9TH ANNUAL DRAGON BOAT FESTIVAL RETURNS TO PENSACOLA

The Northeast Pensacola Sertoma Club, Inc.

(SERTOMA) presents the ninth annual Pensacola Dragon Boat festival. On September 30, thousands of spectators will gather around Bayou Texar, just off Bayview Park near downtown Pensacola (2000 E Lloyd St.), to support up to 40 teams who will be racing for bragging rights and a specialized trophy in this locally renowned event.

Dragon boating originated in Hong Kong in 1976, but its historical roots can be traced back to more than 2,000 years ago in China. Today, there are more than 50 million people worldwide participating in dragon boating each year. Teams and competitions are currently found in over 57 nations.

During races, dragon boaters typically paddle a long, narrow canoe that seats 20 paddlers in 10 rows in sync along a 250 meter to 500 meter racecourse toward the finish line. A steerperson standing in the stern uses a 9-foot oar as a rudder and a drummer sits at the bow of the boat by the dragon’s head, facing the rest of the crew.

SERTOMA, the organizer of the Dragon Boat Festival, was founded in 1988 for the purpose of contributing to the Pensacola Community by raising money and supporting many community charities. This year, the Dragon Boat festival supports its charity partners in the Pensacola community: Gulf Coast Kid’s House, Pensacola Habitat for Humanity and Escambia County Public Schools Foundation. Event organizers note that you can invest in charities that serve the Pensacola community by becoming a sponsor and/or registering a team and joining in team fundraising. SERTOMA is preparing for a full day of racing, food and festivities. This all-day festival is complete with food trucks, local artists, children’s activities, contests, music and more. SERTOMA itself will have beer, water and Dragon Juice for sale. The day will begin with the Young Marines of Pensacola’s opening ceremony at 8 am and the first race of the day commencing at 9 am. Each team will race in three heats. This festival’s course is 300 meters in a straight line. The championship race will be held approximately at 4 pm. Finally, an

awards ceremony will immediately follow the championship race.

The Dragon Boat race serves as a great team building experience for companies, organizations, krewes, non-profits, municipalities, local businesses, civic organizations, rowing clubs and so many more. Dragon Boat racing encourages people to be inclusive, collaborative, organized, communicative, synchronized, productive and committed—all these skills also help people work better as a team in the business world. Taking part in a dragon boating session can build teamwork and a sense of camaraderie. Paddling together can be the great equalizer that bridges the gaps between staff and managers, as well as different departments of an organization.

According to the event organizers, whether you compete with a group or sponsor another team, everyone is sure to leave with memories, a closer group of friends, sore arms and the fact that all the fun is going to support the local charities of Pensacola.

Event organizers suggest carpooling when possible as parking will be limited at the festival grounds. Bleachers will be set up for spectators to get the best view of the race from start to finish. Admission to this festival is free to the public, but opportunities to make donations will be available throughout the day. FEMA: EMERGENCY ALERT TEST SCHEDULED OCT. 4

The Federal Emergency Management Agency, in coordination with the Federal Communications Commission, will conduct a nationwide test of the Emergency Alert System and the Wireless Emergency Alerts notification system on Wednesday, Oct. 4. The national test will consist of two portions, testing WEA and EAS capabilities. Both tests are scheduled to begin at approximately 1:20 p.m. on Wednesday, Oct. 4.

The WEA portion of the test will be directed to all consumer cell phones. The test message will display in either English or Spanish, depending on the language settings of the wireless handset. The EAS portion of the test will be sent to radios and televisions.

The purpose of the Oct. 4 test is to ensure that the systems continue to be effective means of warning the public about emergencies, particularly those on the national level. In case the Oct. 4 test is postponed due to widespread severe weather or other significant events, the backup testing date is Oct. 11.

“This action is being undertaken by the Federal Government and is not an action being taken by Escambia County,” said Emergency Manager Travis Tompkins. “However, this is a very needed test of the Federal Emergency Alert Systems. This system is utilized by the President of the United States to send a communication to the entire population, if necessary.”

