Wgia of seeing an old Volkswagen (VW) driving down the road, whether fond memories of road trips or the shock from punch buggies comes to mind. In the coming weeks, you may see more VWs on the road here in Pensacola thanks to a popular VW car show coming up on October 19.

The much-anticipated car show is hosted by true VW enthusiasts from the Rare Air Emerald Coast VW club, a group of more than 300 members—all ranging in age from 13 to over 80 years old.

As a brand, VWs were initially produced by Ferdinand Porsche (yes, Porsche) in 1938. Later, all VW factories were taken over during WWII to accommodate military vehicle needs. Eight years later, England purchased VW with the hope of restoring Germany. The first VW was sold in the United States in 1949 and from there on out, the rest is history.

Emerald Coast and Rare Air initially began as two separate VW

clubs, which merged in 1991 due to declining members. Four years later, the club found its long-time president, William Tucker, affectionately known by many as “Wild Bill.” His passion for the club and the cars is contagious. “Bill eats, sleeps and probably dreams VWs.

They’re his whole life,” longtime club member and tech session host Don Dorough said.

Tucker became president of the club in 1995 and thanks to his passion for VWs, has remained president since. Tucker first got into the hobby of restoring old VWs after serving in the Navy. In 1969, he bought his first VW bus for $2,000 cash and never looked back. Tucker eventually found his place in the VW Club in 1994, where he’s met many of his closest friends. Tucker can easily be recognized by his VW bus, which is boldly painted black and white with the art from Pink Floyd’s The Dark Side of The Moon album.

“The club and the people are great. Being able to help somebody keep their VW on the road and seeing that same person years

later helping someone else is what it’s all about. It’s kind of like passing the torch,” Tucker explained.

The Rare Air Emerald Coast VW Club is known for its community, having someone for all types of maintenance and always having someone to help out when needed. Like any Volkswagen club, this club caters to anyone with a VW. Due to the age and mechanics of the classic air-cooled VWs, they often encounter issues while on the road. The Rare Air VW Club is there to help anyone, regardless of membership status.

Dorough has been known to bring broken-down buses and bugs back to his workshop to fix them and even let the owners camp on the site if needed. “We all have the same goal, which is to keep the VWs going and help if something goes wrong,” Tucker said.

Tech sessions are a unique part of the Rare Air Emerald Coast VW Club. Members bring their various VW vehicles to be worked on and discussed, while also learning maintenance skills and troubleshooting mechanical issues from one another. Anyone is welcome to become a member, and anyone with a VW is welcome to join in on tech sessions. Meetings are held the first Saturday of the month at 10 am at Dorough’s personal shop located at his home.

“We have a group of like-minded people who have spare parts, knowledge, and enthusiasm for keeping the air-cooled VWs on the road.” This group has the right idea, too, since the tech session, which originated with the Rare Air Emerald Coast club, is now being adopted by other VW clubs around the United States. “Tech sessions

are, at their core, a community of people gathering to help each other out,” Tucker said.

Dorough is also well-known for lending a helping hand with the VW club, regardless of the time and weather, and even offering his home’s backyard for tech sessions.

Another adventure that club members take on is the annual Emerald Coast Rare Air VW Car Show, which will be held on October 19.

Individuals from across the region come to Pensacola for this beloved annual event to admire hundreds of classic and newer models of VWs, including vintage buses, bugs and everything in between. VW owners are also invited to bring their prized VWs to display, trade or sell. The show will have plenty of vendors, food trucks and, of course, the featured cars for visitors to enjoy.

The 28th Annual Rare Air Emerald Coast car show will feature 24 registered classes of VWs compet-

ing for various awards, ranging from best paint job to best in show. Each year has its unique theme, and this year, the theme is zombies, embracing the Halloween spirit. Attendees should watch for VWs decked out in undead paint and decorations. Each year, a percentage of the proceeds from the car show support a local charity selected by the club members. Last year’s charity was Keep Pensacola Beautiful. This year, the club will donate a portion of the car show proceeds to Favor House of Northwest Florida, a domestic abuse treatment center in Pensacola.

