said about the March 17 report wrong. But neither does it mean that everything she said or will say is right, among other reasons because of the particularities of Philippine governance and politics. It’s a characteristic she shares with many of the country’s senior bureaucrats. Some (there are exceptions) usually know their jobs, and are nominally capable. But the demands of politics and the complex ties that in a feudal society bind members of the bureaucracy to the political class often make them seem less than competent or even honest. The draft of the Senate inquiry report into the Mamasapano clash had declared that Mr. Aquino is ultimately responsible for that man-made disaster. Senator Grace Poe, who chaired the Senate inquiry, said during a press conference that “The President must bear responsibility for giving assent to and failing to prevent the unlawful exercise of official functions by [former Philippine National Police Director General Alan Purisima] in connection with Oplan Exodus.” Ms. Poe also said that impeachment would be the sole means of holding Mr. Aquino responsible while he’s still in office. That last part doesn’t belong in Ms. de Lima’s category of “hasty and reckless” conclusions, impeachment being the only recourse against a sitting president. But the Senate report’s describing the clash as “a massacre” rather than a “misencounter [sic]” certainly does. About these and other details in the report, Commission on Human Rights Chairman Loretta Ann Rosales had even more to say. A leading member of Akbayan, which has steadfastly supported Mr. Aquino since 2010, Ms. Rosales, although head of a constitutional body, could similarly be accused of partisanship. But as in the case of Ms. de Lima, not all she’s saying is necessarily wrong. Ms. Rosales is correct in saying that what happened was not a massacre, no matter what such dazzling Senate minds like Francis Escudero may say. The members of the SAF contingent were far from helpless not only because of their number (nearly 400), but also because they were heavily armed. The inability of the alleged victims to defend themselves is integral to the meaning of “massacre.” The November 23, 2009, incident in Ampatuan town, Maguindanao, in which 58 people including 32 journalists and media workers armed only with cameras
and notepads were murdered by over a hundred men wielding automatic weapons was a massacre. The Mamasa-pano clash — it was a firefight in which there was an eight-hourlong exchange of gunfire — was not. The report’s claim that the MILF cannot control its troops, continued Ms. Rosales, does not mean that it is not sincere in seeking peace with the Philippine government. “The inability of the MILF leadership to control a few elements of [its armed force] has nothing to do with its sincerity in entering into peace negotiations. The actions of a few rogue members cannot and should not be interpreted as the actions of the whole.” Hear, hear. But it’s when both Misses Rosales and De Lima try to clear Mr. Aquino that the problem arises: where does reason end and loyalty to the boss begin? Mr. Escudero steers clear of that shoal. When asked about Ms. Rosales’s observations, Mr. Escudero insisted that the clash was a massacre. “Masaker talaga ’yun dahil close range binaril ’yung 34 out of 44 SAF troopers.” (It was a real massacre because 34 out of 44 SAF troopers [sic] were shot at close range.) That statement redefines the meaning of “massacre” as “the act or instance of killing a number of usually helpless or unresisting human beings” to “the killing of human beings at close range.” In further demonstration of his brilliance, Mr. Escudero weighed in on an unrelated issue: he claimed that he was “disappointed” at how the CHR often fails to acknowledge human rights violations against policemen and soldiers. (If a civilian is hurt, it’s a human rights violation, but if a policeman is hurt, doesn’t a uniformed individual have human rights?) This rhetorical question (of course, those in uniform have human rights) echoes the complaint by policemen and soldiers who have been known to whine that while violations of the human rights of ordinary folk are always condemned, violations of their rights are not. A firefight in which there are casualties on both sides does involve the issue of human rights in terms of possible violations of the rules of war, which among others includes the humane treatment of prisoners. It can be argued that the killing of the 34 SAF men was savage and contrary to the rules of war — and the Senate report has correctly taken note of it. But as a general principle with respect to unarmed civilians, their treatment by State security forces is an even more crucial human rights issue. Both the police and the military have been cited by various human