All wireless phones should receive the message only once. The following can be

expected from the nationwide WEA test:

Beginning at approximately 1:20 p.m., cell towers will broadcast the test for approximately 30 minutes. During this time, WEA-compatible wireless phones that are switched on, within range of an active cell tower, and whose wireless provider participates in WEA, should be capable of receiving the test message.

For consumers, the message that appears on their phones will read: “THIS IS A TEST of the National Wireless Emergency Alert System. No action is needed.”

Phones with the main menu set to Spanish will display: “ESTA ES UNA PRUEBA del Sistema Nacional de Alerta de Emergencia. No se necesita acción.”

Important information about the EAS test: The EAS portion of the test is scheduled to last approximately one minute and will be conducted with the participation of radio and television broadcasters, cable systems, satellite radio and television providers and wireline video providers.

The test message will be similar to the regular monthly EAS test messages with which the public is familiar. It will state: “This is a nationwide test of the Emergency Alert System, issued by the Federal Emergency Management Agency, covering the United States from 1:20 to 1:50 hours central time. This is only a test. No action is required by the public.”

ZARZAUR LAW CONFIRMS SETTLEMENT FOR WRONGFUL DEATH CASE AGAINST BAPTIST

Following a nine-day jury trial held in Escambia County Circuit Court before Judge J.J. Frydrychowicz, Baptist Health Care and Tony Yates, as personal representative for the estate of Diane Yates, reached a settlement. The settlement terms are confidential, and the agreement was reached just hours prior to closing arguments. The settlement was not intended to imply fault for either party, as they reached a mutually satisfactory resolution just prior to the conclusion of the trial.

The plaintiff was represented by Attorney Joe Zarzaur of Zarzaur Law, P.A., along with Attorney Brent Bradley. Baptist Health Care was represented by Attorneys Tom Gonzalez and Jena Wise of the Beggs & Lane law firm.

The case arose out of the postoperative care Diane Yates received from nurse Michelle Morrison. The plaintiff alleged that Nurse Morrison negligently administered two incompatible medications, which caused a fatal reaction. Baptist denied the

allegations and contended that the nurse did not administer the medications together and that Mrs. Yates died from complications from the surgery for which she was in the hospital.

Merit System Protection Board (MSPB)

This board was established by the Board of County Commissioners through adoption of Escambia County Ordinance No. 2005-38, enacted on August 18, 2005. Upon the legislative sunset of the Escambia County Civil Service Board, effective October 1, 2005, the MSPB was created to provide a fair and equitable mechanism for the expeditious review of appeals and grievances of the classified employees of the county before a non-partisan deliberative body. County Ordinance 2005-38 provides the means for a classified, permanent employee under the jurisdiction of the MSPB to appeal disciplinary actions, and that these employees may file an appeal or grievance for perceived violations of the ordinance or the rules. Presently, the classified employees under the jurisdiction of the Board of County Commissioners, the Sheriff’s Office, the Supervisor of Elections and the Santa Rosa Island Authority are covered under the MSPB.

The MSPB is composed of five volunteer members, each selected by the Board of County Commissioners. Each member serves a two-year term. MSPB meetings are typically held once per month but may occasionally meet a second time, if needed. Meetings are

normally held on the second Monday of each month at 5 p.m. On months in which a hearing occurs, the hearing is held at approximately 5:30 p.m. in the BCC meeting room at the conclusion of the business portion of MSPB meeting.

Qualifications of Board Members

No person shall be appointed to the MSPB as a member who:

1. Has not been a resident of Escambia County for two or more years preceding the appointment to the MSPB.

2. Is holding an elective or appointive office in federal, state, county or municipal government, provided that prior appointment as a member of the MSPB shall not disqualify a person from being reappointed.

3. Held political office in, or was a salaried or hourly employee of Escambia County, during the 12 months preceding appointment to the MSPB.

4. Is a member of the immediate family of a current employee or elected official of Escambia County.

5. Is a current officer of any union representing employees of Escambia County.

6. Is working for any vendor who has a current contractual agreement with any participating appointing authority.

7. Has been convicted of, or has had adjudication withheld of, a felony or any crime involving moral turpitude. Qualifications must be maintained throughout the member’s tenure, or the member must resign his position on the MSPB.

