A WONDER OF A WHALE

Swimming some 30 miles offshore from Pensacola, a magnificent animal with 40 feet of streamlined dark gray body rises above the surface and takes a breath before diving hundreds of feet to the bottom in search of food.

It’s a whale, and with fewer than 100 of its kind remaining, it’s one of the rarest and most endangered whales on the planet. It’s the Rice’s whale, and without quick action to protect them, these animals that play a vital role in the health of the Gulf could be lost forever.

Rice’s whales were first formally documented by scientists in 1965. However, for decades they were believed to be a subspecies of the Bryde’s whale, which ranges across temperate regions worldwide.

In 2019, a whale came ashore on the Florida Gulf coast and later died. Scientists took this rare opportunity to engage in more detailed study of the deceased animal, including genetic research, which confirmed that they are a fully distinct species. They were then named the Rice’s whale after longtime researcher Dale Rice, the first scientist to write about the whales in the 1960s. This announcement of the whales as a new species is what first brought them into the larger public eye.

Rice’s whales are found only in the Gulf of Mexico and have been observed off all U.S. Gulf states and Mexico, but they are most common off northwest Florida—the quietest and least industrial part of the Gulf, and the only state without

offshore drilling off its coast. Fishermen and scientists from Florida to Texas report occasional sightings, posting videos and photos to social media to help raise awareness about the whales.

The National Oceanic and Atmospheric Administration (NOAA) lists the greatest threats to the whales as vessel strikes, entanglement in fishing gear, energy exploration, ingestion of marine debris, proposed aquaculture activities, oil spills and noise from industrial activities such as oil drilling and ship traffic. Scientists estimate that the 2010 BP oil disaster caused a 22 percent decline in the whale’s population, and it is believed that their numbers continue to decline.

Research and monitoring have found that a suitable habitat for the whales exists along an offshore dropoff where depths range from about 300 to 1,300 feet, and NOAA plans to formally designate this area in the Gulf as critical habitat for the whales. With that, certain offshore activities will be reviewed for their impact on Rice’s whales, affording them some additional protection.

This has already been done for decades for Gulf coast marine life such as sea turtles and manatees, ensuring they have safe space in which to live while working to minimize impacts to various user groups and economic interests. These protections come from the Endangered Species Act, which enshrines in U.S. law that Americans value the wildlife we share our nation with, and we will not allow species to go extinct due to

our actions. Popular Gulf coast animals like brown pelicans and bald eagles have already recovered and been removed from endangered status due to protections under the Act.

Rice’s whales play a vital role in enhancing the ecology of the Gulf, as they are known to help redistribute nutrients in a way that makes offshore areas more productive for fish such as marlin, tuna and wahoo. When they feed on schooling fish at depth and return to the surface, the whales bring up nutrients that enhance the growth of tiny plankton that form the base of the marine food chain.

Residents of Northwest Florida have picked up the cause of the whales, just as they have for other local wildlife. Last April, the first Gulf Coast Whale Festival was held on Pensacola Beach, with attendees enjoying life-sized inflatable whales, whale art, education and more. Many local artists have made Rice’s whales part of their work,

with paintings, murals, jewelry and other whale designs showing-up at festivals and events.

Boaters are helping out as well, as offshore sailors and fishermen capture photos and videos of the whales (while keeping a safe distance) and report whale sightings to (877) WHALE HELP (877) 942-5343. This helps scientists learn more about the whales and their habits.

Others are engaging with whale education and conservation measures and helping to shift our communities toward energy conservation and solar energy, reducing the need for offshore drilling and the threats it brings to whales. That includes conserving energy both at home and in the workplace, and transitioning to solar energy as the primary energy source. There’s also a growing movement to retrofit communities to make them more walkable and bikeable, giving residents choices in how to get around every day, and in doing so, helping to make

the Gulf of Mexico a cleaner and quieter place for all marine life.

This level of engagement and care shows that humans care about things larger than themselves, whether it’s an endangered species of whale or the larger health of the Gulf ecosystem. There is a compelling sense of awe we feel from large and charismatic animals like whales, sea turtles and dolphins.