Pp., G.R. 137567, June 20, 2000).|
Calvary for BBL & Peace Negotiations CHRISTIANITY’S traditional annual “Calvary” is over now. But for the peace workers and the proposed Bangsamoro Basic Law, the long road of Calvary is still continuing. When Philippine chief peace negotiator, Prof. Miriam “Iye” Coronel - Ferrer called me by phone soon after Mamasapano to clarify certain points on the “coordination” issue hounding the incident, I clearly recalled my parting words for her. I told her: “Iye, I dread being in your shoes at this time”. “CATCH 22” -- Indeed, I was in those very same shoes before as peace negotiating panel chair from 2001 to 2003. I tell you, it’s not an easy job. Worse, it’s a thankless job. It puts one in a “catch 22” situation, meaning whichever way a negotiator goes, he or she is in a bind and in an unenviable position. Why so? Simply because the task is not only to negotiate with the armed rebels on the OTHER SIDE of the negotiating table. Unknown to many, the equally difficult task is the "negotiations" that a negotiator must do with those on the SAME SIDE of his table. Meaning, your own colleagues in government and the public at large who usually disdain giving favors or concessions to armed rebels who are understandably perceived as “enemies” or the “bad guys” who blackmail government. Let’s not forget: rebels take up arms because they cannot get redress for grievances within the normal system or they use the force of arms to seek demands. Hence negotiating with them to forge agreements is a tricky and sensitive work. Most important of all, factor in the fact that all rebels (MILF, CPP-NPA-NDF, MNLF) consider it a matter of negotiating principle that they do NOT adhere to nor do they operate within the ambit of our laws and Philippine Constitution while our own government negotiators MUST NOT go beyond those sacrosanct parameters. How to navigate this is inscrutable to ordinary mortals. But negotiators must somehow find a way. FOR PRINCIPAL --- The negotiator represents a principal, in our case, the Philippine president no less, who in turn represents all Filipinos. This is not only true for the government negotiators. This also applies to MILF negotiators. MILF chief negotiator Mohaqher Iqbal merely represents his own principal MILF Chair Murad Ibrahim and the MILF Central Committee, the equivalent of government’s Cabinet and its claimed followings of Bangsamoro people. PRIOR APPROVALS ----During my time, a general but comprehensive framework with a negotiating strategy must first be formulated to be approved by the principal, the President with the concurrence of the Cabinet thru its Security Cluster. And every time there were important agreements to be forged in the course of the negotiations, I had to get approvals first before I could commit important consensus points to the other panel. There were specific instances of periodic consultations as new factors and points emerged in the course of the peace talks. In fact there were instances where I would find it more difficult to “negotiate” with our government side than with the rebels across the table. There were times where it took President Arroyo herself no less to over-rule some Cabinet opposition for me to have the authority to “go ahead” in order to break some impasse in the talks or avert a breakdown. PROTOCOLS--- I remember one instance when I was already in Malaysia about to sign a document with the MILF. Due to some objections by some cabinet officials who were all in Manila, I had to suspend the signing ceremony and took the first plane out to Manila where I had a quick huddle with the Cabinet Security Cluster then flew back on the same day to Kuala Lumpur when things were clarified. Of course, these protocols were required due to the nature and implications of signed agreements. “MINI MAX”- -Generally, before the panel embarked on a foreign trip (usually to Malaysia or to Libya) to attend a round of negotiations, the negotiating positions in the agenda item for that meeting were discussed and cleared and the panel given the mandate to negotiate and commit. There was such a thing as “mini-max” in negotiations, getting inputs coming from government agencies and the Cabinet with a range of options from the minimum to the maximum. Anything “in between”, the panel can commit. Anything “beyond the max” will have to get prior clearance or approval. In other words, a negotiator works on the basis of what has been authorized and processed. This was the procedure during my time. I could not tell how the Aquino panel did its work. But I was surprised to know that the BBL that was finalized, signed and sealed by