GULF COAST TURTLE WATCH IS ON THE JOB!
By Jenny Diamond
Summer is sea turtle nesting season along the Gulf Coast.
From May to October, county, state and national park volunteers patrol the beaches each morning looking for tracks that indicate that a female turtle has come ashore and laid a nest. Each nest is roped off and monitored to ensure that the hatchlings have the best chance of making it to the Gulf. Since turtles stay closer to shore in the summer for nesting and mating purposes, they are also more prone to stranding and being accidentally hooked near piers and shore fishing spots, so in addition to morning nesting patrols, one of the area’s biggest initiatives for turtle safety relates to rescuing these stranded or hooked turtles. Beach residents, locals, and tourists alike share a love for these endangered animals, and a new nonprofit group is working to strengthen the protection already offered to marine turtles.
Gulf Coast Turtle Watch (GCTW) 501(c)(3) nonprofit was established in early 2024 by founders Wendy Hoeflich and Stephenie Allen, both longtime volunteers with Escambia County Marine Resources (a branch of the Escambia County Natural Resources Management Division) for morning nesting patrols. Local government environmental programs and the National Park System are tasked with many different conservation efforts, and various
programs depend on dedicated volunteer effort and work within very tight budget constraints.
GCTW was formed in large part to provide support to the existing programs dedicated to marine turtle conservation and protection. Though the initial focus is on the Pensacola Beach area, there are future plans to connect with other county and national park organizations doing turtle work throughout the Gulf Coast, as the group’s name suggests. This collaboration and connectivity will aid in fundraising efforts, grant writing, community education, etc. Currently, the Board of Directors consists of both Hoeflich and Allen along with Dale Hensley and Christine Brewster.
Though the group is new, Hoeflich notes that beach businesses, especially those surrounding the Pensacola Beach Gulf Pier, and beach residents have been incredibly excited and supportive, and support for the group has grown faster than expected. Pier owner Mike Penzone, his son Devin, pier staff, and the Pensacola Beach Lifeguards have been especially proactive in initiatives and education to help turtles who are hooked near the pier. When a turtle swallows a hook, chances are that the turtle is a “repeat offender;” 60-70 percent of hooked turtles have been hooked before after recognizing the pier as a place to get an easy meal. Additionally, when a turtle washes ashore, it is usually because the turtle has ingested
plastic, hooks, filament, or other materials that have made it difficult for the turtle to eat and swim regularly. Hooked or stranded turtles may be suffering from anemia and will only continue to get sicker. Florida Fish and Wildlife Conservation Commission (FWC) standards indicate that any turtle that is hooked or stranded should receive medical attention, even if it is not suffering from an obvious injury like a boat strike. The closest sea turtle hospital and rehabilitation facility is the Gulfarium’s C.A.R.E. Center (Conserve, Act, Rehabilitate, Educate) located in Destin, and if the C.A.R.E. Center is at capacity, then turtles must be transported to the Gulf World Marine Institute in Panama City Beach.
Currently, permitted volunteers have stepped up to transport turtles in their own vehicles and at their own expense, and transport protocols plus the size of marine turtles often pose difficulties in addition to the sheer number of calls received. “It’s normal for us to receive several calls a week about hooked or stranded turtles, which is actually a good problem to have,” says Hoeflich, “because it means that we’ve built solid relationships with pier staff and fishermen, and they know to call us rather than simply cutting the line, risking further injury to the turtle.” Turtles cannot be transported without cover from sun exposure and dehydration, so pickup trucks are not eligible vehicles. Additionally,
fully grown turtles can be well over 200 pounds and require enough space to ride comfortably in a transport bin, so permitted volunteers with large vans or SUVs are called upon again and again for transport.
Thus, one of GCTW’s immediate initiatives is to raise 20k in order to purchase a large transport van that would remain parked at the pier and to which many trained and permitted volunteers would have access. Currently, the group has raised about 20 percent of that goal, and additional funds would go into wrapping and maintaining the vehicle, insurance, and fuel costs.
