BARKTOBERFEST SO FUN, IT'S SCARY!

Start picking out costumes for you and your fourlegged friend and join other dog lovers on October 27 for the Pensacola Humane Society’s (PHS) 2024 Barktoberfest celebration.

It’s the biggest and best petfriendly festival on the Gulf Coast, serving as one of the most entertaining, silly and educational events of the year. Best of all, there’s no admission fee. The fun starts at 10 am and continues until 4 pm under the shady oaks of Seville Square in downtown Pensacola.

What To Expect:

Attendees of the Pensacola Humane Society’s Barktoberfest can a fun filled day of excitement for both dogs and their owners. Show off your pup’s skills in the Best Trick Contest or dress up together for a chance to win the Doggy/Owner Look-alike Contest. Get creative with your canine’s costume and compete in the Best Costume Contest or let your speedy pooch race in the small dog races. Capture memories with a photo of you and your furry friend and challenge your dog to tackle the obstacle course, ball pit or treat

walk. The event will also feature face painting, K9 demonstrations, a petting zoo and plenty of other activities for all ages to enjoy.

Founded in 1943, PHS is approaching its 82nd anniversary. The organization became a no-kill facility in 1988 and has since, received numerous rewards and recognition from national animal rescue associations. Today, PHS works cooperatively with Escambia County Animal Shelter and Santa Rosa County Animal Shelter.

PHS has developed an excellent working relationship with the Jacksonville Humane Society, one of the foremost animal rescues in the entire country. Members of the PHS staff have undergone stateof-the-art training at Jacksonville Humane Society, giving them a unique perspective and fresh ideas that help PHS fulfill their mission. Additionally, PHS is actively involved with Everett Animal

Welfare Group by providing their fully-equipped Tag and Release van to safely transport community cats for spay and neuter services.

There’s no such thing as an ordinary day at PHS. Here are a few of their accomplishments:

PHS cares for an average of 100 animals on site and in foster homes.

Since June 2023, PHS had 764 pet adoptions.

To date, PHS has assisted with 645 cat spay/neuter procedures by providing transport to surgical clinics through a partnership with Everett Animal Welfare Group.

PHS provided 7,500 pounds of dog and cat food through its Pet Pantry to people in need, allowing for nearly 30,000 meals since October 2023.

Since August 2023, PHS has assisted Escambia County and Santa Rosa County animal shelters by transferring 143 dogs and cats to its shelter for care and adoption.

In May 2024, PHS reopened their surgical suite and to date, completing 210 surgeries/alterations on animals in their care.

The result of all this hard work is a 97.9 percent save-rate (as of August 31, 2024).

With an army of dedicated volunteers and a well-trained staff of 22, including vet techs and veterinarians, PHS provides the best possible care and endless love for homeless, abandoned and neglected animals. PHS offers volunteer training opportunities for those looking to get involved.

PHS also has an active foster program which gives the animals a chance to get a break from shelter life and become more adoptable. PHS provides fosters with food, bedding and toys and also pays for the animal’s medical expenses. If you would like to become a PHS Foster, you can sign up at their volunteer booth at Barktoberfest.

Recently, PHS was commended by Best Friends, the nation’s largest sanctuary for homeless animals, as a no-kill shelter by exceeding a 90 percent save rate for cats and dogs in 2023.

In recognition of Children's Grief Awareness Month in November, Valerie’s House (VH) is offering opportunities to learn more about children’s grief and how to support children who are grieving. Throughout the month of November, VH is committed to providing essential tools and resources aimed at fostering a more grief-informed society. Together we can collectively help alleviate the pain and isolation that children who are grieving often experience.

Children's Grief Awareness Month serves as a poignant reminder of the importance of acknowledging and supporting children who are grieving and their families. One in 11 children in Escambia and 1 in 14 in Santa Rosa County will experience the death of a parent or sibling by the age of eighteen. This devastating event can lead to negative life-altering consequences, including a 5x heightened risk of depression, substance abuse, and engaging in harmful behaviors. These risks are exacerbated for children from low socio-economic and racial minority backgrounds where parental death is 2-5x more common than the national average.

