MARITIME PARK EXPANDS WITH NEW HOTEL AND LUXURY APARTMENTS

Anew development is in the works that will permanently change the skyline of downtown Pensacola. Pensacola’s Community Maritime Park will see significant changes with the recent approval of plans for a REVERB by Hard Rock® hotel and a new 12-story luxury apartment complex

The recently announced project will bring a dynamic mix of entertainment, hospitality and residential options to downtown Pensacola.

Spearheaded by The Dawson Company (doing business as Inspired Communities of Florida), the mixed-use development was approved by the Pensacola City Council in August, and is now in its planning phase.

The Dawson Company is a second-generation real estate development firm that has worked on a variety of projects throughout the country, including here in Pensacola. The company has played a major role in the development of other properties throughout the city, including the Maritime Park Office Building, Southtowne Apartments, the Urban Core Office Building and The 52 World.

“We used to focus on larger markets, such as Atlanta, which is where we started, and we've done pretty big developments across the country. Now, our focus has transitioned to tertiary and quaternary markets. We’ve done some work in Cincinnati, we looked at Baltimore and we're potentially doing some work in Rochester and Huntsville, and, of course, Pensacola. In terms of our role in the maritime park development, we are the lead developer and owner for that development. We won the rights to lot numbers three, four, five, six and eight,” President and COO of The Dawson Company Tamara Bowens said.

The council voted 7-0 to approve the 100-year lease after adding an amendment that requires at least 70 percent of the street-level of the building to be "activated" with some type of retail or office use, including "pop-up" retail that could be removed in the event of severe weather.

The hotel and apartments will be located on lot five, situated next to the Blue Wahoos Stadium. The Dawson Company originally won the rights to build in Maritime Park back in 2020, but the project was delayed due to COVID-19. The final cost of the project is still to be determined.

“We just got our final blessing from the city on August 8 and now, we are in the process of actually signing the lease agreement for lot five and pricing everything out,” Bowens explained.

Some of The Dawson Group’s partners in this project include the renowned global architecture firm Gensler and interior design consultant Kravitz Design, a global conceptual design firm helmed by music and style icon Lenny Kravitz.

Development partners also include Emmitt Smith of EJ Enterprises and Thornton Toma setti, who will provide specialized expertise in mass timber design and engineering. The properties will be constructed using mass timber, which is an eco-friendly building method that promotes a net-zero carbon footprint.

The REVERB by Hard Rock will serve as the property’s central attraction, offering upscale accom modations with sweeping views of Pensacola Bay. This 125 to 150-key hotel will feature all of the staples of Hard Rock Hotels, with a modern twist.

REVERB is Hard Rock Interna tional’s trendy and tech-forward hotel brand concept designed with the modern traveler in mind.

Hotel features include technologyenhanced rooms and designated spaces for both work and play.

The hotel will also offer a variety of dining options, including a rooftop bar, a cafe and fast-casual dining spot.

“It will have an RT60, which stands for Rooftop 60, and is part of the Hard Rock brand. If you visit any of their hotels, you’ll find an RT60 there. We’re definitely going to have that at the REVERB hotel and it’s the only restaurant or dining concept that is certain. There will also be a Constant Grind, which is another Hard Rock concept that will be located inside the hotel. It’s a casual sit down or grab-and-go venue that also serves coffee and espresso specialty drinks,” Bowens explained.

Apart from dining options, other hotel amenities will include a rooftop terrace with a bar, fitness and wellness centers, swimming pools and a variety of entertainment

from a music perspective. We really want to create more cultural experiences centered around music,” Bowens said.

The proposed multi-story luxury apartment complex will be situated next to the hotel on lot five. The multi-story building will have at least 240 units. “The way the process works is we have a vision of what we want the property to look like and how we want it to be situated on the lot. From there, we work with Gensler to determine what the unit mix is and how many units there will be. We definitely know we'll have a minimum of 240, but it could be more than that,” Bowen said.