The 28th Annual Rare Air Emerald Coast VW show will kick off at 8 am on October 19 at the Five Flags Speedway at 7451 Pine Forest Rd. in Pensacola. WASTE AMNESTY DAY AT SOUTH SANTA ROSA SERVICE CENTER

Household Hazardous Waste (HHW) Amnesty Day will be held Sat., Oct. 19, 2024, from 8 a.m. to noon at the South Santa Rosa Service Center, 5841 Gulf Breeze Pkwy. in Gulf Breeze. This event allows residents to dispose of HHW at no charge without having to drive to the Central Landfill in Milton.

Residents may be required to remove items from their vehicles. Remember, HHW items can cause injury if handled improperly. These items usually have a warning or cautionary statement on their labels, such as flammable, corrosive, poison or toxic. The following items will be accepted and should never be disposed of with household garbage:

• up to eight regular car or truck tires per vehicle, no large, heavy-duty or racing tires are accepted

• up to five gallons of antifreeze, gasoline, paint, solvents, and oil (including cooking oil)

• oil filters

• lubricants

• pesticides and fertilizers

• pool chemicals and household cleaners

• battery backups, rechargeable batteries (from vehicles, lawnmowers, laptops, cellphones, coin cells) no alkaline batteries!

• propane bottles

• aerosol cans

• flat-screen monitors and flat-screen TVs only

• computers, laptops, tablets, cellphones

• stereos, radios, amplifiers

• printers, copiers, fax machines, circuit boards

Conditionally exempt small-quantity generators (small businesses, schools and growers, etc.) will be accepted at a reduced rate. CESQG waste is accepted by appointment only. Call (850) 981-7135 by 12 p.m. the day before the event to schedule a dropoff time.

Waste tires will also be accepted at the same location, during Household Waste Amnesty Day. A maximum of eight (8) tires per Santa Rosa County resident will be accepted free of charge with a photo ID as proof of residency. Tires from commercial shops and vendors will not be accepted. Residents can drop off tires during HHW Amnesty Day event hours 8 a.m. to 12 p.m.

Santa Rosa residents can dispose of household hazardous waste, including sharps, Monday through Saturday, 7 a.m. to 5 p.m., at the HHW center at the entrance to the Central Landfill, 6337 Da Lisa Road in Milton. Regular, light duty, truck or car tires are accepted for $5 each, year-round.

BEACH LIFEGUARDS

HOSTING TRYOUTS DEC. 7 & 8

Pensacola Beach Lifeguards will host a tryout on Saturday, Dec. 7 at 9 am. and Sunday, Dec. 8 at 1 pm. for individuals looking for a challenging, rewarding and exciting job with a starting pay of $18.35/hour.

The tryout will occur at the University of West Florida Aquatic Center, 11000 University Parkway, Bldg. 72. Applicants are asked to arrive at least 15 minutes early and to bring all relevant certifications to the tryout event.

Position requirements for employment include the following:

• Able to swim 600 yards in a pool in 10 minutes or less

• Able to run 1.5 miles on a track in 12

minutes or less

• Be at least 16 years old

• Possess a valid driver’s license

Attending and passing a tryout is required to be considered for employment. If you pass the physical tests in the allotted time and meet all of the other requirements, you will be scheduled for an interview. If selected to be hired, you will receive paid training. Training includes but is not limited to, successfully passing 80 hours of open water training and emergency medical training.

CHEERS TO 40 YEARS OF RONALD MCDONALD HOUSE CHARITIES: CELEBRATE WITH WINE & FRIES

Ronald McDonald House Charities of Northwest Florida, alongside McDonald’s, hosts Wine & Fries, presented by Ascension Sacred Heart Emerald Coast, on October 25th. This year’s event celebrates the Chapter’s incredible 40 years of caring for families, and they invite guests to celebrate with them at Hotel Effie Sandestin, Autograph Collection. Guests will enjoy rooftop views starting at 6 p.m. and indulge in McDonald’s French fries and an assortment of wines throughout the evening. There’s more to the event than this dream combination, though! In honor of 40 years, this year’s theme is a ruby jubilee. The rooftop will be in shades of red, and guests are encouraged to wear their finest red attire. On top of the theme, guests can hit the dance floor with DJ TreVy, bid on the silent auction and raffles prizes, and enjoy other surprises throughout the night. Wine & Fries will conclude at 9 p.m.

SPARK INSPIRATION FOR PACE CENTER FOR GIRLS

WSRE invited Pensacola singer-songwriters Greg Bond and Faithe Franklin to bring their stories and original music to Pace Center for Girls the past two Fridays, Sept. 20, and Friday, Sept. 27.