How can your family or organization learn more about children’s grief services and support VH?

COUNTY VETERANS SERVICES OFFICE ADVOCATES ON BEHALF OF LOCAL VETERANS

For veterans trying to navigate the process of getting benefits through the United States Department of Veterans Affairs, or VA, it can easily become overwhelming and confusing.

Escambia County resident and Navy Veteran Michael O’Neal, age 74, was struggling to get a benefits claim approved through the VA for knee surgery – until a friend told him about Escambia County’s Veterans Services Office.

“I had a documented injury that occurred while on active duty, and the VA kept denying me,” O’Neal said. “But these folks were able to put it together in such a way that they pretty much couldn't say no.”

The Escambia County Veterans Services Office consists of two Veterans Services Officers, Stevan Davis and Lisa Horan, who are accredited with the VA and experienced with helping veterans and their dependents navigate the VA benefits process.

Both veterans themselves, Davis and Horan are committed to working with veterans, their spouses, and dependents to file claims for benefits they are entitled to, acting as an advocate for them throughout the process. Most importantly, the Escambia County VSO provides these services to veterans completely free of charge.

“The veterans already paid for their benefits with their service, so why should anybody else get paid for what they’ve already paid for?” said Davis, who retired from the Air Force after 23 years of service.

“We come across people who have done great things and have never asked anything back from their country.”

With a significant veteran population in Escambia County, the VSO stays busy, seeing approximately 65 veterans per week, in addition to outreach events, home visits, and numerous emails and phone calls for assistance. What was once a one-person office has now expanded to two Veterans Services Officers and one administrative assistant.

O’Neal said he worked with another agency before discovering the Escambia County Veterans Services Office, and the difference has been “night and day.” He retired from the Navy after 22 years of service, which included serving on Guam during the Vietnam War. O’Neal has experienced numerous health issues from exposure to Agent Orange, leading to various medical claims filed through the VA.

“We were able to get things accomplished with the VA that had not been able to get done before,” O’Neal said. “They just seem to do better work than anybody ese. They really care about us veterans – there’s no way you could possibly say enough good about them.”

JOYFUL NOISE!

GOSPEL CELEBRATION TO FEATURE NEW YORK’S SING HARLEM CHOIR IN NOVEMBER

WSRE PBS has been awarded a Foo Foo Festival grant to present a three-day music event highlighted by the award-winning gospel choir Sing Harlem and a regional gospel competition. The Joyful Noise! Gospel Celebration will be Nov. 8-10 with a student workshop at Dixon School of Arts & Sciences, the Joyful Noise! Gospel Competition at Pensacola High School, and a champagne brunch featuring Sing Harlem in concert at Lily Hall in Downtown Pensacola.

Under the direction of Ahmaya Knoelle Higginson, Sing Harlem is an influential force in the New York gospel scene. The musical group, from Mama Foundation for the Arts, performs across America and starred on the 17th season of “America’s Got Talent.”

Higginson’s mother is Vy Higginsen, the producer, author, playwright and broadcaster who founded Mama Foundation for the Arts with its mission “to make a joyful noise, to uplift the Black musical treasures of gospel, jazz and R&B, and to heal and inspire through the power of collective music-making.”

The mother-and-daughter team will conduct the educational workshop at Dixon School of Arts & Sciences on Nov. 8, judge the gospel competition on Nov. 9, and appear with Sing Harlem at the gospel brunch on Nov. 10.

Choirs can enter The Joyful Noise! Gospel Competition by submitting videos that follow contest regulations. The deadline for submitting video entries is Sunday, Sept. 1. Contest rules and video submission requirements are on the WSRE PBS website at wsre.org/joyfulnoise.

WSRE PBS will round out the weekend-long celebration with a gospel brunch, featuring event headliner Sing Harlem in concert, on Sunday, Nov. 10, from 12 p.m. to 2 p.m. The menu will be curated by Brother Fox Executive Chef Darian Hernandez and served, church social style, on the lawn at Lily Hall — the boutique hotel whose landmark structure was built in 1928 for the Mount Olive Baptist Church congregation. Tickets will be $125 and on sale beginning Sept. 10. Sunday best attire is suggested.