Similar to the hotel, the apartment complex will boast luxury amenities including a rooftop terrace, a co-working space, a coffee bar, a swimming pool and a commercial-grade gym. Bowens describes the planned fitness facil

Being that the completion of the project is still a few years out, the expected pricing for rent is not available yet. However, Bowens explained that the developers will also use the Florida Live Local Act to have mixed-income housing, with 40 percent of the units priced affordably for individuals who make between 80 percent and 120 percent of the area median income for the Pensacola area. Rent prices will be announced at a later date. The anticipated groundbreaking date for the project is 2026, with a projected opening of 2029, according to Bowens. ART AUCTION TO SUPPORT ASHEVILLE ARTISTS AFFECTED BY HURRICANE HELENE

The Pensacola art community invites you to a special inspiring evening of art and community at the "Artists for Asheville" benefit, raising money for Western North Carolina artists who lost their studios, materials, artwork – and livelihoods – during Hurricane Helene.

The event will be held at Coastal County Brewing (3041 E. Olive Rd., Pensacola, FL 32514) on Sunday, November 10, 2024 from 5 p.m. to 9 p.m. All proceeds from the evening will go directly toward helping Trackside Studios’ nearly 60 artists rebuild in the heart of Asheville’s River Arts District (RAD), which suffered severe damage during flooding.

"As artists, it's essential that we stand together in times of crisis, even when we don't personally know those affected,” said Serena Altarac, owner of The Grove and “Artists for Asheville” planner. “This art benefit is a powerful opportunity for Pensacola to rally behind the artists in Asheville who lost everything, reminding us how vital creative expression is in fostering resilience and healing.”

The aftermath of Hurricane Helene on August 27, 2024 was nothing short of apocalyptic, leaving Asheville and much of the surrounding region unrecognizable. A once-in-1,000-year event, Helene brought catastrophic damage to an area that never expected such devastation—2,500 feet above sea level and 300 miles from the nearest ocean. Tens of trillions of gallons of rain fell, killing more than 200 people, with thousands still unaccounted for. Power outages were so vast that the darkness could be seen from space, and the destruction to water utilities was unprecedented.

The hurricane left much of the region isolated, with roads collapsed, and homes without water, electricity, or cell service. Even now, search crews trudge through knee-deep debris, hoping to find survivors amid the chaos. This "freak event" has ravaged thousands of businesses and households, making Helene the deadliest hurricane to strike the U.S. since Katrina in 2005.

“Some of my fellow Asheville artists lost studios, homes, income, power, water, and more during the hurricane – but we haven’t lost hope, thanks in large part to the generous Pensacola community,” said Kelly Saunders, Trackside Studios artist and Florida Gulf Coast native. “Though the Pensacola beach and the North Carolina mountains may seem a world apart, they are united by the same giving spirit and vibrant arts community. No matter the distance, art and kindness know no boundaries."

AIRPORT RECEIVES $4 MILLION GRANT FROM FEDERAL AVIATION ADMINISTRATION FOR TERMINAL EXPANSION PROJECT

Pensacola International Airport (PNS) is excited to announce the receipt of a $4 million grant from the Federal Aviation Administration (FAA) as part of the Bipartisan Infrastructure Law (BIL) Airport Terminal Program (ATP). This grant marks the first time PNS has been awarded funds through this valuable initiative, which aims to modernize airport terminals nationwide. The grant will play a pivotal role in the ongoing Terminal Expansion and Modernization Program, an effort to meet the increasing demands of the region’s growing air travel market while improving overall passenger experience.

The FAA’s ATP, in its fourth year of a five-year program, awarded a total of $970 million to 128 projects across 125 airports. These investments not only enhance airport infrastructure but also contribute to the creation of high-paying jobs in communities across the country, including Pensacola.

“This grant is a significant milestone for Pensacola International Airport as we continue to meet the demands of our growing passenger base,” said Matt Coughlin, Executive Director of Pensacola International Airport. “The Terminal Expansion and Modernization Program is a major part of our long-term vision for PNS, and the support

from the FAA will allow us to move forward with critical improvements that benefit both our travelers and the community.”