GCTW kicked off their fundraising efforts in June with Sea Turtle Sips, a guest bartending and silent auction night at The Islander featuring coastal art donated by local artists and GCTW swag. Future fundraising efforts include working with beach businesses to institute “round up” programs where patrons can choose to round up their purchases to the nearest dollar, and those extra cents would be then donated to GCTW. Though an official website is still in the works, the group’s Facebook page features a donate option and offers magnets, t-shirts, stickers, etc. for sale.
Once enough funding for the transport van has been secured, GCTW plans to focus on furthering lighting initiatives; turtles who come ashore at night to nest are disoriented by artificial lighting, flashlights, and cellphone lights, but they are unaffected by amber
and red lights. Though there is a turtle-safe lighting ordinance in place for all water-facing businesses, hotels, condos and homes, it is difficult to enforce every violation, and public education and awareness goes a long way in helping to ensure ordinance compliance. Small things like keeping blinds and curtains closed at night and using red turtle-safe flashlights on the beach at night can go a long way in eliminating disorienting light exposure for nesting mothers and hatchlings. GCTW plans to work with Escambia County Marine Resources to get informative refrigerator magnets and window clings in all rental units that inform renters and tourists about safe lighting practices and ‘Clean, Dark, Flat’ initiatives that aim to keep the beach free of holes, trash, sandcastles and other obstacles that may deter nesting turtles. If you’d like to learn more about the GCTWand its efforts to support county programs and marine turtle work in our area, you can connect with volunteers every other Tuesday at Bands on the Beach. Escambia County Natural Resources graciously shares its booth space with GCTW, and volunteers are out every other week to answer questions, spread awareness, and even give away red ‘turtle-safe’ flashlights for evening beach walks. You can also visit Gulf Coast Turtle Watch on Facebook to donate and purchase merchandise (send a message to view available merchandise).■

In partnership with the Pensacola Beach Songwriters Festival, the station will facilitate the morning workshop on campus at Pensacola State College and host a group of students who will attend the songwriters’ soundcheck and concert that evening. Nashville songwriters Anne Buckle and Lauren Mascitti will conduct this year’s workshop.
“StudioAmped” presents the original music of regional artists. Bill Harrell is executive producer. More information about the Season 15 artists and free concert series is published at wsre.org/events. Past seasons of “StudioAmped” are streaming at wsre.org and on the PBS app. About The Artists:
Lauren Mascitti (Nashville, Tenn.) is a singer-songwriter who appeared on the 2020 season of ABC’s “American Idol,” and has been writing and performing since age 7. By the time she was a teen, she was performing six shows a week in Branson, Mo., with gospel singer Gary McSpadden, formerly of The Oak Ridge Boys. She has performed on the Grand Ole Opry multiple times and has written and performed with several of country’s top artists. Her album “God Made a Woman” was named to the New York Times and Saving Country Music’s Best of 2020 lists and went to #4 on iTunes in country albums sales.
Jim McCormick (Nashville, Tenn.; New Orleans) is a Grammy and CMA nominated, multi-platinum selling songwriter who has scored three No. 1 songs atop Billboard’s Country Airplay chart: Gabby Barrett’s “The Good Ones,” Jason Aldean’s “Take A Little Ride” and Brantley Gilbert’s “You Don’t Know Her Like I Do.” His songs have also been recorded by Luke Bryan, Harry Connick Jr., Kelly Clarkson, Jon Pardi, Charley Pride, Payton Smith, Trace Adkins, Tim McGraw, Jamey Johnson, Keith Urban, Randy Travis, Trisha Yearwood, Ronnie Milsap, Tyler Farr,
Cody Johnson, Matt Stell, Dalton Dover, James Barker, Shenandoah, Smash Mouth, Samantha Fish and many others.
CJ Solar (Baton Rouge, La.) fuses influences of Southern rock, Delta blues and country into his songwriting. Named a New Artists You Need To Know by Rolling Stone Country, he says the driving force behind his success is neither fame nor fortune, but a diehard infatuation with the music he grew up on in Louisiana. He has opened for major acts including Lynyrd Skynyrd, Hank Williams Jr. and Gary Allan, and he has penned songs for Jason Aldean, Jerrod Niemann, Justin Moore and others, including the No. 1 single “Some Girls” for Jameson Rodgers and Morgan Wallen’s breakout hit “Up Down” featuring Florida Georgia Line.
