‘Delikado!’ LUNGSOD NG LIPA – Pinangunahan ng Department of Trade and Industry (DTI) - Batangas ang pagsira sa kahon- kahong christmas lights at disposable lighters na nagkakahalaga ng P300k na nakumpiska noong nagdaang taon sa iba't ibang pamilihan sa lungsod ng Tanauan. Ayon kay DTI Provincial Director Ruel Gonzales, matagal na panahon nang ipinatutupad ng kanilang tanggapan ang mahigpit na pagsunod sa quality standards ng isang produkto kung kaya't ang mga produktong tulad nito ay hindi pumasa sa kanilang pamantayan. Aniya, pinangangalagaan lamang nila ang kaligtasan ng mga mamamayan kung kaya't dapat ay hindi tangkilikin ang mga produktong tulad nito sapagkat hindi ito dumaan sa tamang proseso. Ang mga produktong ito ay walang mga ICC mark at maliliit ang mga kable na maaaring maging sanhi ng sunog kapag napabayaang nakasaksak sa matagal na panahon.
Maging ang mga disposable lighters na nakum-piska ay hazardous din sa kalusugan at banta sa kaligtasan sapagkat karamihan sa mga ito kapag nahulog ay biglang pumuputok o sumasabog. Dagdag pa ni Gonzales, sa taong ito ay wala silang nakumpiskang mga substandard products sapagkat karamihan sa mga negosyante ay natuto na at nagdadalawang isip na sa pagbebenta ng mga walang kalidad na produkto. Kasama ng DTI Batangas ang pamahalaang lunsod ng Lipa sa gawaing ito kung saan ginamitan ng pison ang naturang mga substandard na produkto upang tuluyan ng hindi mapakinabangan at maging banta sa kaligtasan ng mga mamamayan. Marami naman sa mga nakasaksi sa isinagawang pagsira ang natuwa sapagkat anila mas mabuti na ito kesa mas malaking problema at kapahamakan pa ang makuha nila sa pagbili ng ganitong produkto.| BHABY DE CASTRO

Dahil dito, nagkaroon ng pagsasanay sa paggawa ng VCO para sa mga opisyales ng Rural Improvement Club at KALIPI ng Tiaong, Quezon. Ang mga nasabing samahan ay magtutulongtulong makapagtustos ng ‘raw oil’ ang Pasciolco, daan para kumita at makapagbigay ng trabaho sa mga kasapi. Sa lalawigan ng Quezon, ang Pasciolco Agri Ventures ay isa sa maraming guma-

Free dental and medical services, delivered in Nasugbu IN pursuit of delivering basic services to the Batanguenos, Batangas Provincial Public Safety Company under the leadership of PSUPT MANUEL JAVIERABRUGENA, Company Commander, has once again hosted the conduct of Medical and Dental Mission and Free Haircut Services through its Community Action Team led by PINSP ROY MAGPANTAY CUEVAS. A total of three hundred ten residents of Brgy. Calayo, Nasugbu, Batangas benefitted from said activities conducted on November 25, 2014. In partnership with the 51st Engineering Brigade, Philippine Army led by MAJ STEVENS N NAVATA, 514 Engineering Construction Brigade, Philippine Army led by CPT JOSE LAUREL M SIBULLAS, 730th Combat Group, Philippine Air Force led by SSG RUBEN A BANAYAT, Batangas Provincial Health Office, Nasugbu Municipal Health Office and Nasugbu Municipal Police Station, one hundred individuals were given aid during the free medical services, eighty individuals benefitted from the free dental services while one hundred thirty residents got their new haircut during the conduct of the outreach program that started at around 9:00AM of November 25, 2014. Ang parangal ay idinaos sa Litkemkai Center, Cagayan de Oro City, Misamis Oriental noong ika -20 ng Nobyembre. Isinabay ito sa 10th Philippine National Corn Congress ng DA na ginanap noong Nobyembre 19-21. Tumanggap ang lalawigan ng plake ng pagkilala at P3 milyon na gagamitin sa mga proyekto para sa patuloy na pagunlad ng industriya ng mais. Ang iba pang mga Outstanding Provinces na tumanggap ng kaparehong premyo ay ang Pangasinan, Isabela, Agusan del Norte at Agusan del Sur. Marinduque gets PHL’s First telemedicine System
BOAC, Marinduque — The country’s first interactive Telemedicine system was launched recently in Marinduque. “This is one big leap for the health care industry because we now have the ability to provide interactive healthcare to patients in far flung areas through a video call using modern technology and telecommunications. Medical examinations can now be done through a live video conversation,” Regional Director Eduardo C. Janairo said during the soft opening of the Telemedicine system at the Marinduque Provincial Hospital.Governor Camencita O. Reyes was present during the launch. “A doctor from Manila can virtually hear a patient’s heartbeat from Marinduque. He can even ask you to cough, inhale or exhale and give you an initial analysis of your health condition,” Janairo said. The Telemedicine system allows a patient to communicate with health care providers live over video in real time for the provision of immediate care. The patients’ video or still images plus additional data needed in the diagnosis will be captured and stored in the system which in turn be sent to physicians. The World Health Organization defines Telemedicine as ‘the delivery of health care services by all health care professionals using information and communication technologies for the exchange of valid information for diagnosis, treatment and prevention of disease and injuries, research and evaluation, and for the continuing education of health care providers, all in the interests of advancing the health of individuals and their communities’.