Another explanation comes from the famous biologist E.O. Wilson, who grew up along the Gulf Coast and spent part of his boyhood in Pensacola. Wilson coined the term biophilia, describing it as the innate tendency of humans to seek connections with nature. As we connect with Rice’s whales and work for their conservation, we are guided by an affinity for the natural world that is inside each one of us.

PBS will host a free film screening of “Florida Road Trip: Pensacola” at 7 p.m. on Thursday, Oct. 3, in the station’s Jean & Paul Amos Performance Studio at Pensacola State College. In its 10th season, “Florida Road Trip” is an award-winning public television series produced by WUCF in Orlando. Programs explore the history, culture and quirks that make the Sunshine State unique. Emmywinning storyteller Scott Fais contributes his passion for Florida history as the show’s new host.

WSRE invites the public to watch the new Pensacola episode on the big screen in the station’s Amos Studio. “Florida Road Trip” Executive Producer Heather Bailey, WUCF Executive Director Jennifer Cook and local stars of the show will be in attendance for the screening event.

Appearing on the half-hour program, in order of appearance, are Judy Bense, University of West Florida president emeritus; Robert Overton Jr., UWF Historic Trust executive director; Capt. In its 10th season, the “Florida Road Trip” series airs on PBS stations across the state and can be streamed on the PBS app.

An early release of the new season is available on-demand for station members with WSRE PBS Passport. The season’s broadcast and general streaming premiere is Sept. 12 with “Lakeland” being the first of ten episodes. “Pensacola” is the season’s final episode, premiering on Nov. 14.

The new season also visits Winter Park, Clearwater, DeLand, Highlands County, Kennedy Space Center, Oviedo, Tarpon Springs and Winter Garden.

IDYLL HOUNDS BREWING COMPANY CELEBRATES A DECADE IN SOUTH WALTON

Idyll Hounds Brewing Company’s signature event, Houndfest X, will take place Thursday - Saturday, September 26 - 28 with proceeds benefiting Alaqua Animal Refuge.

To kick off the signature event, Idyll Hounds Brewing Company is partnering with Back Beach Barbecue for a VIP dining experience on Thursday, September 26 from 6-9 p.m. at the brewery. Attendees will get an exclusive preview of a few select Houndfest releases and have the opportunity to mix and mingle with brew masters that will be featured during the Saturday’s main event. The five-course meal will feature various proteins, including frog legs, quail, lobster, and venison, prepared by Back Beach Barbecue’s pitmaster, Shane Kirkland. On Saturday, September 28, guests are invited to the brewery, located at 845 Serenoa Road, for the main event from Noon –5 p.m. featuring craft brews poured by an array of regional and local breweries, including Alga Brewing Company, Braided River Brewing Company, Destin Brewery, Folklore Brewing and Meadery, Grayton Beer Company, Odd Pelican Brewing Company, Pirate City Brewing Company, Proof Brewing Company, Strange Colt Brewing Company, Third Planet Brewing, and Wood Foot Brewing Company. Idyll Hounds will be debuting new, packaged beer releases during the event along with various options on draft, including several specialty barrel-aged beers as well as brand-new stouts, sours, and hard seltzers. They will also be serving one off specialty releases of some of their flagship beers. Both VIP and general admission ticket holders will have full access to all breweries and enjoy unlimited samples of the various beers being poured throughout the afternoon.

There will be a plethora of food options for purchase including a whole hog roast from Back Beach Barbecue, a shrimp boil from Buddy’s Seafood, and various fare from Idyll Hound Proper. Non-alcoholic beverages will also be available from Amavida Coffee and Noli South Kombucha.

TAKE ACTION TO HELP MANNA FIGHT HUNGER DURING

SEPTEMBER, HUNGER ACTION MONTH

September is Hunger Action Month, a time dedicated to taking action in the fight against hunger. Manna Food Bank, a local grassroots non-profit organization dedicated to fighting hunger in Escambia and Santa Rosa counties, joins the Hunger Action Month campaign to inspire people to take action and raise awareness of the local hunger crisis. Hunger Action Day was Tuesday, September 10.

