Local attorney and mediator David Hiers recently published his new book, 4,000+ Mediations, A Practical Guide for Mediators and Litigators.
Hiers wrote the book to assist litigators and mediators in every aspect of mediation, from choosing a mediator and determining when to mediate to addressing postmediation motions
He explains that although most cases are now settled at mediation many litigators do not know the simple steps they can take to maximize their effectiveness at mediation or how to handle common problems that arise
My goal was to write an easy reading practical guide to mediation for both litigators and mediators, so they could avoid the common pitfalls I was seeing on a daily basis, he said
Throughout the book real life examples of common and not-so-common pitfalls are provided along with various suggestions on how to resolve these issues
For litigators and mediators this book provides invaluable insights from an experienced litigator and now full-time mediator, and is now available on Amazon

NEGLECTED DOG FINDS FOREVER HOME THROUGH ESCAMBIA COUNTY FOSTER PROGRAM
When the Miller family opened their home to a severely neglected dog through Escambia County Animal Welfare’s foster program earlier this year – as they’ve done for many dogs and cats before – they had no idea that this foster dog would end up becoming a permanent part of their family.
The dog, now called Rosario or “Rose” by her new family, arrived at the Escambia County Animal Shelter in April, nearly starved to death, covered with fleas, and afraid.
Rose was especially afraid of humans and withdrew from staff, but the shelter’s veterinary team was able to win her over after a couple of weeks and help her gain 2 pounds. Once she was ready, Animal Welfare put out a call for a foster family to help socialize Rose, show her love, and help her gain some weight so she could ultimately be adopted.
The Miller family stepped up to help, taking Rose into their home to nurture her and shower her with affection.
“It was so sad when she first arrived,” said Ashley Ratz, who regularly fosters animals with her husband, Zack Miller, and their three daughters. “She was probably less than half the size she is now. She had a lot of scars and open wounds on her, she was really timid, and she was so shy. It was like she didn’t know how to be a dog yet. When she first got to go in the yard, that’s when we first saw her excitement.”
Over time, Rose grew more comfortable around the Miller family, becoming especially attached to their three daughters and sleeping next to them every night. Rose also got along well with the family’s two cats and their dog, an Akita named Koda.
Once Rose gained enough weight to be eligible for adoption, the Miller family knew they wouldn’t be able to let her go back to the shelter or even to someone else’s home.
“We just realized we couldn’t put her back in any environment that wasn’t our home,” Ratz said. “She just fits in so well. We all love her, and we couldn’t think of it any other way.”

AMERICAN MAGIC KEEP HOPES ALIVE WITH VICTORY IN RACE 5
On Monday, September 16th, in Barcelona, Spain, NYYC American Magic delivered a crucial win on the third day of the Louis Vuitton Cup Semi-Finals, stunning the Italian Luna Rossa Prada Pirelli and reducing the series deficit to 4-1. Faced with a do-or-die scenario, American Magic needed to win every remaining race to keep their campaign alive, as a loss would have ended their quest for the 37th America's Cup. With their backs firmly against the wall, this victory was a vital step in keeping their hopes alive.
The race was a thriller from the start, with both teams starting evenly and stalking each other closely up the first leg to the windward gate, where Luna Rossa rounded ahead by 17 seconds. With the southerly breeze peaking at around nine knots and a racecourse marked by light wind patches, there was ample opportunity for the chasing American crew to make gains.
Early in the second upwind leg, American Magic found more breeze on the right side of the course to pull level with their opponent at the first cross where Luna Rossa were forced to concede the lead, dipping behind Patriot’s stern and incurring a penalty for cutting it too close. When the boats next converged, the Italians crossed on port but earned a second penalty for doing so illegally.
allowing American Magic to complete the race unchallenged and secure their first point in the Louis Vuitton Cup Semi-Finals.