The Terminal Expansion and Modernization Program is set to increase the capacity of PNS, offering a brand-new terminal with 5 gates, enhanced amenities, improved accessibility, a reconfigured and expanded TSA checkpoint, and more. The project will also support the broader economic growth of the region, attracting more business and tourism to Pensacola.

D.C. Reeves, Mayor of Pensacola, echoed the significance of the grant: “We have worked tirelessly, alongside our federal leadership, to improve Pensacola International Airport. This announcement shows us these efforts are paying off. Obviously, it is not the end of our work, but just the beginning as we move a step closer to offering a world-class center of travel for our residents and visitors to Pensacola and the surrounding area.”

ALAQUA ANIMAL REFUGE SEEKS PUBLIC SUPPORT FOR ANIMALS DISPLACED BY HURRICANE MILTON DESPITE NATIONAL ASSISTANCE

Alaqua Animal Refuge is urgently seeking public support to continue providing life-saving care for animals displaced by Hurricane Milton. While national animal welfare organizations have stepped in with emergency grants, food, and bedding, Alaqua remains in critical need of monetary donations, volunteers, fosters, and adopters to sustain the ongoing care for these animals.

As the designated emergency shelter for Hurricane Milton, Alaqua quickly mobilized to meet the needs of displaced animals, even before state supplies could arrive. The refuge sourced kennels, food, and medical supplies from a three-hour radius, ensuring every incoming animal had the shelter and care they needed.

Thanks to the generosity of national and local organizations, Alaqua received emergency grants and supplies. However, the sheer volume of animals—many of them in dire condition—has placed an enormous strain on the refuge’s resources. The animals are currently housed in two large emergency arenas, and many are suffering from severe health conditions, including heartworm disease, malnutrition, untreated injuries, broken bones, and behavioral trauma from the storm.

“We’re incredibly grateful for the national support we’ve received, but the reality is we still need significant help from our community,” said Laurie Hood, Founder and CEO of Alaqua Animal Refuge. “The animals need long-term care, and for that, we need monetary donations, more volunteers to assist with daily care, foster homes, and adopters willing to take in these special animals.”

The City of Pensacola invites the public to the rescheduled grand opening of Bruce Beach to celebrate the completion of the Bruce Beach Revitalization Project and the unveiling of Phase 2. The event will take place at 3 p.m. Friday, Nov. 8 at Bruce Beach, 601 W. Main St., weather permitting.

Limited parking is included in Phase 2 of the project at South Clubbs Street. However, additional parking will be available at Community Maritime Park.

Originally postponed due to a spike in water bacteria levels, the city is moving forward with the park's grand opening as bacteria levels have returned to normal and the "No Swim" advisory lifted.

In late October, the city's Community Redevelopment Agency was awarded the 2024 Roy F. Kenzie Award at the Florida Redevelopment Association Conference in Tampa for Best Capital Project/Infrastructure for a Large City for Phase 1 of the Bruce Beach Revitalization Project.

The Bruce Beach Revitalization Project is part of the Pensacola Waterfront Frame -

work Plan, supporting the city's goal of creating a more connected public waterfront. All residents, stakeholders and community members are invited to join the City of Pensacola, Mayor D.C. Reeves, Pensacola City Council and the City of Pensacola Community Redevelopment Agency to celebrate the grand opening of this historical site and transformational project.

With the completion of the Bruce Beach Revitalization Project, Pensacola residents and visitors can experience a recreational and educational destination that connects to the city's waterfront while honoring the site's history.

The project was designed by the planning and engineering firm HDR, with consistency review from SCAPE and input from the public. The City of Pensacola awarded a contract to Biggs Construction Inc. for the construction of the Bruce Beach Revitalization Project beginning in 2022.