Bangarang Peter (Pensacola, Fla.) is a rock band and self-described group of “kids” who refuse to grow up. Inspired by the Lost Boys of Never Land, this imaginative show band of seasoned musicians has become known for commanding the stage and mixing with the audience to create memorable music experiences wherever they play.
Civilized Natives (Pensacola, Fla.) was founded in 1994. In 2000, the band was awarded the opportunity to record and release their first CD, “Closing In,” as Pensacola’s SpringFest Discovery Stage Award winner. Fast forward 30 years with founding members Glenn Vignolo and Jeff Gardner; the band is experiencing a revival with new music, new recordings and a robust performance schedule.
Jordan Chase (Pensacola, Fla.) is an R&B, pop and soul singer who developed his love for music as a child in New Orleans, where his father pastored a small church and the unique sounds of jazz and soul moved his heart. He appeared on NBC’s “The Voice” as a high school senior and began touring in 2021 with his first EP at age 21. He has since appeared on ABC’s “American Idol,” performed at major music festivals and opened for national acts LoCash, Ingrid Andress and others.
Johnny Hayes (Mobile, Ala.) is a multigenre artist and singer-songwriter who appeared as a finalist on NBC’s “The Voice” and has since played major music festivals and opened for national acts including JJ Grey & Mofro, Daniel Donato, Spin Doctors and Lukas Nelson & Promise of the Real. His Americana EP “Voodoo Country” was released in 2021 with the song “Rosé and Cigarettes” on Spotify’s popular Acoustic Hits playlist.
Justin Jeansonne (Mobile, Ala.) has a passion for music, kindled after his service in the Marine Corps, and an unwavering love for writing songs that reflect his values. He is making a name for himself on the country music scene while traveling across the U.S. and opening for the Red Clay Strays in Columbus, Ohio, this summer.

AMERICAN MAGIC SECURES VITAL WIN AGAINST ORIENT EXPRESS AFTER CLOSE RACE AGAINST LUNA ROSSA
After claiming their first point of the Louis Vuitton Cup with a win against the British INEOS Britannia syndicate, American Magic was back in action on the third day of the first round-robin stage, facing Italy’s AC36 finalists, Luna Rossa Prada Pirelli.
Race 7: Luna Rossa Prada Pirelli (Port) vs. NYYC American Magic (Starboard)
An issue aboard the U.S. AC75 Patriot forced the team to request a 15-minute delay to the start—a request allowed under the regatta rules. With the problem remedied, Patriot was towed onto its foils with three and a half minutes remaining before the start.
American Magic made a fast entry at the starboard end of the line, crossing behind the Italian boat, which had come in quickly from the left. The Americans held back briefly to avoid the worst of their rivals’ wing wash before gybing and chasing Luna Rossa out to the right of the start box.
Opting for the leeward position, American Magic tacked in front of Luna Rossa to lead back to the line, making a fast start near the pin end. Slightly slower at the gun, Luna Rossa tacked away to the right boundary. When the boats converged, Patriot comfortably crossed ahead on port before tacking in front of the Italians, forcing them to head right again.
The next cross saw a gain for Luna Rossa with just 75 meters between the boats when the U.S. crew cover-tacked once again. At the windward gate, the two AC75s were virtually bow to bow as they converged on each other before making simultaneous tacks to round the two gate marks—with the team leading by three seconds at the port mark, ahead of Italy at the starboard mark.
A close-fought pre-start culminated with NYYC American Magic leading the French boat to leeward of the pin end of the line at the gun before tacking around and building speed on port to dip back behind the line to start fast at the committee boat end. Orient Express followed suit soon after with their committee boat end start, but it was the Americans who controlled the first leg, rounding the windward gate 41 seconds ahead.
Despite this advantage, nothing could be taken for granted in increasingly uncertain conditions that saw the breeze oscillating either side of seven knots and wind holes littering the race area. The Americans looked fast and smooth on the first downwind, but the chasing French made gains to round 28 seconds behind at the first leeward gate. Having rounded the right-hand mark, the U.S. crew struggled for breeze as they tacked away from the right boundary while the French were powered up and closing distance fast on the left.
When the boats came together, there was just 120 meters in it, and the Americans had to execute a hard cover tack on their opponent to stop their charge. However, Orient Express proved hard to shake off, and at the second windward gate, the American lead was just 13 seconds.