Speaking afterward, Tom Slingsby, helmsman of NYYC American Magic, summarized the day by saying: "It was a good race. The start was close. The boat felt really good. We have been making some changes, and in those light conditions that were kind of a weak spot for us a week ago, the boat feels as good as it ever has in those conditions. That’s exciting, and we are going to be faster again on Wednesday. I think the hardest win is the first one and now we are off and running. If you look at the four races they have beaten us, it's by a total of 50 seconds over them all – and we just beat them by a lap. So, yes, we are confident.
American Magic’s win today was crucial. They must now win every remaining race to continue their pursuit of the 37th America's Cup, with no room for error in this highstakes competition.

About American Magic:
Ratz said the positive changes she’s seen in Rose have been incredible to watch, and she’s truly become part of their family. Rose even waits by the door every weekday, ready to hop in the car and go pick up the girls from school.
“She’s like a completely different dog,” Ratz said. “She's the sweetest girl. She just has more confidence, and we can actually take her out in public without her getting scared and nervous. She plays with toys now, she plays fetch – she’s amazing. She’s turned into a real dog.”
Even with a full house of two dogs and two cats now, the Miller family is continuing to foster pets through the Escambia County Animal Shelter’s volunteer program, which Ratz said has been a great experience for their family.
“A lot of people I talk to don’t know that you can go to the shelter and just give a dog a freedom for a weekend, they don’t know you can take them out for walks,” Ratz said. “The dogs that are inside the shelter are completely different than when they’re inside your home, and just being able to give an animal some space is so nice. It’s a lot easier than you think it is, and it means so much to them.”
Escambia County Animal Welfare Director John Robinson said families like the Millers are an example of the incredible positive impact volunteering and fostering can make in an animal’s life.
“A little love and attention can change an animal’s life tremendously, and this heartwarming story is a prime example of that,” Robinson said. “We always have a need for volunteers and fosters to help free up shelter space until dogs and cats can find their forever home, and we are so grateful for generous people like the Miller family who step up to help animals in need in our community. I think Rosario’s smile says it all: This foster 'fail' is a true win for everyone involved.”
Escambia County Animal Welfare always welcomes volunteer applications. To fill out an application, visit myescambia.com.

At the second windward gate, it couldn’t have been much closer, with just three seconds separating Luna Rossa’s rounding of the righthand mark from American Magic’s rounding of the left mark. On the second downwind leg, there was nothing to choose between the two boats, but the Americans took the lead as they approached the leeward gate. Despite Luna Rossa’s aggressive move to cut inside and inflict a penalty, which was skillfully avoided by American helmsmen Tom Slingsby and Lucas Calabrese, the maneuver backfired. The Italians forced themselves off their foils,

“I am honored to be bringing this monumental investment into Escambia County and to help alleviate roadway fatalities,” said FLAL TPO Chairman Commissioner Steven Barry. “There have been too many senseless deaths due to roadway crashes, and we are spearheading the effort to help combat this and make our roadways safer for our residents. With this transformational grant and working alongside the Florida Department of Transportation, our ultimate goal is to reduce crashes and save lives in Escambia and Santa Rosa County.”
Emerald Coast Regional Council, in partnership with Escambia County, will use this award to deploy innovative technological improvements and evaluate the safety impact of Intelligent Transportation System (ITS) improvements on two of Pensacola’s highest crash rate segments, Fairfield Drive and Pensacola Boulevard. Signal Four Analytics, a traffic monitoring technology, has pointed to critical issues on these corridors, such as low lighting, bicycle and pedestrian incidents, and left-turn crashes.
Along Fairfield Drive, from Mobile Highway to Texar Drive, nearly 2,000 crashes were reported from January 1, 2019, through December 31, 2023, including five fatal and 39 serious injury cases. Crashes under dark conditions represented approximately 22% of
overall crashes but more than 40% of fatal and serious injury crashes.
Similarly, Pensacola Boulevard, from W Street to Brent Lane, reported more than 550 crashes in that same timeframe, including one fatal and eight serious injury crashes. However, this segment presented different obstacles, specifically for pedestrians.