These are two of three sessions, now billed as the Lyrics of Light project, which will conclude with the Pace girls collaborating to write a song of their own during a special songwriting workshop at Pensacola State College on Friday, Oct. 4, at 10:30 a.m. Accomplished Nashville artists Anne Buckle and Teea Goans will lead the workshop while in town for the Pensacola Beach Songwriters Festival.

For the past 12 seasons of the “StudioAmped” music series, WSRE has partnered with the festival to present a special concert featuring visiting songwriters who have penned hits or otherwise found success in the music industry. In recent years, this longtime partnership has evolved to include an educational and uplifting project for Pace Center for Girls.

What started in 2019 as an annual songwriting workshop has grown to include the preliminary songwriter sessions presented by local artists and a girls’ night out to attend the “StudioAmped” Pensacola Beach Songwriters Festival concert and TV production at WSRE. This year’s concert features Kensie Coppin, Jim McCormick and CJ Solar sharing their hit songs and the stories behind them on Friday, Oct. 4, at 7 p.m. in the station’s Jean & Paul Amos Performance Studio at Pensacola State College.

With a 2019 grant for community engagement around the Ken Burns “Country Music” documentary series on PBS, WSRE first proposed that the Pensacola Beach Songwriters Festival help facilitate a songwriting workshop for Pace Center for Girls similar to those the festival has conducted at local schools for many years.

Festival director Reneda Cross extended the invitation to Buckle, who has since conducted the Pace workshop with help from fellow festival artists Tim Buppert, Caitlin Evanson and Jerry Vandiver—all Nashville songwriters, many of whom participate as songwriting partners in the Country Music Hall of Fame and Museum’s Words & Music® education program.

“We are so grateful to the singer-songwriters, The Bear Family Foundation and WSRE for bringing Lyrics of Light to our girls and our staff,” said Laurie Rogers, Pace Center for Girls executive director. “These one-of-a-kind experiences leave lasting memories that generate feelings of great times with great people. We are especially thrilled that the orchestrators of these musical moments have expanded the opportunities provided to the girls to include three singing events plus a TV station tour and an evening out to enjoy a performance in person.”

In 2023, The Bear Family Foundation awarded WSRE a grant to help fund “StudioAmped” production and elevate the songwriting project for Pace Center for Girls to increase its impact.

With that support, the station has fortified the project with the Lyrics of Light branding, the new songwriter sessions with local artists, and the project’s first night out where the girls can see award-winning and acclaimed songwriters during the “StudioAmped” production.

In addition to attending the concert, the girls will have their hair done by Pensacola State College cosmetology students, enjoy a pizza party compliments of Jet’s Pizza, and get a behind-the- scenes look at how a television program is produced.

“The Pensacola Beach Songwriters Festival concert brings the heart of Nashville to WSRE’s ‘StudioAmped’ series this year with talent you’d be lucky to see perform at famous venues like the Blue Bird Café,” said the show’s executive producer, Bill Harrell. “It will be a special acoustic evening of storytelling and song, and we all look forward to sharing that with young people who might not otherwise have had the opportunity.”

About the Songwriters

Greg Bond (Pensacola) is a singer-songwriter, professional musician, commercial composer, guitar instructor and a longtime Northwest Florida resident. He studied vocal performance as a music major at (then) Pensacola Junior College on a vocal scholarship and has since performed his original music in and around the Gulf Coast to audiences large and small. His EP “Continent” was released in 2009, and he has recorded several singles in recent years. Bond is currently working on his first full-length album “Kind Over Matter” slated for release in 2024. Faithe Franklin (Pensacola) is a singer-songwriter, producer and musician who provides smooth, soulful vibes through her original music. She writes, produces and records her tracks and has over 50 songs streaming on all platforms. Her solo act offers a combination of piano, vocals and other melodic instruments. She is part of two bands: Thee Auricles, where she is the musical director and keyboardist, and The Groove Family as the lead singer and vocalist.