Attendance

Any member of the MSPB shall be removed and replaced after being absent from more than three consecutive meetings during any calendar year. The MSPB shall determine whether any member’s absence is unexcused.

The MSPB members shall serve on a voluntary basis and not be financially compensated for their service.

REDISTRICTING FIGHT TEED UP IN FEDERAL COURT

TALLAHASSEE — As the state appeals a Leon County circuit judge’s ruling that a congressional redistricting plan violated the Florida Constitution, another battle about the plan is poised to play out in federal court.

A three-judge panel of federal judges is scheduled next week to start hearing arguments in a lawsuit alleging that the plan, pushed through the Legislature last year by Gov. Ron DeSantis, is racially discriminatory and violates the U.S. Constitution.

The two cases, filed by voting-rights groups and other plaintiffs, involve different legal issues. But they both center on a decision by DeSantis and the Republicancontrolled Legislature to overhaul a North Florida district that in the past elected Black Democrat Al Lawson.

White Republicans won all North Florida congressional districts in the November elections after the map was redrawn.

Attorneys for plaintiffs such as the NAACP and Common Cause Florida argue in the federal lawsuit that the overhaul to Congressional District 5 involved “intentional discrimination” and violated the U.S. Constitution’s 14th Amendment and 15th Amendment. The 14th Amendment ensures equal protection, while the 15th Amendment prohibits denying or abridging the right to vote based on race.

The Legislature passed the plan after DeSantis vetoed a proposal that could have led to electing a Black candidate in District 5, the attorneys wrote in a pre-trial brief filed Tuesday.

“Governor DeSantis was viscerally opposed to any district in North Florida in which Black voters could elect a representative of their choice — no matter how such a district was configured,” the brief said. “He vetoed the Legislature’s plan, and pushed through his own, not in spite of his plan’s adverse impact on Black voting power, but precisely because of it. That is unconstitutional.”

But attorneys for Secretary of State Cord Byrd, the named defendant in the federal case, disputed the allegations of discriminatory intent and said the approved plan is a “race-neutral” map.

“There’s a complete lack of direct evidence of discriminatory intent in passing the enacted map,” the state’s attorneys wrote. “In fact, the governor and Florida Legislature went to great lengths in explaining how they weren’t motivated by discriminatory intent and that the enacted map didn’t even consider race in forming district lines.”

The brief also said that J. Alex Kelly, a DeSantis aide who played a key role in drawing the plan, “focused his attention on creating compact districts that respected political and geographic boundaries.”

STATE TOUTS BUILDING EMERGENCY CENTER

Florida officials held a ceremony Wednesday to mark construction of a $180 million State Emergency Operations Center that is targeted to open in 2025. The new facility, near the current Emergency Operations Center in southeast Tallahassee, is designed to provide space for up to 1,000 people to simultaneously coordinate responses to natural disasters, emergencies and events such as Super Bowls and national politicalparty gatherings. In the current center, “we can only house about 400 of those individuals,” state Emergency Management Director Kevin Guthrie said. “So, you have DMS (the Department of Management Services), Department of Health, you have Florida Department of Law Enforcement, FHP (the Florida Highway Patrol), they have to run what we call tactical operations in their own individual offices because we’re just

that the redistricting plan violated part of the Florida Constitution.

The state immediately appealed Marsh’s ruling, and the 1st District Court of Appeal said Monday it will hold what is known as an “en banc” hearing in the case. That means the full Tallahassee-based appeals court will take up the case, as opposed to the usual process of a three-judge panel first ruling on issues.

The state’s attorneys argued in their federal-court brief Tuesday that the statecourt case should be allowed to “run its course to finality.” But attorneys for the plaintiffs said the state-court case should not delay the federal lawsuit.

“Delaying this (federal) case pending the uncertain timeline and outcome of the state appellate process would make it impossible to assure implementation of an unbiased map before the 2024 election,” the plaintiffs’ attorneys wrote.

District 5 in recent years sprawled from Jacksonville to Gadsden County, west of Jacksonville, and included areas with sizable Black populations. Under the new plan, the district was condensed in the Jacksonville area. Lawson ran in another North Florida district last year and lost to U.S. Rep. Neal Dunn, R-Fla.