About Sing Harlem

Sing Harlem is a choir and social impact initiative for young people who have graduated from the Mama Foundation for the Arts’ music training program. The choir is led by Ahmaya Knoelle Higginson. Sing Harlem performs at prestigious venues nationwide and all proceeds from their events and performances benefit the Mama Foundation’s tuition-free music training programs for the Harlem community. The choir has performed on “The Tonight Show Starring Jimmy Fallon,” “Saturday Night Live,” “The View,” “Good Morning America,” “America’s Got Talent,” “The Kelly Clarkson Show,” and the Grammy Awards. In March 2024, Sing Harlem received a standing ovation from the audience and a “YES” from all three judges on “America’s Got Talent” for their performance of “Amazing Grace.”

About Foo Foo Fest

Davis and Horan both emphasized that because they don’t work for the VA, their focus is on helping veterans file the best possible claim to receive the benefits they have earned through their military service.

“I’m your advocate,” said Horan, who served in the Marine Corps for seven years.

“I’m a veteran, just like you. I work for you – I don’t work for the VA. Pretty much anything related to veterans, we’re going to do it if we know how to do it. If we don’t know how to do it, we’re going to find out how.”

The Escambia County VSO can assist veterans and their dependents with a variety of benefit claims, including medical treatment, disability compensation, vocational rehabilitation, pensions, life insurance, burial claims, survivor benefits and more. Working closely with community partners including Waterfront Mission, Volunteers of America, and 90Works, the VSO also helps connect homeless veterans with available resources.

The VSO aims to make services as accessible as possible, visiting nursing homes throughout the county in addition to conducting home visits when the veteran or dependent cannot travel to the office.

As certified VSOs, Davis and Horan have access to the VA’s claims system, which provides them valuable information that can help when filing claims for veterans.

“That’s a huge benefit to us,” Horan said.

“We have insight that the veteran doesn’t have.”

Although they can’t ensure every claim will be approved by the VA, Davis and Horan said they work hard to listen to veterans, gather the right information for their claim, and connect them with their benefits to the best of their ability. The most rewarding part for both of them is just being able to help veterans, many of whom express their appreciation through thank-you cards, letters of appreciation, or even through hugs and tears.

“Just seeing people get help is so rewarding, even if it's a smaller claim,” Davis said. “For example, you get a guy who gets 10% for his hearing loss, he’s getting $171 a month, but he’s happy and thankful and comes and thanks you because now he gets hearing aids. And before, he couldn’t hear because he couldn’t get hearing aids – he couldn’t afford the $10,000 for a set of hearing aids.”

“That’s the great part of the job,” Horan said. “That’s what keeps us going.”

From the video entries, 10 choirs will be selected to compete in person on Saturday, Nov. 9, at the Pensacola High School auditorium. The gospel competition event will be held from 12 p.m. to 5 p.m. with performances by Sing Harlem and the local praise dance troupe Soulful Movement: Spirit of Excellence, food trucks, and a brief film screening of the PBS documentary “Gospel” from Henry Louis Gates Jr. — the original impetus for the overall gospel celebration.

Foo Foo Fest is a 12-day celebration each fall, with culturally creative happenings, events and moments under one banner, attracting visitors to Pensacola. The 2024 festival takes place from October 31 through November 11. About WSRE

PENSACOLA BEACH LIFEGUARDS SHIFT TO WINTER STAFFING, TOWERS OFF THE BEACH

Pensacola Beach Lifeguards have shifted to winter staffing levels. Accordingly, lifeguard towers have been removed from the beach until the 2025 lifeguard season. Lifeguards will maintain a presence on Pensacola Beach throughout the winter at Casino Beach and via patrol vehicles.

Residents and visitors are urged to exercise caution when visiting the beach and swimming in the Gulf, especially when lifeguards are not present.

