Binanggit ni Dr. Richard Mooi na “The Verde Island Passage is living up to its reputation: the ocean vibrates with the cycle of living things inhabiting every nook and cranny.”
After the June 12 huge protest in OrMin, Anti-mining Mindoreños nego revocation of Intex ECC ANTI-MINING advocates from Mindoro demanded the Department of Environment andNatural Resources (DENR) to revoke permit it issued to Norwegian mining firmfor its multi-billion nickel project in Mindoro. “The June 12 protest participatedin by 5,000 Mindoreños from different walks of life is a clear testimony of ourresistance to foreign and large-scale mining,” said Pastor Ian Delos Santos, spokesperson of anti-mining alliance Kaisahan ng mga Mindoreño laban sa Dayuhan at Dambuhalang Pagmimina (KALASMINA, Mindoro People’s Unity Against Foreign and Large-scale Mining). “That piles up to the many bases the DENR should considermore seriously to revoke the ECC (environmental compliance certificate) ofIntex Resources,” he continued. Together with Delos Santos are representatives from religious sector, including Catholic and Protestant churches; indigenous people led by HAGIBBAT-Mangyan Mindoro Federation and Kalipunan Katutubong Mamamayan ng Pilipinas; farmers’ group led by Katipunan ng Samahang Magbubukid sa Timog Katagalugan and Samahan ng mga Magsasaka sa Kanlurang Mindoro; environmental advocacy group Kalikasan People’s Network forthe Environment (KPNE); and women’s group Samahan ng mga Kababaihan sa Mindoro-Gabriela Mindoro. Among those local governments supporting the anti-mining side in the dialogue came all the way from Abra De Ilog, Sablayan, and Governor’s office of Occidental Mindoro and Victoria of Oriental Mindoro. Anchor Boy Cardoza of Bambi FM mass media outfit in San Jose,Occidental Mindoro also joined KALASMINA in the dialogue. “We demand the DENR to revoke theECC issued to Intex Resources because it was proven scientifically that large-scale mining such as that of Intex will cause irreversible damages and retrogresive development. Intex also committeed various technical mishap for its inability to secure permission from indigenous peoples and local governments concerned. Intex also lost its moral ground to operate because Mindoreños have been shouting on top of their lungs that Mindoro is a no-go for foreign and largescale mining as per the 25-year moratorium passed by provincial boards of Oriental and Occidental Mindoro,” Delos Santos asserted. KPNE also emphasized the need to protect the so-called “center of the center of marine biodiversity” located at the Verde Island Passage between Batangas and Mindoro island. The passage is included in the Coral Triangle where California-based scientists recently discovered 100 new native marine species. KPNE raised in the dialogue that any mining operations in the Philippines would cause irreversible and moral crimes to the environment and the humanity. The contigent demanded President Aquino to make the necessary action with regard to the revocation of Intex’ ECC. Otherwise, they pledged to mount more huge protests as the Aquino’s last state of the nation address approaches.|

“...Thus, it is now the Court of Appeals which has the authority and jurisdiction to decide on all matters and issues relating to the instant case...”
Dahil dito, tinanggihan ng Kagawaran ang kawalang merito ng Mosyon ni Tolentino, gaya ng isinasaad sa Kautusan ng DOJ na may petsang January 22, 2015: “WHEREFORE, premises considered, the Motion praying for the issuance of an order directing the Appellees to strictly observe Resolution dated June 6, 2014 and impose the proper sanctions for malicious disobedience is hereby DENIED for lack of merit.”