Anne Buckle (Nashville, Tenn.) is a singersongwriter, multi-instrumentalist and music producer whose storytelling and melodies channel Appalachian roots and create an indie-Americana sound. A descendant of the Carter Family and cousin of June Carter Cash, she has been called “a refreshing take on a legendary family” by the Nashville Music Guide. Her original songs have amassed over 4 million streams across platforms, and she has co-written songs recorded by other artists including David Archuleta and Lindy Boone, daughter of legendary crooner Pat Boone. As a fiddle player and vocalist, she has shared a stage with the late Charlie Daniels, performed with Augustana as an opening act on The Chicks’ 2016 world tour and performed on the Grand Ole Opry. As a teaching artist, she helps individuals and organizations unleash their creativity through music.

Lauren Mascitti (Nashville, Tenn.) is a singer-songwriter who appeared on the 2020 season of ABC’s “American Idol,” and has been writing and performing since age 7. By the time she was a teen, she was performing six shows a week in Branson, Mo., with gospel singer Gary McSpadden, formerly of The Oak Ridge Boys. She has performed on the Grand Ole Opry multiple times and has written and performed with several of country’s top artists. Her album “God Made a Woman” was named to the New York Times and Saving Country Music’s Best of 2020 lists and went to #4 on iTunes in country albums sales.

The series will continue with the original music of Bangarang Peter on Tuesday, Oct. 8; Civilized Natives on Thursday, Oct. 10; Johnny Hayes & The Alabama Fire on Monday, Oct. 14; Jordan Chase on Wednesday, Oct. 16; and Justin Jeansonne on Friday, Oct. 18.

The public is invited to attend all of the “StudioAmped” concerts, joining the studio audience for each show. All shows start at 7 p.m. Doors open at 6 p.m. Admission is free, and donations for Manna Food Pantries will be collected at the door.

BAPTIST HEALTH CARE PROMOTES JOY POWELL TO CHIEF HEALTH EQUITY OFFICER

Baptist Health Care has promoted Joy Powell to chief health equity officer. Joy will continue leading Faith Health Network and Community Health programs in her expanded role.

Joy has been with Baptist for seven years and has more than 20 years of experience in chronic disease management, care management, community project facilitation, curriculum development, wellness and health education, grant writing, and grant funding.

Joy’s development of health programs and innovative approach to health care for our community have earned her recognition, including the World of Difference Community Navigation Award in 2017 and the Pensacola Chamber’s PACE Emerging Leader Award

CHARITY TENNIS CHALLENGE RETURNS FOR 17TH YEAR

Pensacola Sports is partnering with The Lewis Bear Company to present the 17th annual Bud Light Charity Challenge Tennis Tournament on October 18 and 19 from 8 AM to 10 PM at Roger Scott Tennis Complex located at 2200A Summit Blvd in Pensacola (volunteers needed).

This event benefits The Arc Gateway, an organization that provides the best possible life experiences for more than 800 children and adults with intellectual and developmental disabilities and Pensacola Sports, a private 501(c)3 non-profit agency focuses on education, inspiration and participation in various team, individual, amateur and professional sports activities. JUDGES QUESTION STATE DRAG SHOW LAW

A three-judge panel heard arguments Wednesday in the state’s appeal of an injunction blocking a 2023 Florida law aimed at preventing children from attending drag shows.

U.S. District Judge Gregory Presnell last year found that the law, which was challenged by Orlando restaurant and bar Hamburger Mary’s, violated First Amendment rights. The law was among a number of LGBTQ-related measures approved by Gov. Ron DeSantis and the Republican-controlled Legislature in recent years that have spurred court fights.

The law, dubbed by sponsors as the “Protection of Children Act,” would prevent venues from admitting children to adult live performances. It defines adult live performances as “any show, exhibition, or other presentation in front of a live audience, which, in whole or in part, depicts or simulates nudity, sexual conduct, sexual excitement or specific sexual activities, … lewd conduct, or the lewd exposure of prosthetic or imitation genitals or breasts.”

The law would apply to performances that are “patently offensive to prevailing standards in the adult community of this state as a whole with respect to what is suitable material or conduct for the age of the child present.”

Melissa Stewart, an attorney who represents Hamburger Mary’s, told the panel of the 11th U.S. Circuit Court of Appeals during Wednesday’s hearing that the law “employs broad undefined terms like lewd conduct and lewd exposure” and “makes compliance practically impossible.”

Judges Robin Rosenbaum and Nancy Abudu grilled Nate Forrester, a lawyer for the state, about the law.

