A L ABOR OF LOVE IN OLD SEVILLE

I

by Kelly Oden

n a town as rich in history as Pensacola, historic preservation is at the heart of maintaining our cultural authenticity. While older homes and buildings require significantly more maintenance and care, the benefits to the community in terms of preserving history and character are well worth the extra effort. Local law firm Kerrigan, Estess, Rankin, McLeod and Thompson knows the value of such efforts well as they recently invested substantially in the restoration and renovation of their 140-year-old office building across from Seville Square and the results are nothing short of breathtaking. Currently sitting on the corner of East Government Street and Alcaniz Street, the 5,000-square-foot antebellum stunner features a treasure trove of architectural details including a double veranda spanning two floors, carved columns and balustrades, tall double doors to the veranda, Queen Anne-style millwork, broad bay windows and a gabled roof with a short portico. The building also has an interesting history. According to beloved Pensacola historian, the late John Appleyard, Benjamin Overman originally built the home in the 200 block of East Gregory Street. Overman, who hailed from North Carolina, came to Pensacola to join his friend, Ezekial Simpson, in the burgeoning lumber industry. Simpson Mills became a great success, perhaps in no small part due to Overman’s innovative engineering skills. Interestingly enough, Overman also designed a number of significant local structures including the beloved St. Michael’s Catholic Church. In the 1960s, the city began a project to widen East Gregory Street. The Overman house was no longer owned by Benjamin’s descendants and would have been razed, but as luck would have it, a

local architect named Hugh Leitch purchased the property. Leitch had to have the building cut in two in order to move it to its current location at 400 East Government Street in the Seville Historic District. In 1978, Bob Kerrigan and George Estess bought the building to house their young law firm. At that time, Kerrigan did some extensive restoration to the property’s interior woodwork. “All of the window casings and baseboards are the original oak, but all this beautiful wood trim was covered in layers of paint,” said Attorney Mike McLeod, who has been a partner of the firm since the early 80s. “Bob Kerrigan had more than 100 years of paint painstakingly stripped from all of the trim to expose the original oak. We’re very proud of that.” Over the years, McLeod said the building held its own through many storms, including Hurricane Ivan. However, the building suffered substantial damage from Hurricane Sally resulting in the firm’s decision to do a full-renovation. As with most renovations, they encountered a few surprises along the way. “Hurricane Sally was a wake up call,” McLeod said. “We had roof damage and we had water intrusion in some of the exterior walls. We had to move out of the building to repair it, so we decided to do a complete refurbishing. We put a new roof on. We had all the rotten wood from the exterior of the building replaced and painted the original color. A lot of the interior walls had to be removed down to the studs because we had wet insula-

tion. Then, we discovered we had asbestos in two rooms of the building. So, we had to remove the asbestos at a significant expense. We had people in here with HAZMAT suits and they had to use negative pressure respirators. It was an expensive and complicated process for what seems to be just a little bit of removal.”

as far as real genuine old buildings that still look the way they looked when they were built 140 years ago. And now it’s as comfortable as being in a modern building.” One thing that struck McLeod during the renovations was the original window mechanisms. “When we did the renovation we took all of the window molding off to have

We think it’s money well spent. I think the older you get, the more you value older things. And I do think this building is the centerpiece of the historic district as far as real genuine old buildings that still look the way they looked when they were built 140 years ago. And now it’s as comfortable as being in a modern building.” Beyond the structural repairs, the firm also took the opportunity to remove the carpets and refinish the original heart pine floors. All in all, the renovation included a new roof, new insulation, new ductwork, new sheetrock, asbestos removal, floor refinishing, new landscaping, new furnishings, new lighting and the exterior was completely renovated and painted. “We think it’s money well spent,” McLeod said. “I think the older you get, the more you value older things. it cleaned,” he recalled. “Behind that window molding there are these big heavy weights. They’re very big and long and some of them have two weights and they are on these old ropes that create a pulley in order for the original owners to lift them. They’re still on the same old ropes. They’re still functioning.” He also had a chance to see the original structural beams when some of the ceiling was being replaced. “It was interesting to see the old 140 year wood beams. They are so big and just about as hard as steel. They’ve aged and hardened