The Pensacola Beach Lifeguards will be holding tryouts on Dec. 7 and 8 at the UWF Aquatic Center. Instructions on how to apply to become a Pensacola Beach lifeguard will be given at the tryouts. Follow the posted beach condition flag warnings accordingly:

• Green flag - Low Hazard: Generally calms surf and currents

• Yellow flag - Medium Hazard: Moderate surf and/or currents

• Red flag - High Hazard: High surf and/or dangerous currents; beach patrons are

encouraged to remain out of the water Double red flag - Water Closed: No swimming or wading

• Purple flag - Stinging Marine Life: Flown when jellyfish, Portuguese man o'war or other stinging marine life are present Follow all Pensacola Beach rules, including:

• Glass containers are not allowed on the beach.

• The west side of the Pensacola Beach Gulf Pier is an alcohol-free zone. Open containers are not allowed off the boardwalk or outside any establishment.

• No alcohol can be consumed in any parking lot on Santa Rosa Island.

• Dogs other than service animals are not permitted on any of the beaches except in designated dog parks.

West Florida Public Libraries is excited to announce its Día de los Muertos (Day of the Dead) Community Celebration Exhibit, a tribute honoring and remembering departed loved ones. The exhibit is open to the public starting Monday, Oct. 21 through Saturday, Nov. 2 at the Pensacola Library, located at 239 N. Spring St. At the exhibit, attendees can fill out a butterfly card to share memories of their loved ones on the butterfly wall. Each butterfly will become part of the exhibit, symbolizing the community's collective recognition of their loved ones. The exhibit will also feature items commonly associated with Día de los Muertos and their meanings, providing attendees with a deeper understanding of the traditions that honor the deceased. In

addition, attendees can take home Día de los Muertos recipe cards to bring the flavors of the celebration into their own homes.

A special family storytime has also been scheduled at the Pensacola Library at 10:30 a.m. on Oct. 23 and 30, featuring guest speaker Grace Resendez-McCaffery, President of Latino Media Gulf Coast.

Día de los Muertos is a Mexican holiday celebrated each year on Nov. 1 and 2. WFPL's exhibit serves as a cultural and educational opportunity, offering insights into the significance of the holiday.

LEGAL SERVICES OF NORTH FLORIDA ANNOUNCES HEADLINERS FOR 2024 JAZZ FOR JUSTICE EVENT

Get ready to groove at the annual Jazz for Justice event hosted by Legal Services of North Florida (LSNF), a 2024 Pensacola Foo Foo Festival grant recipient where music meets community spirit. Returning for an additional year as part of the eleventh annual Pensacola Foo Foo Festival, this highly anticipated event will occur on Sunday, November 10, 2024, from 1:00 p.m. to 5:00 p.m. at Museum Plaza, located at 120 Church St., in the heart of Historic Downtown Pensacola. This year’s event promises an unforgettable afternoon of vibrant New Orleans jazz, mouth-watering food, local vendors, and family-friendly activities. Best of all, admission is free, making it accessible to all who want to enjoy the lively atmosphere and support a great cause.

Jazz for Justice serves as the grand finale of Pensacola’s renowned Foo Foo Festival, combining world-class musical performances with community engagement. As the music reverberates through the scenic Museum Plaza, attendees will also have the opportunity to support the vital legal services provided by LSNF, which offers access to justice for those in need throughout North Florida.

Headline Performers: A Showcase of Talent

This year’s lineup is nothing short of spectacular, featuring:

• Kermit Ruffins – Known for his ebullient personality and his deep roots in New Orleans jazz, trumpeter and vocalist Kermit Ruffins is a must-see performer. Whether he's slinging barbecue at his Mother-in-Law Lounge or playing on stage, Ruffins delivers energy and joy, embodying the spirit of the Big Easy. Ruffins has a storied career, from founding the Rebirth Brass Band to his appearances on HBO’s Treme. Prepare for a musical journey packed with swing, traditional jazz, and a few surprises along the way.

• Flow Tribe – Bringing their signature blend of funk, soul, and New Orleans rhythm, Flow Tribe is set to electrify the crowd. With high-energy performances that have graced stages from festivals to intimate venues, this band has earned a reputation for getting audiences on their feet. Their collaboration with hip-hop legend Mannie Fresh on the 2017 album "BOSS" cemented their place in the New Orleans music scene.