OPINION
Surprised by Francis
ROBERT A. GAHL, JR Commentary
WITH his new encyclical Laudato Si’, Pope Francis continues to break the mold of preconceived, rigid expectations. Our polarized culture instinctively sorts people and positions into neat boxes according to the politicized categories of right and left or, more simplistically, for and against. Many analysts quickly respond by oversimplifying his profound teaching. Many critics hone in on their favorite topic and promptly applaud or chastise the Pope if he seems to take their favorite view on their favorite topic, or not. But no one should feel comfortable with Laudato Si’. Francis does not seek applause for his teaching but that it be taken to heart. The Pope presses his careful reader to deep conversion and to concerted action in economic and political policy. None of this should be a surprise. Since the late 19th century, with Leo XIII’s Rerum Novarum, Popes have pronounced on matters of social doctrine. Pope Francis is perfectly in continuity with his predecessors and he makes the point in the introduction to this new encyclical by laying out its foundation in the teachings of John XXIII, Paul VI, John Paul II, and Benedict XVI. All of these Popes have expressed acute concern for the environment. Benedict even made the effort to install a vast array of solar panels on the roof of his audience hall to achieve carbon neutrality within Vatican City State, the first state to achieve such a goal. Nonetheless, the run-up to the publication of the encyclical was marked by controversy, even to the point that, on account of their scepticism with respect to the solidity of global warming science, some observers were expelled from meetings on climate change recently held in the Vatican by the Pontifical Academy of the Sciences. Global warming concerns dominated the pre-publication controversy. Media attention increased interest in the Pope and excitement for his encyclical on ecology. Laudato Si’ is probably the most anticipated encyclical in history because concerted attempts were made by opposing political proponents within the Church and in the secular world to modify, delay, impede, and to spin the text before it was finalized. Then, in the final days before publication, a leak of a draft, hardly distinguishable from the final document, fanned the flames of controversy, also regarding the ethics of publishing, or even just discussing, a leaked draft. Exposing irreconcilable views of the journalistic profession, journalists quoted other journalists regarding the tensions between institutional loyalty, accreditations, and the obligation to bring to light matters of international public opinion. Given that Pope Francis enjoys universal recognition as the most influential moral authority today and that many hold that we are living in an historic moment of impending global tragedy on account of the devastating effects of irreversible climate change, activists hold that he must speak out and lead the world towards concerted effort to reduce the emission of carbon dioxide and to save the world from impending doom. Is the Pope taking sides? Indeed, Pope Francis faces an unprecedented situation. In early centuries, Papal teaching focused on the content of revelation, for instance, the unity between the human and divine natures of Jesus; the relationship between the three Persons of the Trinity; the nature of grace, justification; and the sacraments — all subjects foreign to contemporary concerns of secular, political debate. But in recent times, Popes have concentrated on teaching regarding the implications of divine revelation in human affairs. Consequently, they have pronounced encyclicals dedicated to marriage, family, human life, economics, democracy, and all features of social justice. So, if the world is truly facing impending doom, due to anthropogenic, or man-made global warming, then, perhaps, the Pope does have an unprecedented obligation to use his authoritative voice to warn the world and to bring everyone together to act in concert to prevent world-wide devastation. Many scientists and proponents of calling our age “the anthropocene” claim that acting alone, or even as an entire nation or continent, would be ineffective to stave off the global effects of greenhouse gases. If the warnings of climate scientists are well-founded, then surely the Pope must forcefully proclaim the obligation for global coordinated effort to reduce the warming. Moreover, it seems that he must do so without delay in preparation for his upcoming trip to the USA in September, when he will address the joint session of Congress in Washington DC and the UN General Assembly in New York, and prior to the UN’s climate change conference in Paris next December. - To be continued