Emerald Coast Regional Council is one of ten regional planning councils in Florida.
ECRC supports northwest Florida by planning for and coordinating intergovernmental solutions to growth-related problems, providing technical assistance to local governments, and meeting the needs of the municipalities in our seven-county region. The ECRC staffs the Florida-Alabama Transportation Planning Organization, a local, intergovernmental transportation policy board for Escambia and Santa Rosa counties in Florida and Orange Beach and the community of Lillian, Alabama.
"As chair of ECRC, I am thrilled to announce this grant and these dollars coming to Northwest Florida to help save lives,” said Kacey Cuchens, ECRC Board Chair, “Far too many lives have been lost, and it's with great honor that we're doing something to address this serious problem in our region."
Construction is slated to begin in the summer of 2025 and be operational by the following summer.
The Safe Streets and Roads for All program provides grants directly to communities for implementation, planning, and demonstration projects to prevent deaths and serious injuries on the nation’s roadways. Since launching in 2022, SS4A has funded projects in more than 1,400 communities, supporting roadway safety for nearly 75% of the U.S. population. FLORIDA CITES 'CONSEQUENCES' OF WETLANDS RULING
JIM SAUNDERS NEWS SERVICE OF FLORIDA
Florida this week argued a federal appeals court should overturn a ruling about permitting for projects that affect wetlands, contending that “disastrous consequences flow” from the ruling.
Attorneys for the state late Monday filed a 74-page brief at the U.S. Circuit Court of Appeals for the District of Columbia in the battle about a 2020 decision by the U.S. Environmental Protection Agency to shift permitting authority to the state.
Siding with environmental groups that filed a legal challenge, U.S. District Judge Randolph Moss in February vacated the 2020 decision. Moss ruled that actions by the EPA and the U.S. Fish and Wildlife Service in approving the shift violated the federal Endangered Species Act.
The ruling returned the permitting authority to the U.S. Army Corps of Engineers, which had it before the shift. But the state’s brief late Monday, in addition to disputing Moss’ legal conclusions, warned of “disastrous consequences” for permitting under what is known as Section 404 of the federal Clean Water Act.
“The Corps’ resources dedicated to processing permits in Florida do not compare to those Florida has dedicated to its program,” the brief said. “All the while, the staffing and infrastructure set up for Florida’s program — and the regulated community — suffer the consequences of the district court’s ruling, as delays have now pervaded Section 404 permitting in the state.”
The EPA approved the transfer of the permitting authority in December 2020, about a month before former President Donald Trump’s administration ended. The move made Florida only the third state, after Michigan and New Jersey, to receive the authority, which involves dredge-and-fill permits.
The legal organization Earthjustice filed a lawsuit in 2021 against the federal government on behalf of the Center for Biological Diversity, Defenders of Wildlife, the Sierra Club, the Conservancy of Southwest Florida, the Florida Wildlife Federation, Miami Waterkeeper and St. Johns Riverkeeper. The state later intervened to defend the transfer.
Moss’ February ruling focused, in part, on whether the Fish and Wildlife Service properly prepared a biological opinion and what is known as an “incidental take statement” as part of the process of approving the transfer. Incidental takes are situations in which threatened or endangered species could be killed or harmed as a result of what are allowed activities.
Moss said a biological opinion and incidental take statement did not comply with the Endangered Species Act and another law known as the Administrative Procedure Act. He wrote that because the biological opinion and incidental take statement that the Fish and Wildlife Service “issued in this case
were facially and legally flawed, the EPA unreasonably relied on those documents in approving Florida’s assumption application.”
But the state’s brief and a separate brief filed Monday by federal-government attorneys disputed Moss’ conclusions. Among other things, they pointed to a “technical assistance” process that involves the state sending permit applications to the Fish and Wildlife Service for review and potential conditions.