over 140 years,” he explained. The firm worked with interior designer Joy Hodges to update the furniture and lighting, bringing a contemporary and comfortable feel to the space. They also transformed the third floor space from a dusty old storage room to a sleek, modern employee lounge complete with skylights, television, a coffee bar and a sofa. Over the forty years the firm has occupied the building, they have watched downtown Pensacola grow from the neglect of the 70s and 80s to the booming and lively historic neighborhood of today—and they are thrilled to be a part of it all. “While we do love the building itself, we also love the neighborhood,” McLeod said. “It’s surrounded by good restaurants, so you can walk across the street and have lunch or dinner. It’s right by Seville Park, which hosts a lot of festivals. On Friday and Saturday nights, it’s hopping right around our neighborhood. They have live music at Hub Stacey’s on weekends. People sit and eat outside at Dharma Blue. Over the last couple of years we’ve seen old buildings get refurbished. There’s kind of a new life to the streets. Downtown is a happening place to be. It’s the place to live and work. We’ve had opportunities to move into a bank building over the years, but we just like this location. We like being part of the neighborhood.” 

EMMANUEL SHEPPARD & CONDON ANNOUNCES ADOPTION SERVICES Emmanuel Sheppard & Condon (ESC) is proud to announce the addition of adoption to its roster of legal practice areas. On October 28, 2021, attorney Clay Whittaker joined the firm, bringing with him expertise in adoption and a four-year-old adoption practice, Gulf Coast Adoptions. Clay is a licensed attorney in Florida and Alabama and practices in both state and federal courts. Gulf Coast Adoptions will operate under the umbrella of ESC, and will provide the Gulf Coast area with trusted, knowledgeable adoption services for expectant mothers, birth mothers, and families looking to adopt. “Adoption is a sensitive, yet complex area, and it’s important for those adopting and those considering placing their children for adoption to have a highly trusted source for adoption related legal services,” said Wes Reeder, ESC firm President. “As the firm already provides other important family services such as estate planning, family law, and guardianship law, adoption was a natural fit.” Gulf Coast Adoptions is run by Clay and his wife, Cheryl, who bring their own personal experiences with adoption. Four years ago, Clay was practicing law as a board-certified construction attorney when the couple experienced the adoption process firsthand. They became the proud adoptive parents of their daughter, but they both felt they could have improved the adoption process. “When we adopted our daughter, we didn’t have the transparency and communication we thought should be present and which we now make a primary focus.” said Clay. “We strive to build relationships between the adoptive parents and expecting mother/birth mother to foster trust that we feel is vital not only to the success of the adoption plan but their relationship as they move forward through life. We achieve this by open and frequent communication, honesty in the process and expectations, and by being sincere, listening and not judging.”