Throughout the race, the American crew remained composed, executing clean maneuvers and maintaining their lead despite increasing pressure from Orient Express. A critical moment came when American Magic forced the French team into a race-defining mistake, causing them to drop off the foils and lose valuable time.
In addition to the new look and streamlining of service lines, Landrum is consolidating their office locations in Pensacola to one corporate office downtown. With this change, more services than ever before will be available to job candidates online. Job applicants needing faceto-face assistance can receive these services with Landrum team members through its partnership with CareerSource Escarosa in Pensacola.

The dogfight continued down the following run and the next windward leg, with nothing to choose between the two crews as they traded the lead back and forth, with Luna Rossa taking Patriot’s stern twice on the second upwind leg. Something had to give, and unfortunately, a down-speed tack by NYYC American Magic cost them around 120 meters and handed control to the Italians, who rounded the top gate 20 seconds ahead.
With the two boats appearing so equal in speed terms, American Magic was unable to claw their way back into contention—despite sailing fast and cleanly and doing a good job of getting out of phase with the leaders in the hope of finding some better pressure.
At the finish, Luna Rossa Prada Pirelli won the race by a margin of 24 seconds. It was a hard-fought race for American Magic, who showcased skill and determination but ultimately missed out in a closely fought contest.
Race 10: Orient Express Racing Team (Port) vs. NYYC American Magic (Starboard) In American Magic’s second race of the day, the team faced the French challenger, Orient Express Racing Team, in light and flukey conditions that demanded supreme concentration from the crew to ensure they kept Patriot airborne throughout the six-leg race.
With the French unable to get their boat back airborne, the NYYC American Magic crew romped away unchallenged over the final two legs to take the win and put a wellearned second point of the regatta on the Louis Vuitton Cup scoreboard.
President of Sailing Operations, Terry Hutchinson, said," In these races, you're never out of it. You know, it's swings and roundabouts, and if you come off the foil as the lead boat. There's really not a lot you can do to protect against it other than just continue with your processes on board and continue to execute as efficiently as you possibly can.
Paul Goodison, port helm on ‘Patriot’ spoke about the fine margins at the very elite level of America’s Cup racing saying: “I thought we sailed pretty well today. We got really good starts, and we won both first crosses. In the past when we have won the first cross, we've gone on to win, so we are obviously frustrated that the Italians got round us in a very close race. We have learned that the more consistent we are, the better we are. So, we just have to keep polishing and brushing up around the edges. The Italians sailed a good race, but I don’t think there’s too much in it.”

PENSACOLA EVENING LECTURE
BY SARAH ROBB O’HAGAN
When Sarah Robb O’Hagan began leading the turnaround of the $5 billion global Gatorade business amid a global recession, she was also preparing to give birth to her third child. Largely skipping her maternity leave, the combination of extreme hours and late-night childcare led her to experience an extreme and painful “burnout” that changed her perspective and her approach to work life forever.
Years later — taking on the role of CEO at EXOS, the human performance company, at the start of the global pandemic — she decided that a successful business turnaround while burning people out was not an option. As a result, she partnered with the performance science experts on her team, as well as some of the best organizational psychologists in the world to design and implement a far more sustainable and enjoyable way of getting business results while working under immense pressure. In this talk, Sarah outlines:
• Why high performance and productivity do not have to happen at the expense of human wellbeing — with proprietary research and data to prove the case
• How to balance the load of intense work and pressure, with periods of intentional recovery to optimize the human system for higher performance
• How to design your workplace with simple hacks to improve the wellbeing and performance of your team so that you can attract and retain the best talent
• How to understand the connection between your mind and your body as it
relates to overcoming feelings of intense stress and exhaustion
• The magical force multiplier of getting into “flow state” to drive greater productivity for the team, and fulfillment for individuals Sarah Robb O’Hagan is a high-energy combination of disruptive business leader, fitness fanatic, and cheerleading mom. She's been named among Fast Company’s “Most Creative People in Business.” and Forbes "Most Powerful Women in Sports". She is currently CEO of EXOS the Human Performance company where she is transforming the business through digital solutions. Prior to this she led the reinvention and turnaround of the $5Bn Gatorade business as its global president, before leading the digital transformation of Equinox Fitness Clubs as president. Sarah has also held leadership positions at Nike and Virgin and currently sits on the boards of Jet Blue, and previously Strava. In 2017, her first book was published by Harper CollinsExtremeYou - Step Up. Stand Out. Kick Ass. Repeat. Sarah is a sought-after expert on business innovation, and inspiring human performance and is a passionate advocate for getting young women into sports and physical activity to increase their leadership potential. Sarah is a trustee emeritus of the Women's Sports Foundation, A Henry Crown Fellow of the Aspen Institute, and as a proud "Ameri-Kiwi" is an active member of the KEA World Class New Zealand Network.
