PORT OF PENSACOLA RECEIVES FUNDING TO BE HOST PORT TO AMERICAN

The Port of Pensacola has secured a total of $12.4 million in grant funding to complete renovations to Warehouse 10, which will allow American Magic to permanently relocate their headquarters to the Port of Pensacola.

American Magic is the American entry in the 37th Cup in Barcelona which is a prestigious international sailing competition.

Of the $12.4 million secured, $8.5 million is being provided by Triumph Gulf Coast, and $3.9 million is being provided by Governor Ron DeSantis’ Florida Job Growth Grant Fund. The funding will cover the design, renovation, and completion of Warehouse 10. As part of the renovations, a 50-foot addition will be made, and a dock and boat ramp will be designed and constructed.

“Once completed, the facility on the Port of Pensacola will allow American Magic to permanently relocate their training and boat building facility creating 170 high wage jobs in advanced manufacturing, engineering and research and development for marine and other technology sectors,” Pensacola Port Director, Clark Merritt said.

American Magic has used the Port of Pensacola on a temporary, seasonal basis since 2018, most recently training on Pensacola Bay in preparation for the 37th America’s Cup in Barcelona.

American Magic is developing a pathway for a generation of engineers, boatbuilders and technicians to enhance the marine industry in the United States and set Pensacola on a trajectory of being a leader on the world stage.

“This award to the City of Pensacola will strengthen the Port of Pensacola’s

infrastructure and promote economic opportunities in the sailing industry for the Florida Panhandle,” Gov. Ron DeSantis said in a news release. “We believe in making strategic investments that will create job opportunities and ensure Florida’s prosperity for generations to come.”

The grant-funded project will be constructed on publicly owned land, with the City of Pensacola retaining ownership of the land, facility, and associated infrastructure. American Magic, along with the other tenants of the Port of Pensacola, will have the privilege of utilizing the warehouse facility, with the dock and boat ramp made accessible.

“Today is a huge step in making Pensacola, Florida the sailing capital of the United States,” Pensacola Mayor D.C. Reeves said. “The support from the Triumph board and American Magic Sailing is monumental for the city, The Port of Pensacola and the entire region. We appreciate the board seeing this project the way our administration has: The American Magic team calling Pensacola its permanent home will be transformational for this community.”

The design and construction of this project is anticipated to take 24 months. Job creation is expected to begin immediately, with a total rampup period of 24 months from construction completion.

This project aligns with the publicly approved Portside Vision Plan, and it firmly establishes the Port of Pensacola and the state of Florida as the premier location for cutting-edge watercraft and boatbuilding innovation on a global scale.

Lakeview Center welcomes Roxanna Conyers to its team as the new Director of Nursing. Roxanna will report to Dr. Guido Ludergnani, M.D., who serves as Chief of Medical Services for the organization.

Roxanna will play a key role in recruitment, development and retention to position nursing staff as leaders in the field. She will lead, solidify and implement best nursing practices and work on innovative ways to assist clients with physical and behavioral health needs. She will oversee the compliance of state, federal and community rules and regulations and serve as an advocate for clients and nursing staff. Roxanne will develop any corrective action needs such as medication errors, medically complex care, COVID and other infectious disease adherence in partnership with the LifeView Group infection control nurse.

Most recently, Roxanna served as an assistant director of nursing to assist leaders in developing, promoting and fostering quality nursing practices. She performed in a variety of capacities to include pharmacy,

inventory management, rehabilitation practices and as a liaison to the clinical team, executive leaders and patients. In addition, Roxanna has experience supervising nursing unit operations for large staff levels.

Roxanna earned a Master of Science in Nursing Administration and Organizational Leadership from University of South Carolina. She is an Adult and Youth Mental Health

The FloridaWest Board of Directors is pleased to announce they have selected a new CEO to head the economic development agency. Seasoned economic development leader Brian Hilson is coming from Alabama where he has more than 40 years of experience leading programs that address all phases of community-based economic growth. His efforts in Alabama resulted in more than 100,000 new jobs and more than $3 billion in investment.

Hilson served as President & CEO of the Chamber of Commerce of Huntsville/ Madison County, President & CEO of the Birmingham Business Alliance, and Executive Director of the Japan-America Society of Alabama, in addition to other roles.

FloridaWest Board Chair Rick Byars said Hilson’s deep experience and successes in economic development initiatives made him a unanimous board choice for the position.