Palawan health workers, nagsanay para sa complimentary feeding PUERTO PRINCESA, Palawan — Bilang paghahanda sa 120 araw na complementary feeding sa mga bata na isasagawa sa ilang mga munisipyo sa Palawan ay sumailalim sa pagsasanay ang mga health worker sa Palawan. Ang pagsasanay ay ang ‘Training-Workshop on DOSTPINOY (Package for the Improvement of Nutrition of Young Children)” na nilahukan ng mga Barangay Environment, Agriculture and Nutrition Scholars o BEANS, Barangay Health Workers, Midwives, Nurses at Municipal Nutrition Action Officers kamakailan. Ang mga health worker na dumalo sa pagsasanay ay mula sa 11 munisipyo sa Palawan na napili para sa complementary feeding para sa mga bata. Ang mga munisipyong ito ay ang Sofronio Española, Bataraza, Busuanga, Coron, Roxas, Taytay, Rizal, Brooke’s Point, Aborlan, Balabac at Culion. Ipinaliwanag ni Provincial Nutrition Action Officer Rachel Paladan, bahagi ng ipinapatupad na Malnutrition Reduction Program ng Food and Nutrition Research Institute o FNRI ang DOST-PINOY. Ito ay isang nutrition intervention strategy kung saan ang mga health at nutrition workers ay sinasanay upang turuan ang mga nanay at mga caregivers ng basic at maternal nutrition, kahalagahan ng pagpapasuso sa mga sanggol, angkop na complementary feeding, pagpaplano ng pagkain, ligtas na paghahanda ng mga pagkain at pagtatanim ng gulay sa bakuran. Pagkatapos ng pagsasanay ay kanilang isasagawa ang complementary feeding para sa mga batang mababa ang timbang at iyong sobrang baba ng timbang.|

Intensify efforts to promote the full unity of all Christians Here below is the Vatican-provided text of the joint declaration signed by Pope Francis and Ecumenical Patriarch Bartholomew this morning in Istanbul: COMMON DECLARATION We, Pope Francis and Ecumenical Patriarch Bartholomew I, express our profound gratitude to God for the gift of this new encounter enabling us, in the presence of the members of the Holy Synod, the clergy and the faithful of theEcumenical Patriarchate,to celebratetogether thefeast ofSaint Andrew, the first–called and brother of the Apostle Peter. Our remembrance of the Apostles, who proclaimed the good news of the Gospel to the world through their preaching and their witness of martyrdom, strengthens in us the aspiration to continue to walk together in order to overcome, in love and in truth, the obstacles that divide us. On the occasion of our meeting in Jerusalem last May, in which we remembered the historical embrace of our venerable predecessors Pope Paul VI and the Ecumenical Patriarch Athenagoras, we signed a joint declaration. Today on the happy occasion of this further fraternal encounter, we wish to re–affirm together our shared intentions and concerns. We express our sincere and firm resolution, in obedience to the will of our Lord Jesus Christ, to intensify our efforts to promote the full unity of all Christians, and above all between Catholics and Orthodox. As well, we intend to support the theological dialogue promoted by the Joint International Commission, instituted exactly thirty–five years ago by the Ecumenical Patriarch Dimitrios and Pope John Paul II here at the Phanar, and which is currently dealing with the most difficult questions that have marked the history of our division and that require careful and detailed study. To this end, we offer the assurance of our fervent prayer as Pastors of the Church, asking our faithful to join us in praying "that all may be one, that the world may believe" (Jn17:21). We express our common concern for the current situation in Iraq, Syria and the whole Middle East. We areunited in the desire for peace and stability and in the will to promote the resolution of conflicts through dialogue and reconciliation. While recognizing the efforts already being made to offer assistance to the region, at the same time, we call on all those who bear responsibility for the destiny of peoples to deepen their commitment to suffering communities, and to enable them, including the Christian ones, to remain in their native land. We cannot resign ourselves to a Middle East without Christians, who have professed the name of Jesus there for two thousand years. Many of our brothers and sisters are being persecuted and have been forced violently from their homes.It even seems that the value of human life has been lost, that the human person no longer matters and may be sacrificed to other interests. And, tragically, all this is met by the indifference of many. As Saint Paul reminds us, "If one member suffers, all suffer together; if one member is honoured, all rejoice together" (1 Cor 12:26). This is the law of the Christian life, and in this sense we can say that there is also an ecumenism of suffering. Just as the blood of the martyrs was a seed of strength and fertility for the Church, so too the sharing of daily sufferings can become an effective instrument of unity. The terrible situation of Christians and all those who are suffering in the Middle East calls not only for our constant prayer, but also for an appropriate response on the part of the international community. The grave challenges facing the world in the present situation require thesolidarity ofall peopleof goodwill, andso wealso recognize the importance of promoting a constructive dialogue with Islam based on mutual respect and friendship. Kabayaran ng panggagahasa SI Sunshine, bagamat 15anyos na, ang kapasidad ng kanyang pag-iisip ay sa isang 7-anyos na bata. Nakatira siya sa isang malayong barangay kasama ang kanyang Lola Pearl. Noong 1995, napansin ni Pearl na buntis si Sunshine. Nagalit si Pearl at inusisa kung ano ang nangyari kay Sunshine. Sinabi ni Sunshine na tatlong beses siyang ginahasa. Nagreklamo si Pearl sa Barangay Kagawad. Unang tinawag ng kagawad si Obet, pero sabi ni Sunshine, hindi ito ang gumahasa. Sunod na tinawag ang kapatid ni Obet na si Ambo. Hindi rin daw ito ang gumahasa ayon kay Sunshine. Nang iharap kay Sunshine ang kapatid nina Obet at Ambo na si Tito, dinuro siya ng dalagita at sinabing ito ang gumahasa sa kanya. Kinasuhan si Tito ng tatlong kaso ng panggagahasa. Ipinahayag ni Sunshine na si Tito ang ama ng kanyang anak. Nahihirapan man, nagawang isalaysay at ilarawan ni Sunshine kung paano siya ginahasa ni Tito. Ginahasa raw siya ni Tito ng tatlong beses sa ilalim ng punong duhat. Sa una at ikalawang panggagahasa,
tinutukan daw siya ng gulok ni Tito. Ngunit sa pangat-lo, hindi na siya kailangang pilitin ni Tito dahil nagustu-han na niya ang nangyari. Alibi naman ni Tito, tatlong taon na siyang nagtatrabaho sa isang probinsiya na dalawang oras ang layo mula sa lugar na pinangyarihan ng krimen kaya imposibleng siya ang salarin. Dapat ba siyang panagutin sa tatlong kaso ng panggagahasa. Ayon sa mababang hukuman at Korte Suprema, mahina ang depensa ni Tito at nananaig ang testimonya ng biktima. Hindi imposible ang paratang ni Sunshine lalo pa at kayang-kaya naman ni Tito na pumunta sa lugar na pinangyarihan ng krimen dahil dalawang oras lang ang layo nito. Ginawa ni Tito ang panggagahasa at nakuha niyang pasunurin si Sunshine dahil ginamit niya ang gulok para takutin ang dalagita. Ngunit tungkol naman sa pangatlong insidente, nararapat bang kasuhan pa rin si Tito ng panggagahasa gayong ipinahayag naman ni Sunshine na nagustuhan niya ito?