Sarah Robb O'Hagan's Pensacola Evening Lecture will be held in dowtown Pensacola at 40 South Alcaniz St. on Thursday, September 19 at 5:30 pm.
Because most cyclists are “self-taught,” each month we offer information about bicycle laws, safety tips, and addressing different bicycling skills that will help keep rides safe and enjoyable. There is no charge for the ride and no registration required. The ride will be about one hour and ten minutes long, at a casual pace. Nobody will be “dropped” or left behind. Children ages 10 to 16 must be accompanied by an adult; no kids under 10 on their own bicycle. Cyclists under 16 must wear a helmet by law; ages 16 and up helmets are recommended but are not required by law. And we will enjoy a ride escort by officers of the Pensacola Police Department.
The Choral Society of Pensacola announces its 2024-2025 season, featuring four major concerts, a Foo Foo Festival event, and a special holiday performance by its treble ensemble. The 100-voice volunteer chorus will be conducted by artistic director Peter Steenblik.
The season opens with Wine and Song , presented by the Choral Society and Aragon Wine Market + Wine Bar on Saturday, October 12, 2024, at 5:30 pm in the Sanders BeachCorrine Jones Community Center. Timed so that patrons can enjoy the sunset over Pensacola Bay through the Center’s wall of windows, the tasting event pairs wines from six countries with choral selections by such composers as Haydn, Brahms, Offenbach, Kodály, and Piazzolla. This event is for adults 21 and older.

COLE EXECUTED IN FSU STUDENT'S MURDER
JIM SAUNDERS NEWS SERVICE OF FLORIDA
More than 30 years after he murdered a Florida State University student who was on a camping trip in the Ocala National Forest, Loran Cole was executed by lethal injection Thursday evening at Florida State Prison.
Cole, 57, was pronounced dead at 6:15 p.m. and became the first inmate executed in Florida this year. He could be seen breathing heavily and briefly trembling after the lethalinjection process started at 6 p.m. but did not move after 6:06 p.m.
Cole did not have any last words, though he looked up and appeared to nod to a witness who was seated in a viewing area.
Gov. Ron DeSantis on July 29 signed a death warrant for Cole, who was convicted of killing FSU student John Edwards, 18, in February 1994.
Edwards went to the national forest to camp with his sister, a student at Eckerd College. Cole and another man, William Paul, joined the brother and sister at their campsite.
After they decided to walk to a pond, Cole knocked Edwards’ sister to the ground and ultimately handcuffed her, according to court records. Paul took the sister up a trail, and Edwards died from a slashed throat and blows to the head that fractured his skull. Edwards’ sister was sexually assaulted and was tied to two trees the next morning before freeing herself. (In most cases, The News Service of Florida does not identify sexual-assault victims by name.)
The Edwards family did not attend the execution. But the victims’ parents, Timothy and Victoria Edwards, released a statement that described the crime as “horrendous” and “senseless” and said it shattered the family.
The parents said their children asked for mercy, but that “Mr. Cole did not extend mercy to our children.” They added that Cole “does not deserve mercy.”
The execution came several hours after the U.S. Supreme Court on Thursday morning refused to take up an appeal by Cole’s attorneys or grant a stay. The Florida Supreme Court also rejected arguments by Cole’s attorneys last week.
Cole awoke at 6 a.m. Thursday and ate a last meal of pizza, ice cream, M&Ms and soda, said Ted Veerman, communications director for the Florida Department of Corrections. Cole had two visitors, including his son.