“Where is the definition of lewd in this provision or anywhere in the Florida statutes, because it seems your brief talks a lot about obscenity. Where is lewd?” Abudu asked. Forrester said that the word has a “longstanding history” in state law.

“The word ‘lewd’ is basically a reference to something that is sexually explicit. We think that is something that everyone understands as a matter of common sense,” he said, adding that it would apply to something like an “X-rated movie performance” and that the law sets an “age-variable standard.”

But Rosenbaum pressed Forrester, asking how someone would know “whether something is OK for, say, a 12-year-old but not for, say, an 8-year-old?”

“Well again, this does at the edges call for the exercise of judgment and common sense,” Forrester said.

Rosenbaum posed a scenario in which actors in a Shakespeare play wore imitation breasts or genitals.

“I’m not aware of a Shakespeare play that has actually exposed genitalia as part of the performance,” Forrester said.

The law “says ‘exposure,’” the judge said. “I think it just means that you have to be able to see it. I mean, what does that mean? It says lewd exposure. That’s what I'm trying to get at. What do we mean?”

“I think everyone has a sense of what the word lewd means, and there is a line there.

I admit there are difficult edge cases, but that’s not enough to render it facially vague,” Forrester replied.

Abudu continued to question Forrester.

“You have parents and children, arguably, who felt comfortable with these performances … and someone in the Legislature perhaps felt that the mere presentation of those shows was problematic and enacted the statute to address those scenarios. So, how should Hamburger Mary’s and others determine whether or not their shows are lewd if there’s no clarity as to what constitutes lewd behavior?” Abudu asked.

“Well, I'd dispute that there is no clarity. I think the word has an understanding that everyone can ascertain,” Forrester said.

A divided U.S. Supreme Court in November refused to lift Presnell’s preliminary injunction, which blocked enforcement of the law statewide. The law would allow regulators to suspend or revoke licenses of restaurants, bars and other venues that are in violation. The law also would prohibit local governments from issuing public permits for events that could lead to children being exposed to the targeted behavior. In addition, people could face first-degree misdemeanor charges for “knowingly” admitting children to adult live performances.

Although the law does not specifically mention drag shows, lawmakers passed it after the state Department of Business and Professional Regulation cracked down on venues in South Florida and Central Florida where children attended drag shows.

Stewart on Wednesday pointed to the DeSantis administration’s actions, saying the secretary of the department “has already demonstrated … an appetite for finding obscenity where there is none to be found.”

Amid the litigation, Hamburger Mary’s owners stopped hosting the performances, shuttered their downtown Orlando venue and announced they intend to relocate in Kissimmee.

“Plaintiffs’ fear and the actions Hamburger Mary’s has taken to self-censor are not speculative, they are not an overreaction. … There is no way to determine how the secretary is going to define a term like lewd conduct,” Stewart argued.

The restrictions make it “impossible for citizens to know how to comply with this law and it gives law enforcement the opportunity to enforce this law in arbitrary and discriminatory ways,” she argued.

Judge Gerald Tjoflat, however, asked Stewart whether the law was designed to protect children.

“Let’s suppose that, in a given case, the state believes the performance constitutes child abuse by the parent bringing the child to the place. … This is a prophylactic arrangement which is designed to prevent certain things, including child abuse,” Tjoflat said.

The state “already has statutes on the books that address that kind of abusive behavior” and shield children from obscenity, Stewart said.

“It’s not enough. We know that every time you enact a law to prohibit something, people get around it and do something else,” the judge responded.

CITIZENS TO SHED POLICIES IN DECEMBER

Florida regulators have approved proposals by private insurers to take more than 300,000 policies in December from Citizens Property Insurance Corp., as the state continues to try to shrink the size --- and risks --- of its insurer of last resort.

A series of orders signed Friday by Insurance Commissioner Michael Yaworsky would allow private insurers to assume up to 310,022 policies from Citizens. That comes after earlier approvals for private insurers to assume hundreds of thousands of policies later this month and in November.

Yaworsky’s orders also came just days before Citizens could face a costly hit from Hurricane Milton, which is expected to make landfall on the state’s Gulf Coast late Wednesday or early Thursday. As of Sept. 20, for example, Citizens had 227,708 policies in Hillsborough, Manatee, Pinellas and Sarasota counties, which could be in the bullseye of the powerful storm.