Escambia County is excited to announce this year's Peanut Butter Challenge, an annual jar collection for local food pantries hosted by UF/IFAS Extension and Florida A&M University Cooperative Extension. Launched in the Florida Panhandle counties in 2012, the challenge is again spreading statewide this year.

Coordinated by UF/IFAS Extension and FAMU faculty, staff and volunteers, the competition among counties – for bragging rights only – was conceived as a way to feed hungry families ahead of the holidays in addition to promoting a Florida-grown crop. The peanut, which is produced mainly throughout the northern regions of the state, contributed $137 million to the state economy in 2023, according to the Florida Agricultural Statistics Service.

Peanut butter is an ever-popular item in food pantries because of its nutrient density and shelf stability. The project took on new meaning in 2020 as it spread statewide for

the first time as demand for food bank assistance had increased as an economic effect of the COVID-19 pandemic. The latest numbers from the United States Department of Agriculture shows food insecurity affected roughly 12 percent of Floridians in 2023.

In addition to the community donations, the Florida Peanut Producers Association and Florida Peanut Federation have partnered with the project for years. These organizations are based in the northwest and northeast peanutproducing regions of the state and will again contribute to the totals distributed to food pantries in those regions.

NYYC AMERICAN MAGIC WOMEN FALL SHORT IN QUALIFYING AT PUIG WOMEN’S AMERICA'S CUP

Despite flashes of quality, the American Magic Women’s team fell short of qualifying for the final series at the Puig Women’s America's Cup. Finishing 5th in Group A, the team was unable to secure a spot in the top three needed to progress. While their performance in the final races showed significant improvement, the damage had already been done on the opening day, leaving them with too large a points deficit to overcome.

Over the first four races on Day 1, the American Magic Women demonstrated moments of promise but also made costly errors. Despite their clear potential, the team was left playing catch-up after a day of fifth- and sixth-place finishes. "It wasn’t the start we wanted, but we know there’s a lot more in this team," said Erika Reineke, helm. The team used the time between races to regroup, analyze their performance, and tighten their maneuvers for the remaining races. However, they were facing an uphill battle.

Determined to bounce back, the American Magic Women returned on Race Day 2 with renewed focus. Their third-place finish in the day’s single race showed marked improvement and kept their slim qualifying hopes alive. However, with only one race completed due to weather, there was little time to close the gap to the top teams. "We sailed well today and gave ourselves a chance; we just needed to keep aiming for wins and see if it would be enough to qualify," said Francesca Clapcich, helm.

As light air persisted into Day 3, the team’s chances of qualifying slipped away. With only one race remaining, American Magic was math-

ematically eliminated from contention. Still, the team showed their fighting spirit, leading Race 6 before it was abandoned due to unstable conditions. In the restart, the team sailed well to finish third, but it wasn’t enough to change the outcome. Though they ended the regatta on a higher note, the early mistakes had left them with too much ground to make up.

Finishing 5th in the qualifier series is disappointing for a team that had its sights set on advancing to the finals. However, there were positives to take from their performance, especially their improvement over the final two days. The American Magic Women fought hard and represented the United States, the New York Yacht Club, and American Magic with resilience and pride. Still, this campaign serves as a reminder that there’s no margin for error at this level of competition.

Looking ahead, the team will take the lessons from this regatta and apply them as they continue to grow and develop. Their potential is clear, and with more time together, there’s every reason to believe they’ll come back stronger in future competitions.

COURTS GRAPPLE WITH GUN AGE LAWS

With a federal appeals court poised next week to hear a challenge to a Florida law that bars people under age 21 from buying rifles and other long guns, the U.S. Supreme Court on Tuesday at least temporarily allowed a Pennsylvania gun restriction on young adults.

The Supreme Court overturned an appeals-court ruling that blocked a Pennsylvania law preventing people under age 21 from carrying guns during declared emergencies.

While the specifics of the Florida and Pennsylvania laws differ, both cases involve Second Amendment challenges to gun restrictions for people ages 18 to 20. Both also focus heavily on how to interpret Supreme Court precedents and the “historical tradition” of gun regulation.