In their appeal to the U.S. Supreme Court, Cole’s attorneys primarily argued that his case should be sent back to a lower court for an evidentiary hearing about whether the state's lethal-injection procedures would cause "needless pain and suffering" because of Cole's symptoms from Parkinson’s disease.
“Cole now experiences shaking in both of his arms from his neck to his fingertips and in his legs,” a petition to the Supreme Court said. “Cole’s Parkinson’s symptoms
will make it impossible for Florida to safely and humanely carry out his execution because his involuntary body movements will affect the placement of the intravenous lines necessary to carry out an execution by lethal injection.”
But Florida Attorney General Ashley Moody’s office urged justices to reject the argument, in part because Cole has had Parkinson’s symptoms since at least 2017. Cole’s attorneys argued that executing him by lethal injection could violate the constitutional ban on cruel and unusual punishment.
“Cole argues that this (Supreme) Court should stay the execution because it presents constitutional issues which this court should be free of time constraint to properly consider,” lawyers in Moody’s office wrote. “He laments that the court only has several days to consider the issue. However, this supposed conundrum is one created by Cole’s own doing. Cole knew for at least seven years that he was suffering symptoms of Parkinson’s disease but delayed bringing any claim challenging lethal injection as applied to him until his death warrant was signed. Nothing prevented him from doing so.”
As is common, the U.S. Supreme Court did not explain its reasons for turning down the appeal.
Cole could be seen Thursday evening with what appeared to be an intravenous line in his left arm.
In addition to the Parkinson’s disease issue, Cole’s attorneys argued in state courts that the execution should be halted because of abuse he suffered as a teen at the notorious Arthur G. Dozier School for Boys in Marianna. The attorneys said the jury that recommended a death sentence did not know about the abuse he suffered at the state reform school. Also, the attorneys pointed to a law that DeSantis signed this year to compensate some victims of abuse at Dozier, though the law would not apply to Cole.
But Marion County Circuit Judge Robert Hodges and the Florida Supreme Court refused to block the execution.
Cole was the first inmate executed in Florida since October, when Michael Duane Zack was put to death by lethal injection for a 1996 murder in Escambia County.
The state last year also executed James Phillip Barnes in the 1988 murder of a woman in her Melbourne condominium; Duane Owen in the 1984 murder of a Palm Beach County woman; Darryl Barwick in the 1986 murder of a woman in her Panama City apartment; Louis Gaskin in the 1989 murders of a couple in Flagler County; and Donald David Dillbeck in the 1990 murder of a woman during a carjacking in a Tallahassee mall parking lot.
Dillbeck was the first person executed since Gary Ray Bowles was put to death by lethal injection in August 2019 for a 1994 murder in Jacksonville.
FLORIDA LOTTERY SALES DECREASE
JIM TURNER NEWS SERVICE OF FLORIDA
Increased costs for necessities might have helped lead to consumers dialing back purchases of scratch-off lottery tickets, as state economists reported Florida Lottery sales decreased during the past fiscal year.
Economists reported that ticket sales came in at $9.417 billion during the 2023-2024 fiscal year, which ended June 30. That was down from $9.8 billion in the previous fiscal year and was $132.5 million less than anticipated.
The 2023-2024 total marked the fourth consecutive year of ticket sales --- driven by a series of large jackpots in the multi-state Mega Millions and Powerball games --- above $9 billion. But economists project sales to be below $9 billion this fiscal year and during the next two years.
A big part of the decline in 2023-2024 was a 6 percent drop in scratch-off ticket sales.
Saba Igbal, senior economist in Gov. Ron DeSantis’ office, said scratch-off sales tracked the arrival of the COVID-19 pandemic and then inflation.
“It's kind of the story around COVID, the time of COVID, we saw the ticket sales really start to increase. So, people were kind of playing a lot more,” Igbal said during an Aug. 8 meeting of a panel of economists known as the Revenue Estimating Conference. “And then in recent years, we've seen that kind of start to decline a little bit. Especially last year, probably as people now have to spend more on kind of the necessities, as things are kind of more expensive. So, we've seen the ticket sales kind of start to come down to reflect that.”