Gulf Coast Adoptions sets itself apart with its open communication and every call or text is answered by a seasoned member of the adoption team rather than a call center. “We are available 24/7 to discuss matters with expectant mothers and birth mothers when issues or questions arise or if they simply need a friendly ear. We also communicate with adopting families during and after hours to ensure their questions are fully answered and to remove as much of the uncertainly in the process that is possible.” In addition to handling newborn adoptions, Clay also handles stepparent adoptions, relative adoptions, second parent adoptions, adult adoptions, and identified adoptions. “Families come in all shapes and sizes, and our adoption practices recognizes that. Some of the best phone calls, Cheryl and I receive are from parents who want to ‘make official’ their parental status even though they have been raising a child as their own for a long time. We view family as the single most important thing in life and we are so lucky to be in a position to help others grow their families.” “We’re thrilled to be a part of the ESC team,” said Clay. “Our goal is to provide expectant mothers, birth mothers and potential adoptive parents with peace of mind and the ESC name simply adds to that sense of security.” If you’re an expectant mother considering adoption for your child or are interested in adoption, you can contact Gulf Coast Adoptions 24/7 at 850-999-7977. AIRPORT, CITY AND HYATT HOTEL COLLABORATE ON ANGEL TREE CAMPAIGN FOR LOCAL FAMILIES After a record-setting year for air travel, the team at Pensacola International Airport, City Hall, and the Airport Hyatt Hotel are working together to give back to the community this holiday season. Employees at all three organizations teamed up to help several Pensacola area children in need by purchasing Christmas gifts through the Salvation Army’s Angel Tree program. Between the three organizations, 27 children and their families have been supported. The Angel Tree campaign is a way to give back to the Pensacola community and to help area families who otherwise would have struggled or been unable to provide gifts to their children this holiday season. “With a global pandemic, Hurricane Sally, and the damage to the Pensacola Bay Bridge, the past year has been a real challenge for everyone, including the airport,” Airport Director Matt Coughlin said. “While much of our economy is back, including air travel and tourism, there are still many families in our community who need help.” “We’re glad to be able to give back to these local families and hopefully make their holiday season brighter,” Mayor

Grover Robinson said. I’m grateful for the partnerships between our airport, City Hall, the Airport Hyatt and everyone with the Angel Tree campaign who worked together to make this initiative possible.” The Airport and Hyatt Place have collaborated on projects before, and the Angel Tree effort is just an extension of that relationship. “We’ve always enjoyed a great working relationship with the airport staff, often coordinating with them on special events, community programs, and of course, parking,” said Nikki Williams, Director of Sales. “This Angel Tree effort is another way for us to partner with the airport and the city to brighten up the holidays for some special families in our area.” Through the Angel Tree program, the Salvation Army helps put new clothes and toys under the tree for 1 million children across the United States who usually have to go without Christmas gifts. OMICRON COULD PUT DENT IN INTERNATIONAL TOURISM JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — State economists anticipate the new omicron variant of the coronavirus will slow, at least temporarily, Florida’s resurging pace of tourism — particularly a return of international visitors. Saying the world is entering a time of uncertainty, members of the state Economic Estimating Conference agreed Monday to slightly lower expectations through the middle of 2022 for Canadian and overseas travelers, as the panel looked at various aspects of the Florida economy. “In the near term, I think, yeah, omicron and all that might have some dampening effect,” said Holger Ciupalo, policy coordinator for the governor’s Office of Policy and Budget. Amy Baker, coordinator of the Legislature’s Office of Economic & Demographic Research, said she expects the highly contagious variant will affect people’s decisions to travel to and from Florida. “I think omicron kind of changed the environment,” Baker said. “I know of two people who were planning to travel internationally. They canceled their trips because of omicron, not knowing what additional lockdown restrictions (would be) if they got some place. Would their country be open? What’s happening in the United States? What would be their requirements on them going?” Baker said after the meeting that forecast numbers had not yet been recalculated. The state’s tourism industry exceeded expectations in the third quarter of 2021, drawing 32.6 million visitors, which was 2 million more than forecast earlier this year and 0.3 percent above the overall number of visitors in the third quarter of 2019 --- before the pandemic began. The third-quarter totals followed 31.7 million visitors in the second quarter, which was a 16.3 percent improvement on the first quarter and 2.2 percent below the second quarter of 2019. Almost 90 percent of visitors this year have come from other states. Officials at Visit Florida, the state’s tourismmarketing arm, have been expecting a resurgence in Canadian and overseas visitors after the White House eased travel restrictions in November. However, just as international trips were starting to pick up, the rules of overseas travel have again changed because

HOLIDAY TRAVEL UP AS GAS PRICES DIP NEWS SERVICE OF FLORIDA STAFF Nearly six million Floridians are expected to travel over the next two weeks, an increase of 35 percent over holiday travel last year. That comes as gasoline prices have dropped 12 cents a gallon in the past month. Holiday travel is still expected to be down about 4.5 percent from a record high in 2019, before the COVID-19 pandemic, according to the AAA auto club. Of people traveling this year, more than 91 percent will be driving. AAA spokesman Mark Jenkins said travelers should expect long lines at airports and busy roads this week. “Everybody is trying to accomplish the same goal,” Jenkins said.

