PENSACOLA BEACH SONGWRITERS FESTIVAL

FEATURING 100 ARTISTS AT 19 LOCAL VENUES

Each year in October, the Pensacola Beach Songwriters Festival offers a special opportunity for music lovers to hear about the stories behind the songs.

This annual series will return October 4-8, hosting 100 local and national artists at 19 downtown and beachside venues. Created by Reneda Cross Pasquale and her late husband Jim, this annual event not only spotlights musicians and their songs but reaches out to the community through music education.

Pasquale started as a volunteer at a songwriter festival more than 25 years ago and after just two years, she expanded upon that role to become a coordinator. It’s a career she’s held ever since, and one that she talks about with warmth while discussing the Pensacola Beach Songwriters Festival.

“I had been organizing festivals for many years prior to starting the Pensacola Beach Songwriters Festival, so for me, it was like stepping back into doing what I love all over again…Supporting the songwriters and working with the community,” Pasquale said.

Pasquale said that paying attention to the experiences that songwriters share in their songs, has given her a whole new perspective on what music is all about.

“I feel like a lot of people may take songs kind of for granted. They hear them and love the tune, but don’t realize the meaning of the lyrics behind it,” Pasquale said. “So, this event really does serve as much more than just a live music event.”

While drawing people from all over the country, and a few internationally, the Pensacola Beach Songwriters Festival is also meant to serve as an educational event for audiences. “We want people to enjoy the music and realize what these people go through to get these songs to you. Music education is the foundation of our festival,” Pasquale said.

“The Pensacola Beach Songwriters Festival began back in 2009, when my husband and I were contacted by Renee Mack, who is the general manager of Paradise Bar & Grill, asking if I would consider starting a songwriters festival on Pensacola Beach,” Pasquale explained. “After meeting with her that same August, we decided on

a timeframe and the first festival came to life about six weeks later. It’s only continued to grow ever since.”

The inaugural songwriters festival kicked off in 2009 with 12 songwriters performing at five participating venues on Pensacola Beach. Now, more than a decade later, the event has grown to include 100 artists performing at more than 18 venues across Pensacola Beach and downtown Pensacola.

“Last year was our first year back since 2019. With the passing of our event co-founder Jim Pasquale, the COVID-19 pandemic and the bridge outage, the 2021 event did not happen,” Pasquale explained. “So, we were really pleased to have made that kind of comeback and we’re expecting twice that for this year’s event.”

Proceeds from the Pensacola Beach Songwriters Festival go to support music education and expansion in the classroom.

“During the event, we partner with three local elementary and middle schools to teach children the influence music provides in fostering creativity, confidence and self-discipline,” Pasquale said. “Songwriters that participate in the Nashville Country Music Hall of Fame ‘Words & Music’ program will host the workshops in our affiliated schools. One of their objectives is to bring songwriters into the classroom to provide instruction and mentoring around the art of music. Children are encouraged to participate in the process of creating their own songs and take the stage to perform their own creations.”

In addition to its outreach programs in local schools, the festival will bring its music programs into Valerie’s House, Magdalene’s and Pace Center for Girls.

The Pensacola Beach Songwriters Festival will feature multiple songwriter showcases and special events October 4-8 at different venues across Pensacola Beach and downtown Pensacola. Performances will feature more than 100 artists and songwriters representing a variety of music genres such as country, rock, folk, pop, blues and bluegrass.

LIVE PAINTING EVENT TO TAKE PLACE NOV. 10-12 IN DOWNTOWN PENSACOLA

Zarzaur Law, P.A., an award-winning personal injury law firm based out of Pensacola, Florida, will host “Mural Alley”, a threeday live painting event that will attract locals and visitors that are in the heart of Downtown Pensacola in conjunction with the Foo Foo Festival activities happening during the first two weeks in November. Air quality monitoring provides the public with measurements of pollutant concentration levels in the ambient air, the portion of the atmosphere near ground level and external to buildings or other structures. Through the Air Quality Monitoring Network, Escambia County provides the public with data on particle pollution, particulate matter, ozone and other parameters at each station. The network will also provide data to weather reporting services such as the AirNow Fire and Smoke Map and the PurpleAir Map.

FOUR-WAY STOP INSTALLED AT BOYD AVENUE AND GEEKER STREET INTERSECTION

Escambia County’s Engineering department has completed signage and striping improvements at the intersection of Boyd Avenue and Geeker Street in District 4. Additional stop signs and white stop bars have been added to the intersection, converting the intersection from a two-way stop to a four-way stop.

Configuring the intersection to a fourway stop will cause motorists to stop, signal,

then proceed, creating safer traffic conditions when navigating the roadways. Drivers should use caution in the area and remember to approach the intersection at Boyd Avenue and Geeker Street as a four-way stop. U.S. SUPREME COURT ASKED TO HALT EXECUTION

TALLAHASSEE — Attorneys for convicted killer Michael Duane Zack on Tuesday asked the U.S. Supreme Court to block his planned Oct. 3 execution, after Florida courts rejected arguments that he should be spared because of Fetal Alcohol Syndrome.