Manna fights hunger in Northwest Florida year-round by providing the healthiest food possible at no charge through its Emergency Food Assistance Pantry and 17 food security programs with 25 community partners. These programs and partnerships with a variety of agencies address the hungerrelated needs of some of the most vulnerable people in Escambia and Santa Rosa counties. Every action to fight hunger makes a difference for neighbors in need.

Here are five ways to support Manna and engage in the fight against hunger during Hunger Action Month:

RODNEY PRATT RECEIVES SEPTEMBER 2024 EMPLOYEE OF THE MONTH

The Escambia County Board of County Commissioners is pleased to recognize Rodney Pratt, Master Correctional Officer in Escambia County Corrections’ Court Services Division, as the September 2024 Employee of the Month. Officer Pratt’s selection was recognized at the Sept. 5 BCC meeting.

Officer Pratt, who will celebrate 30 years with Escambia County later this year, began his career with the county on Nov. 7, 1994.

Officer Pratt has been recognized by his team for his in-depth knowledge of the Court Services unit, including medical and inmate transportation, court proceedings, Department of Juvenile Justice hearings, and county vehicle checks. He works with multiple prisons in the state of Florida, ensuring proper documentation and required paperwork are completed for acceptance from Escambia County Corrections into the Department of Corrections. He has built productive relationships with members of the court system and Department of Corrections, leading to quick and efficient operations within the Court Services Division.

“It's an honor to be selected as Escambia County's Corrections Employee of the Month,”

Officer Pratt said. “I want to express my heartfelt thanks for the recognition from my supervisors. It is truly a blessing to know that my efforts have made a positive impact. I also appreciate my coworkers and their support, as we are all one team.”

In addition to his daily tasks, Officer Pratt recently took over additional administrative duties at the jail, maintaining inmate state prison records, scheduling state prison transports, and coordinating and performing inmate prison runs. He eagerly serves as a mentor to junior offices because of his strong work ethic and positive demeanor. Additionally, Officer Pratt honorably served in the Florida National Guard for 20 years.

“Master Correctional Officer Pratt is the type of officer who knows his duties and completes them to the highest standard,” Escambia County Corrections Director Rich Powell said. “His dedication to our profession is second to none and makes him a positive role model to his peers. He is always willing to assist no matter the task. We are proud to celebrate his 30 years of service to Escambia County by recognizing him as the Employee of the Month.”

NINTH ANNUAL BLOODY MARY FESTIVAL SET FOR OCTOBER 12

The Market Shops will host its Ninth Annual Bloody Mary Festival, benefiting Habitat for Humanity - Walton County, on Saturday, October 12. The annual event, powered by Step One Automotive Group, will feature unlimited tastes of South Walton’s most creative and innovative bloody marys, made with Distillery 98’s Half Shell Vodka, served by the area’s best restaurants, bars, and catering companies.

Guests are invited to the coastal shopping center from 11 a.m. to 2 p.m. to sip and sample up to 15 of the area’s most coveted bloody marys, each served in specialty cups provided by Compass Builders of Florida. Participants confirmed to compete for the 2024 title of “Best Bloody Mary” include The Beach House, Big Bad Breakfast, Bitterroot, Chanticleer Eatery, Down Island Gulf Seafood Restaurant, Emeril’s Coastal Italian, Grimaldi’s Pizzeria, The Hilton Sandestin Beach Golf Resort and Spa, Jackacudas, Louis Louis, Mozey’s Mobile Catering, Ovide, The Red Bar, Ruby Slipper Café, Soleil, Sunset Bay Café, and more. There will be a highly coveted first-, second-, and third-place People’s Choice Award chosen by each guest in attendance, with votes tallied by Hill Coleman, CPA. A panel of food critics and local celebrities will judge each bloody mary to select the winners for the most delicious “Judge’s Choice” award and most creative “Best Bloody Accoutrement” award. Awards will be handmade by local artist, Maxine Orange.

For the non-bloody mary aficionado, Idyll Hounds Brewing Company will be pouring a variety of craft brews, along with spiked seltzer by Palm Folly, and waters provided by the BankPlus Hydration Station. Good Clean Wine rosé and sparkling wine will also be served from the Bubbly Bar courtesy of Courtyard by Marriott Sandestin at Grand Boulevard, Residence Inn by Marriott Sandestin at Grand Boulevard, and the Hyatt Place by Marriott Sandestin at Grand Boulevard.