Questioning the BBL MEMBERS of the Philippine Constitution Association (PHILCONSA) and the National Transformation Council (NTC) have questioned the Framework Agreement on the Bangsamoro (FAB) and the Comprehensive Agreement on the Bangsamoro (CAB) before the Supreme Court. Notable in the petition is the names of prominent members of the NTC namely Archbishop Ramon Arguelles, Bishop Romulo Dela Cruz, Archbishop Fernando Capalla, Former Sec. of Defense Norberto B. Gonzales, and Former Sen. Francisco Tatad. PHILCONSA is an institution historically and widely known for its advocacy of protecting the 1987 Constitution from Executive and Legislative transgressions. It argued that the CAB is attempting to create another autonomous region in addition to the two autonomous regions allowed under the Constitution. It postulated that no other autonomous regions may be created by Congress without amending the Constitution. Thus, the CAB and the proposed Bangsamoro Basic Law (BBL) are violative of the fundamental law of the land. In a very strong language, PHILCONSA denounced the Bangsamoro Political Entity which the BBL seeks to establish as an intruder and interloper in the 1987 Constitution. It asserted that unless and until the 1987 Constitution is first amended ‘Bangsamoro’ is a shadow entity of no legal consequence. PHILCONSA said, “Constitutionally, it is nothing, but a band of amorphous rebels.” The petition recalled that the Supreme Court has struck down a similar agreement before, the Memorandum Agreement on the Ancestral Domain Aspect (MOA-AD) between the government and the MILF, for violating many provisions of the 1987 Constitution. It stated that the FAB CAB are nothing but toxic intellectual contortions meant to delude and deceive the people into believing that they could take

them as a panacea for their organic ills when they were actually designed to subvert them. Former Negros Oriental representative Jacinto Paras filed a separate petition. He claimed that the agreements are attempts on the part of [the government peace panel] to virtually sell out the sovereignty and territorial integrity of the Republic of the Philippines to the MILF. These challenges against the FAB and the CAB are bold attempts to stop the administration from enacting the Bangsamoro Basic Law (BBL) into law. They complement the oppositions of some senators and representatives to the BBL. There is no telling how the Supreme Court will act on these petitions. There are speculations that it is likely to dismiss the petition for being pre-mature since the congressional actions on the BBL which embodies the terms and conditions of the FAB and the CAB are not yet finished. Some quarters meanwhile claim that the petition will be dismissed eventually for being moot and academic as the government and the MILF have already signed the agreement. They are missing the point of course. Whether Congress enacts the BBL or not will not prevent the Supreme Court from adjudication on the constitutionality of the agreements entered by government and the rebel group. Also, the fact that these agreements were signed already did not make the challenges against them moot and academic. Precisely, the determination of their validity is essential if their terms and conditions are to be carried out by the government. People have the right to question them especially since the government is bound to spend billions of public funds to implement them. The ball is now in the Supreme Court, We can only hope that it will not abandon its duty to safeguard the Constitution and the rule of law.|

Are we anywhere near peace in Mindanao? The Bongbong Marcos I know THE headlines of major dailies trumpeted the symbolic decommissioning of 145 fighters of the Moro Islamic Liberation Front and the turning over of 75 highpowered firearms. It is supposed to be a positive step toward peace. Also it was used as an occasion by the Aquino government to push for the enactment of the proposed Bangsamoro Basic Law (BBL), which is still encountering rough sailing in Congress. As sweetener, the Aquino government reportedly agreed to spend P2.4 billion ($53 million) for the decommissioned former rebels. At the same time, at less prominent sections of some dailies, it was reported that Superintendent Josephine Fadul of the Department of Educatio– Davao del Norte endorsed the closure of Lumad community schools: the Salugpungan Ta Tanu Igkanugon Community Learning Center (STTICLC) and the Mindanao Interfaith Services Foundation (MISFI) academy. The closure would affect 3,000 Lumad children who, before the community schools were established, had no access to education. In its stead, Fadul has recommended the setting up of temporary schools with soldiers as parateachers. The closure was preceded by harassments of teachers and students by soldiers from the 60th and 68th Infantry Battalions of the Philippine Army. The military has been accusing the schools of being ‘fronts’ of the New People’s Army. In the case of the MILF, the Aquino government has been pushing for the enactment of the law, which is the culmination of its peace negotiations with the rebel group and is willing to spend billions of pesos for the decommissioned MILF fighters. On the other hand, the government and the Armed Forces of the Philippines ordered the closure of Lumad schools on the absurd accusation that these schools are NPA ‘fronts’. Doing what? Training guerillas as part of physical education? Shouldn’t the Aquino government be glad, instead, that NGOs are doing what it has been failing to do: to let Lumad children enjoy their right to education?