Press Freedom PRESS freedom is said to be a fundamental human right and one of the foundations of democratic societies. In 2006, then UN Under-SecretaryGeneral for Communications and Public Information Shashi Tharoor lamented, “The number of journalists killed in the line of duty has become a barometer for measuring press freedom.” However, press freedom advocates also note “Wherever there is an independent media, there is bound to be friction with the Government.” (Ann Cooper, Executive Director of the Committee to Protect Journalists [CPJ], May 2006). Not only that, the CPJ noted that 85 percent of the murder of journalists had been committed with impunity. The CPJ said that most attacks on journalists come from “governments, drug lords, criminal mafias, or others with reason to silence critical, independent reporting.” So in the case of the Philippines, the “others” include local warlords and political dynasties who, in reality, are no different from drug lords and criminal mafias because they corner all legal and illegal profitmaking ventures in their respective fiefdoms. The Philippines has earned the infamy of being one of the most dangerous countries for journalists, second only to Iraq, because of the Ampatuan massacre. The CPJ deemed that the “failure of justice” is the most urgent threat facing journalists worldwide. With the developments, or lack of it, in the Ampatuan massacre case, the Philippines appears to be headed toward becoming the face of impunity in the killings of journalists. On the occasion of the World Press Freedom Day commemoration on May 3, 2014, the UN highlighted “the importance of independent, free and pluralistic media to protecting and promoting these rights.” “Only when journalists are at liberty to monitor, investigate and criticize policies and actions can good governance exist.” (Joint Message from Mr. Ban Kimoon, Secretary-General of the United Nations and Ms. Irina Bokova, Director-General of UNESCO, on the
occasion of World Press Freedom Day, 3 May 2014). Aside from the killings of journalists, what other threats to press freedom are there in the world today? How independent are media conglomerates? Has the media been exercising its liberty to monitor, investigate and criticize policies and actions of governments? Consider this: An article published by the Economic Collapse. Who owns the media: The 6 monolithic corporations that control almost everything we watch, hear and read written by Michael Snyder and published in October 4, 2010, revealed that in 1983, around 50 corporations controlled majority of the news media outfits in the US. Now, it is controlled by just six giant corporations that own television networks, cable channels, movie studios, newspapers, magazines, publishing houses, music labels and even many websites. The six giant media corporations are Time Warner, Walt Disney, Viacom, Rupert Murdoch’s News Corp., CBS Corporation and NBC Universal. Outside these six, other media platforms are likewise controlled by a few corporations: “Clear Channel now owns over 1000 radio stations across the United States. Companies like Google, Yahoo and Microsoft are increasingly dominating the Internet.” “In 1983, fifty corporations dominated most of every mass medium and the biggest media merger in history was a $340 million deal. … [I]n 1987, the fifty companies had shrunk to twenty-nine. … [I]n 1990, the twenty-nine had shrunk to twenty-three. … [I]n 1997, the biggest firms numbered ten and involved the $19 billion Disney-ABC deal, at the time the biggest media merger ever. … [In 2000] AOL Time Warner’s $350 billion merged corporation [was] more than 1,000 times larger [than the biggest deal of 1983].” (Ben H. Hypocrisy and big joke! OVERSPENDING --- I am reading in the news that the COMELEC is starting to prosecute election “overspending”. In fact, Gov. ER EJERCITO lost his seat in Laguna recently for exceeding the limits. By all means let’s run after all violators. But the problem is: the limit of P5.00 per registered voter (unless this has been changed) is not only realistic. It is plain and simple hypocrisy! And a big joke, we all know the expense involved in an election campaign. Everyone “doctors” his campaign record expenses just to comply. Those caught are jokingly called “tanga” or the crime as “katangahan”. If we expect, at the very start, our aspiring public officials to be good at “doctoring” records and be dishonest just so they comply with the election law limits, then let's forget about “good governance” when they are in office. About time we change the rules! CANADIAN LAW -- I was glad I was able to catch last Thursday, while on my way to Manila, a bit of the brief talk of a Pinoy- Canadian lawyer, ATTY. BAYANI ABESAMIS during the Canadian Chamber of Commerce regular Davao chapter luncheon meeting at Marco Polo Hotel. He said the "CORRUPTION OF FOREIGN PUBLIC OFFICIALS ACT" was approved in 1999 after Canada adhered to the UN International Anti-corruption Declaration. Ordinarily, persons can be prosecuted only in the countries where the criminal acts are committed. But under the said law, a Canadian citizen can be prosecuted if, for example, he bribes a Filipino public official in the Philippines. As an exception to the "territoriality rule", a Canadian can be prosecuted in a Canadian court back home although he committed the crime in the Philippines. Interesting to know! ENVIRONMENT --- I learned during my recent visit at the coal-fired STEAG POWER PLANT in Misamis Oriental that 75% of the pollution in the Philippines is caused by exhaust and emissions coming from vehicles and smoke. Only 25% is caused by industries, including power plants. I wonder why so-called "guardians" of the environment are only focusing their angst and protests at coal-fired plants and ignoring the bigger culprits. Some nitwit asked: "Why not protest against vehicle owners and drivers and cigarette smokers, too?" Why not, indeed! FEDERAL --I got an invitation from Mayor RODY DUTERTE to be facilitator in a "Federal Summit" in Davao City this week where he is convenor. This is to seek some systemic changes that may hopefully give Mindanao and all the regions, a new governance arrangement that will allow the locals to govern and determine for themselves what is good for them with lesser interference from central government in Manila. Like in the "Bangsamoro" struggle, those who are comfortable with the "status quo" or fearful of the uncertainties ahead will make things difficult. There is always resistance to change! BIRTH PAINS -- That reminds me. I had a chat with Cagayan de Oro Congressman RUFUS RODRIGUEZ, Jr. during the wake of the late SEN. TING PATERNO in Manila. He is marshalling the wide-ranging consultations on the proposed Bangsamoro Basic Law (BBL) that will implement the MILF peace agreement. He said the original timetable of passing it by end of December; this year is NO LONGER POSSIBLE. Moreover, there are constitutional and