Attendees can sit back and relax in the main lawn lounge area featuring additional seating and cornhole games provided by Vacayzen, as well as various SEC football games live streaming throughout the afternoon on the big screen. Over the past eight years, the annual event has raised over $161,000 for local charities. Money raised during the ninth annual event will benefit Habitat for Humanity –Walton County, a local nonprofit housing organization that works toward building and improving homes in partnership with individuals and families in need of a decent and affordable place to live.

ESCAMBIA COUNTY REACHES SETTLEMENT WITH LONGLEAF AT NO COST TO THE COUNTY

Escambia County has reached a settlement agreement with Longleaf C&D Disposal Facility, Inc. at no cost to the County, saving millions of dollars in potential claimed damages and attorney’s fees.

The settlement agreement, which was reached through successful mediation between both parties, was approved by the Board of County Commissioners at the regular BCC meeting on Thursday, Sept. 5. Longleaf C&D Disposal Facility, Inc. began operating a construction and demolition debris facility on Longleaf Drive with an initial permit issued in 2006 and renewed annually each year until 2014. The settlement agreement includes the following terms:

• Longleaf C&D Disposal Facility, Inc. has agreed to waive any claim for loss of capacity and has waived its right for attorney’s fees under Florida Stat. 70.001.

• The Longleaf facility remains subject to the Florida Department of Environmental Protection permit #0253281-012-SO that has specific requirements that are protective of air and water quality including dust and odor suppression, liner, leachate, and closure requirements.

AMERICAN MAGIC SECURES VICTORY AGAINST ORIENT EXPRESS TO CLINCH SPOT IN SEMIFINALS

The seventh day of racing at the Louis Vuitton Cup – the Challenger Selection Series for the Louis Vuitton 37th America’s Cup – was another two-match day for NYYC American Magic, with the US Challenger taking on the series leader Luna Rossa Prada Pirelli from Italy in the first race of the day, before facing the French Orient Express Racing Team in the day’s third race.

In the first race, American Magic faced the in-form Luna Rossa team in a southerly breeze ranging from six to 11 winds and a running swell. Both teams started evenly, but Luna Rossa gained an early advantage. Despite the Italians' solid upwind performance, American Magic fought back to close the gap at several critical points in the race. A few tactical maneuvers, including a smart starboard advantage, briefly put the American team ahead. In the end, despite the Americans sailing cleanly and smoothly throughout the race, it was the Luna Rossa Prada Pirelli crew that won by a margin of 26 seconds.

However, it was the second race of the day that secured American Magic’s place in the semifinals. Going up against Orient Express Racing, the American team needed a win to guarantee their advancement, and they delivered. Tom Slingsby and Paul Goodison guided the team to a clean start, quickly taking the lead and putting pressure on the French crew. Though a poor gybe briefly handed Orient Express an opportunity, American Magic recovered swiftly and extended their lead to 14 seconds on the downwind leg.

As the race progressed, the challenging conditions — including waves, debris, and variable winds — made for a tough contest. American Magic’s cyclors provided the necessary power to keep the boat at optimal speed while Slingsby and Goodison maintained

composure under pressure. By the final leg, despite a late surge from the French team, American Magic held strong, crossing the line 15 seconds ahead to secure their fourth win in the Challenger Series.

Reflecting on the race, American Magic helmsman Tom Slingsby acknowledged the challenges: “We’re happy with that. We’ve got a lot of work to do if we want to keep progressing, but we’re really happy to get through that one and move into the semis. There’s a lot of debris in the water — we hooked something up on the rudder, but luckily it popped off. That was a risky one.”

Andrew Campbell, also on board for the victory, summed up the tough conditions after the race, saying, “That’s some hard conditions, man.”

The victory is all the more significant in that it earned the team the critical point that guarantees NYYC American Magic a spot in the Louis Vuitton Cup semi-finals.

FLORIDA SEEKS TO KEEP ALIVE GUN SALES LAWSUIT

Attorney General Ashley Moody’s office this week argued that a judge should allow Florida to continue challenging a new federal rule that requires more gun sellers to be licensed and run background checks on buyers, contending the rule causes a financial hit to the state.