The attorneys filed a request for a stay of execution and an accompanying petition asking the U.S. Supreme Court to consider the issues in the case. The move came after the Florida Supreme Court on Thursday refused to halt Zack’s execution for the 1996 murder of a woman in Escambia County.

Meanwhile Tuesday, a panel of the 11th U.S. Circuit Court of Appeals rejected a separate request for a stay of execution that was based on arguments Zack received a flawed state clemency process.

Zack’s attorneys contend he should be shielded from execution because of Fetal Alcohol Syndrome that he suffered because his mother drank alcohol while pregnant.

The U.S. Supreme Court ruled in a 2002 case known as Atkins v. Virginia that executing people with intellectual disabilities violates the Eighth Amendment ban on cruel and unusual punishment.

Tuesday’s request at the U.S. Supreme Court for a stay of execution said “the medical community now recognizes that the unique, cognitive, practical and social impairments inherent to Fetal Alcohol Syndrome (are) indistinguishable from those of Intellectual Developmental Disability.”

“At every opportunity since his trial, Mr. Zack has presented evidence of his prenatal alcohol exposure to the full extent allowed by then-contemporaneous scientific legal and legal standards,” the request said. “Evolving standards of decency have finally progressed to the tipping point that allows Mr. Zack to establish that his FAS (Fetal Alcohol Syndrome) disability affords him the same protections established in Atkins. To deny review would penalize Mr. Zack for being right too soon.”

But in its ruling Thursday, the Florida Supreme Court said Zack has raised intellectual-disability arguments over two decades of appeals. As a result, the court said the latest arguments did not meet legal tests for “timeliness” and were procedurally barred.

The opinion, written by Justice Renatha Francis, said Zack’s claim that he should be shielded from execution “is, at its core, the same claim he’s repeatedly raised since 2002.” The Supreme Court upheld an Escambia

Tiffany Carr, the former longtime president and CEO of the Florida Coalition Against Domestic Violence, turned herself in to North Carolina authorities after an arrest warrant was issued on fraud, grand theft and official misconduct charges. The Florida Department of Law Enforcement said Carr turned herself in Monday at the Jackson County Sheriff’s Office in North Carolina. Florida authorities charged Carr and Patricia Duarte, a former chief financial officer for the coalition, and alleged they

“As demonstrated by the extensive history of Zack’s postconviction and habeas proceedings, the facts upon which his intellectual disability claim is predicated have long been known to him and his attorneys,” Francis wrote in Thursday’s 34-page opinion. “He has long known his IQ score range (the lowest score of 79 was established in 2002) and his experts’ FAS diagnosis (relied on at trial in 1997). Yet, he relies on this 20-year-old-plus information to now claim he should be deemed intellectually disabled and, thus, categorically exempt from execution. … But Zack raises no newly discovered evidence on this point.”

Gov. Ron DeSantis on Aug. 17 signed a death warrant for Zack, 54, in the murder of Ravonne Smith, who was killed in her Escambia County home after meeting Zack in a bar where she worked. A jury in September 1997 convicted Zack of first-degree murder, robbery with a firearm and sexual battery, records show. He also is serving a life sentence for the murder of Laura Rosillo in Okaloosa County shortly before the Smith killing.

Zack’s attorneys filed cases in state and federal courts to try to prevent the execution. The federal-court case has centered on the state clemency process but also involves issues related to Fetal Alcohol Syndrome.

Zack’s attorneys have argued, in part, that his clemency interview was in 2014 and that he has not been able to provide medical evidence that has emerged since then about Fetal Alcohol Syndrome. Clemency was denied in August when DeSantis signed the death warrant.

But U.S. District Judge Robert Hinkle refused to issue a stay, and the panel of the Atlanta-based appeals court followed suit Tuesday. Among other things, the appeals court said “there is no provision in the clemency rules that prevented Zack from providing supplemental materials (about Fetal Alcohol Syndrome) if he believed they would bolster his clemency application.”

“While Zack is correct that there is no clemency rule affirmatively authorizing supplemental submissions, there is also no rule precluding them,” said the appeals-court ruling by Chief Judge William Pryor and Judges Robin Rosenbaum and Jill Pryor. “And the state says that any materials that Zack submitted about the research on FAS would have been considered as part of his clemency application. So based on the record, we cannot conclude that there was no opportunity for Zack’s counsel to submit updated materials.”

SPORTS BETTING PLAN FACES NEW CHALLENGE

TALLAHASSEE — After a federal appeals court ruled against them, two pari-mutuel companies on Tuesday asked the Florida Supreme Court to strike down part of a multibillion-dollar deal that would give the Seminole Tribe control over sports betting throughout the state.

The challenge, filed by West Flagler Associates and Bonita-Fort Myers Corp., alleges the deal runs afoul of a 2018 constitutional amendment requiring voter approval of expansions of casino-style gambling. West Flagler holds three jai alai licenses, while Bonita-Fort Myers Corp. does business as Bonita Springs Poker Room in Southwest Florida.