the two panels, had to be retrieved, re-drafted and “cleaned up” by Malacañang before the final version was submitted to Congress. I wondered why: either Malacañang did not monitor closely and just gave the negotiators a free hand or the Chair Iye’s panel exceeded its mandate. Or it was pure hubris only to be shaken back to reality by Mamasapano. But I can tell you that the work of a negotiator is not an easy job. One usually walks a tight rope. And in the eyes of the public, any error in judgment is the negotiators’ responsibility. The whole government though must bear responsibility -- the President primarily. IN DEFENSE OF FERRER --- With Mamasapano, the whole scenario was radically altered. While during our time the Filipinos at large were not

Right and wrong rights groups including the US Department of State country report for committing human rights violations against non-combatants as well as crime suspects. As State actors responsible for upholding both the country’s laws and international law, they have been correctly condemned for it, with the CHR often taking note of such violations. If Mr. Escudero is saying that violations of the rights of police and military men with a legal monopoly over the use of armed force — which in the first place are extremely rare — are on the same level of accountability as violations of the rights of civilians, he’s profoundly wrong. Ms. Rosales declared that the Senate report was based on emotions rather than facts. I submit that it is based more on the Senate’s reading of — and shameless pandering to — public sentiment, which, in the poisoned atmosphere that the media and certain politicians with an eye on 2016 have generated, can be summed up as opposed to the conclusion of the peace process and heavily in favor of war. This is the very same assumption behind the statements of certain politicians including some senators who harbor the illusion that after decades of war, the country can stand another decade or so of more fighting between the MILF and State forces. Not everything government officials say is wrong. But neither is everything they say right, as the Senate report makes painfully obvious. In tandem with the irresponsibility of much of the media, that reality has led to, and is continuing to create, a situation in which the citizens of this country are more confused rather than enligh-
tened not only about the Mamasapano clash but also about a host of other public issues. It helps explain why too many Filipinos are forsaking political engagement altogether to the detriment of that elusive ideal known as Philippine democracy.| * The views expressed in Vantage Point are his own and do not represent the views of and Pahayagang Balikas. <<<MONUMENT.... from P/1
Montemaria statue rises as of peace icon The Montemaria monument is the centrepiece of the Montemaria pilgrimage center dedicated to Mary, Mother of All Asia, a development conceived as a shrine to attract devotees and pilgrims. Strategically located at Punta Verde, a plateau that overlooks Verde Island Passage and the entrance of Batangas Bay of almost all vessels coming from Southern Philippines and international vessels entering China Sea to
use the Batangas International Port. The Verde Island Passage is widely acclaimed as the center of the center of marine biodiversity. The main feature of the 130-hectare development will be the 63- meter tall stainless steel monument of the Mother of All Asia on top of a 25-meter tall podium. The statue will be seen by all vessels coming to the Philippines. However, it will
be primarily a pilgrimage center that will have a chapel and meditation gardens in strategic areas within the development. The Mother of All Asia mixed-used development has a total land area of 5-hectares. Approximately 22 hectares of land will be allocated for the development of 1,000 condotel rooms and villas with average floor areas of 40 sqm and 240 sqm, respectively. These units will be

Calvary for Peace Negotiations too keen and focused on the peace negotiations except for the affected sectors, today an angry and awakened sector at large must be mollified. Mamasapano was a monkey wrench. I just could not picture myself now in the shoes of Chair Ferrer with all the challenges she and all the peace negotiators and peace workers are now facing. Truth to tell, I credit her for her composure and clarity in defending and explaining the collective outcome of a difficult, tedious and crafty procedure that is now being publicly scrutinized, torn to pieces -- even demonized. DEFEND PACT --- It is not fair that we should take it personally against Chair Ferrer for standing pat on the signed documents, as she is being pilloried today. Having forged