In its ruling Tuesday, the Supreme Court did not explain its reasons but sent the Pennsylvania dispute back to the 3rd U.S. Circuit Court of Appeals “for further consideration in light of” a Supreme Court opinion this summer in a Texas gun-rights case. In that case, known as United States v. Rahimi, the Supreme Court backed a ban on gun possession by people under domestic-violence restraining orders.

The 11th U.S. Circuit Court of Appeals, which will hear arguments Tuesday on the Florida law, put the case on hold until after the Supreme Court ruled in the Rahimi case. Attorneys for Florida and the National Rifle Association, which is challenging the constitutionality of the Florida law, have filed briefs in recent months addressing how the Rahimi opinion applies — or doesn’t — to the case.

In a brief filed last month, the NRA also cited the 3rd Circuit’s decision in the Pennsylvania case to help support its challenge to the Florida law.

Then-Gov. Rick Scott and the Republican-controlled Legislature in 2018 barred people under 21 from buying rifles and other long guns after Nikolas Cruz, who was 19 at the time, used a semiautomatic rifle to kill 17 students and faculty members at Parkland’s Marjory Stoneman Douglas High School.

Federal law already prevented people under 21 from buying handguns.

While the state law prevents people under 21 from buying long guns, it allows them to receive the guns, for example, as gifts from family members.

The NRA filed a lawsuit challenging the constitutionality of the law, but Chief U.S. District Judge Mark Walker upheld the age restriction. A three-judge panel of the 11th U.S. Circuit Court of Appeals also upheld the law, but the NRA asked the full appeals court to consider the case. The full court will hold what is known as an “en banc” hearing Tuesday in Atlanta.

A key to the case could be how the appeals court interprets the Rahimi decision and a 2022 U.S. Supreme Court opinion in a case known as New York State Rifle & Pistol Association v. Bruen, which said gun laws must be “consistent with this nation’s historical tradition of firearm regulation.”

The NRA has argued that the Bruen decision prevents the Florida law.

“This law is unconstitutional. The Second Amendment’s text protects young adults’ right to purchase a firearm, and the state has not proven that the ban is consistent with our nation’s historical tradition of firearm regulation. The young adult ban cannot stand,” a July NRA brief said.

But in an August brief, attorneys for the state cited the Rahimi opinion in arguing the appeals court should uphold the Florida law.

“In upholding a law that disarmed an individual subject to a domestic-violence restraining order, the (Supreme) Court was careful not to ‘suggest that the Second Amendment prohibits the enactment of laws banning the possession of guns by categories of persons thought by a legislature to present a special danger of misuse,’” the state brief said, partially quoting the Rahimi opinion. “Whatever might be said about other legislative categories, or of a general ban on possession, the history shows that it is at least permissible to restrict firearm purchases by those under the age of 21, who are still free to exercise their Second Amendment rights by obtaining arms from more mature adults.”

STATE DENIES ABORTION CLINIC LICENSE

The Florida Agency for Health Care Administration on Friday denied a license for a new Pensacola abortion clinic, rejecting a recommendation by an administrative law judge who said the application should be approved.

Agency Secretary Jason Weida signed a 49-page final order that cited a “pattern of deficient performance” at a now-closed Louisiana clinic with ties to the proposed Pensacola facility.

Administrative Law Judge Yolonda Green on Aug. 28 recommended that a license should be issued to July Medical Services, LLC, which applied in March 2023 to operate a clinic that would provide abortions and other services, such as ultrasounds, contraception and counseling.

July Medical Services, which does business as Hope Medical of Pensacola, sought a hearing before an administrative law judge after the Agency for Health Care Administration said last year it would deny the license. Under administrative law, Green’s ruling was a recommended order that had to go back to the agency for a final decision.

Friday’s final order focused, in part, on the similarly named June Medical LLC, a longtime Shreveport, La., clinic that closed in 2022. The Agency for Health Care Administration last year reached out to the Louisiana Department of Health, which provided documents about deficiencies and alleged deficiencies at the Shreveport clinic from 2004 to 2021.

In her recommended order, Green said Louisiana citations against the clinic “consisted of lack of documentation in personnel files, lack of board meeting minutes, and inadequate documentation to verify physician's orders failed to demonstrate diligence. Most of these violations were non-repeated offenses.”