Gov. Ron DeSantis and Seminole Tribe of Florida Chairman Marcellus Osceola, Jr. signed the deal, known as a compact, in 2021 and state lawmakers ratified it.

A “hub-and-spoke” plan in the agreement allowed the Seminoles to accept sports wagers from mobile devices anywhere in the state, with the bets run through servers on tribal land. The deal said bets “using a mobile app or other electronic device, shall be deemed to be exclusively conducted by the tribe.”

The lawsuit filed Tuesday at the Supreme Court accused DeSantis and the Legislature of exceeding their power by allowing sports betting off tribal lands — without approval from voters.

“This abuse of authority warrants this court’s review and correction,” Raquel Rodriguez, a Miami-based attorney with the Buchanan Ingersoll & Rooney PC firm, wrote in the 76-page lawsuit known as a “petition for a writ of quo warranto.”

The challenge pointed to part of the constitutional amendment that says it “ensures that Florida voters shall have the exclusive right to decide whether to authorize casino gambling” in the state. The amendment includes an exception for gambling that takes place on tribal lands.

“The amendment is an enduring grant to the people themselves – and only them --to authorize new gambling in Florida. The constitutional provision should be interpreted for sports betting as it exists today,” Rodriguez wrote.

The amendment, known as Amendment 3, applies to types of gambling found in casinos and to types of gambling that are considered Class III under federal law. A presentation by DeSantis’ lawyers to Florida lawmakers in 2021 noted that, “because of Amendment 3, commercial sports betting outside of a tribal compact is unconstitutional in Florida.”

The lawsuit accuses DeSantis and legislators of constructing the sports-betting plan and an accompanying law in a manner designed to skirt the constitutional requirement for a statewide vote.

DeSantis and lawmakers “sought to bypass” and “avoid the requirements” of the amendment “not by actually limiting sports betting to Indian lands, but by labeling the problem away. But the Florida Constitution cannot be so easily avoided,” the lawsuit said.

“The governor and Legislature’s fiction does not change the reality that the governor and Legislature are seeking to authorize gambling that takes place off Indian lands.”

The lawsuit called the setup deeming wagers placed anywhere in the state to have occurred on tribal lands — where the

computer servers handling bets would be located — a “transparent artifice” to try to meet the exception in the amendment.

“This artifice to avoid (the amendment’s) requirement of a citizens’ initiative is contrary to established law, the undisputed facts and common sense,” Rodriguez argued.

The state lawsuit came as the pari-mutuel operators also seek a U.S. Supreme Court review of the compact in a separate federalcourt case. That case alleges the compact violates the federal Indian Gaming Regulatory Act, or IGRA, which regulates gambling on tribal lands.

U.S. District Judge Dabney Friedrich in 2021 ruled against the compact, calling the sports-betting plan a “fiction” and invalidating other parts of the agreement. But a panel of the U.S. Circuit Court of Appeals for the District of Columbia overturned Friedrich’s ruling, and the full appeals court this month refused to reconsider the panel decision.

The pari-mutuels filed a motion saying they intended to ask the U.S. Supreme Court to weigh in on the issue, arguing that the outcome could “represent a blueprint for expanded gaming outside of Indian lands.”

The Seminoles briefly rolled out the Hard Rock SportsBook mobile app amid the legal wrangling but stopped accepting wagers and deposits on the app in December 2021 after Friedrich’s ruling.

The pending cases will keep sports betting in Florida in limbo, at least for now.

“Do I think online sports betting will ultimately be allowed under the compact? It’s probably a better than 50 percent chance that the Seminole Tribe will end up .. having the ability to roll out online sports betting. But the key question for today is one of timing,” Daniel Wallach, an attorney who specializes in gambling law, told The News Service of Florida on Tuesday. “What is known is these parallel judicial proceedings will likely cause further delay in the timing of the rollout of online sports betting.”

Isadore Havenick, an owner of the parimutuels whose family has operated gambling facilities in Florida for more than 60 years, also is a plaintiff in the lawsuit filed Tuesday. The case argues the federal appellate rulings have resulted in an “urgent” situation necessitating state Supreme Court review.

“Unless this (Florida Supreme) Court grants this petition, casino gambling throughout the state in the form of off-reservation in-person and mobile sports betting will take effect without the approval by the voters of Florida, as explicitly required by the text of Article X, Section 30 of the Florida Constitution. … Further, since the current status of the case is that the 2021 compact is valid under federal law, review of the legality of offreservation sports betting under state law is urgent,” the lawsuit said.

The challenge also pointed to the June 30 decision by the three-judge panel of the federal appeals court. While the decision was a major victory for the Seminoles and the state, the panel also emphasized that questions about whether the compact violates the Florida constitutional amendment remain a matter for state courts to consider.

“Whether it is otherwise lawful for a patron to place bets from non-tribal land within Florida may be a question for that state’s courts, but it is not the subject of this litigation and not for us to decide,” appealscourt Judge Robert Wilkins wrote in a 24-page opinion joined by Judges Karen Henderson and J. Michelle Childs.