THE ART GALLERY AT UWF PRESENTS ‘DRAW TOGETHER: A LIVING EXHIBITION’

The Art Gallery at the University of West Florida presents “DRAW TOGETHER: A Living Exhibition.” Local artist and UWF alumni, Jarrod Goldman, brings his vision of creating an approachable community-based art space to a gallery setting.

As a living exhibition, the works and curation of the gallery space will continue growing as viewers are invited to participate in the artmaking process. UWF and the surrounding communities can visit TAG, in the Center for Fine and Performing Arts, Building 82, on the Pensacola campus to view and interact with the exhibition. Public workshops, facilitated by Jarrod Goldman and inspired by game-based art activities, will take place in TAG from 5 to 8 p.m. on Oct. 30, Nov. 6 and Nov. 13. DRAW TOGETHER: A Living Exhibition will run Oct. 17 through Nov. 21. The final iteration of the exhibition can be viewed during the closing reception, held in TAG on Nov. 21 from 5 to 7 p.m. TAG at UWF seeks to challenge, stimulate, and engage students and the greater public through direct interaction with modern and contemporary artworks. TAG is open from 10 a.m. to 4 p.m. Monday through Friday during scheduled exhibition dates and observes all UWF closures and holidays. All events are free and open to the public. NOVEMBER EVENTS AT YOUR LIBRARY

Library Closures

All Santa Rosa County Libraries will be closed on Mon., Nov. 11, in observance of Veterans Day, and Thur. – Sat., Nov. 28-30, in observance of Thanksgiving.

The Pace Library will be closed beginning Nov. 1 for remodeling. No programs will take place this month. It will reopen on Dec. 2. More details can be found on our website santarosa.fl.gov/libraries.

Preschool Storytime

Storytime programs are presented for preschool children ages three through five and include stories, finger plays and action rhymes. Caregivers must remain in the library during storytime; however, they cannot accompany children into the programs. Programs start promptly at the assigned times; latecomers are not admitted.

The UF/IFAS Santa Rosa County Extension Service asks community members to donate unopened jars of peanut butter to their office or other participating locations during the month of October. The donations are then given to local food pantries and other partners in the fight against food insecurity.

In 2023, Santa Rosa County collected 1,970 jars/2,485 lbs. of peanut butter!

VOTERS WEIGH PARTY LABELS IN SCHOOL BOARD RACES

When Florida voters went to the polls in 1998, they passed a constitutional amendment that made a series of election-related changes, including requiring nonpartisan races for county school board seats. But 26 years later, voters could change course.

Voters are casting ballots on a proposal, known as Amendment 1, that would require partisan school-board elections starting in 2026.

The Republican-controlled Legislature put the proposal on the Nov. 5 ballot, in part saying including party labels for candidates would increase transparency about schoolboard elections, which often are already battlegrounds for Republicans and Democrats.

“This is not about, at least for me, advancing the cause of one political party over another. But for me it’s about transparency, and I simply believe that we have an obligation to give voters as much information about a candidate as possible, and let them make a decision about vetting a candidate,” Rep. Spencer Roach, a North Fort Myers Republican who sponsored the proposal, said last year as a House panel debated the issue.

But critics argue the proposal is an effort to consolidate power by Republicans, who hold voter-registration edges in 57 of the state’s 67 counties.

In a video posted on Facebook, Rep. Anna Eskamani, D-Orlando, said keeping non-partisan school board races would help reduce “political polarization” in communities.

“I do think that Republicans are trying to change this so that it will be much more difficult for more thoughtful, rational individuals to run for school board in more-red counties,” Eskamani said in the post. “This is designed to make it impossible for them to win.”

The proposed amendment comes after controversies have roiled many school boards in recent years about issues such as mask mandates during the COVID19 pandemic and removing or restricting school library books. Also, Republican Gov.

Ron DeSantis has taken a high-profile role in trying to help elect conservatives to school boards in some parts of the state.