Marsh issued a 55-page decision that said the new map violated a 2010 state constitutional amendment known as the Fair Districts amendment, which set standards for redistricting. Part of that amendment barred drawing districts that would “diminish” the ability of minorities to “elect representatives of their choice.”

“Under the stipulated facts (in the lawsuit), plaintiffs have shown that the enacted plan results in the diminishment of Black voters’ ability to elect their candidate of choice in violation of the Florida Constitution,” Marsh wrote.

Next week’s trial, however, will focus on federal constitutional issues.

“The evidence will show Governor DeSantis went into the 2022 congressional redistricting with one overriding goal: eliminating (the previous configuration of) Florida’s Fifth Congressional District, a district where Black voters could elect their candidate of choice,” said the brief filed Tuesday by the plaintiffs’ attorneys.

But DeSantis contended that the U.S. Constitution’s Equal Protection Clause prevented using a district similar to the previous shape of District 5 because it would involve racial gerrymandering.

Tuesday’s brief by the state’s attorneys pointed to a memorandum that DeSantis issued when he vetoed the Legislature’s earlier proposal.

“The governor’s memorandum bears emphasis: He forcefully argued that racebased redistricting is antithetical to the Equal Protection Clause’s race-neutrality dictates,” the brief said. “That very well could have changed minds in the Florida Legislature.”

The 2021-2022 state budget included $100 million for planning, design, site acquisition, permitting and construction. The 2022-2023 budget had $80 million for construction. The main room of the current building is designed for 200 people, but up to 400 people have been crowded into desk spaces when responding to storms. The new main room will provide space for 500 people. The new building is also designed to withstand winds up to 200 mph. The current, 27-year-old facility is built to withstand a Category 3 hurricane, which is reached when maximum sustained winds reach 111 mph.

ESCAMBIA SCHOOL BOOK BATTLES CONTINUE

TALLAHASSEE — With Escambia County a key battleground in a broader debate about school books, plaintiffs in a lawsuit against the county school board urged a federal judge Monday to reject a request to dismiss a challenge to the removal and restriction of library books.

Attorneys for authors, a publishing company, parents and a non-profit organization filed a 51-page document disputing the school board’s arguments that the case should be dismissed. The plaintiffs contend the board violated First Amendment and equal-protection rights in removing 10 books from school-library shelves and restricting access to more than 150 others.

“These books include many classics of American literature, which have been on school-library shelves for years, if not decades,” the plaintiffs’ attorneys wrote. “The board’s restrictions and removals have disproportionately targeted books by or about people of color and/or LGBTQ people.”

The document was a response to a motion that the school board filed last month arguing that Pensacola-based U.S. District Judge T. Kent Wetherell should toss out the case. In part, the school board contended that the plaintiffs don’t have legal standing to pursue the case. It said, for example, that removal or restriction of books from school libraries does not create a “constitutional injury” to the authors who are plaintiffs.

“The board has not inhibited or prohibited the author plaintiffs’ ability to write, market, and sell their books, even to the board’s students,” the motion said. “The mere fact that their books have been removed or restricted from the board’s shelves does not give the author plaintiffs standing to challenge the board’s decisions and their claims should be dismissed with prejudice.”

The case is one of two federal lawsuits involving decisions by the Escambia County board to remove or restrict books. The other case, which also is filed against the Lake County school district and the State Board of Education, centers on the children’s book “And Tango Makes Three.”

That book tells the story of two male penguins who raised a penguin chick at New York’s Central Park Zoo. Plaintiffs in the case, authors Peter Parnell and Justin Richardson and an Escambia County third-grade

student, are seeking a preliminary injunction to require restoring the book to Escambia school library shelves.

“The school defendants previously purchased, provided, and permitted access to the book in public school libraries,” the lawsuit said. “The school defendants removed the book from public school libraries or restricted access to the book within public school libraries based on the topic discussed, idea or message expressed, and opinion of the author plaintiffs — namely, that samesex relationships and families with same-sex parents exist; that they can be happy, healthy, and loving; and that same-sex parents can adopt and raise healthy children.”