Lawyers in Moody’s office filed a 16-page response Monday after the Biden administration last month urged Tampa-based U.S. District Judge Charlene Edwards Honeywell to dismiss the state’s lawsuit. U.S. Department of Justice attorneys say Florida doesn’t have legal standing to challenge the rule.

But in the response, Moody’s office tried to show standing by arguing that the rule would affect sales-tax revenues because of a decrease in purchases of admission tickets to gun shows.

“Florida’s theory is based on a 6 percent sales tax that the state collects on admission to gun shows,” the response said. “It is not speculative or remote to expect a loss in revenue from the challenged rule because the entire point of the challenged rule is to prevent unlicensed gun sales at gun shows, which were previously treated as lawful. In fact, the federal government has characterized gun shows as a ‘critical gap in the background check laws’ that the challenged rule seeks to fill.”

The rule, which the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives finalized in April, is an outgrowth of a 2022 federal law, known as the Bipartisan Safer Communities Act, that made changes to the longstanding background-check system.

In part, the rule changed a definition of being “engaged in the business” as a firearms dealer who needs to be licensed, according to court documents filed by Justice Department attorneys. The revised definition applies to a “person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business to predominantly earn a profit through the repetitive purchase and resale of firearms. The term shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of the person’s personal collection of firearms.”

Florida’s lawsuit contends that the rule violates a federal law known as the Administra-

tive Procedure Act. But to move forward with the case, the state needs to establish standing — essentially that it is being harmed by the rule — and has focused heavily on the possibility of losing tax revenues from gun shows.

In last month’s motion to dismiss the case, Justice Department attorneys argued the state did not “provide a basis for inferring a causal link between the rule and the myriad decisions about whether to attend certain gun shows made by individuals whose conduct in no way implicates the rule.”

“Indeed, there are plenty of reasons why Floridians might elect not to attend a particular gun show — e.g., a general increase in firearms prices, changes in purchasing preferences, poor advertising or show management, bad weather, et cetera,” the motion said. “And Florida’s complaint wholly fails to plausibly establish that the rule was instead the cause of the … decline in gun show attendance that the state alleges.”

Florida also has sought to establish standing by arguing that the rule would require the state to increase resources for the Florida Department of Law Enforcement to conduct background checks. While many states rely on the FBI to conduct background checks, Florida uses the state law-enforcement agency.

In the motion to dismiss the lawsuit, Justice Department attorneys described as “self-inflicted harm” any need for the state to increase resources. The motion said “any harms Florida suffers from conducting background checks result from its voluntary decision to perform services that the federal government is otherwise willing to perform (and does perform for the majority of states) for free.”

Moody’s office, however, pushed back against those arguments in this week’s response.

“That a state has duly enacted plans and policies does not render all injuries interfering with those plans voluntary,” the response said. “To be sure, in some cases, a state’s claimed injuries may be self-inflicted. … Here, by contrast, Florida’s injury is that it must do more background checks and expend more resources as a direct result of ATF’s (the Bureau of Alcohol, Tobacco, Firearms and Explosives’) unlawful rule. It does not claim injury based purely on its decision to conduct background checks but based on defendants’ unlawful decision to increase the burden of doing so.”

DESANTIS SAYS CONDO HELP CAN’T BE ‘PUT OFF’

Gov. Ron DeSantis said Monday that lawmakers should act before the 2025 regular legislative session to address problems facing condominium associations and owners, including soaring costs.

Suggesting no-interest or low-interest loans to help condo owners being hit with large assessments for such things as repairs, DeSantis said lawmakers before the end of this year can tweak laws passed after the 2021 collapse of the Champlain Towers South condominium building in Surfside that killed 98 people.

The 2025 regular session will start March 4. “We do need to do something this year,” DeSantis said during an appearance at the Roberto Alonso Community Center in Miami Lakes. “I don't think this is something that you can just put off until next March or April.”

Lawmakers aren’t expected to return to Tallahassee until after the November election, but DeSantis said they need to talk with constituents and develop ideas that can be implemented quickly.