The numbers are part of a long-range “financial outlook” that will go Friday to the Joint Legis-
COURT REJECTS PREGAME PRAYER LAWSUIT
FLORIDA
SAUNDERS NEWS SERVICE OF
JIM
A federal appeals court Tuesday said the Florida High School Athletic Association did not violate First Amendment rights when it blocked a Tampa Christian school from offering a prayer over a stadium loudspeaker before a 2015 high-school football championship game.
A three-judge panel of the 11th U.S. Circuit Court of Appeals upheld a 2022 ruling by U.S. District Judge Charlene Edwards Honeywell in the lawsuit filed by Cambridge Christian School.
Amid the long-running case, Gov. Ron DeSantis and the Legislature in 2023 approved a law that required allowing high schools to offer “brief opening remarks” — which could include prayers — before championship events. The appeals court said that made moot parts of the lawsuit but that it needed to rule on the First Amendment issues because Cambridge Christian sought “nominal damages.”
The panel, in a 52-page opinion, concluded that announcements over the loudspeaker at the 2015 game were “government speech.” as they were scripted and controlled by the Florida High School Athletic Association. It said blocking a prayer over the public-address system did not violate free-speech rights.
“At the 2015 football finals, the only person who made announcements over the PA system at any point during the game was the PA announcer,” said the opinion, written by Judge Ed Carnes and joined by Judges Gerald Tjoflat and Britt Grant. “His announcements were entirely scripted (except for a halftime announcement about the game’s statistical leaders which, of course, couldn’t be scripted in advance). Every word of that script was put there by an FHSAA employee.”
The court also rejected arguments that the association’s stance violated the right to free exercise of religion.
“Because we conclude that the FHSAA was regulating its own expression when it restricted pregame speech over the PA system at the 2015 football championships, Cambridge Christian’s free exercise claims fail,” the opinion said.
The case stems from the 2015 championship game at Orlando’s Camping World Stadium between Cambridge Christian and Jacksonville’s University Christian School. While the FHSAA, a non-profit governing body for high-school sports, denied the use of the loudspeaker, the teams prayed on the field
before and after the game, Tuesday’s opinion said. Those prayers could not be heard by people in the stands.
Honeywell initially dismissed the case in 2017, but the Atlanta-based appeals court in 2019 overturned the dismissal and sent the case back to Honeywell for further consideration. That led to her 2022 judgment in favor of the association, which prompted another appeal by Cambridge Christian.
As the FHSAA defended its decision in court, the Florida Department of Education filed a brief supporting the school in the appeal. The Republican-controlled Legislature followed last year by approving the law to allow schools to give opening remarks before championship games.
“Such remarks may not be longer than 2 minutes per participating school,” part of the law said. “The athletic association may not control, monitor, or review the content of the opening remarks and may not control the school's choice of speaker.”
While the appeals court ruled Tuesday on the First Amendment issues, it said Cambridge Christian did not have legal standing to pursue other parts of the case, including an injunction to prevent the FHSAA from repeating its 2015 prayer ban.
The court noted, in part, that Cambridge Christian had not returned to the championship game since 2015.
“Hope springs eternal but standing cannot be built on hope,” the opinion said. “With all due respect to the Cambridge Christian Fighting Lancers, there’s nothing to suggest that the team’s participation in a future football state championship is imminent or even likely.”
Also, it said the 2023 state law made issues such as an injunction moot.
“The new law and policy unambiguously allow for brief opening remarks over the PA system at state championship events,” the opinion said. “The only content restriction on those remarks is that they may not be derogatory, rude, or threatening, and they can be no longer than two minutes in length. There are no specific restrictions applicable only to prayer. The law and corresponding policy effectively ‘repeal’ the FHSAA’s earlier prayer restriction, making it clear that the allegedly wrongful conduct — a ban of all pregame prayer over the PA system at a state championship football game — cannot reasonably be expected to recur.”
UNIONS TAKE AIM AT MEMBERSHIP THRESHOLD
JIM SAUNDERS NEWS SERVICE OF FLORIDA
Unions including Florida A&M University professors and St. Lucie County teachers have challenged the constitutionality of changes approved by Gov. Ron DeSantis and the Republican-controlled Legislature that can force public-employee unions to seek recertification.
lative Budget Commission, which is made up of House and Senate members.