an agreement together with the MILF negotiators, she is duty bound to stand by it and defend it. For her to do so does not mean she's taking the side of the MILF as she is unfairly charged. In the same vein, MILF Chair Mohaqher Iqbal has to defend the same agreement and MILF should not, in the same vein, charge him of being pro-government. They jointly forged an agreement and they had to stand by it, no matter what. If Chair Ferrer is being “roasted” by the public after she worked hard to get a peace settlement, Chair Iqbal will get more roasting from the MILF if he too falters, for sure. RESIGN? -- At a critical time like this, there is a call for Chair Ferrer to resign. Perhaps that can be the most expedient escape from it all but to me, that’s the last thing a negotiator should do at this time. One worth her salt does not dismount at the time when she is most needed to give clarity to a muddled situation, however difficult or inscrutable the work appears to be, however tempting and convenient it would be to leave and go back to quiet private life. This is a time to work and face the music. There is another time to call it quits and quietly dismount. I trust Chair Iye will continue to hold her ground as she does -- and which she must. MY OWN STORY -- I have
my own story about resignations to tell, although a bit different from what Chair Ferrer is facing today. When the Arroyo government assumed office in 2001, the peace process was in disarray. I was appointed as the chief negotiator with the principal task of restoring the abandoned peace talks due to the Mindanao “war” policy of former President Estrada. Within a short period, we signed the framework “agreement for peace” in Tripoli, Libya in a few months to restart and pick up the pieces for the resumption of peace talks. For 2 years, we signed other milestone agreements. I RESIGNED -- Things went well until 2003 when something happened. I was on the verge of resigning in a huff as chief negotiator due to an incident. I refused to put my concurring signature on a prepared “Minutes” that was presented to me containing points I didn’t concur in during our meeting. It was handed to me for signature by MILF’s Musib Buat when I was already back home in Manila. Normally, Minutes of Meetings were discussed to the last comma before heading back home. This one was different. But instead of totally refusing to sign, I annotated the minutes with some notes. This ruffled the feelings of the MILF and the Malaysian facilitators and they said I altered the minutes. Because of this, I was convinced that my affectivity as negotiator was seriously undermined. But I refused to immediately resign or dismount at that time because it would be disruptive of the over-all peace efforts. It took another subsequent incident (an attack by MILF on Siocon town of Zamboanga del Norte) and a lull in the peace talks that gave me an excuse to hand in my resignation to the President. Sec. Silvestre “Yong” Afable took over from me but he also eventually resigned too. Then retired Army Gen. Rodolfo “Rudy” Garcia took over from Sec. Yong in whose watch, the Supreme Court ruled the “Memorandum of Agreement on Ancestral Domain” (MoA AD) as unconstitutional. I also served the OPAPP position only to turn it over to Sec. Hermo-
genes Esperon when I became Press Secretary. BANGSAMORO DREAM --- An additional note. When MoA-AD was signed and later declared unconstitutional by the Supreme Court, although I was no longer at OPAPP but at the Malacañang press office as press secretary, I aggressively defended and explained the MoA-AD knowing the implications of depriving the Bangsamoro an opportunity to achieve its long dream and aspiration of self-governance and selfdetermination. But what I cannot still understand up to now is why our present government panel and the MILF did not learn from the lessons of the failed MoA AD and merely re-languaged those provisions that failed the constitutional test. Well, all those are behind me now.
I have now the luxury of just reminiscing and viewing things from a distance -- but definitely not in a detached manner given that what happens to the Bangsamoro aspirations will affect me and the rest of the nation. CALVARY --- Today, how we deal with the present challenges and discordant noises involving the proposed BBL will be crucial. But in the meantime, it is still a continuing Calvary for Chair Iye Ferrer, together with all those who work for peace -- including the BBL as well. Whether BBL’s “crucifixion” will eventually come now or later is of no moment. Whatever happens in the unsettled maze of Mamasapano, I am confident that all peace efforts are bound to somehow “resurrect”. Maybe not now. But inevitably later.|