School board races traditionally were partisan, but that changed after 64 percent of voters approved the 1998 constitutional amendment. In addition to requiring nonpartisan school board races, the 1998 amendment included election-related changes such as putting a public campaign financing program in the Constitution.

Lawmakers also have proposed a measure, Amendment 6, on the Nov. 5 ballot that would repeal the public campaign financing program, which makes available state matching money to candidates for governor and Cabinet seats.

Florida’s political landscape and education system have undergone dramatic changes since the 1998 amendment passed. Republican Gov. Jeb Bush was first elected in 1998, with the GOP controlling the governor’s office and both chambers of the Legislature ever since.

As an example of changes in the education system, Bush began a move toward school vouchers that has now become a fullblown voucher program — long a priority of Republicans and anathema to most Democrats and their allies in teachers unions.

Amendment 1 would need approval from 60 percent of voters to pass Tuesday. It has received relatively little attention, overshadowed by fierce political fights about other proposed amendments aimed at allowing recreational use of marijuana and enshrining abortion rights in the Constitution.

The Republican Party of Florida Executive Board approved a resolution in May that included supporting the school-board amendment. But party Chairman Evan Power indicated recently to The News Service of Florida that it is unclear if the measure will pass.

“I think that’s a tough road,” Power said. “I think we see that’s a polarizing issue. And it’s hard to get to 60 percent on something that is kind of polarizing.”

CITIZENS INSURANCE POLICY COUNT DROPS

Amid long-running efforts to shift customers into the private market, the number of homeowners insured by the state’s Citizens Property Insurance Corp. plunged last week.

Citizens posted data online Monday that showed it had 1,035,534 policies as of Friday, down from 1,271,907 policies a week earlier and 1,268,738 policies two weeks earlier.

The drop coincided with nine private insurers having approval to assume up to 410,008 Citizens policies last week as part of what is known as a “depopulation” program. Private insurers also have received approval from regulators to assume as many as 549,307 additional policies before the end of the year through the program.

Those are maximum numbers, with the actual shifts of policies into the private market smaller. But the depopulation program is a key strategy as state leaders try to shrink Citizens, which in recent years became Florida’s largest property insurer because of financial problems in the private market.

As an example of how the process works, Tampa-based HCI Group said its subsidiaries, Homeowners Choice Property & Casualty Insurance Co. and TypTap Insurance Co., assumed a combined total of 42,000 policies last week. The subsidiaries had been approved to assume a combined maximum of 50,000 policies.

The two companies also have been approved to assume as many as 50,000 policies in November, according to the state Office of Insurance Regulation. But an HCI news release last week indicated that it does not play to pick up those policies.

“We successfully navigated a highly competitive Citizens’ depopulation process and exceeded our fourth quarter new business goal through the October assumption alone,” Paresh Patel, HCI’s chairman and chief executive officer, said in a prepared statement. “Our technology, which enables us to select policies that best fit our underwriting and profitability criteria, combined with our strong rate of policyholder adop -

FPL SEEKS APPROVAL TO COLLECT STORM COSTS

Florida Power & Light customers likely will face increased monthly bills in 2025 after the utility Tuesday requested approval to collect nearly $1.2 billion to cover costs of restoring power after hurricanes Debby, Helene and Milton and to replenish a storm reserve fund.

FPL wants to recover an estimated $1.179 billion over a 12-month period starting in January, with much of the cost stemming from Hurricane Milton, which made landfall Oct. 9 as a Category 3 storm in Sarasota County before crossing the state, according to a filing at the Florida Public Service Commission.

The filing said Milton affected electric service for 2 million FPL customers, and the utility used 20,000 workers from as far away as Canada to restore power.

The Public Service Commission would need to approve FPL recovering the money, but utilities have regularly received such approvals in the past. In addition, storm-cost recovery was contemplated in a broader 2021 rate agreement for FPL.

Storm costs are essentially a temporary add-on to customer bills. Utilities typically use as a benchmark residential customers who consume 1,000 kilowatt hours of electricity a month — though actual electricity use varies widely.