Benjie Oliveros
So is the Aquino government’s peace policy a case of what the left hand giveth the right hand taketh away? Or is it a classic example of using the carrot for those who are willing to submit to its terms and the stick against
those who do not? It still remains to be seen whether the conclusion of the peace negotiations with the MILF, the enactment of the BBL into law, the decommissioning of all MILF fighters and the turning over of their weapons, and the creation of the Bangsamoro political entity would achieve peace with the Bangsamoro people. After all, the Government of the Philippines signed a Final Peace Agreement with the Moro National Liberation Front (MNLF) in 1996 and the Agreement on General Cessation of Hostilities in 1997, and established the Autonomous Region of Muslim Mindanao, with MNLF chairman Nur Misuari as governor. After which, the MILF rebellion escalated in 1999 after the Estrada administration declared an “allout war” and the MILF chairman then Hashim Salamat declared a jihad in return. For as long as the Bangsamoro people do not genuinely enjoy their right to self-determination, the secessionist movement would continue under another group. While the Aquino government’s peace overtures with the MILF may achieve some measure of peace, albeit temporarily, its closure of Lumad schools do not in any way create the conditions for peace. On the contrary, it stokes the fire of revolution. Resource-rich Mindanao island has yet to achieve some measure of peace. Perhaps, it is the reason why the Aquino government is in such a hurry to have the MILF decommissioned and its arms turned over to the AFP while employing all means to “strategically defeat” the NPA. Many administrations have tried and all have so far failed because they refused to address the roots of the armed conflict. Its being resource rich is the very reason that Mindanao has historically been a land of conflict.|

Learning the art of interior struggle YES, as long as we struggle interiorly, there is spiritual life, the very wellspring that produces the living water for our river of life. As long as we struggle interiorly, we can be assured of our fidelity to whatever commitment we have entered into. Interior struggle is essential and indispensable to our life. Our life is very dynamic, with all sorts of challenges to face, problems to solve, issues to be clarified. We need to see to it that our interior life, our spiritual life, our thoughts, desires, and intentions are firmly rooted on God, their proper foundation. We need not only to purify our thoughts and intentions from any stain of pride, vanity, lust, envy, sloth, gluttony, anger, etc. We need to also fill them and rev them up with true love and wisdom. These are the reasons why we have to engage in a lifelong interior or spiritual struggle. The ideal situation should be that we are always in awe at the presence of God in our life, making him the principle and objective of all our thoughts, words and deeds. We have to be spiritually fit before we can be fit anywhere else—family-wise, professionally, socially, politically, etc. Let’s never be deceived that our life is mainly physical, and its development is just a matter of struggling externally—that we manage to eat, to work, to earn, to stay away from physical danger, etc. The real battle is in our internal selves—in our thoughts and desires, our will and plans. The struggle in life cannot just be a matter of economics or politics. The battle always starts and ends in our mind and heart, in the spiritual aspect of our life. This is where things start to happen, and where things also get resolved. Even if there are still things to be fixed externally, we can still manage to fix them internally, because that’s where we get in touch directly with God, and with him, nothing is impossible. Let’s disabuse ourselves from the thought that we get our ultimate peace and joy somewhere else. That’s why we have to see to it that our thoughts and desires are properly engaged with God who is their true foundation and end, for outside of Him, we will just expose ourselves to all sorts of random and usually dangerous possibilities.
And God is not a figment of our imagination, a product of our desire to believe, a mere psychological crutch. He is the most real being—in fact, the fullness of subsistent being whose essence we can somehow know but can never fathom. He is the very author of reality itself. This task of conforming our thoughts and desires to Him is getting to be very exciting, because these days many are the earthly things—attitudes, philosophies, ideologies, cultures, together with their lifestyles—that dare to be alternatives to God. Today’s world is so immersed in worldly values that any reference to God is at best a mere formalism, a decorative item, a lip service to tradition that is already emptied of its true substance. And this is because in the first place many people are not praying anymore, are not exercising and living by faith. They prefer to follow by the rule of “following what comes naturally.” And that’s usually just obeying one’s feelings and passions, or the many flipping fads around. Thus you have ad slogans like, “Obey your thirst,” “I don’t wanna grow up….. I’m a Toys R Us kid,” “It’s fun to tickle your tongue with…” If you’re constantly bombarded with messages like this, chances are you will believe them, and start abdicating the use of your spiritual faculties. We have to wage an abiding interior struggle if only to keep our sanity, our humanity. We need to do it to avoid becoming mainly conditioned by earthly values that are blind to the spiritual and supernatural realities of our life. We need to see to it that our minds and hearts are truly engaged with God, with the living God, and not just an idea or theory of God. This is not only possible, but also highly practicable, because in the first place, God himself wants it that way. The reason many people find it hard to get in contact with God is because they have lost the art of prayer and contemplation, and have assumed a dominantly worldly outlook that makes them self-centered, complacent, agnostic, if not atheistic. This is where interior struggle is most needed.|