SUPREME COURT TO HEAR ‘MARSY’S LAW’ CASE NEWS SERVICE OF FLORIDA STAFF The Florida Supreme Court said Tuesday it will take up a legal battle about whether a 2018 constitutional amendment known as “Marsy’s Law” can shield the identities of police officers. An order issued by the court did not set a date for oral arguments. The voter-approved Marsy’s Law amend-

of the emergency of the omicron variant, which was first detected in southern Africa and has spread around the world, including in the United States. Weeks after pandemic travel restrictions were lifted on more than 30 countries, the Biden administration banned visitors from South Africa, Lesotho, Eswatini, Botswana, Namibia, Malawi, Mozambique and Zimbabwe and implemented stricter testing requirements for inbound travelers, including U.S. citizens. The state economists expressed differences of opinion about whether the international pause will continue for another year or if the testing requirements are just another step in travel. Still, the overall forecast for Florida’s tourism industry remains positive. Vesselka McAlarney, an Office of Economic and Demographic Research economist who was among the more pessimistic regarding the short-term impact on international travel, pointed to Florida’s “welcoming stance in the background of increasing governmentimposed rules regarding COVID and further requirements to travel internationally.” “As we saw under the initial lockdowns, more visitors might have switched to travel to Florida to where they can drive rather than going internationally. So, we may further benefit from that,” McAlarney said. Florida counts on international travelers, who typically spend more time and cash while in the state. In a November news release that touted the third-quarter numbers, Visit Florida President and CEO Dana Young highlighted steps the travel industry is taking to “overcome anything that comes our way.” “Looking ahead, Visit Florida will only be hitting the accelerator as we re-enter the global travel arena and the lucrative winter travel season,” Young said in the release. Canadian tourists on average spend about 16 days in the state. For overseas visitors, the average is 12 days, and domestic tourists spend an average of six days. Economists provided some positives for domestic travelers, including that high gasoline prices should return to lower levels seen in prior forecasts. Also, they said increasing air travel prices should remain below pre-coronavirus levels through next year.

“We all want to get to our destination to spend time with friends and family. It’s the getting there that can sometimes be challenging. So, please, just allow yourselves extra time to get to where you need to go.” Gas prices Sunday averaged $3.23 per gallon for regular unleaded fuel. That was down three cents from last week, but still $1.03 higher than a year ago. Florida’s most expensive gas was in West Palm Beach, while the cheapest fuel was in Fort Walton Beach. “Fortunately, we are getting a little bit of a gift in that gas prices are declining,” Jenkins said. “They are about 12 cents less than what we saw around Thanksgiving, which is great news. We should see gas prices dip a little lower as we head through the holiday season.”

ment included a series of protections for crime victims. The 1st District Court of Appeal in April sided with two Tallahassee police officers who invoked the law to prevent their identities from being released after use-of-force shooting incidents in which they were threatened. The officers argued they were victims in the incidents. The city of Tallahassee appealed and, along with news media organizations, called on the Supreme Court to hear the case.