She also cited an incident in which the clinic did not report to authorities that a 14-year-old patient had been impregnated by a 17-year-old, a crime in Louisiana. But Green said that “incident alone is not sufficient to establish a pattern of deficient performance.”

Friday’s order, however, said that the violations “reflect a clinic that, over the course of many years, could not get its act together. The agency concludes that these violations constitute a demonstrated pattern of deficient performance.”

WARY OF LOWER WORKERS' COMP RATES

Pointing to issues such as heavy demand for repairs after hurricanes and an increase in young, inexperienced workers, a roofingcontractors industry group Tuesday argued against lowering workers’ compensation insurance rates for roofers.

Leaders of the Florida Roofing and Sheet Metal Contractors Association urged state regulators to freeze the roofing industry’s rates, rather than approve a decrease that would take effect in 2025.

The arguments came during a hearing held by the Florida Office of Insurance Regulation to consider a proposal to reduce rates for employers by an overall average of 1 percent.

While it might seem counterintuitive for an industry group to oppose reducing rates, leaders of the roofing contractors association — which has a self-insurance fund — expressed concerns about stability and a potential increase in future claims.

“FRSA believes that considering recent hurricanes and those over the past few years, we will begin to see more inexperienced labor hired as contractors struggle to keep up with the growing demand for work,” Lisa Pate, the association’s executive director, said. “Many older workers are retiring, and the pull for younger employees who want to work on roofs is dwindling. This trend will place more inexperienced workers on roofs and job sites and open contractors up to additional exposure. It’s only a matter of time before injuries and claims increase and rates swing in the opposite direction. Consistency in the rates will help mitigate this exposure.”

The National Council on Compensation Insurance, better known as NCCI, proposes rates each year to regulators for the workers’

compensation insurance industry. In August, NCCI proposed an overall average 1 percent decrease for 2025, seeking to continue a string of years of reduced rates.

As an example, regulators approved a 15.1 percent decrease that took effect this year and an 8.4 percent decrease that took effect in 2023.

During Tuesday’s hearing, NCCI officials presented their 2025 proposal. A summary released in August by NCCI described the workers’ compensation system as “healthy” and said that while “consumer inflation has been elevated, the inflation for workers’ compensation medical costs remained stable.” It also said a combination of continued claims “frequency declines and moderate benefit costs at or below the level of wage growth, have continued to put downward pressure on overall WC (workers’ compensation) system costs relative to collected premiums.”

But the proposed overall 1 percent decrease reflects numerous types of employers. Pate said what is known as a roofing rate “class code” would see a 7.89 percent decrease. She described such a rate as “unsustainable.” Tuesday’s hearing came six days after the Category 3 Hurricane Milton made landfall in Sarasota County and caused property damage across the state. It also came after Hurricane Helene caused widespread damage in September.

“Our experience has taught us that immediately after a hurricane, the large influx of inexperienced workers into potentially insecure environments can quickly lead to an increase in claims costs,” Debbie Guidry, administrator of the association’s self-insurance fund, said.

It was not immediately clear Tuesday when regulators will decide whether to approve the NCCI proposal or require changes.

GAS PRICES STABLE AS STATIONS STILL SHUTTERED

Average gasoline prices in Florida remained stable during the past week despite increased demand in the run-up to Hurricane Milton and as hundreds of stations are still without electricity after the storm.

When pressed, he responded that, “we just have to be careful before we're saying, ‘Do this or do that.’”

“You have to figure out, OK, how much do you want to be dictating from the state, or how much do you want to just work collaboratively on some of this stuff," DeSantis said.

The final order focused on the role of July Medical Services owner Michael Rothrock, whose late mother, Robin Rothrock, founded the Louisiana clinic about 1980 and operated it until she died in 2010, according to Green’s recommended order. Ownership of the Louisiana clinic went to Robin Rothrock’s estate, with her son becoming executor in 2011.

Also, the final order focused on the role of July Medical Services’ administrator, Kathaleen Pittman, who served as administrator of the Louisiana clinic.