State leaders have long sought to move policies out of Citizens into the private market, at least in part because of the financial risks if Florida gets hit by a major hurricane or multiple hurricanes. If Citizens wouldn’t have enough money to cover claims, policyholders across the state — including possibly nonCitizens policyholders — could face paying “assessments” to make up shortfalls.

JUDGE WEIGHS BLOCKING MEAT LAW

A federal judge said Monday he intends to rule quickly on a request to temporarily halt a new Florida law banning meat that state officials have lambasted as “fake.”

Chief U.S. District Judge Mark Walker held a more than two-hour hearing on the request for a preliminary injunction filed by UPSIDE Foods, Inc., a California-based company that is challenging the constitutionality of the law banning the sale and manufacturing of cultivated meat.

Walker indicated he would rule before an early November date that UPSIDE Foods attorney Paul Sherman said was needed for the company to prepare its poultry-based products for Miami Beach’s Art Basel event in December. An injunction would allow the company to sell the products while the underlying legal challenge moves forward.

“I usually don’t let grass grow on these things,” Walker said.

UPSIDE Foods, which contends in part that Florida’s law is improperly designed to favor in-state businesses over out-of-state competitors, has also expressed a desire to distribute its products at the 2025 South Beach Food and Wine Festival in MiamiDade County. It says Florida’s ban has affected the company’s revenue, promotional opportunities and reputation.

The company, which is represented by lawyers from the Institute for Justice legal organization, filed the lawsuit in August and named as defendants Florida Agriculture Commissioner Wilton Simpson, Attorney General Ashley Moody and four state attorneys.

Walker on Monday removed two state attorneys as defendants: Bruce Bartlett, the state attorney in the 6th Judicial Circuit, which is made up of Pinellas and Pasco counties; and Andrew Bain, the state attorney in the 9th Judicial Circuit, which is made up of Orange and Osceola counties.

Walker said UPSIDE Foods in the lawsuit specifically noted events and unnamed chefs in Miami and Tallahassee as potential clients, while no direct sales or distribution links were available for the areas covered by Bartlett and Bain. The other state attorneys who are defendants are Katherine Fernandez Rundle, the state attorney in the 11th Judicial Circuit in Miami-Dade County, and

Jack Campbell, the state attorney in the 2nd Judicial Circuit, which includes Leon and surrounding counties.

The ban was part of a broader Department of Agriculture and Consumer Services bill (SB 1084) that Gov. Ron DeSantis signed on May 1 at an event in Hardee County that featured a sign proclaiming, “Save Our Beef.”

DeSantis, who has described cultivated meat as “fake meat,” said during the billsigning event that the law would protect against “an ideological agenda that wants to finger agriculture as the problem.”

The law, which makes it a seconddegree misdemeanor to sell or manufacture cultivated meat, doesn’t prohibit cultivatedmeat research because of concerns that such a ban could affect Florida’s space industry.

The manufacturing process for the products includes taking a small number of cultured cells from animals and growing them in controlled settings to make food.

David Costello, a senior deputy solicitor general in Moody’s office, told Walker the state has the power to regulate food, health and safety and questioned UPSIDE Foods’ chicken as a poultry product. Costello agreed the initial cells come from slaughtered poultry, but the state considers what is grown in lab settings as a different product.

Costello also argued that UPSIDE Foods isn’t blocked from manufacturing its products outside of Florida, as its manufacturing facilities are located in California.

The U.S. Food and Drug Administration and the U.S. Department of Agriculture last year approved UPSIDE Foods to manufacture and sell its products. Since then, the company has distributed cultivated chicken products at restaurants and tasting events across the nation, including in Florida.

The lawsuit contends Florida’s ban violates the Supremacy Clause in the U.S. Constitution because of federal laws regulating meat and poultry products. The Supremacy Clause generally leads to federal laws trumping state laws. Also, the lawsuit alleges the ban violates what is known as the “dormant” Commerce Clause by insulating Florida agriculture from out-of-state competition.

Alabama followed Florida in approving a similar law. Similar bans have been proposed in states including Kentucky, Iowa, Pennsylvania and Texas.

MOMS FOR LIBERTY GETS WIN IN SCHOOL BOARD CASE

A federal appeals court Tuesday backed a chapter of the group Moms for Liberty in a constitutional challenge to Brevard County School Board policies that placed restrictions on speakers at board meetings.