Other big wins for Hilson include attracting 4,700 jobs in a U.S Army Base Realignment & Closure project, the Hudson-Alpha Institute for Biotechnology with 1,000 jobs and $120 million in investment, a Raytheon project that brought 300 jobs and a $75 million investment and a new Amazon facility that resulted in 1,500 jobs and $180 million in investment.

Hilson said when he was first contacted about the position, he was already aware of Pensacola’s strong reputation in economic development, and he learned quickly about the local leadership’s commitment to continuing economic growth.

“Pensacola and Escambia County have an impressive track record in recruiting and developing businesses,” said Hilson. “The community has much to offer growing businesses as well as people who want to live and work here. We have excellent leadership already in place, not only at the EDA but throughout the community and Gulf Coast region, and my hope is that we will work closely together to bring more economic prosperity to the region resulting in better opportunities and an improved quality of life for all citizens.”

Children must be at least 10 years of age to ride their own bicycle, and ages 10 - 16 must be accompanied by an adult. No pets are allowed on the Rides. SLOWING DEER DISEASE ‘BEST THAT WE CAN HOPE FOR’

TALLAHASSEE — Environmentalists and animal-rights advocates want state wildlife officials to put more restrictions on deer farming and hunting as Florida responds to the long-expected arrival of a contagious disease fatal to deer.

The Florida Fish and Wildlife Conservation Commission imposed a management zone covering parts of Holmes, Jackson and Washington counties after the detection last month of chronic wasting disease in a “roadkilled” deer in Holmes County.

The positive test was the first known case of a deer in Florida having the disease, which has been found in 30 other states including Alabama and Mississippi. The disease is described as similar to mad cow disease, with deer becoming emaciated and often being found isolated and trembling. While not considered harmful to people, the disease can result in death within four months to deer.

During a Fish and Wildlife Conservation Commission meeting Wednesday in St. Petersburg, environmentalists praised the quick actions to set up the management zone but said more needs to be done to limit the spread of the disease.

“I think this is the time to act, when there’s just one deer that’s been identified with CWD (chronic wasting disease),” said Chuck O’Neal of the group Speak Up Wekiva.

O’Neal suggested reassigning commission officers from immigration-enforcement efforts to focus on illegal importation of deer. He also suggested prohibiting game farms from offering deer for hunting.

“The concentration of cervids in these areas, it’s a large problem in other parts of the country,” O’Neal said. “When you put them together and they’re concentrated, the CWD spreads at an alarming rate.”

Kate MacFall, representing the Humane Society, urged “double fencing” of the game facilities, acknowledging that phasing out such operations is “not probably likely.”

Still, MacFall was critical of game farms as being “breeding grounds for disease.”

“Packing animals in unnaturally high densities, transporting them between ranches, increases the potential to bring the disease to new areas,” MacFall said.

APPEALS COURT REJECTS PARKING RESTRICTION

Wading into a neighborhood dispute, a state appeals court Wednesday rejected an on-street parking restriction because a developer decades ago turned over streets to the city of Tallahassee. A three-judge panel of the 1st District Court of Appeal overturned a Leon County circuit judge’s ruling that involved the Kenmare Commons neighborhood in Tallahassee. The Kenmare Commons Homes Association and some residents alleged in the lawsuit that Edward and Linda Huck violated covenants and restrictions because a caregiver for Edward Huck parked on the street in front of the Huck house, according to Wednesday’s ruling. The neighborhood’s developer, Killearn Properties, Inc., recorded the covenants and restrictions in 1991. But the developer also deeded the roads to the city of Tallahassee. “Coming from the developer at the beginning

DEATH ROW INMATE APPEAL DENIED IN 1994 MURDER

A federal appeals court this week denied an appeal by a Death Row inmate convicted in the 1994 murder and rape of a woman kidnapped from a Lake City supermarket parking lot. A three-judge panel of the 11th U.S. Circuit Court of Appeals on Tuesday rejected arguments raised by inmate Anthony Wainwright, including that new evidence could show he was innocent in the murder of 23-year-old Carmen Gayheart. Wainwright and Richard Hamilton were accused of kidnapping Gayheart from a Winn-Dixie parking lot after escaping from a North Carolina prison, according to a 1997 Florida

With no simple treatment or vaccine for chronic wasting disease, deer farmers have expressed concern that a single positive test could require the eradication of entire herds, which in some cases represent millions of dollars in investments.