The state’s brief said that in the three years after the permitting shift was approved, “Florida processed thousands of permit applications, issued over 700 individual permits, and denied over 300 applications, all under continuous, permit-by-permit federal oversight. Florida also routinely revised permits and accepted Fish & Wildlife’s proposed mitigation recommendations, consistent with the technical-assistance process.”
Also, the state argued that Moss’ ruling improperly required an “upfront accounting of all species- and site-specific effects and numerical take limits — something Fish & Wildlife determined was scientifically impossible for Section 404 program approval and the unknowable permitting decisions it triggers.”
The federal government’s brief Monday largely agreed with the state’s arguments that Moss’ ruling should be overturned. But it said federal officials conceded that the EPA had erred by failing to consult with another agency, the National Marine Fisheries Service, before approving the permitting shift.
The state disagreed, saying Moss “erred by second-guessing EPA’s findings on marine species.”
The federal-government attorneys said the case should be sent back to Moss — and the Corps of Engineers should continue handling permitting until the issue about the National Marine Fisheries Service is resolved.
“In this circumstance, where plaintiffs’ success on their full complement of claims remains uncertain, but the disruptive consequences of … (permitting) jurisdictional ping-pong are clear, the appropriate course is for the district court’s vacatur of EPA’s assumption to remain in place for the limited duration of district court proceedings on remand,” the federal brief said.
Attorneys for the environmental groups face a Nov. 1 deadline for filing a response to the state and federal briefs.
The state’s efforts to defend the transfer have been backed by groups such as the Florida Chamber of Commerce, Associated Industries of Florida and the Association of Florida Community Developers. In a February court filing, the state said Moss’ ruling could affect permit applications for a wide range of projects, including roads, housing and construction of hospitals and schools.
DESANTIS VOWS STATE PROBE OF ASSASSINATION ATTEMPT
JIM TURNER NEWS SERVICE OF FLORIDA
Gov. Ron DeSantis said Monday the state needs to investigate the apparent attempted assassination of former President Donald Trump this weekend in Palm Beach County, alongside a federal probe.
Without giving specifics, DeSantis said the incident Sunday at Trump International Golf Course in West Palm Beach appears to include multiple violations of state law.
“We also believe that there's a need to make sure that the truth about all this comes out in a way, you know, that's credible,” DeSantis said Monday during an appearance at Lawton Chiles Elementary School in Orlando.
“I mean, I look at the federal government with all due respect to them, you know, those same agencies that are prosecuting Trump in that jurisdiction are now going to be investigating this,” DeSantis added. “I just think that that may not be the best thing for this country. Nevertheless, they have their prerogative, but we have our prerogative.”
Federal prosecutors have accused Trump of trying to interfere with the 2020 election results after he lost to President Joe Biden. He also was charged separately with mishandling classified documents at his Palm Beach home. A federal district judge dismissed the classified-documents case, but the ruling has been appealed.
In Sunday’s incident, Ryan Wesley Routh, 58, is accused of pushing the muzzle of a rifle through fencing at the golf course. He was spotted and fired upon by a U.S. Secret Service agent and was later captured after driving away.
COURT GRAPPLES WITH 'LEGISLATIVE PRIVILEGE'
JIM SAUNDERS NEWS SERVICE OF FLORIDA
In a dispute rooted in a lawsuit about a congressional redistricting plan, an appeals court Tuesday grappled with an attempt by the Florida House and Senate to shield lawmakers from testifying in lawsuits.
Attorneys for current and former House and Senate members ultimately want the issue to get to the Florida Supreme Court and to undo a 2013 Supreme Court decision that allowed legislative testimony in certain circumstances.
The dispute started when current and former lawmakers and staff members faced the possibility of testifying in a lawsuit challenging the 2022 redistricting plan. Their attorneys contended that a concept known as “legislative privilege” shielded them.