As an example, the order said the agency concluded that the Louisiana clinic’s activities were “imputable” to Michael Rothrock. It said the clinic’s “pattern of deficient performance constitutes an ‘action’ by Mr. Rothrock as a controlling interest of July Medical. June Medical’s demonstrated pattern of deficient performance is therefore legally sufficient grounds to deny July Medical’s license application.”

But in her August recommended order, Green concluded that “AHCA failed to demonstrate that any ‘pattern of deficient performance’ on the part of June Medical, a separate entity, should be attributed to July Medical. Therefore, the license should be issued.”

“The operation history of June Medical raises some concerns about their compliance with state regulations,” Green wrote. “It also raises concern about the safety of patients. However, based on the evidence of record, there was no threat or actual harm to patients. All the deficiencies proven were corrected. Based on the foregoing, the competent substantial evidence establishes that June Medical’s Louisiana deficiencies did not establish a pattern of deficient performance.”

Friday’s final order, which can be appealed, came amid a fierce political battle in Florida about abortion issues. Voters in November will decide whether to pass a ballot initiative, known as Amendment 4, that would enshrine abortion rights in the state Constitution.

Gov. Ron DeSantis, who last year signed a law that prevents abortions after six weeks of pregnancy, is helping lead efforts to fight the ballot initiative. Also, the Agency for Health Care Administration has been embroiled in a controversy about information it has posted about abortion on a website and in video public-service announcements.

Critics contend the information is biased and inaccurate and is part of efforts to defeat the ballot initiative. The agency has contended the information presented facts.

Gov. Ron DeSantis said Monday his office will look at a “loophole” in a state law about electric generators at gas stations, though he stopped short of saying the law would be changed. Meanwhile, the AAA auto club said “conditions are improving,” with all but two gas terminals at Florida ports reopened to load tanker trucks.

GasBuddy, an online site that tracks gas prices, said Monday afternoon that 17.5 percent of the 7,915 gas stations in Florida did not have fuel, with half of the stations in the Tampa to Sarasota region out. In the Fort Myers and Naples region, 20.8 percent of the stations didn’t have fuel. In the region from Orlando to Daytona Beach, 17.9 percent of stations did not have gas, while Gainesville still had about 16.5 percent of stations out.

Noting the number of stations that were unable to quickly reopen, DeSantis over the weekend was critical that many didn’t have generators to resume operations.

“A lot of these gas stations, quite frankly, are supposed to have generators. Very few of them have used them that I've seen, especially in the areas that were the hardest hit,” DeSantis said during an appearance Saturday in Plant City.

Florida law requires most stations to be able to run on generators, while requiring gas-station chains to have at least one portable generator for every 10 fuel outlets they own in a county.

While at Port Manatee on Monday, DeSantis described the law as a “loophole,” adding “we'll look at that and see if anything needs to be addressed.”

"And to say we're just going to mandate almost anything. I don’t know that that’s necessarily the best approach,” DeSantis continued. “The fact is these are private businesses; the fuel supply is a private sector. We are not Venezuela.”

AAA said Monday the average price of a gallon of regular unleaded in Florida was $3.10, the same as a week earlier and down 3 cents from a month ago. Milton made landfall Wednesday night as a Category 3 hurricane in Sarasota County and caused extensive damage along the Gulf Coast and in Central Florida.

Patrick De Haan, head of petroleum analysis at GasBuddy, said in a statement Monday that Milton is not affecting prices nationally, and the situation in Florida is expected to improve. The national average price Monday was $3.20 a gallon, according to AAA.

“With restoration happening in Florida, we could start to see a decline in gas prices in the weeks ahead, with a good chance of seeing the first sub-$3 per gallon national average since 2021,” De Haan said.

To offset delays in fuel shipments last week, the state over the weekend started to offer motorists up to 10 gallons of free gas at sites in Bradenton, Plant City, St. Petersburg, Sarasota, Arcadia, Port Charlotte, North Port, Tarpon Springs, Port Richey and Tampa. The sites remained open Monday.

On Monday, DeSantis said 2.4 million gallons of gas had been distributed from state reserves.

In addition to the free fuel, the state also has been rerouting fuel trucks to stations that were opened but ran out due to demand.