Newton Cook, who serves on the commission’s Deer Management Technical Advisory Group, encouraged deer farmers and hunters to “trust the staff” on the science to slow chronic wasting disease, which “my grandchildren will be living with.”

“They (staff members) have a lot of experience. They see what’s happening across the country,” Cook said. “They have to do what they have to do in order to at least slow the spread of the disease in Florida. And that’s about the best that we can hope for.”

The commission is reaching out to hunters in Northwest Florida to quickly collect samples from deer to determine the prevalence of the disease.

“Our hopes are that that’s maintained to the Panhandle area of the state and that we can slow that spread effectively,” commission Hunting and Game Management Director George Warthen said. “And we’ve seen other states be able to manage this.”

Commission Chairman Rodney Barreto told Warthen to “stay the course.”

Florida has monitored the issue since 2002, testing about 17,500 hunter-killed, road-killed and sick deer. Since 2017, the state has bought equipment needed to address an outbreak.

In 2021, the state placed certain limits on importing deer carcasses into Florida. As examples, people can bring in deboned meat, finished taxidermy mounts and clean hides and antlers.

Exceptions are made for deer harvested from properties in Georgia or Alabama that are bisected by the Florida border and are under the same ownership.

Indeed, the roads now belong to the taxpayers. If KCHA or individual association members do not like how the neighborhood roads are being maintained or policed, they have a remedy, but it does not lie in the courts. Rather, they can contact the city.”

CHINESE LAND OWNERSHIP LAW DEBATED

TALLAHASSEE — A federal judge listened to more than two hours of arguments Tuesday about whether he should block a new Florida law that restricts people from China from owning property in the state.

U.S. District Judge Allen Winsor asked numerous questions of attorneys for the state and plaintiffs seeking a preliminary injunction against the law. He said he would make a decision as soon as he can but that a ruling would not be “super imminent.”

Four Chinese people and a real-estate brokerage that serves Chinese clients filed a lawsuit and sought an injunction after Gov. Ron DeSantis signed the law (SB 264) in May. The lawsuit, which has been backed by the U.S. Department of Justice, contends that the restrictions violate constitutional rights and the federal Fair Housing Act and are trumped by federal law.

DeSantis and Republican legislative allies this spring pointed to a need to curb the influence of the Chinese government and Chinese Communist Party in Florida. But Ashley Gorski, an American Civil Liberties Union attorney representing the plaintiffs, told Winsor the state has relied on “pernicious stereotypes” to conflate people from China with the Chinese government.

“There are always all of these stereotypes and really tired tropes that governments have used, perpetuating Asians as foreigners and enemies of the state,” Bethany Li, an attorney with the Asian American Legal Defense and Education Fund who also represents the plaintiffs, told reporters before the hearing.

State Solicitor General Henry Whitaker said during the hearing that the law is designed to protect the security of Florida.

“The state is concerned with the influence of the Chinese Communist Party and their agents in Florida,” Whitaker said.

As an indication of the interest in the case, an unusually large crowd packed a courtroom in the federal courthouse in Tallahassee. Before the hearing, dozens of opponents of the law gathered outside the building.

The law affects people from what Florida calls “foreign countries of concern” — China, Russia, Iran, North Korea, Cuba, Venezuela and Syria, with part of it specifically focused

on Chinese people who are not U.S. citizens or permanent U.S. residents.

The legal challenge centers on such Chinese people. Under the law, they would be prevented from purchasing property in Florida, with some exceptions. For example, they each would be allowed to purchase one residential property up to two acres if the property is not within five miles of a military base and they have non-tourist visas.

Plaintiffs are in the United States on such things as work and student visas. One is seeking asylum, according to the lawsuit, which was filed May 22 and revised June 5.

The law also would prevent people from the seven “foreign countries of concern” from buying agricultural land and property near military bases. Those parts of the law would apply to people who are not U.S. citizens or permanent U.S. residents.

Winsor and the attorneys engaged in back-and-forth discussions about a series of issues Tuesday, including whether the law violates constitutional equal-protection rights, the Fair Housing Act and whether it is “preempted” by federal law.

Part of the preemption issue stems from a federal law that created what is known as the Committee on Foreign Investment in the United States, or CFIUS, which has power to review real-estate transactions involving certain people from other countries.