But in documents filed Friday, attorneys for the Escambia County board and the State Board of Education argued the request for a preliminary injunction should be denied. Attorneys for the state wrote, in part, that “exercise of discretion in the selection of school-library books is government speech” that can be regulated.

“The choice of which message should be spoken in our schools is for democratically accountable governments, not courts or litigants,” the state’s attorneys wrote.

A decision on the motion for a preliminary injunction could be delayed because U.S. District Judge Brian Davis last week transferred the case from Jacksonville in the federal Middle District of Florida to Tallahassee in the federal Northern District of Florida. It was originally filed in the Middle District, which includes Lake County, but was moved to the Northern District, which includes Escambia County.

Disputes have emerged in school districts across Florida and in numerous other parts of the country during the past two years about efforts to remove or restrict access to books.

Critics describe the efforts as book banning, while supporters say they are trying to prevent children from being exposed to such things as sexually graphic books.

The Escambia County lawsuit before Wetherell includes as plaintiffs five authors, the publishing company Penguin Random House, seven parents of schoolchildren and the free-speech group PEN America. It details a series of examples of the school board removing or restricting library books after receiving complaints — with the board, at least in some cases, going against the recommendations of review committees.

TALLAHASSEE Some deer killed during two popular hunting days in December must be tested for a contagious disease fatal to the animals as the state expands efforts to limit the spread of the disease.

The Florida Fish and Wildlife Conservation Commission said Tuesday that deer killed on Dec. 9 and Dec. 10 in most areas of Holmes, Jackson and Washington counties must be tested for chronic wasting disease at one of 21 check stations before being processed for food or going to taxidermists.

“These counties comprise the CWD (Chronic Wasting Disease) Enhanced Surveillance Zone, and the FWC (Fish and Wildlife Conservation Commission) is prioritizing heightened surveillance and regulations within this zone to reduce the potential spread of CWD both within the zone and throughout the state,” Lauren Claerbout, a spokeswoman for the commission’s Division of Hunting and Game Management, said.

The disease is described as similar to mad cow disease, with deer becoming emaciated and often being found isolated and trembling. While not considered harmful to people, the disease can result in death within four months to deer.

The testing details were presented Tuesday during a meeting in the Holmes County community of Bonifay. Another meeting is scheduled Oct. 10 in Marianna in Jackson County.

The commission will try to get as many samples as possible to meet testing goals.

“We can get some deer out of season from road kills. but the majority of our samples will come from hunter-harvested deer,” commission Deer Management Program Coordinator Cory Morea said in Bonifay. “So, it’s really important to get out and hunt and provide samples whenever.”

The commission is asking people who see sick, abnormally thin deer, or deer dead of unknown causes to report the finds. Claer-

bout said it also is asking hunters to bring in deer heads for testing outside of the “check station weekend.”

The commission issued an emergency order after a case of chronic wasting disease was detected in June in a “road-killed” deer in Holmes County. The positive test was the first known case of a deer in Florida having the disease, which has been found in 30 other states including Alabama and Mississippi.

No additional cases have been detected in close to 200 deer tested since the Holmes County case, but wildlife officials expect an increase in deer deaths from the disease. Directives from the commission will be reevaluated after the upcoming hunting season.

Claerbout said the December weekend --the start of the second phase of the “general gun” season for deer hunting in the Panhandle region that includes the three counties --“is very popular for deer hunting.”

“We also looked at harvest reporting data from the last few years to determine which weekend would most likely yield the highest number of harvested deer from that area,” Claerbout said. “Since these check stations will be fully staffed, we needed to pick the most effective time to do this to ensure that we’ll be able to collect as many samples as possible.”

Claerbout said the state will also work with taxidermists and processors in the threecounty area and provide drop-off freezers for hunters so samples can be collected.

With no simple treatment or vaccine for chronic wasting disease, deer farmers have expressed concern that a single positive test could require the eradication of entire herds, which in some cases represent millions of dollars in investments.

Florida has monitored the issue since 2002, testing about 17,500 hunter-killed, road-killed and sick deer.

In 2021, the state placed certain limits on importing deer carcasses into Florida. People can bring in deboned meat, finished taxidermy mounts and clean hides and antlers.