legal issues that are yet UNRESOLVED. These are the so-called necessary birth pains. I shared to him my thoughts. What is important is that the MILF is engaged closely during the congressional stage so it will understand -- and accept -- whatever is the final version that Congress shall approve. The government and the MILF are already irretrievably stuck with one another. They cannot peel away from an irreversible course. But the road to peace is not that smooth and easy. This reminds me too of another forum in Manila this week about the "Bangsamoro Agreement" under the auspices of the Asian Peace and Unity Corps/ Integrity Circles Movement/ Universal Peace Federation groups. They are composed of regional peace advocates, military and police officers and other peace builders who want to see the peace process succeed. Then the BISHOP ULAMA CONFERENCE of Mindanao will also hold a forum among its bishops and Ulamas about the BBL the following week in Davao City. Everyone wants to nurture the process but it may good to do some reality checks along the way. So we manage expectations! [Atty. Respondent may be served with pleadings, orders, and other processes of this Honorable Court through the Honorary Consul of Mongolia to the Philippines, at 2nd Floor Alencor Bldg., No. 41 Linaw Street Sta. Mesa Heights, Quezon City. III. STATEMENT OF FACTS 5. On 1 September 2012, Petitioner arrived in the Philippines with plans of investing in the economy and contributing to the development of the country. In consort with this goal, Petitioner applied for a Special Investor Resident Visa (“SIRV”) with the Bureau of Immigration, after being qualified as an investor by the National Board of Investments. 6. Sometime in the same month, Petitioner invited the Respondent to come to Manila and bring with the latter their infant daughter Tergelsar. At that time, Respondent had custody of Tergelsar and both were living abroad. 7. On 19 September 2012, Respondent, along with Tergelsar, and Respondent’s mother, Solongo Bukhchuluun (“Solongo”), arrived in Manila. The three of them first stayed at The Exchange Regency Hotel in Pasig City. Petitioner hired a professional nanny to assist Respondent in taking care of Tergelsar. 8. During their first few days in Manila, as Petitioner, Respondent and Tergelsar began to settle in, Petitioner observed that Respondent and Solongo’s belongings consisted primarily of paraphernalia used in, what appeared to be, satanicshamanistic rituals, including but not limited to, demonic cult ritual garb, skulls, dried snakes, other dead and partially-decayed animals, animal and human body parts and bones, grave dirt, candles, whips, ritual daggers, restraining ropes, and pipes for smoking hallucinogenic substances. 9. Upon seeing these paraphernalia, and through the representation of Respondent and Solongo, Petitioner realized that Solongo is a voodoo practitioner, and Respondent is a witchcraft apprentice. Petitioner, while visiting Respondent’s hotel room, observed that Respondent and Solongo would engage in daily voodoo-esque rituals and practices. These acts included satanic worshipping ceremonies, incense burning in the shape of human figurines, consistent intake of alcohol, smoking of unknown substances to facilitate going into a trance, masked dancing, drum beating, dressing and eating snake skins, speaking to animals, filling precious metal cups with blood and vodka, lighting the same on fire and taking turns ingesting the same.

Petitioner likewise observed that these rituals centered around Tergelsar. 10. Later during their stay in Manila, Petitioner noticed that Tergelsar had bruises on some parts of her body. Petitioner likewise learned from the nanny that he hired, that amidst these rituals, Respondent and Solongo would involve Tergelsar by feeding the latter with vodka and other alcoholic drinks, flogging her and dripping candle wax on her. 11. Upon learning of the apparent harm inflicted by Respondent and Solongo on Tergelsar, Petitioner pleaded with the two to stop their rituals and practices, at the very least, on Tergelsar. 12. Petitioner became very concerned about these practices and, having initially thought the events described to be a result of a cultural misunderstanding, he proceeded to acquire the services of a full-time translator from Mongolia and invited everyone to the Shangri-La Resort in Boracay Island, Malay, Aklan, to discuss the aforementioned rituals and to understand the Respondent’s perspective. Petitioner likewise attempted to make steps in order to protect what appeared to him as child abuse. Unfortunately, while Petitioner was partially successful in understanding the ideas behind the ritual, he failed to put an end to the acts of abuse being done by Respondent and Solongo on Tergelsar, which exponentially escalated as the days passed. 13. Eventually, due to the continued ceremonies and complaints from the other guests of the Shangri-La Resort that Respondent and Solongo refused to clothe themselves, Petitioner, along with the people he invited, were asked to leave the resort. 14. Due to the worsening events, Petitioner made one last effort to try to resolve the issue. Petitioner chartered a plane to Amanpulo resort in Palawan, which offered a more secluded setting where special arrangements to accommodate the ritualistic practices were made, with the condition that Tergelsar be supervised by a full time professional nanny and special attention be given to monitor the child’s well-being. 15. Unfortunately even with this level of service, Respondent and Solongo were successful in several other ways to abuse the child including refusing to put sunscreen on Tergelsar while keeping her naked on the beach for hours, which resulted in an extremely severe sunburn and a heat stroke. There was even an instance when Tergelsar was force-fed bird droppings. 16. After returning from Amanpulo, Petitioner, along with Respondent, Tergelsar and Solongo, decided to stay at the Exchange Regency Hotel in Pasig City. There, the abuse kept intensifying. Apart from the already familiar practices of feeding the then five month-old Tergelsar raw meat and alcohol, Respondent and Solongo likewise refused to take the child to the hospital to treat the resulting diarrhea, vomiting, and fever. In addition to the foregoing, other abusive practices were introduced. These included but were not limited to binding Tergelsar with ritual restraint ropes, which preventing normal blood circulation to a degree where Tergelsar’s extremities would turn blue, and gagging the child with a ritual cloth containing hallucinogenic plants and grave dirt. Half-decomposed animals and decaying animal and human body parts were likewise placed on top of Tergelsar while Respondent and Solongo conducted their satanic rituals. The two likewise pulled Tergelsar’s tongue out of her mouth with tongs, and ritual incisions were made on her, in order to extract blood. Such extracted blood was offered to skulls placed on Solongo’s voodoo altar by means of wetting the idol’s lips with the Tergelar’s blood. 