A panel of the 11th U.S. Circuit Court of Appeals said policies targeted at “abusive,” “obscene” and “personally directed” speech violated the First Amendment. The panel overturned a decision by U.S. District Judge Roy Dalton.

The majority opinion said, for example, that the school board policies did not include a definition of “abusive” speech and that thenboard Chairwoman Misty Belford effectively interpreted it to address what was considered “unacceptable” speech.

In recent years, Citizens grew to become Florida’s largest insurer as private carriers faced financial problems. As of Friday, Citizens had 1.265 million policies.

A key part of the state’s strategy to shrink Citizens is what is known as a “depopulation” program in which private insurers can seek approval from the state Office of Insurance Regulation to assume Citizens policies.

The orders issued Friday were part of that program. Six insurers submitted proposals in August and, after approval, will be able to take Citizens policies in midDecember. While a maximum of 310,022 policies could be assumed, the actual number likely won’t be that high, based on past depopulation rounds.

American Integrity Insurance Company of Florida was approved Friday to assume up to 102,923 policies, while Slide Insurance Co. was approved to assume up to 75,000 and Southern Oak Insurance Co. was approved to assume up to 50,000. In addition, Manatee Insurance Exchange was approved to assume up to 39,000 policies, Trident Reciprocal Exchange was approved for up to 23,099 and Florida Peninsula Insurance Co. was approved for up to 20,000 policies.

Insurers earlier were approved to assume up to 414,258 policies this month and 235,035 policies in November, according to an Office of Insurance Regulation summary.

“For many parents, school board meetings are the front lines of the most meaningful part of local government — the education of their children,” said Tuesday’s opinion, written by Judge Britt Grant and joined fully by Judge Barbara Lagoa and partly by Judge Charles Wilson. “And sometimes speaking at these meetings is the primary way parents interact with their local leaders or communicate with other community members. No one could reasonably argue that this right is unlimited, but neither is the government’s authority to restrict it.”

The opinion came after school boards in various parts of Florida and the country have become battlegrounds during the past few years about contentious issues such as restricting or eliminating access to certain school-library books.

The Brevard County chapter of Moms for Liberty, a conservative group, and individual plaintiffs filed the lawsuit in 2021 alleging that school-board policies chilled speech at meetings. Wilson, who dissented on one part of Tuesday’s majority opinion, wrote that the case stemmed from incidents that occurred from Jan. 19, 2021, to Oct. 26, 2021.

The majority opinion said the government “has relatively broad power to restrict speech” in what are known as limited public forums, such as school board meetings. But it said that “power is not unlimited.”

“Speech restrictions must still be reasonable, viewpoint-neutral, and clear enough to give speakers notice of what speech is permissible,” Grant wrote. “The board’s policies for public participation at board meetings did not live up to those standards.”

“At one meeting, for example, she interrupted a speaker who criticized the board’s COVID-19 masking policy as a ‘simple ploy to silence our opposition to this evil LGBTQ agenda,’” the majority opinion said. “Belford quickly stopped the speaker, who had not yelled, screamed, or otherwise caused a disruption. In her affidavit (in the lawsuit), Belford explained that she interrupted him because his ‘characterization of people as ‘evil’ was abusive.’ ,,, No one likes to be called evil, but it is not ‘abusive’ to use that term. Restrictions that bar offensive or otherwise unwelcome speech are impermissible, regardless of the forum in which the government seeks to impose them.”

As another example, the appeals court said the policies did not include a definition of “obscene.” It said the school board “used its obscenity policy to bar protected speech, and it did so in a way that impeded the purpose of a school board meeting.”

As an example, the opinion said a Moms for Liberty member was interrupted at a school-board meeting while reading from a book that was in an elementary-school library. The book included a description of a sexual encounter and a profanity.

“It would be difficult, if not impossible, for speakers to adequately air their concerns about a particular book without informing both the board and the community about what that book says,” Grant wrote. “Describing the content of a book is not as potent as reading its words — nor is it as informative. And it is remarkable for the board to suggest that this speech can be prohibited in a school board meeting because it is inappropriate for children when it came directly from a book that is available to children in their elementary school library.”

Wilson dissented on part of the opinion that addressed a policy about speech “personally” directed at other people. That policy was revised during the legal battle, and Wilson said he would find the current policy constitutional.