FPL also has differing rates based on whether customers are in the utility’s traditional service area or a Northwest Florida area that was part of a purchase of the former Gulf Power.

Under the proposal filed Tuesday, residential customers in the traditional service area who use 1,000 kilowatt hours of electricity would see their monthly bills go from the current $121.19 a month to $133.99 in January, according to FPL. Such customers in the Northwest Florida area would see their bills go from the current $135.38 to $143.45.

"FPL worked relentlessly to quickly restore power to our customers in the after-

math of each of these hurricanes,” FPL President and CEO Armando Pimentel said in a prepared statement Tuesday. “We're mindful that customers pay these restoration costs, which is why we continue to invest in storm hardening and smart grid technology. This avoids many outages, speeds restoration and reduces restoration costs while helping customers bounce back faster, from getting kids back to school to getting Florida's economy back up and running."

In a U.S. Securities and Exchange Commission filing last week, FPL’s parent company, NextEra Energy, outlined that the utility would seek to recover storm costs. But Tuesday’s filing at the Public Service Commission provided detailed information.

The filing estimated FPL costs of about $811.1 million related to Milton, $157.8 million related to Helene and $113.5 million related to Debby. Those costs would be partially offset by a nearly $75.4 million storm reserve that the utility had before Debby.

The utility also wants to collect $150 million to replenish the storm reserve, along with interest-related costs.

Milton slammed FPL customers on both coasts, including in Sarasota County, and spun off damaging tornadoes in other areas. Helene made landfall Sept. 26 in Taylor County, after causing widespread damage in other coastal areas as it moved up the Gulf Coast. Debby also made landfall in Taylor County in early August. Duke Energy Florida and Tampa Electric Co. also had to undertake massive powerrestoration efforts after the hurricanes, making it likely they will seek to recover costs from customers. As of Tuesday morning, they had not filed proposals, according to the Public Service Commission website. FPL this spring finished recovering about $1.3 billion in storm-restoration costs primarily related to hurricanes Ian and Nicole in 2022, according to last week’s Securities & Exchange Commission filing.

tion, allows us to forgo additional assumptions for the balance of the year.”

Citizens reached as many as 1.412 million policies last year before seeing the number reduced because of earlier depopulation rounds. Still, Citizens has dwarfed other insurers. For instance, as of June 30, Citizens had slightly more than 1.2 million policies, while the next-largest insurer, State Farm Florida, had 641,565, according to an Office of Insurance Regulation report.

Pointing to the depopulation efforts, Citizens President and CEO Tim Cerio said last month that the policy count is projected to total 891,184 at the end of the year. Cerio and other officials have said the private market has improved, resulting in carriers looking for policies that they consider good risks.

A potential downside for Citizens customers, however, is that they can see rate increases if their policies are assumed by private insurers. Trying to spur depopulation, lawmakers in 2022 approved a change that required Citizens customers to accept offers of coverage from private insurers if the offers are within 20 percent of the cost of Citizens premiums.

State leaders want to minimize the number of policies in Citizens, at least in part because of financial risks if the state gets hit by a major hurricane or multiple hurricanes. If Citizens wouldn’t have enough money to pay claims, policyholders throughout the state — including possibly non-Citizens policyholders — could have to pay what are known as “assessments” to cover the costs.

Insurers seek approval from the Office of Insurance Regulation to take part in depopulation rounds. Along with TypTap Insurance Co. and Homeowners Choice Property & Casualty, insurers that were approved to assume policies last week were American Integrity Insurance Company of Florida; Slide Insurance Co.; Monarch National Insurance Co.; Southern Oak Insurance Co.; Orion180 Select Insurance Co.; Manatee Insurance Exchange; and Florida Peninsula Insurance Exchange, according to information on the Office of Insurance Regulation website.

In a long-anticipated move, two internetindustry groups Monday filed a constitutional challenge to a new Florida law aimed at keeping children off social-media platforms.