“Let's just be nimble with this. Let's listen to people,” DeSantis said. “Let's make sure they're able to stay in their home.”

Lawmakers will start holding committee meetings in December in advance of the 2025 session. House committees will meet during the week of Dec. 2 to Dec. 6, while Senate committees will meet during the week of Dec. 9 to Dec. 13. Both chambers will hold meetings during the weeks of Jan. 13 to Jan. 17; Jan. 21 to Jan. 24; Feb. 3 to Feb. 7; Feb. 10 to Feb. 14; and Feb. 17 to Feb. 21.

Lawmakers during a 2022 special session passed a measure aimed at requiring condominium associations to have adequate financial reserves to pay for needed repairs to buildings. Also, the bill set requirements for inspections of condominium buildings that are three stories or higher.

Any “substantial structural deterioration” found by engineers or architects would require more-detailed inspections. Association boards were also required to have “structural integrity reserve” studies to determine how much money should be set aside.

DESANTIS DEFENDS ABORTION INFORMATION

SERVICE OF FLORIDA

With Democrats accusing the state Agency for Health Care Administration of improper politicking, Gov. Ron DeSantis on Monday described as “above board” information that the agency has released in advance of a November referendum on abortion rights.

“You know, we have resources to do public-service announcements across a wide variety of fronts. That goes to the Department of Transportation, for example, on safe driving,” DeSantis said during an appearance in Miami Lakes. “It's being used by the AHCA agency to basically provide people with accurate information. And I think that that's something that's really important, because, quite frankly, a lot of people don't usually get that in the normal (information) bloodstream. So, everything that's put out is factual. It's not electioneering.”

But Democrats and other supporters of a proposed constitutional amendment on abortion rights contend the agency posted biased information online, as DeSantis fights the ballot initiative. The Agency for Health Care Administration also has released a 30-second video public-service announcement.

Democratic leaders argue, in part, that the agency has violated a state law that bars government employees from using their offices or authority to try to influence elections.

“We can have philosophical policy, livedexperience differences of opinion, but state agencies, all 26 of them, are really supposed to be completely agnostic and neutral,” incoming Senate Minority Leader Jason Pizzo, D-Sunny Isles Beach, said Monday. “And I would say that the plain reading of (the state law) speaks to, you know, employees not overreaching on their authority to go ahead and express either personal opinion or basically what amounts to coercion and influence of campaigning against a particular entity or ballot measure referendum. So, I think that's clear overstepping.”

The proposed amendment, which will appear on the ballot as Amendment 4, has touched off perhaps the state’s fiercest political battle this year. In part, the proposal says, no ”law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient's health, as determined by the patient's healthcare provider.”

Also, for example, it takes issue with wording of the amendment, such as the use of the term “healthcare provider,” which it contends “could include a wide range of professionals connected to healthcare which might differ from the current requirement that these important decisions be made only by a physician.”

Such statements echo arguments that opponents of the amendment have made for weeks — and that are refuted by supporters of the amendment.

The agency posted the 30-second video public-service announcement Monday on the social-media platform X. Fine print at the end of the video says, “This message is sponsored by the Agency for Health Care Administration, the Florida Association of Broadcasters and this television station.”

Florida Association of Broadcasters officials Monday afternoon did not immediately respond to an email that included questions about where the public-service announcement might appear on television stations.

“Florida cares about women and families,” an announcer says in the video. “Last year, Florida provided nearly $500 million to support pregnant women and their families. No woman can go to jail for having an abortion. And abortions are available before a child’s heartbeat is detected and in cases or rape or incest and at all points of pregnancy to save the life and health of the mother.”

The video refers viewers to the webpage, floridahealthfinder.com/FloridaCares.

State law about issues such as abortions to save the life and health of women is more nuanced than the video. For instance, one part of law says that in such situations, two physicians must certify in writing that an abortion “is necessary to save the pregnant woman’s life or avert a serious risk of substantial and irreversible physical impairment of a major bodily function of the pregnant woman other than a psychological condition.”

Also, state law allows abortions up to 15 weeks of pregnancy in cases of rape, incest or human trafficking but includes certain requirements.

The law, which was signed by DeSantis, was tweaked in 2023, and the Legislature this year passed a measure that targeted wrongdoing by members of association boards.