Gorski argued that the Florida law deals with the “intersection” of national security, foreign affairs and foreign investment — and is preempted by federal law.

But Whitaker said there has been no indication that the Florida law would undermine the federal government’s ability to scrutinize property sales.

The Department of Justice last month filed a 22-page “statement of interest” supporting the lawsuit and preliminaryinjunction request, arguing the law violates the Fair Housing Act and the Equal Protection Clause.

Meanwhile, attorneys general from Idaho, Arkansas, Georgia, Indiana, Mississippi, Missouri, Montana, New Hampshire, North Dakota, South Carolina, South Dakota and Utah filed a friend-of-the-court brief last week opposing the plaintiffs’ request for a preliminary injunction.

STATE APPEALS RULING ON KIDS IN NURSING HOMES

TALLAHASSEE — The state quickly launched an appeal after a federal judge ruled Friday that Florida has violated the Americans with Disabilities Act and needs to make changes to keep children with “complex” medical conditions out of nursing homes.

Attorneys for the state filed a notice Monday that is a first step in challenging U.S. District Judge Donald Middlebrooks’ ruling at the 11th U.S. Circuit Court of Appeals.

As is common, the notice does not detail arguments the state will make at the Atlantabased appeals court. But the state Agency for Health Care Administration issued a statement Monday that criticized Middlebrooks’ ruling and said Florida would seek a stay and appeal.

nursing homes in Broward and Pinellas counties. It also said more than 1,800 children are considered at risk of being institutionalized.

Middlebrooks wrote that the Americans with Disabilities Act requires the state to provide services in the most “integrated setting appropriate” to meet the needs of people with disabilities. He also cited a major 1999 U.S. Supreme Court ruling that said “undue institutionalization” of people with disabilities is a form of discrimination.

But the statement Monday from the Agency for Health Care Administration disputed Middlebrooks’ conclusions.

“During the trial, witnesses testified that their medically complex children were in nursing homes for various reasons unrelated to the state or its policies,” the statement said.

Supreme Court opinion that detailed the case. Wainwright and Hamilton were accused of raping and murdering Gayheart, whose body was found in Hamilton County. Wainwright, now 52, was convicted in 1995 and sentenced to death. In the appeal, Wainwright, in part, offered a report from a DNA analyst that criticized the findings of two state DNA experts who testified at Wainwright’s trial, according to Tuesday’s opinion. But in upholding a ruling by a federal district judge, the appeals-court panel said the new evidence “is insufficient when considered together with the other evidence presented” at his trial. “Reasonable jurors, considering the new evidence along with the evidence available at trial, would still find Mr. Wainwright guilty beyond a reasonable doubt,” said the 17-page opinion by Judges Adalberto Jordan, Britt Grant and Andrew Brasher.

“The judge’s failure to understand the law is demonstrable in his order,” said the statement from the agency, which runs most of the Medicaid program. “The court’s conclusion that the state’s actions or omissions force children to live in nursing homes against their parent’s wishes is unsupported and refuted by the evidence presented at trial.”

Middlebrooks’ ruling and an accompanying injunction came in a decade-long legal battle in which the U.S. Department of Justice alleged the state unnecessarily institutionalized children in nursing homes. The South Florida-based judge ordered the state to make changes aimed at providing care to children in their family homes and communities.

“Unjustified institutionalization of individuals with disabilities is unacceptable, especially given the advances in technology and in the provision of home-based care,” Middlebrooks wrote in a 79-page decision.

“Any family who wants to care for their child at home should be able to do so.”

The case focuses on children in the Medicaid program with conditions that often require round-the-clock care involving such needs as ventilators, feeding tubes and breathing tubes. The ruling said about 140 children in the Medicaid program are in three

The Justice Department filed the lawsuit in 2013, after conducting an investigation that concluded the state Medicaid program was unnecessarily placing children in nursing homes. The state has vehemently fought the allegations and the lawsuit, with the U.S. Supreme Court last year declining to take up a state appeal aimed at preventing the case from moving forward.

A key part of Middlebrooks’ ruling was that the Medicaid program and contracted managed-care organizations were not providing adequate private-duty nursing that could enable children to receive care in their family homes or communities.

Middlebrooks ordered that the Medicaid program provide 90 percent of the privateduty nursing hours that are authorized for the children. He also ordered the state to improve what are known as “care coordination” services and to take steps to improve the transition of children from nursing homes.