WHEN I saw him last week in his Roxas Blvd. office in Metro Manila, Sen. Ferdinand R. Marcos, Jr. was looking well. But I soon found out why he sent “Zandro”, his 21-year old son, an Oxford London student who was on school break to read his speech at a Manila university the day before. ( Zandro was a “hit” by the way to the young university students.) ‘Bonggets’ -- his friends usually call him -- had stomach problem and had been subsisting on water and hot tea. But he was otherwise in his usual high spirits. We had a good chat for over an hour. FIRST SIGHT -Flashback. I was a young Davao journalist then in the mid 70s during Martial Law after I passed the 1973 Philippine Bar exams. I joined a delegation from the Davao media to Malacanang to meet then President Marcos who was reclusive due to his ailment. That was the first time I spotted young Bongbong who was unobtrusibly standing in a corner by the window curtains just watching closely what was going on. My take then was that he was closely looking after his father who was just seated on a chair talking to us. Every time FM would take a glance towards his back, as if wanting something, the young son would oblige. Then he would return back to his corner. FRIENDS -- Fast forward. When I was Davao Congressman from 1992 to 1995, “Bonggets” was Ilocos congressman. Although we were colleagues, we did not bond much as close friends while working in the Batasan. He was seated up front and I was in the back row. Having humble beginnings and as a “probinsyano” reporter, the Marcos family was a distant star from my own ordinary world down south. However, it was when a congressional committee of which we were both members (together with then Congressmen Ralph Recto, Oscar Orbos, etc.) came to Davao and stayed at our family owned Seagull Beach Resort in Punta Dumalag that I got to know more about him. Before last week’s chat, the last time we met was in November, 2013 when we disembarked at the Manila airport together from an international flight from Frankfurt, Germany (after my wife Beth got her second fresh stem cell infusion from Villa Medica for her kidney problem). ‘Bonggets’ was with wife, Lawyer Liza (nee Araneta) and yes, “kodakan” even at the tube area. “LOW-KEY & SHY” -- More recently, when the Mamasapano incident broke out and the issue about the Bangsamoro Basic Law (BBL) broke the headlines, “BBM” (that’s his cryptic initials that his staffers and co-workers refer to him) was enthused about how he could be of help but as low key as possible. Unknown perhaps to many, he was known for being “shy” about publicity and would prefer to just quietly do his work. But the BBL issue was something he could not duck and must grapple with as he was chair of the committee tasked to handle it for the Senate. Suddenly, he was thrust to the center of the public eye, a scenario he did not relish much -- a task that if mishandled would be very divisive, sensitive and explosive. But which he must do. HIS DREAMS -- During our chat last week, he intimated that due to the intense polarization of the pro and anti BBL factions, he would be in a no - win situation. Nonetheless. But his formula, from how it looks, does not however kow-tow to what is preponderantly popular or what the gallery wants. It's definitely NOT about “playing to the gallery.” He wants to do justice to the task and to the Bangsamoro as well. He personally led Mindanao-wide consultative meetings on the ground and met and heard the views of all stakeholders, especially those who were excluded from the earlier engagements. He dreams of an inclusive and sustainable legal framework for the Bangsamoro. DOING RIGHT. -- He tersely said: “I want to do what is right to be able to help the Bangsamoro. I could just let things pass as they are and not at all lift a finger. But from where I sit, there is still a lot of work and refinement to be done to make the BBL compliant to our basic law. There are sacrosanct parameters that must be observed; there are the lines we all ought not to cross. Otherwise, we are not doing our Bangsamoro justice; we are again misleading them and denying them the aspirations they have all dreamed of for so long”. VINDICATION -- Yes, he is agonizing over accusations by some sectors that he is resorting to alleged “delatory moves” in the Senate, missing timelines and watering-down the BBL. He said that if there is anyone who should be blamed for some delay, it is Malacañang, for the length of time it worked on a revised BBL after the Bangsamoro transition commission submitted its finished work. Malacañang “embargoed” it ostensibly to review but what came out was still a non-compliant version. He added that if there is some more blaming to do, the OPAPP must explain why it gave in to demands that clearly crossed lines that not anyone of us is allowed to do. He said he was not surprised by some quarters tagging him as “antiMoro” but he said the final output of his work will vindicate him and “prove them wrong”. So far, he has done great efforts, listening and consulting. Let’s see how this ends. LOVES MUSIC -- ‘Bonggets’, although nurtured by a “princely world”, has his two feet on the ground, so to speak. His is a well-rounded personality and can easily de-stress himself. He loves music and as a musician, he

The Bongbong Marcos I know plays the saxophone and the flute. He dotes on his 3 boys, all studying in London whom he and his wife Liza assiduously protect from the public eye. As I said earlier, the debut of vacationing “Zandro” in public reading his father’s speech with some faltering Tagalog due to his Londoner accent must be a desperate option, the ailing senator not wanting to be a “no show” to the expectant university students. (Zandro’s video appearance posted by some netizens has gone viral, by the way!) Liza is a practicing lawyer at the MOST Law firm in Manila.