In addition to the requirements passed by lawmakers, many condo associations are facing soaring property-insurance costs.

Rep. Tom Fabricio, R-Miami Lakes, called the threat of condo owners being priced out of their homes “probably the most important issue in the state of Florida at this time.”

Fabricio, appearing at Monday’s event with DeSantis, said one problem is many condo boards have overly deferred maintenance and now have to impose “excessive” assessments to meet needed costs and reserves.

Fabricio added that the assessments also create issues for people, including seniors on fixed incomes, who are trying to sell their units.

“Unfortunately, what they're seeing is that it's not that easy to sell, because when you try to sell that unit, and you do your seller's disclosure, you have to disclose these assessments and the repairs that are required,” Fabricio said. “So, that's causing issues with the market throughout. So, it’s causing a problem for these seniors.”

On Aug. 16, Senate President Kathleen Passidomo, R-Naples, ruled out a special legislative session before the November election to address condo issues.

In a memorandum to senators, Passidomo said condo laws can be addressed during committee meetings after the elections and during the 2025 regular session. She pointed to what she described as “misconceptions and inaccuracies” about condo laws passed the past several years.

“In my view, no law is perfect. Sometimes issues arise during implementation, and there is often room for improvement,” Passidomo wrote in the memo. “However, the legislative process best serves Floridians when there is analysis, collaboration, and input from all stakeholders. I believe the upcoming committee weeks and regular session following our post-election reorganization provide the best opportunity for this type of dialogue.”

The political committee Floridians Protecting Freedom began the drive to pass the constitutional amendment after DeSantis and the Republican-controlled Legislature last year passed a law to prevent abortions after six weeks of pregnancy. That law took effect May 1.

JUDGE TO WEIGH PUTTING MEAT LAW ON ICE

A federal judge will hear arguments next month about whether he should block a new Florida law that bars the production and sale of “cultivated meat" in the state.

Chief U.S. District Judge Mark Walker has scheduled a hearing Oct. 7 on a request by the California-based UPSIDE Foods, Inc. for a preliminary injunction against the law, which Gov. Ron DeSantis signed May 1, according to a court docket.

UPSIDE Foods filed a lawsuit last month challenging the constitutionality of the law and requested a preliminary injunction. The lawsuit contends, in part, that a federal poultry-products law preempts Florida from imposing such a ban.

The motion for a preliminary injunction pointed to what is known as the Supremacy Clause of the U.S. Constitution, which generally leads to federal laws trumping conflicting state laws.

“An injunction will not substantially injure others, because it will not compel the state to take any action or obligate any resources, and because the state has no legitimate interest in the continued operation of an unconstitutional law,” the motion said. “An injunction is in the public interest because it will permit UPSIDE to exercise its right to bring innovative products to the interstate market and allow consumers to exercise their freedom to decide for themselves what foods they want to eat.”

The state faces a deadline next week for filing a response to the motion for a prelim -

inary injunction. Cultivated meat, often known as lab-grown meat, is made through a process that includes taking a small number of cultured cells from animals and growing them in controlled settings to make food.

State Agriculture Commissioner Wilton Simpson last month called the lawsuit “ridiculous” and said “lab-grown meat is not proven to be safe enough for consumers.”

“Food security is a matter of national security, and our farmers are the first line of defense,” Simpson, a key supporter of the law, said in a statement. “As Florida’s commissioner of agriculture, I will fight every day to protect a safe, affordable, and abundant food supply. States are the laboratory of democracy, and Florida has the right to not be a corporate guinea pig. Leave the Frankenmeat experiment to California.”

In an Aug. 30 order, Walker wrote that the state can seek information about “the source or origin of the cells plaintiff uses to produce the cultivated chicken products it wishes to sell in Florida” and the company’s “plans to distribute its cultivated-meat product in Florida.”

The Legislature this year approved the ban as part of a broader Department of Agriculture and Consumer Services bill (SB 1084). The law, in part, makes it a seconddegree misdemeanor to sell or manufacture cultivated meat.

The U.S. Food and Drug Administration and the U.S. Department of Agriculture last year approved UPSIDE to manufacture and sell its products.