17. Petitioner observed that there are other times when blood would be extracted from Tergelsar by pricking her palms and feet. On other occasions blood would be collected for the rituals from wounds on Tergelsar’s lips and mouth resulting from the ritual whipping of the child’s face. 18. Petitioner repeatedly tried to interfere and protect Tergelsar on multiple occasions, however Respondent and Solongo threatened that they would rather kill the child with their ritual daggers than let her live under the influence of forces alien to their accepted hierarchy of demons. This is an allusion to the fact that Petitioner was raised as a practicing Christian. 19. Sometime towards the end of October 2012, Petitioner, Respondent, Tergelsar and Solongo moved into Unit 17B, North Tower, Pacific Towers Condominium in Taguig City. Petitioner hoped that providing such a high standard of living and engaging Respondent and Solongo in various healthy activities such as physical exercise, yoga, swimming, and diving, would distract them from their barbaric practices. Unfortunately, upon their settling at the Taguig condominium, the ongoing child abuse quickly escalated to a very dangerous degree. New rituals involving strangulation with ceremonial skull beads resulted in the near asphyxiation of Tergelsar. Respondent and Solongo, began poking into the Tergelsar’s mouth cavity with ritual daggers resulting in profuse bleeding and untold suffering of the child. For the entire duration of the ceremonies, Respondent kept pouring vodka and other alcoholic drinks into the Tergelsar’s mouth while Solongo was chanting incantations. 20. For the entire duration of the Tergelsar’s stay in the Philippines, Respondent and Solongo refused Tergelsar basic medical care, and denied the necessary hospital visits and vaccinations. Rather than refer Tergelsar to qualified medical specialists, which Petitioner insisted on and was more than willing to provide, Respondent and Solongo would instead perform their sadistic “healing” rituals on her. 21. Due to his ever growing concern for the safety and well-being of Tergelsar, Petitioner talked to Respondent on the possibility of turning over to him the custody and care of Tergelsar. Petitioner requested for the full custody and care over Tergelsar as Respondent had no legitimate source of income
December 1 - 7, 2014 in Mongolia or anywhere else, which would enable her to raise the child. Respondent likewise did not want to reside in the Philippines for the long term. After several discussions with Petitioner, Respondent agreed to waive custody rights over the infant Tergelsar. 22. On the 5 November 2012, in hopes of providing Tergelsar some rest from the continuous abuse, Petitioner brought Respondent and Tergelsar to Arthur’s Place, Anilao, Mabini, Batangas for a vacation. There at a local resort, Respondent again subjected Tergelsar to vodka ingestion. Tergelsar started crying hysterically as apparently, she could no longer take any more alcohol, and because of this Petitioner finally decided to intervene and took the vodka away from Respondent. 23. Respondent resented Petitioner’s act of stopping what she was doing. Respondent became enraged, shouted that Tergelsar must die, and then violently threw Tergelsar to the ground. Tergelsar then lost consciousness for several minutes, had convulsions and seizures, vomited and defecated. Fearing for the Tergelsar’s life, Petitioner immediately picked up the baby from the ground and rushed Tergelsar back to Manila. Upon arriving in Manila more than two and a half hours later, Petitioner brought the baby to Cardinal Santos Medical Center in San Juan City, where at the said hospital, Tergelsar was found to have had alcohol poisoning and severe concussion. 24. Due to these events, Petitioner filed criminal cases against Respondent and Solongo in the Office of the City Prosecutors of Pasig, Taguig and the Office of the Provincial Prosecutor of Batangas. Supported by Petitioner’s own complaint-affidavit , as well as the affidavits of witnesses who personally witnessed abusive conduct committed by the Respondent on Tergelsar, the criminal complaints prospered. All three criminal complaints were found to be credible and with proper basis. In each of the said complaints, probable cause to file a criminal case was found. 25. The Office of the City Prosecutor of Taguig, in a Resolution dated 14 January 2014, found probable cause to charge the Respondent with a violation of Section 10(a) of Republic Act No. No. 7610, otherwise known as the Special Protection of Children Against Abuse, Exploitation and Discrimination Act (R.A. No. 7610) due to cruelty and psychological abuse: “After evaluating the evidence on record, we find probable cause to charge respondents with Violation of Sec. 10(a) of R.A. 7610 committed by inflicting physical harm on the victim by strangulating the child, poking into the child’s mouth cavity with a ritual dagger and pouring alcoholic drinks into the child’s mouth constituting cruelty and psychological abuse.” 26. The Office of the City Prosecutor of Pasig likewise found probable cause to charge Respondent and Solongo with violation of R.A. No. 7610. 27. More notably, the Office of the Provincial Prosecutor of Batangas, in a Resolution dated 21 December 2012, found probable cause to charge Respondent with Frustrated Parricide under Article 246 in relation to Article 6 of the Revised Penal Code due to the act of Respondent in throwing Tergelsar on the floor with intent to kill her: “With respect to Ayatungaa’s act of throwing on the ground her baby, who was merely five months old, out of anger and after shouting that the child must die, the undersigned finds that there was intent to kill on the part of Ayatungaa Todruul. And the fact that the child sustained cerebral concussion shows the gravity of respondent’s acts and the seriousness of injury sustained by the baby. Thus, the undersigned finds that the crime of Frustrated Parricide is applicable in this case.” 28. Informations in relation to the foregoing findings of probable cause against Respondent were accordingly filed before the appropriate courts and corresponding warrants of arrest were subsequently issued. The following criminal cases against the Respondent are now pending before the courts: 28.1. People of the Philippines v. Ayatungaa Todruul and Solongo Bukhchuluun, docketed as Criminal Case No. 150322, for Violation of R.A. No. 7610, pending before the Regional Trial Court of Taguig City, Branch 163; 28.2. People of the Philippines v. Ayatungaa Todruul and Solongo Bukhchuluun, docketed as Criminal Case No. 150026, for Violation of R.A. No. 7610, pending before the Regional Trial Court of Pasig City, Branch 159; and 28.3. People of the Philippines v. Ayatungaa Khiad Todruul, docketed as Criminal Case No. 17882, for Frustrated Parricide under Article _ of the Revised Penal Code, pending before the Regional Trial Court of Batangas City, Branch 1. 