10 BIG LEGAL ISSUES TO WATCH IN 2022 JIM SAUNDERS NEWS SERVICE OF FLORIDA • TALLAHASSEE — From elections to vaccines, state and federal courts are weighing major Florida lawsuits. Here are 10 big legal issues to watch in 2022: • ELECTIONS: With high-profile elections looming in November, Chief U.S. District Judge Mark Walker is slated to start a trial Jan. 31 in challenges by voting-rights groups to a controversial new elections law. Among other things, the law made it harder for Floridians to cast ballots by mail and added restrictions to drop boxes, where voters can drop off completed ballots. • GUN PURCHASES: The National Rifle Association is asking the 11th U.S. Circuit Court of Appeals to reject a 2018 Florida law that prevents people under age 21 from buying guns. The law, passed after the mass shooting at Parkland’s Marjory Stoneman Douglas High School, was upheld by a federal district judge. The NRA argues the law is unconstitutional. • LOCAL GUN RESTRICTIONS: The Florida Supreme Court has agreed to take up a case challenging a 2011 state law that threatens tough penalties if city and county officials approve gun-related regulations. Local governments began fighting the law after the 2018 mass shooting at Parkland’s Marjory Stoneman Douglas High School. The 1st District Court of Appeal upheld the law. • MARSY’S LAW: More than three years after voters approved a victims’ rights measure known as “Marsy’s Law,” the Florida Supreme Court will consider whether the law can shield the identities of police officers involved in shootings. The 1st District Court of Appeal backed two Tallahassee officers who argued they were entitled to privacy protections because they were threatened in the use-of-force incidents. • PROTEST CRACKDOWN: The 11th U.S. Circuit Court of Appeals is slated in March to hear an appeal by Gov. Ron DeSantis’ administration in a battle about a law aimed at cracking down on protests. DeSantis championed the law after nationwide protests in 2020 focused on racial justice. A federal district judge issued an injunction against the law, which enhances penalties and cre-

JUDGE BACKS TURTLE RESCUE GROUP IN PERMIT FIGHT NEWS SERVICE OF FLORIDA STAFF An administrative law judge said Monday that state wildlife officials improperly denied permits for a non-profit group that patrols Broward County beaches and rescues and releases sea-turtle hatchlings. The Florida Fish and Wildlife Conservation Commission in April denied renewal of three permits for the group Sea Turtle Oversight Protection, Inc., or STOP. The agency approved two other permits for the group. Administrative Law Judge Francine Ffolkes wrote Monday that the commission intended to phase out such programs after local governments approved lighting ordinances. Lights

PROPOSAL WOULD ALLOW GUNS AT LEGISLATIVE MEETINGS NEWS SERVICE OF FLORIDA STAFF A House Republican on Monday filed a proposal that would allow people with concealed-weapons licenses to be armed at state legislative meetings. Rep. Anthony Sabatini, R-Howey-in-

ates new crimes in protests that turn violent. SOCIAL MEDIA: The state wants the 11th U.S. Circuit Court of Appeals to overturn a preliminary injunction against a law targeting social-media giants such as Facebook and Twitter. The law, in part, seeks to prevent platforms from banning political candidates from their sites and requires the companies to publish and consistently apply standards. The online industry challenged the law on First Amendment grounds. SPORTS BETTING: Gov. Ron DeSantis and the Seminole Tribe are looking to a Washington, D.C., federal appeals court to salvage a gambling deal that allowed sports betting in Florida. A district judge said the deal violated a federal Indian gambling law. The deal, approved in a May special legislative session, called for the tribe to control online sports betting in the state. It was challenged by two pari-mutuel facilities. TRANSGENDER STUDENT: In a case that is drawing national attention, the 11th U.S. Circuit Court of Appeals is slated to hear arguments in February about whether a transgender male student should have been allowed to use boys’ bathrooms at a St. Johns County high school. A district judge ruled in favor of student Drew Adams, spurring the St. Johns County School Board to appeal. UF PROFESSORS: Chief U.S. District Judge Mark Walker will hear arguments Jan. 7 in a lawsuit filed against the University of Florida after it blocked political-science professors from testifying against the state in an elections case. Six professors contend that a university policy violates First Amendment rights. UF walked back the decision in the elections case, but the school has faced heavy scrutiny about the policy. VACCINE MANDATES: Attorney General Ashley Moody has gone to the 11th U.S. Circuit Court of Appeals after a district judge refused to block a Biden administration rule requiring health-care workers to be vaccinated against COVID-19.