The Computer & Communications Industry Association and NetChoice, whose members include tech giants such as Google and Meta Platforms, said in a federal lawsuit that the law violates First Amendment rights and that parents should make decisions about children’s social-media use.

“While states certainly have a legitimate interest in protecting minors who use such services, restricting the ability of minors (and adults) to access them altogether is not a narrowly tailored means of advancing any such interest,” the 48-page lawsuit said. “In a nation that values the First Amendment, the preferred response is to let parents decide what speech and mediums their minor children may access — including by utilizing the many available tools to monitor their activities on the internet.”

The law (HB 3) was a priority of House Speaker Paul Renner, R-Palm Coast, and became one of the biggest issues of the 2024 legislative session. Industry groups repeatedly signaled they would challenge the constitutionality of the law — with Renner and Attorney General Ashley Moody vowing to defend it.

“You better believe, I am going to fight like hell to uphold this in court,” Moody said in March during an event where Gov. Ron DeSantis signed the bill.

The law, in part, seeks to prevent children under age 16 from opening social-media accounts on some platforms — though it would allow parents to give consent for 14and 15-year-olds to have accounts. Children under 14 could not open accounts.

Renner and other key supporters argued that social-media companies have created addictive platforms that harm children’s mental health and can lead to sexual predators communicating with minors.

Renner said in March the law focuses on addictive features of the platforms and not on social-media content — an approach that he said was designed to withstand a First Amendment challenge. The law is scheduled to take effect Jan. 1.

“You will not find a line in this bill that addresses good speech or bad speech because that would violate the First Amendment. We’ve not addressed that at all,” Renner, an attorney, said. “What we have addressed is the addictive features that are at the heart of why children stay on these platforms for hours and hours on end.”

But Monday’s lawsuit, filed in the federal Northern District of Florida, said similar laws have been blocked by courts in other states. It said Florida “cannot begin to show that its draconian access restrictions are necessary to advance any legitimate interest it may assert.”

“Parents already have a wealth of tools at their disposal to limit what online services their minor children use, what they can do on those services, and how often they can use them,” the lawsuit said. “Florida may wish that more Floridians shared its own views about whether minors should use ‘social media platforms.’ But while the state may take many steps to protect minors from harm, including by persuading parents to take advantage of tools to limit their minor children’s access to ‘social media platforms,’ it may not take matters into its own hands and restrict access itself.”

The law does not name social-media platforms that would be affected. But it includes a definition of such platforms, with criteria related to such things as algorithms, “addictive features” and allowing users to view the content or activities of other users.

The lawsuit repeatedly referred to sites such as YouTube and Facebook — while also saying the law would not apply to services such as Disney+.

“While the law purports to address ‘addictive features,’ it does not restrict access to all mediums that employ similar features to engage their audience,” attorneys for the industry groups wrote. “The law leaves services like Disney+, Hulu, and Roblox uncovered, even though many minors spend hours on those services each day, and even though they employ the same so-called ‘addictive features,’ like personalized algorithms, push notifications, and autoplay. The state’s only evident justification for restricting access to Facebook and YouTube while leaving many other mediums for speech untouched is the state’s apparent belief that the covered websites deliver content the state thinks is particularly harmful.”

If social-media companies violate the law they could face penalties up to $50,000 per violation. The law also would open them to lawsuits filed on behalf of minors.

The lawsuit, which names Moody as a defendant, seeks an injunction to prevent the restrictions from moving forward. It does not challenge a separate part of the law requiring age verification to try to prevent minors under age 18 from having access to online pornographic sites.

The Computer & Communications Industry Association and NetChoice also have been locked in a long-running legal fight with the state over a 2021 law that placed restrictions on large social-media companies. Those restrictions included preventing the platforms from banning political candidates from their sites and requiring companies to publish --- and apply consistently --- standards about issues such as banning users or blocking their content.

A federal district judge and an appeals court blocked much of the 2021 law on First Amendment grounds, but the U.S. Supreme Court this year sent the case back for further consideration.