29. Considering that all three (3) trial courts issued warrants of arrest against her, the Respondent, along with Solongo, fled the country and supposedly returned to Mongolia. In order to effect their arrest, and owing to the seriousness of the offenses committed by the Respondent, the Interpol, through the recommendation of the Philippine Center for Transnational Crimes, issued a Red Notice against the Respondent in order to seek her location and effect her detention, arrest or restriction of movement for the purpose of extradition, surrender, or similar lawful action. 30. After filing the foregoing criminal cases, Petitioner, the only remaining parent and guardian of Tergelsar, brought the latter out of the country in order to seek proper medical treatment for her. Since the flight of the Respondent out of the country, Petitioner has exercised sole and actual parental authority and custody over Tergelsar, raising her in the safety and protection of his constant supervision, affection and care. 31. Petitioner has now returned to the country, and brought Tergelsar along with him, in order to raise her here in the Philippines, as he continues his plan of investing in Philippine economy. IV. ARGUMENTS IN SUPPORT OF THE PETITION 32. From the clear and undeniable acts of abuse, cruelty and excessive harshness inflicted upon Tergelsar by the
CLASSIFIED ADS Respondent, which acts have become the basis for charging her with serious violations of R.A. No. 7610 and Frustrated Parricide under the Revised Penal Code, the parental authority of the Respondent over Tergelsar must be suspended, if not altogether revoked, pursuant to Article 231 of the Family Code, which reads: Article 231. The court in an action filed for the purpose or in a related case may also suspend parental authority if the parent or the person exercising the same: (1) Treats the child with excessive harshness or cruelty; (2) Gives the child corrupting orders, counsel or example; (3) Compels the child to beg; or (4) Subjects the child or allows him to be subjected to acts of lasciviousness. The grounds enumerated above are deemed to include cases which have resulted from culpable negligence of the parent or the person exercising parental authority. If the degree of seriousness so warrants, or the welfare of the child so demands, the court shall deprive the guilty party of parental authority or adopt such other measures as may be proper under the circumstances. The suspension or deprivation may be revoked and the parental authority revived in a case filed for the purpose or in the same proceeding if the court finds that the cause therefor has ceased and will not be repeated. (332a) 33. As narrated above, Respondent committed acts against Tergelsar that could easily be categorized as excessive harshness or cruelty. At her tender age, Tergelsar was exposed to serious and bizarre forms of physical abuse in the form of forced ingestion of alcohol, wounds caused by knife stabs and cuts, flogging, asphyxiation, and forced feeding of bird droppings. On account of these reprehensible acts, Respondent was charged with several counts of Violation of R.A. No. 7610 or Child Abuse by both the Office of the City Prosecutor of Taguig and Pasig. 34. Throughout all the abusive conduct of Respondent, Tergelsar was denied medical treatment by Respondent despite repeated pleas from the Petitioner to bring Tergelsar to a hospital, which in itself constitutes a clear form of abuse under R.A. No. 7610, to wit: Section 3. Definition of Terms. – xxx (b) “Child abuse” refers to the maltreatment, whether habitual or not, of the child which includes any of the following: xxx (4) Failure to immediately give medical treatment to an injured child resulting in serious impairment of his growth and development or in his permanent incapacity or death. 35. The acts committed by Respondent against the infant Tergelsar culminated in the act of violently throwing Tergelsar on the ground while shouting that “Tergelsar must die.” The convulsions and seizures, as well as the severe concussion suffered by Tergelsar resulting from her being thrown on the floor is clear evidence of the excessive harshness and cruelty inflicted by the Respondent upon her own daughter. The abusive and cruel conduct of the Respondent over Tergelsar was confirmed by the Office of the Provincial Prosecutor of Batangas found which found probable cause to charge Respondent with Frustrated Parricide. 36. Frustrated Parricide under the Revised Penal Code, is merely one step lower than actual Parricide – the capital offense of killing a father, mother, or child, whether legitimate or illegitimate, or any of his ascendants, or descendants, or spouse, and punishable by the penalty of reclusion perpetua to death. By being charged with Parricide in its “frustrated” stage, the Respondent “[performed] all the acts of execution which would produce the felony as a consequence but which, nevertheless, do not produce it by reason of causes independent of the will of the perpetrator.” In other words, had it not been for the swift and effective intervention of the Petitioner in saving the life of Tergelsar by rushing her to a medical facility, Respondent would have killed Tergelsaras, as she, with criminal intent, performed all the acts necessary to commit the crime of Parricide. On this very score alone, Respondent should be stripped of parental authority over Tergelsar. 37. The existence and continued pendency of the criminal cases against the Respondent before three (3) different Courts, the outstanding warrants of arrest issued against her, and the Interpol Red Notice for her arrest, speak volumes on the propriety of suspending Respondent’s parental authority over Tergelsar pursuant to Article 231 of the Family Code. 38. The serious abuse and excessive harshness and cruelty inflicted by the Respondent upon Tergelsar cannot be justified on the ground of tradition or of cultural ritualistic ceremonies of Mongolia, for the following reasons: 38.1. First, it is the declared policy of the State “to provide special protection to children from all forms of abuse, neglect, cruelty exploitation and discrimination and other conditions, prejudicial their development.” R.A. No. 7610 does not provide for any exception to the proscription against child abuse on traditional or cultural grounds. 38.2. Second, the protection of children from abuse is an international policy that is highlighted and embodied in the United Nations Convention on the Rights of the Child, a treaty signed, ratified and accepted by more than one hundred countries – including Mongolia and the Philippines. According to this treaty, “States Parties shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, including sexual abuse, while in the care of parent(s), legal guardian(s) or any other person who has the care of the child.”