But as a three-judge panel of the 1st District Court of Appeal considered the issue Tuesday, it questioned whether the dispute is moot. Votingrights groups that challenged the redistricting plan long ago dropped the idea of taking depositions of the current and former lawmakers, and the underlying challenge to the redistricting plan has moved on to the Supreme Court.
“Big important issues, got it,” Judge Susan Kelsey said as she questioned Andy Bardos, an attorney for House members. “But not this case, maybe. How do you overcome the mootness problem?”
Bardos, however, argued that the dispute is not moot because it involves an “issue of great public importance” that is likely to recur in the future. He said that would allow the appeals court to decide the case even though the redistricting-testimony issue is moot.
“It’s likely to recur. We’ve seen time and time again, both in state and federal court, parties attempting to depose legislators, issuing deposition subpoenas, document subpoenas,” Bardos said.
A coalition of groups, such as the League of Women Voters of Florida and Equal Ground Education Fund, and individual plaintiffs filed a lawsuit in 2022 challenging the constitutionality of the congressional redistricting plan, which Gov. Ron DeSantis pushed through the Legislature. They contended the plan violated a 2010 constitutional amendment, known as the Fair Districts Amendment, that set redistricting standards, including a standard that said plans could not “diminish” the ability of minorities to “elect representatives of their choice.”
The 1st District Court of Appeal in December 2023 upheld the constitutionality of the
redistricting plan, and the Supreme Court heard arguments last week in an appeal by the voting-rights groups.
As part of the underlying lawsuit, the voting-rights groups in 2022 sought depositions from six current and former lawmakers and five current and former staff members. The Legislature fought the depositions, but Circuit Judge J. Lee Marsh in October 2022 said he would allow the lawmakers and staff members to be questioned, with some limits.
Marsh cited the 2013 Supreme Court precedent.
“The appropriate line in this case is where the doors to the House and Senate meet the outside world,” Marsh wrote. “Accordingly, each legislator and legislative staff member may be questioned regarding any matter already part of the public record and information received from anyone not elected to the Legislature, their direct staff members or the staff of the legislative bodies themselves. They may not be questioned as to information internal to each legislative body that is not already public record (e.g., their thoughts or opinions or those of other legislators).”
The appeals-court panel Tuesday took up a House and Senate appeal of that decision. House and Senate attorneys are trying to get a ruling by the appeals court on the legislative privilege issue that can then be taken to the Supreme Court to try to reverse the 2013 decision.
Bardos said lawmakers need to be able to “act and to vote and to speak freely within the legislative process” without apprehension about being faced with depositions.
Judge Brad Thomas raised questions about the “value” of the appeals court issuing an opinion that the Supreme Court decision was wrong, after no depositions were taken in the redistricting case.
“Do you think that is of value to the Supreme Court?” Thomas asked Bardos.
“I don’t think it’s an academic exercise,” Bardos said. “I think the Florida Supreme Court would recognize that this (2013) decision is having an impact currently on the legislative process.”
But Jyoti Jasrasaria, an attorney for the voting-rights groups, said “there’s no disagreement about the state of the law” under the Supreme Court precedent.
“Just because appellants (the current and former lawmakers) don’t like that guidance doesn’t mean that the courts all of a sudden will need new guidance,” she said.
ACC LAUNCHES NEW APPEAL IN FSU FIGHT
JIM SAUNDERS NEWS SERVICE OF FLORIDA
In the latest move in a fierce legal battle, the Atlantic Coast Conference has appealed a Leon County circuit judge’s refusal to dismiss a lawsuit filed by Florida State University against the ACC over issues such as sports media rights.
both FSU and Miami in Florida regarding home game media rights and, incidentally, with the selling of related merchandise,” Cooper wrote. “Put otherwise, the ACC entered into a sports media business in Florida centered on FSU and Miami home games.”
The FBI also is investigating an assassination attempt against Trump in July in Butler, Pa.. Routh was charged in federal court with possessing a firearm despite being a convicted felon and possessing a firearm with an obliterated serial number.
Additional charges are expected as the investigation continues.