The financial outlook will include detailed data and analysis about a variety of state financial issues for the 2025-2026, 2026-2027 and 2027-2028 fiscal years.
Lottery sales are projected to decline to $8.778 billion in the current 2024-2025 fiscal year, which started July 1. Sales are forecast to slowly return to the $9 billion mark by the 2027-2028 fiscal year.
The economists’ report said high jackpots in the Mega Millions and Powerball games are independent events and are treated in making projections as “one-time windfalls.”
Powerball provided the Florida Lottery with $750.9 million in sales during the past fiscal year, driven by a pair of jackpots rolling over the $1 billion mark. During the next five years, Powerball is projected to bring Florida nearly $500 million in sales annually.
Mega Millions accounted for $450 million in sales for Florida in the past fiscal year. The forecast is for the game to bring the state about $300 million annually over the next five years.
The lottery helps fund education programs. While Florida had a drop in ticket sales in 2023-2024, the lottery will send $28.2 million more than projected to what is known as the state Educational Enhancement Trust Fund because of earnings on investments and unclaimed prizes.
About $2.4 billion will go to the trust fund, a fourth consecutive year topping $2 billion, according to the economists. But that is projected to dip to $2.095 billion in the current fiscal year and show little growth over the following five years.
The Florida A&M and St. Lucie County unions, along with the United Faculty of Florida and two educators, filed a lawsuit last week in Leon County circuit court alleging that the changes made in 2023 and this year violate constitutional collective-bargaining rights.
The lawsuit, which names as a defendant the Florida Public Employees Relations Commission, is the latest in a series of legal cases stemming from the controversial changes.
The new lawsuit centers on part of the 2023 law that requires unions to be recertified as bargaining agents if fewer than 60 percent of eligible employees had paid dues. The lawsuit said the requirement was “exacerbated” by this year’s law (SB 1746), which added a 60 percent requirement for employees signing what are known as membership authorization forms.
“That means that, in some cases, (the part of the 2023 law) threatens an employee organization with decertification even though a clear majority of employees in the bargaining unit have paid dues,” the lawsuit said. “In addition, after SB 1746, an employee organization is threatened with decertification unless a 60% super-majority of represented employees have submitted signed, unrevoked membership authorization forms, containing various statements prescribed by defendant PERC (the Public Employees Relations Commission).”
The lawsuit said collective bargaining is a “majoritarian process” and that a 60 percent dues-paying threshold is invalid under the state Constitution.
“Florida has no compelling interest in abridging the collective-bargaining rights of employees and labor organizations based on whether a super-majority of employees in the bargaining unit pay dues,” the lawsuit said.
The changes particularly drew heavy debate during the 2023 legislative session, with union members from throughout the
state converging on the Capitol. Republican lawmakers argued that the changes would increase transparency for union members, but opponents described them as an attempt at “union busting.”
Part of the controversy also has come from lawmakers and DeSantis exempting unions that represent law-enforcement officers and firefighters from the changes. Those unions in recent years have often backed Republican candidates in elections, while teachers unions and other public-employee unions frequently support Democrats.
As an example of other legal challenges to the changes, Chief U.S. District Judge Mark Walker is scheduled to hold a trial in October on part of the law that bars deduction of union dues from workers’ paychecks.
Unions representing public-school and university employees contend in the federal lawsuit that the ban on dues deductions from paychecks violates what is known as the Contracts Clause of the U.S. Constitution. That allegation stems from existing collective bargaining agreements that included agencies deducting union dues from paychecks.
In July, however, Walker rejected a series of other arguments made by the unions.
Under the changes approved by DeSantis and lawmakers, unions that do not meet the 60 percent thresholds have to go through a process that includes holding elections to try to get recertified, according to the Leon County lawsuit.
The lawsuit said the Florida A&M chapter of the United Faculty of Florida in April reported that 56.6 percent of employees in its bargaining unit were dues-paying members, below the threshold. It said the United Faculty of Florida submitted a petition for recertification but that the Public Employees Relations Commission had not scheduled an election as of last week.
The St. Lucie County union, Education Association of St. Lucie, includes three units that did not meet the 60 percent threshold, including a teachers unit where 57 percent of employees were dues-paying members, the lawsuit said. The union has submitted a petition for recertification but an election had not been scheduled as of last week.