PAHAYAGANG BALIKAS 7 38.3. Third, Respondent was charged with Frustrated Parricide for an act that was not, in any way whatsoever, connected with or arising from Respondent’s cultural and traditional background --- i.e., throwing Tergelsar on the floor with intent to kill her. Hence, Respondent cannot hide under the notion that the acts done on Tergelsar is part of the cultural or traditional practices of Respondent to justify the same. 39. The fact that Tergelsar is only two (2) years old does not preclude the suspension of Respondent’s parental authority. According to the Supreme Court in Perez v. Court of Appeals : “The general rule that a child under seven years of age shall not be separated from his mother finds its raison d’etre in the basic need of a child for his mother's loving care. Only the most compelling of reasons shall justify the court's awarding the custody of such a child to someone other than his mother, such as her unfitness to exercise sole parental authority. In the past the following grounds have been considered ample justification to deprive a mother of custody and parental authority: neglect, abandonment, unemployment and immorality, habitual drunkenness, drug addiction, maltreatment of the child, insanity and being sick with a communicable disease.” 40. Under the aforequoted jurisprudence, maltreatment of a child is cause for a parent to lose parental authority even if the child is less than seven (7) years old. Calling what the Respondent did to Tergelsar as “maltreatment of a child” is understating what Tergelsar went through in the hands of Respondent. There is therefore much more compelling reason why this Honorable Court should suspend the parental authority of Respondent. 41. Furthermore, Respondent’s flight to Mongolia is a strong indication of her guilt of the crimes charged against her. Indeed, it is “well-established that the flight of an accused is competent evidence to indicate [her] guilt; and flight, when unexplained, is a circumstance from which an inference of guilt may be drawn.” Thus, there is more than sufficient basis, in fact and in law, to suspend, if not altogether remove, the parental authority of Respondent over Tergelsar. 42. To date, Respondent has been absent from the Philippines, and in all likelihood, will not be returning in the country due to the outstanding warrants of arrest and the criminal cases that she will be facing should she choose to enter this jurisdiction. Since the Respondent’s flight to Mongolia, Petitioner has provided, and continues to safeguard, Tergelsar’s well-being, security and overall development.Accordingly, Petitioner, who is gainfully employed, is the only remaining parent and guardian of Tergelsar present in the country whocan and will guarantee that her best interests are protected. 43. In this regard, due to violent acts committed by Respondent against Tergelsar, Respondent’s parental authority over Tergelsar must be suspended. Likewise, by automatic operation of law and since this Honorable Court must recognize that Tergelsar is most safe and most cared for in the custody of the Petitioner, Petitioner must be granted custody of Tergelsar. 44. Moreover, granting custody over Tergelsar in favor of the Petitioner will operate to serve her best interests. Petitioner intends to raise Tergelsar in the Philippines and will, thus, require an official pronouncement over his parental authority and custodial rights over Tergelsar to efficiently and expediently discharge his duties as parent, including, but not limited to, securing Tergelsar’s health insurance and enrolling her in educational institutions. 45. As a final note, it must be recalled that is a declared policy under Republic Act No. 7610, otherwise known as the “Special Protection of Children Against Abuse, Exploitation and Discrimination Act,” that the “State shall intervene on behalf of the child when the parent, guardian, teacher or person having care or custody of the child fails or is unable to protect the child against abuse, exploitation and discrimination or when such acts against the child are committed by the said parent, guardian, teacher or person having care and custody of the same.” Petitioner believes that this Honorable Court can and should uphold such policy. PRAYER WHEREFORE, Petitioner Charles Edwards respectfully prays that case this Honorable Court: 1) SUSPEND the PARENTAL AUTHORITY of Respondent Ayatungaa Todruul over the minor Tergelsar Charles Edward Krasny Ergen; and 2) GRANT Petitioner Charles Edwards PERMANENT CUSTODY over his minor daughter Tergelsar Charles Edward Krasny Ergen. the primary purpose of their existence is to make money.” “These gigantic media corporations are not going to do anything to threaten their relationships with their biggest advertisers (such as the largest pharmaceutical companies that literally spend billions on advertising), and one way or another these gigantic media corporations are always going to express the ideological viewpoints of their owners.” (Michael Snyder, Who owns the media: The 6 monolithic corporations that control almost everything we watch, hear and read). The same is true in the Philippines. The Lopez group owns the ABS-CBN conglomerate. The Manny Pangilinan PLDT group owns Business World Publishing Corp., Associated Broadcasting Company (TV5), Nation Broadcasting Corporation (NBC), Cignal Digital TV (Cignal), and the Unitel Group. The group recently acquired majority stake in The Philippine Star. Felipe Gozon, Gilberto Duavit, and Menardo Jimenez own the GMA 7 conglomerate and recently, Ramon Ang of San Miguel Corporation bought a 30% stake in the media conglomerate. The president and CEO of the Philippine Daily Inquirer Sandy Priteo-Romualdez is married to Benjamin Philip Romualdez, president and
CEO of Benguet Corporation and the president of the Chamber of Mines of the Philippines. Like their US counterparts, these media conglomerates would not go against the business interests of its owners nor its biggest advertisers. One of the biggest advertisers is the government, including government owned and controlled corporations (GOCCs). Other big advertisers are multinational corporations and their local partners, local and foreign businesses. Thus, combined with the killings of journalists, the lack of access to government records, and the self-censorship of media conglomerates, could we say that there is genuine press freedom in the world and in the country today? Michael Snyder also wrote: “That is one reason why we have seen the alternative media experience such rapid growth over the past few years. The mainstream media has been losing credibility at a staggering rate, and Americans are starting to look elsewhere for the truth about what is really going on.” In the Philippines, alternative media groups gathered together last October 9-10 and formed the first ever nationwide network of alternative media groups in the country, Altermidya or the People’s Alternative Media Network.|