Outside the White House on Monday, Biden told reporters that Congress needs to provide more personnel to the Secret Service.
“Thank God the president is OK,” Biden told reporters. “One thing I want to make clear: the service needs more help. And I think Congress should respond to their needs.”
DeSantis first announced a state investigation Sunday night, posting on the socialmedia platform X that, “the people deserve the truth about the would be assassin and how he was able to get within 500 yards of the former president and current GOP nominee.”
In a statement issued Sunday by the Secret Service, Rafael Barros, special agent in charge of the Miami Field Office, thanked “all of our law enforcement partners, including the Palm Beach County Sheriff's Office and the Martin County Sheriff’s Office, for their involvement today.”
“Former President Donald Trump is safe and unharmed following a possible attempted assassination shortly before 2 p.m. Sunday at Trump International Golf Club at West Palm Beach,” Barros said in the statement. “U.S. Secret Service personnel opened fire on a gunman located near the property line. The FBI has assumed its role as the lead agency investigating this matter."
The ACC is challenging at the 1st District Court of Appeal an Aug. 13 order by Circuit Judge John Cooper denying a conference motion to dismiss the case. In seeking dismissal, the ACC contended, in part, that Cooper didn’t have “jurisdiction” over the university’s claims against the North Carolina-based conference.
A notice of appeal, filed last week, does not detail arguments the ACC will make at the Tallahassee-based appeals court.
But in an accompanying motion for a stay of the lawsuit while the appeal plays out, conference attorneys pointed to a separate case that the ACC filed against Florida State in North Carolina over similar issues.
The motion argued that disputes about the media-rights agreements should be resolved in North Carolina and that the ACC is not subject to what is known as a “long-arm” law that would make it subject to Florida courts.
“Indeed, in its 70-plus-year existence, the ACC always has operated under North Carolina law, and the North Carolina contracts that FSU asks this court (Cooper) to construe have existed for years,” the motion for a stay said. “The ACC thus would have no reason to anticipate that if questions ever arose about the proper construction of those contracts, then Florida’s courts — not North Carolina’s courts — would provide the answers.”
In his Aug. 13 order, however, Cooper wrote that FSU “sufficiently alleged several different bases of long-arm jurisdiction.” He said the conference exercises “home-game media rights” for FSU and the University of Miami and uses those media rights for programming on the ACC Network and licensing to the ESPN sports network.
“I find … that the ACC operates and conducts a significant business or business venture with
But in the motion for a stay last week, the conference’s attorneys argued that “games played in Florida are not the basis for the ACC’s revenue generated from the revenue rights that FSU granted” to the conference in agreements.
“Rather, FSU transferred all its media rights to the ACC,” the conference’s attorneys, who include former Florida Supreme Court Justice Alan Lawson, wrote. “The ACC then bundled those rights with those of its other members and sold them to ESPN. This activity — i.e., the bundling, negotiation and execution of these agreements with ESPN — occurred exclusively at the conference’s headquarters in North Carolina, not Florida.”
The notice of appeal was filed after a panel of the 1st District Court of Appeal heard arguments last week in a separate appeal filed by the ACC in June. That appeal is aimed at putting the Leon County lawsuit on hold while the lawsuit that the ACC filed in North Carolina is resolved.
The legal battle is being closely watched in college sports and comes amid major restructuring of conferences. FSU, which is widely believed to be seeking to leave the ACC to move to a more-lucrative conference, essentially contends the ACC has shortchanged its members through television contracts and that the school would face exorbitant financial penalties if it leaves.
FSU filed its lawsuit Dec. 22 in Leon County, a day after the conference filed its case in Mecklenburg County, N.C.
Florida State sought dismissal of the North Carolina lawsuit, but Louis Bledsoe, chief business court judge in Mecklenburg County, rejected the request in April. FSU appealed to the North Carolina Supreme Court, where the issue remains pending, according to the motion for a stay filed last week in the Leon County case.