When the East meets West: A Meeting Among Brothers in 'Faith, Charity and Hope' ISTANBUL -- The relationship between the Bishop of Rome, Successor to St. Peter, and the Ecumenical Patriarch of Constantinople, successor to St. Andrew, has been a fraternal relationship for the past 50 years. In the Gospel of St. Matthew, it was Peter and Andrew who were the first disciples called by Jesus to become “fishers of men.” Excommunications leveled after the Great Schism of 1054 were nullified when Blessed Paul VI and Ecumenical Patriarch Athenagoras I met in Jerusalem. While not uniting the Churches, it displayed a great desire for reconciliation between them. Since then, it has been the tradition for a delegation from each Church to celebrate the patronal feast of the other’s Church: Sts. Peter and Paul on June 29th and St. Andrew on November 30th. On the eve of the feast of St. Andrew, Pope Francis and Ecumenical Patriarch Bartholomew I joined together for an Ecumenical Prayer service at the Patriarchal Church of St. George in Phanar, Turkey. While the reverent, prayerful sounds of the Greek Orthodox prayers echoed in the Church, both the Pope and the Patriarch sat side by side, their heads bowed reverently. Addressing Pope Francis, Bartholomew I welcomed him with “joy, honor and gratitude,” saying that his visit symbolically bridges “West and East through this movement, while translating the love of the Chief Apostle to his brother, the First-Called Apostle.” The Ecumenical Patriarch also noted that the Holy Father’s visit is a witness of the will of the Church of Rome for the restoration of full communion with the Orthodox Church. The relics of St. Gregory the Theologian and St. John Chrysostom, which lie in the Patriarchal Church, are a very sign of the desire for communion and

Following a request by the Patriarch, St. John Paul II returned the relics of the two beloved Saints to the Ecumenical Patriarchate on November 27th, 2004. They were previously housed in St. Peter’s Basilica after they were stolen from Constantinople by mercenary crusaders in 1204. It was a gesture that was not forgotten by the Ecumenical Patriarch. “This year marks the tenth anniversary since the blessed return of the relics of St. Gregory and St. John,” Patriarch Bartholomew said. ”We express to Your Holiness our fervent thanks for this fraternal gesture on behalf of Your Church to our Patriarchate.” A Brother’s Blessing For his part, Pope Francis also expressed his gratitude for being present at the prayer service, saying that his “heart awaits the day which we have already begun liturgically: the Feast of the Apostle Saint Andrew, Patron of this Church.” “Yes, my venerable and dear Brother Bartholomew, as I express my heartfelt ‘thank you’ for your fraternal welcome, I sense that our joy is greater because its source is from beyond; it is not in us, not in our commitment, not in our
efforts – that are certainly necessary – but in our shared trust in God’s faithfulness which lays the foundation for the reconstruction of his temple that is the Church.” Reflecting on the calling of Peter and Andrew, the Pope said that their encounter with Christ transformed them from blood brothers to brothers in faith, charity and especially, hope. “What a grace, and what a responsibility, to walk together in this hope, sustained by the intercession of the holy Apostles and brothers, Andrew and Peter!” he exclaimed. After extending his best wishes, the Pope asked a favor from the Ecumenical Patriarch rarely seen. “I ask of you a favor: to bless me and the Church of Rome.” Pope Francis approached Bartholomew I, who was visibly moved by the gesture. The Patriarch blessed the Pontiff, kissed his forehead and embraced him. As they exited the prayer service and removed their respective stoles, Patriarch Bartholomew reached over to fix the Holy Father’s pectoral cross as he took his stole off. Worth mentioning are the the pointers given by the resource persons during the critiquing of our outputs. JUST in time for the first anniversary super typhoon Yolanda, SM Foundation through the SM Cares Housing Program gave hope to typhoon victims by turning over 200 homes at the SM Cares Village in Brgy. Polambato, Bogo City in northern Cebu. The 200 houses is the first of the 1,000 disaster resilient homes that will be given for free to chosen beneficiary survivors of super typhoon Yolanda. Another 200 homes will be built in Çoncepcion, Iloilo, as well as 400 in New Kawayan, Tacloban City. SM Foundation is also set to break ground for another SM Cares Village with 200 houses in Ormoc City. Presidential Assistant for Rehabilitation and Recovery (PARR)’s Secretary Panfilo Lacson, United Nations Chief of International Strategy for Disaster Reduction Asia and Pacific Margareta Whalstrom, Cebu Governor Hilario Davide III, and Bogo Mayor Celestino Martinez, Jr. led the ribbon cutting ceremony and unveiling of the donor’s wall and village marker together with SM Prime Holdings President Hans T. Sy and SM Foundation Executive Director Debbie Sy, and members of the Fernan family who donated the lot. Ramon Aboitiz Foundation Trustee Fr. Ernesto Javier led the blessing of the houses. Keys and certificates were then distributed to the families to officially identify them as beneficiaries of the program.
“These houses send the message that indeed, there is light at the end of the tunnel,” said Mayor Celestino Martinez. “These homes provide a start for these families- a new beginning.” He also thanked the Sy family, the Fernan family who donated the land, and “all those who worked hard to make this dream come true for the beneficiaries of the project.” Governor Davide thanked the SM Group for partnering with the local government unit in giving not just houses, but a village to the community. “Now I can say that Bogo City has risen. Life goes on and we are determined to bring the northern part of Cebu to full recovery.” Secretary Panfilo Lacson, on the other hand, was happy to note that, “SM followed the standards with the structure of these houses, and we are classifying these housing units as permanent shelters because they followed the 250 km per hour wind resistance. Each of the 20 x 23 square meter houses is designed to exceed the requirements of the Building Code and mandated standards, each house can withstand the winds and strength of a Category 5 super typhoon without any major material damages. The village has utilities, basic amenities like streetlights, community center and basketball court. In addition to its disaster resiliency features, the houses will also have heat resistant painted roofing to help lower interior temperature and increase energy efficiency. The turnover ceremonies brought a lot of joy to the beneficiaries. Ernesto Orque, who works in a fishpond, luckily saved all his ten children but lost his wife during the typhoon. They lost their home, too and for a year lived with friends and neighbors. Ernesto thanked SM for “providing my family a new shelter and a new hope to pick up the missing pieces of our lives Eufrecina Tepait and her family lived in a shanty and lost hope after the typhoon badly damaged their house. After we learned that we are one of the beneficiaries of the housing project, our hearts leaped with joy,” said Eufrecina. After the program, donors were able to meet with the different beneficiaries who were all survivors of the super typhoon. Families thanked the donors for the early Christmas gift they received. Among the very generous donors present were Ramon Aboitiz Foundation President Robert Aboitiz, Rotary International Past District Governor Ed Chiongbian, and Bernie and Alice Liu of Golden ABC. Also present were FCB Manila’s Nikki Diyco, Jun Young Bang and Tony Park of Tony and Jackey Beauty Salon; as well as executives from the SM Store, Watsons, SM Appliance Center.
